BACKGROUND:
In 2023, the legislature passed a law that prohibits residential landlords from imposing a penalty or
terminating a lease based on conduct occurring off of the premises except in certain instances. This new law
will become effective June 1, 2024, and will require a change to the Columbia Heights City Code Section
5A.401 regarding Conduct on Licensed Premises/Crime Free/Drug Free and Disorderly Use Lease
Requirements
SUMMARY OF CURRENT STATUS:

STAFF RECOMMENDATION:
Chief Austin will be reviewing this information at the work session, and the first reading of the amended

Premises/Crime Free/Drug Free and Disorderly Use Lease Requirements

This item relates to a Healthy and Safe Community.
The 2023 legislature passed a law that prohibits residential landlords from imposing a penalty or
terminating a lease based on conduct occurring off of the premises or curtilage of the premises
except in certain instances. The new law is at Minn. Stat. Sec. 504B.171, Subd 2a and provides
that:
Pursuant to Minn. Stat. Sec. 504B.171, Subd. 2a, a residential landlord may not impose a
penalty on a residential tenant or terminate the lease of a residential tenant for the
conduct of the residential tenant, household member, or guest occurring off of the
premises or curtilage of the premises, unless (1) the conduct would constitute a crime of
violence against another tenant, the tenant’s guest, the landlord, or the landlord’s
employees, regardless of whether a charge was brought or a conviction obtained; or (2)
the conduct results in a conviction of a crime of violence against a person unrelated to the
premises. For purposes of this subdivision, crime of violence has the meaning given in
section 624.712, subdivision 5, except that it does not include offenses under chapter 152.
This new law will become effective June 1, 2024.
As a result of a change in Minnesota Statutes, the City needs to amend City Code Section
5A.420 Conduct on Licensed Premises/Crime Free/Drug Free and Disorderly Use Lease
Requirements to remove reference to conduct “near” the premises while at the same time
recognizing that certain off premises conduct may still be prohibited. The revised Code section
with the changes from the prior version noted are attached to this memorandum.
The City plans to provide an informational letter to existing residential landlords relating to this
change to further assist with this issue.

ORDINANCE ___
AN ORDINANCE AMENDING § 5A.410
CONDUCT ON LICENSED PREMISES/CRIME FREE/DRUG FREE AND
DISORDERLY USE LEASE REQUIREMENTS.
THE CITY OF COLUMBIA HEIGHTS, MINNESOTA ORDAINS:
Section 1. Code Amended. That Section 5a.410, Entitled Conduct On Licensed Premises/Crime
Free/Drug Free And Disorderly Use Lease Requirements be amended as follows:
§ 5A.410 CONDUCT ON LICENSED PREMISES/CRIME FREE/DRUG FREE AND
DISORDERLY USE LEASE REQUIREMENTS.
(A) All residential tenant leases, except for state licensed residential facilities and subject to all
preemptory state and federal laws, shall contain the following, or substantially comparable to,
crime free/drug free and disorderly use language:
(1) Crime free/drug free.
(a) Resident, any members of the resident's household or a guest or other person affiliated
with resident shall not engage in criminal activity, including drug-related criminal activity, on or
near the premises or curtilage of the premises.
(b) Resident, any member of the resident's household or a guest or other person affiliated
with resident shall not engage in any act intended to facilitate criminal activity, including drug-
related criminal activity, on or near the premises or curtilage of the premises.
(c) Resident or members of the household will not permit the dwelling unit or curtilage of
the premises to be used for, or to facilitate criminal activity, including drug-related criminal
activity, regardless of whether the individual engaging in such activity is a member of the
household, or a guest.
(d) Resident, any member of the resident's household or a guest, or other person affiliated
with the resident shall not engage in the unlawful manufacturing, selling, using, storing, keeping,
or giving of a controlled substance at any locations, whether on or near the premises or
otherwise. or curtilage of the premises.
(e) Resident, tenant, household member, or guest shall not engage in conduct, whether on
or off the premises, where (1) the conduct would constitute a crime of violence against another
tenant, the tenant’s guest, the landlord, or the landlord’s employees, regardless of whether a
charge was brought or a conviction obtained; or (2) the conduct results in a conviction of a crime
of violence against a person unrelated to the premises. For purposes of this subdivision, crime of
violence has the meaning given in section 624.712, subdivision 5, except that it does not include
offenses under chapter 152.
(e) (f) Violation of any one of the above provisions shall be a material and irreparable
violation of the lease and good cause for immediate termination of tenancy by the property
owner.

(2) Disorderly use.
(a) Resident, members of the resident's household, guests, or other persons under the
resident's control shall not engage in the following disorderly use activities: violations of state
law relating to alcoholic beverages, trespassing or disorderly conduct, and violations of the city
code relating to prohibited noise.
(b) Three disorderly use violations involving the same tenancy within a continuous 12-
month period shall be a substantial and material violation of the lease and good cause for
termination of the tenancy by the property owner.
(3) Definitions. For the purpose of this section, the following definitions shall apply unless
the context clearly indicates or requires a different meaning.
CRIMINAL ACTIVITY. Prostitution, gambling, maintaining or conducting a disorderly
house, unlawful possession, transportation, sale or use of a weapon, domestic assault,
delinquency of a minor, criminal street gang activity, threatening, intimidating or assaultive
behavior, the unlawful discharge of firearms, or any other criminal activity on or near the
premises that jeopardizes the health, safety and welfare of the landlord, his agent, other resident,
neighbor or other third party, or involving imminent or actual serious property damage.
DRUG RELATED CRIMINAL ACTIVITY. The illegal manufacture, sale, distribution,
use or possession with intent to manufacture, sell, distribute, or use of a controlled substance or
any substance represented to be drugs (as defined in § 102 of the Controlled Substance Act [21
U.S.C. 802]).
(4) Non-exclusive remedies.
(A) The crime free/drug free and disorderly use provisions are in addition to all other terms of
the lease and do not limit or replace any other provisions.
(B) These lease provisions shall be incorporated into every new lease for a tenancy beginning
January 1, 2008 and all renewed leases by January 1, 2009.
(C) Upon determination by the Police Department that a licensed premises or unit within a
licensed premises was used in violation of the crime free/drug free provisions of subdivision
(A)(1) herein, the Police Department shall cause notice to be made to the owner and property
manager of the violation. The owner or property manager shall notify the tenant or tenants within
ten days of the notice of violation of the crime free/drug free lease language and proceed with
termination of the tenancy of all tenants occupying the unit. The owner shall not enter into a new
lease for a unit located in any licensed property within the city with an evicted tenant for a period
of one year after the eviction.
(D) Upon determination by the Police Department that a licensed premises or unit within a
licensed premises was used for disorderly use activities as set forth in subdivision (A)(2) herein,
the Police Department shall cause notice to be made to the owner and property manager of the
violation and direct the owner and property manager to take steps to prevent further disorderly
use violations.
(E) If a second disorderly use violation as determined by the Police Department occurs within
a continuous 12-month period involving the same tenancy, the Police Department shall cause
notice to be made to the owner and property manager of the second violation. The owner or

property manager shall respond in writing within ten days of receipt of the notice with an action
plan to prevent further disorderly use violations.
(F) If a third disorderly use violation as determined by the Police Department occurs within a
continuous 12-month period involving the same tenancy, the Police Department shall cause
notice to be made to the owner and property manager of the third violation. The owner or
property manager shall notify the tenant or tenants within ten days of the notice of disorderly use
violation of the crime free/drug free lease language within the lease and proceed with termination
of the tenancy of all tenants occupying the unit. The owner shall not enter into a new lease for a
unit located in any licensed property with an evicted tenant within the city for a period of one
year after the eviction.
(G) The provisions of divisions (C), (D), (E) and (F) herein do not apply if the determination
that the premises have been used in violation of the crime free/drug free provisions of
subdivisions (A)(1) and (A)(2) herein originates from a call from or at the request of one or more
tenants occupying the premises for police or emergency assistance, or in the case of domestic
abuse, from a call for assistance from any source. The term DOMESTIC ABUSE has the
meaning given in M.S. § 518B.01, subd. 2.
(H) If the licensee fails to comply with the requirements of this section, the rental dwelling
license for the premises may be denied, revoked, suspended, or not renewed. An action to deny,
revoke, suspend, or not renew a license under this section shall be initiated by the City Council at
the request of the Police Department in the manner described in § 5A.408.

ITEM: Review of Grant Applications for Sullivan Park Trail and Fitness Court

BACKGROUND:
The Minnesota Department of Natural Resources (DNR) outdoor recreation grant program makes annual or bi-
annual grants available for projects involving outdoor recreation at public sites, including city parks. The
maximum award available for this grant is $350,000; any award requires a 50% cost match on the project from
the grant recipient. Grant applications are due April 1, 2024, and awarded projects may begin in 2025.
The Fitness Court is an outdoor community gym space created by the non -profit organization the National
Fitness Campaign (NFC). Blue Cross Blue Shield is the corporate sponsor for the campaign in MN for 2024-
2025, providing a $50,000 grant for 10 Fitness Court partner communities to build outdoor gyms in public
spaces. Blue Cross Blue Shield is also sponsoring the cost of adding public art to the Fitness Court, providing an
additional $25,000 for that cost. Grant applications are being accepted and awarded on a rolling basis.
SUMMARY OF CURRENT STATUS:
Staff are gathering necessary background information to define the scope of the project and apply for the DNR
Outdoor Recreation grant; the grant application is due April 1, 2024. The targeted project is the walking trail
around Sullivan Lake; the trail would be improved, repaired, and rehabilitated with complete replacement in
some sections. Repairs and upgrades to the retaining wall on the West side of the lake may be necessary and
the status is under investigation. Additional project items will include upgrades to the lighting around the trail
and other trail accessories/support structures if total project costs allow.
Staff have met with representatives of NFC and discussed the possibility of bringing a Fitness Court to
Columbia Heights. Staff from NFC conducted a site feasibility analysis on multiple sites discussed as potential
locations in preliminary discussions. Huset Park and Sullivan Lake Park scored the highest in the feasibility
analysis, with the scores from both sites qualifying for a maximum grant award of $50,000. After grant awards,
the remaining cost for a Fitness Court is approximately $160,000, and $210,000 for the larger Fitness Court
Studio. The application can pre-qualify multiple locations, with a final location decision not necessary until
after the application and award process.

STAFF RECOMMENDATION:
Staff recommends applying for the DNR Outdoor Recreation Grant for improvements, repairs, and
reconstruction of the Sullivan Lake walking path and lighting.
Staff recommends applying for a grant to become a National Fitness Campaign partner community and build a
Fitness Court Studio including the public art component. Staff recommends including both Huset and Sullivan
Lake Parks in the grant application as possible locations.

BACKGROUND:
In 2022, the Columbia Heights City Council passed Resolution 2022-46 supporting No Mow May. In the past,
City staff have created yard signs for residents to purchase to show their support for No Mow May. Since then,
research has shown that No Mow May may not be providing the benefits as was once thought.
STAFF RECOMMENDATION:
Staff recommends amending No Mow May and developing a marketing campaign in support of Less Mow
May.

BACKGROUND:
City code section § 3.302 established a City PARK AND RECREATION COMMISSION. Amended in 2021, it
provides that the Commission shall recommend improvements for parks and shall have the authority to make
reasonable administrative rules and regulations, including public use of park lands and buildings, but shall at
all times be subject to the direction and authority of the Council.
In 2024, the Commission will be updating the Park Plan, last completed in 1996. For reference, a copy of the
1996 Plan Summary is attached. As part of that process, the Commission will be seeking input from the
community to help guide the updated plan. The Commission may utilize outreach at events such as the City
Services Expo, Community Art and Info Fair and Music in the Park events. The Communications department
will also assist with a survey available through the City’s website and other social media. Some park related
questions were asked in the most recent City wide survey. Staff provided the Park and Recreation Commission
a copy of both the City-wide survey completed by Morris Leatherman and the online survey completed by City
staff. Utilizing these, staff will work with the Commission to focus the survey questions on the plan update and
avoid repeating the recent survey questions.
One item that has been discussed in the past with the Council is Murzyn Hall, but more broadly a future
redevelopment of JPM to a community center. Staff desires direction from the Council on including a
Community Center in the survey for feedback in 2024, or direct that be a separate effort at a future date.
STAFF RECOMMENDATION:
Review and discussion for public engagement process for the park plan update, and possibly including Murzyn
Hall.

Plan Summary
Serving as the backbone for the community, the Columbia Heights Park System is considered to be
one of the major community assets. Providing beauty, recreation, open green space, and the
opportunity for neighborhood interaction, the City's parks contribute profoundly to the look, feel,
and vitality of the community. Besides helping raise property value, the Columbia Heights Park
System positively impacts the health, crime prevention efforts, the economy, and the quality of life
in Columbia Heights.
Like most of our urban parks, the Columbia Heights Park System has suffered from years of
inadequate maintenance, aging facilities, governmental streamlining, lack of sufficient labor,
inadequate planning, and very heavy usage rates. As the population and demand for various park
and recreational facilities changes, so must we in terms of how we think about parks and their role
in the community.
It is now time for this change. In doing so we must first renew the interest in the minds of the city
decision-markers as well as the general public that parks and trails are not luxuries, but essential
elements of a broader strategy to promote fiscal strength, private economic growth, and improve the
quality of life in Columbia Heights. Careful planning and promotion must be done on a park-by-
park basis as well as on a broader City and Regional level. Issues to be considered must include
changing demographic, land developments, recreation and facility trends, user characteristics, and
park maintenance and management issues.
The first step is anticipating the paradigm shifts concerning the future ofthe Columbia Heights Park
System is this plan. Intended to offer direction and guidance for future park planning and
maintenance, we must remember that the results of this plan are not set in stone and that flexibility
is essential to successful park planning.
As this plan sits at pivotal point between the current and future Columbia Heights Park Systems, it
is recommended that a review similar to this, be conducted every three years to ensure the
implementation of this plan is carried out to the fullest extent while best serving the residents of the
Columbia Heights.

Council reviewed the 2024 Application and Board and Commission applications and interview questions at the
February 2024 Work Session. Council agreed that applications would be accepted through February 29, 2024,
and interviews for open positions conducted on March 8 th and 11th.

I recently moved to this community, and I have always found it very important to be involved in my
community to do what I can to make a difference. I felt as though this would be an excellent

Transparently, I went back and forth on applying. I was not sure if I would be the right candidate to apply to a position like this. However, I decided to throw my hat in the ring because I m inspired by all of
our local leaders. From neighbors wanting to help each other on our block, to the folks who organize the Buy Nothing Group Free Sale, and just seeing the strong leadership within our local community
government, I just feel inspired to give back to the community in a positive way. The library has been such a fantastic place for our family and I want to ensure that the rest of our community knows about all
the cool things we have to offer! In addition to this, I want to ensure that we re offering services for everyone in our community, not just the vocal majority.
I feel qualified because I have been a part of many professional organizations, both as a general member and while holding leadership positions. I am prepared to have difficult conversations and
disagreements with board members while balancing this with a can do-positive attitude. My top 5 strengths (From Strengths Quest) include: Harmony, Communication, Restorative, Includer, and Empathy.
This means that I m ready to create and foster relationships while also being forward thinking. In my past roles (and current one) I have implemented social programming events, managed budgets, and
created resources for folks within the Minneapolis/ St. Paul area.
I think my time in residential life/ college housing at the University of Minnesota (and currently Macalester College) gives me a fresh perspective on diversity, equity, and inclusion. I think including facets of
DEI within our community s leadership roles is vital to ensuring that we re including voices that may have been overlooked. I also think my love for planning events is going to come into play. During my
time as a Hall Director, I have had to plan many social events, which is something I truly enjoy doing! I think the other biggest thing is I LOVE our library. I enjoy promoting all the wonderful things it has to
offer to our community members. For example, on our buy nothing group, I was able to promote some of the cool cooking appliances/ items that we have to offer! The library is an important part of our
family s life and I think it s important to include folks who utilize the services on the board! (Even if it s not me that gets a position.) I think the other component that makes me a unique candidate is that
I worked in a library in high school. (That was more of a fun fact.)

I am interested in serving because I want to be involved in the community and would like to know what
is going on with the cities Parks system. I feel that I am qualified because I have worked for a
municipality in the Parks Department and I beleive I would bring a unique perspective due to my
background.
Being an arborist I would bring a perspective with the knowledge in Natural Resources. Also, having
worked for a municipality I know what goes into maintaining and managing individual parks and the
park system as a whole. I think having this background would make me a good asset for this
commission.
