authorize the technology updates at the Public Safety Building and approving the purchase
of equipment and services through Bluum Technology.
8. Authorization to Purchase and Outfit Police Vehicles.
MOTION: Move to authorize the purchase of four 2024 Ford SUV patrol vehicles and one
2024 Chevrolet Traverse to be used as an unmarked squad car; all vehicles to be purchased
under the State of MN Cooperative Purchasing Venture (CPV) at a total cost of $212,477.
MOTION: Move to authorize an expenditure of up to $167,547 to set up and outfit the
police vehicles to be purchased, in addition to the two Dodge Chargers that were
purchased in December 2023.
9. Authorize Sergeant Jackie Urbaniak’s attendance at Northwestern School of Police Staff
and Command.
MOTION: Move to authorize the attendance of Sergeant Jackie Urbaniak at the
Northwestern School of Police Staff and Command being held in the City of Eagan from
September 23 through December 6, 2024.

10. Authorize the Acquisition of Miscellaneous Equipment for the New Aerial Apparatus.
MOTION: Authorize the fire department to purchase loose equipment for the new Aerial
with 2024 Capital funds, not to exceed the budgeted amount of $74,000.
11. Rental Occupancy Licenses for Approval.
MOTION: Move to approve the items listed for rental housing license applications for
January 22, 2024, in that they have met the requirements of the Property Maintenance
Code.
12. License Agenda.
MOTION: Move to approve the items as listed on the business license agenda for January
22nd 2024, as presented.
13. Review of Bills.
MOTION: Move that in accordance with Minnesota Statute 412.271, subd. 8 the City
Council has reviewed the enclosed list to claims paid by check and by electronic funds
transfer in the amount of $950,751.96.

14. Consideration of Resolution 2024-07, Declaration of a Public Nuisance in the City of
Columbia Heights is Requested Against the Property at 4411 3rd Street NE for Failure to
Meet the Requirements of the Residential Maintenance Codes.
MOTION: Move to close the public hearing and waive the reading of Resolution 2024-07,
there being ample copies available to the public.
MOTION: Move to adopt Resolution 2024-07, being a Resolution of the City Council of the
city of Columbia Heights approving declaration of a public nuisance, pursuant to City Code,
of the property listed.
ITEMS FOR CONSIDERATION
15. Approve Joint Powers Agreement with MN Bureau of Criminal Apprehension for
Columbia Heights’ Participation in Violent Crime Reduction Unit
MOTION: Motion to Authority the Mayor, Interim City Manager, and Police Chief to enter
into a Joint Powers Agreement with the Minnesota Bureau of Criminal Apprehension to
participate in its Violent Crime Reduction Unit.

16. Consideration of a Rental License Exemption for 4411 6th Street NE.
MOTION: Move to waive the reading of Resolution 2024-10, there being ample copies
available to the public.
MOTION: Move to adopt Resolution 2024-10, a resolution approving the single-family
rental exemption request for the rental application at 4411 6th Street NE, Columbia
Heights, MN 55421.

COMMUNITY FORUM
The Community Forum is the public’s opportunity to address the Council regarding any matter that has
not had a public hearing earlier in the meeting.
Speakers that are in-person are asked to complete a Speaker Form and submit it to the City Clerk.
Once called to the podium, the speaker should state their name and connection to Columbia
Heights.
Speakers attending virtually should send a request to speak as well as their address and connection
to Columbia Heights to the moderator using the chat function and wait to be called on to speak.

MINUTES
The following are the minutes for the Work Session Meeting of the City Council held at 6:00 pm on
Monday, January 2, 2024, in the Shared Vision Room, City Hall, 3989 Central Avenue NE, Columbia
Heights, Minnesota.
CALL TO ORDER/ROLL CALL
The meeting was called to order at 6:05pm.
Present: Mayor Márquez Simula; Councilmember Buesgens; Councilmember Jacobs; Councilmember
James (electronically via Teams), Councilmember Spriggs
Also Present: Andrew Bouche, City Planner; Aaron Chirpich, Assistant City Manager / Community
Development Director; Jesse Hauf, IT Director; Kevin Hansen, Interim City Manager; Sara Ion, City
Clerk; Charlie Thompson, Fire Chief.
WORK SESSION ITEMS
1. Authorize Purchase of Phoenix G-2 Alerting System.
Chief Thompson gave a brief overview of the Pheonix G-2 Alerting System and all the
positive impacts that it will have on the Fire Department Team vs. the now outdated pager
system that is currently in use.
The Council agreed to move forward with the purchase of the new system and asked that it
be added as an item “to be considered” on the next council meeting agenda so that the
positive impacts could be shared with the community.
2. Xcel Energy Partners in Energy
City Planner Bouche led the presentation of the positive impacts that Xcel Partners in
Energy Program would have on the City of Columbia Heights if it was approved and
implemented. Bouche gave a brief overview of the requirements of the program and
showcased the process that the City of Coon Rapids used to implement the program.
The Council agreed to move forward with the Partners in Energy program and asked that it
be added as an item “to be considered” on the next council meeting agenda so that the
positive impacts could be shared with the community.
3. IT Department Update
IT Director Jesse Hauf led a presentation on the recently completed updates and future
planned updates for the IT Department and the City as a whole. Hauf gave information on
the status of the Sciens Strategic Technology Plan that was approved by the Council and all

the recent updates that have occurred.
Additionally, Hauf updated the Council on Comcast franchise agreement extension (he
noted that cable subscribers are down significantly), he is anticipating that the extension
will be finalized soon.
Hauf also updated the Council on the availability of USI Internet in the community in the
coming years.
4. Lobbyist: Eyes on Session.
Interim City Manager Hansen gave an update on the current status of what the Lobbyist
hired to assist the City is working on and future potential projects including: MSC building
bonding, City Hall sales tax refund and future potential for park bonding and what the
application process would look like.
Hansen asked the Council what items would need to be clarified or lobbied for in the
legislature that we could use the assistance of our lobbyist for.
Councilmember James mentioned she would support public building firearms restrictions
that the League of MN Cities Lobbyist supports. Additionally she would support lobbying
for the State to take over the Massage Therapist Licensing and additional clarification of
the SRO (School Resource Officer) position.
Councilmember Buesgens inquired about the timeline for getting bonding for Murzyn Hall.
Hansen stated that the City can not support the share of the bonding for Murzyn Hall until
after the completion of the Public Works building.
5. Designation of Legal Newspaper for 2024.
Interim City Manager Hansen led a brief presentation of the requirements for the Council
to select a legal newspaper for 2024. He highlighted that our current legal newspaper
allows for reasonable publishing costs, and he would suggest continuing on with that.
The council agreed to continue utilizing “Life Newspaper” as the official legal newspaper
for 2024 and to have the item placed on the consent agenda for approval.
6. Council Liaison Board and Commission Appointments for 2024.
Mayor Márquez Simula stated that she would like to continue with the appointments that
were established in 2023.
The Council agreed to continue with the Board and Commission Appointments that were
established in 2023 for the year 2024.
7. Select Date for 2024 Local Board of Appeal & Equalization Meeting.
Interim City Manager Hansen introduced the potential dates proposed for the LBAE

meeting to precede the regularly scheduled City Council meetings on April 8th and 22nd at
5:00pm.
The Council agreed to proceed with the proposed dates in April at 5pm prior to the
scheduled Council Meetings. There was concern about training that can be completed, and
City Clerk Ion will follow up with the County to see when the training link has been
refreshed for 2024.
8. Council Corner.
Councilmember James would like to see opportunities to support renters in the
community. She would like this item to be discussed at an upcoming work session so that
Staff can research what the Council is interested in.
Mayor Márquez Simula voiced her concerns with the parking area at City Hall. She was
concerned that one of the EV (Electric Vehicle) Chargers was not working and that there
was some garbage in the area. She stated that “she did not want items to come across as
piddly”. Additionally, she stated that there should be signs stating that specific parking
spots are for EV Charging only. Additionally, she also voiced concerns that workers are
parking too close to the doors.
City Manager Hansen clarified that all the Electric Vehicles are working, and that he has
used each one of them. He has concerns that designating the EV parking spots as such may
lead to concerns for general parking when there are larger meetings. Hansen also clarified
that there are some City vehicles that could be relocated, and this will occur once a deep
cleaning of the garage can occur, further clarifying that there is a machine to clean the
garage floor at public works and they will complete the cleaning at City Hall.
Mayor Márquez Simula would like to have a “Old Business” section added to the Work
Session Agenda. This way she could keep track of items like having the parking garage
cleaned.
Councilmember Jacobs would like to have residents’ issues addressed during the City
Manager Update section. She does not feel that this needs to be during every meeting.
Hansen stated that he would make sure these items are addressed in the City Manager
update portion of the meeting.
Councilmember Buesgens stated that she would like to see the achievements of staff
highlighted throughout the year. Councilmember Jacobs would like to see specific
departments highlighted.
Mayor Márquez Simula inquired about the status of who will be taking over the position of
City Attorney.
Hansen stated that it is an attorney that has worked for the City / Council previously, and
that Scott Lepak is well versed in union contract negotiations for the City, and this is very

important this year as three contracts are up for renewal. There is a need for continuity in
this position through this year’s negotiations.
9. Review 2024 Council Schedule.
Interim City Manager Hansen led the conversation related to prescheduled council
meetings on the first, second and fourth Monday of the month and what days were
updated or changed to reflect a holiday or tentative meeting.
City Clerk Ion confirmed that the City’s online calendar has been updated to reflect
meetings, holidays, and other important events for 2024.
10. Executive Session: Discuss Property Acquisition of PIN: 35 -30-24-43-0018.
ATTENDANCE INFORMATION: Move to recess to Closed Session pursuant to Minnesota
Statutes Section 13D.05, subdivision 3(b), members of the public will not be able to attend.
Mayor Márquez Simula stated that the meeting will be closed pursuant to Minnesota
Statute 13D.05 subdivision 3(b) to discuss the acquisition of property at PIN: 35-30-24-43-
0018.
Motion by Councilmember Jacobs, seconded by Councilmember Spriggs to go into closed session.
Motion Carried 5-0 (individual roll call vote was taken as James was in attendance virtually) and
the meeting was closed at 8:19pm.

work session meeting. Motion Carried 5-0 (individual roll call vote was taken as James was in
attendance virtually) and the meeting was reconvened at 8:43pm.

PROCLAMATIONS, PRESENTATIONS, RECOGNITION, ANNOUNCEMENTS, GUESTS
A. MWMO (Mississippi Watershed Management Organization) Informational Presentation.
MWMO Executive Director Kevin Reich explained that the MWMO has a joint powers
authority in the State. The joint powers are made up of seven jurisdictions. All of the
members represent taxing entities and are elected officials and therefore can act as an
independent special unit of government with a purpose that is guided by the State law.
Local government units need to be configured within watersheds and are nature derived.

While Columbia Heights does not directly touch the Mississippi River, the City’s built
environment does touch it which includes structures and infrastructure. He noted it is
important to address how to mitigate the impacts of those areas in order to improve the
water quality of the river. This is done through collaborative partnerships and goals. The
goals include design, policy making and class participation.
Mr. Reich noted that they are currently working to decrease the impacts of salt. He added
that the sidewalks in front of City Hall are heated in order to help reduce the impact of
chlorine on the river. He explained that there are a number of challenges being a City that
is urban by the river. In many projects, rain water is able to be collected and then soaked
into the earth. However, during the library project, that was not an option. A mechanism
was created in the back of the building to help with the filtration process. Another example
of helping to improve the rivers water quality is the 37th Avenue project through
pedestrian, multimodal and environmental friendly sidewalks and stretches of roads.
Mayor Márquez Simula asked how community members who are interested in learning
more about the MWMO could get involved. Mr. Reich replied that people can contact the
MWMO at any time and go to the website to learn more information. He noted that there
is a committee that overviews the grant programs and are always looking for more
participation with that. They are program water stewards for water quality where people
can do direct action.
Mayor Márquez Simula asked if people can stop by the MWMO. Mr. Reich replied that
people can make an appointment at any time. It is a public building and people can stop by
between 9 am- 3pm. He noted if people would like an informative discussion of what the
facility is, to call in advance.
Councilmember James noted that the MWMO works with the water quality for the lakes
within the districts. She asked how the MWMO works with the lakes in Columbia Heights.
Mr. Reich replied that they have not done a lot of work with standing bodies of water
because the work is emphasized on the Mississippi River.
Councilmember Buesgens thanked Mr. Reich and mentioned that he does good work in the
community.
Mayor Márquez Simula mentioned that the MWMO building is gorgeous and innovative.
Interim City Manager Hansen noted that Columbia Heights joined the MWMO in 2012 and
that it has been a great partnership. He added that the educational resources are also a key
part in the partnership. The library is also able to additional educational resources.
CONSENT AGENDA
Councilmember James noted an amendment to the December 11, 2023 City Council Meeting Minutes
on page 14, item 24, is missing the “City Manager” title for Community Development
Director/Assistant City Manager Chirpich’s title. She asked to amend paragraph 1, 2 and 3 to reflect the
change in title.

Councilmember James referenced item 14, page 64 of the Agenda Packet, “Animal Services to a
Veterinary Firm,” Review of Bills, and asked what it was for. Police Chief Austin replied that the charge
was for a contract with Pet Central. Councilmember James asked if the City owned any animals or if it
was for animals that were picked up. Chief Austin replied for animals that were picked up. Mayor
Márquez Simula asked if it was an annual fee. Chief Austin replied that it was.
Motion by Councilmember Jacobs, seconded by Councilmember Spriggs, to approve the Consent
Agenda as presented. All Ayes, Motion Carried 5-0.

• Curb stop and service repairs for delinquent accounts and foreclosed properties.
11. Capital Equipment Replacement of Unit #250: 4x4 7.3 Liter Cab and Chassis.
MOTION: Move to authorize the purchase of one (1) 2024 Ford F-550 XLT 4x4 7.3 Liter cab
and chassis of the State of Minnesota Purchasing contract from Midway Ford in the
amount of $67,421.67.

Council has reviewed the enclosed list to claims paid by check and by electronic funds
transfer in the amount of $2,680,493.27.
PUBLIC HEARINGS
15. Consideration of Resolution 2023-76, and 2023-77 regarding the revocation of the license
to operate rental units within the city of Columbia Heights against the rental property at
4144 Quincy Street NE for failure to meet the requirements of the Residential
Maintenance Codes.
Assistant Fire Chief O’Brien noted this item was the first of two public hearings but would
need to go through the public hearings separately because it is a procedural matter. He
noted that the Council tabled this item during the November 27, 2023 meeting. He noted
since that meeting, the property owner sold the property on December 19, 2023. The new
owners were legally noticed for the meeting and their responsibility for the item. At least
one of the tenants is still occupying the property prior to the property being sold. The new

property owners have not applied for a rental license but have until January 18, 2024 to do
so.
Assistant Fire Chief O’Brien noted that rental licenses automatically terminate 30 days after
the sale of a property it is not transferred to an eligible property owner licensee. During the
November meeting, it was presented to the Council to consider revo cation due to failure to
correct violations. The violations included to have all electrical wiring inspected by the City
electrical inspector and have proof that wiring is properly installed and approved. This was
completed to the inspector’s satisfaction. An additional violation included to install
hardwire smoke alarm in the basement and shall be installed by a local contractor. This has
also been satisfied. The property is licensed as a duplex rental property but inspectors
noticed a third unit had been added and that multiple families were occupying the
property. The third unit was required to be removed and would not be allowed to be
legally converted to a triplex. The property owner was required to remove any remaining
unpermitted plumbing in the basement and bathroom area and properly cap all copper
water pipes in the basement kitchen area.
Assistant Fire Chief O’Brien stated that inspectors have performed a number of inspections
on the property since November 2023 and all of the violations have been corrected and
resolved.
Councilmember Jacobs asked if the third unit was removed and the tenants were no longer
living in the third unit. Assistant Fire Chief O’Brien replied that the unit was removed and
there were no tenants were occupying the third unit.
Councilmember Jacobs asked if all violations had been satisfied from the November 2023
City Council meeting. Assistant Fire Chief O’Brien replied that they were satisfied.
Councilmember Spriggs asked why the property was sold. Assistant Fire Chief O’Brien
replied that he knew that the property owner was interested in selling the property but did
not know it was to be so soon.
Assistant Fire Chief O’Brien mentioned that if the Council does not want to approve the
revocation then they need to vote against the motion.
Councilmember Jacobs asked if the item could be tabled until January 18, 2024 to see if the
new property owners apply for the rental license. Councilmember Buesgens noted that the
revocation was in regard to the license if the new property owners choose to transfer the
license.
Mayor Márquez Simula asked what the Staff recommendation was. Assistant Fire Chief
O’Brien replied that the Staff recommendation would be not to revoke the rental license.

ITEMS FOR CONSIDERATION
16. Authorize the Purchase of a Station Alerting System (PHOENIX G-2 ALERTING SYSTEM)
and Associated Instillation Costs for the System in the Fire Department.
Fire Chief Thompson explained that during the October 2, 2023 budget work session, he
presented to the Council about an alerting system. He brought the item back to the Council
after it was budgeted under the Capital Expenditure for 2024. He noted that that the
current system can be unreliable due to the pager in the system. If the pager is taken out of
the cradle, then the system cannot be controlled.
Fire Chief Thompson stated that the Phoenix G-2 Alerting System would provide a number
of solutions. The dispatch advantages of the system are that it is a digital system and is fast.
This would help with the wellness of the dispatchers since the information would come to
them digitally. It is a triple redundant system so if a portion of the system went down, the
entire system would not go down with it. The alerting system would increase the
situational awareness in first responders by using a clear, concise language every time. He
mentioned that the current pager is loud and can cause stress. The new system wo uld
reduce stress and anxiety. The new system would have lights that would gradually come up
as well as have a speaker that would have noise gradually increase. In addition, there are
screens that can provide updated information which helps first responders have a clear
idea of what the mission is when they arrive on scene.

Fire Chief Thompson mentioned that he received the final quote on Friday and was
shocked at the increase in price. The budget was for $75,000 for the system. The new
estimate is $85,905.05. The difference in quotes is due to the installation cost. The
installation cannot be contracted out to a different company. The other increase in cost is
due to the controller box for the system. He recommended to the Council to continue to
proceed with the purchase and installation since it will allow for large improvements.
Councilmember James noted that as a resident, she would like the upgrade in order to
have more safety and resiliency in the City.
Mayor Márquez Simula explained that during the work session, all of the Councilmembers
spoke about how happy they were to be moving forward with the department and wanted
the public to know what improvements were coming to the department. She noted the
importance of having the same quality as other surrounding cities.
Interim City Manager Hansen explained that the motion should include an amendment to
the approved budget.
Motion by Councilmember James, seconded by Councilmember Jacobs, to authorize the
Mayor and Interim City Manager to enter into an agreement with US Digital Designs for a
G-2 fire station alerting system and installation and amending the budget to the total of
$85,905.05. All Ayes, Motion Carried 5-0.
Ordinances and Resolutions
17. Consideration of a Rental License Exemption for 4721 Chatham Rd NE
City Planner Boucher stated on December 14, the owner of 4721 Chatham Rd NE, reached
out to the Community Development Department requesting an exemption from the single -
family rental density cap. Attached to the Agenda Packet is the letter that Staff received.
Section 1 of Ordinance 1685, which established the single-family rental density cap, states
that:
“If the number of detached single-family dwellings rental properties meets or exceeds the
permitted number of rental properties per defined block on the effective date of the
ordinance from which this section is derived, a property owner may request a temporary
license to allow an additional rental property for that block. The City Council may grant or
deny a temporary license in its sole discretion. Persons requesting a temporary license
must make an annual application to the City. No property owner shall hold a temporary
rental license for the same property for more than two consecutive years.”
City Planner Boucher added that as it is the homeowners’ right to appeal to the Council.
Staff brought forth the appeal along with supporting documents for discussion and review.
If approved, Resolution 2024-001 would grant a temporary rental license exemption to the
homeowner with a few additional requirements. The homeowner is required to complete
the license application process within three months from the passage of the resolution.
This puts a limit on how long they can take to bring the house into rental compliance if

needed. The temporary rental license will be valid for one year from the date that the
license is approved. This provides the homeowner and tenant the ability to rent the home
for a full one-year lease. After the term of the temporary license, the persons requesting a
temporary license must make an annual application to the City. No property owner shall
hold a temporary rental license for the same property for more than two consecutive
years.
Applicant Derek Batiste shared that his grandfather was the County Auditor for Anoka
County and the house has been in the family since it was built. He explained that his
grandparents passed the house down to him after they passed away. He will be moving to
Oregon with his partner but would like to keep the property in Columbia Heights to keep it
in the family.
Councilmember Buesgens mentioned that Mr. Batiste will need to go through the rental
license application process and it is not guaranteed that the Council will approve it. She
added that after the one year license, he would need to apply for a rental license after that
and it would only last two years. Mr. Batiste explained that he would be willing to move
back to the City when the rental license expires. He mentioned that he would take out an
equity loan in order to do any repairs that are needed to pass the inspection.
Councilmember Jacobs asked who has been staying in the house the past year. Mr. Batiste
replied that he was been partially living in the home and will have the neighbor check the
house anytime he has to be away for an extended amount of time.
Councilmember Jacobs asked about the average period of time that the house has been
occupied in the past year. Mr. Batiste replied less than six months.
Councilmember Jacobs expressed her concern that typically when the Council is asked to
reconsider the Ordinance, it is due to a hardship in life and she does not see that in Mr.
Batiste’s case. An additional concern is that there is no finite timeline of when the house
could be fully occupied without renting it out.
Mr. Batiste explained that his mother would like to return to the house because she has
recently been through a divorce and does not make enough money to live in the area.
Councilmember Spriggs stated he would classify having a new child as a form of hardship.
He added that he would deny an application if someone had the intent to simply make a
profit off of it. He mentioned that he believes this would be within the guidelines for an
exemption to the Ordinance.
City Planner Boucher stated Staff recommends approving resolution 2024-001, a resolution
approving the single-family rental exemption request for the rental application at 4721
Chatham Road NE, Columbia Heights, MN 55421.

18. Consideration of Resolution 2024-02, being a Resolution to Authorize Participation in
Xcel Energy Partners in Energy Program.
City Planner Boucher stated Xcel Energy Partners in Energy provides communities in
Colorado, Minnesota, and Wisconsin services through a two-year commitment to develop
an energy plan and assistance with implementing that plan, understanding a community’s
unique energy needs and priorities, and tailors its services to complement each
community’s vision. By working with citizens, businesses, and even their own government
facilities, a community can shave dollars off utility bills, promote renewables, drive
resource conservation or contribute toward greenhouse gas reduction goals. Partners in
Energy helps address the challenge of identifying local priorities and then struct ures a path
that leverages all resources available.
City Planner Boucher added that the Energy Action Planning application describes how
Partners in Energy helps gather stakeholders to develop and implement energy action
plans to address local energy challenges and priorities with actionable and equitable
strategies and resources. If the City is accepted as a community, there will be a scoping
meeting to help determine the pathway that best aligns with the community’s interests
and capabilities. This program is offered at no cost to participant communities with the
expectation that Xcel Energy provides staff and financial resources during the planning and
implementation phases as well as the City/community provides staff time and financial
support to implement strategies.
City Planner Boucher mentioned that once accepted into the Partners in Energy Program,
Xcel Energy will organize preliminary kickoff meetings to build the framework to launch
energy action planning workshops. They anticipate six to eight weeks for preparation, and
20 to 26 weeks for development of the plan. Following the plan development, the City will
collaborate for 18 months to implement the strategies. The plan will outline actionable
strategies that may include promotional outreach, education, events, PR to help guide the
project implementation and bring tools and resources to help overcome implementation
barriers.

City Planner Boucher explained that ideally, a champion from the community will be
identified who will help smooth the process of developing an Energy Action Plan and rolling
out implementation. Community engagement specialists will help lead workshops and
empower the team with resources and energy expertise. Over the first six months of
working together to develop the action plan, it may require up to 100 hours of time from
your Partners in Energy champion. A group of local participants will need to be identified
and get involved in developing the plan.
City Planner Boucher stated throughout the planning and implementation, they will
leverage the City’s existing communications channels, such as city website, social media,
press media, newsletters, or cable channels. Xcel Energy resources are there to support
and provide tools and help throughout the process—but it is the community that owns the
plan. The program also serves as an Inflation Reduction Act resource for residents,
businesses, local governments, nonprofit and faith-based organizations, and tribes to
access individual and business tax credits, residential rebates, grants for the creation of
new programs and projects, and direct pay tax credits for local governments to access for
clean energy, commercial clean vehicles, alternative fuel infrastructure, etc. Other areas of
focus include building efficiency, electrification, renewable energy, and EV fleet and
charging infrastructure. The City of St. Lou is Park utilized the program to create their
Climate Champions program, which offers cost-sharing for different buildings in their
community (e.g. business, multifamily, and residential) to support energy efficiency and
renewable energy improvements.
City Planner Boucher noted at the January 2, 2024 Council Work Session, Staff were given
direction to review the 2040 Comprehensive Plan and 2018 Solid Waste Management
Policy regarding community goals for energy, sustainability, environmental justice, and
climate actions. Goals for social equity, community and land use, healthy foods, energy,
and waste were included in the application as defined in the above plans .
City Planner Boucher added that Staff recommends that the Council adopt Resolution 2024
– 002 authorizing staff to submit the Partners in Energy application before the January 15,
2024, deadline.
Mayor Márquez Simula asked if the City would hear back around March. City Planner
Boucher replied that he would assume that the City would be able to start working through
the program after the application is submitted.
Councilmember Buesgens asked when work in the program would begin. City Planner
Boucher explained that the application would be due on January 15, 2024 and they would
start working in the program shortly after that. He added that he would return to the
Council with more information about when the program would begin after the application
was submitted.
Councilmember Buesgens expressed her excitement about the p rogram. Councilmember
James thanked Staff for updating the goals. Councilmember Spriggs agreed and added his
excitement about the community aspect of the project and be ing able to collaborate more.

CITY COUNCIL AND ADMINISTRATIVE REPORTS
Report of the City Council
Councilmember Jacobs mentioned that she attended the listening session tours with Metro Transit,
and the City holiday lunch. She reminded the community that beginning January 1, 2024 new
regulations are offering protection for renters and tenants such as mandatory 24 -hour notice before
entering for a non-emergency item. Regulations can be found by going to the State of Minnesota
Renter’s Rights. She attended the funeral of Captain Markham’s daughter with Councilmember
Buesgens. She also facilitated three resident reach outs.
Councilmember Spriggs stated he attended the Santa City Tour. He signed onto two letters which
included a letter urging President Biden and Congress to pass a durable cease fire in the Middle East
and a letter for the Minnesota Housing Partnership urging the Minnesota Congress members for policy
changes to expand the low-income housing tax credit and to increase funding for housing homeless
prevention programs. Additionally, he has provided a written update on what is happening in the City
to the School Board. He connected with the three legislators to discuss priorities for the City. He
attended the Library Board meeting, the EDA meeting, and the Work Session.
Councilmember James noted that she attended the Holiday Train and volunteered with the SACA toy
giveaway. She attended the City Staff holiday luncheon. She met some St. Anthony city leaders along
with Mayor Márquez Simula to hear about their plans for a community center. She had a meeting with
the Anoka County Commissioner to hear about the County’s tax levies and their priorities for 2024. She
had a meeting with a Crest View board member regarding what is happening in Columbia Heights and
their goals. She went to the Neighborhood Watch update meeting and got with the consultant
regarding the City Manager search process. Her children were able to ski through the Columbia Heights
Parks and Recreation program. She attended the EDA and Work Session meetings. She signed onto the
letter that Councilmember Spriggs mentioned regarding the housing pro grams. She read a paragraph
from the cease fire letter to President Biden and Congress , noted the letter is available to share, and
that she is standing with other elected officials to call for a cease fire. She thanked the Staff for all they
did in 2023.
Councilmember Buesgens explained that she attended the Holiday Trai n, Mississippi Watershed
Management Organization meeting, Sustainability Commission as a Council liaison, the high school
band concert, Columbia Heights Fire Department pancake breakfast, Sue Chapman’s retirement party
from Public Works, the Parkview Villa Christmas dinner, and Matt Markham’s daughter’s funeral.

Mayor Márquez Simula expressed her condolences to Mark Markham’s family for the passing of his
daughter. She stated she attended a Governor’s meeting for the Latinx community leaders, Youth
Commission meeting, Staff holiday luncheon, and Shop with a Cop. She has toured a lot of local
development sites and local businesses. She attended a meeting along with Councilmember James
with St. Anthony city leaders regarding the possibilities for collaborating. She added that she attended
a housing meeting with a local housing advocate, Sue Chapman’s retirement party, the Parkview Villas
holiday party, the Silverwood neighborhood holiday party, the Columbia Heights booster’s holiday
party, and the Regional Council of Mayors holiday lunch at the Westwood Hills Nature Center, which is
the first zero net building in the State of Minnesota. She explained that she is now a member of the
Regional Council Mayor Executive Team and attended the first meeting. She also signed the letter that
Councilmember Spriggs and Councilmember James signed regarding the cease fire in the Middle East
and added that she would post the letters on her social media pages. She invited Senator Kunesh,
Representative Feist, and Representative Koegel to the next City Council meeting. She also met with
the Crest View Director for updates on their property.
Report of the City Manager
Interim City Manager Hansen stated there would be a meeting tomorrow regarding the comprehensive
plans for the Metronic site. There will be presentations by the consultant in the Council chambers and
then there will be break outs to hear from the community. The fourth annual Snow Blast is on February
3, 2024 at Huset Park from 4-7 pm. City offices will be closed on Monday due to Martin Luther King Jr.
day.
Interim City Manager Hansen noted the Fire Department has ordered new equipment for the fire truck
and delivery is still on schedule. The City is doing a cooperative study with Anoka County regarding 40 th
Avenue. One public meeting has been held and designs have been updated because of it. An additional
open house will be held mid-February after the Council has a chance to see the designs and provide
input.
Interim City Manager Hansen mentioned that the City has been working on a grant for the Safe Streets
for All and are working with consultants. The Council will review and approve a consul tant in February.
The City received a Safe Roads to School grant a number of years ago. A consultant was hired at the
end of 2023 and have completed the survey and preliminary design. The next step is to meet with the
City of Hilltop and then come back to the Council in February for the final review and authorization to
seek bids. The City is planning on it being a 2024 improvement project.
COMMUNITY FORUM
Dirk Schmitz, City resident, stated that in his opinion Columbia Heights has a small town feel but local
employment and services are disappearing. According to Chapter 5 in the 2040 Comprehensive Plan ,
the City has lost 725 jobs since 2015 and that does not include lost employment and services from the
old Rainbow site. The Comprehensive Plan states that the City should increase by 900 more residents
by 2040. He believes the City could surpass that due to the addition of 400-600 units at the old
Rainbow site, not including the new units above City Hall or the Legends. He asked why the consultants
and Staff believe the Medtronic site should be rezoned for high-density housing instead of other
commercial endeavors that could increase business and jobs to residents. He read that one option for

the Columbia Heights southwest industrial area is to change half of it to high-density housing. He asked
where the City thinks a large employer or business would have the area to operate in the City, where
residents would be able to walk or bike to if services are lost in the City , what the current Staff and City
Council were planning on doing for the future of Columbia Heights , and how will the City keep a small
town feel in 2040.
Laurel Deenen, City resident, thanked the Council for doing the Xcel program. She asked if there were
any thoughts on how to convert grants to local businesses who are currently in older buildings that are
aging poorly to do green initiatives within the City. She expressed her concern regarding the current
aging buildings and how to encourage those buildings to be come more carbon neutral.
Mayor Márquez Simula explained that it is standard for staff to investigate citizens’ concerns and
gather follow up information to respond at the next City Council meeting.

5. City Attorney Review of Questions from Commissioner Laine in Relation to the
Process for Recall Election.
Commissioner Laine stated that she had privately emailed City Attorney Jim
Hoeft regarding questions related to who can sign a petition for a recall,
because there is no reference in the Recall portion of the Charter to
“registered” voters, whereas there is for Referendum and Initiative.
City Attorney Hoeft asked this to be put on the meeting agenda of the Charter
Commission but then was not able to be present.
A copy of the email to the Commission from City Attorney Hoeft, sent the day
before the meeting, is included with these minutes. Briefly, Hoeft’s email gives

COLUMBIA HEIGHTS CHARTER COMMISSION
1. The officers of the commission shall be a president, vice-president, and a secretary, who shall be
elected by a majority of the entire commission.
a. Election of officers shall be held at the commission meeting each January.
b. An election may also be called, with seven (7) days written notice, by petition of any five (5)
members of the
commission.
c. Upon a vacancy in any office, that office shall be filled by election at the next meeting of the
commission.
d. For all duties herein listed, the vice-president shall serve as the president in the president’s
absence.
2. In all deliberations of the commission, any of its permanent or special committees or when it
functions as a committee of the whole, except as specified herein, Robert’s Rules of Order, Revised,
shall apply.
3. The full commission shall act as a committee of the whole. Special committees may be appointed
from time to time when deemed necessary by the commission.
a. Committee assignments shall be made by the president, with majority approval of the entire
commission.
b. Each committee shall have a chair, who shall be appointed by the president, with majority
approval of the
entire commission.
c. Each committee shall consist of not less than three (3) members.

6. Proposed amendments may be presented to the commission by any member of the commission.
The proposed amendment shall be in written form with copies available for each member of the
commission. A majority vote of the commission members present shall decide what action is to be taken
on the proposed amendment.
7. Committees, including the committee of the whole, reviewing a proposed amendment are charged
with the duties of investigating, clarifying, and drafting the proposed amendment in proper form for
inclusion in the charter. Specially appointed committees are also to consider its merit and can either
report it back to the commission positively or negatively or with no recommendation.
8. If the committee refers a proposed amendment to the commission negatively, the commission can
by majority vote of the members present:
a. Send it back to the same committee for further consideration,
b. Take no action, which would, in effect, defeat the proposed amendment, or
c. Consider it as the committee of the whole.
9. If the committee does not report a proposed amendment to the entire commission within ninety
(90) days, the commission can, by majority vote of the members present:
a. Consider it as the committee of the whole, or
b. Take no actions, thereby leaving it in the same committee.
10. The commission, acting as the committee of the whole, has the same responsibilities as any other
committee. A proposed amendment can be considered by the committee of the whole on the same day
it is introduced. Favorable consideration by majority vote of the commission of a proposed
amendment shall constitute the first reading of the amendment.
11. When a specially appointed committee refers a proposed amendment to the commission positively,
it is given its first reading and can be debated.
12. A proposed amendment cannot be given its second reading for at least ten (10) days after its first
reading. The proposed amendment shall be deemed approved with direction for a public referendum or
recommended to the City Council for amendment by a unanimous vote of the Council, by a vote
constituting a majority of the entire commission following its second reading.
13. If the City Council decides not to amend the charter under the provisions of Section 12, the
commission can reconsider the proposed amendment, and by a majority vote of the entire commission,
the proposed amendment can be passed with directions for a public referendum.

14. In order to transact business of either the commission or any of its committees, a quorum must be
present which will consist of a simple majority of the members.
15. All meetings of the commission and any of its committees shall be open to the public.
16. The commission, acting as the committee of the whole, can conduct public hearings on proposed

17. The above rules can be only suspended or amended by a two-thirds vote of the members present.
18. Rulings on motions: The president, or acting president, may rule on all motions and controversies
raised by members. Such rulings by the president are final unless the ruling is challenged by a member.
If any ruling is challenged, the presiding officer will immediately take vote of the members. A ‘yea’ vote
sustains the ruling by the presiding officer and a ‘nay’ vote overrules the ruling of the presiding officer.

charter, the ordinances of the city, and the laws of the state. A president pro tempore shall be

this charter, the ordinances of the city and the laws of the state. In the absence of both the
mayor and the president pro tempore, the council member with the most seniority (as
determined by consecutive uninterrupted years of service to date) shall exercise and perform
said powers and duties. The mayor shall have the appointment, control, and direction of all
police officers of the city, and shall be recognized as the official head of the city for all
ceremonial purposes, by the courts for the purpose of serving civil processes, and by the
governor for the purposes of the military law. In the event of a vacancy in the office of mayor,
whether by death, resignation, or any other cause, the council shall order a special election to
fill the vacancy for the unexpired term except in the case of a recall, the vacancy shall be filled

RE: Recommended Charter Amendments
As you may know, I am leaving my position as city manager for Columbia Heights effective
tomorrow. Before I leave, I wanted to share a couple Charter amendment suggestions I ask that
you consider. I understand both of these items have been considered in th e past but given the
changes we have seen in the size and complexity of municipal operations I feel they both
warrant consideration and action at this time. I discussed both these items with the Mayor and
Council at their April Work Session so they are aware I of my recommendations as well.
MAYOR OVERSIGHT OF THE POLICE DEPARTMENT
The first item is amending Sections 10 and 53, removing the Mayor from overseeing the Police
Department and making that a duty of the City Manager. I have the utmost respect for our
current Mayor and the past Mayors I have worked for in Columbia Heights and this is not meant
to be a slight to Mayor Márquez Simula or our previous Mayors. I believe with the complexities
involved in policing in today’s world as well as the fact that most of the duties outlined as the
Mayor’s role in Charter are delegated by Statute or Rule to the Chief Law Enforcement Officer
(the Police Chief), and finally that any decision that impacts the budget must be made by the
full City Council, the Mayor is ineffectual as the overseer of the Police Department.
In addition, given these restrictions on the Mayor’s ability to act as the Charter states, I believe
it puts the Mayor in a potentially contentious and unfair position with the public because the
expectation is that the Mayor has carte blanche to do the will of the public whereas, the
Mayor’s hands may be tied due to the Statutory and budget constraints identified.

I recommend the Charter draft an Ordinance to be adopted by the City Council amending

MAYOR TERM OF OFFICE
The second item I’d like to ask you to consider is amending the Charter to change the mayoral
term from two years to four years. Currently, the four councilmember terms are staggered 4
year terms with two seats open each election, and the mayor term is a 2 year term that is open
at each election. It would make sense to change the mayor term to a four year term to 1) make
it consistent with the other councilmember terms, and 2) to make the po sition more effective
and reduce staff time needed to onboard a new mayor. Again, this is not meant to disparage
our current or former mayors at all.
Columbia Heights operates as a weak mayor form of government whereby the Mayor has no
more power than any other Councilmember when it comes to votes and actions of the city
council. However, the Mayor does have administrative, ceremonial, and procedural duties the
other Councilmembers don’t have. I would estimate generally it takes a new Mayor a full year
to learn their roles and functions and to hit a rhythm with staff. Currently, with a two year term
that only leaves one year of the term for the Mayor and staff to work highly efficiently and
effectively together. Then add in having to campaign for another election less than one year
later it is a lot to ask of a part time elected official.
Staff feels changing the mayoral term to a four year term would be beneficial to staff, the
community and to the person serving as Mayor. It provides continuity, efficiency, and stability
that can be lost when Mayors change over every two years. With that, I recommend the
Charter draft an Ordinance to be adopted by the City Council amending Section 7 of the Charter
to read as follows:

members who shall be qualified electors, and who shall be elected at large in the manner

A note on the adoption and implementation of these charter amendments should they move
forward. The mayoral oversight of the police department can be adopted by the Council via the
standard Ordinance process and this would be effective following publication in the newspaper:
Initial charter action to make the amendment;
A second motion by Charter Commission to amend the charter;
City Council first reading of an Ordinance amending the Charter;
If the first reading is approved by a 5/0 vote, then a second reading of the Ordinance;
If the second reading is approved by a 5/0 vote, then the ordinance is published in the
newspaper and effective 30 days after publication.
Per State Statute, changing the mayoral term from two to four years requires a different
implementation timeline. The general Ordinance review process is the same as above however
the ordinance doesn’t become effective until the next election which would be held in 2024 for
the mayoral term beginning in 2025. Therefore, the current Mayoral term would remain two
years and expire the end of 2024.

Columbia Heights when the Charter Commission discusses these recommendations, I would be
happy to discuss my thoughts with you at any time. Otherwise, I wish you the best and

Communications Coordinator Rottler discussed the opportunities for the Youth Commission to
volunteer for different activities at SnowBLAST as well as assisting with social media the day of the
event on February 3.

BACKGROUND:
Section 30 of the Columbia Heights City Charter requires the City Council (Council) appoint at least three
qualified voters to be Election Judges (or a number determined by the City Clerk) to each of the City’s polling
locations for all elections.
Each polling location is supervised by the Head Judge and supported by an Assistant Head Judge. All Election
Judges will go through two hours of required training online and are afforded in -person and hands-on training
opportunities with the City’s elections eq uipment lead by the City Clerk if needed. Election Judges are assigned
different roles, these can include: Greeter Judge, Registration Judge, Ballot Judge, and Technology Judge. Head
Judges are required to undergo an additional two hours of training, and Assistant Head Judges are offered the
same training. Election Judges are paid $14.00 per hour, Assistant Head Judges are paid $15.00 per hour, and
Head Judges are paid $16.00 per hour. This is a $1.00 per hour increase for all positions from 202 3, to stay
completive with other municipalities nearby. All judges are requested to start work at 6:00 a.m. to begin
setting up the polling locations, some accommodations can be made for half day shifts upon request. Precincts
are open for voting from 7:00 a.m. to 8:00 p.m. Judges work through the close of polls, often past 9:00 p.m.

BACKGROUND
The police department is seeking to implement two technology updates at the Public Safety Building. The first
update would bring the Curt Ramsdell Conference Room technology in line with the system installed at the
city hall, and work with the mobile-first functionality recommended by the city IT department. The project
includes replacing the controls and video system with a Microsoft Teams compatible unit , and including door
panels to communicate the status of the room.
The second update is to implement sound masking technology in the main police department work area. With
additional staff working out of the front office area it has been determined that sound masking technology
would assist in making the workings space more serviceable for the number of workers involved. The system
has been installed at the city hall and has been positively received by those working in the area.
Bluum technology has provided a Cooperative Purchasing Venture (CPV) quote for th is project. The
conference room update is quoted at $18,080.58 and the Sound Masking installation is quoted at $12,431.22
for a total project cost of $30,511.80. These contract prices meet the city requirements for purchasing , and
have been reviewed by city IT for reasonableness and accuracy. The city has used Bluum Technology in the
past with positive results.
Funding for this project will come from Fund 411, which has sufficient resources for this project. In addition,
available Fund 411 resources are expected to be increased by council action later in 2024; in which 2023
General Fund surplus will be transferred to 411.
STAFF RECOMMENDATION
Staff recommends amending the 2024 capital budget per the attached resolution and approving the purchase
of services and products from Bluum Technology

BACKGROUND
In 2022 and 2023, the Ford Motor Company canceled the police department Ford Hybrid SUV patrol vehicle
orders and in 2023 communicated that they will no longer be guaranteeing delivery of hybrid squad cars. Ford
communicated that they would fill gas engine SUV orders in the spring of 2024. With the cancellations, the
department had four unfilled SUV orders in 2023. Two out of the four 2023 SUVs were from the unfilled 2022
order. The department budgeted for an additional three hybrid SUVs for 2024. Two hybrids were for patrol,
and one was scheduled to be built out as an unmarked administrative squad.
Since the fleet is aging and patrol vehicle repairs were on the rise the department purchased two Dodge
Chargers in December of 2023 to fill the 2022 squad car need. The department then put an order in for four
gas-engine Ford SUVs in 2024. The four SUVs would fill the two squads needed for 2023 and two for 2024.
The department then submitted an order for one 2024 Chevy Traverse as the unmarked admin squad. These
squad orders would bring the department fleet up to the current 2024 replacement schedule. Retired squad
cars will be moved to other city departments for continued use.
SUMMARY OF CURRENT STATUS
In 2024 the two Dodge Chargers purchased in December of 2023 will need to be outfitted as squad cars.

The Northwestern School of Police Staff and Command is an intensive 10-week program that prepares law
enforcement managers for senior level positions by combining academics with practical applications.
Sergeant Jackie Urbaniak is scheduled to attend this training.
The Northwestern School of Police Staff and Command will be held at the City of Eagan from September 23
through December 6, 2024. The cost for the 10-week course is $4,750. The cost for this school is budgeted in
the 2024 Police operating budget.

BACKGROUND:
On October 2, 2023, the fire department presented its 2024 budget to the city council. The proposed capital
budget for 2024 included a detailed outline from the fire chief regarding the essential items needed for the
acquisition of an upcoming aerial apparatus scheduled for delivery in October 2024. The specified budget for
loose equipment was set at $74,000.
During the budget presentation, the fire chief elaborated on the department's strategy for outfitting the new
apparatus using the standard practice of salvaging items from the old apparatus and incorporating them into
the new ones whenever feasible. Given the substantial cost of certain equipment, priority is given to the reuse
of items such as hoses, nozzles, SCBA's, and spare bottles, which are transferred from the old apparatus to the
new one.
SUMMARY OF CURRENT STATUS:
The truck committee is actively working on prioritizing the equipment needed for purchase and installation on
the new aerial. Certain items, such as handheld radios and mobile radios, require ordering up to 30 weeks in
advance due to the lead time necessary for delivery. While some items may be more readily available, we still
need to obtain quotes from various vendors to ensure we secure the best possible pricing.
Included in the considerations are thermal imaging cameras, diverse hand tools, smoke extraction fans,
battery-powered hand lights, battery-operated hand tools, extrication equipment, handheld extinguishers,
mobile radio, cabling and antennas, handheld radios, and various other items.
STAFF RECOMMENDATION:
Authorize the fire department to procure necessary hand tools and essen tial items crucial for the
commissioning of the new aerial unit. The approved expenditure should not surpass $74,000, and acquisitions
should be sourced from different vendors following a comprehensive review of the provided quotes.

BACKGROUND:
In July of 2022 a complaint inspection was performed by the city’s seasonal inspector. Several dead/hazardous
tree violations were found, and compliance orders were sent via regular mail to the owner. On September 6th,
inspectors found that one of the dead tree branches had fallen onto the house. A seasonal extension was
granted to allow the homeowner time to create and finance a mitigation plan.
On June 1st, 2023, a second notice of violations was sent and on July 19th, 2023, the dead/diseased tree
violations were referred to the City Forester for removal/abatement. The City Forester went through his
process and received bids for the abatement/removal of the trees. He found that the bids exceeded his
allowed spending limit and, after conferring with the city attorney, it was decided that this matter should
come before the council for declaration as a public nuisance.
On January 11th, 2024, our inspectors performed a final pre-council inspection of the outstanding violations
and determined that significant progress towards correction of the code violations listed in the initial
compliance order had not taken place.
STAFF RECOMMENDATION:
Adopt Resolution 2024-07, being a declaration of a public nuisance and abatement of violations within the city
of Columbia Heights regarding property at 4411 3rd Street NE for ordinance violations pursuant to City Code.
RECOMMENDED MOTIONS:
MOTION: Move to close the public hearing and waive the reading of Resolution 2024-07, there being ample
copies available to the public.
MOTION: Move to adopt Resolution 2024-07, being a Resolution of the City Council of the city of Columbia
Heights approving declaration of a public nuisance, pursuant to City Code, of the property listed.

RESOLUTION NO. 2024-07
Resolution of the City Council for the city of Columbia Heights declaring the property a nuisance and approving
abatement of ordinance violations pursuant to City Code of the property owned by Clifford A. Rude (Hereinafter
"Owner of Record").
Whereas, the owner of record is the legal owner of the real property located at 4411 3rd Street NE, Columbia
Heights, Minnesota.
And whereas, pursuant to Columbia Heights Code, written notice setting forth the causes and reasons for the
proposed council action contained herein was sent via regular mail to the owner of record on December 7, 2023.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the city of Columbia
Heights, the City Council of the city of Columbia Heights makes the following:
FINDINGS OF FACT
1. That on July 1, 2022, an inspection was conducted by the Fire Department’s seasonal inspector on the
property listed above. Several dead/hazardous trees were found. A compliance order was sent via
regular mail to the owner listed in the property records.
2. That on September 6th, 2022, inspectors found that one of the dead trees had fallen onto the home.
3. That on September 16th, 2023, a seasonal extension was granted, and a message was left with the
property contact regarding the discarded brush and dead trees on the property, with a request to contact
the Fire Department with a plan to mitigate the violations.
4. That on June 1, 2023, July 19, 2023, August 31, 2023, and October 9, 2023, re-inspections were
performed. And the violations remained uncorrected. During this period, the property was inspected by
the city’s Urban Forestry Specialist, who determined that removal of the dead/hazardous trees would
be in excess of $3,000 and, following consultation with the city attorney on November 1st, 2023, it was
decided to present the violations to the City Council for consideration as a public nuisance.
5. That on December 7, 2023, inspectors performed an inspection that verified the violations remained
uncorrected, and a compliance order Statement of Cause and notice of public hearing for declaration as
a public nuisance was sent via regular mail to the owner listed in the property records.
6. That on January 11, 2024, inspectors performed a final pre-council inspection and found that the
violations remained uncorrected.
7. That based upon said records of the Fire Department, the following conditions and violations of City
Code were found to exist, to wit:
A. All exterior property and premises shall be maintained free from diseased, dead, and hazardous
trees. Diseased, dead, or hazardous trees are considered a public nuisance and will be abated by the
city at the expense of the owner if not removed.
8. That all parties, including the owner of record and any occupants or tenant s, have been given the
appropriate notice of this hearing according to the provisions of the City Code .

CONCLUSIONS OF COUNCIL
1. That the property located at 4411 3rd Street NE is in violation of the provisions of the Columbia Heights
City Code as set forth in the Notice of Abatement.

other hearings relevant to the abatement of violations on the property listed above.
3. That all applicable rights and periods of appeal relating to the owner of record, occupant, or tenant, as
the case may be, have expired, or such rights have been exercised and completed .
ORDER OF COUNCIL
1. The property located at 4411 3rd Street NE constitutes a nuisance pursuant to City Code.
2. That a copy of this order shall be served upon all relevant parties and parties in interest.

BACKGROUND
On November 27, 2023, Scott Mueller, BCA Deputy Superintendent of Investigations, conducted a
presentation to the Columbia Heights City Council on the BCA Violent Crime Reduction Unit. Attached is the

SUMMARY OF CURRENT STATUS
The BCA Violent Crime Reduction Unit was implemented as part of the state’s response to combating the spike
in violent crime that has occurred over the last few years, specifically since 2020, and it is part of a larger state
crime reduction strategy. Part of this strategy includes the BCA initiating a partnership with local agencies to
provide support across the state investigating violent crimes, violent crimin al organizations, carjackings, auto
thefts, and disrupting plots of mass violence before they occur.
The Violent Crime Reduction Unit has had success in reducing violent crime working with local, state, and
federal partners, as well as community groups. However, the current staffing for this unit is challenging
because all the agents and analysts assigned to this unit were drawn away from other BCA investigative
activities which impact on the BCA’s delivery of services to the rest of the state. One of the ways that the BCA
is looking at increasing the staffing of the unit is to partner with local agencies of first ring suburbs of
Minneapolis and St. Paul, by offering the opportunity to assign officers from these agencies to the Violent
Crime Reduction Unit.
STAFF RECOMMENDATION
It is the Police Department’s recommendation that the City of Columbia Heights enter into the Joint Powers
Agreement with the BCA to be part of the BCA’s Violent Crime Reduction Unit.

BCA VIOLENT CRIME REDUCTION UNIT
JOINT POWERS AGREEMENT
This Joint Powers Agreement (“Agreement”) is between the State of Minnesota, acting through its
Commissioner of Public Safety on behalf of the Bureau of Criminal Apprehension (“BCA”), and Columbia
Heights Police Department. 825 41st AVE NE Columbia Heights, MN 55421 (“Governmental Unit”), to-
gether known as “Parties.”
Recitals. Under Minnesota Statutes § 471.59, the BCA and the Governmental Unit are empowered to
engage in agreements to jointly and cooperatively exercise their powers. The Parties wish to work together
to prevent, investigate, and prosecute violent crimes, including but not limited to murder and assaults, the
trafficking of illicit drugs and firearms, carjacking, and other violent crimes. The Governmental Unit wants
to work cooperatively with the BCA Violent Crime Reduction Unit (“VCRU”), which is operated by the BCA.
1. Term of Agreement.
A. Effective Date. This Agreement is effective on the date the BCA obtains all required
signatures pursuant to Minnesota Statutes § 16C.05, subdivision 2.
B. Expiration Date. This Agreement expires five (5) years from the Effective Date, unless
terminated at an earlier date pursuant to clause 12.
C. This Agreement does not establish an employment relationship between the BCA and th e
Governmental Unit, nor any persons performing under the Agreement.
2. Purpose. The Governmental Unit and the BCA enter into this Agreement to facilitate the
cooperation and coordination of the Governmental Unit with the work of the VCRU, which uses
an array of proactive and reactive investigative techniques to prevent, investigate, and prosecute
violent crime; gathers information necessary to identify crime patterns and uses this information
to develop strategies for prevention and enforcement; and conducts outreach and education to
community members, groups, and stakeholders in order to facilitate the creation and
implementation of solutions to deter and prevent violent crime.
3. Responsibilities of the Governmental Unit. The VCRU’s interagency collaborative approach is
implemented via the performance of the following activities by the Governmental Unit and any

individuals working with the VCRU on its behalf, under the leadership of the Special Agent in
Charge of the VCRU (“the SAIC”) and the VCRU’s Assistant Special Agents in Charge (“ASAICs”):
A. Assign one or more investigators or employees of the Governmental Unit to the VCRU.
This agreement shall refer to them as “Assigned Investigator” or “Assigned Employee,”
throughout. These Assigned Investigators or Assigned Employees must be approved to
participate in VCRU activities, in advance of doing so, by the BCA’s Deputy Superintendent
- Investigations. During the period of assignment to this task force, the Governmental Unit
will remain responsible for establishing the salary and benefits, including overtime, of the
Assigned Investigator(s) and/or Assigned Employee(s), and for making all payments due
them. BCA will reimburse the Governmental Unit for the full salary and fringe costs of the
assigned employee, and will reimburse overtime costs of the assigned employee up to
$21,000.00.
B. Be willing and able to respond and/or work jointly on violent crimes and complete any
duties assigned to the Governmental Unit, by the SAIC, for the duration of the term of this
Agreement.
C. Conduct investigations in accordance with provisions of state and federal law, BCA
policies and operating procedures as indicated herein, and any other investigative
standards required of a BCA Special Agent.
D. Investigate illicit firearms trafficking crimes committed by organized groups or individuals,
including the trafficking in illicit firearms parts and the illicit manufacture of firearms.
E. Investigate homicide, assault, carjacking and other crimes against the person as directed
by the SAIC/ASAICs, utilizing best investigative practices to create prosecutable cases, and
providing support to victims and witnesses involved therein.
F. Investigate illicit street racing and automobile theft cases with a focus on identifying and
disrupting organizations or networks of individuals involved in the commission or
facilitation of such crimes.
G. Where indicated to have a nexus with firearms crimes or other violent crimes under VCRU
investigation, investigate illicit drug trafficking crimes as necessary to facilitate VCRU
investigative purposes.
H. Participate in operations to apprehend dangerous fugitives as directed by the
SAIC/ASAICs.
I. Maintain accurate records of prevention, education, and enforcement activities, to be
collected and forwarded quarterly to the SAIC for statistical reporting purposes.
J. Prepare an operational briefing sheet for each active operation, including deconfliction
measures as directed, to be approved by the SAIC/ASAICs.
K. Prepare investigative reports to be submitted to the BCA’s chain of command.
L. Ensure evidence collected is appropriately collected, accounted for, and retained in a BCA -
authorized secure facility.

M. Each assigned investigator will be issued a body -worn camera by the BCA, to be utilized
in the course of VCRU activities. Assigned investigators will adhere to BCA’s policies
regarding body-worn cameras, and shall ensure footage captured by BCA-issued cameras
is appropriately uploaded to the BCA system(s).
N. Participate in training as directed by the SAIC/ASAICs or designee(s).
O. While conducting VCRU activities, adhere to the following BCA policies and/or
procedures:

Q. Assigned Investigators must comply with the use of force provisions of their home
agency’s policies/procedures. Assigned Investigators must also comply with directives
issued by the SAIC/ASAICs. In the event of a conflict between the use of force
requirements of the Assigned Investigator ’s home agency policy, and the policies or
directives of the VCRU, the policies and procedures of the home agency shall govern. Prior
to deployment in the field, Assigned Investigators will confer with the VCRU SAIC/ASAIC
to identify any potential use of force policy conflicts and work to resolve them in advance
of operational activities.

R. Utilize task management and accountability programs and procedures, including Time
Tracker, as directed by the SAIC/ASAICs.
S. Submit all requests in the requested format for reimbursement in a timely manner to the
SAIC.
4. Responsibilities of the BCA. The aforementioned approach will be implemented via the
performance of the following activities by the BCA:
A. The BCA will provide the VCRU with a BCA Special Agent in Charge to serve as the SAIC
of the VCRU.
B. Provide guidance and training, as appropriate, on all VCRU standards to be followed by
the Governmental Unit, Assigned Investigators, and Assigned Employees.
C. Review, approve or decline, or request additional information on appropriately submitted
and pre-approved reimbursement requests, within three (3) business days of receipt.
D. Provide reimbursement within thirty (30) business days of the appropriately submitted
and pre-approved reimbursement requests directly to the Governmental Unit.
E. Provide supplies and equipment to Assigned Investigators and Assigned Employees.
Supplies issued to Assigned Investigators include, but are not limited to, a squad vehicle,
a body worn camera, a computer, a cellular phone, and office supplies. Supplies issued to
civilian Assigned Employees include, but are not limited to, a computer, a cellular phone,
and office supplies. Supplies issued to Assigned Investigators and Assigned Employees
remain the property of the State of Minnesota, and shall be remitted back to the BCA
when the Assigned Investigator or Assigned Employee leaves the VCRU.
F. Provide copies of body worn camera footage that captures or documents the activities of
the Governmental Unit’s Assigned Investigator for purposes of internal
review/investigation by the Governmental Unit, upon request of the Assigned
Investigator’s chief law enforcement officer. Body worn camera recordings shall be
treated in accordance with the Minnesota Government Data Practices Act, the premature
disclosure of which could reasonably be expected to interfere with criminal investigation
and prosecution. The Governmental Unit shall not further disseminate the recording(s)
beyond the Governmental Unit or release to the public without consultation with the BCA.
G. Provide evidence storage at BCA headquarters or a BCA-approved secure facility.
H. Proceeds from assets seized through VCRU activities and forfeited through judicial
proceedings shall be maintained in a separate fund administered by the state, for
purposes of offsetting equipment expenses, future salaries, and other expenses incurred
by the VCRU. The BCA retains the right to distribute proceeds from forfeited assets to the
Governmental Unit at its discretion.
5. Standards of the Governmental Unit. The following standards must be met by the Governmental

Unit, each Assigned Investigator, and each Assigned Employee:
A. Assigned Investigators must be licensed peace officers in good standing with the
Minnesota Peace Officer’s Standards and Training Board (POST). Assigned Investigators
and Assigned Employees must be in good standing with their home agency.
B. Assigned investigators and Assigned Employees must be skilled in a broad array of
investigative technologies and techniques, to be used as appropriate, throughout their
work with the VCRU.
C. Assigned Investigators and Assigned Employees must utilize task management and
accountability programs and procedures, including Time Tracker, as directed by the
SAIC/ASAICs.
D. Assigned Investigators and Assigned Employees will follow all applicable and appropriate
state and/or federal laws in all VCRU-related activities.
E. Assigned Investigators and Assigned Employees must be employed by the Governmental
Unit.
F. Assigned Investigators and Assigned Employees must follow best law enforcement
practices in the discharge of their VCRU duties, conducting themselves with the highest
degree of professionalism, avoiding any conflicts of interest, and conducting their
activities impartially.
6. Employment Relationship. This agreement does not create an employment relationship between
the Assigned Investigators and/or Assigned Employees and the BCA. All Assigned Investigators &
Assigned Employees from the Governmental Unit shall continue to be employed and directly
supervised by the same Governmental Unit currently employing that member, regardless of their
participation in VCRU activities. All services, duties, acts or omissions performed by the Assigned
Employee or Assigned Investigator will be within the course and duty of their employment and,
therefore, covered by any benefits or protections provided them as employees of the
Governmental Unit. This includes, but is not limited to, workers compensation, health, and dental
benefits. Nothing in this Agreement shall otherw ise limit the jurisdiction, powers, and
responsibilities possessed by an Assigned Investigator and Assigned Employee of the
Governmental Unit.
7. Reimbursement of Expenses. In order to obtain reimbursement for expenses associated with
activities of the VCRU, the Governmental Unit must:
A. Submit a written request, in the appropriate format, for pre-approval of the
reimbursement for funds expended as a result of the activities of the VCRU.
B. If and when this pre-approval is received, the Governmental Unit may expend funds to be
reimbursed within the limitations of the pre-approval.
C. In order to receive reimbursement following this expenditure, the Governmental Unit

must supply original receipts to be reimbursed on the aforementioned pre-approvals.

9. Assignment, Amendments, Waiver, and Agreement Complete.
A. Assignment. The Governmental Unit may neither assign nor transfer any rights or
obligations under this Agreement.
B. Amendments. Any amendment to this Agreement must be in writing and will not be
effective until it has been executed and approved by both Parties, through their
Authorized Representatives.
C. Waiver. If the BCA fails to enforce any provision of this Agreement, that failure does no t
waive the provision or its right to enforce it.
D. Agreement Complete. This Agreement contains all negotiations and agreements
between the BCA and the Governmental Unit. No other understanding regarding this
Agreement, whether written or oral, may be used to bind either party.
10. Liability. The Parties agree that each will be responsible for its own acts, omissions, and/or the
results thereof, to the extent permitted by law and shall not be responsible for the acts or
omissions of any others, and/or the results thereof. The BCA’s liability shall be governed by

provisions of the Minnesota Tort Claims Act, Minnesota Statutes § 3.736, and other applicable law.
The Governmental Unit’s liability shall be governed by provisions of the Municipal Tort Claims Act,
Minnesota Statutes §§ 466.01-466.15, and other applicable law.
11. Audits. Under Minnesota Statutes § 16C.05, subdivision 5, the Governmental Unit’s books, records,
documents, and accounting procedures and practices relevant to this Agreement are subject to
examination by the BCA and/or the State Auditor and/or Legislative Auditor for a minimum of six
(6) years from the end of this Agreement.
12. Government Data Practices. The Governmental Unit and the BCA must comply with the
Minnesota Government Data Practices Act, Minnesota Statutes Chapter 13, and other applicable
law, as it applies to all data provided by the BCA under this Agreement and as it applies to all data
created, collected, received, stored, used, maintained, or disseminated by the Go vernmental Unit
under this Agreement. The civil remedies of Minnesota Statutes § 13.08 apply to the release of the
data referred to in this clause by either the Governmental Unit or the BCA.
A. If the Governmental Unit receives a request to release the data referred to in this clause,
the Governmental Unit must immediately notify and consult with the BCA’s Authorized
Representative as to how the Governmental Unit should respond to the request. The
Governmental Unit’s response to the request shall comply with applicable law.
13. Governing Law, Jurisdiction, and Venue. Minnesota law, without regard to its choice-of-law
provisions, governs this Agreement. Venue for all legal proceedings that result out of this
Agreement, or its breach, must be in the appropriate state or federal court with competent
jurisdiction in Ramsey County, Minnesota.
14. Expiration and Termination. Either party may terminate this Agreement at any time, with or
without cause, upon 30 days written notice to the other party. To the exten t funds are available,
the Governmental Unit shall receive reimbursement in accordance with the terms of this
Agreement through the end of the 30 days. Upon expiration or earlier termination of this
Agreement, the Governmental Unit shall provide the VCRU SAIC all investigative equipment and
supplies provided by the VCRU and/or the BCA.
15. Survival of Terms. The following clauses survive the expiration or cancellation of this Agreement:
8, Liability; 9, Audits; 10, Government Data Practices; and 11, Venue.

BACKGROUND
On January 18, 2024, the owner of 4411 6th Street NE, reached out to the Community Development
Department requesting an exemption from the single-family rental density cap. Attached is the letter that
staff received. Section 1 of Ordinance 1685, which established the single-family rental density cap, states that:
“If the number of detached single-family dwellings rental properties meets or exceeds the permitted number
of rental properties per defined block on the effective date of the ordinance from which this section is derived,
a property owner may request a temporary license to allow an additional rental property for that block. The
City Council may grant or deny a temporary license in its sole discretion. Persons requesting a temporary
license must make an annual application to the City. No property owner shall hold a temporary rental license
for the same property for more than two consecutive years.”
As it is the homeowners’ right to appeal to the Council. Staff brought forth the appeal along with supporting
documents for discussion and review.
If approved, Resolution 2024-10 would grant a temporary rental license exemption to the homeowner with a
few additional requirements. The homeowner is required to complete the license application process within 3
months from the passage of the resolution. This puts a limit on how long they can take to bring the house into
rental compliance if needed. The temporary rental license will be valid for one year from the date that the
license is approved. This provides the homeowner and tenant the ability to rent the home for a full one-year
lease. After the term of the temporary license, the persons requesting a temporary license must make an
annual application to the City. No property owner shall hold a temporary rental license for the same property
for more than two consecutive years.
STAFF RECOMMENDATION
Staff recommends approving resolution 2024-10, a resolution approving the single-family rental exemption
request for the rental application at 4411 6th Street NE, Columbia Heights, MN 55421.

Dear Council Members,
My name is Wilson Zhina, and I am writing to bring a matter of personal significance to your attention
regarding the property located at 4411 6th St NE.
My fiancée, Anai, and I are facing unforeseen challenges that require an exemption to Ordinance 1685 to
enable us to rent our home. Originally, our plan was to move into the property; however, complications
have arisen, leading us to reconsider our plans. I am reaching out to seek your understanding and
support in navigating these unique circumstances.
Initially, we had intended to move into the property, resulting in the expiration of the city rent permit.
Unfortunately, our tenant encountered difficulties in vacating by the agreed-upon date, compelling us to
extend their stay until December 4, 2023. This extension not only caused a significant delay but also left
the house in a state of disarray with large amounts of leftover trash, prompting a notice of overflowing
garbage. I promptly addressed all these costly issues at our expense.
Due to these unforeseen delays, we are currently facing challenges in relocating, especially with Anai
now 37 weeks pregnant and our daughter Juliana expected on February 6, 2024. Moving under these
circumstances, particularly in low-temperature weather, is impractical. Financial and logistical
constraints further necessitate postponing the move. In response, we have made temporary living
arrangements in Richfield, minutes away from my mom and Anai’s family. We have set up our baby’s
nursery and child-proofed the house to ensure a safe and comfortable environment.
In light of these challenges, we are exploring the option of renting the property. While we acknowledge
the city council's concerns regarding excess single-family rentals, we wish to highlight the potential risks
associated with leaving the home vacant, vulnerable to vandalism and squatters. In anticipation of either
scenario, I have initiated renovations to make the property appealing and comfortable for potential
tenants and, eventually, for my family.
Understanding the importance of upholding city ordinances, we seek your guidance and support to
secure an exemption that takes into account our unique circumstances. We remain hopeful for a
positive resolution that considers the challenges we face.

The July 24, 2023 City Council meeting is a good place to start. The City Council began the rental density cap
discussion after bringing up worries regarding single-family home conversions to rental properties and were
concerned that it has become increasingly difficult for potential home buyers wishing to purchase property in the
City to identify financially attainable options.
Blocks that have an overflow of single-family rental properties are grandfathered in; however, if any of these
properties lets their license expire/decline to renew it or have had it revoked, then they would lose that
grandfathered status and be treated like a new application subject to the rental density limit on the block. If your
block has four (4) rental properties and the allotment is three (3), then those four (4) would be able to maintain
their license and no additional license applications would be accepted until two (2) of the properties decline to
renew theirs.

A RESOLUTION APPROVING SINGLE FAMILY RENTAL EXEMPTION REQUEST FOR THE RENTAL APPLICATION
AT 4411 6th STREET NE, COLUMBIA HEIGHTS, MN 55421
BE IT RESOLVED BY the City Council (the “Council”) of the City of Columba Heights, Minnesota (the “City”) as
follows:
WHEREAS, on August 14, 2023, the Council approved ordinance 1685 which established a rental density limit
for detached single-family rental dwellings by splitting the city into blocks and caping the number of rentals per
that block; and
WHEREAS, Ordinance 1685 establishes that applicants that are not allowed to obtain a single-family rental
license because of the density limits will be able to request an exemption and the Council has sole discretion to
grant the exemption requests for a span of one year, if the situation lasts longer than a year, the applicant can
re-apply for the temporary license but a property owner is only allowed a temporary license for no more than
two years; and,
WHEREAS, the City has received a request from the owner of 4411 6th Street NE, Columbia Heights, MN 55421
to make an exception for the property and allow a new rental license to be issued.
NOW, THEREFORE, BE IT RESOLVED, the City does hereby approve the exemption request for 4411 6th Street
NE, Columbia Heights, MN 55421, allowing the homeowner to apply for a temporary one -year rental license,
with the addition of the following requirements.
1. The owner of 4411 6th Street NE, Columbia Heights, MN 55421 must apply for and complete the licensing
process, to receive the temporary license, within 3 months of the passage of this resolution.
2. The temporary rental license shall be valid for the period of one year after the date that the license has
been approved.
3. After the one-year term of the temporary license, the rental license will be revoked, and the property
owner may re-apply for the temporary license again for no more than a period of two years for the
same property.
