HomeMy WebLinkAbout2026-044 Approving Alatus TIF Special LawCITY OF COLUMBIA HEIGHTS, MINNESOTA RESOLUTION NO.2026-044 APPROVING LAWS OF MINNESOTA 2026, CHAPTER 128, ARTICLE 6, SECTION 6, RELATING TO THE ALATUS TAX INCREMENT FINANCING DISTRICT BE IT RESOLVED By the City Council of the City of Columbia Heights, Minnesota (the "City"), as follows: Section 1. Background. 1.01. The City and the Columbia Heights Economic Development Authority (the "Authority") previously established the Alatus Tax Increment Financing District (the "TIF District"), a redevelopment district within the Downtown Central Business Redevelopment Project in the City, pursuant to Minnesota Statutes, Sections 469.174 through 469.1794, as amended (the "TIF Act"). 1.02. The Legislature of the State of Minnesota passed a special law with respect to the TIF District, authorizing the extension of the five (5) year period under Section 469.1763, subdivision 3 of the TIF Act, to ten (10) years, and the extension of the period under Section 469.1763, subdivision 4 of the TIF Act, relating to the use of tax increment after the expiration of the five (5) year period to eleven (11) years, all as provided in Laws of Minnesota 2026, Chapter 128, Article 6, Section 6 (the "Special Law"), specifically paragraph (a). 1.03. Paragraph (b) of the Special Law also allows the City or the Authority, notwithstanding Section 469.176, subdivisions 1 b and 1 d of the TIF Act, to elect to extend the duration of the TIF District by five (5) years. 1.04. Pursuant to Minnesota Statutes, Section 645.021, subdivisions 2 and 3, paragraph (a) of the Special Law is effective upon approval by a majority vote of all members of the governing body of the City and the filing of a certificate by the chief clerical officer of the City stating the essential facts necessary to valid approval, including a copy of this resolution, in the form prescribed by the Minnesota Attorney General with the Minnesota Secretary of State. 1.05. Pursuant to Section 469.1782, subdivision 2 of the TIF Act, paragraph (b) of the Special Law is effective upon approval by a majority vote of all members ofthe governing bodies of the City, Anoka County, Minnesota (the "County"), and Independent School District No. 13 (Columbia Heights Public Schools), Anoka County, Minnesota (the "School District"), and the filing of a certificate by the chief clerical officer of the City stating the essential facts necessary to valid approval, including a copy of each of the resolutions of approval by the City, the County, and the School District, in the form prescribed by the Minnesota Attorney General with the Minnesota Secretary of State. 1.06. The City Council has determined that it is in the best interest of the City and its residents to approve the Special Law. Section 2. Approval of Special Law. 2.01. The Special Law is approved. 4910-1435-0703.2 2.02. The City Clerk, as the chief clerical officer of the City, is hereby authorized and directed to file the certificate stating the essential facts necessary to valid approval, in the form attached to this resolution, and a copy of this resolution, as approved, and a copy of each of the resolutions of approval by the County and the School District with the Minnesota Secretary of State as required by Minnesota Statutes, Section 645.021, subdivision 3, and Section 469.1782, subdivision 2 of the TIF Act. 2.03. City staff are authorized and directed to take any additional action necessary to implement the Special Law. 2.04. This resolution shall be in full force and effect following its approval.
