Commission Members present- Novitsky, Hoium, Schill, Sahnow, and (Fiorendino arrived late) Members Absent: Kaiser and Szurek Also present were Elizabeth Hammond (Planner), Shelley Hanson (Secretary), and John Murzyn (Council Liaison). RE-APPOINTMENT AND SWEARING IN OF COMMISSIONER Stan Hoium was sworn in for another four year term, prior to the start of the meeting. APPROVAL OF MINUTES Motion by Schill, seconded by Novitsky, to approve the minutes from the meeting of February 5, 2019. All ayes. MOTION PASSED. CASE #: 2019-0501 APPLICANT: Renaissance Fireworks LOCATION: 4005 Central Avenue NE REQUEST: Interim Use Permit Hammond explained that Renaissance Fireworks, Inc. has applied for an Interim Use Permit to allow the operation of a seasonal fireworks sales tent at 4005 Central Avenue. The specific development standards for outdoor fireworks sales/display are found in Section 9.107 (C) (22) of City Code, and will be added as conditions of approval for this permit. The attached property and tent location map illustrates the configuration and orientation of the fireworks tent to Central Avenue. The Fire Chief has inspected the plans and will conduct a site inspection of the tent. The applicant must schedule the inspection with the Fire Department before sales can occur on the property. ZONING ORDINANCE The property located at 4005 Central Avenue is located in the CBD, Central Business District. The properties to the north, south and west are also zoned Central Business and the properties to the east are zoned in the R-4, Multiple Family Residential District. Seasonal Fireworks Sales is allowed as Interim Use in the Central Business Zoning District. COMPREHENSIVE PLAN The Comprehensive Plan designates the property for commercial use. The proposal for seasonal fireworks sales is consistent with the intent of the City’s Comprehensive Plan. FINDINGS OF FACT Section 9.104 (I) of the Zoning Ordinance outlines seven findings of fact that must be met in order for the City to grant an interim use permit. The use is one of the interim uses listed for the zoning district in which the property is located, or is a substantially similar use, as determined by the Zoning Administrator. Fireworks tents are specifically listed as an Interim Use in the Central Business District, and are considered retail sales, which are permitted. 2. The use is in harmony with the general purpose and intent of the Comprehensive Plan. The Comprehensive Plan designates the property for commercial use, including retail sales. The proposal is consistent with the intent of the City’s Comprehensive Plan. 3. The use will not impose hazards or disturbing influences on neighboring properties. The proposed temporary use should not have hazardous or disturbing influence on neighboring properties because of its proximity to Central Avenue and because it’s shielded from adjacent residential uses by the surrounding commercial buildings. 4. The use will not substantially diminish the use of property in the immediate vicinity. The fireworks tent shouldn’t diminish the use of the adjacent properties. 5. The use will be designed, constructed, operated and maintained in a manner that is compatible with the appearance of the existing or intended character of the surrounding area. The fire department will conduct an on-site inspection prior to any temporary sales. All State and City requirements regarding fireworks sales will be achieved. 6. Adequate measures have been or will be taken to minimize traffic congestion on the public streets and to provide for appropriate on-site circulation of traffic. The traffic generated by the fireworks tent will not significantly increase the traffic on the public streets, and the site is large enough to handle additional interior traffic. 7. The use will not cause a negative cumulative effect on other uses in the immediate vicinity. As indicated by prior descriptions, the fireworks tent should not have a negative impact on other uses in the immediate vicinity, which are all zoned commercial. Staff recommends that the Planning Commission approve the Interim Use Permit to all ow the operation of a seasonal fireworks sales tent at 4005 Central Avenue, subject to conditions of approval outlined below. Questions by members: Hoium asked how many years they have been located at this site. The applicant told members he has been at this location for 14 years, and that they have between 25-50 locations in various cities each year. Schill asked if anything was different this year and the answer was no. Hammond told the applicant and members that the City has a new Building Official and he is requiring a Building Permit this year for the temporary structure. Sahnow questioned the use of flame breaks on the tables that is noted in the application. The applicant stated these are used to prevent flames from jumping to other merchandise should an event occur. Motion by Sahnow, seconded by Schill, to waive the reading of Resolution No. 2019-PZ01, there being ample copies available to the public. All ayes. MOTION CARRIED. Motion by Sahnow, seconded by Schill, to adopt Resolution No. 2019-PZ01, being a Resolution approving an Interim Use Permit for a fireworks tent at 4005 Central Avenue NE, from June 17, 2019 to July 12, 2019, subject to certain conditions of approval that have been found to be necessary to protect the public interest and ensure compliance with the provisions of the Zoning and Development Ordinance, including: 1. The fireworks tent, display area, access aisles, and surrounding area shall be reviewed by the Fire Department prior to operation. The applicant must contact the Fire Department to set up an inspection prior to any sales occurring on the property. 2. The applicant must obtain a Building Permit from the Building Official, and a site inspection must be conducted prior to operation. The applicant must contact the Community Development Department to obtain the Permit and schedule an inspection prior to any sales occurring on the property. 3. The sale of fireworks shall meet all requirements of Chapter 24 of the Fire Code and NFPA Chapter 1124. 4. The fireworks tent shall be accessory to a commercial use. 5. Fireworks tents located within the public right-of-way are prohibited. 6. All goods shall be displayed on a designated impervious surface area. 7. All goods shall be displayed in an orderly fashion, with access aisles provided as needed. 8. Music or amplified sounds shall not be audible from adjacent residential properties. 9. The fireworks tent shall not reduce the amount of off-street parking provided one-site below the level required for the principal use. 10. An appropriate transition area between the use and adjacent property shall be provided by landscaping, screening or other site improvements consistent with the character of the neighborhood. 11. Signage shall be limited to two professionally made signs, with a combined square footage not exceeding 32 square feet. 12. Fireworks tents may be allowed for a maximum of 90 days per calendar year. 13. The tent must be anchored to withstand 90MPH/3Second wind gusts. Any electrical use will need a permit and is required to be inspected by the State Electrical Inspector. All ayes. MOTION PASSED. DEVELOPMENT: New residential home and attached garage on the subject property LOCATION: 4320 Stinson Blvd. NE, Columbia Heights, MN 55421 REQUEST: Variance to the height requirements for an accessory structure PREPARED BY: Elizabeth Hammond, City Planner INTRODUCTION D.T. Meisinger Development Inc., on behalf of Alexis and Jennefer James, have requested a Variance to the wall and total height requirements for the proposed attached garage to be located on the subject property. Currently, the property is vacant and the property owners are planning to construct a new single family home on the property. The proposed house would meet setbacks and height requirements; however the attached garage as proposed exceeds the ordinance allotment for wall height and total height to the highest point. The City’s Zoning Ordinance defines accessory buildings or structures in Section 9.103 as: A building or structure or portion of a structure subordinate to and serving the principal structure on the same lot. In Section 9.106, the standards which regulate the construction and maintenance of accessory structures include that, the wall height cannot exceed 9 feet and that the total height measured to the highest point, cannot exceed 18 feet or the height of the house, whichever is less. The proposed garage has 12 foot walls and a total height of 21 feet, at the highest point, exceeding the wall height and total height by 3 feet. The applicant has requested a variance to allow for the proposed garage and included a narrative which details the reasoning for the request. According to the applicant, the request for taller walls and a taller total height is due to the location of the garage on the subject property and water run off concerns. Additionally, the applicant argues there could be financial impacts to lowering the garage to meet the wall and total height requirements. ZONING ORDINANCE The property is located in the R-1 Single Family Residential Zoning District. The properties to the north, south, and west are zoned R-1, Single Family Residential and Public and Open Space. The properties to the east are located in the City of St. Anthony. City of Columbia Heights Planning and Zoning Commission August 7, 2019 Planning Report Page 2 COMPREHENSIVE PLAN The Comprehensive Plan guides this property for low density residential. SITE PLAN The owner has submitted a legal certificate of survey dated June 13, 2019 indicating the proposed location of the home and attached garage along with concept plans including elevations. The survey shows that the attached garage will be located on the east side of the house. FINDINGS OF FACT Section 9.104 (G) of the Zoning Ordinance outlines five conditions that must be met in order for the City Council to grant a Variance. They are as follows: (a) Because of the particular physical surroundings, or the shape, configuration, topography, or other conditions of the specific parcel of land involved, strict adherence to the provisions of this article would cause practical difficulties in conforming to the zoning ordinance. The applicant, however, is proposing to use the property in a reasonable manner not permitted by the zoning ordinance. This does not appear to be entirely true. While the applicant is proposing to use the property in a generally reasonable manner, not permitted by the Zoning Ordinance, the conditions of the specific parcel do not cause the need for the variance. The applicant could modify the garage to comply with the height requirements. The applicant argues that the placement of the garage on the lot is part of the justification for the request; however the placement of the garage does not correlate to the request for the garage to be taller. Additionally, the City’s Engineer and Building Official have concluded that the geotechnical and water run off challenges the applicant argues in the narrative would not impede the garage achieving the height requirement. (b) The conditions upon which the variance is based are unique to the specific parcel of land involved and are generally not applicable to other properties within the same zoning classification. The parcel’s location is unique due the secluded area, adjacent to the lake access in Columbia Heights and parkland in St. Anthony. The subject property is larger than typical lots in Columbia Heights. The parcel area is 13, 817 sq. ft., whereas typical lots in Columbia Heights are approximately between 5,000 sq. ft. – 9,000 sq. ft. However, the size of the subject property is not unique to the neighborhood area or zoning classification (R-1 Single Family Residential). There are lots in the neighborhood and same zoning classification with a similar or larger area (lot size). The grade on the lot increases on the west side, which requires a retaining wall to be built, as shown on the survey. However, the variance request appears to be based on the applicant’s desire to have a taller, larger, garage and financial impacts associated with potentially building a taller retaining wall, both of which are not unique to this specific parcel of land, and could City of Columbia Heights Planning and Zoning Commission August 7, 2019 Planning Report Page 3 generally be applicable to other properties within the same zoning classification or elsewhere in the City. (c) The practical difficulties are caused by the provisions of this article and have not been created by any person currently having a legal interest in the property. Practical difficulties do not appear to be evident in this case, based on the applicant’s justification for the variance requests. (d) The granting of the variance is in harmony with the general purpose and intent of the Comprehensive Plan. The Comprehensive Plan supports low density residential development in this area. The construction of a new attractive single family home on the lot is in harmony with the Comprehensive plan. (e) The granting of the variance will not be materially detrimental to the public welfare or materially injurious to the enjoyment, use, development or value of property or improvements in the vicinity. If the City Council decides to grant the variance, it does not appear that the taller garage would be substantially harmful to the public welfare, or the use and value of property in the vicinity. The home would likely not appear to be significantly out of scale with the surrounding homes or alter the character of the area. RECOMMENDATION Staff recommends that the Planning Commission recommend denial of the variance requests. It does not appear that the request meets the findings outlined in the City’s Ordinance. Additionally, it does not appear that the request meets the legal standard set forth in law that cities must apply when considering a variance request. Cities must apply a three factor test in considering variance requests, and all three factors must be satisfied. The three factors are: 1) Reasonableness 2) Uniqueness 3) Essential Character. Based on the information provided by the applicant, staff does not find that all three factors have been satisfied to constitute a practical difficulty. Ground elevation on the soil boring is 952.2ft. The ground water was found 10’ below that at 942.2. However at 944.2 CL-ML soil classifications are found. These soil types have a bearing capacity of 1500psf and are still suitable for building per the building code. 2. The basement of the home has a wall height of 8’4” which is 3’ above grade and 3ft above the garage floor. 3. The survey shows elevations of 954 on the north side and 955 on the south side of the home. This is an elevation increase of 1.8’-2.8’ over the soil boring. 4. It is my belief that the basement of the home could be lowered 3’ and still remain in the desired soils above the CL-ML soils, and still above the ground water. 5. Lowering the basement of the home 3’ would bring the first floor down to the same elevation as the garage and would bring the 2nd floor elevation down which would allow for 9’ walls in the garage. According to the applicant’s narrative, additional space is needed to meet the current and future needs of the school’s programming. The proposed addition is 3,348 sq. ft. (54’ X 62’) and will match the existing structure in terms of design and color. The proposed addition satisfies the City’s setbacks and height requirements. ZONING ORDINANCE The subject property is located in the R-1 Single Family Residential District. The properties to the north and east are located in the R-1 District, and the properties to the south and west are located in the R-2A One and Two Family Residential and R-3, Multiple Family Residential Districts. COMPREHENSIVE PLAN The Comprehensive Plan guides this property for Institutional development. FINDINGS OF FACT Section 9.104 (N) of the Zoning Ordinance outlines four findings of fact that must be met in order for the City to approve a Site Plan. They are as follows: a. The Site Plan conforms to all applicable requirements of this article. The applicable Zoning Code requirements are achieved. The Comprehensive Plan guides this area for Institutional Use. Staff believes the proposed Site Plan for the property is consistent with the intent of the Comprehensive Plan. c. The Site Plan is consistent with any applicable area plan. There is no area plan for this parcel. d. The Site Plan minimizes any adverse impacts on property in the immediate vicinity and the public right-of-way. This is correct. The proposed addition will not impact the surrounding property in the immediate vicinity or the public right of way. RECOMMENDATION Staff recommends that the Planning Commission approve the Site Plan for the proposed addition to the Columbia Heights High School subject to certain conditions of approval. Motion: Move to waive the reading of Resolution No. 2019-PZ02, there being ample copies available to the public. All the conditions set forth by Greg Metz of the Department of Labor and Industry (DLI) shall be addressed and met prior to issuance of a permit. 2. The plans submitted for the building permit must show all the required revisions requested as part of the DLI agreement. 3. The existing separation walls in areas other than the addition separation wall shall be upgraded to provide 2-hour fire resistance and openings are to be protected accordingly. 4. The Architect shall prepare a proposed future project diagram indicating locations where fire area separations will be improved/constructed within the existing building to subdivide it into separate fire areas and submit this plan the to the Columbia Heights Inspections Department. 5. The Architect shall provide a cost estimate for the proposed future work to the School district, DLI, and the Columbia Heights Inspections Department. 6. The school district shall provide a letter of agreement to the Minnesota Department of Labor and Industry (CCLD), and the Minnesota Department of Public Safety, State Fire Marshal’s Division committing to enter into contract to execute a project to divide the building in to code compliant fire areas within the first half of the next legislative biennium (not later than July 1, 2022). A copy of this letter shall also be provided to the Columbia Heights Building Inspections Department prior to permit issuance. 7. A preconstruction meeting shall be scheduled with the Columbia Heights Building Department after the plan review process has finished. Ryan Smith Building Official 20190730 CHHS Band Room July 30, 2019 Project Title: Columbia Heights Senior High School Proposed Band Room Addition Address: 1400 49th Ave NE, Columbia Heights, MN 554421 Review of the plans submitted at the July 18th meeting does not contain any information specifically addressing the fire and life safety aspect of this project. The Applicant’s project, taking place while school is in session, highlights concerns for an increased risk to the life safety of the occupants for the duration of the project. Therefore, my recommendation for approval is contingent upon the Applicant meeting the following requirements: 1. The Applicant’s project shall meet the current requirements of the Minnesota State Fire Code (MSFC) Chapter 33 Fire Safety during Construction and Demolition. 2. Applicant shall submit to the fire department for approval prior to the start of the project a Fire Safety and Evacuation Plan for the duration of the project. The plan shall be compliant with Section 404 of MSFC and the applicant shall train staff on the plan prior commencing the project. Included in the plan shall be a fire safety site plan specific to the duration of the project and a schedule of fire and evacuation drills. 3. Applicant shall submit to the fire department for approval prior to the start of the project a temporary exiting plan that meets all current requirements for means of egress. 4. The exiting plan shall be strictly adhered to by the project owner. 5. Applicant shall submit a plan for notifying the fire department prior to any impairment to any fire protection system(s). The following is a list outlining the needs;  The existing practice spaces are undersized preventing small groups from using them to practice and do not provide needed sound proofing and acoustics  The existing instrument repair space is not large enough to support a work space for repairing and cleaning instruments  The existing instrument storage space can only support approximately 130 instruments and we currently have over 150 instruments and growing  The existing classroom space is undersized for the number of students and has low ceilings and poor acoustics The school district has worked with outside vendors to evaluate the existing space and other possible spaces within the building that could be made to meet these above outlined needs. In consult with others it was determined that the only option to meet the needs of the current and expanding instrumental music program was to add an additional classroom space onto the high school. We have developed a plan working with MLA architects and Kraus-Anderson and received voter approval to have the funding to build the additional classroom space. The new instrumental music classroom will provide larger practice spaces with appropriate sound proofing and acoustics. It will provide a large enough separate space for both instrument repair and cleaning. It will provide new instrument storage for a capacity of approximately 200 instruments. Finally, it will be a larger classroom space with higher ceilings to allow for the growth in student participation in instrumental music programs and to provide the needed acoustics within the space. Catch basins necessary for site drainage during construction shall be provided with inlet protection.9.In areas where concentrated flows occur (such as swales and areas in front of storm catch basins and intakes) the erosioncontrol facilities shall be backed by stabilization structure to protect those facilities from the concentrated flows.10.Inspect the construction site once every seven days during active construction and within 24 hours after a rainfall event greaterthan 0.5 inches in 24 hours. All inspections shall be recorded in the SWPPP.11.All silt fences must be repaired, replaced, or supplemented when they become nonfunctional or the sediment reaches 1/3 of theheight of the fence. These repairs must be made within 24 hours of discovery, or as soon as field conditions allow access.12.If sediment escapes the construction site, off-site accumulations of sediment must be removed in a manner and at a frequencysufficient to minimize off-site impacts.13.All soils tracked onto pavement shall be removed daily.14.Temporary soil stockpiles must have silt fence or other effective sediment controls, and cannot be placed in surface waters,including stormwater conveyances such as curb and gutter systems, or conduits and ditches unless there is a bypass in placefor the stormwater.15.Collected sediment, asphalt and concrete millings, floating debris, paper, plastic, fabric, construction and demolition debris andother wastes must be disposed of properly and must comply with MPCA disposal requirements.16.Oil, gasoline, paint and any hazardous substances must be properly stored, including secondary containment, to prevent spills,leaks or other discharge. Restricted access to storage areas must be provided to prevent vandalism. Storage and disposal ofhazardous waste must be in compliance with MPCA regulations.17.External washing of trucks and other construction vehicles must be limited to a defined area of the site. Runoff must becontained and waste properly disposed of. No engine degreasing is allowed onsite.18.All liquid and solid wastes generated by concrete washout operations must be contained in a leak-proof containment facility orimpermeable liner. A compacted clay liner that does not allow washout liquids to enter ground water is considered animpermeable liner. The liquid and solid wastes must not contact the ground, and there must not be runoff from the concretewashout operations or areas.
