BEING AN EMERGENCY INTERIM ORDINANCE DECLARING A LOCAL EMERGENCY AND IMPLEMENTING A
TEMPORARY CURFEW IN THE CITY OF COLUMBIA HEIGHTS AS AN EMERGENCY RESPONSE TO CIVIL UNREST.
WHEREAS, on April L7,2027, Daunte Wright died during a traffic stop by officers of the Brooklyn Center Police
DepartmenU and
WHEREAS, civil unrest has emerged in the Twin Cities metropolitan area following Daunte Wright's death; and
WHEREAS, civil unrest constitutes a local emergency as defined by Minnesota Statute Section t2.03, subd. 3;
and;
WHEREAS, with the City of Columbia Heights (the "City'') being in close proximity to the City of Brooklyn
Center, it is necessary, proper, and prudent to protect the safety of life and property in the City and to
implement proactive measures to reduce the possibility of civi! disobedience, vandalism, looting, civil unrest
and rioting resulting in property damage and threats to the health and safety of the citizens of the City; and
WHEREAS, on Monday, April L2,2O2L, the Governor of the State of Minnesota, in response to widespread civil
unrest, issued Executive Order ?L-LB implementing a temporary curfew in Anoka, Hennepin, and Ramsey
counties which included the City of Columbia Heights, Minnesota (the "City") from 7 p.m. on Monday, April L2,
2O2Lto Tuesday, April 13, 2O2L at 6 a.m.
NOW, THEREFORE, THE CITY OF COLUMBIA HEIGHTS DOES ORDAIN, that the City Council of the City of
Columbia Heights, Minnesota (the "Council") declares a loca! emergency for April L3,2O2t and April L4,2O2L.
BE lT FURTHER ORDAINED BY THE CITY OF COIUMBIA HEIGHTS, the Council given the circumstances finds it
necessary to continue a nighttime curfew and directs as follows:
1. Nighttime curfew: effective Tuesday, April 13, 2O2L at 10 p.m. to 6 a.m. Wednesday, Apri! L4,2021.
2. Travel: During this curfew, all persons must not trave! on any public street or public place.
3. Exemptions: All law enforcement, fire and medical personnel, as well as other personnel authorized by
the City, Anoka County, the Department of Public Safety, Minnesota State Patrol, or Minnesota
National Guard, and credentialed members of the media are exempt from the curfew. tndividuals
seeking emergency care, fleeing danger, or experiencing homelessness, and having to travel to and
from employment and religious services are also exempt.
4. Definitions: For purposes of this emergency declaration, travel" includes, without limitation, travelon
foot, bicycle, skateboard, scooter, motorcycle, automobile, or public transit, or any other mode of
transporting a person from one location to another. "Public Place" means any place, whether on
privately or publicly owned property, accessible to the genera! public, including but not limited to
public streets, roads, alleys, highways, sidewalks, parks, vacant lots and unsupervised property.

This ordinance shall be in full force and effect immediately upon passage.
