Background:
In 2008, the City of Columbia Heights went through an extensive process in which a program was considered
that would have required the inspection of all residential homes before the properties could be sold. If code
violations were discovered during the inspection, the homeowner would have been required to make the
necessary improvements before the sale of the property would be authorized. This proposed program was entitled
the “Residential Inspection Before Sale” program, or “RIBS” for short. After extensive public debate, the City
Council determined not to implement the RIBS program. The RIBS proposed program faced opposition from
citizens, as well as local real estate agents.
Frost Simula, a concerned resident, has requested that the City of Columbia Heights reconsider implementing a
residential inspection before sale program. Mr. Simula has stated that his home had many deficiencies, and he
feels that a city-sanctioned inspection would have uncovered many of the problems. Mr. Simula will be present
at the Council Work Session to discuss his situation and his ideas for creating a new program.
Point of Sale and Inspection Programs Defined
Municipalities in Minnesota are authorized under state statute to create city-based inspections requirements of
single family homes prior to sale. These inspections are generally referred to as “Truth in Housing Inspections”,
“Point of Sale Inspections” or “Time of Sale Inspections”. The inspections are based upon individual cities’
minimum housing codes and evaluator guidelines.
The housing inspections are completed on a report form provided by the city, and results must adhere to
minimum city standards. (For your reference, attached is a similar form that the City of Columbia Heights
currently uses when evaluating new single family rental homes.) Depending on the city, work orders may be
issued that must be completed prior to exchanging ownership. State law authorizes fining or revoking the
licenses of real estate agents and contractors who offer homes for sale without having the inspection done.
According to the Minnesota Association of Realtors (MAR), it is common for buyers of new homes to request
independent inspections of homes prior to sale, regardless of whether or not cities have inspection requirements
in place. It is also common for sellers to proactively perform pre-listing inspections.
Where are Point of Sale Programs Required?
The following cities require an inspection by a city official prior to sale of a home:
•Crystal (expected to discontinue its Point of Sale program in August)
•Golden Valley (private sanitary sewer line inspection only)
•New Hope
•Richfield
•St. Louis Park
•Osseo

The following cities require an inspection by an independent home inspection contractor prior to sale of a
home:
• Minneapolis
• St. Paul
• Bloomington
• South St. Paul
• Maplewood
• Hopkins
• Robbinsdale
No communities in Anoka County currently require Point of Sale inspections.
Program Costs
According to Anoka County records, there is an average of approximately 10 -15 single family homes that change
ownership in Columbia Heights every week. In 2008, based on contractor pricing for inspections, the City
estimated that each inspection would cost approximately $185. Assuming that costs have increased to $200 per
home based on inflation, a Point of Sale program’s annual operation costs would be between $104,000 and
$156,000. In addition to contractor’s costs, the City would also have to factor additional resources for scheduling
and data management duties associated with the program.
If the City were to initiate a Point of Sale program, the City could choose to pass inspection and administrative
costs to the homeowners, or the City could choose to completely or partially subsidize the program. Homeowners
could have additional costs associated with the inspections if corrections to the property would be required prior
to sale. Certain cities that have Point of Sale inspections require that corrections are made prior to sale, while
other cities use the inspections as a notification and disclosure mechanism.
Next Steps:
Larry Pepin, Building Official for Columbia Heights, will be present at the Council Work Session to discuss
elements of the formerly proposed RIBS program, as well as his thoughts on the possibility of new program
requirements. The Building Official currently inspects all single family residential rental properties before a new
rental license may be granted. Mr. Pepin will discuss the criteria used for new rental inspections, as those criteria
would likely be used as a starting place if a Point of Sale program were to be implemented.
The creation of any new program will require either additional staff resources or the assistance of
contractors/consultants. There would be a cost associated with the program that would be shared by homeowners
and the City. Staff seeks direction from the Council regarding whether or not to pursue creation of a new Point of
Sale inspection program.

With the rebound of the housing market, real estate fraud is also on the rise. One type of
fraud can best be described as “predatory remodeling”.
• A property Seller transfers responsibility of building code violations to an
unsuspecting Buyer by hiding the problems behind cosmetic repairs.
o Tactic used by deceptive home “flippers”
o Seller does not obtain building permits, so there is no building inspection.
o Hidden problems are dangerous to the property and the residents.
• Victims are left with little or no legal recourse.
o After closing, Seller bears no responsibility for the property.
o Sale cannot be reversed.
o Home owner insurance does not cover damages from fraud.
• An extreme case of this fraud has occurred in Columbia Heights.
o Endangered the safety of the Buyer (load-bearing structures removed)
o Lowered the value of the property (finished square footage reduced by
41%)
o Lowered the value of neighboring properties
o Financially crippled the Buyer (estimated $100,000 in damages)

I urge the City of Columbia Heights to consider the development of ordinances that:
• Prevent real estate fraud
o Point of Sale Inspections (property maintenance certificates)
o Property resale limits (minimum of 24 months)
o Home warranties
• Offer recourse for victims of real estate fraud
o Penalties for hiding building code violations
o Seller bears basic responsibility for proper repairs
A Point of Sale program could be modeled after those of many surrounding cities, such as
Maple Grove, Coon Rapids, and St. Louis Park.
Other options, such as property resale limits and home warranties, can be modeled after
those of New York, Illinois, or most European countries, including Belgium and Finland.
The value of our properties and the livelihood of our citizens directly affects the success
of Columbia Heights. Thank you for your consideration and attention to this important

The FBI National Academy is a course focused on professional development for law enforcement leaders in the
United States and throughout the world. The ten week course consists of several different classes including but
not limited to law, behavioral science, communication and leadership development. The FBI National Academy
is the one professional development course by which all other law enforcement staff and command courses are
measured.
Several of the Anoka County Law Enforcement agencies have sent Chiefs, Captains, Commanders and
Lieutenants to the FBI National Academy. County agencies that have benefitted from the National Academy
include Fridley, Coon Rapids, Blaine, Anoka, Lino Lakes, Ramsey, and the Anoka County Sheriff’s Office.
In 2014, I had the opportunity to attend the FBI National Academy. I found the National Academy experience to
be an important part of my development as a law enforcement leader. I feel that the FBI National Academy
would be a significant piece in Captain Austin’s professional development.
Currently, the next available opening for the National Academy is 2018. Captain Austin has expressed interest
in attending and feels that it would be an important part of his professional development, and would like to move
forward with the application process to attend the FBI National Academy.

Background:
Bids for CP-1 were awarded in June to Veit Companies, and work has begun. CP-1 involves mass site
grading, environmental remediation including removal of unsuitable material, and storm sewer.
Generally this work can be described as getting the site “Pad Ready” for the building.
CP-2 bidding documents were broke into four (4) bid packages and included:
•General Building Construction – General Contractor (GC)
•Fire Protection (FP)
•Building Mechanical (Mech)
•Building Electrical (Elec)
Analysis/Conclusions:
Plans and specification were prepared and advertised both electronically, on the City’s website, local
newspaper and building trade associations. Bids were received and publicly read aloud at the July 29th
2015 bid opening.
Bid results are as follows:
•GC – 9 bids, amended to 8
•FP – 2 bids
•Mech – 5 bids
•Elec – 2 bids
The preliminary bid tabulation is attached for each section. As previously described, there were several
alternates provided for each or across bid sections. The bids are currently being reviewed and tabulated
by the Owner’s Rep, ICS Consulting, Inc., and those results should be available prior to Monday’s
meeting. In each bid section, the apparent low bidder is highlighted, and their base bid plus alternates is
provided at the end of each listing. The initial low bid for the GC section, Donlar Construction,
contacted ICS following the bid opening to report a bidding error and to formally request withdrawal of
their bid. This process is allowed in ours and in most public bidding documents.
Staff will review each of the bid sections, including each of the alternates. A detailed update on the
overall budget will also be provided at the meeting.
MOTION: None - Update provided on Library CP-2 bids and overall Library budget. Contract awards
will be requested at the next regular Council meeting on August 10th.
