MOTION: Move to approve the items listed for rental housing license applications for September 11, 2023, in that they have met the requirements of the Property Maintenance Code. 6. Review of Bills. MOTION: Move that in accordance with Minnesota Statute 412.271, subd. 8 the City Council has reviewed the enclosed list to claims paid by check and by electronic funds transfer in the amount of $1,141,410.65. ITEMS FOR CONSIDERATION Ordinances and Resolutions 7. Centerpointe Franchise Agreement - Renewal MOTION: Move to close the public hearing and waive the reading of Ordinance No. 1689, there being ample copied available to the public. MOTION: Move to set the second reading of Ordinance 1689, pertaining to the renewal of the franchise agreement with Centerpoint Energy for Monday, September 25, 2023, at approximately 6:00 pm in the City of Columbia Heights City Council Chambers. 8. Second Reading of Ordinance 1688, Prohibiting Smoking Within Par ks and Amending the Definition of Public Place. MOTION: Move to waive the reading of Ordinance No. 1688, there being ample copies available to the public. MOTION: Move to approve Ordinance No. 1688, being an ordinance amending chapter 10 article II of the Columbia Heights city code to prohibit smoking within city parks and amending the Columbia Heights City Code to redefine the definition of public place and direct staff to send the summary ordinance for publication in the legal newspaper. 2 City of Columbia Heights AGENDA September 11, 2023 City Council Meeting Page 3 9. Approval of Resolutions 2023-49 and 2023-50 Requesting Funds from the Anoka County HRA and Transferring Said Funds to the EDA MOTION: Move to waive the reading of Resolutions numbered 2023-49 and 2023-50, there being ample copies available to the public. MOTION: Move to approve Resolution No. 2023-49, a resolution requesting funds from the Anoka County Housing and Redevelopment Authority to support economic development activities within the City of Columbia Heights. MOTION: Move to approve Resolution No. 2023-50, a resolution transferring $780,000 of ACHRA grant funds from the City of Columbia Heights to the Columbia Heights Economic Development Authority for the purchase, abatement, utility work, and demolition of 385 3 and 3851 Central Ave. Bid Considerations New Business and Reports CITY COUNCIL AND ADMINISTRATIVE REPORTS Report of the City Council Report of the City Manager COMMUNITY FORUM The Community Forum is the public’s opportunity to address the Council regarding any matter that has not had a public hearing earlier in the meeting. Speakers that are in-person are asked to complete a Speaker Form and submit it to the City Clerk. Once called to the podium, the speaker should state their name and connection to Columbia Heights. Speakers attending virtually should send a request to speak as well as their address and connection to Columbia Heights to the moderator using the chat function and wait to be called on to speak. When speaking, virtual attendees should turn their camera on. All speakers should limit their comments to five (5) minutes. Personal attacks, threats, the use of profanity, and other disrespectful comments are prohibi ted. The City Council will listen to the public comments, ask clarifying questions, and if needed, request staff to follow up or direct the matter to be added to an upcoming agenda. ITEMS PULLED FROM THE CONSENT AGENDA 1. Approve the August 7, 2023 City Council Work Session Meeting Minutes. Councilmember Jacobs referenced paragraph 8 and requested to include that Councilmember Buesgens and Councilmember Jacobs opposed having an outside firm look for a new City Manager. She also requested that Councilmembers be named in a vote. Motion by Councilmember Jacobs, seconded by Councilmember Buesgens, to approve the August 7, 2023 City Council Work Session meeting minutes as amended. All Ayes, Motion Carried 4-0. 5. Adopt Resolution 2023-45 Accepting Safe Streets for All (SS4A) Grant Agreement for Development of a Citywide Safety Action Plan. 9 Item 1. City of Columbia Heights MINUTES August 28, 2023 City Council Meeting Page 4 Mayor Márquez Simula stated she wanted to remove this item from the Consent Agenda because the Council has been asking about this item for the last 18 months and wanted the community to know about it. City Engineer Khan explained the grant agreement for the Safe Streets for All is before the Council. The agreement could take 1-2 months until the agreement is ready. He added Staff would like to gather ideas from the Council on the Request For Proposal (RFP) in order to solicit proposals. Public engagement will be a key element in this process. The City is 1 of 12 organizations who have been awarded this grant in Minnesota. Motion by Councilmember Jacobs, seconded by Councilmember Buesgens, to waive the reading of Resolution 2023-45, there being ample copies available to the public. All Ayes, Motion Carried 4-0. Motion by Councilmember Jacobs, seconded by Councilmember Spriggs, to adopt Resolution 2023-45, being a resolution accepting SS4A grant funding in the amount of $200,000, with a $50,000 match from the City, from the Federal Highway Administration (FHWA) for development of a citywide safety action plan. All Ayes, Motion Carried 4-0. 7. Approval of Professional Services Agreement Between the City of Columbia Heights and Hoisington Koegler Group Inc. Councilmember Jacobs asked for additional background to be provided. Community Development Director/Assistant City Manager Chirpich stated the agreement is for the Medtronic site, which is currently up for sale publicly and there is significant interest in redevelopment by many developers. The City has amended its Comprehensive Plan since it does not specify the use except for commercial. The redevelopment plan is for the City to expan d uses beyond commercial use. The contract proposes to use the same consulting firm that just completed the City’s most resent update to the 2040 Comprehensive Plan and would take the City through an amendment process. The process is expected to take about 6 months. Mayor Márquez Simula noted it is a significant property and the City does not typically change the Comprehensive Plan. Community Development Director/Assistant City Manager Chirpich agreed and added that Staff meet with the Metropolitan Council staff to discuss what triggers an amendment. Staff agree that this is the correct way to move forward. Councilmember Jacobs stated she wanted to make sure the public knew that this was a research effort and not a purchasing scenario. Motion by Councilmember Buesgens, seconded by Councilmember Jacobs, to waive the reading of Resolution 2023-47, there being ample copies available to the public. All Ayes, Motion Carried 4-0. Motion by Councilmember Buesgens, seconded by Councilmember Spriggs, to adopt Resolution 2023- 47, a resolution approving Professional Services Agreement with HKGi for up to $25,000.00 in funds from the City’s Planning and Inspections Fund 201 and authorize the execution of the agreement for the associated project costs. All Ayes, Motion Carried 4-0. 10 Item 1. City of Columbia Heights MINUTES August 28, 2023 City Council Meeting Page 5 PUBLIC HEARINGS 11. Consideration of Resolution 2023-44, Revocation of the License to Operate Rental Units Within the city of Columbia Heights against the rental property at 4522 Tyler Street NE for failure to meet the requirements of the Residential Property Maintenance Codes. Assistant Fire Chief O’Brien explained the revocation is for the incomplete repair of violations for the property. There are electrical hazards, missing switch plate covers, missing smoke covers, infestation of mice, and the sewage pump found in the sump pump system with a backup of sewage. There was a small extension with a re-inspection on July 28, 2023 and nothing was fixed. Mayor Márquez Simula opened the public hearing. Julie Findell, property owner, explained that she and her husband have not been able to fix the issues with the house because her husband had two surgeries. She added that she has been in pain over the last three months. She had a pet control company come out and fix the mouse infestation. She asked for an extension and stated she would hire someone to start working. Mayor Márquez Simula asked how long Ms. Findell has owned the property. Ms. Findell replied that it has been a number of years. Councilmember Jacobs asked if there has been an extension granted to the property in the past. Assistant Fire Chief O’Brien stated an extension has not been requested in the past and has not needed to use an extension. Councilmember Jacobs asked if the property owners were compliant to inspections in the past. Assistant Fire Chief O’Brien replied that they have been compliant. Chad Findell, City resident, explained that his parents have been going through a difficult time and do not typically hire out companies to help since they are usually able to fix items on their own. He added that he is able to help his parents with the rental properties. Councilmember Jacobs asked if Assistant Fire Chief O’Brien would be interested in looking into an extension. Assistant Fire Chief O’Brien replied that the request is granted by the Council. City Attorney Hoeft explained that typically, the Council would table the item and keep the public hearing opened so that Staff does not need to notify the public again about the public hearing. Councilmember Jacobs asked Ms. Findell how much reasonable time she would need for an extension. Mr. Findell replied 45 days. Motion by Councilmember Buesgens, seconded by Councilmember Jacobs, to table consideration of Resolution 2023-44 being a Resolution of the city council of the city of 11 Item 1. City of Columbia Heights MINUTES August 28, 2023 City Council Meeting Page 6 Columbia Heights approving revocation, pursuant to city code, of the rental license listed, until October 9, 2023. All Ayes, Motion Carried 4-0. Mayor Márquez Simula reordered the agenda to next consider Item 14. 14. First Reading of Ordinance 1688, Prohibiting Smoking Within Parks and Amending the Definition of Public Place. Community Development Director/Assistant City Manager Chirpich noted at the last City Council work session, the Council discussed a variety of issues regarding the use of cannabinoids within public spaces. From this discussion came the Council’s guidance to prohibit smoking within City parks. Ordinance 1688 prohibits the smoking of tobacco, marijuana, and other plants natural and synthetic within City parks. Smoking is already defined in City code as: Inhaling, exhaling, burning, or carrying any lighted or heated cigar, cigarette, or pipe, or any other lighted or heated product containing, made, or derived from nicotine, tobacco, marijuana, or other plant, whether natural or synthetic, that is intended for inhalation. SMOKING also includes carrying or using an activat ed electronic delivery device. With smoking already defined and already including electronic delivery devices, Ordinance 1688 would also prohibit the use of electronic delivery devices on park property. Ordinance 1688 also amends the City’s definition of p ublic place to make it a more comprehensive definition. Last, Staff have utilized this opportunity to update the pronouns in the related sections. Councilmember Jacobs noted Item S in the ordinance includes parking lots adjacent to public parks. Mayor Márquez Simula mentioned she was in favor of this. She added Item I in the ordinance could be adjusted to be more forward facing and inclusive. Councilmember Spriggs agreed. Community Development Director/Assistant City Manager Chirpich asked the City Attorney if the change could be made in between the first and second reading of the ordinance. City Attorney Hoeft replied that the provision could be included in the reading of the motion. Mayor Márquez Simula declared the public hearing opened. There were no public comments. Motion by Councilmember Buesgens, seconded by Councilmember Spriggs, to close the hearing and waive the reading of Ordinance No. 1688, there being ample copies available to the public. All Ayes, Motion Carried 4-0. Motion by Councilmember Spriggs, seconded by Councilmember Jacobs, to revise the language for item I to be more forward facing and inclusive and set the second reading of Ordinance No. 1688, being an ordinance amending chapter 10, article II, of the Columbia Heights City Code to prohibit smoking within City parks and amending the Columbia Heights 12 Item 1. City of Columbia Heights MINUTES August 28, 2023 City Council Meeting Page 7 City Code to update the definition of public place, for September 11, 2023. All Ayes, Motion Carried 4-0. 12. Appeal #1 of Rental License Revocation Resolution 2023-35 for 1000 Peters Pl NE. Assistant Fire Chief O’Brien stated the revocation is based on the property owner feeling as if the issues have been addressed. He introduced the property owner and their attorney. Morgan Smith, attorney of KSR Investments LLC, which is the registered owner of 1000 Peters Place NE, stated the owner submitted photos illustrating that the required repairs were completed on July 10, 2023. The repairs included a new fire door, new concrete work on the foundation, and an exterminator. The fire door repair was delayed due to ordering issues. The concrete work was not done to the satisfaction of the City but was done a second time and completed by July 10, 2023. Mr. Smith felt there was a lot of prejudgment from Councilmembers regarding the revocation. A number of Councilmembers had mentioned they spoke with many of the tenants but none of the tenants were available for the meeting to speak. He noted his client does not babysit the tenants for repair. If there is a need for a repair, tenants are required to write in and explain the issue so it can be repaired. The client has a one-year contract with a rodent exterminator and has resolved the issue. He noted a Councilmember told the client that he did not have the right to be ther e and explained that his client had every right to be there. He asked the Council to give his client another chance to pass the inspection. Councilmember Jacobs asked if the infractions were building issues or in specified units. Assistant Fire Chief O’Brien replied that the mice infestation is building wide and the concrete work is exterior. Mayor Márquez Simula opened the public hearing. Shanna Knight, City resident, stated have been ongoing mice issues even after the one year exterminator. She added there are roaches crawling in her apartment and it has been horrible to speak with management. She mentioned homeless people sleep in the stairwells, there are no cameras, or snow plows. The toilet does not work and she did not receive communication after it continued to not be fixed. Kemtpon Jackson, City resident, stated the apartment above him flooded so there is now mold on his ceiling and he would like to have his bathroom fixed. Mr. Smith stated he had not heard from Mr. Jackson or Ms. Knight before and suggested they write a letter to his client regarding the repair issues. He added that the address for the notice is incorrect. He noted that he was not able to complete the repair items on time because it had to wait until after winter weather to fix the exterior repairs. He asked the Council to review their decision, stating that it was premade, and to reverse the revocation. 13 Item 1. City of Columbia Heights MINUTES August 28, 2023 City Council Meeting Page 8 Assistant Fire Chief O’Brien mentioned that the initial inspection was on August 19 th for the infestation. In December 2022, there was a proposal given to the City on what they would complete. He noted the City has not received documentation on what was being worked on throughout the process and the inspectors still found signs of infestation when they did the inspection. In May 2023 they sent a notice saying they were doing a final inspection and if it fails, it would go to the Council for revocation. No additional information was provided at that time and the door and concrete work was also not completed at the time. Motion by Councilmember Buesgens, seconded by Councilmember Jacobs, to close the public hearing. All Ayes. Motion carried 4-0. Appeal #2 of Rental License Revocation Resolution 2023-35 for 966-968 44 ½ Ave NE. Assistant Fire Chief O’Brien stated Penrod Lane LLC owns the rental property. In May of 2023, three separate revocation hearings were sent to the addresses associated with the property and ended up with eight notices total. He feels confident that the notices were received since none of them were returned and it is the LLC’s responsibility to notify City Staff if any addresses change. Mr. Smith stated he represented MSA properties and noted that Mr. Khan also represented MSA properties. He added the first time MSA properties was notified about a revocation was on July 11, 2023 regarding Peters Place. The standard in the ordinance is “an interest in” and noted that MSA does not have interest in Peters Place. Mr. Khan does not own any interest in the properties because he works for them and is not an owner. Mayor Márquez Simula opened the public hearing. City Attorney Hoeft stated the Council is speaking on the interest of the rental license not the property ownership, noting 1000 Peters Place was listed as a related property which makes it a common interest. School Resource Officer Discussion. 14 Item 1. City of Columbia Heights MINUTES August 28, 2023 City Council Meeting Page 9 Police Chief Austin stated a new law prohibits physical restraints. There are several law enforcement agencies in the process of cancelling their contract with various schools due to the new law and Columbia Heights is in the process of waiting to hear more information from the League of Minnesota Cities before coming back to the Council with a decision on how to best proceed with the current SRO contract . In the meantime, SRO’s will be temporarily reassigned. The police department will continue to collaborate with the school district and hope to have clarification in the next couple of weeks. Mayor Márquez Simula noted that the Council did not vote on this item and thanked Chief Austin for providing an update to the Council. Councilmember Jacobs expressed her gratitude for Chief Austin’s work and noted that police officers should not be put in a position where they cannot do their job effectively. Councilmember Spriggs asked if there is a process for pulling out of the contract. Chief Austin stated the contract allows for a temporary reassignment for SROs which will provide the police department additional time for a recommendation. A cancellation of the contract would be a Council decision. CITY COUNCIL AND ADMINISTRATIVE REPORTS Report of the City Council Councilmember Spriggs stated he attended the open house for the new City Hall. Councilmember Jacobs noted she attended the City Hall celebration, Officer Baumgardner’s Swearing in Ceremony, and announced the Kiwanis club is celebrating 40 years of recycling on September 16 from 9 am to 12 noon at the Columbia Heights Recycling Center (3801 Madison). She thanked Staff for getting the Shellito banner back up. She read a statement about the Council Corner and highlighted that the Council Corner meeting had the topic of hiring a City Manager. She added that she objected to having the discussion about a new City Manager on a work session agenda since it should remain on a regularly scheduled agenda for a City Council meeting. She noted a 3 pm start time may not encourage residents to attend these meetings. She added that the notice of the discussion was never announced but simply posted on the City’s webpage and she felt it was the Council’s failure to be transparent with the community. The Council Corner is held on the second Wednesday of the month at City Hall from 3 - 4 pm. She encouraged residents to attend and to check the calendar to make sure a meeting has not been cancelled. Councilmember Buesgens stated she attended the employee’s picnic and takes care of the Murzyn Hall flower pots. She attended Cone with a Cop, friends of Kordiak Potluck, the City Hall open house, and Officer Baumgardner’s swearing in. Mayor Márquez Simula reported she attended the employee picnic, senior painting class, and swearing in for Baumgardner. She mentioned several events that were canceled due to the heat i ndex and concern for volunteers safety. She attended the school districts luncheon, Metro Cities transportation 15 Item 1. City of Columbia Heights MINUTES August 28, 2023 City Council Meeting Page 10 and general governance meeting, open house at City Hall, Friends of Kordiak meeting, and movie in the park. Report of the City Manager Community Development Director/Assistant City Manager Chirpich asked Finance Director Joe Kloiber to share the budget process since the Charter requires a summary of the budget before the end of August. Finance Director Kloiber stated the City website has the City Manager’s proposed budget for 2024. The budget will go through a variety of updates for the remainder of the budget season until the public hearing in December. The information under the Charter for the proposed budget is by fund for 2024 and includes the detail of the components of the propo sed levy for 2024. Additional details will be included by department in about a week. Mayor Márquez Simula invited the community to the budget work session next Tuesday. Community Development Director/Assistant City Manager Chirpich thanked everyone who was involved in making the grand opening of the new City Hall a success. He noted that about 50 people attended the past movie in the park. The last movie in the park event will be on September 5, 2023 and will show Trolls World Tour and is sponsored by New Horizon Academy. The movie will take place at McKenna Park at 7:30 pm with free popcorn. Community Development Director/Assistant City Manager Chirpich mentioned that the board and commission applications are on the City’s website with 10 positions opened on the Youth Commission, two positions opened on the Economic Development Authority and one open position for the Charter Commission. The deadline to apply is September 29, 2023. COMMUNITY FORUM Barbara DeLaria, City resident, stated she was at the meeting two weeks ago and still has not heard back from anyone from the City. Community Development Director/Assistant City Manager Chirpich provided a brief update and stated there have been several exchanges between the fire department and Staff. He added that someone will be reaching out to Ms. DeLaria soon. Cathy Gomez, City resident, noted she was at a meeting a month ago regarding the fence in her backyard and she had not heard anything yet. She also has not heard back about the blacktop in the alley. She asked why vents by the building are so loud by her house. Community Development Director/Assistant City Manager Chirpich replied that all of the items she mentioned have been brought up to the developer of the project to bring resolution to it. He added all of the issues were happening on the east side of the City Hall project and Ms. Gomez’s property is right next to the Ratio Apartment property. An exterior walkthrough is scheduled for September to address all of the issues that have been mentioned. The fence will be removed and the blacktop for the alley is still being looked at. 16 Item 1. City of Columbia Heights MINUTES August 28, 2023 City Council Meeting Page 11 Ms. Gomez asked in the winter, could the plow clear the area like they used to so residents do not have to do it. Community Development Director/Assistant City Manager Chirpich agreed and indicated he would work with Public Works to make sure it is plowed correctly. Diane Meyer, City resident, stated she would like to have more people trained in the City to figure out what is happening in her neighborhood regarding traffic in the area as well as rentals in the area. She noted the more rentals that go in without hiring more people , the more issues there are going to be. Catherine Vesley, City resident, explained she would like to make some comments regarding an outside search for a City Manager. She has been a part of many outside searches and asked the Council not to do a national search but to focus on the five state area and the metro area. She added the wider the search, the more expensive it is. She stated the person that is hired should have a mind to serve 22,000 people, which is a smaller community. She noted the reality is that the new hire may stay for only a couple of years and then move on. She wished the Council good luck. Dewayne Morrell, City resident, asked if the SROs would be at the school or not. Chief Austin replied as of now, they will be reassigned and not at the school. Mr. Morrell asked who could talk to bus drivers because they are driving 50 miles an hour down residential streets. He stated if a police officer is in continual contact with the bus drivers, it may help enforce better driving. Chief Austin encouraged Mr. Morrell to speak with the school district as well. Mr. Morrell asked if the police department had an all-black Dodge Charger. Chief Austin replied that they do not have an all-black Dodge Charger. Mr. Morell noted there is no signage for the new City Hall. Community Development Director/Assistant City Manager Chirpich replied that the signs are on order, will be received in the next week, and then will be put up. Mr. Morell asked where the Mayor’s office is located. Mayor Márquez Simula replied there are two spaces that can be used as a Mayor and Council office. Mr. Morell stated the plants are inappropriate out front because they are arborvitaes that will grow to be 16 to 20 feet tall, and the branches will end up encroaching on the sidewalk. He asked the City to reconsider their yard waste container program and suggested having a one-time processing fee for anyone who would like to purchase the yard waste container. He added the college students who are involved are getting tired and a vehicle could be helpful for them. Mr. Morell asked if Kevin Hansen was still in the running for the City Manager position. Mayor Márquez Simula replied that he is currently the Interim City Manager until a decision is made. Mr. Morell noted he has seven points on why Kevin Hansen should not be the next City Manager. He added that the height of the podium all of the Councilmembers are sitting at is too high. Kay Handley, City resident, stated on July 15 she wrote a letter to the Council and Mayor. She read the letter she wrote and highlighted her acknowledgement of Kevin Hansen as the City Man ager for 2023, and that he should continue in the position as he has done a great job serving the city. She added that he was professional and knowledgeable when she spoke with him in his roles with the city. She believes that Kevin Hansen should become the City Manager instead of spending the money to search for a new City Manager. She reviewed various ways her family has been involved in the community for the past 50 years. 17 Item 1. WORK SESSION ITEMS 1. Discuss Residential Time of Sale Program. Assistant City Manager / Community Development Director Chirpich introduced this item. Time of Sale Program has been brought up by the Council as something that is a priority, and there are two ways to implement the program internal or external staffing. Chirpich recommended that money be budgeted for the program internally and that this person be supervised and trained by our exceptional Building Official Ryan Smith. Community Development Coordinator Forney further presented information on the process of inspecting for health and safety issues and the various levels of inspections. It was noted that City Staff would not be able to complete sewer inspections. Building Official Smith was present to speak about the importance of inspections and reviewed photos of the concerns that he often sees. Overall, there was a focus on life safety concerns that can be caught and corrected with this program. He noted that electrical issues are reviewed and followed up by the State Inspector. Councilmember Jacobs inquired if the Cities listed are similar in size. She inquired about the type of infractions that would prohibit sale of the property, and how often there is severe level of infractions. She inquired if this type of inspection covers the one required by the mortgage or insurance company and questioned where the liability lands. She stated that would be more comfortable having an inspection that is independent and not part of the City because of enforcement, follow-up and liability concerns. 19 Item 2. City of Columbia Heights MINUTES September 05, 2023 City Council Work Session Page 2 Assistant City Manager Chirpich stated that the most relevant City listed in the supporting documents would be Robbinsdale and Hopkins as far as size and age of housing stock. He stated that the contracts and inspections language is vetted to make sure that there is no liability to the City, and we are weighing the benefit to the City overall. This theme transcends the market, and the scope of what Staff is proposing is to address the volume of issues that the Building Official is seeing. Building official Smith stated that he finds serious infractions weekly. Coordinator Forney stated that there are some insurance and mortgage companies that accept this inspection, as the person completing the inspection is a Building Official. Councilmember James thinks that the inspection price point is low and would consider a graduated scale for multiple units. She is in favor of this being completed by a City Building Inspector. She would like to think more about the Sewer Inspection. Interim City Manager Hansen stated that the sewer inspection component is important because of clay tile pipes, and damage that has occurred to the joints and root intrusion. Councilmember Buesgens stated that she would like to hire a city inspector to increase the quality of our housing stock. Councilmember Spriggs stated that he supports all of this because of his personal experience with these issues. He feels the pros outweigh the cons, particularly with the single-family rental density cap. Mayor Márquez Simula stated that she is in favor of Staff’s recommendations. Assistant City Manager Chirpich stated that he appreciated Council’s direction and that there will be public hearings and further discussions around this issue as we move forward with hiring an additional staff member to execute this program. 2. Safe Streets For All Citywide Safety Action Plan Request For Proposal Discussion. Interim City Engineer Khan presented information on the status of the SSFA action plan. The city is in the beginning stages of putting together an RFP for a consultant. He reviewed the scope of the work and the expectations for what is most impactful. This is a $200,000 federal grant with a $50,000 local grant. Mayor Márquez Simula is interested in the data for narrowing lanes with paint, adding one side of the street as a bike lane. She would also like a roundabout at First Luteran Church. She likes the idea of all the public outreach that will occur. Councilmember Jacobs likes the LSI idea where only pedestrians are moving. Councilmember James would like to see if all uncontrolled intersections can be eliminated. She would like to see a memorable campaign used for this outreach initiative. 20 Item 2. City of Columbia Heights MINUTES September 05, 2023 City Council Work Session Page 3 Councilmember Spriggs would like to have a specific sidewalk plan posted to the city website. Councilmember Buesgens is excited to use this study to go for funding and grants for art. She feels that neighborhoods do not feel safe because of the speed of vehiles. She wants to find a way to address the neighborhoods as well as the main roads. She would like to have meetings in the parks and have commission members and council members go out into neighborhoods and speak to people about what their concerns are. Interim City Manager Hansen addressed that there is not specifically funding for sidewalks in this plan, but there can be areas identified that would benefit from sidewalks and bikeways. The purpose of this plan is to go after even more funding and grants once opportunities are identified. This program is at least a twelve-month process and will include PEL study information as well. Interim City Manager Hansen stated that we cannot act on the RFP until the grant is signed on a federal level and this could take up to two months or longer. Interim City Engineer Khan also confirmed that there is also the need for the NEPA authorization by MNDOT on behalf of FHWA and this would need to be completed for the process to begin as well. 3. School Resource Officer Contract Discussion. Police Chief Austin presented information on the status of the SRO Contact. There has been a lot of attention on this topic, and there may be a special session called at a State Level to address the issue. The council should know by the next meeting if there will be a special session, he has been meeting with the Superintendent and the City Attorney regu larly. He hopes that we can get back to SRO business. Mayor Márquez Simula clarified that the SRO’s are on a temporary 30 day reassignment. Chief Austin clarified that the contract does allow for this to occur. The contract is still in place. Councilmember Spriggs clarified that there is a 90 written notice that needs to be given to the School District. Chief Austin stated that there would be written notice, but cancelation can occur immediately. Councilmember James asked if payment on the contract would still need to occur. Councilmember Buesgens also clarified payment as well as the role of an SRO. Chief Austin clarified that payment does not occur during the reassignment or if the contract is canceled. He further clarified the role of the SRO beyond simply the job 21 Item 2. City of Columbia Heights MINUTES September 05, 2023 City Council Work Session Page 4 description. The connections that the SRO officers make with the students and faculty are truly what is important and impactful. Councilmember James is confused about why LMC is so delayed in responding to this issue. She also inquired about training that could occur to be in compliance with the law as written. Chief Austin stated that this was not a city specific item and was an oversight that was not caught by LMC. For a small agency such as Columbia Heights it is very hard to train just to SRO restrictions versus a patrol officer. For most agencies this is a temporary assignment, there are a lot of risks that are to be considered. Councilmember Jacobs does not like the use of the word “any” in the legislation. Mayor Márquez Simula inquired what additional information would be needed prior to completion of the contract. Chief Austin stated that he hoped the special session would allow for direction on training and guidance. 4. Overview of Proposed 2024 Budget. Finance Director Kloiber gave an overview of what the budget process will look like over the next several months. He reviewed the City Manager budget that was sent to the Council via email on August 28, 2023 and also posted to the City website. The overall numbers / increases in taxes are close to what occurred in 2023, due to there being a decrease for a second year in the metro area subsidy. Kloiber noted that most cities in Anoka County have also experienced this same issue. Because of this decrease in fiscal disparities being given to the City for a second year, the portion paid by local property owners will increase to 14.2%. Director Kloiber also reviewed LGA, Bond Finance as well as potential projects. Councilmember Buesgens inquired if there would ever be a time where the fiscal disparities equation would be recalculated. Director Kloiber stated that he was not sure, but there will be a time when it likely needs to change. Interim City Manager Hansen stated that October and November Work Session Meetings will have presentations by specific departments. 5. City Council. Discussion Regarding Capturing Majority Decisions in Council Minutes. Councilmember Jacobs would like to capture council consensus statements and votes regarding commitments to the community. She does not feel that this is a huge request from staff. 22 Item 2. Vice President Attest: Secretary BUSINESS ITEMS 3. Purchase of 941 44th Avenue NE, Purchase Agreement and Budget Amendment Approval (pg. 44). Forney reported that Staff are bringing forth, for consideration, the purchase of the property located at 941 44th Ave NE. Earlier this year Councilmember Buesgens reached out to community development staff regarding the passing of the home’s previous owner. As the property is zoned general business, the acquisition of the property falls within the confines of the EDA’s Commercial Revitalization redevelopment program. Community Development Staff sent a letter to the premise and were able to set up a viewing with the estate of the previous owner. After negotiating with the estate, Staff settled on an offer of $200,000 dollars. The Commercial Revitalization redevelopment program allows Staff to negotiate and enter into a purchase agreement contingent on approval by the EDA. This gives Staff the ability to move quickly on strategically important properties. The house itself has just over 600 sq/ft of living space. The lot itself holds most of the value since it is in an important area with the 25 Item 3. City of Columbia Heights MINUTES August 07, 2023 Economic Development Authority Page 3 redevelopment of 4300 Central Avenue underway. The corner of 44th and Central has a small contingent of owners, and by purchasing 941 44th the City will have more influence over future redevelopment efforts in this area. Community development staff believe this property is a prime candidate for redevelopment due to its substandard condition and parcel location. Forney added that each year the EDA budgets $200,000 for the Commercial Revitalization redevelopment program. Since the purchase of 941 44th falls within the program, most of the purchase price is covered under this year’s budget. With that being said, a budget amendment is still needed. Resolution 2023-19 approves the purchase of the property while amending the 2023 budget to reflect the additional money needed to cover the acquisition and demolition of the property. The related project costs that are covered by the budget amendment are: closing costs, hazardous material abatement costs (asbestos and trash removal), and demolition costs (demolition, grading, and utility disconnects). Fund 408 has about $2.4 million available after accounting for the projected 2023 budget. This is more than sufficient to fund the project. As stated in the resolution, $57,700 will go to the related costs described above. Excess money will be returned to fund 408 after the demolition and grading has been complete. This resolution allocates money for and allows staff to purchase 941 44th. The EDA will be involved in approving all future aspects of the project. Questions/Comments from Members: James asked if the City has any plans for the property after demolition. Forney replied that Staff does not have any ideas and it would be up to the EDA to determine what they would like to see on the property. Márquez-Simula asked if Midas owned the property to the west. Forney stated that Midas owns the property. Spriggs asked what the timeline was for the demolition. Forney explained the goal is to complete it in the fall. Jacobs asked what will be done with the property. Forney replied that it would be empty green fields with grass and the demolition contractor would apply seed and blanket and Public Works would mow the lawn. City of Columbia Heights MINUTES August 07, 2023 Economic Development Authority Page 4 BE IT RESOLVED BY the Board of Commissioners ("Board") of the Columbia Heights Economic Development Authority (the "Authority") as follows: SECTION 1. RECITALS. 1.01. The Authority and The Estate of Pauline Shold (“Seller”) desire to enter into a purchase agreement (the “Purchase Agreement”) pursuant to which the Authority will acquire certain property in the City located at 941 44th Avenue NE (the “Property”) from the Seller for economic redevelopment purposes. The Property is described in Exhibit A attached hereto. 1.02. Pursuant to the Purchase Agreement, the Authority will purchase the Property from the Seller for a purchase price of $200,000 plus related closing costs. 1.03. The Authority finds that acquisition of the Property is consistent with the City’s Comprehensive Plan and will result in redevelopment of the substandard property located at 941 44th Ave NE. Such acquisition of this Property, for subsequent resale, best meets the community’s needs and will facilitate the economic redevelopment and revitalization of this area of the City. 1.04. The Authority also finds that this redevelopment project is consistent with the purpose of the Economic Development Authority Redevelopment Fund 408. The current 2023 budget for Economic Development Authority Redevelopment Fund 408 does not include this redevelopment project and must be amended as the property was not available on September 26, 2022, when the Authority adopted this budget. The available balance of the Economic Development Authority Redevelopment Fund 408, beyond that committed for the existing 2023 budget, is approximately $2.4 million, which is more than sufficient to fund the redevelopment project. SECTION 2. PURCHASE AGREEMENT AND BUDGETT AMENDMENT APPROVED. 2.01. The Authority hereby ratifies and approves the actions of Authority staff and of Kennedy Graven (“Legal Counsel”) in researching the Property and preparing and presenting the Purchase Agreement. The Authority approves the Purchase Agreement in the form presented to the Authority and on file at City Hall, subject to modifications that do not alter the substance of the transaction and that are approved by the President and Executive Director, pr ovided that execution of the Purchase Agreement by those officials shall be conclusive evidence of their approval. 2.02. The Authority herby amends the 2023 budget for Economic Development Authority Redevelopment Fund 408 to appropriate $57,700 for additional estimated project costs. 2.03. Forney reported that the report pertains to EZ Exchange’s 2023 Façade Improvement Grant application for their new location at 4931 Central Ave NE. The check cashing business seeks to add a sign to their storefront and has obtained two bids, with the lowest being $6,311.53. As this cost, EZ Exchange is eligible for reimbursement of $3,115.77, Community Development Staff recommends funding the project in full. The addition of EZ Exchange will bring increased foot traffic to the area and benefit other nearby businesses. Renderings of the proposed sign and bids are included in the attached application. Forney explained regarding site cameras, Staff will confirm EZ Exchange’s commitment to installing cameras. Thus far in 2023 the city has approved $8,089 over 2 Façade improvement applications. Leaving $41,911 available for future applications and cameras. Additional applications are expected to come in. Questions/Comments from Members: Márquez-Simula commented on how distracting the security lights on Big Marina and $5 Tasty Chicken that are nearby can be while driving. Forney explained he would pass on the comments to the planner. Spriggs expressed his opinion that the City should not be giving out funds with check cashing to buy the sign since it can perpetuate systemic issues. He added he has done research on the perpetuation of poverty and systemic racism. Buesgens commented that she understands Spriggs’ opinion as she has witnessed it firsthand through a friend. Jacobs expressed her concerns regarding the legality of it. She added Buesgens idea of going to the State level would be more productive and less risky. Spriggs asked what the purpose of the EDA was in the process. Forney replied the application states that the applicant recognizes and agrees that the EDA retains abso lute authority and 28 Item 3. City of Columbia Heights MINUTES August 07, 2023 Economic Development Authority Page 6 discretion to decide whether or not to accept or deny any particular grant application. Many façade grants have been denied in the past. He added it is brought to the EDA in order to have discussion since the EDA makes the final decision. James noted if a business is not increasing economic vitality to the City, it would be a means to deny the application. Forney noted that language around systemic racism could be included to the grant. James mentioned that a money transfer was included in the application and noticed their sign included the colors of the Mexican flag. She spoke with many residents who commented that many residents who have family in Mexico will use the business for wire transfers to relatives. She added that the grant application states the business must be in good standing as well as bring economic vitality and believes the sign will revitalize, rehabilitate and restore store fronts. Spriggs asked what legal standing the EDA has if they deny an application due to the signage. Jacobs asked if there should be a redefinition on the parameters for the application process. Márquez-Simula agreed with Spriggs’ comments regarding the role of the EDA in the application process and the potential to get sued if it is denied. She agreed with Buesgens’ comment on requiring a nice sign to go in. Márquez-Simula expressed feeling uncomfortable with saying that a business is doing something wrong since it is not her role and does not know much about check cashing businesses. Spriggs agreed with Buesgens comments of the business opening regardless if the grant is approved or denied. He expressed his opinion that the City should ask what they are condoning and supporting and what message is it sending as a City as a whole. Jacobs asked the Commissioners if they have the right to tell somebody how to run their business. Economic Development Authority Commission Member Recognition and Appointment (pg. 78). Forney stated unfortunately the EDA has recently lost a long standing Commissioner, Gerry Herringer. He served on the EDA since 2008. He noted he would like to get the EDA’s ideas on how to recognize Gerry Herringer. The Planning Commission typically recognizes members on their years of service with items such as a plaque. He mentioned some ideas from Staff such as requesting a proclamation from the Mayor or a plaque with the proclamation. An additional idea is to have a moment of recognition during the grand opening of the new City Hall since Mr. Herringer was on the EDA during the purchase of the building or to have a press release thanking him for his years of service. He asked the EDA what their thoughts and ideas were. Jacobs suggested doing something at the grand opening of the City Hall and the article in the paper should give history of his contribution to the City. She added a plaque could be presented to the family at the grand opening of the City Hall building. Márquez-Simula stated she would be willing to do a proclamation. James explained she was in favor of all of the presented ideas and asked if there would be a Staff member who would be able to spend time researching Mr. Herringer’s history and role in the City. Forney replied that the press release would not be ready in time of the grand opening but would have enough information for the proclamation. James stated she would like to direct Staff to make a plaque. The Commissioners agreed. Márquez-Simula requested a Staff member to put together the proclamation since she does not know Mr. Herringer’s history. Hansen stated it would be difficult to have a plaque ready by the grand opening since many companies are estimating 2-8 weeks. He suggested having the plaque ready for a Council meeting. Márquez-Simula added that something could be said at the grand opening about Mr. Herringer and then do a plaque later. The Commissioners agreed. Forney noted both Mr. Herringer and Chair Szurek’s terms expire at the end of the year. Chair Szurek’s position will go through the normal process to fill the seat with interviews beginning in September. The EDA does not have a limit on how many terms can be served and it is a possibility to have Szurek return. In regards to Mr. Herringer’s position, the City Code and Charter mentions that the EDA would need to elect someone to fill his position for the remainder of his term or the EDA can decided to wait and be down a member until the term has expired. Staff and the City Attorney recommend to wait. 31 Item 3. City of Columbia Heights MINUTES August 07, 2023 Economic Development Authority Page 9 James stated there would be the most applicants if the EDA decides to wait go undergo the normal process. Márquez-Simula mentioned she would like to discuss the term limits since there are term limits for the other Commissions. Buesgens asked about altering term limits. Forney replied that the term limits would be verified since the EDA operates under different rules that traditional commissions. Spriggs asked if it would be beneficial to have two six term members on staggered years so the terms do no expire at the same time. Forney stated Staff would explore that and come back to the Council. Márquez-Simula asked if the discussion would be added to the work session or and EDA meeting. Forney stated it would be Council work session since it is a code amendment. OTHER BUSINESS Forney stated the abatement was completed on 841 and 4243. The Fire Department is getting the paper work ready for the burning down of 841 and are allowed to do training. He stated he went to 4243 with the building official to ensure everything was removed and added that the building was in poor condition. The current gas franchise agreement with CenterPoint Energy expires in 2023. The renewal of a new franchise agreement grants CenterPoint Energy the authority to import, distribute and sell gas for public and private use within the City’s borders. The franchise agreement has been reviewed by the City Attorney and City staff and is recommended for approval. Approval of the proposed franchise agreement is in ordinance format and requires two readings at regular City Council meetings, becoming effective 30 days after the second reading. SUMMARY OF CURRENT STATUS: The City of Columbia Heights gas franchise agreement with CenterPoint Energy expires this year. Public Works has developed a new franchise agreement for the City Council’s review. The new ordinance is based on a model ordinance created by the League of Minnesota Cities (LMC). The model ordinance was developed to assist local governments in creating a uniform agreement for natural gas service. I would highlight the following specifics of the ordinance before the council:  Provides additional definitions of terms and entities used in the agreement.  Provides for a twenty (20) year agreement.  This agreement is consistent with the permit and restoration standards that the gas company must follow in the City’s existing Right-of-Way Ordinance and Minnesota Rule 7819.  Provides proper notice of proposed public improvements by the City to CenterPoint.  An indemnity clause has also been included to protect the City from potential problems that may arise due to construction, maintenance, operation, repair, inspection or removal of gas service lines within the City of Columbia Heights.  The proposed ordinance preserves the right of the City to implement a franchise fee that can be enacted over the life of the contract. The proposed ordinance does not enact the franchise fee at this time. The City Attorney and City staff have also reviewed the proposed ordinance and those comments are incorporated into this document. A writing served by any party or parties on any other party or parties. Company shall pay the expense of publication of this Ordinance. 2.5. Dispute Resolution. If either party asserts that the other party is in default in the performance of any obligation hereunder, the complaining party shall notify the other party of the default and the desired remedy. The notification shall be written. Representatives of the parties must promptly meet and attempt in good faith to negotiate a resolution of the dispute. If the dispute is not resolved within thirty (30) days of the written Notice, the parties may jointly select a mediator to facilitate further discussion. The parties will equally share the fees and expenses of this mediator. If a mediator is not used or if the parties are unable to resolve the dispute within thirty (30) days after first meeting with the selected mediator, either party may commence an action in District Court to interpret and enforce this Franchise or for such other relief as may be permitted by law or equity. 68 Item 7. | P a g e 3 o f 7 | 2.6. Continuation of Franchise. If the City and the Company are unable to agree on the terms of a new franchise by the time this Franchise expires, this Franchise will remain in effect until a new franchise is agreed upon, or until ninety (90) days after the City or the Company serves written Notice to the other party of its intention to allow Franchise to expire. SECTION 3. LOCATION, OTHER REGULATIONS 3.1. Location of Facilities. Gas Facilities shall be located, constructed, and maintained so as not to interfere with the safety and convenience of ordinary travel along and over Public Ways and so as not to disrupt normal operation of any City Utility System. Gas Facilities may be located on Public Grounds in a location to be mutually agreed by the City and the Company. The location and relocation of Gas Facilities shall be subject to reasonable regulations of the City consistent with authority granted the City to manage its Public Ways and Public Grounds under state law, to the extent not inconsistent with a specific term of this Franchise. 3.2. Street Openings. Company shall not open or disturb the surface of any Public Way or Public Ground for any purpose without first having obtained a permit from the City, if required by a separate ordinance, for which the City may impose a reasonable fee, unless the City is receiving a franchise fee pursuant to this Ordinance, in which case all permit fees will be waived. Permit conditions imposed on Company shall not be more burdensome than those imposed on other public right-of-way users for similar facilities or work. Company may, however, open and disturb the surface of any Public Way or Public Ground without a permit if (i) an emergency exists requiring the immediate repair of Gas Facilities and (ii) Company gives telephone, email or similar Notice to the City before commencement of the emergency repair, if reasonably possible. Within two (2) business days after commencing the repair, Company shall apply for any required permits and pay any required fees. 3.3. Restoration. After undertaking any work requiring the opening of any Public Way or Public Ground, the Company shall restore the Public Ways or Public Grounds in accordance with Minnesota Rules, 7819.1100. Company shall restore the Public Ground to as good a condition as formerly existed, and shall maintain the surface in good condition for six (6) months thereafter. All work shall be completed as promptly as weather permits, and if Company shall not promptly perform and complete the work, remove all dirt, rubbish, equipment and material, and put the Public Ground in the said condition, the City shall have, after demand to Company to cure and the passage of a reasonable period of time following the demand, but not to exceed five (5) days, the right to make the restoration of the Public Ways or Public Grounds at the expense of Company. Company shall pay to the City the cost of such work done for or performed by the City. The Company shall not be required to post a construction performance bond. 3.4. Avoid Damage to Gas Facilities. The Company must take reasonable measures to prevent the Gas Facilities from causing damage to persons or property. The Company must take reasonable measures to protect the Gas Facilities from damage that could be inflicted on the Gas Facilities by persons, property or the elements. Per Minnesota Statute § 216D.05, the City must take protective measures when it performs work near the Gas Facilities. 3.5. Notice of Improvements to Streets. The City will give Company reasonable written Notice of plans for improvements to Public Ways and Public Grounds where the City has reason to 69 Item 7. | P a g e 4 o f 7 | believe that Gas Facilities may affect or be affected by the improvement. The Notice will contain: (i) the nature and character of the improvements, (ii) the Public Ways or Public Grounds upon which the improvements are to be made, (iii) the extent of the improvements, (iv) the time when the City will start the work, and (v) if more than one Public Way or Public Grounds is involved, the order in which the work is to proceed. The Notice will be given to Company a minimum of eight (8) weeks time, considering seasonal working conditions, in advance of the actual commencement of the work to permit Company to make any additions, alterations or repairs to its Gas Facilities Company deems necessary. 3.6 Mapping Information. If requested by City, Company must promptly provide complete and accurate mapping information for any of its Gas Facilities in accordance with the requirements of Minnesota Rules 7819.4000 and 7819.4100. 3.7. Emergency Response. As emergency first responders, when a public safety concern exists both the City and Company shall respond to gas emergencies within the City without additional direct fee or expense to either City or Company. SECTION 4. RELOCATIONS 4.1. Relocation in Public Ways. The Company and City shall comply with the provisions of Minnesota Rules 7819.3100 with respect to requests for the Company to relocate Gas Facilities located in Public Ways. 4.2 Relocation in Public Grounds. City may require Company at Company’s expense to relocate or remove its Gas Facilities from Public Grounds upon a finding by City that the Gas Facilities have become or will become a substantial impairment to the existing or proposed public use of the Public Grounds. Nothing in this Section 4.2 shall be construed so as to invalidate or impair any existing company easements in Public Grounds. 4.3. Projects with Federal Funding. Relocation, removal or rearrangement of any Company Gas Facilities made necessary because of the extension into or through City of a federally aided highway project shall be governed by the provisions of Minnesota Statutes §§ 161.45 and 161.46. SECTION 5. INDEMNIFICATION 5.1. Indemnity of City. Company shall indemnify and hold the City harmless from any and all liability, on account of injury to persons or damage to property occasioned by the construction, maintenance, repair, inspection, the issuance of permits or the operation of the Gas Facilities located in the Public Ways and Public Grounds. The City shall not be indemnified for losses or claims occasioned through its own negligence or otherwise wrongful act or omission except for losses or claims arising out of or alleging the City's negligence as to the issuance of permits for, or inspection of, Company's plans or work. 5.2. Defense of City. In the event a suit is brought against the City under circumstances where this agreement to indemnify applies, Company at its sole cost and expense shall defend the City in such suit if written Notice thereof is promptly given to Company within a period wherein Company is not prejudiced by lack of such Notice. If Company is required to indemnify and defend, 70 Item 7. | P a g e 5 o f 7 | it will thereafter have control of such litigation, but Company may not settle such litigation without the consent of the City, which consent shall not be unreasonably withheld. This section is not, as to third parties, a waiver of any defense or immunity otherwise available to the City. The Company, in defending any action on behalf of the City, shall be entitled to assert in any action every defense or immunity that the City could assert in its own behalf. This Franchise agreement shall not be interpreted to constitute a waiver by the City of any of its defenses of immunity or limitations on liability under Minnesota Statutes, Chapter 466. SECTION 6. VACATION OF PUBLIC WAYS AND PUBLIC GROUNDS The City shall give Company at least two weeks prior written Notice of a proposed vacation of a Public Ways or Public Grounds. The City and the Company shall comply with Minnesota Rules 7819.3100 and 7819.3200 with respect to any request for vacation. SECTION 7. CHANGE IN FORM OF GOVERNMENT Any change in the form of government of the City shall not affect the validity of this Ordinance. Any governmental unit succeeding the City shall, without the consent of Company, succeed to all of the rights and obligations of the City provided in this Ordinance. SECTION 8. FRANCHISE FEE 8.1. Form. During the term of the franchise hereby granted, the City may charge the Company a franchise fee. The Company will administer the collection and payment of franchise fees to City in lieu of permit fees or other fees that may otherwise be imposed on the Company in relation to its operations as a public utility in the City. The franchise fee will be collected on a flat fee basis, or by some other method that is mutually acceptable to both City and Company for each retail customer account within the corporate limits of the City. The amount of the fee collected may differ for each customer class. The City will use a formula that provides a stable and predictable amount of fees, without placing the Company at a competitive disadvantage. Such fee shall not exceed any amount that the Company may legally charge to its customers prior to payment to the City and be consistent with the Minnesota Public Utility Commission’s March 23, 2011, Order establishing franchise fee filing requirements in Docket No. E,G999/CI-09-970. If the Company claims that the City required fee formula is discriminatory or otherwise places the Company at a competitive disadvantage, the Company will provide a formula that will produce a substantially similar fee amount to the City. If the City and Company are unable to agree, the disagreement shall be subject to the Dispute Resolution provisions of this Ordinance. 8.2. Separate Ordinance. The franchise fee shall be imposed by separate ordinance duly adopted by the City Council. The effective date of the franchise fee ordinance shall be no less than ninety (90) days after written Notice enclosing a copy of the duly adopted and approved ordinance has been served upon the Company by Certified mail. The Company is not required to collect a franchise fee if the terms of the fee agreement are inconsistent with this franchise or state law, provided the Company notifies the City Council of the same within the ninety (90) day period. 8.3. Condition of Fee. The separate ordinance imposing the fee shall not be effective against the Company unless it lawfully imposes a fee of the same or substantially similar amount on the sale of energy within the City by any other energy supplier, provided that, as to such supplier, the 71 Item 7. | P a g e 6 o f 7 | City has the authority or contractual right to require a franchise fee or similar fee through an agreed- upon franchise. 8.4. Collection of Fee. The franchise fee shall be payable not less than quarterly during complete billing months of the period for which payment is to be made. The franchise fee formula may be changed from time to time, however, the change shall meet the same Notice and acceptance requirements and the fee may not be changed more often than annually. Such fee shall not exceed any amount that the Company may legally charge to its customers prior to payment to the City and be consistent with Minnesota Public Utility Commission’s March 23, 2011, Order establishing franchise fee filing requirements in Docket No. E,G999/CI-09-970. Such fee is subject to subsequent reductions to account for uncollectibles and customer refunds incurred by the Company. The Company shall not be responsible to pay City fees that Company is unable to collect under Commission rules or order. The Company, if requested by the city, shall provide a statement summarizing how the franchise fee payment was determined, including information showing any adjustments to the total made to account for any non-collectible accounts, refunds, or error corrections. Company agrees to make available for inspection by City at reasonable times all records necessary to audit Company’s determination of the franchise fee payments. 8.5. Continuation of Franchise Fee. If this franchise expires and the City and the Company are unable to agree upon terms of a new franchise, the franchise fee, if any being imposed by the City at the time this franchise expires, will remain in effect until a new franchise is agreed upon. However, the franchise fee will not remain in effect for more than one (1) year after the franchise expires as stated in Section 2.6 of this Franchise. If for any reason the franchise terminates, the franchise fee will terminate at the same time. SECTION 9. ABANDONED FACILITIES The Company shall comply with Minnesota Rules, Part 7819.3300, as it may be amended from time to time with respect to abandoned facilities in Public Ways. The Company shall maintain records describing the location of all abandoned and retired Gas Facilities within the Public Ways and Public Grounds, produce such records at the City’s request and comply with the location requirements of Minnesota Statutes § 216D.04 with respect to all Gas Facilities located in Public Ways and Public Grounds. SECTION 10. PROVISIONS OF ORDINANCE 10.1. Severability. Every section, provision or part of this Ordinance is declared separate from every other section, provision or part; and if any section, provision or part shall be held invalid, it shall not affect any other section, provision or part. Where a provision of any other City ordinance is inconsistent with the provisions of this Ordinance, the provisions of this Ordinance shall prevail. 10.2. Limitation on Applicability. This Ordinance constitutes a franchise agreement between City and Company as the only parties. No provisions herein shall in any way inure to the benefit of any third person (including the public at large) so as to constitute any such person as a third-party beneficiary of this Ordinance or of any one or more of the terms hereof, or otherwise give rise to any cause of action in any person not a party hereto. 72 Item 7. | P a g e 7 o f 7 | SECTION 11. From this discussion came the Council’s guidance to prohibit smoking within City parks. Ordinance 1688 prohibits the smoking of tobacco, marijuana, and other plants natural and synthetic within City parks. Smoking is already defined in City code as: Inhaling, exhaling, burning, or carrying any lighted or heated cigar, cigarette, or pipe, or any other lighted or heated product containing, made, or derived from nicotine, tobacco, marijuana, or other plant, whether natural or synthetic, that is intended for inhalation. SMOKING also includes carrying or using an activated electronic delivery device . With smoking already defined and already including electronic delivery devices, Ordinance 1688 would also prohibit the use of electronic delivery devices on park property. Ordinance 1688 also amends the City’s definition of public place to make it a more comprehensive definition. Last, staff have utilized this opportunity to update the pronouns in the related sections. At the First Reading of Ordinance 1688, members of the Council identified issues with section I of chapter 10.201 and voted to amend this section of the code. In working with the City Attorney, staff concluded that the section should be deleted. The outdated language expressed items that need not be expressed in an ordinance and, with regard to maintenance personnel, can be handled in a city-wide policy. Moving forward, it will be the policy of the City that during times of maintenance and cleaning, bathrooms will be vacated of non- maintenance personnel to allow for the proper cleaning of the areas. (C) No person shall go on foot or otherwise upon the grass or turf of any park where any sign is posted prohibiting such conduct. (D) No person shall throw, deposit or leave in any park any paper, rubbish, waste, or refuse of any kind, whether or not the same is offensive to the senses or is injurious to health, except in the receptacles therein provided for such paper, rubbish, waste and refuse. (E) Any person, firm, group or organization who shall distribute or display any circulars, cards, announcements or other items, either printed or otherwise, shall cause the same to be distributed in an orderly manner. Further, that any such of the aforesaid items shall not be allowed to litter any of the park property. (1) Any person, firm, group or organization who so distributes any of the aforesaid items shall be responsible to clean the park property of such distributions. (2) No person shall post, paste, fasten, paint or affix any placard, bill, notice or sign upon any structure tree, stone, fence, thing or enclosure along, or within any park without the written authorization of the Park and Recreation Commission. (F) No person shall at any time set, lay, prepare, or have in possession any trap, snare, artificial light, net, bird line, or any contrivance whatever, for the purpose of catching, taking, injuring or killing any bird or wild animal in any park, except if authorized by the Public Works Director. (G) No person shall play golf, tennis or other ball games upon or within any park, or parkway, except upon ball, tennis or appropriate athletic grounds or golf links established by the Park and Recreation Commission. This section shall not prohibit persons from playing catch with a ball or other object customarily used for that purpose so long as that activity does not unreasonably interfere with the use of the park by other persons. 76 Item 8. (H) No person shall move benches, seats and tables from their places in any park or parkway, except that tables and benches placed in picnic areas for picnics may be shifted in the picnic area within any single park for use. (I) No male, except for personnel in connection with their duties of park maintenance, shall enter a toilet room set apart for females; no female, except for personnel in connection with their duties of park maintenance, shall enter a toilet room set apart for males. (JI) No person shall solicit, offer for sale, or sell to the public any article or thing whatsoever in any park or parkway, except sales of refreshments and other articles under the direction of the Park and Recreation Commission. (KJ) No person using a parkway as a pedestrian shall carelessly or maliciously interfere with the passage of vehicles. (LK) No person shall be permitted to take any pet into any park unless it is led by a suitable leash, and in no case shall any person allow or bring any dog owned or attended by him them upon any bathing beach or into any park waters, or upon any skating rink, or in any park building whether the dog is leashed or otherwise, unless so authorized in writing by the Public Works Director. (ML) (1) No entertainment or exhibitions shall be given in any park or parkway except under the direction or by authority of the Park and Recreation Commission. (2) No public meeting of any kind shall be held in any park or parkway, playground or athletic field, nor shall there be any public speaking therein, without a written permit granted therefor by the Park and Recreation Commission. (NM) No person shall start any fire in any park or upon any park property, except that small fires may be made by picnic parties in parks designated by the Park and Recreation Commission and in the places in said parks provided for said purpose by the Public Works Director. (1) Every person who starts any such fire and every person using such fire is hereby charged with the duty of completely extinguishing such fires or fire before leaving such park. (2) Nothing herein shall be construed as limiting or restricting the enforcement of any ordinances regulating air pollution control and setting ambient air quality standards. (ON) No person shall persistently interfere with the orderly conduct of games or play by the participants therein. Such interference shall constitute disorderly conduct within the provisions of this chapter. (PO) No person shall have in his their possession or consume any intoxicating liquor or non-intoxicating malt liquor in or upon any city park, parkway, or bathing beach within the city. (1) Provided, however, the City Council may by affirmative vote grant permission to persons attending family gatherings, employees and their families attending gatherings in conjunction with their employment, and persons attending gatherings of or gatherings sponsored by non-profit public service, charitable, educational, or religious organizations within the community to possess and consume 3.2 malt liquor in city parks, except before 8:00 a.m. and after 9:30 p.m. No such permission may be granted for such possession or consumption in or upon any public bathing beach or anywhere in Silver Lake Beach Park. 77 Item 8. (2) The prohibitions of this division shall not apply on Fridays, Saturdays, Sundays, or legal holidays to Huset Park between the hours of 8:00 a.m. and 11:00 p.m. and shall not apply to John Murzyn Hall (Columbia Heights Fieldhouse) at any time. (QP) Nothing contained herein shall be construed as limiting or restricting Park and Recreation Commission or city agents and employees from doing all acts necessary to the performance of their duties. (RQ) (1) The Park and Recreation Commission is hereby authorized to post the Silver Lake Beach area, which includes the boat landing, with signs indicating that the said beach area or designated portion thereof is closed to the public. Signs posted pursuant to this chapter must clearly describe the area which is closed, the times at which such restriction applies, and the penalty which may result to any person who violates the prohibition of the sign. The location of signs posted pursuant to this section shall be reasonably calculated to give notice to persons of the prohibition. No sign shall be posted in accordance with this section unless the Park and Recreation Commission shall first approve the message placed upon the sign and the proposed location thereof. (2) No person shall enter or be upon the beach property, including the boat landing, in violation of the prohibitions of any sign posted pursuant to this section. Ord. 1367, passed 12-8-97); Ord. 1688, passed XX-XX-XX) 10.303 of the Columbia Heights City Code is hereby amended to read as follows, to wit: 10.303 CURFEW. (A) Findings and purpose. (1) In recent years, there has been a significant increase in juvenile victimization and crime. At the same time, the crimes committed by and against juveniles have become more violent. A significant percentage of juvenile crime occurs during curfew hours. (2) Because of their lack of maturity and experience, juveniles are particularly susceptible to becoming victims of older perpetrators. The younger the person is, the more likely he is they are to be a victim of crime. (3) While parents have the primary responsibility to provide for the safety and welfare of juveniles, Columbia Heights also has a substantial interest in the safety and welfare of juveniles. Moreover, the City of Columbia Heights has an interest in preventing juvenile crime, promoting parental supervision, and providing for the well being of the general public. (4) An updated and enforceable curfew ordinance will reduce juvenile victimization and crime and will advance public safety, health, and general welfare. (B) Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning. 78 Item 8. EMERGENCY. A circumstance or combination of circumstances requiring immediate action to prevent property damage, serious bodily injury, or loss of life. ESTABLISHMENT. Any privately owned place of business to which the public is invited, including but not limited to, any place of amusement, entertainment, or refreshment. GUARDIAN. An adult appointed pursuant to M.S. §§ 525.6155 or 525.6165, as they may be amended from time to time, who has the powers and responsibilities of a parent as defined by M.S. § 525.619, as it may be amended from time to time. JUVENILE. A person under the age of 18. The term does not include persons under 18 who are married or have been legally emancipated. PARENT. Birth parents, adopting parents, and step parents. PROPRIETOR. Any individual, firm, association, partnership, or corporation operating, managing, or conducting any establishment. The term includes the members or partners of an association or partnership and the officers of a corporation. PUBLIC PLACE. Property owned, leased, or controlled by a governmental unit and private property that is regularly and frequently open to or made available for use by the public in sufficient numbers to give clear notice of the property's current dedication to public use but does not include the following: (1) a private residence including the person’s curtilage or yard; (2) private property not generally accessible by the public. Any place to which the public or a substantial group of the public has access and includes, but is not limited to, streets, highways, and the common areas of schools, hospitals, apartment houses, office buildings, transport facilities, and shops. RESPONSIBLE ADULT. A person over the age of 18 specifically authorized by law or by a parent or guardian to have custody and control over a juvenile. SERIOUS BODILY INJURY. Bodily injury that creates a substantial risk of death, serious permanent disfigurement, or protracted loss or impairment of the function of any body part or organ. (C) Prohibited acts. (1) It is unlawful for a juvenile under the age of 16 to be present in any public place or establishment within the city. (a) Any time between 10:00 p.m. on any Sunday, Monday, Tuesday, Wednesday, or Thursday and 5:00 a.m. on the following day. (b) Any time between 11:00 p.m. on any Friday or Saturday and 5:00 a.m. on the following day. (2) It is unlawful for a juvenile, age 16 or 17 to be present in any public place or establishment within the city: (a) Any time between 11:00 p.m. on any Sunday, Monday, Tuesday, Wednesday, or Thursday and 5:00 a.m. the following day. 79 Item 8. (b) Any time between 12:01 a.m. and 5:00 a.m. on any Saturday or Sunday. (3) It is unlawful for a parent or guardian of a juvenile knowingly, or through negligent supervision, to permit the juvenile to be in any public place or establishment within the city during the hours prohibited in subsections (1) and (2). (4) (a) It is unlawful for a proprietor of an establishment within the city to knowingly permit a juvenile to remain in the establishment's property during the hours prohibited in subsections (1) and (2). (b) If the proprietor is not present at the time of the curfew violation, the responding officers shall leave written notice of the violation with an employee of the establishment. A copy of the written notice shall be served upon the establishment's proprietor personally or by certified mail. (D) Defenses. (1) It is an affirmative defense for a juvenile to prove that: (a) The juvenile was accompanied by his their parent, guardian, or other responsible adult. (b) The juvenile was engaged in a lawful employment activity or was going to or returning from his their place of employment. (c) The juvenile was involved in an emergency situation. (d) The juvenile was going to, attending, or returning home from an official school, religious, or other recreational activity sponsored and/or supervised by a public entity or civic organization. (e) The juvenile was on an errand at the direction of a parent or guardian. (f) The juvenile was exercising First Amendment rights protected by the United States Constitution or Article I of the Constitution of the State of Minnesota. (g) The juvenile was engaged in interstate travel. (h) The juvenile was on the public right-of-way, boulevard or sidewalk abutting the property containing the juvenile's residence or abutting a neighboring property, structure, or residence. (2) It is an affirmative defense for a proprietor of an establishment to prove that: (a) The proprietor or employee reasonably and in good faith relied upon a juvenile's representations of proof of age. Proof of age may be established pursuant to M.S. § 340A.503, subd. 6, as it may be amended from time to time, or other verifiable means, including but not limited to, school identification cards and birth certificates. (b) The proprietor or employee promptly notified the city Police Department that a juvenile was present on the premises of the establishment during curfew hours. (E) Penalty. The purpose of this ordinance is to establish, upon passage, a prohibition on smoking within City parks and parking lots adjacent to City parks. This Ordinance also makes small updates to the City Code. For example, updating pronouns in the referenced sections, updating the definition of public place, and deleting code section 10.201 I relating to maintenance personnel entering park bathrooms. EDA staff have estimated the abatement, utilities removal, and demolition of the buildings on these properties would cost the EDA approximately $80,000. With that, the EDA and EDA staff thought it best to utilize the Anoka County HRA (ACHRA) levy to fund the purchase and demolition of the properties. The EDA will front the initial costs but requires the City Council to request the funds from the ACHRA in order to refund the project costs. Before the council are resolutions 2023-49 and 2023-50. 2023-49 requests the $780,000 in estimated project funds from the ACHRA. Whereas upon receipt of the funds the City will transfer the funds to the EDA, which is actioned by Resolution 2023-50.
