Total cost: $13,869.00
Exclusions
All projects to exclude Utility Relocation, Survey, Sidewalk Closure, Traffic Control, Erosion Control,
Inspections or Independent Testing,
Acceptance/Time. This Contract must be approved and executed by the City of Columbia Heights within
30 days of its presentation by Contractor, it will be void thereafter. The attached Terms and Conditions are
part of this Contract.

Additional Terms mid Conditions
I . Changes/Extra Costs. Changes in the work, including deviation from the approved plan and specifications,
which involve extra charges to the City of Columbia Heights, will only be executed when authorized by a written
agreement of the parties, which describes the changed work and the costs to be paid by the City of Columbia Heights
to Contractor to perform it.
2. Labor and Materials/Warranty. Contractor warrants to the City of Columbia Heights that the labor and
materials furnished will be of good quality, will conform to the requirements of this Contract and will be free from
defects in material or workmanship for a period of one year (365) days from the date of completion. Contractor will
correct deficiencies in the work during the warranty period at its own expense. This warranty excludes remedy for
damage or defect caused by abuse, changes not executed by Contractor, improper or insufficient maintenance, natural
disasters, or normal wear and tear and normal usage.
3. I» teresVCollec(ion. Payments that are not made by the City of Columbia Heights to Contractor when due
will bear interest at the rate of 12% per annum until paid.
4. Job Site Conditions. Contractor assumes that materials & equipment can be stored on -site. Contractor will
access work area in most direct route or as specified in drawing, this may include use of Owners Driveway, some
damage may result. Contractor assumes soil holds necessary weight bearing qualities with no obstructions (boulders,
utilities (private or otherwise), underground dog fencing, high ground water, peat or other hidden obstacles).
Additional costs may be required if otherwise.
Pre -Lien Notice.
"(a) Any person or company supplying labor or materials for this improvement to your
property may file a lien against your property if that person or company is not paid for the
contributions.
"(b) Under Minnesota law, you have the right to pay persons who supplied labor or materials
for this improvement directly and deduct this amount from our contract price, or withhold
the amounts due them from us until 120 days after completion of the improvement unless we
give you a lien waiver signed by persons who supplied any labor or material for the
improvement and who gave you timely notice."
