The purpose of this ordinance is to update several provisions of the City Code related to liquor licensing and occupancy posting timelines. The ordinance formally codifies the On -Sale Malt Liquor License, which the City has historically is- sued but had not previously been included in the Code, and allows restaurants, hotels, and theaters (live performance or movie) to ob- tain this license if at least 30% of gross receipts are derived from the sale of food or non-alcoholic bever- ages. It also allows theaters to ob- tain an On -Sale Intoxicating Liquor License if at least 40% of gross receipts are from food or non-alco- holic beverage sales and reduces the required food and non-alcohol- ic beverage sales threshold for all establishments from 55% to 40%. In addition, the ordinance permits theaters to obtain an On -Sale Wine License if at least 30% of gross receipts are derived from food or non-alcoholic beverage sales. Fi- nally, the ordinance extends the maximum period for tenants to va- cate a property posted as unlawful to occupy from 45 days to 90 days. This is a summary of Ordinance No. 1726.
