(Carlson McCain) has been assisting the City of Columbia Heights (City) to address environmental concerns at the above referenced Site, in order to spur redevelopment of the Property. This purpose of this Letter is to provide an Agreement by and between the City and Carlson McCain to complete remediation, as outlined in the following Sections. Scope of Work In short, the following Tasks were/will be conducted to complete this Project: * Prepared Specifications and solicited Bids from qualified demolition & excavation contractors. • Environmental remediation of the Site was conducted in December of 2021. • Implementation was conducted following the Minnesota Pollution Control Agency (MPCA) approved Response Action Plan (RAP) prepared by Carlson McCain, with Veit Companies providing demolition & excavation work and Carlson McCain providing oversight. In short, remediation activities consisted of the following: o Underground utilities were cleared prior to the start of work. o Regulated & hazardous materials were removed from the buildings, prior to the start of demolition. a The three smaller buildings were demolished and the foundation of the main building (which burned in 2010) was removed. o Clearing and grubbing of trees & brush was conducted, as necessary. o Excavation of known contaminated soils which exceeded MPCA Residential Screening Limits was conducted, including approximately 644 tons (495 cubic yards) of non- hazardous soil and approximately 22 tons (17 cubic yards) of hazardous soil. o All materials were disposed of at approved landfills and recycling_ of clean concrete was conducted, whenever possible. o Not surprisingly (given the age, history and location of the Site), there were some newly discovered subsurface issues identified, including buried bundles shingles (in several 1565036THAVENUE NORTH, SUITE 110, PLYMOUTH, MN 55446 \ TEL952.346.3900 \ FAX 952.346,3901 \ CARLSONMCCAIN.COM Agreement to Conduct Environmental Remediation Former Root Property locations), a secondary concrete slab beneath one of the buildings, an area where dumping had occurred (which included asbestos containing material or ACM) and twin 6,000 gallon underground storage tanks (USTs). o Interim grading was conducted. • Carlson McCain will be preparing a RAP Implementation Report and will be recommending the MPCA issue a No Further Action Letter. • Carlson McCain will continue working with the City and/or MPCA (i.e. meetings, correspondence, etc.), as necessary. Carlson McCain will also continue working with the City, Minnesota Department of Commerce (MDC) and the MPCA to address removal, investigation and/or cleanup associated with the two USTs; however, work, costs and schedule associated with this Task will be handled separate from this Agreement. Payment As you are aware, Carlson McCain recently submitted invoices to the City, which covered planning and oversight related to remediation (i.e. RAP Implementation, estimated cost of $14,250). Subsequently, remaining invoices will be related to Preparing the RAP Implementation Report (estimated cost of $8,925) and Project Management & MPCA liaison necessary until the No Further Action Determination Letter is issued (estimated cost of $3,380). As a reminder, the MPCA VBP is a fee for service program, their staff bill at $150/hour for their services and they will send their invoices directly to the City. Schedule Carlson McCain will soon begin preparing the RAP Implementation Report and once finalized, will be submitted to the MPCA for review. Assuming the MPCA utilizes the full 60 days for review and agrees with our Recommendations, the No Further Action Determination Letter will likely be issued sometime in late summer of 2022.
