The ordinance vould anend Section 56 & 57 of the City Charter. The changes vould raise the City l{anager's spending and contract signature requirements fron the present threshold of $1,000 to $3,000. The entire ordinance is being published in the official nevspaper on Novenber 2L and 28, 1990. December L0, 1990, is scheduled as the second reading and official public hearing on this ordinance. I 1' Prr*l I I RI COUNCIL ACTION: ORDINANCE NO. 1213 BEING AN ORDINANCE AMENDING CHAPTER 6, SECTION 56, PURCHASES AND CONTRACTS, AND SECTION 57, CONTRACTS, HOt.l LET, OF THE CHARTER OF THE CITY OF COLUI'IBIA HEIGHTS Columbia Heights does ordain: Chapter 6, Section 56, of the Charter of the City of Columbia Heights which reads as follows, to-wit: 'PURCHASES AND CONTRACTS. The city manager shall be chief purchasing agent of the city. A1l purchases on beha'lf of the city shal] be made, and a1l contracts let by the city manager subject to the approval of the council, whenever the amount of such purchases or contract exceeds $1,000.00. All contracts, bonds and instruments of every kind to which the city shall be a party sha'll be signed by the mayor on behalf of the city as well as by the city manager, and sha1l be executed in the name of the city." Is herewith amended to read as follows, to-wit: Section 56. PURCHASES AND C0NTRACTS. The City Manager sha'll be the chief purchasing agent of the City. All purchases and contracts on behalf of the City shal'l be made by the City lvlanager, but subject to the approval of the City Council whenever the amounts of such purchases or contracts exceeds $3,000.00. A'll contracts of any kind to which the City is a party exceeding $3,000.00 and instruments for the conveyance of any real estate by the City shal'l be signed by the lvlayor and the City ltlanager on behalf of the City and shall be executed in the name of the City. Chapter 6, Section 57, of the Charter of the City of Co'lumbia Heights which reads as follows, to-wit: "C0NTRACTS, H0bl LET. If the work to be done or property of any kind to be purchased is estimated to exceed $10,000.00 the city sha'l'l advertise for sealed bids in such manner as may be designated by the city council. Contracts of this magnitude sha1l be let only by the city council and sha'll go to the'lowest responsib'le bidder. The city council may e'lect to reject any and all bids. If the amount of the contract is estimated to exceed $5,000.00 but not exceed $10,000.00 the contract may be made upon either sealed bids or by direct negotiation, by obtaining two or more written quotations comp'lying with the requirenrents of competitive bidding. If the amount of the contract is estimated to be $5,000.00 or less the contract may be made either upon quotation or in the open market by discretion of the city council; but, so far as The Ci ty of Section 1: Section 2: .I Ipracticable, shall be based upon at least two written quotati ons. A'l 'l contrac ts of the City shall be let in accordance with the Uniform Municipal Contracting Law of the State of Minnesota. Further regulations for the taking of bids and letting of contracts may be made by ordinance. This 0rdinance shall be in full force and effect from and after ni nety (90 ) days af ter i ts pub'l i cati on. Anderson Acting City llanager City of Columbia Heights 590 - 40th Avenue NE Columbia Heights, MN 5542L RE: Ordinance No. LZL3 - Amendments to Charter Sections 56 and 57 Dear Stu: Enclosed is proposed 0rdinance No. 1213 which amends Sections 56 and 57 of the City Charter in accordance with the recormendation of the Charter Cormission. You may have a first reading at the next regular meeting. The statute requires two weeks' published notice for the public hearing. I would recommend that we publish notice fn the Focus on November 2L, and November 28, 1990, for a December 10, 1990, public hearing. The notice should be in substantially the fo'll owi ng form, to-wi t: "PLEASE TAKE NOTICE that on the 10th day of December, 1990, at 7:30 p.m. in the Council Chambers of the Co'lumbia Heights City Ha1l,590 - 40th Avenue Northeast, Co'lumbia Heights, Minnesota, the City Council of the City of Columbia Heights will hold a public hearing to consider passage of the fo1'lowing amendments to the Charter of the City of Columbia Heights as set forth in the Ordinance hereafter pub1ished..."
