HomeMy WebLinkAbout2022-4108CONTRACT #2022-4108 AGREEMENT FOR AGENT OF RECORD SERVICES WHEREAS, the League of Minnesota Cities Insurance Trust requires cities to use the services of an agent in order to participate in the LMCIT property/casualty program; and WHEREAS, the City Council has reviewed and considered the written materials from LMCIT discussing the agent's role and compensation in LMCIT; and WHEREAS, Brian J. Lundquist has agreed that the Nesbit Group is willing to provide to the city the services listed below under the terms and conditions listed below; The City Council of the City of Columbia Heights resolves as follows: APPOINTMENT 1. The City of Columbia Heights hereby appoints as its agents for purposes of the City's participation in the League of Minnesota Cities Insurance Trust (LMCIT) property/casualty program. Term 2. This appointment is to begin on 06/01/2020 and is anticipated to remain in effect until 06/01/2023 but may be terminated sooner with cause and ninety (90) days prior written notice by either party. COMPENSATION 3. As compensation for services provided to the city as described in paragraph 4 below, the agent will receive a fee of $1,000.00/month for property, liability, and fleet automobile coverages. Workers' Compensation fees shall be included in the fee listed above. Agent stipulates that if the Columbia Heights City Council does not feel that Brian J. Lundquist and the Nesbit Group have performed the "services" listed on page 2 to their satisfaction, 50% of the fees received will be returned to the City of Columba Heights. SERVICES 4. The agent will perform for the city the following services: a) Advise and assist the city in assembling and accurately reporting underwriting data, including updating property values, for rating purposes. b) Advise and assist the city in evaluation and selecting among coverage alternatives such as deductibles, limits, optional coverage, alternative coverage forms, etc. c) Review coverage documents and invoices to assure coverage has been correctly issued and billed. d) Advise the city on potential gaps or overlaps in coverage. e) Assist the city as requested in submitting claims and interpreting coverage as applied to particular claims. f) Review loss reports for correct reporting, appropriate reserves, etc. g) Assist as requested with safety and loss control activities. h) Assist the city in identifying risk exposures and developing appropriate strategies to address those exposures. i) Make recommendations on risk management based on review of past risk management studies. j) The successful candidate will be in contact with the city's administrator in all matters as they relate to property/liability insurance for the city. Said candidate may also be required to address the City Council or one of the Council Committees as the need arises. k) Prompt response to questions and request is an absolute requirement. It is expected that there will be more than one individual within the firm capable of addressing possible concerns of the city. �I25120 Date Nesbit Group
