HomeMy WebLinkAboutPolicy Appointment of Parkview Villa North Resident as Commissioner to EDACITY OF COLUMBIA HEIGHTS ADMINISTRATIVE POLICY FOR APPOINTMENT OF PARKVIEW VILLA NORTH RESIDENT AS COMMISSIONER TO COLUMBIA HEIGHTS ECONOMIC DEVELOPMENT AUTHORITY (EDA) REVISION: September 2\ 2000 PURPOSE: To establish a policy statement and procedures for the appointment of a Parkview Villa North resident as Commissioner on the Columbia Heights Economic Development Authority (EDA) in order to comply with the U.S. Department of Housing and Urban Development (HUD) requirements for soliciting resident participation on Public Housing Agency (PHA) goveming body boards. All appointments shall be made in accordance with the EDA Bylaws; City enabling resolution 96-01; Minnesota Statutes Chapter 469.095, subd. 2 (c-f); and HUD 24 CFR Part964, Public Housing Agency Organization, Required Resident Membership on Board of Directors or Similar Goveming Body, Final Rule effective November 22, 1999' all as may be amended from time to time. MEMBERSHIP: The Columbia Heights Economic Development Authority Board of Commissioners consists of seven members, at least two, but not more than five of whom shall be Council members. The members are appointed by the Mayor and approved by the City Council, per Resolution 96-01, Section 2.02. PROCEDURE: In order to comply with the HUD published Final Rule governing resident participation on PHA boards, including the EDA, the following procedures shall be implemented. A written notice shall be forwarded by the Executive Director of the EDA to the Parkview Villa North management staff and Resident Council Chairperson not later than October I't (or the preceding business day if said date falls on a weekend or a holiday) of the year preceding the first available or scheduled term expiration for an at-large corrunission appointment. Notice shall also be posted in a prominent and visible location to residents of Parkview Villa North informing them of the opportunity to apply for appointment to the EDA. The notice shall at a minimum state the date and time for which all applications must be submitted to the City Council Secretary of the City of Columbia Heights, the manner in which application forms (see Exhibit A, City of Columbia Heights Application for Appointment to Board or Commission) may be obtained and submitted, and the term for which the vacancy on the EDA exists. A full term on the EDA is six (6) years. All applications must be fully completed, include an original signature of the applicant, and be forwarded to the Mayor or his,4rer designated appointee not later than the close of business on November l't or the subsequent business day immediately thereafter if November I't falls on a weekend or holiday. The Mayor shall review all applications submitted and consider appointment of a resident member to the EDA at his,&er sole discretion and subject to complyurg with the applicable federal, state, and local rules, laws, and ordinances which may apply to said appointment. All applicants must qualify as an "eligible resident" which is a person who meets three criteria as listed below: a) The person must be "directly assisted" by a PHA (Parkview Villa North resident). b) The resident applicants name must appear on the lease. c) The person must be eighteen (18) years ofage or older. The Mayor shall endeavor to consider, but not be limited to, other criteria such as the applicants demonstrated commitment to serve the community, level of education, level of work experience, and ability to communicate with and represent the interests of the Parkview Villa Resident Council, residents, and community at-large. 2. Page 2 of 2 The Mayor shall submit his recommended appointrnent of a resident member to the EDA in writing to the Ciry Manager not later than December l" or the subsequent business day rmmediately thereafter for placement on the next available City Council agenda. The City Council shall consider the Mayor's recommendation of a resident member appointment to the EDA which shall be ratified and approved by a simple majority vote of the City Council; said appointment shall not be later than December 31 of the year preceding the at-large commissioner vacancy. The resident member appointnent on the Columbia Heights EDA shall be made at the next available term expiration for an at-large member appointment to the EDA (non Councilmember appointment to the EDA) or January 8,2002, whichever occurs flust and subject to the resident participation exception. RESIDENT MEMBER EXCEPTION The Columbia Heights EDA qualifies for the "small PHA" exception to the resident participation Final Rule. That is, with less than 300 public housing units, the Columbia Heights EDA is eligible to qualify for the exception to resident participation on the EDA Board of Commissioners. This exception requires the EDA to inform the residents of the opportunity to serve on the Columbia Heights EDA at least once annually if no appointrnent of an eligible resident is made to the EDA (see 24 CFR 964.425 (a) (l) - (4). However, once an appointrnent of an eligible resident is made to the EDA, the annual posting requirement is no longer applicable. Subsequent posting ofnotices of the vacancy should occur only as vacancies for the eligible resident seat may arise at a future time. DEADLINES: I Notice forwarded and posted by October l't of the year preceding a scheduled vacancy for an eligible resident appointment. 2. November I't - Submission of applications by eligible residents. 3. December l"- Mayor submittal to City Manager of recommended appointrnent. 4.
