HomeMy WebLinkAbout2024-4223CITY OF COLUMBIA HEIGHTS AND INDEPENDENT SCHOOL DISTRICT 13 JOINT PO\üERS AGREEMENT (PURCHASE OF SERVICES AGREEMENT FOR VOLLEYBALL PROGRAM) THIS AGREEMENT initially made and entered into the _ day of December,2}24by and between the City of Columbia Heights, Minnesota (hereinafter referred to as the City) and Independent School District 13 (hereinafter referred to as the School District or ISD). The City and School District will hereinafter be collectively referred to as the parties. PRELIMINARY STATEMENTS The parties hereto are each governmental units as that term is defined in Minn. Stat. Sec. 47 1.59, Subdivision 1 (b). The Columbia Heights Police Department (hereinafter the Police Department) has partnered with the School District to conduct a mentoring program with the Columbia Heights High School (CHHS) Basketball team for a number of years. The program has been successful in helping to build positive relationships with the students and the police department. In addition, the parties have determined that engaging youth in quality mentoring programs with positive role models can help reduce criminal activity. As part of Police Department otrtreach to the multi-cultural community, the City has learned of a high level of interest in volleyball among local youths - particularly among the most recent influx of citizens. ISD currently does not have a volleyball program, and the district does not have available budget funds to start a program. This represents a unique opportunity for the parties to build positive relations with the students, particularly those who are relatively new to the City, and the Police Department. This partnership between the parties will include an active mentorship program with the Police Department members and the student athletes in a positive and supporting environment. The mentorship program is designed to help increase life skills including additional help with homework, leadership, conflict management, career opportunities, academic skills, and post-high school success. The program will include guest speakers and provide students and parents an opportunity to get to know police department officers and build positive relationships. The student athletes will have an added layer of support through the Police Department and the potential to break down barriers with one another. 1n2023, the City received one-time Public Safety Aid Funding from the State of MN. Among the authorized uses of this funding are Community Violence Prevention and Intervention Programs and Community Engagement. The City has determined that using a portion of these funds to partner with the school district to help start up a high school volleyball program will serve as a benefit to the community as a body and which, at the same time, is directly related to the functions of government as it relates to public safety and education. Based upon these preliminary statements, the parties agree as follows: CONTRACT #2024-4223 1. The City agrees to purchase the following services from ISD in order to carry out its public purpose as noted above. Specifically: The program will include staff from the Police Department, students, administration, coaches, and school staff. Each police officer will be assigned mentees from the volleyball program. a The staff will schedule one day to meet, talk, and eat with their mentee bi-weekly on school grounds. The staff will show continued support throughout the program by attending volleyball games and support in other areas needed such as academic and social activities. Each meeting will begin with time for homework completion/help. 2. The City will pay twenty-six thousand eight hundred seventy-eight dollars ($26,878) to the ISD. This amount will be deposited by ISD in a separate account to be used for purposes of this Joint Powers Agreement. 3. The services purchased by the amount notid in Paragraph 2 will include the following (with estimated costs): : a a Equipment Transportation Officials/Game Vy'orkers Uniforms Coach Stipends s 2,500.00 $ 5,178.00 $ 3,000.00 $ 6,000.00 $ 10,200.00 4. ISD agrees to provide the City with reasonably requested invoices and other information as may be required by the City related to how the ISD is expending the funds noted in Paragraph2. 5. Any amounts unused by December 31, 2025 will be rolled over into continued operation of the program for the following year unless the Joint Powers Agreement is discontinued. In the event that the Joint Powers Agreement is discontinued as outlined in Paragraph 9, all remaining amounts, after payment of all pending obligations upon the effective date of the termination, will be returned to the City. 6. In all of the activities within the scope of this Agreement, the City and ISD shall be deemed to be exercising their governmental functions, and neither shall be liable to the other for any negligence of the officers, employees, or representatives of the other. 7. This agreement may be amended upon recommendation of the parties. 8. Either party is authorized to accept donations for this program. 2 9. This Agreement will become effective upon approval by the latest approving party and will remain in effect until discontinued and the Joint Powers Agreement is dissolved by either the City or the ISD upon notice in writing no less than six months in advance of the desired dissolution date.
