RESOLUTION NO. 92-54 DESIGNATING DEPOSITORIES FOR FUNDS OF THE CITY OF COLUMBIA HEIGHTS BE IT RESOLVED, that the Marquette Banks Minneapolis and the Northeast State Bank be hereby designated as the depositories for monies of the City of Columbia Heights, and the Treasurer of this City is hereby directed to deposit monies of this City in said banks, and the Marquette Bank and Northeast State Bank are hereby authorized and directed to honor and pay any checks or orders, when signed by the Mayor, City Manager and Treasurer for the withdrawal or transfer of funds on deposit in said banks in whatever form. There were no additional ordinances or resolutions to thosealready addressed on the Consent Agenda. COMMUNICATIONS A.Appointments to Boards and Commissions 1.Human Services CommissionMotion by Clerkin, second by Peterson to appoint DanGarcia to the Human Services Commission with such term toexpire in April of 1993. Roll call: All ayes 2.H.R.A. BoardThis item was removed from the agenda at this time. Councilmember Nawrocki suggested that other vacancies on various boards and commissions should be considered soon at a Council work session. The City Manager agreed and also recommended that appointments and re-appointments be included on the agenda as well. B.Alexandra House Councilmember Nawrocki had attended a meeting at the Alexandra House where future building construction was discussed. He noted that the City presently provides some operating funds for this organization and that some Columbia Heights' residents benefit from its services. Representatives of the Alexandra House will be making a presentation for funding from the City's Community Development Block Grant funds for its building fund. This presentation will be made to the Human Services Commission. Councilmember Nawrocki requested that the Commission review this organization's application very carefully and he feels they are a very worthwhile organization. 8.OLD BUSINESS 9. There was no old business. NEW BUSINESS A.Classified Contract with Star Tribune Motion by Nawrocki , second by Ruet timann to authorize the Mayor and City Manager to renew the classified contract with REGULAR COUNCIL MEETING DECEMBER 28, 1992 PAGE 5 the Star Tribune, effective January 1, 1993 through December 31, 1993. Roll call: All ayes B.Attendance of the Assistant Finance Director at theAnnual GFOA Conference Motion by Ruettimann, second by Peterson to authorize the attendance of June Johnston, Assistant Finance Director, at the Annual Government Finance Officer's Association Conference from May 2 -5, 1993 and that related expenses be reimbursed. Councilmember Nawrocki expressed a concern with having this person out of town when the audit is being done. He noted that a new auditing firm is doing the audit and may need additional staff assistance from this employee. He also requested reassurance that the completion of the audit will not be interrupted because of her absence for this conference and other anticipated time out of the office. The Finance Direct or assured the Counc i 1 that her absences will not interfere with the timely completion of the audit. Roll call: All ayes C.Change Order for Park Building Accessibility Improvements The Public Works Director advised that the correct amount of funds still left in the CDBG fund for this project is $3,858.00. Motion by Clerkin, second by Ruettimann to authorize Change Order #1 to furnish and instail two new lavatories on Project #9211 and to lower two drinking fountains on Project #9220, to KM Building Company, Inc. of Minneapolis, Minnesota, for a total of $925.10 and to authorize the Mayor and City Manager to enter into an agreement for the same. Roll call: All ayes D.Final Payment for Municipal Project #9200 (1992 Miscellaneous Concrete) • Motion by Peterson, second by Clerkin to accept the work for Municipal Project #9200 (1992 Miscellaneous Concrete) and to authorize final payment of $5,438.83 to Advanced Concrete, Inc. Roll call: All ayes E.Purchase of Athletic Equipment Motion by Ruettimann, second by Peterson to authorize staff to obtain quotes for youth athletic equipment for the recreation program. Roll call: All ayes REGULAR COUNCIL MEETING DECEMBER 28, 1992 PAGE 6 10.REPORTS A.Report of the City Manager The City Manager's report was submitted in written form and the following items were discussed: 1.Jackson Pond Repair Project: The City Manager advisedthis project is completed except for seeding of the grasswhich will be done in the spring. A full report will bemade to the City Council. 2.HP.A: A memo was received from the City Manager whichaddressed the future of having the bookkeeping functionsof the HRA maintained by the City's Finance Department.A memo was also received regarding a potential buyer ofthe Columbia Heights Business Center. These two itemswill be discussed at the joint meeting of :he CityCouncil and the HRA Board of Commissioners on December29th. Councilmember Nawrocki stated he felt it difficult to believe that the bookkeeping functions of the HRA could not be combined with those of the City for calendar year 1993. He had understood after much discussion this was a possibility and it has been done successfullly in other cities. Discussion followed regarding Councilmembers serving on both the Council and and Economic Development Authority. The Finance Director advised there are probably no legal prohibitions for service on both bodies but felt it was an accounting requirement. He noted this could affect the City's bond rating and initiate questions from the State Auditor's office. The Mayor inquired if there is additional information on this matter. The City Manager responded that staff will copy the Council on the source. 3.Council Work Sessions: Monday, Jan·uary 4th at 6:00 p.m.and Tuesday, January 19th at 7:00 p.m. were the dates andtime selected for Council work sessions. 4.Purchase of Biodegradable Compost Bins: Two "winterspecials" of compost packages will be made in the amountof $189.90. Councilmember Nawrocki inquired if Councilauthorization is required for this purchase. The CityManager advised this is not necessary. REGULAR COUNCIL MEETING DECEMBER 28, 1992 PAGE 7 5. 6. Incorrect Statement: At the December 14th Council Meeting, Steve Dziedzic stated that one of his neighbors is a City employee and it appears that the Housing Maintenance Code is not being enforced at that person's residence. The City Manager advised that no City employee lives at the residence identified by Mr. Dziedzic. It also is not rental property and the entire building houses one family. Criteria for Hazardous Sidewalk: The criteria for designating sidewalk as hazardous was discussed. A public hearing wi 11 be held to address assessable hazardous sidewalk repair projects. Councilmember Peterson suggested that a video be made of the problem areas in the City as this faci 1 i tates any discussion at the public hearing. The City Council has retained a consultant to assist them in the selection of a new City Manager. The City Council has requested that the public be allowed the opportunity to address the City Council on the selection of the new City Manager. A letter of invitation to make comment was sent to the Northeaster, the Focus, the Chair of each of the City's Boards and Commissions, and the president of several civic organizations. PLANNING AND ZONING COMMISSION REGULAR MEETING -MINUTES JANUARY 5, 1993 PAGE l The January 5, 1993 Planning and Zoning Commission meeting was called to order at 7:15 p.m. Members present were Deering, Larson, Peterson, and Szurek. Also present were Evelyn Nygaard, auilding/Zoning Administrator, Don Schneider, Director of H.R.A., John Kalligher, representing the City Attorney's office, Matthew Field and Gary Gorman, Fire Inspectors and Lowell DeMars, Assistant Fire Chief. Motion by Larson, seconded by Peterson, to approve the minutes of the meeting of November 3, 1992 as presented in writing. Roll Call: All Ayes. OLD BUSINESS: At the meeting of November 3, 1992 the Commission directed Staff to research information pertaining to the installation of the screening fence along the north side of Central Value Mall. A problem has arisen due to a taking of a portion of right-of-way for widening of 44th Avenue. A visibility problem has developed hampering traffic exiting the Mall on the north end due to the closeness of the screening fence to 44th Avenue. It was the recommendation of the Planning and Zoning Commission that the City Engineer determine how far the fence would need to be lowered to resolve the current visibility problem and/or if any portion of the fence should totally be removec. STAFF REPORTS: Evelyn Nygaard presented proposed changes to Ordinance #1176, the Housing Maintenance Ordinance, submitted by herself and the members of the Fire Department for discussion. Each proposed change was reviewed and discussed at length. A final draft of the recommended changes will be compiled by the City Attorney"s office for ·review by the Planning and Zoning Commission prior to submittal to the City Council. It was also suggested by the Fire Department that a similar Ordinance/Code be developed covering commercial and industrial properties. Staff was directed to obtain similar Ordinances from other cities. This organization represents communities in the metropolitan area and serves as our spokesperson and lobbying body regarding State legislation and policies affecting local jurisdictions. Also, the AMM staff has been very active in formulating policies and positions favorable to local jurisdictions as regards the Metropolitan Council. In the past, members of the City Council and the City Manager have been active members of various committees of the AMM. The committees formulate policies to be followed by lobbyists when representing positions of the AMM. The City Manager recommends continued membership in the AMM since this organization is a very effective force in lobbying in behalf of its member cities. The cost for membership is $4,860 and is consistent with funds included in the 1993 budget. The AMM is in its 19th. year of service to metropolitan area cities and its record of success and accomplishments on behalf of cities at the legislature and before the various metropolitan agencies is one of which we can all be proud. We must not and will not rest on our laurels, however, as we begin a new year. We will once again be facing a state budget deficit and many at the state level will be looking to reduce city revenues to make up the state shortfall. The AMM was a leading force in the last session in preserving the Local Government Trust Fund which provides the funding for LGA and HACA. Metropolitan Waste Control Commission is required to own a trunk line to each city. Because MWCC does not own a trunk to the City of Hilltop, they paid the City of Columbia Heights a rental fee each year from 1983 through 1989. Since December 31, 1989, Columbia Heights has not been compensated for allowing Hilltop to deposit sewage into Columbia Heights' sewers. On July 25, 1992, representatives of the two cities met in an attempt to negotiate a contract. At that meeting, we agreed to meet again on August 14, 1992. Hilltop cancelled that meeting and rescheduled a meeting for August 28, 1992. Hilltop again cancelled that meeting. On September 25, 1992, I sent Hilltop a proposal and a letter requesting that they call me to schedule a new meeting date. I received no response from Hilltop representatives. On December 3, 1992, I sent a letter to the Hilltop Mayor requesting that their city representa­ tives meet with us and I further advised the Mayor that I would take legal steps to halt their use of our sewers unless they met with us on a regular basis to negotiate a contract for the use of our sewers. I have received no response. I recommend to the City Council that I be authorized to take legal steps to halt the use of our sewers by the City of Hilltop. I believe the correct step at this time is to apply to the Court for an injunction to halt the flow of sewage until such time as a contract for the use of our lines can be agreed to. RECOMMENDED MOTION: Move tQ direct the City Manager and City Attorney to apply for an injunction to halt the discharge of sewage by the City of Hilltop into sewer lines owned by the City of Columbia Heights. They were very delinquent in getting both drivers and vehicles licensed. Some vehicles then failed the Police Inspection. We have been working with Yellow Cab every day to bring the service up to the required standards. By Wednesday evening, the complaints were becoming fewer, but errors and omissions were still occurring on Thursday. We will continue to work with Yellow Cab to get satisfactory service to the citizens. 5)JULY 4TH ACTIVITIES-- July 4th fireworks and/or other activities has always been a subject of discussion. This year, we are starting the planning process early. Your desires and/or direction is solicited as soon as possible. Unless directed otherwise, we plan on not sealcoating University Avenue. 7)CONDUCT ON LICENSED PREMISES-- Recently, the Council adopted an ordinance which made property owners responsible for the conduct of their tenants and that failure to correct problems could result in the property owner losing their license. Because this new ordinance could have a major impact on licensed holders, we are sending a copy of the ordinance to each licensed holder. 8)1993 UNION CONTRACT STATUS-- Public Works, 49'ers: One mediation session has been held and an offer was made to the union. This off er was voted down by the membership. Another mediation is scheduled for January 13. The primary issues to be resolved are the union's request for increased compensation for weekend duty and a shorter timeframe to move from Maintenance I to Maintenance II. Firefighters: Multiple meetings with the union have failed to reach agreement. They are-requesting a 5% wage increase in 1993 and in 1994 and are requesting several language changes which would cost money. The union verbally said they were going to request mediation, but we have received no official notice. 9)REQUEST TO VACATE ALLEY-- At the work session on January 4, the Council reviewed the request to vacate the alley behind 3932 Quincy Street NE. I could not say who owned the land; and, thus, a position by the Council was premature. I have reviewed the original plat from 1893 with the Attorney and find that the alley is dedicated public land. Thus, vacating the alley would not give any land to the homeowner. Further, a survey reveals that they presently have a fence which is unlawfully placed over the fourteen foot alley plus approximately two feet onto our park land. These issues will be corrected at the January 25, 1993, Council meeting. 13)CIVIL LAWSUIT-- As you perhaps saw in the Friday, January 8, 1993, Star Tribune, the Minnesota Police Recruitment System, of which Columbia Heights is a member, is the defendant in a lawsuit filed last week. The exact process for the joint defense is unclear at this time. The organization which was created by a Joint Powers Agreement is the owner of the research project upon which the tests were based on. I will keep you advised. 14)ISO FIRE RATING-- Our last survey by the insurance industry to determine the rating of our Fire Department was in 1988. Chief Kewatt and I believe that we have made improvements that could help us to achieve a lower rating. See the attached letter requesting a new study this summer. This is our largest trip to date. 4.A Defensive Driving Class was held on December 10 and 11 with 34 seniorsattending. 5.The Senior Coordinator has attended 2 meetings regarding the inserviceprograms to be offered to city staff in 1993. She will continue to be apart of the planning process. 6 The Senior Coordinator attended the inservice on Sexual Harassment onDecember 14. 7.52 seniors attended a caroling and pizza party in the Senior Center onDecember 18. These sessions will continue throughFebruary and March. 3.The Volunteer Coordinator was contacted by Anoka County and met withrepresentatives of the County concerning programs aimed at seniorcitizens, youth employment and youth volunteer programs. YOUNG \I.� ASSISTANT CITY ENGINEER UNIVERSITY AVENUE SERVICE ROAD DECEMBER 9, 1992 As you may recall, the University Avenue service road required a substantial amount of patching in the spring of 1992. The Street Department used 169 tons of bituminous material ($3,084.25) and 470 gallons of tack coat ($329.00) for a material cost of $3,413.25. The Street Department labor was $4,732.88. The total cost for repairing the service road was $8,146.13. This is 7% of the Street Department costs for patching for 3% of the street system. The patches are skin patches and may prove to be temporary, lasting only a year or two. There is also concern that the unpatched areas of the service road will develop the same type of failure. Our current recommendation is to observe the service road in 1993 and possibly 1994. A more informed decision can then be made if the service road should be reconstructed, overlaid or sealcoated. Based on the existing street construction and condition, we anticipate reconstructing the University Ave. , service road from 37th Ave. to 40th Ave. and overlaying the service road from 40th Ave. to 53rd Ave. We do not intend to sealcoat the service road north of 44th Ave. in 1993. There are two different assessment concerns: 1.The Columbia Heights Corporate limit north of 45th Ave. is thecenterline of the service road.
