D.Ken Kronstedt suggested that we notify the Chief Judge of Court of the vacancieson this commission that need to be filled. We realize it is a two step process.We need to generate names and then notify the judge. E.Future Meeting dates are: January 20, 1987 at 7:30 p.m.April 21, 1987 at 7:30 p.m. July 21, 1987 at 7:30 p.m. October 20, 1987 at 7:30 p.m. F.Steve Mihalchick will look at the Fridley Charter. The meeting was adjourned at 7:36 p.m. :sh CHARTER COMMISSION JANUARY 20, 1987 The meeting was called to order at 7:30 p.m. in the Conference Room by Chairman Anderson. Those present were: Bradley Bird, Steve Mihalchick, Stuart Anderson, Pam Hanson, Robert Nixon, Ken Kronstedt, Gerral Herringer, Charles Vescio, and Linda Magee. Minutes of Oct. 29, 1986 wi 11 be avai !able at our next meeting. Fi !ling Vacancies: Discussion about where we may find members. Cable .. and Newsletter ads created no response. Robert Nixon suggested contacting Civic Organizations. Members of these organizations are civic oriented and may be a good source. We wi 11 explore various options of contact-Anderson. Fridley Charter: Mihalchick gave an overview and comparisons were drawn with our existing charter. Thoughts given for consideration: 1). Extending length of Mayor's Term. 2). Prohibiting Kick-backs for City Employees, Officials, etc. Beyond this, the charters are very similar. There was a discuss ion on the availability of City Buildings, Meeting Rooms, and whether or not a fee was required, etc. Mihalchick suggested that the present guidelines on public facilities use may be of interest to the Commission. Therefore, a request was made for a copy of the guide Ii nes for the next meeting {or a report on same). Areas that need looking at by the Commission per Ron Kalina: 1). Bonding 2). MINUTES OF CHARTER COMMISSION PAGE 2 JANUARY 20, 1987 Assignments of Committees Bonding, Special Assessments , Spending Limits are assigned to Finance. Mayor 1 s Term is assigned to Governmental. Kick backs is assigned to Administration. .. Some members of the Intergovernmental Committee were also assigne d to other committees, due to very little activity by this committee. See names for the other committee assi gnments. Review of Statute 410 Members were asked to review this statute on their own time prior to the next meeting. Any concerns will be brought up at that time. With no further New Business, the date of the next meeting was set for April 21, 1987. Respectf ully submitted, Gerral Herringer Secretary Charter Commission :sh ORDINANCE NO. 1145 BEING AN ORDINANCE AMEN DING CHAPTER 4, SECTION 28A, OF THE CHARTER OF THE CITY OF COLUMBIA HEIGHTS PERTAINING TO PRIMARY ELECTIONS The City of Columbia Heights does ordain: Section 1: Chapter 4, Section 28a, of the Charter of the City of Colt111bia Heights which reads as follows, to-wit: ... Section 28a. THE PRIMARY ELECTION. A primary municipal election shall be held twenty-one da ys be fore the regular municipal election in the year 1933 and biennually thereafter at the same place or places as general elections are held an d like officers shall preside at such elections. The purpose of such primary election shall be to select candidates to be voted for at the general municipal election and the candida tes for nanination to each office who shall receive the greatest num be r of votes in such primary election shall be placed upon the ballot of the next general election in num be rs not to exceed double the nunber of vacancies to be filled, and no other name shall be placed upon the ballot for such general election than the candida tes selected at said primary election. Any person desiring to be cane a candida te for an elective office in the general muncipal election shall file with the city clerk at lest twenty-one days prior to said primary election a statement of such candidacy as follows: I, [ ], be ing first duly sworn, say that I reside at [ ] Street in the City of Colunbia Heights, County of Anoka, State of Minnesota; That I am a qualified voter therein; That I am a candidate for nomination to the office of [ ] to be voted upon at the primary election on [ ] the [ ] da y of [ ], 19 ; and I hereby request that my name be printed upon the official primary election for said office. At least fif­teen days notice shall be given by the City Clerk of the time and place of holding such primary election and of the officers to be naninated, by posting a notice thereof in at least three of the most public places in each election district in the city or by publication of a notice thereof at least one in the official newspaper, or both, as the City Council may ordain, but failure to givesuch notice shall not invalida te such election. Election of officers shall be held at the corrrnisslonmeeting each October. An election may also be called, with seven (7)days written notice, by petition of any five (5) members of the com­mission. Upon a vacancy in any office, that office shall be filledby election at the next meeting of the corrrnission. For ell dutiesherein listed, the vice-president shall serve es the president In thepresident's absence. 2.In all deliberations of the conrnlssion, any of Its permanent or specialcommittees or when it functions as a committee of the whole, except asspecified herein, Robert's rules of order, revised, shall apply. 3� The full commission shall be divided Into conrnittees, with each member serving on no less than one committee. The committees shall Include four (4) permanent committees; administration, political, financial, and intergovernmental, the commission serving es the co111nittee of the whole, and any other special committees as may be appointed from time to time when deemed necessary by the conrnission. A.Conrnittee assignments shall be made by the president, withmajority approval of the entire conrnisslon.B.Each committee shall have a chair, who shall be appointed by thepresident, with majority approval of the entire commission.C.Each committee shall consist of not less than three (3) members.D.Commission members may serve on more than one committee, but cannotchair more than one conrnittee et any given time.E.All reports from a co111nittee shall be in writing. Rules Page 2 6.Proposed amendments may be presented to the colffllisslon by any memberof the conrnission. The proposed amendment shall be In written formwith copies available for each member of the colfflllsslon. A majorityvote of the commission members present shall decide what action Is tobe taken on the proposed amendment, either assignment to a colffllltteeor defeat.• 7.Conrnittees to which a proposed amendment Is assigned are charged withthe duties of investigating, clarifying and drafting the proposed amend­ment in proper form for inclusion in the charter. They are also to con­sider its merit and can either report it back to the colffllisslon positivelyor negatively. 8.If the committee refers a proposed amendment to the conmisslon negatively,the conrnission can by majority vote of the members present:A.Send it to a new committeeB.Send it back to the same committee for further consideration.C.Take no action, which would, in effect, defeat the proposedamendment, orD.Consider it as the conrnittee of the whole. 9.If the committee does not report a proposed amendment to the entire com­mission within ninety (�O) days, the conwnission can, by majority voteof the members present:A.Send it to a new committeeB.Consider it as the conrnittee of the whole, orC.Take no action, thereby leaving It In the same conwnittee. 10.The cor:vnission, acting as the committee of the whole, has the sameresponsibilities as any other conrnittee. Although a proposed amendmentcan be considered by the committee of the whole on the same day it tsIntroduced, it may not be referred for Its first reading for at leastten (10) days after the committee of the whole has met. 11.When the committee refers a proposed amendment to the conmisslonpositively, It is given Its first reading and can be debated. 12.A proposed amendment cannot be given Its second reading for at leastten (10) days after its first reading •. The proposed amendment shallbe deemed approved with direction for a public referendum or recommendedto the City Council for amendment by a unanimous vote of the Council,by a two-thirds vote of the members present followi_ng its second readl_ng. 13.If a proposed amendment does not receive the required two-thirds voteon its second reading, it Is defeated. Further consideration of a de­feated proposed amendment would require• reintroduction, which cannotbe done at the same meeting at which It was defeated. Rules Page 3 1�. If the City Council decides not to amend the charter under the provisions of Section 12, the co111nission can reconsider the proposed amendment and by a two-thirds vote of the members present the proposed amendment can be passed with directions for a public referendum. 15.In order to transact business of either the co111nission or any of Itsconvnittees, a quorum must be present which will consist of a simplemajority of the members. 16.All meetings of the commission and any of Its committees shall beopen to the public. 17.The corrrnission, acting as the corrrnittee of the whole, can conduct publichearings on proposed amendments. 18.The above rules can be only suspended or amended by a two-thirds voteof the members present. > 1
