RESOLUTION OF THE CITY COUNCIL OF COLUMBIA HEIGHTS, MINNESOTA, REQUESTING CONVEYANCE OF TAX
FORFEIT PROPERTY.
BE IT RESOLVED BY the City Council (Council) of the City of Columbia Heights (City), Minnesota that the City Seeks
unrestricted ownership of one parcel forfeited to the State of Minnesota by Anoka County Commissioners
Resolution No. 2011 -101 due to unpaid taxes of certain Property located at 3930 University Ave NE, Columbia
Heights, Anoka County, Minnesota, PIN: 35- 30 -24 -32 -0249, and legally described in Exhibit A;
Hereinafter referred to as the "Subject Parcel"
BE IT FURTHER RESOLVED that the City requests Anoka County Board of Commissioners sell the Root Property to
the City Council of the City of Columbia Heights; and
BE IT FURTHER RESOLVED that Minnesota Statutes Chapter 282.01, Subd. 1 a, paragraph (d), states, "tax- forfeited
lands may be sold by the county board to an organized or incorporated governmental subdivision of the state or
state agency for less than their market value if:
(1) The county board determines that the sale at a reduced price is in the public interest because of reduced
price is necessary to provide an incentive to correct the blighted conditions that make the lands
undesirable in the open market, or the reduced price will lead to the development of affordable housing;
and
(2) The Governmental Subdivision or state agency has documented its specific plans for correcting the blighted
conditions or developing affordable housing, and specific law or laws that empower it to acquire real
property in furtherance of the plans "; and
BE IT FURTHER RESOLVED that the Subject Parcel has become environmentally contaminated and blighted
negatively impacting the surrounding neighborhoods.
BE IT FURTHER RESOLVED that the City Council in and for the City of Columbia Heights intends to remove the
environmental contaminants, eliminate the blighted conditions, and facilitate redevelopment of the Subject Parcel.
NOW, THEREFORE BE IT FINALLY RESOLVED that the City Council of the City of Columbia Heights, Minnesota
formally requests the Anoka County Board of Commissioners resolve to convey the Subject parcel with an
unrestricted deed to the City Council of the City of Columbia Heights at a reduced price to provide an incentive to
correct blight. ORDER OF THE CITY COUNCIL

LEGAL DESCRIPTION OF PROPERTY
That certain property in Anoka County, Minnesota, legally described as follows;
The South Half of Lot 2; all of Lot 3; that part of Lot 11, all in Rearrangement of Block "E" Columbia Heights Annex
to Minneapolis, Anoka County, Minnesota, Described as follows:
Beginning at the point of intersection of the west line of State Highway NO. 56 as now laid out and constructed said
point being 351.1 feet northeasterly along the northwesterly line of said Lot 11 from the most westerly corner
thereof: thence south along the west line of said highway right of way a distance of 85 feet; thence westerly at
right angles a distance of 90 feet; thence north at right angles to the northwesterly line of said Lot 11; thence
northeasterly along the north westerly line of said Lot 11, a distance of 99.1 feet, more or less, to the point of
beginning; and,
That part of Lot Eleven (11), Rearrangement of Block "E ", Columbia Heights Annex to Minneapolis, Anoka County,
Minnesota, Described as follows: Commencing at the point of intersection of the West line of State Highway No.56,
as now laid out and constructed, said point being Three Hundred Fifty -one and One Tenth (351.1) feet
Northeasterly along the Northwesterly line of said Lot Eleven (11), from the most westerly corner thereof; thence
South along the West line of said Highway right of way a distance of Eighty -five (85) feet; thence West at right
angles a distance of Ninety (90) feet to the actual point of beginning of the tract to be hereby described; thence
continuing West on last mentioned line a distance of Ninety -four Hundredths (94.24) feet, more or less, to its
intersection with the Northwesterly line of said Lot Eleven (11); thence Northeasterly along the Northwesterly line
of said Lot Eleven (11) to its intersection with a line drawn North from the actual point of beginning. Said line being
at right angles to the South line of said Tract; thence South along last mentioned line to the actual point of
beginning, except that part of Lot Eleven (11) which lies Northwesterly of a line described as follows: Beginning at a
point on the Northwesterly line of said Lot Eleven (11), distant One Hundred Seventy -seven and Nine Tenths

except that part described as follows:
Beginning at a point on the North line of said Lot 14, distant 220.9 feet East from the Northwest corner thereof,
thence West along the North line of said Lot 14, 220.9 feet to the Northwest corner thereof, thence Southeasterly
along the Westerly along the South line of said Lot 13, 152.2 feet, thence Northwesterly in a straight line to the
point of beginning, a distance of 251.35 feet, more or less.
Except that part of said Lots 2, 3, 11, 12, 13 and 14 which lies easterly of a line running parallel with and distant
119 feet westerly of the following described line: Beginning at a point on the north line of section35, Township 30
North, Range 24 West, distant 1270.16 feet east of the northwest corner thereof; thence run southerly at an angle
of 90 degrees 18 minutes 30 seconds with said north section line (when measured from west to south) for 734.8
feet; thence deflect to the right at an angle of 2 degrees 30 minutes for 458.51 feet; thence deflect to the left at an
angle of 4 degrees 17 minutes 45 seconds for 572.61 feet; thence deflect to the right at an angle of 2 degrees 00
minutes for 689.93 feet; thence deflecting to the right on a 0 °30' curve (delta angle 2 °00') for 400 feet and there

Commencing at a point in the westerly line of said Lot 13, distant 151.25 feet southerly along the westerly line of
Lots 14 and 13 of said plat from the northwest corner of said Lot 14, of said plat distant 220.9 feet east from the
northwest corner of Lot 14, said 156.15 feet being measured along a line which if extended would intersect the
southeasterly line of Lot 13, at a point distant 152.2 feet northeasterly from the southwesterly corner of said Lot;

Northwesterly line of said Lot Eleven (11) from the most Westerly corner thereof: thence South along the West line
of said highway right of way a distance of Eighty -five (feet) to the actual point of beginning of the tract to be
described; thence West at right angles a distance of One Hundred Forty (140) feet; thence South at right angles a
distance of Fourteen (14) feet; thence East at right angles a distance of One Hundred Forty (140) feet to the West
line of said Highway right of way; thence North along the West line of said Highway right of way to the actual point
of beginning, all being in Anoka County, Minnesota.

follows: Commencing at the point of intersection of the West line of former State Trunk Highway No. 56 (now
known as State Trunk Highway No. 47.) said point being Three Hundred Fifty -one and One Tenth (351.1) feet
Northeast along the Northwest line of Said Lot Eleven (11) from the most Westerly corner thereof; thence South
along the West line of said of said former State Trunk Highway right of way a distance of Eighty -five (85) feet, to
the actual point of beginning of the tract to be described; thence West at right Angles to a point of intersection
with a line described as follows and hereinafter referred to as Line "A ", beginning at a point on the Northwesterly
line of said Lot Eleven (11), distant One Hundred Seventy -seven and Nine Tenths (177.9) feet Northeasterly as
measured along the Northwesterly line of said Lot Eleven (11) from the most Westerly corner of said Lot Eleven
(11) thence Southwesterly a distance of One Hundred Sixty -five (165) feet, more or less, to a point on the
Southwesterly line of said Lot (11), which point is distant One Hundred Seventeen and Three Tenths (117.3) feet

terminating, said last line produced West at right angles from said former Highway right of way line to be
