Approve Permits for the 2024 Jamboree. MOTION: Move to authorize staff to close Huset Parkway from 39th to 40th Avenues beginning Tuesday afternoon, June 25, through Sunday, June 30, 2024. MOTION: Move to authorize the Police Department to issue a parade permit for the Jamboree Parade to be held on Friday, June 28, 2024, beginning at 6:00 PM for the following streets: 45th Avenue to Quincy Street, south to 40th Avenue, west to 5th Street. 2 City of Columbia Heights AGENDA May 28, 2024 City Council Meeting Page 3 MOTION: Move to authorize fireworks at dusk on Saturday, June 29, 2024, and to waive the Fire Department fireworks display permit fee. 10. License Agenda. MOTION: Move to approve the items as listed on the business license agenda for May 28th 2024, as presented. 11. Rental Occupancy Licenses for Approval. MOTION: Move to approve the items listed for rental housing license applications for May 28, 2024, in that they have met the requirements of the Property Maintenance Code. 12. Review of Bills. MOTION: Move that in accordance with Minnesota Statute 412.271, subd. 8 the City Council has reviewed the enclosed list to claims paid by check and by electronic funds transfer in the amount of $1,415,322.85. Adopt Resolution 2024-44 for Abatement. MOTION: Move to close the public hearing and waive the reading of Resolution 2024 -44, there being ample copies available to the public. MOTION: Move to adopt Resolution 2024-44, a Resolution of the City Council for the City of Columbia Heights declaring the property a nuisance and approving abatement of ordinance violations pursuant to City Code of the property owned by Brandon Gilbert (hereinafter "Owner of Record"). ITEMS FOR CONSIDERATION Ordinances and Resolutions 14. Second Reading of Ordinance No. 1697, an Ordinance amending Chapter 9.107 Specific Development Standards (16) Day Care Centers. MOTION: Move to waive the reading of Ordinance No. 1697, there being ample copies available to the public. MOTION: Move to approve Ordinance Amendment No. 1697, an Ordinance amending chapter 9.107 Specific Development Standards (16) of the City Code of 2005 to amend the on-site outdoor play area requirement for child day care centers, and direct staff to send a copy of the ordinance as presented for publication in the legal newspaper. 3 City of Columbia Heights AGENDA May 28, 2024 City Council Meeting Page 4 Bid Considerations 15. Adopt Resolution 2024-42 Being A Resolution Accepting Bids and Awarding a Contract For 2024 Concrete Alley Construction, City Project 2406. MOTION: Move to waive the reading of Resolution 2024-42, there being ample copies available to the public. MOTION: Move to adopt Resolution 2024-42 being a resolution accepting bids and awarding the 2024 Concrete Alley Construction, City Project 2406 to IDC Automatic of Coon Rapids, Minnesota, based upon their low, qualified, responsible bid in the amount of $1,016,455.59 with $996,455.59 from Fund 415.6400 and $20,000 from Fund 653.9699; and, furthermore, to authorize the Mayor and City Manager to enter into a contract for the same. New Business and Reports CITY COUNCIL AND ADMINISTRATIVE REPORTS Report of the City Council Report of the City Manager COMMUNITY FORUM The Community Forum is the public’s opportunity to address the Council regarding any matter that has not had a public hearing earlier in the meeting. Speakers that are in-person are asked to complete a Speaker Form and submit it to the City Clerk. Once called to the podium, the speaker should state their name and connection to Columbia Heights. Speakers attending virtually should send a request to speak as well as their address and connection to Columbia Heights to the moderator using the chat function and wait to be called on to speak. When speaking, virtual attendees should turn their camera on. All speakers should limit their comments to five (5) minutes. Personal attacks, threats, the use of profanity, and other disrespectful comments are prohibited. The City Council will listen to the public comments, ask clarifying questions, and if needed, request staff to follow up or direct the matter to be added to an upcoming agenda. Generally, the City Council will not take official action on items raised at the Community Forum at the meeting on which they are raised. ADJOURNMENT 4 PROCLAMATION ARBOR DAY – ARBOR MONTH WHEREAS: Trees and forest soils keep our lakes and streams clean by absorbing and filtering pollutants and sediments; and WHEREAS: Forest soils prevent flooding and reduce stormwater by capturing and storing rainwater and snowmelt, which is then slowly released to our lakes, streams, and groundwater; and WHEREAS: Careful management of our forests is one of the best ways to protect drinking water and reduce the cost of water treatment; and WHEREAS: Sound management of forested public lands surrounding the Mississippi River ensures clean drinking water for more than one million Minnesotans; and WHEREAS: About three-quarters of Minnesotans get their drinking water from the forested parts of the state; and WHEREAS: Planting trees is a natural and easy way to keep our water clean; and WHEREAS: The last Friday in April, and throughout the month of May, Minnesotans pay special tribute to our trees as natural resources and rededicate ourselves to the vitality of our forests. NATIONAL PUBLIC WORKS WEEK Proclamation WHEREAS, public works services provided in our community are an integral part of our citizen’s everyday lives; and WHEREAS, the support of an understanding and informed citizenry is vital to the efficient operation of public works systems and programs such as water, sewer, streets and highways, parks, public buildings, solid waste collection, and snow removal; and WHEREAS, the health, safety and comfort of this community greatly depends on these facilities and services; and WHEREAS, the quality and effectiveness of these facilities, as well as their planning, design, and construction, is vitally dependent upon the efforts and skill of public works officials; and WHEREAS, the efficiency of the qualified and dedicated personnel who staff Public Works departments is materially influenced by the people’s attitude and understanding of the importance of the work they perform, NOW, THEREFORE, I, Amáda Márquez Simula, Mayor of the City of Columbia Heights, do hereby proclaim the week of May 19 through May 25, 2024 as “NATIONAL PUBLIC WORKS WEEK” in the City of Columbia Heights, and I call upon all citizens and civic organizations to acquaint themselves with the issues involved in providing our public works and to recognize the contributions that public works officials make every day to protect our health, safety, comfort and quality of life. ___________________________________ Mayor Amáda Márquez Simula (Seal) 6 Item C. PROCLAMATION Amyotrophic Lateral Sclerosis (ALS) Awareness Month 2024 WHEREAS, Amyotrophic Lateral Sclerosis (ALS), known as Lou Gehrig’s disease, is a progressive, fatal neurodegenerative disease that impairs nerve cells, leading to the loss of basic functions like walking and breathing; and WHEREAS, around 30,000 Americans have ALS at any time, with 5,000 new cases annually, and a person dies from ALS every 90 minutes; and WHEREAS, ALS affects all races, sexes, ages, and ethnicities, with 90% of cases having no family history and incidence expected to rise by 70% worldwide by 2040, with military veterans being more likely to develop and die from ALS; and WHEREAS, ALS has no cure, making access to new therapies, durable medical equipment, and communication technologies crucial, with clinical trials playing a pivotal role in evaluating new treatments and enhancing quality of life; and WHEREAS, the 10th Anniversary of the Ice Bucket Challenge renews our commitment to raising awareness and funding for ALS research, with the ALS Association having funded over $154 million in research globally, supporting over 550 projects; and WHEREAS, our commitment to finding a cure remains strong, aiming to make ALS a livable disease until a cure is found; and WHEREAS, ALS Awareness Month highlights the severe impact of ALS on individuals, families, and communities, and acknowledges ongoing research to eradicate this disease; NOW, THEREFORE, I, Amáda Márquez Simula, Mayor of Columbia Heights, do hereby proclaim the month of May 2024 as ALS Awareness Month in the City of Columbia Heights, County of Anoka, State of Minnesota, U.S.A. PROCLAMATION National Cities, Towns and Villages Month, May 2024 Whereas, the National League of Cities (NLC) was founded in 1924 in Lawrence, Kansas, as the American Municipal Association by state municipal leagues seeking national representation for rapidly expanding municipalities; and Whereas, the nonpartisan NLC is the oldest and largest organization representing over 19,000 cities, towns, and villages across the United States, working with 49 state municipal leagues to strengthen local leadership, drive innovation, and influence federal policies impacting local programs; and Whereas, the NLC, as the voice of municipalities in Washington, DC, has successfully advocated for federal legislative solutions and educated policymakers on local implementation; and Whereas, Columbia Heights is a proud NLC member, benefiting from its research, technical expertise, federal advocacy, and opportunities to learn from other local governments; and Whereas, local governments are the foundation of American democracy, providing 336 million residents with accountable, responsive, inclusive, ethical, and transparent governance, and have been essential in transforming the United States into a leading global nation; and Whereas, Columbia Heights became a village in 1898 (established by the Anoka County Board of Commissioners), Columbia Heights City Charter was adopted in 1921 and is proudly served by Mayor Amáda Márquez Simula, Council Members Connie Buesgens, KT Jacobs, Rachel James, Justice Spriggs, and dedicated public servants; Now, therefore, I, Amáda Márquez Simula, Mayor of Columbia Heights, do hereby proclaim May 2024 as National Cities, Towns, and Villages Month in celebration of America’s local governments and the NLC’s historic centennial anniversary in the City of Columbia Heights, County of Anoka, State of Minnesota, USA. ________________________________ Amáda Márquez Simula, Mayor May 28, 2024 8 Item E. CITY COUNCIL WORK SESSION Mayor Amáda Márquez Simula Councilmembers Connie Buesgens Kt Jacobs Rachel James Justice Spriggs Interim City Manager Kevin Hansen City Hall—Shared Vision Room, 3989 Central Ave NE Monday, May 06, 2024 5:30 PM MINUTES The following are the minutes for the Work Session Meeting of the City Council held at 6:00 pm on Monday, May 6, 2024, in the Shared Vision Room, City Hall, 3989 Central Avenue NE, Columbia Heights, Minnesota. CALL TO ORDER/ROLL CALL The meeting was called to order by Council President Buesgens at 5:45 pm. Present: Mayor Márquez Simula (arrived at 6:10); Councilmember Buesgens; Councilmember Jacobs; Councilmember James, Councilmember Spriggs (departed at 6:35pm). Also Present: Aaron Chirpich, Assistant City Manager / Community Development Director; Andrew Boucher, City Planner; David Cullen, Interim Public Works Director; Mitch Forney, Community Development Coordinator; Kevin Hansen, Interim City Manager; Sara Ion, City Clerk; Joe Kloiber, Finance Director; Matt Markham, Police Chief; Keith Windschitl, Recreation Director; Kelli Wick, HR Director WORK SESSION ITEMS 1. 8.106 - Chickens. City Planner Andrew Boucher led a presentation on the current status of City Code 8.106 related to keeping chickens in the City. Additionally, Assistant City Manager Aaron Chirpich clarified that the League of MN Cities has stated based on MN law that chickens are not to be considered as livestock. Councilmember Jacobs stated that she is not against chickens, but want s to address concerns from residents. She feels that regulating chickens is the same as regulating the number of pets that are allowed in the home. She wants to have licensing or permitting of the keeping of chickens as it is in line with surrounding communities. She has received over 50 calls related to backyard chickens and feels that the calls are directed towards her because other Councilmembers keep chickens. Councilmember James and Councilmember Spriggs stated that they have not received complaints and do not have a pressing need to move forward on the issue. Councilmember James would like to utilize the existing components of City Code to enforce concerns related to noise, and waste treatment. Councilmember Buesgens asked about the staffing level needed to execute inspections. She indicated that we do not license pets, so why would we license chickens. If we were to 9 Item 1. City of Columbia Heights MINUTES May 06, 2024 City Council Work Session Page 2 move forward, she would like to refine the ordinance to regulate how complaints are managed and provide education to residents. Assistant City Manager Chirpich stated that this would potentially fall under the City Planner or property maintenance inspections. Interim City Manager Hansen inquired if there are recent concerns related to Chickens that Staff has taken. His concern was related to neighbor-to-neighbor disputes. City Planner Bouche stated that there were a few concerns related to the topic. Assistant Manager Chirpich recommended an amendment to the existing code, and this process would flow through the Planning Commission. This process would take several months and consultation with the City Attorney. Staff will also follow up on nuisance call data related to this issue. 2. Liquor Store 3 Redesign. Finance Director Joe Kloiber led the overall presentation on the options for the Store 3 Redesign to address the addition of a potential municipal marijuana sales space added in the Wold Architecture Design. Councilmember Jacobs was concerned about losing the original intent for the purchase of the building. Councilmember Buesgens would prefer option two, related to the costs of construction. Finance Director Joe Kloiber stated that the situation with the flux in regulatory environment would impact the repayment timeframe related to buildout of a dispensary. He additionally reviewed updates related to the status of this in the MN State Legislature to give information to address the concerns related to the buildout and implementation of the statewide licensing requirements. The City would be able to obtain the space to open a location faster than it would be able to build one out. Mayor Márquez Simula stated that she felt options one and two were very similar, but that option one is the best fit. She would also like to revisit rebranding TopValu and would like to use the funds to refine what we are already doing. Councilmember James prefers options one and two, and inquired if the increase in revenue would cover the costs. Finance Director Kloiber confirmed that recovering the costs and increasing sales is very important, and he stated that the road closure on 37 th impacted Store Two immensely. Doing the remodel for store three in advance of the construction on Central Avenue would be critical. 10 Item 1. City of Columbia Heights MINUTES May 06, 2024 City Council Work Session Page 3 Mayor Márquez Simula would like to follow up with the past conversation related to mini liquor bottles. Finance Director Kloiber stated that it would be best not to restrict the product , but to take the initiative to prevent litter. He stated that it was a profitable product. The consensus of the Council was to move forward with design option one. Added Agenda Item: Information from New Police Chief Markum. Mayor Márquez Simula introduced Police Chief Markum and he gave a few updates related to the updates in the department. Councilmember James clarified that the information that is sent to the Council is generally public data. She would like for Chief Markham to clearly state when things are not public data / information when he emails. Councilmember Buesgens followed up related to concerns for traffic enforcement. Chief Markum clarified that Captain Johnston was following up with the newly appointed Captain in charge of traffic enforcement on Central. 3. Status of Youth Commission. Communication and Engagement Coordinator Will Rotler presented concerns related to the status of the Youth Commission. Additionally, he gave information about the struggles that the commissioners have encountered in attendance because of school and work commitments, and that it might be good to add the members of the Youth Commission to the existing city commissions instead of having a stand-alone Youth Commission. Councilmember Buesgens asked about the continued engagement of the Youth Commission. She is concerned that the Youth Commission did not have a specific task. Rottler clarified that it can be hard to get commitments and quorums. Councilmember James stated that she likes the idea of assigning Youth Commissioners to the existing commissions. Councilmember Jacobs would like to see the youth commissioners become non-voting members of the existing commissions. Mayor Márquez Simula stated that she was glad that the City tried this to get a feel for what works best. The consensus of the Council was to move forward with structuring youth involvement to what the City of Eden Prairie currently does. 11 Item 1. City of Columbia Heights MINUTES May 06, 2024 City Council Work Session Page 4 4. Community Survey Questions for Murzyn Hall. Interim City Manager Hansen led an overview of the results of the community survey from 2022, and focused on the feedback that the community gave related to wanting more of a community center vs. event space. He proposed putting together questions with the Communications team to gather feedback regarding programing and future use. Councilmember Buesgens inquired about utilizing the kitchen space for food truck rental. Director Windschitl addressed the question by saying that would interfere with the exi sting rental of the event space. The Council further refined the questions that they would like to move forward and gave direction to Interim City Manager Hansen. Mayor Márquez Simula would like to make sure that there is a disclaimer that this is for future use, not immediate updates when the questions are ready to be directed to the residents. 5. Bituminous Paving of Two City Lots. Interim City Manager Hansen led a presentation of the two lots that need to be paved. These lots are located at the Library as well as the space behind City Hall and the plans to move forward with the process. This item will be placed on an upcoming Council Agenda for approval. 6. Polling Place Locations. Interim City Manager Hansen led the overview of the concerns that the school district addressed to State Election Officials regarding the safety of students and impact to the curriculum when the ISD 13 schools are used as a polling location. The consensus of the Council was to wait until 2026 for updates to polling locations. 7. Council Corner. Updates from council regarding schedules, information sharing and priorities for continued education. Proposed Resolution Urging the Department of Homeland Security to Grant Ecuador Temporary Protected Status (TPS). Councilmember James inquired if the Council would be interested in adding this item as a resolution for the Council’s approval. The council supported the addition of this item to the May 13th City Council Meeting. 8. Old Business. There was no outstanding items to review from the April work session. 9. Review of City Manager Contract Patty Heminover, Baker Tilly Consultant led an overview of the process for pulling together 12 Item 1. City of Columbia Heights MINUTES May 06, 2024 City Council Work Session Page 5 a contract for current Assistant City Manager Chirpich to take on the position of City Manager. Assistant City Manager Chirpich stated that overall he has been reviewing options for reducing risk for City Managers that had not been provided for in previous contracts. The Council did not have any specific questions for Assistant City Manager Chirpich , and after presenting the proposed contract to Council he left the room. Heminover inquired if the Council was worried about any of the items that were presented and would like additional direction from the Council on what direction the Council wants to take with the contract. Councilmember James inquired if there was anything in the contract that would be an issue or something that has red flags. She was concerned with the 180-day period for removal before and after an election. Heminover clarified for the Council that there was nothing in the contract that would be an issue, or something that is new. Councilmember Buesgens stated that she liked the stability of 180 days before and after. Heminover and HR Director Wick will review and give an update to the proposed language. She will then get final information to the Council, the City Attorney and then finally to the Assistant City Manager Chirpich. MOTION: Move that in accordance with Minnesota Statute 412.271, subd. 8 the City Council has reviewed the enclosed list to claims paid by check and by electronic fun ds transfer in the amount of $2,324,614.98. PUBLIC HEARINGS 15. First Reading of Ordinance 1698, Creating a Housing Trust Fund Within the City of Columbia Heights, and Designating the EDA as the Fund’s Administrator. Community Development Coordinator Forney noted that Ordinance 1698 would create a Housing Trust Fund within the City and designate the EDA as the Fund’s administrator. During the 2023 legislative session, the Minnesota legislature passed an omnibus housing finance bill (HF2335/SF 2566). The bill earmarked millions of dollars for a variety of agencies and programs dedicated to the current issues in the housing market. Article 5 of the bill established the metropolitan region sales and use tax. This tax required the Metropolitan Council to impose a metro sales tax of 0.25% on sales made in the metropolitan counties or to a destination in the metropolitan counties. Funds received from the tax are distributed: 25% to the State’s rental assistance program, 25% to the metropolitan city aid account, and 50% to the metropolitan county aid account. Community Development Coordinator Forney stated the metropolitan city account disburses local affordable housing aid to cities via distribution factors. Calculations made as of June 30th 2023, expect Columbia Heights to receive $260,089 annually. These numbers are preliminary, and the City will not know how much it is set to receive until the funds are released in June or July. These funds must be used for affordable housing initiatives or projects and must qualify under the law. State law also establishes that all funds must be spent on qualifying projects by December 31 of the third year after the aid was received. This requirement can be bypassed if: the city can prove that by no fault of its own it could not expend all the funds, the city places the received funds into a housing trust fund, and the funds used from the trust fund go to qualified projects. Community Development Coordinator Forney explained that cities can put the funds into a housing trust fund which would prove the city has “spent” the funds. This allows cities more time to distribute the funds on qualifying projects. Community Development Coordinator Forney mentioned that the Minnesota Housing Finance Agency (MHFA) also received $4,800,000 money from 2023 legislative session for their Local Housing Trust Fund Grants. The Local Housing Trust Fund Grant program is 16 Item 2. City of Columbia Heights MINUTES May 13, 2024 City Council Meeting Page 4 stricter than the affordable housing sales tax funds, but Staff see the local housing trust funds purpose as a tool to develop and maintain affordable housing. This also opens the fund for application to the Local Housing Trust Fund Grants. The EDA will discuss applying to the grant program after establishment of the fund. Ordinance 1698 also designates the EDA as the administrator of the fund. The City’s HRA has delegated its powers to the EDA making the EDA best suited to administer the programs and projects the fund will be used for. In the past the EDA has established and administered the City’s housing initiatives. Mayor Márquez Simula opened the public hearing. There were no public comments. Motion by Councilmember Buesgens, seconded by Councilmember James, to close the hearing and waive the reading of Ordinance No. 1698, there being ample copies available to the public. Motion by Councilmember Buesgens, seconded by Councilmember Jacobs, to set the second reading of Ordinance No. 1698, being an ordinance establishing a Housing Trust Fund, and designating the Columbia Heights Economic Development Authority as the administrator of the fund, for May 28th, 2024, at approximately 6:00 p.m. in the Council Chambers. Councilmember James expressed her excitement over how the money would be spent. She added that the City is looking to create new projects as well as work on affordability and fixing the aging housing stock. Mayor Márquez Simula added that she is grateful that the City can be creative in the projects. All Ayes, Motion Carried 4-0. ITEMS FOR CONSIDERATION 16. Consideration of a Rental License Exemption for 3857 Quincy Street NE. City Planner Boucher stated on April 17, 2024, the owner of 3857 Quincy Street NE, reached out to the Community Development Department requesting an exemption from the single-family rental density cap. The property is located on Block 143 with six (6) single family rentals out of 38 total single-family units and an allotment of four (4) single family rentals. Section 1 of Ordinance 1685, which established the single -family rental density cap, states that: “If the number of detached single-family dwellings rental properties meets or exceeds the permitted number of rental properties per defined block on the effective date of the ordinance from which this section is derived, a property owner may request a temporary license to allow an additional rental property for that block. The City Council may grant or deny a temporary license in its sole discretion. Persons requesting a temporary license must make an annual application to the City. No property owner shall hold a temporary rental license for the same property for more than two consecutive years.” City Planner Boucher mentioned as it is the homeowners’ right to appeal to the Council. Staff brought forth the appeal along with supporting documents for discussion and review. If approved, Resolution 2024-034 would grant a temporary rental license exemption to the 17 Item 2. City of Columbia Heights MINUTES May 13, 2024 City Council Meeting Page 5 homeowner with a few additional requirements. The homeowner is required to complete the license application process within 3 months from the passage of the resolution. This puts a limit on how long they can take to bring the house into rental compliance if needed. The temporary rental license will be valid for one year from the date that the license is approved. This provides the homeowner and tenant the ability to rent the home for a full one-year lease. After the term of the temporary license, the persons requesting a temporary license must make an annual application to the City. No property owner shall hold a temporary rental license for the same property for more than two consecutive years. Staff recommends to deny the application. All Ayes, Motion Carried 4-0. 17. Consideration of a Rental License Exemption for 4314 7th Street NE. City Planner Boucher explained that on May 1, 2024, the owner of 4314 7th Street NE, reached out to the Community Development Department requesting an exemption from the single-family rental density cap. The property is located on Block 70 with four (4) single family rentals out of 23 total single-family units and an allotment of two (2) single family rentals. The property owner will not be residing on the property. Councilmember Jacobs asked if it was an income property. City Planner Boucher replied that it would be and the property owner would be renting it out to a friend that will be the property manager. Councilmember Jacobs asked if it would be a homestead. City Planner Boucher replied that it would be. Rachel Yenko-Martinka, property owner, explained that she has to partially travel for work which is why she would not be able to reside in the home. In addition, having someone rent the property would allow her to pay for the mortgage while she is away for work. She added that she hopes to find a job that would allow her to build roots in the City. Councilmember Jacobs asked Ms. Yenko-Martinka if the home would be her primary residence. Ms. Yenko-Martinka replied that it would be. Councilmember Jacobs asked if she could have roommates instead of having a rental property. Ms. Yenko-Martinka explained that it would be helpful to have the door o pen for a rental property so she would be able to protect herself and the renters since she might not personally know who is residing in the home. 18 Item 2. City of Columbia Heights MINUTES May 13, 2024 City Council Meeting Page 6 Councilmember Jacobs asked Ms. Yenko-Martinka if there was someone available to live in the home. Ms. Yenko-Martinka explained that if the rental license is approved, then she has someone that would be able to move in. Councilmember Jacobs asked if that could qualify as a roommate. Ms. Yenko-Martinka explained that she would like the ability to rent out her room while she is traveling for work. City Planner Boucher added that the plan would be for Ms. Yenko-Martinka’s friend to be the primary tenant, resident, and property manager. Mayor Márquez Simula asked Ms. Yenko-Martinka if she was hoping to rent out her room month to month. Ms. Yenko-Martinka replied that she was hoping to do that. Councilmember Buesgens explained that if Ms. Yenko-Martinka received approval of the license, she would have to file as non-homestead and would have to pay higher taxes as a landlord. Mayor Márquez Simula asked when the property was purchased. Ms. Yenko-Martinka replied that she closed on the property in December. Councilmember Jacobs asked Ms. Yenko-Martinka if she was traveling as much for work during the time she was purchasing the home. Ms. Yenko-Martinka replied that she was and has the intention of changing jobs. Councilmember Jacobs noted that the job change has not occurred yet. She encouraged Ms. Yenko-Martinka to put things in place that may affect the homestead tax and to make a decision about that before moving forward. Ms. Yenko-Martinka mentioned that if the application was approved, she would make sure to look into all of the information before moving onto the next step. Mayor Márquez Simula noted if the rental license was granted, there is a time limit on how long the property can be rented for and after two years, Ms. Yenko-Martinka would need to live on the property. Councilmember James mentioned that she is in favor of the exemption. Motion by Councilmember James, seconded by Councilmember Buesgens, to waive the reading of Resolution 2024-038, there being ample copies available to the public. All Ayes, Motion Carried 4-0. City Planner Boucher stated on April 28, 2024, the owner of 4356 Quincy Street NE, reached out to the Community Development Department requesting an exemption from the single-family rental density cap. The property is located on Block 123 with three (3) 19 Item 2. City of Columbia Heights MINUTES May 13, 2024 City Council Meeting Page 7 single family rentals out of 20 total single-family units and an allotment of two (2) single family rentals. Councilmember Buesgens noted in the application it mentions that a tenant was moved from 4205 Quincy Street NE to 4356 Quincy Street NE in September. She asked if the applicant had a rental license during that time. Councilmember James noted in the applicant’s email, it states that the property owner is looking to sell the property to the current occupant of the home which means that someone other than the property owner is occupying the home at this time. Councilmember Buesgens added that someone is living there as a tenant and not a roommate without a rental license. City Planner Boucher explained that the property owner currently has a rental license for the 4205 Quincy Street NE property but not for the 4356 Quincy Street NE property. Mayor Márquez Simula mentioned that the applicants email indicates that a tenant was moved to the 4356 Quincy Street NE property while the property owner did not have a rental license. City Planner Boucher noted that the rental license for 4356 Quincy Street NE expired on April 30. 2024. Councilmember Buesgens asked if the property owner did not get the applicant in time for the 30 days to roll over the rental license. Community Development Coordinator Forney explained that the Ordinance states that if a single -family rental is sold, it lapses and it is required to re-enter the rental license process. Councilmember Buesgens asked if the home was purchased as an investment property. Community Development Coordinator Forney replied that it was purchased as an investment property as an LLC. The property owner did not do his homework on if the license would transfer as an LLC. Councilmember James noted that the applicant reached out to the City on April 25, 2024 which was before the rental license lapsed. She added that the property owner may not have been collecting rent illegally. Mayor Márquez Simula asked if the property owner wanted the rental license until the new owner can afford the down payment. City Planner Boucher replied that was correct and the new owner would have a minimum of the one year period. There would be an ability to apply for the rental license for an additional year. The applicant has the intentional to transfer the property to the current occupant. Councilmember Jacobs expressed her concern that the applicant purchased the home as an income property, he was not present at the City Council meeting, and that he moved someone into the property as a tenant. City Planner Boucher explained that the applicant reached out to the City before the license was expired. Councilmember Jacobs explained that the rental license stopped when the property was purchased in September 2023. It was not until the rental license renewal was due in April when it was caught that there was no rental license on the property. She asked if there was no rental license on the property from September until April. City Planner Boucher replied that that was correct. Councilmember Jacobs noted that there are other options such as 20 Item 2. City of Columbia Heights MINUTES May 13, 2024 City Council Meeting Page 8 contract for deed, or keep the tenant in the property that had a rental license on it. She mentioned that she would be troubled to approve the rental license. Motion by Councilmember James, seconded by Councilmember Buesgens, to waive the reading of Resolution 2024-039, there being ample copies available to the public. All Ayes, Motion Carried 4-0. Motion by Councilmember James, seconded by Councilmember Jacobs, to adopt Resolution 2024-039, being a Resolution of the City Council of the City of Columbia Heights approving the single-family rental exemption request for the rental application at 4356 Quincy Street NE, Columbia Heights, MN 55421. All Nays, Motion Failed 0-4. Ordinances and Resolutions 19. Temporary Protected Status Resolution. Councilmember James explained that the Temporary Protected Status Resolution is an opportunity for the City to call on the U.S. Department of Homeland Security to add the Country of Ecuador to the list of the other 16 nations that already receive temporary protection status. This would allow an opportunity for those who come from Ecuador going through the immigration system to receive work permits and be free from deportation while they wait for their court date. Minnesota has received many immigrants from Ecuador. Councilmember James read Resolution 2021-41. Jose Narvaez, City resident, stated he has lived in Columbia Heights for more than 30 years. He explained that he has not been able to retire because he is undocumented. He has considered returning to Ecuador many times but due to the instability in Ecuador, he has remained in the United States of America. He asked the community for their support. Alexandra Giler Aquilar, City resident explained that she had to flee from Ecuador because she sent someone to jail for molesting her daughter. Due to the jail in Ecuador, they sent people to harass her and her family. The people running jails in Ecuador are very powerful and it is not safe. She added that she hoped the Resolution would go through so that she could be safe here. Mayor Márquez Simula mentioned that the speakers were brave and belong to the City. She thanked Councilmember James for bringing the Resolution to the Council work session. She added that WCCO has done a video on the Columbia Heights school districts on how the district is embracing new residents. She encouraged the community watch it by googling WCCO Columbia Heights Spanish Speaking. Motion by Councilmember James, seconded by Councilmember Jacobs, to read and approve Resolution 2024-41, being a Resolution of the City Council of the City of Columbia Heights calling for temporary protected status for Ecuadorian Immigrants. All Ayes, Motion Carried 4-0. 21 Item 2. City of Columbia Heights MINUTES May 13, 2024 City Council Meeting Page 9 20. Minor Subdivision for 5085 Central Avenue NE. City Planner Boucher stated the Architects Partnership, LTD on behalf of Chase Bank and La Casita, has requested approval of a Minor Subdivision proposing to split a portion of the La Casita parking lot into two separate parcels and in preparation of const ruction of a new 3,365 square foot banking facility with a drive-thru ATM on the proposed parcel located at 5085 Central Avenue NE (between 51st Ave/CT NE and Central Avenue NE). City Planner Boucher noted the applicant is proposing to subdivide the existing 1.67 acre parcel and remove 52 of the 135 parking spaces on-site to create two separate lots. The subject site is located at the northern end of the municipal boundary along Central Avenue and the surrounding adjacent properties are all zoned for Comme rcial use through the General Business District; further to the south, east, and west of those commercial properties are pockets of multi-family, duplexes, and single-family residential zoning adjacent to Central Avenue. The subject site is zoned, General Business District, and the use as a financial institution with a drive-thru ATM is permitted use in the district subject to Specific Development Standards 9.107 (18) for a drive-up facility. City Planner Boucher explained the proposed subdivision would reduce the required parking for the restaurant to 83 parking spaces which is below the minimum requirements of 91 parking spaces for the restaurant, a deficit of 8 spaces. A total of 11 parking spaces are required for the financial institution, one (1) per 300 gross floor area; the applicant is proposing 14 parking spaces creating a combined deficit of 5 spaces. A shared parking agreement is a necessary condition of approval subject to approval by the City Attorney and filed with the Anoka County Recorder’s Office within 60 days after approval of the shared parking use to ensure that both uses have compliant parking. As conditioned, the proposed minor subdivision meets subdivision regulations in accordance with City Code. City Planner Boucher mentioned that as part of the code analysis, the lot area, width, building and parking setback requirements per 9.100.C and subdivision regulations per 9.116 of the Zoning Ordinance have been satisfied. City Planner Boucher reviewed the findings of fact. Section 9.104 (K) of the Zoning Code outlines specific conditions for the City Council to approve a minor subdivision as follows: 1. The proposed subdivision of land will not result in more than three lots. The proposed subdivision will result in two conforming lots. 2. The proposed subdivision of land does not involve the vacation of existing easements. No vacation of existing easements will occur as a result of the minor subdivision. 3. All lots to be created by the proposed subdivision conform to lot area and width requirements established for the zoning district in which the property is located. Both newly created lots will conform to the lot width and lot area requirements of the applicable GBGeneral Business zoning designation. 4. The proposed subdivision does not require the dedication of public rights-of-way for the purpose of gaining access to the property. 22 Item 2. The proposed subdivision meets all the design standards specified in Section 9.116. As a condition of minor subdivision approval, all applicable design standards of Section 9.116 of the Zoning ordinance must be satisfied. City Planner Boucher noted that Staff have coordinated with the City Engineer and the Fire Department. The Staff review finds that the proposed Minor Subdivision application meets the requirements of the Zoning Ordinance as conditioned: 1. A shared parking agreement between La Casita and Chase Bank shall be proposed and subject to approval by the City Attorney and filed with the Anoka County Recorder’s Office within 60 days after approval of the shared parking use to ensure that both uses have compliant parking. 2. The applicant shall be responsible for filing the approved subdivision with the Anoka County Recorder’s Office. The approved minor subdivision shall become invalid if the subdivision is not filed with the Anoka County Recorder’s Office within one year of the date of City Council Approval. 3. The applicant shall adhere to the requirements and comments provided by the City Public Works and Engineering Departments in a memo dated April 17, 2024. The applicant is responsible for filing and recording any proposed easements with Anoka County Recorder’s Office. 4. A cross access easement for vehicular movement is required to be filed and recorded with Anoka County Recorder’s Office to provide access perpetually for all current and future owners. Councilmember Buesgens asked what the history was on how La Casita and Chase began discussions. City Planner Boucher replied that he does not know how discussion began but Chase pursued La Casita and that they came to an agreement together. Councilmember Buesgens noted that she is not concerned with the parking. City Planner Boucher agreed and added that the peak hours for both businesses occur at different times. 23 Item 2. Councilmember James expressed her excitement at seeing development on Central Avenue. She noted that the Planning Commission voted 7 -0 to approve and that she trusts the Planning Commission members. City Planner Boucher noted that the project is zoned as Opportunity in the Comprehensive Plan. Mayor Márquez Simula noted that the project is an opportunity for landscaping development. City Planner Boucher added that the developer is proposing to reduce about 2,000 square feet of impervious surface as well as proposing to keep some trees and plant additional ones. He mentioned that they are committed to sustainability. Motion by Councilmember Buesgens, seconded by Councilmember Jacobs, to waive the reading of Resolution 2024-036, there being ample copies available to the public. All Ayes, Motion Carried 4-0. Motion by Councilmember Buesgens, seconded by Councilmember Jacobs, to approve Resolution 2024-036, being a Resolution of the City Council of the City of Columbia Heights approving a Minor Subdivision for the property located at 5085 Central Avenue NE, within the City of Columbia Heights, Minnesota, subject to certain conditions stated in the resolution. All Ayes, Motion Carried 4-0. 21. First Reading of Ordinance No. 1696, an Ordinance amending Chapter 9.106 General Development Standards (M) to establish Tree Preservation and Planting Standards. City Planner Boucher explained at the April work session, City Council discussed a potential amendment to City Code 9.106 General Development Standards in relation to amending Landscape and Screening Requirements to include Tree Preservation and Planting Standards and directed the City Planner and Urban Forester to prepare a zoning te xt amendment for the May 7, 2024 Planning Commission meeting. Tree preservation ordinances were examined by peer-reviewing other cities such as Fridley, New Hope, Shakopee, St. Anthony’s Village, Maple Grove, and Minneapolis for key components. Fridley, St. Anthony’s Village, and Minneapolis do not have tree preservation ordinances. Additionally, Staff have consulted with the League of Minnesota Cities and the City Forester for their guidance on what a model ordinance should include. City Planner Boucher mentioned that Staff felt that it was necessary to mend the existing ordinance to establish a process to include the City Forester in development review and adopt standards aligned with industry and agency best practices as well as reflecting the securities and letter of credit language seen across the municipalities. The current Ordinance does not reflect the most up to date information, standards or processes that ensure successfully mature tree canopies or preservation of the existing canopy. City Planner Boucher stated the 6th U.S. Circuit Court of Appeals in F.P. Development, LLC vs. Charter Township of Canton, Michigan found that, Canton’s ordinance classification of certain trees as “significant trees”, created permitting requirements, restricted tre e 24 Item 2. City of Columbia Heights MINUTES May 13, 2024 City Council Meeting Page 12 removal, and required mitigation for removal. A property owner that removed trees was required to either pay into a town fund or replant trees; the town enforced action against a developer that removed 159 trees and argued that, under the ordinance, the developer had to replant trees or pay the town approximately $50,000. The 6th Circuit found that the ordinance violated the Fifth Amendment’s “unconstitutional conditions” doctrine, if a permit is conditioned on the waiver of constitutional rights, then the local government permitting may be found unconstitutional. Local governments may choose whether and how a permit applicant mitigates developmental impacts, but they must establish an “essential nexus and rough proportionality to those impacts” and “make some sort of individualized determination that the required mitigation is related both in nature and extent to the impact of the proposed development.” City Planner Boucher reviewed the required findings for the zoning text amendment. 1. Councilmember Buesgens explained that she is in favor of the Ordinance. She clarif ied that the Ordinance does not apply to residential properties. City Planner Boucher replied that it does apply to residential properties. It applies to everything that requires a survey. Councilmember Buesgens noted that during the Planning Commission meeting, a resident mentioned that they were sad that their neighbor cut down all of their trees so that they did not have to deal with the leaves. She suggested that Staff consider having an educational pamphlet to educate the community about the importance of trees. Mayor Márquez Simula added that it could be helpful to include how various trees drop their leaves so home owners can know what type of tree they would prefer. Councilmember James mentioned that she has spoken with quite a few community members about the Ordinance. Many are in favor of the Ordinance while others have questions regarding if a tree is in the way of a house and being able to remove and replant a tree. She asked where people can go if they have detailed questions. City Planner Boucher replied that it would apply to trees that are within 10 feet of the building footprint and are identified as protected trees. Questions can go to the City Forester. 25 Item 2. City Planner Boucher replied that there is a section that addresses how to remove diseased trees. Mayor Márquez Simula mentioned that this is case-by-case and the goal is not to stop someone from developing a space. The goal is more to avoid someone from clearing all of the trees on a property where trees could have been saved. She added that the City desires to work with people. She mentioned that the City values trees and is a Tree City. All Ayes, Motion Carried 4-0. 22. First Reading of Ordinance No. 1697, an Ordinance amending Chapter 9.107 Specific Development Standards (16) Day Care Centers. City Planner Boucher explained that JDA Design Architects, Inc. representing Mohamed Abdulle has requested approval of a Zoning Ordinance Amendment to amend Specific Development Standards in City Code 9.107 for Day Care Centers. The applicant is proposing to modify (16)(c): a requirement for child day care centers to provide at least 75 sq. ft. of outdoor play area for each child under care to allow for the submission of a written plan to use an adjacent public park to satisfy this requirement subject to approval by the City Manager or their designee. The proposed text amendment would make the City Code less restrictive and bring local requirements into alignment with MN State Statute 9502.0425 (Physical Environment) which allows day cares to use public parks if the on -site play areas are not sufficient. City Planner Boucher stated that Staff have worked with the owner of 2201 37th Avenue NE, a block south of Prestemon Park, on a proposed child day care center building permit application through administrative review under the current code requirements providing a 2,700 sq. ft. on-site play area as well as on the proposed zoning text amendment which would allow the applicant to serve a greater number of children. The proposed zoning text amendment changes the child day care outdoor play area language to reflect the standards that allow adult day care facilities to use an adjacent park subject to approval of a written plan reviewed by the City Manager or their designee. The applicant is prepared to move forward with building the on-site play area, but that would limit the occupancy of the day care center; whereas, if the zoning text amendment were approved, then they would be able to increase their occupancy. City Planner Boucher mentioned that Staff examined existing day care facilities and their outdoor play areas, zoning districts that allow child and adult day care facilities as uses, and identifying parks that would be within the 1,500-foot distance from any commercially 26 Item 2. City of Columbia Heights MINUTES May 13, 2024 City Council Meeting Page 14 zoned properties to better understand the impact of the proposed zoning text amendment. There are approximately 11 existing day care centers that the amendment would apply to, but each of these centers appears to provide on -site play areas or are on a site, such as a place of worship or school facility, that has those facilities readily available. Existing day care centers would be able to expand their operations if their occupancy is currently limited by the on-site play area, but this amendment would likely be more applicable to future day care centers. City Planner Boucher stated Staff also examined the city code requirements of Andover, Big Lake, Maple Grove, Minneapolis, Minnetonka, Richfield, Roseville, and Saint Paul to better understand how cities are regulating day care facilities in relation to MN State Statute 9502.0425. Cities such as Andover, Richfield, and Roseville do not have specific development standards for day care centers and adhere to the state requirements. Big Lake, Maple Grove, and Saint Paul require play areas for day cares to be enclosed with a fence. Minneapolis allows for public parks to be used accessory to a childcare center. City Planner Boucher noted that the proposed zoning text amendment would not be applicable to every City park, only City parks that are within 1,500 feet of a commercially zoned property where a future child day care center could propose a written plan to use one of the parks. The remaining parks are either outside the distance allowed for a day care to use the park or do not have any commercial zones where a child day care center would be allowed. The parks that were identified and property owners within 350 feet of the identified parks were sent a notice of the Public Hearing are:  Edgemoor Park  Gauvitte Park  Huset Park  Labelle Park  Prestemon Park  Sullivan Lake Park City Planner Boucher reviewed the required findings for the zoning text amendment. 1. The amendment is consistent with the comprehensive plan. The City’s 2040 Comprehensive Plan identifies establishing and maintaining a strong sense of community, strengthening the identity and image of the community as a desirable place to live, work, and play, and promoting the safety of residents and ensure a safe environment for pedestrians, bicyclists, and other vulnerable roadway users as some of the land use goals and policies. 2. The proposed amendment will allow for more child care capacity and remove a barrier to entry for future day care providers while also providing the City with greater understanding how public parks are being used. 3. City Planner Boucher explained that the Public Works Department, Police Department, and Fire Department have been provided copies of the application mate rials and had no concerns regarding the amendment to allow child day care facilities to use a public park in lieu of an on-site play area. The Building Official provided a memorandum of understanding regarding accessible playground equipment at day care facilities. The City Attorney does not have any concerns regarding liability as these businesses are required to carry appropriate insurance to cover any potential damages. Furthermore, there does not appear to be an ability for the City to require a waiver of liability. City Planner Boucher mentioned that it is the opinion of Staff that the proposed zoning text amendment, as presented, is consistent with the 2040 Comprehensive Plan and would bring City Code requirements in alignment with MN State Statute 95 02.0425 governing the physical environments of day care facilities. The proposed text amendment is identical to a previous zoning ordinance amendment from 2017 that was approved by City Council and the requirement of an approved written plan will benefit p roviders as well as the City to ensure that public access of the parks is not compromised. City Planner Boucher noted in this regard, the following Zoning Ordinance modification to City Code 9.107 Specific Development Standards is recommended by Staff and is highlighted in red: 1. The existing specific development standards for Day Care Centers shall be amended to include additional language for “child day care facilities” that specifies that if a subject property does not have sufficient outdoor play area on -site, then the property owner must submit a written proposal that demonstrates that recreational activities for adults under the facility’s care will be provided off-site subject to approval or denial by the City Manager or their designee. 28 Item 2. The following uses are subject to specific development standards: (16) Day care center (c) For child day care facilities, at least 75 square feet of outdoor play area shall be provided for each child under care. If there is not sufficient space for an outdoor play area on-site, then the property owner must submit a written proposal that demonstrates recreational activities for children under the facility’s care will be provided off-site within 1,500 feet of the facility. Councilmember Buesgens noted that she attended the Planning Commission meeting as the City Council liaison and learned that there are 15 day care centers in the City at this time. There were people in attendance that were both in favor and against this Ordinance. Those that were against the Ordinance had concerns regarding liability and the number of children being brought to a park. Notices were sent to about 1,000 residents. She asked if there were restrooms at the parks for the children. Interim City Manager Hansen replied that there are portable restrooms at the parks. Councilmember Buesgens asked if t hey were near the playground since that is where children would be playing. City Manager Hansen replied that he did not know where each restroom was located at each park and agreed with Councilmember Buesgens concerns regarding restroom placement. Councilmember Buesgens asked if the City would be amenable to offering if the Ordinance passed. Interim City Manager Hansen replied that the City would be. Councilmember James asked City Planner Boucher to share more about how schools may use the public parks. City Planner Boucher replied that there is a section in the State Code reference that allows schools to use public recreational facilities such as parks. Councilmember Jacobs explained that she does not have an issue with adult day care use but has some concerns with child day care using the facilities such as getting the children to and from the park. She noted that the Building Official recommends to keep playgrounds on site of daycares and that it holds a lot of weight for that to be the recommendation. City Planner Boucher explained that a lot of those concerns are in regard s to accessibility and those concerns would remain whether or not the Ordinance was passed. Councilmember Jacobs referenced the Building Official’s memo that states day cares should provide equipment that would best serve the children in their care. City Planner Boucher replied that the current applicant has a building permit and are comfortable meeting either standard. Councilmember Jacobs asked how big the daycare site was. City Planner Boucher replied that the day care would have a maximum of 37 children based on the outdoor play area. It would be a maximum of 60-61 children without the outdoor play area. Councilmember Buesgens mentioned that the residents who were in favor of the day care facility noted that the day care facility is very concerned about the children’s safety and 29 Item 2. It is their job to come up with a plan to maintain the safety of children and they have already discussed which children would be allowed to go to the playground. City Planner Boucher explained that the City can revoke the use of the public play area to day cares if they are not following the requirements wh ich would incentivize day cares to follow the requirements. Councilmember Jacobs stated she would abstain from the vote due to an injury her son experienced at a day care facility. Councilmember James mentioned that there is a child care shortage in the State which effects the economy since people cannot work. She added that she is hopeful that the City can increase the supply of child care and that it is a wonderful opportunity for the City . City Planner Boucher noted that the Ordinance could help Staff have a better understanding about what is happening at the parks from a maintenance and programming standpoint. Mayor Márquez Simula mentioned that it is an equity concern for new businesses by requiring additional financial costs when there is a beautif ul public facility that could be used instead. She added that by having more people at the park it will make them safer as well as provide people an opportunity to spend more time in the City and learn about the community. City of Columbia Heights MINUTES May 13, 2024 City Council Meeting Page 18 Coalition meeting, the Climate Change Updates with Betty McCollum meeting, Police Chief Lenny Austin’s retirement party, the Applebee’s fundraising event for St. Matthew’s theater program, Matt Markham’s swearing in as the new Police Chief, the high school play, the memorial for Marilyn Peters, the Arbor Day tree planting celebration, the live burn by the Fire Department, the Fiddler on the Roof performance at St. Matthew’s, the Planning Commission meeting, and a play at the Plymouth Theater with the senior program. Councilmember James mentioned that she attended many of the events that Councilmember Buesgens attended. She also attended a webinar training for councilmembers on how to reduce evictions in cities. She attended Chief Austin’s retirement party, a play, the Arbor Day tree planting celebration, a lunch meeting with the Mayor and Metropolitan Councilmember Reva Chamblis, the house burning by the Fire Department, the EDA meeting, the Council work session, the blood drive at the Public Safety building, and the soft opening for a new coffee shop opening up. Councilmember Jacobs explained that she attended the live burn by the Fire Department, the retirement party for Police Chief Austin, the oath ceremony for the new Police Chief, the tree planning celebration, the Korean exhibit at MIA to celebrate Asian Pacific American Heritage month, the Twins game to celebrate adopt a drain volunteers, and Fiddler on the Roof at St. Matthew’s. She thanked Interim City Manager Hansen for moving the chicken Ordinance forward. She acknowledged that it is police week and the fallen Officer Curt Ramsdell. Mayor Márquez Simula stated she attended Police Chief Austin’s retirement party, and the new Police Chief’s swearing in ceremony. She thanked the School District, community partners and the City Council for the community survey that provided feedback on what the community would like to see in a new Police Chief. She added that she attended the Joint Law Enforcement Committee for Anoka County (JLAC) meeting, and the Metro Cities annual meeting with Councilmember Buesgens. S he spoke to a class about public service at Bethel University. In addition, she attended the Anoka County Fire Protection Council meeting, saw Wicked Little Letters at the Heights Theater, and attended the corridor planning meeting. She met with Councilmember James and Metropolitan Councilmember Reva Chamblis as well as met with past citizen of the year recipients to discuss who the recipients should be for this year. She congratulated Pizza Man for being the recipient for best Columbia Heights business of the year and noted that she delivered a plaque to the business. She spoke at the State Capitol for the Minnesota Council on Latino Affairs. She attended the Regional Council of Mayors executive team member for planning the EDA meeting, the Council work session meeting, and an operation pollination planning meeting. She expressed her excitement for the new State flag and getting the new flag into the chambers. Councilmember Buesgens mentioned that the bakery items at Fix Coffee at the Central Mix are “to di e for” and encouraged people to try their baked items. City Attorney Lepak asked that the Council revisit item 22 to read the Ordinance since the City Charter requires a reading of the Ordinance if there is not a 4/5 vote to waive the reading. He read the Ordinance Amendment No. 1697, an Ordinance amending chapter 9.107 Specific Development Standards (16) of the City Code of 2005 to amend the on-site outdoor play area requirement for child day care centers, for May 28, 2024. 31 Item 2. City of Columbia Heights MINUTES May 13, 2024 City Council Meeting Page 19 Report of the City Manager Interim City Manager Hansen acknowledged that Matt Markham as the new Police Chief and announced there will be a meet and greet on Tuesday at Circle Terrace Boulevard at the park from 4:00-5:30 pm. On May 17, 2024, there will be an open house by the Recreation Department at Huset Park from 5:30-7:30 pm. Pets in the Park will be held on May 18, 2024 from 1:00-4:00 at Keys Park. The Outstanding Citizen of the Year will be announced during the May 28, 2024 City Council meeting. Interim City Manager Hansen explained that the time of sale program and the fees for it were introduced and begins on May 22, 2024. Questions can go to the Community Development department. COMMUNITY FORUM Dirk Schmitz, City resident, stated something that makes Columbia Heights great is the mature trees. He noted that there are residents who are cutting down mature trees simply because they want to. He wondered if the City Forester could be involved to take inventory and make any recommendat ions on what trees should stay, which ones are diseased, and which ones should be trimmed of dead branches. He mentioned that he saw two people unprofessionally cut down a tree and saw branches on telephone poles. He asked if there was a way to stop this b ehavior. He mentioned that training for fire fighters is helpful and the money spent on it is worthwhile. Mayor Márquez Simula explained that she had the opportunity to experience part of the fire fighter training and noted how impactful it was. Councilmember Jacobs added that her father was a firefighter and has much gratitude and respect for fire fighters. Mayor Márquez Simula expressed her gratitude to Fire Chief Thompson who communicates the needs of all of the firefighters and staff members. She mentioned that the Council recently voted on using some of the ARPA funds to go towards the firefighter’s equipment. Councilmember James noted that tree service contractors are supposed to be licensed in Columbia Heights. Councilmember Buesgens added that if there are questions about if someone is a licensed contractor, community members can call the City. Laurel Deneen, City resident, stated that she is on the Planning Commission and wanted to discuss the day care concern. She noted that while some of the day care children would be from out of the City, many are residents and deserve to be experiencing the parks. She noted that there is an in-home day care on her street, and they use the park nearby frequently. A part of the licensing includes the adu lt- to-child ratio requirement and would be included in the parks as well. She explained that the public may believe that by passing the Ordinance it will mean that many day cares will open and crowd the parks. However, many day cares desire to have play equipment on their own property but some may have barriers on space and in that case, providing them an opportunity to use a nearby park can be helpful. She added that it is important to be equitable to new businesses in the community. Kathy Cooper, City resident, stated that she spoke at the City Council meeting about a month ago regarding her concerns about the Police Department not taking her reports seriously about crimes 32 Item 2. City of Columbia Heights MINUTES May 13, 2024 City Council Meeting Page 20 against vulnerable adults. She scheduled a meeting with Police Captain Johnston and it did not go well because he refused to watch a video entitled “Deception of Protection Anatomy of an Involuntary Guardianship” and refused to prosecute. She had hoped that the Police Department would prosecute a dangerous person who had trespassed on her property on March 14, 2024. She added that Police Captain Johnston promised her many things but has not followed through on any of them. She requested to meet with Police Chief Matt Markham but has not heard back from him. She spoke with Officer Nightingale and explained that she does not want police on her property unless they are invited. Within an hour of having that conversation, two police officers showed up on her property. She expressed her frustration and asked to have a meeting set up with Poli ce Chief Markham. Façade Improvement Grant Report The Golden Nuts, 4801 Central Ave NE Forney reported that the item pertains to The Golden Nuts 2024 Façade Improvement Grant application for their new location at 4801 Central Ave NE. The nuts, candy and international market seeks to add a sign to their storefront and has obtained three bids, with the lowest being $10,551.81. At this cost, they are eligible for the full $5,000 grant. Community Development Staff recommend funding the project in full. The addition of The Golden Nuts will bring increased foot traffic to the area and fill one of the City’s recently vacated store fronts. Renderings of the proposed sign and bids are included in the attached application. The EDA has received a couple of Façade applications for 2023 and 2024. Staff will look into Installing cameras later this year on priority businesses. The EDA has already approved $4,750 this year with $15,000 being asked for at this meeting. Since there are a large number of applicants, Staff will work with the Police Department to determine how to prioritize those cameras. Buesgens asked how much the cameras were. Forney replied last time cameras were installed, five businesses received cameras and it cost $32,000 for all five. It is roughly $6,000 per business. Szurek asked if the cameras would need to be put off since there are so many applicants for the façade improvement grant and there is not enough funding. Forney replied that it was a possibility but noted that there are still funds available. Szurek noted that there is only $30,000 in the grant funds for the remainder of the year. Forney explained that the $30,000 is what is left of the $50,000 that was budgeted for the year. There are still funds in the 408 fund that were not used in previous years. The new owners are applying for the façade grant to restore the buildings openings in preparation for a coffee shop. The previous owner had boarded up the windows and doors of the building, which now need to be replaced. The bid to replace the windows and doors came in at $24,142.94 which is well above the amount needed for a full $5,000 grant. Community Development Staff recommend funding the project in full. Getting a business in to 852 40th, which has been vacant for a long time, is a great addition to the corridor. Improving the windows and doors will have an immediate effect on the look of that corner. The EDA has received a couple of Façade applications for 2023 and 2024. The proposed awning is electric and has boards that can rotate to block the sun or on cooler days be moved to allow for much needed sunlight. Due to the technical specification the Awning is offered by one company which has made it difficult for them to obtain additional bids. The bid comes in at $54,260, which is wel l above the amount needed for the full $5,000 grant. Community Development Staff recommend funding the project in full as it is a major upgrade to one of the City’s cornerstone businesses. President Attest: Secretary 6. 2024 Outstanding Business of the Year Award Forney clarified that this item is the 2024 award and not the 2023 and that it was a forward looking 42 Item 4. City of Columbia Heights MINUTES April 01, 2024 EDA Meeting Page 8 program. Forney reported that in November of 2022, the EDA approved the establishment of the Business of the Year Award. This award set out to recognize local businesses for noteworthy accomplishments, long-standing contributions to the community, and significant community service efforts. The criteria for nomination are based on a variety of notable accomplishments, such as being a long- standing business within the City of Columbia Heights reaching a milestone year, a major business expansion, remodel, exterior renovation, landscaping improvements, or relocation to a new facility within the City, environmentally friendly or sustainability-related initiatives or improvements, a major contribution to the community, or other major accomplishments or contributions worth y of recognition. However, it is important to note that the EDA reserves the right to make no selection if nominations do not meet the standard of recognition. Forney noted this year, the EDA received three nominations all of them for Heights Pizza Man. All three nominations were submitted by various community members. The reasoning behind the submissions includes the owner’s dedication to the community and the businesses partnerships with nonprofit organizations. Heights Pizza Man is known for their philanthropic work, be it supplying food and water to those who cannot afford a meal, fundraising for the local food shelf, or working to give its employees good benefits. In addition to all their philanthropic work, Heights Pizza Man was recently highlighted in the news when the business offered rides home to those who were out late on New Year’s Eve. Forney added that if selected as the Business of the Year, the winning business will be honored with a plaque during a brief presentation at a City Council Meeting, marketing of the ach ievement at City events and on City reader board signs, and a recognition article posted on the City's website and newsletter. Questions/Comments from Members: Márquez-Simula mentioned that the Mayor did a recognition for Heights Pizza Man’s efforts in 2022. Purchase of 4416 Central Ave NE, Purchase Agreement and Budget Amendment approval Forney reported that Staff are bringing forth, for consideration, the purchase of the property located at 4416 Central Avenue NE. In early March, one of the owners of the property reached out to the city to see if we would be interested in purchasing the property. As the property is zoned general business, the acquisition of the property falls within the confines of the EDA’s Commercial Revitalization program. Community Development staff set up a time to tour the property and found the small house to be in generally poor shape. The owners have begun the process of clearing out the house so its condition will be better than the ones that have previously been 43 Item 4. City of Columbia Heights MINUTES April 01, 2024 EDA Meeting Page 9 purchased. After negotiating with the owners, staff settled on an offer of $225,000. The Commercial Revitalization program allows staff to negotiate and enter into a purchase agreement contingent on approval by the EDA. This gives staff the ability to move quickly on strategically important properties. The house itself has just over 1,300 sq/ft of living space. The lot holds most of its value since it is in an important area with the redevelopment of 4300 Central Avenue underway. The corner of 44th and Central has a small contingent of owners and densely packed single-family, multifamily, and commercial buildings. By purchasing 4416 Central Avenue the City will have more influence over future redevelopment efforts in this area and may hold the property for the redevelopment of the Northwest corner of 44th and Central. Community development Staff believe this property is a good candidate for redevelopment due to its commercial possibilities and parcel location. Forney explained that each year the EDA budgets $200,000 for the Commercial Revitalization program. Since the purchase of 4416 Central falls within the program, most of the purchase price is covered under this year’s budget. With that being said, a budget amendment is still needed. Resolution 2024-11 approves the purchase of the property while amending the 2024 budget to reflect the additional money needed to cover the acquisition and demolition of the property. The related project costs that are covered by the budget amendment are closing costs, hazardous material abatement costs (asbestos and trash removal), and demolition costs (demolition, grading, and utility disconnects). Fund 408 has about $518,000 available after accounting for t he projected 2024 budget and recent loan. This is more than sufficient to fund the project. As stated in the resolution, $55,000 will go to the related costs described above. Excess money will be returned to fund 408 after the demolition and grading have been completed. This resolution allocates money for and allows staff to purchase 4416 Central Ave. The EDA will be involved in approving all future aspects of the project. Questions/Comments from Members: Márquez-Simula asked if the City was focusing on single-family homes or if they would look into acquiring something like the apartment buildings. Forney replied that the focus is on single family homes but if something huge came along, it would be a possibility to look into it. James noted that there are four owners listed in the purchase agreement and asked what the timeline and process looked like with going through escrow. Forney explained that the deed was transferred to all four new owners since they are siblings. All owners have signed the agreement. Buesgens noted that there are six houses on the block. She asked if in the future if the City could look into being strategic on what blocks to look at for development. Forney stated that if the EDA would like to look at specific properties, Staff can reach out with a letter to see if the property owner is willing to sell. Buesgens asked if the EDA should share what blocks to look at now or wait to come up with a strategy. Chirpich replied that Staff would like to have more time to come up with a strategy. Szurek asked if the owners were looking for relocation benefits. Forney replied that they were not. 44 Item 4. BE IT RESOLVED BY the Board of Commissioners ("Board") of the Columbia Heights Economic Development Authority (the "Authority") as follows: SECTION 1. RECITALS. 1.01. The Authority and The Collection of the Current Property owners (“Seller”) desire to enter into a purchase agreement (the “Purchase Agreement”) pursuant to which the Authority will acquire certain property in the City located at 4416 Central Avenue NE (th e “Property”) from the Seller for economic redevelopment purposes. The Property is described in Exhibit A attached hereto. 1.02. Pursuant to the Purchase Agreement, the Authority will purchase the Property from the Seller for a purchase price of $225,000 plus related closing costs. 1.03. The Authority finds that acquisition of the Property is consistent with the City’s Comprehensive Plan and will result in redevelopment of the substandard property located at 4416 Central Ave NE. Such acquisition of this Property, for subsequent resale, b est meets the community’s needs and will facilitate the economic redevelopment and revitalization of this area of the City. 1.04. The Authority also finds that this redevelopment project is consistent with the purpose of the Economic Development Authority Redevelopment Fund 408. The current 2024 budget for Economic Development Authority Redevelopment Fund 408 does not include this r edevelopment project and must be amended as the property was not available on September 26, 2023, when the Authority adopted this budget. The available balance of the Economic Development Authority Redevelopment Fund 408, beyond that committed for the existing 2024 budget, is approximately $518,000, which is more than sufficient to fund the redevelopment project. 45 Item 4. The Authority hereby ratifies and approves the actions of Authority staff and of Kennedy Graven (“Legal Counsel”) in researching the Property and preparing and presenting the Purchase Agreement. Deconstruction of 941 44th, 3851-3853 Central Ave Forney reported when purchasing previous properties, the EDA had contemplated recycling and deconstructing some of or part of the homes in which it purchases. At a recent City Council meeting a resident gave Staff the contact information for a company that would be able to complete such a task. Staff reached out and met on site with Better Futures Minnesota, to get bids on the deconstruction and reuse of materials from 941 44th, 3851 and 3853 Central Ave. Forney explained in brief, Better Futures Minnesota is a nonprofit organization dedicated to transforming the lives of men who have faced incarceration, homelessness, and unemployment. Through their comprehensive program, they provide a range of supportive services includin g 46 Item 4. City of Columbia Heights MINUTES April 01, 2024 EDA Meeting Page 12 transitional housing, employment training, job placement assistance, personal development workshops, mental health counseling, and substance abuse support. They support this mission through offering deconstruction services. These deconstruction services involve the dismantling and repurposing of buildings, which provide valuable job skills training while also promoting sustainable practices. Forney noted attached are the bids that Staff received. 941 44th qualifies for a full deconstruction with minimal materials being able to be reused. The house was built in 1951 and due to the poor condition, the useful items have been removed or are damaged. A full deconstruction means that Better Futures would remove the house stud by stud leaving nothing but the foundation remaining. After which, the EDA would partner with a demolition contractor to remove the foundation and utility lines. 3851 Central Ave, being a concrete block building, would only qualify for the removal of certain internal finishes and materials. A list of items that would be removed from the building was included in the meeting packet. The block structure would then be demolished by a separate contractor. 3853 Central is the house that the fire department will be burning down. Due to it being burned only internal materials and finishes would be able to be reused or recycled. Better Futures will also board up the windows that are removed to prep the building for training. Attached are specification and bid sheets for the properties. 941 44th does not have a specification sheet as it is a full tear down. As you can see from the bid table below, deconstruction can be expensive. The EDA has budgeted $50,000 for the demolition of 941 44th, and $80,000 for 3851 -3853 Central, with $17,000 across all three already having been spent on Asbestos Abatement. While the money would cover deconstruction additional funds may be needed for the actual dem olition. Specifically regarding 941 44th, deconstruction adds significant costs to the demolition of the properties. Bids: 941 44th: $24,914 3851 Central: $11,657 3853 Central: $11,657 Forney stated Better Futures is a great organization which not only offers deconstruction services but utilizes them for job training. By utilizing deconstruction, the EDA can keep items and finishes that are as good as new from ending up in the land fill. With that bei ng said, deconstruction is an added cost in the demolition of a property. Increasing the amount the EDA needs to spend on each project. Staff recommend considering the projects on a case-by-case basis as the EDA deliberates if it wants to go the deconstruction route. Upon agreement of the EDA staff can make the calculations to edit the motion based on the decision. Questions/Comments from Members: Szurek asked if Staff knew what the demolitions would cost. Forney replied that previous demolitions were about $20,000 per building. Buesgens noted it would be about $60,000 and asked how much money was set aside for demolitions. Forney replied $80,000 was set aside for the two properties on Central Avenue and $50,000 set aside for the 941 44 th property. Chirpich added that the cost also includes asbestos abatement and environmental work. 47 Item 4. City of Columbia Heights MINUTES April 01, 2024 EDA Meeting Page 13 Buesgens asked if the EDA could pick and choose what could be utilized for more value when deconstructing the homes. Forney replied that it was a possibility to change the scope of work for the bid. For example, the EDA could say they do not want to deconstruct the garage of a house but have everything taken from within the garage. Buesgens asked if that would change the bid price. Forney replied that it would. Buesgens noted that some points of value would be the windows, copper, doors and other metals. Szurek asked what would be done with the items that are retrieved. Forney replied that Better Futures would recycle the items, reuse them in their projects or sell them for their benefit. Chirpich explained that it is a value proposition. He added that the EDA and the City Council wanted Staff to look into suitability practices to see if it was something that was valued to put into place in the future. It will cost the City more to deconstruct versus demolish the homes. It is a better cause to extract valuable materials from a property that are reusable. Jacobs agreed with Chirpich’s comments and added that the benefit is the employment aspect of what Better Futures is doing. She added as long as the City does not get too deep in the hole of paying more to do this. James noted that the 3853 Central Avenue property was the one that began the discussion and has the most interest in investing in it as a pilot project. She added that she would be in favor of doing one property this time around to see how it goes and then if it is valuable to look into it as a future policy. Buesgens asked if the windows were new on the 3851 Central Avenue property. Forney replied that a couple are new and a couple are old. Forney stated 3853 Central Avenue is a time sensitive property since the Fire Department will be burning it on May 4, 2024. It is possible to have a bidder come out and provide a more specified scope of work and bring it back to the EDA. Buesgens explained that she would be interested in seeing if there was anything of value such as metals and windows in the 3851 Central Avenue property. Buesgens asked if the $11,000 would be taken from a different fund if the EDA decided to go through with the bid. Forney replied that the money was budgeted from the 408 Fund to pay for the Commercial Revitalization Program. Any money that is not used will go back into the 408 Fund. For the Central Avenue properties, the any money that is not used after the demolitions and utilities will go back into the Anoka County Economic Development levy. Chirpich added that for the two Central Avenue properties, Staff sought reimbursement from Anoka County in their Economic Development levy funds. Buesgens stated she would like to see a large media blitz so that tax payers could see what is going on. She added that it could be a way to promote what the City is doing. 48 Item 4. James suggested having a bid for the 3853 Central Avenue property and then wait on the other two properties for the EDA to decide at a future time. Forney stated that the Affordable Housing Trust Fund is being work on by the City’s attorneys. They are currently working on a document with an Ordinance that the City Council will pass to create the trust fund to hold the sales tax funds. The attorneys are also making it so that it is eligible for the Minnesota Housing grant match. Staff thinks the EDA should handle and administer the trust fund. Szurek asked if the program was connected to a project or if it was an overall project the Council wanted to do. Forney replied that the City is receiving extra money from the State that the City has to use. The fund would allow the money to be put somewhere and then determine what to do with it at a later date. Spriggs asked if the funds would be available this year or next year. Forney replied that they would be available this year and expect to receive the funds in June or July. Szurek asked if there was an update on the old Rainbow site. Chirpich replied that there are no updates. Jacobs asked what was stalling the project. Chirpich replied that the primary barrier is interest rates. Jacobs asked what would happen if the interest rates do not come down. Chirpich explained that if the City can have the grocery store commit, it will h elp overcome some of the concerns related to interest rates for the investors. There is still a viable project in the absence of a grocery store But it may change the strategy of housing. Márquez-Simula asked if there was any interest in purchasing the property on the corner of 47 th Avenue and Central Avenue. Forney replied that Staff could reach out to the property owner. Dibba asked if there were other options if the grocery store fell through. Chirpich replied that it would be the same project without the grocery store. Consider Adopting Proposed Change to Library Service Hours: Pre-pandemic the CHPL was open for 54 hours per week; once re-opening we have gone through stages of curbside pickup only, entrance by appointment only, 32 hours per week with capacity limits, 40 hours per week, and 47 hours per week since September 2021. Now that our staffing levels have stabilized, Renee would like to increase service hours again to 50 hours per week beginning the Monday after Memorial Day 2024 (an additional hour on Friday afternoon, and two more hours on Saturday afternoon.) Staff will study usage patterns, busy times, and staffing and present a report to the Board to in the fall to determine if other changes are needed in service hours. Complete Streets Policy Update Khan referred to the updated policy that had been completed by Commissioner Finkelson . Commissioner Finkelson stated that he wanted to take out irrelevant references that were in the policy, and create more Columbia Heights specific information. Khan explained a bit more about the City’s street rehab program that currently exi sts. Boucher asked if we could 53 Item 6. There was some discussion within the group as a whole about equitability and how to prioritize projects and funding. Commissioners and staff discussed the ability to include way finding in the Complete Streets Policy, and the conceivability of including other commissions and boards in the complete streets planning and implementation process. 5. Partners in Energy Update Boucher stated that we did complete a kick-off meeting for Partner in Energy – he then went over what the next steps in the process are. We will need to put together an “energy action team” of about 17-24 people. He identified some of the organizations that were brought up as being possible stakeholders and interested parties in this team, and then opened the floor to the commissioners for suggestions and thoughts. Some suggestions were brought forward to Boucher who agreed these would be great people and organizations to reach out to in addition to the ones that have already been identified. Previously identified groups: Sustainability Commission, HeightsNext, the school district, Kiwanis Club, Rotary Club, Lions Club, SACO food shelf, the Multicultural Advisory Committee, the Business Council, homeowners, renters, the Ecuadorian population, the Somali populations, potentially connecting with Native American folks in Columbia Heights, landlords & rental property managers, and realtors. 6. GreenCorps Host Site Update LaPlante stated that the subcommittee has been meeting regularly. 7. Sustainability Commission Newsletter Submission LaPlante stated that the commission had picked a topic in our last meeting and then wrote an article for the newsletter. Khan said that they will probably need to cut some of it down for the physical newsletter, but will publish the full article in the online version. Commissioners will pick the next topic in the May meeting. 8. Implementing Ban on Black Plastic To-Go Containers From Restaurants LaPlante tabled this item. 9. Sustainability Commission Representation at City Events With the Expo coming up, the Sustainability Commission will have a table. She also said that MNDOT has dedicated $25 million to the reconstruction of Central Avenue. ITEM: Second Reading of Ordinance 1698, Creating a Housing Trust Fund Within the City of Columbia Heights, and Designating the EDA as the Fund’s Administrator. The bill earmarked millions of dollars for a variety of agencies and programs dedicated to the current issues in the housing market. Article 5 of the bill established the metropolitan region sales and use tax. This tax required the Metropolitan Council to impose a metro sales tax of 0.25% on sales made in the metropolitan counties or to a destination in the metropolitan counties. Funds received from the tax are distributed: 25% to the state’s rental assistance program, 25% to the metropolitan city aid account, and 50% to the metropolitan county aid account. The metropolitan city account disburses local affordable housing aid to cities via distribution factors. Calculations made as of June 30th 2023, expect Columbia Heights to receive $260,089 annually. These numbers are preliminary, and the City will not know how much it is set to receive until the funds are released in June or July. These funds must be used for affordable housing initiatives or projects and must qualify under the law. “Article 5, section 3, subd. 4 defines qualifying projects to include emergency rental assistance for households earning less than 80% of area median income, financial support to nonprofit hous ing providers, construction, acquisition, rehabilitation, permanent financing, interest rate reduction, refinancing, and gap financing of housing. Homeownership projects are limited to units affordable to those at 115% of greater of state or area median income and 80% of greater area of greater of state or area median income for rental housing projects.” (LMC 2023 Legislative Session Summary) State law also establishes that all funds must be spent on qualifying projects by December 31 of the third year after the aid was received. This requirement can be bypassed if: the city can prove that by no fault of its own it could not expend all the funds, the city places the received funds into a housing trust fund, and the funds used from the trust fund go to qualified projects. In speaking with other cities and our public finance consultants at Ehlers, all agree that the first step in responding to the new law is to establish a housing trust fund and, upon receipt of the funds, transfer them into the trust fund. As stated above this is a major step in proving the City has “spent” the funds. Which allows CITY COUNCIL MEETING AGENDA SECTION CONSENT MEETING DATE 05/28/2024 56 Item 8. City of Columbia Heights - Council Letter Page 2 the City more time to distribute the funds on qualifying projects. Cities are given the right to establish Housing Trust Funds in section 462C.16 of state statute. Ordinance 1698 establishes the framework for the City’s Local Housing Trust Fund which contains a set of rules and regulations regarding the administration of the fund. These rules are established in compliance with state law and the requirements set by the Minnesota Housing Finance Agency (MHFA) for their Local Housing Trust Fund Grants. MHFA also received $4,800,000 money from 2023 legislative session for their Local Housing Trust Fund Grants. The Local Housing Trust Fund Grant program is stricter than the affordable housing sales tax funds, but staff see the local housing trust funds purpose as a tool to develop and maintain affordable housing. This also opens the fund for application to the Local Housing Trust Fund Grants. The EDA will discuss applying to the grant program after establishment of the fund. Ordinance 1698 also designates the EDA as the administrator of the fund. The City’s HRA has delegated its powers to the EDA making the EDA best suited to administer the p rograms and projects the fund will be used for. In the past the EDA has established and administered the City’s housing initiatives. Affordable Housing Aid funds must be used in accordance with the affordability and other requirements of Minnesota Statutes section 477A.35. In addition to any specific requirements of Minnesota Statutes section 477A.35 or the Grant Program, funds in the Local Housing Trust Fund may be used only to: 1. pay for administrative expenses, but not more than ten percent of the balance of the funds in the Local Housing Trust Fund may be spent on administration; 2. make grants, loans, and loan guarantees for the development, rehabilitation, or financing of housing; 3. match other funds from federal, state, or private resources for housing projects; or 4. provide down payment assistance, rental assistance, and home buyer counseling services. The Economic Development Authority of Columbia Heights, Minnesota (the “EDA”) shall administer the Affordable Housing Trust Fund on behalf of the City. The EDA shall determine the terms and conditions of grants, loans, and loan guarantees for the development, rehabilitation, or financing of housin g from the Affordable Housing Trust Fund, including the appropriate security and interest, if any, and whether repayment is required. Interest on loans and grants shall be as established by the EDA from time to time or at the time of approval of a specific project or program. The EDA shall report annually to the City on the use of the funds in the Affordable Housing Trust Fund, including the number of loans and grants made, the number and types of residential units assisted, and the number of households for which rental assistance , down payment assistance or home buyer counseling services were provided. Shortly after the first stop work order was removed, a second stop work order was posted on the property and a notice was mailed on 10/4/23 to the owner regarding the need to secure a building permit for the structure or to remove the structure, giving a 30-day timeline for compliance. On 9/1/23/ the property owner pulled an online permit for roofing and siding, which requires no review by City staff. This permit was pulled without contacting City staff to discuss the stop work order and scope of corrections needed. The roofing and siding permit was insufficient to cover the scope of work for the structure, as the structure in question is actually a porch-like structure that was built by the property owner to cover an exterior stairwell that enters the basement (see attached pictures). The property owner was informed that the permit pulled for the project was insufficient and that a building permit for an addition to the home would be required. Additionally, the owner was informed that building plans would be required with the permit application. On 10/19/23, the property owner submitted an online application for an addition but did not include any plans. During the week of 11/17/23, the owner brought plans to City Hall representing what had been built on the property. The City’s Building Official informed the owner that the plans, and thereby the existing structure, were deficient and that they would have to be amended to comply with the building code. The owner was also informed that the existing structure had no path to compliance with the building code and that it would have to be deconstructed. The Building Official gave directions to the owner on what revised plans would need to include and general guidance on how a code compliant structure similar to the one that had been built could be designed. For the next several months, City staff and the owner debated over what type of construction and design would be acceptable for the type of structure being contemplated. On 5/2/24, the property owner was mailed a Statement of Cause and Notice of Public Hearing informing the owner of the City’s intent to pursue a nuisance abatement (removal) of the unpermitted, non-compliant structure. SUMMARY OF CURRENT STATUS The Building Official performed a final compliance check on 5/23/24 and determined that the structure had not been removed. Staff have worked with the owner of 2201 37 th Avenue NE, a block south of Prestemon Park, on a proposed child day care center building permit application through administrative review under the current code requirements providing a 2,700 sq. ft. on-site play area as well as on the proposed zoning text amendment which would allow the applicant to serve a greater number of children. The proposed zoning text amendment changes the child day care outdoor play area language to reflect the standards that allow adult day care facilities to use an adjacent park subject to approval of a written plan reviewed by the City Manager or their designee. Staff has determined that the proposal is identical to a similar zoning text amendment the City processed and approved in 2017 allowing adult day care facilities use of an adjacent public park to satisfy outdoor play area 112 Item 14. Page 2 requirements. Staff recommended approval of the amendment so that an alternative approach to providing on-site outdoor space could be considered, which was approved by t he City Council. Staff examined existing day care facilities and their outdoor play areas, zoning districts that allow child and adult day care facilities as uses, and identifying parks that would be within the 1,500 -foot distance from any commercially zoned properties to better understand the impact of the proposed zoning text amendment. There are approximately 11 existing day care centers that the amendment would apply to, but each of these centers appears to provide on-site play areas or are on a site, such as a place of worship or school facility, that has those facilities readily available. Existing day care centers would be able to expand their operations if their occupancy is currently limited by the on-site play area, but this amendment would likely be more applicable to future day care centers. The proposed zoning text amendment would be applicable to only city parks that have a commercially zoned property within 1,500 feet of them where a future child day care center could propose a written plan for review to use the park. These parks are:  Edgemoor Park  Gauvitte Park  Huset Park  Labelle Park  Prestemon Park  Sullivan Lake Park The remaining parks are either outside the distance allowed for a day care to use the park or the parks do not have any commercial zones where a child day care center would be allowed. The property owners within 350 feet of each of these six parks were sent a Notice of Public Hearing regarding the zoning text amendment because staff determined it was appropriate, within the scop e of the zoning text amendment, to give the public ample notice of the application and provide time for adequate public comment. Staff received multiple written comments which are included as part of the public record. The Planning Commission gave a positive recommendation (4-2-1) to draft Ordinance No. 1697, an Ordinance amending chapter 9.107 Specific Development Standards (16) of the City Code of 2005 to allow for child day care centers to propose a written plan to use a public park in lieu of an on-site outdoor play area at the May 7, 2024 Planning Commission meeting. The following Zoning Ordinance modifications are recommended by Staff with the full draft ordinance attached to the staff report. RECOMMENDATION Staff finds that the proposed zoning amendment is consistent with the intent of the comprehensive plan and is in the public interest of all residents of Columbia Heights.
