Cities of Columbia Heights and Hilltop are included in this project.
•Hazardous sidewalk repair throughout the City; work would include the removal and

Staff has the following suggestions and requests with regard to the Public Hearing.
1)Staff suggests tpat the Public Hearing for the Sealcoat beheld first as there will probably be fewer residents inattendance regarding this project. The Mayor may want to pollthe audience to determine if this is true.
2)Staff has just received preliminary approval from Mn/DOT onthe State Aid designation of Mill Street. Hazardous sidewalkconditions will be corrected as part of a proposedreconstruction of Mill Street and therefore; if a resolutionis approved for the Hazardous Sidewalk project it should beamended to remove those properties on Mill Street from theproject.
3)In performing a final check on quantities of sidewalks to bereplaced, staff has discovered some errors on 41st Avenuebetween Central Avenue and LaBelle Park. This will result insome significant increases for three properties; 4101 Central(First Minnesota Bank), 999-41st Avenue (LaBelle IICondominiums and 4001 Central (Columbia Heights Mall) . Inorder for these properties to receive proper notification;staff requests that the Council continue the hearing to theMay 10,1993 Council meeting for just those properties.
4)Due to the need to continue the Hazardous Sidewalk hearing,staff requests that Council consider and approve at the April19, 1993 hearing the attached motion to authorize staff tosolicit bids for the 1993 Miscellaneous Concrete project ofwhich the Hazardous Sidewalk program is a portion. This willallow the project to keep on schedule. Should the Councilultimately not approve all or a portion of the HazardousSidewalk Replacement project, an addendum can be issuedreducing the quantities or all bids can be rejected.

5)Attached is a copy of the Resolution of No. 85-15 relating topermits and bonding if a resident wishes to replace their ownsidewalk. The Resolution states that a permit needs to be taken out and a $10.00 permit fee collected. The bonding requirements are to be waived. Unless the Council wishes to change this procedure, the direction of this Resolution will be followed.
6)Engineering staff has been working with property owners whohave called with concerns about the hazardous sidewalkprogram. As of this date, all but one of the concerns appearsto be resolved.

BEING A RESOLUTION REGARDING STREET EXCAVATIONS
BE IT RESOLVED BY THE CITY OF COLUMBIA HEIGHTS:
Pursuant to §6.301, City Code of 1977, that prior to issuance by the Clerk to a
resident homeowner of a permit allowing such resident homeowner to do sidewalk repair on his homestead property within the City of Columbia Heights, a permit fee of ten dollars ($10.00) shall be required and the bond requirement under
§6.301(5) shall be waived.

1993 Sealcoat -Northwest Quadrant -Project# 9301 • P.LR. # 886
City streets are sealcoated every six years in order to provide a new wearing surface and to
seal the surface.
City crews will repair major cracks and potholes before sealcoating.
Sealcoating will be done between July 15 and August 15.
Signs will be posted the day before a particular street is sealcoated as a reminder not to park
on the street the next day.
Street will be closed temporarily Oess than 1 hour) during sealcoating.
Excess rock will be swept up within two weeks.
Hazardous Sidewalk Repair -Project# 9201-P.I.R. # 881
The City has approximately 31.5 miles (665,000 square feet) of sidewalk. Every 7-8 years all
sidewalk is inspected to look for hazardous conditions. In the latest inspection, approximately
61,000 square feet (9%) were found to be hazardous for the following reasons:
-Sections of the sidewalk are missing
-3/4" or more displacement of joints or cracks
-Cracks wider than 1"
-Excessive tertiary (small) cracks
-Excessive spalling (chipping) of the sidewalk surface
-Water ponding
Hazardous sidewalks need to be replaced in order to provide a safe place for pedestrians to
walk. If someone trips or slips while walking on the sidewalk, both the property owner and
the City could be liable for injuries and damages.
If a property owner does not wish to have the sidewalk in front of their property replaced
under this project and wants to do the work themselves or have contractor do the work, the
property owner or his/her contractor will need to obtain a $10 permit from the City.
Sidewalks removed under this project will be replaced the same day or the next day depending
on weather. If tree roots are the cause of the problem, they will be cut before the sidewalk is
replaced. After the new concrete has cured for seven days, the sidewalk will be backfilled and
seeded. Property owners are asked to keep the seed watered until it becomes established.
If the section of sidewalk to be replaced is part of the driveway, the resident will be informed
before the work is done and asked to park on the street for the seven day curing period.
Sidewalk replacement will begin in early June.

CITY OF COLUMBIA HEIGHTS GENERAL ASSESSMENT POLICY SYNOPSIS
SEALCOATING CHARGES ARE ARRIVED AT THIS WAY--
Front Footage Formula
Street feet= full cost per foot plus Avenue feet= 1/3 cost per foot
All property within an assessment sealcoat project boundaries are subject to both a street and
avenue charge based on front footage. The street in front of the property is at the full rate
(street feet) and at a one third rate for their nearest side street (avenue feet). Or, in the case
of a comer property the short side will be considered the frontage at full rate and the long side
plus the frontage minus 40 feet will be at the one third rate. Diagram will be presented on the
overhead screen.
Adiustment for Irregular Conditions
Adjusted front footage is used for cxld or irregular shaped lots. The City's policy is to give
the property owner the benefit of footage that would result in the least assessment cost to
them. The adjusted footage may be arrived at by taking the square footage of the parcel and
dividing it by 130 feet, or by averaging front and rear.
A parcel with a street on both its back and front is assessed for the street in back at the avenue
rate (1/3 rate).
State/County Aid Roads
Streets that are state or county aid are not charged to the property owner as long as aid funds
are available.
Adm in istration Charges
Administration costs are arrived at, for all projects, using the same formula prepared by the
Auditors. The formula for the first year is the number of parcels in a project X .75 hours per
parcel X wage cost per hour equals the administration cost. Additional years of levy is
calculated by multiplying the number of parcels in the project by .50 hours per parcel X wage
cost per hour X the additional number of years added to the first year amount equals the total
administration cost
Terms/Conditions of Payment:
Sealcoat of streets is a one year levy. The levy hearing usually takes place the later part of
November. Payment of the assessment may be paid in part or in full without interest for 30
days following the levy hearing. Any unpaid amount at the end of the 30 days will have
interest added (currently 9.5%) with payment due by September 15th the next year. After
September 15th any unpaid amount becomes delinquent and a 10% penalty is added. This
unpaid amount plus penalty is certified to the real estate taxes payable the following year.
HAZARDOUS SIDEWALK REPAIR CHARGES ARE ARRIVED AT THIS WAY--
Square Footage Formula
Sidewalk is measured by the Engineering Department. The Square footage is then calculated
from these measurements. Each property owner is assessed for the sidewalk adjacent to their
property based on the square feet of the repair or replacement to be done. Before the levy the
work that is actually done will be remeasured and the actual square footage assessed.
Terms/Conditions of Payment:
Hazardous sidewalk is a proposed two year levy. The payment procedure is the same as stated
above with the exception that 1/2 of the original assessment is due the second year after levy.

Pursuant to City Charter, notice is hereby given that the City Council has determined the
following Public Improvement Hearings be held on Monday, April 19, 1993, at 8:00 P.M in the
City Council Chambers/Court Room, 590 40th Avenue N .E. to consider:

Sealcoating of all bituminous City streets in the Northwest Quadrant of the City (Area I) or that
part bounded by but not including University Avenue Service Road on the west, 44th Avenue

streets between the Cities of Columbia Heights and Hilltop are included in the project.
Work would include selective concrete curb and gutter replacement, bituminous surface patching
and sealcoat application.
Estimated total project cost $202,803.11
Proposed assessment period of 1 year.
P.I.R. 881 -Municipal Project 9201 -Hazardous Sidewalk Repairs Throughout the City
Only those property owners who are notified by mail are being considered for an assessment.
Work would include the removal and replacement of damaged, heaved, settled and deteriorated
sections of concrete sidewalk, as well as mudjacking certain settled sections, and miscellaneous
associated construction items.
Estimated total project cost $293,511.87
Proposed assessment period of 2 years.
Notice is hereby given that all persons having an interest therein will be given an opportunity to
be heard, and such information pertaining to the said construction or installation may also be
considered at that time. The hearing may be continued to additional dates.
Auxiliary aids for handicapped persons are available upon request when the request is made at least 96 hours in advance. Please call the City Council Secretary at 782-2800,
extension 209, or TDD 782-2806 (for deaf only) to make arrangements.

BE IT HEREBY RESOLVED by the City Council of the City of Columbia Heights on the 8th day of February, 1993 ordered notice of a hearing to be given to property owners, and
WHEREAS, pursuant to a notice of hearing certain residents appeared at a Council Meeting on the 19th day of April, 1993, and
WHEREAS, the Council determines to proceed with this local improvement, a portion of the cost being defrayed by special assessments under Charter provisions.
NOV, THEREFORE, IT IS HEREBY RESOLVED:
1.That the location and extent of such improvements is as follows:
Sealcoating Streets of all bituminous City streets in the NorthwestQuadrant of the City (Area I} or that part bounded by but not includingUniversity Avenue Service Road on the west, 44th Avenue N.E. on the south,Central Avenue on the east and 53rd Avenue N.E. on the north. The City has a program each year to replace miscellaneous concrete structures such as curb and gutter, sidewalk and street. The concrete replacement is either budgeted for, such as sidewalk at Wargo Court; is required as part of a project, such as curb and gutter replacement in M.S.A.S. overlay areas; or as repairs of damaged concrete caused by watermain breaks. The project this year will include the Hazardous Sidewalk replacement.
