Resolution No. 2018 -76, approving a variance for the property located at 1020 Lincoln Terrace City Planner Elizabeth Hammond reported that the applicants have requested a variance to the side yard setbacks for the subject property. The current attached garage is smaller than what the homeowners feel will fit their needs. The applicants are requesting a variance of 2.5 feet. The original garage was built within the required setback, and the proposed addition would keep the existing building line consistent, rather than moving the garage farther west to meet the required setback. The Planning Commission voted unanimously to recommend that the City Council approve the requested variance. Motion by Councilmember Buesgens, seconded by Councilmember Williams to waive the reading of Resolution No. 2018 -76, there being ample copies available to the public. All Ayes Motion Carried. ADMINISTRATIVE REPORTS Councilmember Buesgens attended the Heights Next Plant Exchange & Movie Night. She attended the Growing Sustainable Communities Conference in Dubuque, IA, where she learned various ideas to discuss with city departments. She attended the Fix -it Clinic and reported that 28 people were served by seven volunteer "fixers ". 218 pounds of material was made reusable, rather than ending up in the landfill. Councilmember Williams commended the Police Department for their diligence in drug enforcement; noting that six arrests were made in recent traffic stops. Councilmember Murzyn, Jr. participated in a ride along with the Fire Department (rental inspections). An announcement was made that the Lions will be hosting a shredding event on October 13th in the Murzyn Hall upper parking lot. Councilmember Novitsky participated with the Lions in a tailgating event at the Columbia Heights High School homecoming game; a 51 -13 victory was celebrated. Mayor Schmitt attended a Deployment Ceremony in St Paul, assisting with serving 5,000 dinners. She attended the Comcast Voices, a Civil Rights Movement; at the Minnesota History Center. City Manager Walt Fehst announced Anoka County will be presenting "The History of Columbia Heights" on Saturday October 13th at the Columbia Heights Library. 11. COMMUNITY FORUM Frost Simula -1700 49th Ave requested that the Council look into funding for future efforts in climate change protection. Mayor Schmitt suggested he contact the Director of Finance with any suggestions or questions. 12. ADJOURNMENT Motion by Councilmember Williams, seconded by Councilmember Murzyn, Jr. to adjourn. Meeting adjourned at 7:37p.m. Respectively Submitted, Katie Bruno, City Clerk /Council Secretary City Council Minutes October 8, 2018 Page 4of5 ORDINANCE NO. 1652 BEING AN ORDINANCE AMENDING ORDINANCE NO. 1616, CITY CODE OF 2014, RELATING TO THE USE OF TOBACCO LICENSE REQUIREMENTS WITHIN THE CITY OF COLUMBIA HEIGHTS The City of Columbia Heights, Minnesota does ordain: Chapter 5, Article III, Section 5.303, Subsection (B), which currently reads as follows, to wit: § 5.303 LICENSE. (B) No person shall operate a smoke shop without first having obtained a smoke shop license to do so from the city. At any given time, there shall be no more than four smoke shops, all with appropriate licenses, throughout the city. Currently existing smoke shop establishments should be granted the first preference to renew their smoke shop license if they choose to do so. Is hereby amended to read as follows: § 5.303 LICENSE. (B) No person shall operate a smoke shop without first having obtained a smoke shop license to do so from the city. At any given time, there shall be no more than three smoke shops, all with appropriate licenses, throughout the city. RESOLUTION NO. 2018 -76 A resolution of the City Council for the City of Columbia Heights, Minnesota, approving a Variance for the property located at 1020 Lincoln Terrace NE. Whereas, a proposal (Case # 2018 -1001) has been submitted by Richard and Bonnie Walker to the City Council requesting a variance from the City of Columbia Heights Zoning Code at the following location: ADDRESS: 1020 Lincoln Terrace NE (Property Identification Number: 25- 30 -24 -23 -0102) LEGAL DESCRIPTION: On file at City Hall. THE APPLICANT SEEKS THE FOLLOWING RELIEF: 1) Waiver to Section 9.109 (C)- allowing an addition to an attached accessory structure to be located 4.5' feet from the side (east) property line. Whereas, the Planning Commission has held a public hearing as required by the City Zoning Code on October 2nd, 2018; Whereas, the City Council has considered the advice and recommendations of the Planning Commission regarding the effect of the proposed variances upon the health, safety, and welfare of the community and its Comprehensive Plan, as well as any concern related to traffic, property values, light, air, danger of fire, and risk to public safety, in the surrounding area; Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of Columbia Heights, the City Council of the City of Columbia Heights makes the following: City Council Minutes October 8, 2018 Page 5 of 5 FINDINGS OF FACT (a) Because of the particular physical surroundings, or the shape, configuration, topography, or other conditions of the specific parcel of land involved, strict adherence to the provisions of this article would cause practical difficulties in conforming to the zoning ordinance. The applicant, however, is proposing to use the property in a reasonable manner not permitted by the zoning ordinance. (b) The conditions upon which the variance is based are unique to the specific parcel of land involved and are generally not applicable to other properties within the same zoning classification. Meeting of: COLUMBIA HEIGHTS CITY COUNCIL Date of Meeting: October 1, 2018 Time of Meeting: 7:00 PM Location of Meeting: Conference Room #1 Purpose of Meeting: Work Session CALL TO ORDER /ROLL CALL - The meeting was called to order at 7:22 PM Present: Mayor Schmitt, Councilmembers Murzyn Jr, Novitsky, Williams, and Buesgens (via telephone) Also present: Walt Fehst; City Manager, Lenny Austin; Police Chief, Matt Markham; Police Captain, Keith Windschitl; Recreation Director, Joe Kloiber; Finance Director, Kelli Bourgeois: Human Resources Director /Assistant City Manager, Renee Dougherty; Library Director, Joe Hogeboom; Community Development Director, Keith Dahl; Economic Development Manager, and Katie Bruno; City Clerk. 2019 Budget Discussion Mayor Schmitt announced that the Police and Fire Departments 2019 Budget discussion will be moved to a work session on October 22nd at 6:00 PM. Re guest for Upgrade of Public Safety Building Security Cameras Police Chief Lenny Austin reported that the security needs have changed since the building was constructed in 2009. The cost is proposed to be split between the police and fire department. The item will be brought to the October 8th City Council meeting for consideration. Recreation Keith Windschitl, Recreation Director gave a comparison between the 2018 and 2019 budgets. The nine departments within the Recreation budget have a decrease of $12,068. There is an increase in the Capital Equipment Fund of $65,000 to replace the minibus. The current vehicle is 15 years old with 140,000 miles. The part-time Recreation Coordinator positon is included in the 2019 budget, although it is currently vacant. Community Development Joe Hogeboom reported that Community Development has the following areas; Building Department, Permits /Licensing, and Planning. The Economic Development budget is for EDA /Housing. Keith Dahl reported overall Community Development's budget increased by 8.514 %. Expenses and revenues are equal. Fund 408 is the EDA Capital Improvement Project fund, this funds various projects and programs offered to the community. Mayor Schmitt requested an update on HyVee. Hogeboom reported HyVee is expected to start construction in 2019. Library Renee Dougherty, Library Director reported that in 2017 visitors increased 4.8 %, use of public meeting rooms has more than doubled, over 8,000 participated in programs, circulation increased 6.5 %, and public internet use increased 33.6 %. In 2018 visitors seem to be down, while circulation and room use has increased. The 2019 proposed budget includes a 5.3% increase, attributed to personnel, utilities and the IS department's change in allocation. Administration Mayor Council City Clerk Katie Bruno reported the overall increase for the Mayor /Council budget from 2018 to proposed 2019 is $14,271 (10.9 %). Increases include health insurance, local travel expense, and membership fees. City Council Work Session October 1, 2018 Page 2 of 2 Mayor Schmitt commented that the membership for Metro Cities has increased substantially. City Manager Fehst stated he thinks it is a benefit to the city, as it proactively educates the Council. City Manager Kelli Bourgeois, Human Resources Director /Assistant City Manager reported that there is a net overall increase in the City Manager's budget of $896. The City planned to participate in the GARE (Government Alliance on Race & Equity) program, at a cost of $20,000. Because of the decrease in fiscal disparities Bourgeois indicated this will be removed from the budget, and she will look into other training. Other increases include personnel and insurance costs. City Clerk The overall decrease for the City Clerk budget from 2018 to proposed 2019 is $45,958. This large decrease is due to 2019 being a non - election year. For the 2018 -2019 decrease the election related costs to personnel, supplies and "other services" were the most significant. It makes sense to mention a budget comparison to the most recent non - election year (2017). The difference is a $3,555 increase, over 2 years. The increase is in both personnel and IS change in allocation. Assessing & Legal Services Assessing increased $200, for personnel costs. Legal Services increased by $5,100 in order to more closely match what has been spent in civil prosecution services over the past few years. Bourgeois indicated that our current contract with Barna & Guzy is very good. Cable Bourgeois reported that the purchase of NeoGov Software will allow the City to attract more applicants by utilizing online employment applications. The current HR Software (Bamboo) costs about $12,000 annually, this is adequate until new finance software is purchased. Mayor Schmitt asked if the cable intern position will remain in the budget. Bourgeois indicated that it will for the foreseeable future. Mayor Schmitt questioned if there is any way to make up the loss in fiscal disparities, asking how much would need to be removed from the budget to decrease the levy by 1 %. Finance Director Joe Kloiber stated that $100,000 would decrease by slightly more than 1 %. Manager Fehst reported that an increase in inspection revenue is likely. Kloiber suggested discussing that further at the Fire Department budget presentation. Various ideas were discussed including reduction in the Fire Department, and removing the expansion of the EDA Special Projects Fund. Kloiber stated that cutting the levy, would make the fiscal disparities formula worse for 2020. Meeting Adjourned at 9:11 PM Respectively Submitted, Katie Bruno, Council Secretary /City Clerk 10 OFFICIAL PROCEEDINGS COLUMBIA HEIGHTS TRAFFIC COMMISSION MONDAY, August 6, 2018 CALL TO ORDER The meeting was called to order by Chairperson Carlson at 5:30 p.m. ROLL CALL Members present: Commissioners Carlson, Doty, Olson, and Schluender Members absent: Commissioners Clerkin Staff present: Kathy Young, Assistant City Engineer Lenny Austin, Police Chief Sue Schmidtbauer, Public Works Secretary Council Liaison: Connie Buesgens APPROVAL OF MINUTES Motion by Doty, seconded by Olson, to approve the minutes of June 4, 2018 as presented. Motion passed unanimously. OLD BUSINESS A. CONSTRUCT BARRIER ALONG JEFFERSON STREET AND LOWER SPEED LIMIT ON 46% AVENUE The City Engineer met with a consulting engineer to discuss options for constructing a barrier along Jefferson Street across from 46% Avenue. The barrier must be designed to stop a vehicle from continuing westbound, but not seriously injure the driver or passengers when hitting it head on. Doty stated cars do pick up momentum going downhill and asked how many cars have hit the barrier. Young advised the barrier is struck at least 1 -2X a year at different times, but winter is when the hill is slipperiest and vehicles tend to slide through the intersection. Carlson inquired about a CAUTION sign designating 20 mph. Staff did research lowering the speed limit on 46% Avenue. According to State Statute, a residential roadway of less than one -half mile in total length can be designated as 25 miles per hour if adopted by the road authority having jurisdiction over the residential roadway. The 25 mph designation would need to be adopted by both the Columbia Heights and Hilltop City Councils. Also, a study conducted by MnDOT clearly shows drivers' behavior does not change simply by reducing the posted speed limit. Therefore, staff does not recommend lowering the speed limit on 46% Avenue. Doty asked about a traffic count as well as checking the speed on 46% Avenue. A traffic count was done in May and showed an average of 368 cars in 48 hours on 46% Avenue. Austin stated the speed trailer would be ineffective in that short of a distance. Young advised we could do something temporarily and then decide on a more permanent solution at a later date. Motion by Olson to deny the request to lower the speed limit on 46% Avenue. Motion seconded by Carlson. Motion passed unanimously. m Traffic Commission Minutes —August 6, 2018 Page 2 OTHER OLD BUSINESS None NEW BUSINESS A. REQUEST FOR STOP SIGNS AT THE INTERSECTION OF 4T" STREET AND 43RD AVENUE Mr. Gregory Johnson has requested STOP signs stopping traffic on 4th Street at 43rd Avenue. His concern is traffic speed. This is a T- intersection. Visibility is good. Traffic on 4th Street stops at 42nd Avenue and at 44th Avenue. Traffic on 43rd Avenue must turn either north or south onto 4th Street. There was one reported accident at this intersection during the previous five years. The accident was on May 20, 2016 and damaged City property. Carlson stated he drives through this intersection frequently and sees absolutely no need for a stop sign. Schluender thinks drivers feel safe at the "T" and that's why they speed. Olson feels if you add stop signs drivers will disregard them all. Schluender asked what the manual for streets allows regarding design to slow traffic, can we account for this when re- engineering. Young advised we have looked at this on some of our wider streets; however, this street is narrow. Buesgens asked if residential roundabouts, the small ones, have been considered. Young states we do have 60' right -of -ways so could possibly reconstruct the curb and gutter for cars to go around. Roundabouts do force drivers to slow down. Doty advised roundabouts make winter plowing very difficult. Austin asked when the complaint was received. Young advised it was the end of June. Austin stated this may have stemmed from a lot of traffic being detoured along 4th Street during the construction. Police did have some speed issues to address at that time. Also, some trucks were using unauthorized detour routes. Motion by Olson to deny the request for stop signs at the intersection of 4th Street and 43rd Avenue. Motion seconded by Doty. Motion passed unanimously. Carlson added that westbound traffic is also stopped on 41St Avenue and 4th Street. There's only one intersection without stop signs. RESIDENTS PRESENT: Marsha Stroik, 3938 Polk Street B. REQUEST FOR STOP SIGNS AT THE INTERSECTION OF POLK STREET AND 42ND AVENUE Ms. Stephanie Stroik has requested two -way STOP signs at the intersection of Polk Street and 42 "d Avenue. Her concerns are that drivers are either not aware or do not care that this is an 12 Traffic Commission Minutes — August 6, 2018 Page 3 uncontrolled intersection and speed right through. During the winter the snow banks are so high that it makes it difficult to see traffic on the cross streets. And, she is concerned about the many children that ride their bikes in this area. The intersection is skewed at an angle. Visibility at the intersection is fair. Traffic on Polk Street stops at 41St Avenue and Arthur Street. Traffic on 42nd Avenue stops at Reservoir Boulevard and Arthur Street. There have been no reported accidents at this intersection within the last five years. Stephanie Stroik was unable to attend the meeting tonight. Marsha Stroik is Stephanie's mother -in- law and lives two blocks from Stephanie on Polk Street. She stated there is a lot of traffic on Polk Street. Last Friday, in the few seconds it took her to get out of her vehicle, three cars sped past and no one stopped, slowed down or looked. There are no sidewalks but lots of children, a daycare, and traffic from the church and Ostrander Park. There's continuously a lot of foot traffic coming down Polk Street. She stops at the intersection for safety reasons because the cross traffic does not stop or slow down. She feels that just because there have been no accidents does not mean it's not a dangerous intersection. Carlson advised this intersection has been before the Traffic Commission before but he does not feel it merits a stop sign. Ms. Stroik stated she is requesting stop signs on 42nd Avenue because there's less traffic on 42nd Avenue. Schluender looked at the intersection and feels visibility is fair. There is a hill with some additional landscaping on top as you're coming south on Polk Street. Approaching 42nd Avenue without a stop sign and waiting to see if you can see cross traffic puts a vehicle pretty far into the intersection, which may account for squealing brakes and stopping quickly. Because of the diagonal, there's also a lot of space in the intersection, making it easier to proceed with less caution as it feels like you have more room. Ms. Stroik advised this is also used as a shortcut to get to Highland Elementary and the high school so there's a lot of traffic during the school year. Then there's the playground and activities at First Lutheran Church and Ostrander Park. There's always a lot of pedestrian activity. Olson advised the Traffic Commission needs to follow certain guidelines designated by the State of Minnesota that help decide where to put traffic control. This intersection does not meet any of the criteria. Drivers need to drive defensively, especially through uncontrolled intersections. Ms. Stroik feels the bigger concern is pedestrians and children. Olson advised there are many other uncontrolled intersections in town that are the same or similar and there haven't been any issues. We need to follow the state guidelines. Doty agrees the intersection is wide open which may cause drivers to not slow down. Austin also stated that because of snowbanks, you do learn to drive defensively. Stop signs may solve some concerns but will generally bring on more issues. Approximately only 20% of traffic actually stops for stop signs. Stop signs significantly disrupt traffic flow and that's why there are state guidelines to help with some of these decisions. Young advised that if traffic does have a stop sign on 42nd Avenue, it will increase the speed of traffic on Polk Street because drivers know traffic is required to stop on 42nd Avenue. It provides more of a thoroughfare. Again, Ms. Stroik stated her concern is all the children walking to the park. 13 Traffic Commission Minutes – August 6, 2018 Page 4 Buesgens advised that residents can possibly request a sidewalk to be placed on either side of the street. If the neighbors are in agreement, Ms. Stroik can generate a petition and then request the sidewalk from Public Works for her block. There would be assessments but this is a possibility. Doty stated they petitioned a sidewalk where he grew up in Columbia Heights. Ms. Stroik stated it just seems like a lot of traffic and it's traveling too fast. Motion by Olson to deny the request for stop signs at the intersection of Polk Street and 42nd Avenue. Motion seconded by Doty. Motion passed unanimously. Carlson advised Ms. Stroik that the route of appeal it to go to the City Council, but this intersection does not meet any of the state guidelines. Olson also re- iterated about petitioning for a sidewalk. OTHER NEW BUSINESS None REPORTS CITY ENGINEER At the request of the residents, disabled parking signs have been installed at the following locations: 4256 Van Buren Street, Permit number 814664, 4419 Jefferson Street, Permit number 044166806, and 3708 2% Street, Permit number E83939 POLICE CHIEF The Police Department is looking into purchasing new speed equipment. This will be brought up to the Traffic Commission when everything is final. COMMISSIONERS Doty asked if in the future we could also obtain information 1 -2 blocks from the requested intersection to compare accidents where there are stop signs vs. uncontrolled intersections. Austin advised we can provide that information but the results could go either way. However, he would also be curious to see the results, but also advised that we do not always receive reports of accidents. Doty stated it seems like drivers roll through stop signs all the time. Austin agreed - -they do. The 20% compliance rate is nationwide —the reality is that most drivers do not stop completely at stop signs based on what the statute rules. Doty stated drivers are continuously running red lights on Central Avenue. Austin does not know the current traffic count on Central Avenue but it does seem busier. The number of red light runners has increased and driver behavior has changed over the years. We can include the extra intersections requested and make a comparison but part of the problem is location. Example: Arthur Street is a main thoroughfare and has more traffic than Polk Street, but if you put stop signs up it would increase traffic somewhere else. Stop signs solve some issues but tend to create others, especially when it comes to traffic flow. Young stated she is currently working with a property owner on Arthur Street where the concern is speeding and all of the cross streets have stop signs. Schluender asked if the crash data is public data. Austin advised it is public, but if he wanted to look at actual police reports they may contain redaction. Austin reiterated that information is just for reported 14 Traffic Commission Minutes — August 6, 2018 Page 5 accidents; a lot of accidents are not reported. Carlson inquired about the intersection at 44th and Central Avenue. Austin advised we've had crashes there but he's unsure if they've been significant lately. States Central Avenue is busy with approximately 26,000 vehicles a day; crashes are up there but not at a critical number. Winter is a different story. Buesgens stated things may change if we get the two grants we're applying for at 43rd and 47th Avenues on Central. Due to HyVee that whole area may change. Old Business: Northeaster Photo Contest Update: Renee was not able to reconnect with Margo Ashmore (Northeaster) since her return from vacation, so we don't know how many entries have been submitted. Monument Sign Update: As far as we know, installation is still on schedule; which is mid - October, so we should see some preliminary work soon. The LED panel has been ordered and should arrive mid - August. 2019 Budget Update: Budget has been accepted so far, but has yet to be formally presented to the Council. Council must set the City tax levy amount by the end of September, so we should have a better understanding then. Renee, Library Director, received advice from the Finance Director on how to address the Council regarding the budget. New Business: Change in Procedure for Rental DVDs ($1 fee for Fiction DVDs released in current year, plus one previous year (formerly previous two years): This is a change by Anoka County Library, and it would be best to follow suit. They are doing it to increase circulation on items; the $1 fee can be a deterrent to many (most library systems do not charge 16 for any DVDs). If it were up to the Renee, Library Director, we wouldn't charge for any DVDs either; circulation is more important than the fee collected for them (we average about $1500 /year, but we are likely going to come up short this year anyway). The fee barrier may also encourage more theft. MOTION: Columbia Heights will align the DVD Fee Schedule with Anoka County's revised schedule: Conway moved, Smith seconded... Approved. Approve Youth Read Down programs for October 2018, June, July and October 2019: Bri Belanger would like to keep the Youth Read Down Program going with the Board's permission. MOTION: Approve Youth Read Down for October 2018, and June, July, October of 2019: Smith moved, Conway seconded... Approved. Also brought up was the idea to allow Youth Read Down all year long (rather than certain months) for children to eliminate fines; may need an opportunity for adults as well. Items from the Floor: Libraries eliminating fines. St. Paul just announced no fines; Washington County has already implemented the change; Hennepin County is considering it. • This means eliminating late fees, but patrons still need to return items, and they will still be billed for lost /damaged items (billed after 30 days past due, but can still return the item with no fine). • In St. Paul it was determined that 1/5 of patrons have fines excessive enough to prevent checkout (and fines adversely affect lower income patrons); they want to lift that barrier to encourage patrons to come back to the library, and increase circulation. • Fines can account for a substantial portion of library income, so eliminating them means a decreased budget or offset with more tax money. We don't know if these policies will create the changes they intend to, but we have some time to learn from the counties who've already done so. • It would be difficult for Columbia Heights to enact this kind of policy without Anoka County being onboard, and we don't yet know their opinion on the subject. It could come in stages... starting with eliminating fines on juvenile material. Spaghetti Dinner occurs next week; spaghetti is still catered by Tasty Pizza, as well as custard from Culver's, and will feature pianist, Tara Brueske. Tricia mentioned that she won't be able to work her volunteer shift because now she needs to be out of town; Pat Sowada said she would cover the shift.
