ORDINANCE NO. 1236 BFTNG AN ORDINANCE .AMENDING ORDINANCE NO. 853, CITY CODE OF 1977, PERTAINING TO THE REGULATION OF SKATEBOARDS, ROLLERSKIS, ROLLERSKATES AND ROLLERBLADES ON PUBLIC AND PRIVATE GROUNDS The City of Columbia Heights does ordain: Section 1: Chapter 10, Article II, Section 7 of Ordinance No. 853, City Code of 1977, which is currently reserved, shall be amended to hereafter read as follows, to wit: 10.207(1) Intent and Purpose. It is the intent and purpose of this ordinance to protect the public health and safety by the regulation of the use of skateboards, ro1lerskis, rollerskates and rollerblades within the City and to prohibit use of the same within designated areas and to provide penalties for violations. 10.207(2) Definitions. The following definitions shall apply REGULA? COUNCIL MEETING S E P T EM 5 E F. 2 8 , 1 9 9 2 PAGE 2 in the interpretation and application of this section, and the following words and terms, wherever they occur in this section, are defined as follows: (a)Skateboard. A non-motorized platform mounted on wheels. (b)Rollerski. A non-motorized ski-like devise mounted onwheels. (c)Rollerskate/Rollerblade. A non-motorized device withwheels which is attached to a shoe or designed to beattached to a shoe. 10.207(3) Prohibited Conduct. No person shall ride or propel oneself upon skateboards, rollerskis, rollerskates or rollerblades within any of the following areas: (al Th� area west of Reservoir Boulevard, east of Van Buren Street N.E., and north of 39th Avenue N.E., south of 42nd Avenue N.E. (b)OrJ or abc,1Jt any public te:·!nis courts within the citylimits of Colu��ia Heights. (c)On o:r abo1.1t ar;y public or private parking lot, ramp, arecor facility without the express written permission of theO\,.nE:r-t:--iereof. (dl In any area within the city limits of Columbia Heightswhile being pushed, pulled, or in any way propelled byany motorized vehicle or by a person on a bicycle. (el In any area or in any manner which is contrary to thestatutory provisions applicable to the operation ofbicycles. 10.207(4) Exceptions. Notwithstanding anything herein to the contrary, the provisions of this Chapter shall not apply to the following: (a)The owner of any property using such premises forskateboards, rollerskis, rollerskates or rollerblades forthe owner's own use or for an organized event conductedwith the owner's permission. (bl Nothing in this Chapter shall be construed to prohibitthe use of a wheelchair or any other wheeled devicedesigned to assist a disabled person on any of the placesmentioned herei�. Any violation of this Chapter is a petty misdemeanor and is subject to all penalties provided for such violation under Minnesota Statutes. 10.207(6) Impoundment. The Columbia Heights Police Department may impound any skateboard, rollerskis, rollerskates or rollerblades used, ridden, operated, owned or possessed or otherwise existing upon any public or private property within the City of Columbia Heights in violation of this Section. Any skateboard, rollerskis, rollerskates and/or rollerblades impounded by the City and which remains unclaimed by the owner for a period of 60 days may be sold at public sale or auction following published notice. Stat.609.75 through 609.76, which prohibit gambling; (b)Minn.Stat. 609.321 through 609.324 which prohibit prostitution and acts relating thereto; (c)Minn. Stat. 152.01 through 152.025, and 152.027, subds. 1 and 2, which prohibit the unlawful sale or possessionof controlled substances; REGULAR COUNCIL MEETING SEPTEMBER 28, 1992 PAGE 4 (d)Minn. Stat. 340A.401, which prohibits the unlawful saleof alcoholic beverages; (e)Minn. Stat. 609.33, which prohibits owning, leasing,operating, managing, maintaining, or conducting adisorderly house, or inviting or attempting to inviteothers to visit or remain in a disorderly house; (f)Section 10.312 of this code, which prohibits noisyassemblies; (g)Minn. Stat. 97B.021, 97B.045, 609.66 through 609.67 and624.712 through 624.716, and section 10.307 of this code,which prohibit the unlawful possession, transportation,sale or use of a weapon; or (h)Minn. Stat. 609.72, which prohibits disorderly conduct. SA.410(2). The Police Chief (Department) shall be responsible for enforcement and administration of this section. SA.410(3). Upon determination by the Police Chief (Department) that a licensed premises was used in a disorderly manner, as described in Section (1), the Police Chief (Department) shall notify the licensee by mail of the violation and direct the licensee to take steps to prevent further violations. SA.410(4) If another instance of disorderly use of the licensed premises occurs within twelve (12) months of an incident for which a notice in subsection (3) was given, the Police Chief (Department) shall notify the licensee by mail of the violation and shall also require the licensee to submit a written report of the actions taken, and proposed to be taken, by the licensee to prevent further disorderly use of the premises. This written report shall be submitted to the Police Chief (Department) within five (5) days of receipt of the notice of disorderly use of the premises and shall detail all actions taken by the licensee in response to all notices of disorderly use of the premises within the preceding twelve (12) months. If the licensee fails to comply with the requirements of this subsection, the rental dwelling license for the premises may be denied, revoked, su·spended, or not renewed. An action to deny, revoke, suspend, or not renew a license under this section shall be initiated by the City Council at the request of the Police Chief (Department) in the manner described in Section SA.408(1), and shall proceed according to the procedures established in Sections 5.102 and 5.104. REGULAR COUNCIL MEETING SEPTEMBER 28, 1992 PAGE 5 5A.410(5) If another instance of disorderly use of the licensed premises occurs within twelve (12) months after any two (2) previous instances of disorderly use for which notices were sent to the licensee pursuant to this section, the rental dwelling license for the premises may be denied, revoked, suspended, or not renewed. An action to deny, revoke, suspend, or not renew a license under this section shall be initiated by the City Coun,ci 1 at the request of the Pol ice Chief (Department) in the manner prescribed in Section SA.408(1), and shall proceed according to the procedures established in Sections 5.102 and 5.104. SA.410(6) No adverse license action shall be imposed where the instance of disorder 1 y use of a 1 i censed premises occurred during the pendency of eviction proceedings (unlawful detainer) or within thirty (30) days of notice given by the licensee to a tenant to vacate the premises, where the disorderly use was related to conduct by that tenant or by other occupants or guests of the tenant's unit. Eviction proceedings sha 11 not be a bar to adverse 1 i cense action, however, unless they are diligently pursued by the licensee. Further, any action to deny, evoke, suspend, or not renew a license based upon violations of this section may be postponed or discontinued at any time if it appears that the licensee has taken appropriate measures which will prevent further instances of disorderly use. SA.410(7) A determination that the licensed premises has been used in a disorder 1 y manner as described in subsection ( 1) shal 1 be made upon substantial evidence to support such a determination. It shall not be necessary that criminal charges be brought to support a determination of disorderly use, nor shall the fact of dismissal or acquittal of criminal charges operate as a bar to adverse license action un�er this section. Section 2: This ordinance shall be in full force and effect from and after thirty (30) days after its passage. First Reading: September 28, 1992 The second reading of Ordinance No. 1249 is scheduled for October 12, 1992. REGULAR COUNCIL MEETING SEPTEMBER 2 8, 199 2 PAGE 6 ORDINANCE NO. 1252 BEING AN ORDINANCE REGULATING UNNECESSARY NOISE AND ODORS The City of Columbia Heights does ordain: Section 1: An amendment to Section 8.203 of the Public Health and Safety Ordinance adding the following: 8.203(8) UNNECESSARY NOISE AND ODORS GENERALLY: No person, in any public or private place, shall make or assist in making, by any manner or means, any loud, unpleasant, or raucous noise or odor disturbing to others, unless the same be reasonably necessary to the preservation of life, health, safety or property. This section (8.203(8)) is enforceable twenty-four (24) hours a day. 8.20 3 ( 9)OFFENSIVE USE OF SOUND AMPLIFYING EQUIPMENT: No person shall use or maintain any sound amplifying equipment when the use or maintenance of such equipment creates noise so loud and unnatural in their time, place, use, or maintenance as to annoy, injure, or endanger the safety, health, comfort, or repose of any persons. This section (8.203(9)) is enforceable twenty-four (24) hours a day. 8.203(10) NOISY ASSEMBLY: Subdivision 1 Definition: The term "noisy assembly" shall mean a gathering of more than one person in a residential area or building between the hours of 10 p.m. and 7 a.m. that produces noise that unreasonably disturbs the peace, quiet, or repose of a person or persons of ordinary sensibility. Subdivision 2 Prohibition: {a) No person shall participate in, visit, or remain, at a gathering knowing or having reason to know that the gathering is a noisy assembly, except persons who have come to the gathering for the sole purpose of abating the disturbance. (b) No person shall knowingly perrni t real estate under such person's care or control to be used for a noisy assembly. This Section (8.203(10) is enforceable during the hours stated. Section 2: EFFECTIVE DATE: This ordinance sha 11 be in f u 11force and effect from and after the date of its passage and publication. Polish American Heritaae Month Proclamation Mayor Murzyn read the proclamation which designated October as Polish American Heritage Month in the City. He presented the proclamation to members of the Columbia Heights Sister City Committee. He requested staff to contact Northern States Power regarding the electrical portion of the project being analysed by Honeywell for city buildings. Councilmember Ruettimann requested that Superintendent Huber in the Spring Lake Park School District also be contacted regarding their experience with a Honeywell project similar tc the one Columbia Heights is considering. Counci I member Nawrocki felt the opportunity for the most savings would be in the lighting portion of the project. He is still of the opinion that competitive bids should be sought for the entire proposal. Mayor Murzyn noted he had already been contacted by Northern States Power and that utility firm would handle only electrical projects. Motion by Nawrocki that Northern States Power be contacted and asked to make a proposal to the City for the kind of work they would do and the possible cost savings. Councilmember Nawrocki noted he was unaware that Northern States Power had already contacted the City. Motion dies for lack of a second. REGULAR COUNCIL MEETING SEPTEMBER 28, 1992 �AGE 9 The City Manager understood that the City would deal exclusively with Honeywell through the Letter of Intent until a contract is accepted or rejected. The City Attorney advised that asking Northern States Power about comparable services would not breach the agreement with Honeywel 1. The City Manager will contact the President of NEI and Dr. Huber of the Spring Lake Park School District. He will report his findings at the September 30th Council work session. Councilmember Nawrocki also requested staff to contact the State Department of Energy regarding this matter. c.Bids for City's Auditor Mayor Murzyn inquired if the bids for the City's auditor have been let yet. The Public Works Director advised that the work would involve signage, removal of present fixtures and removal of walls to accommodate wheelchairs. The bids received for the project were quite high. Some of the contractors who bid commented that the reasons for the high bids are the unknown conditions involved with renovation work and the extra paper work involved with federal aid projects. The Public Works Director suggested that only some of the park buildings could be bid rather than all of them. He noted that the City has until 1998 to bring these buildings into compliance. It was also noted that the Community Development Block Grant funds must be used sooner than that. Discussion followed regarding which parks should be included iri the bidding. The Public Works Director stated that all parks could be individually bid with the understanding that only four would be selected. Motion by Clerkin, second by Peterson to reject bids received for Park Building Accessibility Improvements Projects. The principal structure was used as a single family dwelling up to that time. However, this property is located in the Limited Business District. A single family residence is not a permitted principal use in this zone. Therefore, these struc�ures are non-conforming. Section 9.104(3)(f) of the Zoning Ordinance states "Whenever a non-conforming use of a building or structure or land is discontinued for a period of six (6) months, any future use of said building or structure or land shall be in conformity with the provisions of this Ordinance". The structures are dilapidated, substandard and structurally unsound. The Building Inspection Department and the Police Department have received numerous complaints about the property including trepassing, failure to remove snow from the sidewalks, debris and junk vehicles on the property, an attractive nuisance to children, broken and dead limbs obstructing the sidewalk and the neighbors driveway. Attached is a summary of the events pertaining to this property. RECOMMENDED MOTION: Move that there is adequate evidence to find the structures at 4207 Central Avenue are hazardous and in violation of the law and that the City Council orders the existing structures to be razed, demolished and all parts of the former structures including concrete slabs and foundations to be removed. Utilities are to be cut off and sealed per the Engineering Departments requirements. The site must then be restored to a safe condition with fill as necessary. Such correction shall be completed within thirty (30) days of the service of this order. A motion for the summary enforcement will be made to the Anoka County District Court unless corrective action is taken or unless an answer is filed within the time specified by Minnesota Statute 463.18. COUNCIL ACTION: DATE: TO: FROM: RE: October 6, 1992 Stuart Anderson, City Manager Evelyn Nygaard, Building/Zoning Administrator..P-- 4207 Central Avenue Non-Conforming/Hazardous Property This is a summary of events leading up to the scheduled condemnation hearing on October 12, 1992 for property located at 4207 Central Avenue N.E. The owners of record are Mr. and Mrs. Lloyd Nestrud. The property first came to my attention in 1991 when Don Schneider, Director of H.R.A., requested that the Building Inspection Department provide a list of dilapidated properties within the City that might be acquired/razed and/or rehabed through a Federal program to alleviate blight. Chris Land, Assistant Building Inspector, had been to the property in response to a complaint, so we knew the property was abandoned. Ve checked with the Water Department and found that the water was turned off sometime between May and November of 1988. The property consists of a lot 40 feet by 128 feet with the principal structure a one story frame dwelling of approximately 650 square feet plus an open front porch of 136 square feet and a closed rear porch of 90 square feet. A frame shed/garage of 216 square feet is at the rear of the property. The year built, taken from the Assessing Department records, is 1917. The funding to acquire several properties did not materialize. So we pursued razing/removal of properties on an individual basis concentrating on the most hazardous. To date, eight properties, both non-conforming and hazardous have been razed, one of which required condemnation. The Building Inspection Department received another complaint in April of 1992 and Chris Land visited the property. It was still vacant and he again contacted the owner to secure the building. Another complaint was received a few days later and I contacted the owner by phone. Ve discussed the alternatives and he agreed to remove the buildings and clear the property in order to avoid the costs he might incur if the property required condemnation. No action had taken place at the site by May 6, 1992, so I sent a letter to Mr. Lloyd Nestrud at his address of 8060 Jefferson Street in Spring Lake Park, Minnesota 55432. I requested that Mr. Nestrud submit a plan to the City in the next thirty (30) days for removal of the house and garage within the next sixty (60) days. Mr. Nestrud responded by telephone and said he would need a little more time. On July 3, 1992 the Water Department informed me that the water had been turned on as of July 1, 1992 at the request of the new owner, Robert Defour. I went out to the property and no one answered the door and we could see evidence of remodeling in process. No building or plumbing permits had been issued, so a •stop York" order was posted on the front door as well as a •Hazardous-Do Not Occupy• notice. Both postings carry our Building Department telephone number and a request to contact this office immediately. No one responded. The postings were removed the next day, so we posted the notices on the building a second time. This time a Robert DeFour called our office and spoke with Chris Land. He was abusive and threatening in voice and manner. A few days after the second posting, Mr. Dufour called Chris Land and he gave Chris his telephone number. I called him back and we had a conversation. I explained that the property could not be occupied as a residence and requested that he allow an inspection of the interior. He hung up on me. On July 14, 1992 I sent a letter to Mr. DuFour at the property explaining again what the circumstances were. A few days later he called back and made an appointment for inspection on July 24, 1992. I met with Firefighters Flermoen and Hinrich at the property on July 24, 1992 and Mr. Dufour allowed us to go through the interior of the property. The following code violations were noted: 1.Basic equipment and facilities. Violation of 5A.201(1). a. No hot water was available. The gas water heater in the basement had an improper flue and Mr. DuFour said he was going to replace it. When the firefighters went back on October 5, 1992, it appeared that the water heater was on. The flue had not been corrected. b.At the time of the inspection, no range for cooking orrefrigerator for food storage was on site and Mr. DuFour was cooking on a gas grill in the front porch. When the firefighters returned on October 5, 1992 a stove and refrigerator had been installed. c.A new toilet had been installed without the required plumbing permit. 2.Safe Building elements. Violations of 5A.205(l)(g). a.Stairway in front is of pre-cast concrete and is unstable withobvious deterioration. The steps rock when you step on them. The front porch floor is rotted and spongy. The paint is completely worn off the surface. It appears that both front and rear porches lack frost footings. 3.5A.204(1) Minimum Thermal Standards. Mr. DuFour stated that the old furnace was not functioning and would have to be replaced. 4.5A.205(1) Foundation, Exterior Valls and Roofs. a.The foundation is structurally unsound. The blocks are crackedand broken. The mortar joints are broken and the mortar has fallen out in some areas. The block walls are bowed or out of line in areas. The foundation was neither water/weather tight nor vermin proof. The many cracks were of sufficient size to admit vermin and water was evident in puddles on the floor. Mr. DuFour stated that the heavy chemical odor in the basement was a spray he had used to "fumigate" the area. b.The windows have broken glass, missing putty, broken rope andweight assemblies, door and window panels. Some windows had no storms and/or screens. c.The ceilings showed evidence of roof leaks. Mr. DuFour statedthat he had used "lots of caulking" to stop the leaks. d. The wood siding and trim is flaking and peeling. As a result, there is wood rot in several areas, especially in the trim around the windows and doors. 5.5A.205(l)(f). The garage/shed is dilapidated and no longer weatherproof or rodent and vermin proof. Daylight can be seen through the roofand walls. No door exists. Paint is flaking very badly. After inspecting the interior we were out on the front lawn talking and Mr. Dufour stated that he was going to live on the premises and remodel it into offices. Ve again told him that the entire building, starting with the foundation, would need to be brought up to code and he could not occupy the property under any circumstances. Mr. DuFour became very excited. He proceeded to become beligerant and made wild statements. He called back later and apologized saying he hadn't eaten his breakfast and had diabetes which caused his irratic behavior. I received a telephone call from a Jane Brooks who said she was Mr. DuFour's attorney. Her telephone number is 638-9447. I had several phone conversations with Jane Brooks regarding the situation. She told me she had spoken with Mr. DuFour and tried to convince him that his anger was misdirected and the City was only attempting to protect him and his interests. Notwithstanding anything herein to the contrary, the provisions of this Chapter shall not apply to the following: (a)The owner of any property using suchpremises for skateboards, rollerskis,rollerskates or rollerblades for theowner's own use or for an organizedevent conduc ted with the owner'spermission. (b)Nothing in this Chapter shall beconstrued to prohibit the use of awheelchair or any other wheeled devicedesigned to assist a disabled person onany of the places mentioned herein. 10.207(5) Penalties. SA.410(2). The Police Chief (Department) shall be responsible for enforcement and adm inistration of this section. SA.410(3) Upon determination by the Police Chief (Department) that a licensed premises was used in a disorderly manner, as described in section (1), the Police Chief (Department) shall notify the licensee by mail of the violation and direct the licensee to take steps to prevent further violations. SA.410(4) If another instance of disorderly use of the licensed premises occurs within twelve (12)months of an incident for which a notice insubsection (3) was given, the Police Chief(Department) shall notify the licensee by mail ofthe violation and shall also require the licenseeto submit a written report of the actions taken,and proposed to be taken, by the licensee toprevent further disorderly use of the premises.This written report shall be submitted to thePolice Chief (Department) within five (5) days ofreceipt of the notice of disorderly use of thepremises and shall detail all actions taken by thelicensee in response to all notices of disorderlyuse of the premises within the preceding twelve(12)months. If the licensee fails to comply withthe requirements of this subsection, the rentaldwelling license for the premises may be denied,revoked, suspended, or not renewed. An action todeny, revoke, suspend, or not renew a licenseunder this section shall be initiated by the CityCouncil at the request of the Police Chief(Department) in the manner described in sectionSA.408 (1), and shall proceed according to theprocedures established in sections s.102 and5.104. Eviction proceedings shall not be a bar to adverse license action, however, unless they are diligently pursued by the licensee. Further, an action to deny, revoke, suspend, or not renew a license based upon violations of this section may be postponed or discontinued at any time if it appears that the licensee has taken appropriate measures which will prevent further instances of disorderly use. SA.410(7) A determination that the licensed premises has been used in a disorderly manner as described in subsection (1) shall be made upon substantial evidence to support such a determination. It shall not be necessary that criminal charges be brought to support a determination of disorderly use, nor shall the fact of dismissal or acquittal of criminal charges operate as a bar to adverse license action under this section. NOISY ASSEMBLY: Subdivision 1 Definition: The term "noisy assembly" shall mean a gathering of more than one person in a residential area or building between the hours of 10 p.m. and 7 a.m. that produces noise that unreasonably disturbs the peace, quiet, or repose of a person or persons of ordinary sensibility. Subdivision 2 Prohibition: (a) No person shall participate in, visit, or remain at a gathering knowing or having reason to know that the gathering is a noisy assembly, except persons who have come to the gathering for the sole purpose of abating the disturbance. A.Public Hearing Special Purpose FenceCase #9210-18 Gerald H. Hinrichs 4353 Arthur Street N.E. Columbia Heights, Mn. Evelyn Nygaard presented the request of Mr. Hinrichs for approval of an existing six foot high cedar special purpose privacy fence located on the side property line between 4353 and 4359 Arthur Street. The fence presently extends from the front of the attached garage at 4353 Arthur east approximately 115 feet. The owner of 4359 Arthur Street has given his permission in writing to allow a privacy fence on the boundry line. Ms. Nygaard informed the Commission that Mr. Hinrichs has also erected a fllean­to" (shed roof) on the north side of the attached garage over the fence which encroaches into the side yard and, presently, extends one foot onto the lot at 4359 Arthur Street. She indicated that the fence, which runs along the side of the attached garage, is holding up a shed roof and acts as the side wall of the shed. Ms. Nygaard stated that on August 31, 1992 a letter was mailed to Mr. and Mrs. Hinrichs notifying them that the "lean-to" shed had to be removed in thirty (30) days. As of this date, the shed roof has not. been removed. Mr. and Mrs. Hinrichs were not in attendance at this meeting. Council Representative Peterson asked if Mr. Hinrichs was informed of the consequences if he refused to conform to Ordinance requirements. N.E., AT 43RD AVE. Residents on Jefferson St. submitted a petition to install stop signs to stop traffic on Jefferson St. due to the high speed of traffic on that street. Jefferson St. is a State Aid Street and designed to be a main thoroughfare through the City. Traffic on 43rd Avenue already stops at the intersection with Jefferson St. Staff indicated that the guidelines for turning a 2-way stop to a 4-way stop are met. At 43rd Ave. there were three reported accidents in 1990 and two thus far in 1992. Chief Mawhorter believes that these accidents may be correctable by a stop sign. Residents in attendance at the Public Hearing were those who initially made the request for the stop signs to be added. Two additional residents, Julie Erickson of 4329 Jefferson and Debbie Schnabel of 4327 Jefferson, were present and both agreed a stop sign at the corner of 43rd on Jefferson is necessary. There was discussion about where the school bus stops and being able to see the stop sign at the corner and problems caused in the winter by having a stop sign at the bottom of the hill. Miller Funeral Horne has requested a "Stop Sign" and "Watch for Pedestrian Sign" be installed for southbound traffic in the alley. The concern is that traffic does not stop before pulling out onto 40th Ave. Many businesses have stop signs for customers leaving the parking area. This would be a similar situation. MN/DOT Statue 169.31 states that "the driver of a vehicle within a business or residence district emerging from an alley, driveway, or building shall stop such vehicle immediately prior to driving onto a sidewalk or into the sidewalk area and shall yield the right-of-way to any pedestrian and all other traffic on the sidewalk". Commissioner Goodman indicated he didn't think an alley should have a stop sign. Commissioner Gorecki felt the Commission would be setting a precedent by adding a stop sign in this alley. Having been in contact with the Historical Center/State Archives, it was suggested that the City update its Retention Schedule to show that microfilming may be used as a medium for the retention of City records. See attached. The majority of the modifications reflect a change in storage media from paper to microfilm or computer. At the time the Retention Schedule was approved by the State, most staff did not have a personal computer, nor did the City own microfilming equipment. Because this change was necessary, I requested Division Heads review in detail their retention schedule and submit other recommended changes at this time also. If you have a specific question, I would appreciate you contacting Bonnie Jewett or the individual Division Head. These guides are to be used as minimum standards. Many departments are retaining information and materials well beyond the State regulations. I.#. r DATE: 10/6/92 I "-q In mid-September it was discovered that the furnace at Liquor Store #3 was not working. Minnegasco was called under their service contract to check the furnace. They ascertained that the blower was worn out and, during their inspection, the air conditioning condenser on the roof went out. Neither of these items are covered under the Minnegasco contract. The furnace is approximately 25 years old and parts are no longer available. Two quotes have been received to replace the furnace and the air conditioning condenser. Minnegasco's quote was $7,995.00 and the quote from Northern Air was $7,500.00. Minnegasco's recommendation (which Northern Air concurred with) is to replace the current furnace with two 100,000 BTU furnaces installed in a staged series. With this concept, one furnace would be the main unit and the other would operate only when additional heat is required. The main advantage to this is that the two units would alternate on an annual basis as the main furnace and the back-up, which would significantly extend the life expectancy of the furnaces. Also, two 100,000 BTU furnaces are more energy efficient that one 200,000 BTU furnace. The furnaces Minnegasco recommends are 78% efficient. The breakdown on Northern Air's quote is $4,275.00 for the air conditioning condenser and $3,225.00 for the furnace replacement. In addition, Northern Air estimated that they could repair the current furnace for $1,400.00; however, this would simply be fabricating a blower and would provide no guarantee. Based on this cost and the age of the furnace it is more appropriate to replace it with two newer, more efficient furnaces. Staff will be reviewing alternatives and if more information is available, it will be presented at the City Council meeting. RECOMMENDED MOTION: Move to authorize the Mayor and City Manager to enter into an agreement with Northern Air to replace the furnace and air conditioning condenser at Heights Liquor at a cost of $7,500.00. The notice for bids was published in the Columbia Heights FOCUS Newspaper the week of September 7, 1992. The bid opening was held Thursday, October 1, 1992 at 2 PM; bids were received from two cab companies. The companies submitting bids were Suburban Taxi Corporation, our current provider, and Yellow Taxi Service Corporation, a former provider. As you are aware, the bid specifications were written so contractors could bid a rate based on origina­ tion/destination per passenger carried (Alternative A), or a flat hourly rate (Alternative B) or on both. Bidders were informed that the City Council reserves the right to select Alternative A or Alternative B. Suburban Taxi Corporation submitted a bid on Alternative A, while Yellow Taxi submitted a bid on Alternative A and Alternative B. Attached are the bids submitted. Also attached is a comparison of the current rates to the rates submitted under Alternative A. Regional Transit Board staff have indicated to me that they will be recommending to the Regional Transit Board funding for 1993 Shared Ride in the amount of $83,000. This is $707 less than the 1992 funding level, and $15,170 less than what was requested for 1993. Other funding requests are proposed to be cut up to 3% over 1992, and others are proposed to be no more than the 1992 funding level. The Regional Transit Board will be acting upon the 1993 funding requests at their meeting of November 16, 1992. In the application to the Regional Transit Board for funding for 1993, it was projected that purchase of service would cost $152,614. This amount was based on a 15% increase over the projected 1992 purchase of service cost. The 15% increase was anticipated to incorporate changes in costs and ridership. I believe there is a need to make additions to the holiday street decorations whic.h were started fo 1992. The white snowflakes used on the NSP poles were often hard to see against an overcast sky. Main Street Designs has worked with Don Jolly to find a way to correct this defic:iency without starting over. After some tria1 and error, the recommended solution is to intertwine amber gold 4 1/2" metallized garland onto the existing white snowflake and to change the bulb to an amber-colored bulb. AlsQ, amber gold pole wrap would be added to the NSP poles. In the downtown area last year, we had red banners only. We are recommending green metallized pole wrap be added to each pole which has a banner. Thes.e would not have lighting, but would pick up other light because of the metallized material within the green base color. The large stanchions which were installed as part of HRA's streetscape program seveTal years ago have been without any flags or banners for a very long time. Main Street Designs has made a proposal for these stanchions and an artist rendition over a photograph will be available at the Council meeting for inspection. They propose a special lighted design for the large stanchion at 40th and Central and lesser banners and pole wrap at the smaller stanchions. Total cost for all of these recommendations is $7,332. My recommendation is for less than the total package because by doing so we could fund a Spring banner with the leftover Columbia Park Clinic gift money and the $2,000 budgeted for 1993. My recommendation is: a.Amber gold metallized wrap and new bulbs for the existing white snowflakes, $1,467; b.Amber gold pole wrap for 28 NSP poles and green metallized pole wrap for 37 City-owned metal poles, $2,080; and c.40th & Central stanchions, $1,940. The total cost of these three items is $5,487. There is $2,066.46 left in the 1992 budget for decorations and we could use $3,420.54 of the Columbia Park Clinic gift. This would leave $1,579.46 of the gift money to carry ·over to 1993 to go with the budgeted $2,000, which together would pay for a new Spring banner yet o be designed. C.Seniors1.The North Suburban Senior Coordinators sponsored a trip to the Old LogTheater on September 10th. Approximately 75 seniors took part in the walk. 3.The Senior Center had a craft and bake sale on September 12th and raised$270.00 to assist with senior projects. Many seniors donated items forsale as well as their time in helping throughout the day. 4.A Defensive Driving class was held on September 17th and 18th with 35seniors attending. 5.Several seniors made food and served it to those helping build "CastleHeights" on Friday, September 18th. COLUMBIA HEIGHTS POLICE DEPAR1MENT t :·� ' :=::�::-ns TO: Mayor and City Council Members FRa1: Chief David Mawhorter_!)\\ SUBJECT: Operational Report, September, 1992 DATE: October 5, 1992 I.Events/Accomplishments A.Captain Olson and I were in Portland, Oregon, for the NationalCommunity Policing Conference from September 22-25. This was anexcellent conference with representatives from 38 states and severalforeign countries. There were 540 total persons in attendance. Theconference both affirmed my current plans to move to the philosophy ofcommunity based policing and taught me several new ideas that havemerit for our city. We also made many new friends who will be valuableresources to us in the future. There were only two departmentsrepresented from Minnesota. They were Columbia Heights and Minneapo­lis. B.Officer Pat Nelson, our latest new officer, is progressing well throughthe Field Training program. He is a very impressive young man and willbe a valuable addition to our department. C.We have also made a conditional offer of employmenrtoGred Fi scb� asthe new officer to fill the vacancy created when Officer Bartlett beganhis duties as the Hilltop/business district community police officer.This, as you recall, is the position funded by the $53,000 grant. D.The Depa!'tment was not successful with our Education grant request of$150,000 to establish the community service center and several otherrelated programs. There still is some very strong interest from thebusiness community to scale back the program and still open theresource center. The various interested groups want to possibly donatefunds to get the center started and fund its operation. Much of thisinterest is in the preliminary stage at this time and I will keep youadvised on where it goes from here. E.The Department was successful in obtaining a grant for $3,000 from theDepartment of Education. The purpose of this grant is to establish andfund a conmuni ty violence prevention council which would identifycommunity needs and resources for violence prevention and to developservices that address conmrunity needs related to violence prevention. F.The Department responded to 1,269 calls for service in September. Thisis a difference of -147 from August. Of-,these calls, one was a strongarm robbery of a person and one was a brother on brother stabbing.Part I and Part II crimes are down by '.166 when compared to the same :'18.yor and City Council Members Page 2 October 5, 1992 month in 1991. So far, in 1992 the department has responded to 321 more Part I and Part II crimes than it did in 1991. G.In September we promoted CSO Joe Sturdevant from pa.rt time to full timeCSO. He filled the vacant position of Sue English. So far, this hasproven to be a positive change. We have more consistency in operationsand Joe is doing a very good job. H.One of our police Explorers, Kevin Rosar, received the J. F.dgar -Hooverlaw enforcement scholarship. There were very few of these awardednationwide and only one was awarded in Minnesota. Kevin plans to usethis money toward his law enforcement degree. II.Projects/Goals A.We are continuing in our efforts to implement community orientedpolicing. Our next areas to achieve are: 1.Call reduction strategies designed to free up more officer time. 2.The implementation of a new daily log for officers designed to savesome of the report writing time. 3.The consideration of using Police Reserves and community volunteersto take desk reports on cold police calls. 4.The consideration of forming a chief's forum, to be made up ofvarious community leaders. The purpose of the forum would be tofoster better communications and citizen input among the variousfactions of our community. III.Issues and Problems DFM:mld 92-331 A.We re beginning to implement the Federal OSHA blood borne pathogenprogram. This is, as usual, a very complicated and extensive program.It will require additional rmbudgeted monies to implement. I hope toprovide you with estimated costs in our October operational report. C�TY 0; (� :...: ,·;_ DEPARTMENT AL GOALS: 1992 AUDIT On September 14th at 11:00 a.m., staff opened the responses to the audit proposal. Seven Requests for Proposals had been mailed out and five responses were received. In mailing the responses out, a survey of metropolitan cities was conducted and the Requests were mailed out to auditing finns that were auditing at least two metropolitan cities with a population in excess of 8,000. The Request for Proposals was also published in the Focus newspaper. 1991· BUDGET CALENDAR The resolution adopting a proposed 1993 budget and levy was certified to the county auditor's office, which is now preparing the parcel specific tax notices. From discussions with county staff, it is anticipated that we will have fairly good figures on the impact of the proposed budget by October 15th. LIQUOR OPERATIONS Staff has received a proposed lease for the liquor store at 37th and Stinson, which is currently being reviewed by staff and the City Attorney. With the current plan of opening the store March 1, 1993, the goal is to have a lease in place by November 1st and no later than December 1, 1992. The schedule for getting a cooler installed is approximately three months. Operational Report October 5, 1992 Page Two ISSUES AND PROBLEMS: STAFF V ACANCIES[IRAINING As I reported in the September Operational Report, all staff vacancies are filled. Three people in the department were promoted to new positions, and three new people were hired. With six people in new positions, there is a significant amount of the Assistant Finance Director's and my time being spent on training and reviewing operating procedures. In addition to this, a temporary meter reader was hired to fill in for Myrtice Degenstein who is out on Workers Comp. It is anticipated that Myrtice will be out for at least six months. Even with all of these changes in the Finance Department, things are running quite well, and we are catching up on some of the functions that fell behind while understaffed. PHONE SYSTEM On September 10th, the console on the phone system quit working. Because of the design of the system and the provision for back-up procedures, the receptionist was able to maintain and receive calls utilizing a regular telephone. The console was down for two days, but very little disruption of phone service was noticed. When Taylor Telephone repaired the console, we also reviewed some of the minor ongoing problems we are having with the system. I requested that Taylor submit a proposal to correct these -problems. It is my anticipation that the cost of these corrections will cost approximately $1,000. However, it would be well worth it to eliminate some of the inconvenience and frustration that a few staff people feel because of these minor flaws in the system. ELECTION All City preparations for the election are going very well. However, the County is significantly behind schedule in preparing ballots ·and the program used in the ballot box counters. Normally, the program used in the ballot box counters is delivered to the City at least a month prior to the election, allowing us ample time to prepare a sample test deck of ballots and test each ballot box counter. With the County running this far behind schedule, City staff will be limited to approximately two weeks to prepare the test deck and test the ballot box counting system. If no problems are encountered, this should be an adequate amount of time. Operational Report October 5, 1992 Page Three HRA COMPUTER SYSTEM In 1991, HRA purchased an in-house computer system for their financial accounting. This system utilizes the same software that the City uses for accounting. When they purchased the system the Finance Department staff, mainly the Assistant Finance Director, aided their part-time Accounting Coordinator in setting the system up, training her, and ensuring that things were operating correctly. Shortly after she was trained and up to speed, she resigned from HR.A and moved out of state. HR.A has hired a new financial coordinator and requested that City staff train this individual and help them with the financial system. Since the individual hired has no computer background or experience, this is becoming a very time-consuming project. With the significant number of new staff in the Finance Department and the time it takes to train them, we simply do not have adequate time available to give HRA the assistance they need in training their staff person.
