CALL TO ORDER/ROLL CALL PLEDGE OF ALLEGIANCE 111W&1-i0I.T4L01i;1►9WWII%IM0 Emergency Interim Ordinance 1665, Declaring a Local Emergency and Implementing a Temporary Curfew in the City of Columbia Heights as an Emergency Response to Civil Unrest. MOTION: Move to waive the reading of Emergency Interim Ordinance No. 1665, there being ample copies available to the public. MOTION: Move to approve Emergency Interim Ordinance No. 1665, Declaring a Local Emergency and Implementing a Temporary Curfew in the City of Columbia Heights as an Emergency Response to Civil Unrest. Please contact Administration at 763-706-3610 to make arrangements. In- EMERGENCY INTERIM ORDINANCE NO. 1665 Item 1. BEING AN EMERGENCY INTERIM ORDINANCE DECLARING A LOCAL EMERGENCY AND IMPLEMENTING A TEMPORARY CURFEW IN THE CITY OF COLUMBIA HEIGHTS AS AN EMERGENCY RESPONSE TO CIVIL UNREST. WHEREAS, on April 11, 2021, Daunte Wright died during a traffic stop by officers of the Brooklyn Center Police Department; and WHEREAS, civil unrest has emerged in the Twin Cities metropolitan area following Daunte Wright's death; and WHEREAS, civil unrest constitutes a local emergency as defined by Minnesota Statute Section 12.03, subd. 3; and; WHEREAS, with the City of Columbia Heights (the "City") being in close proximity to the City of Brooklyn Center, it is necessary, proper, and prudent to protect the safety of life and property in the City and to implement proactive measures to reduce the possibility of civil disobedience, vandalism, looting, civil unrest and rioting resulting in property damage and threats to the health and safety of the citizens of the City; and WHEREAS, on Monday, April 12, 2021, the Governor of the State of Minnesota, in response to widespread civil unrest, issued Executive Order 21-18 implementing a temporary curfew in Anoka, Hennepin, and Ramsey counties which included the City of Columbia Heights, Minnesota (the "City") from 7 p.m. on Monday, April 12, 2021 to Tuesday, April 13, 2021 at 6 a.m. NOW, THEREFORE, THE CITY OF COLUMBIA HEIGHTS DOES ORDAIN, that the City Council of the City of Columbia Heights, Minnesota (the "Council") declares a local emergency for April 13, 2021 and April 14, 2021. BE IT FURTHER ORDAINED BY THE CITY OF COLUMBIA HEIGHTS, the Council given the circumstances finds it necessary to continue a nighttime curfew and directs as follows: 1. Nighttime curfew: effective Tuesday, April 13, 2021 at 10 p.m. to 6:00 a.m. Wednesday, April 14, 2021. 2. Travel: During this curfew, all persons must not travel on any public street or public place. 3. Exemptions: All law enforcement, fire and medical personnel, as well as other personnel authorized by the City, Anoka County, the Department of Public Safety, Minnesota State Patrol, or Minnesota National Guard, and credentialed members of the media are exempt from the curfew. Individuals seeking emergency care, fleeing danger, or experiencing homelessness, and having to travel to and from employment and religious services are also exempt. 4. Definitions: For purposes of this emergency declaration, "travel" includes, without limitation, travel on foot, bicycle, skateboard, scooter, motorcycle, automobile, or public transit, or any other mode of transporting a person from one location to another. "Public Place" means any place, whether on privately or publicly owned property, accessible to the general public, including but not limited to public streets, roads, alleys, highways, sidewalks, parks, vacant lots and unsupervised property.
