Domestic Violence Awareness Month
WHEREAS, the community problem of domestic violence has become a critical
public health and welfare concern in Anoka County; and
WHEREAS, domestic violence is a crime, the commission of which will not be
tolerated in Anoka County and perpetrators of said crime are subject to prosecution and
conviction in accordance with the law; and
WHEREAS, over thousands of women and children have and will continue to access
assistance from Alexandra House, Inc., a domestic violence service provider; and
WHEREAS, domestic violence will be eliminated through community partnerships of
concerned individuals and organizations working together to prevent abuse while at the
same time effecting social and legal change; and
WHEREAS, October is National Domestic Violence Awareness Month; and
WHEREAS, during National Domestic Violence Awareness Month, Anoka County
organizations will inform area residents about domestic violence, its prevalence,
consequences and what we, as a concerned community can do to eliminate its existence.

The following are the minutes for the regular meeting of the City Council held at 7:00 PM on Monday,

Mayor Schmitt had a question related to a payment to the City of Fridley for the Home & Garden show.
Keith Dahl, Economic Development Manager explained that the City has participated in the Home & Garden
Show for a few years, and due to lack of sponsorship the portion the cities have been asked to pay is greater
than expected. The City is planning a local City Expo and Town Hall Meeting in March of 2019.
Motion by Councilmember Novitsky, seconded by Councilmember Williams to move that in accordance with
Minnesota Statute 412.271, subd. 8 the City Council has reviewed the enclosed list of claims paid by check and
by electronic funds transfer in the amount of $749,397.33. All Ayes, Motion Carried
8. PUBLIC HEARINGS
A. Resolution No. 2018 -64, approving variances for the property located at 685 49th Ave NE
Elizabeth Hammond, City Planner reported that the property owner has requested a Variance to the
front and side yard setbacks for the subject property. Currently, there is a one car attached garage on
the property. The current garage is in disrepair and the property owners wish to remove the existing
garage and replace it with a new two car attached garage. The Planning Commission voted

unanimously to recommend that the City Council approve the requested variance to allow for the
proposed garage to be constructed.
Motion by Councilmember Buesgens, seconded by Councilmember Murzyn, Jr. to waive the reading of
Resolution No. 2018 -64, there being ample copies available to the public. All Ayes, Motion Carried.
Motion by Councilmember Murzyn, Jr., seconded by Councilmember Novitsky to approve Resolution No.
2018 -64, as presented. All Ayes, Motion Carried.
B. First reading of Ordinance No. 1651, being an ordinance amending City Code of 2005 relating to
zoning and land development, and removing the planning and zoning fee schedule from the zoning
code.
Elizabeth Hammond, City Planner reported that Staff is recommending a Zoning Text Amendment, to
remove the fee schedule chart currently displayed in City Code, Section 9.104. The way the Zoning Code is
set up currently, when a fee is changed by the City Council, staff must bring an ordinance to the Planning
Commission and then to the City Council for approval, as this action is technically amending the literal
language (the fee chart) in the code. Alternatively, staff has added language to the code referencing that
the Community Development Department will keep a record of the current fees. Removing this chart will
ultimately save staff time going forward, and lessens the likelihood that outdated fees are left in the
Zoning Code. In addition, it will save money on publication fees associated with ordinance changes.
Motion by Councilmember Buesgens, seconded by Councilmember Williams to waive the reading of
Ordinance No. 1651, there being ample copies available to the public. All Ayes, Motion Carried.
Motion by Councilmember Murzyn, Jr., seconded by Councilmember Novitsky to approve the ordinance on
first consideration and set the second reading of Ordinance No. 1651, for September 24th, 2018 at
approximately 7:00 P.M. in the City Council Chambers at the Columbia Heights City Hall. All Ayes, Motion
Carried.
9. ITEMS FOR CONSIDERATION
A. Other Ordinances and Resolutions
a. Approval Consideration of Resolution 2018 -65, a Resolution Approving the Entering into of an Agreement
and Grant License with Certain Property Owners
Keith Dahl, Economic Development Manager reported that in a collaborative effort between the City of
Columbia Heights, the Police Department and the EDA, a Facade Improvement Grant Program was offered to
businesses and commercial property owners along Central Ave. The intent of the Grant Program was to
encourage businesses and commercial property owners to revitalize, rehabilitate, and restore their existing
store fronts, but also for the CHPD to provide monitored surveillance along Central Ave with the installation of
security cameras at selected grantee locations.
Each individual grantee is required to enter into an agreement and grant license with the City since the CHPD
desires to retain ownership of these exterior surveillance systems for the next ten years. The agreement will
allow the CHPD to install security cameras on the exterior of the primary structure; install recording equipment
inside of the primary structure in a locked and secured location to prevent destruction or tampering; and allow
for annual maintenance inspections for a period of ten years.
Currently, the CHPD is in the process of obtaining proposals from security consultants to provide the design and
installation services of the exterior surveillance systems.
Councilmember Buesgens questioned if the cameras will be installed in alleys. Dahl indicated that two of the
businesses will have alley facing cameras. Buesgens asked what happens after the ten year contract is up. Dahl

stated that the cameras may not last more than ten years, and this will give the city an opportunity to
reevaluate the program.
Motion by Councilmember Buesgens, seconded by Councilmember Murzyn, Jr. to waive the reading of
Resolution 2018 -65, there being ample copies available to the public. All Ayes, Motion Carried.
Motion by Councilmember Buesgens, seconded by Councilmember Williams to adopt Resolution 2018 -65, a
resolution of the City Council for the City of Columbia Heights, Minnesota, approving the entering into of that
certain Agreement and Grant of License with various property owners. All Ayes, Motion Carried.

10. ADMINISTRATIVE REPORTS
Councilmember Novitsky attended Cuts with a Cop, Coffee with a Cop, and the very informative North Metro
Chamber meeting. The VFW Flag Retirement ceremony was well attended. Novitsky, along with the Boosters
participated in tailgating prior to the high school football game.
Councilmember Murzyn, Jr. attended the swearing in ceremony for Police Officer Thomas Hall, and the VFW
Flag Retirement ceremony.
Councilmember Buesgens attended the League of Minnesota Cities Local Economy Committee, and Fiscal
Futures Committee. She also attended Cuts with a Cop, the swearing in of Officer Thomas Hall, and an MWMO
meeting.
Mayor Schmitt was at Columbia Heights High School to welcome students on the first day. She also attended
the MWMO meeting. A plaque was sent over to our Sister City, Lomianki from the City of Columbia Heights in
honor of Poland's Centenary of regaining independence.
City Manager Walt Fehst reminded the Council of a Library Fundraiser on September 12th at Murzyn Hall. He
announced a Candidate Forum is scheduled for Thursday, September 201H

A resolution of the City Council for the City of Columbia Heights, Minnesota, approving Variances for the
property located at 685 49th Ave. NE.

Whereas, a proposal (Case # 2018 -0901) has been submitted by Ivan and Randeelyn Clauson to the City
Council requesting variances from the City of Columbia Heights Zoning Code at the following location:
ADDRESS: 685 49th Ave. NE. (PID 26- 30 -24 -13 -0004)
LEGAL DESCRIPTION: On file at City Hall.
THE APPLICANT SEEKS THE FOLLOWING RELIEF:
1) Waiver to Section 9.109 (C)- allowing an attached accessory structure to be located 20.5' feet from the front
(east) property line.
2) Waiver to Section 9.109 (C)- allowing an attached accessory structure to be located 4.4' feet from the side
(north) property line.
Whereas, the Planning Commission has held a public hearing as required by the City Zoning Code on
September 5, 2018;
Whereas, the City Council has considered the advice and recommendations of the Planning Commission
regarding the effect of the proposed variances upon the health, safety, and welfare of the community and its
Comprehensive Plan, as well as any concern related to traffic, property values, light, air, danger of fire, and
risk to public safety, in the surrounding area;
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of Columbia
Heights, the City Council of the City of Columbia Heights makes the following:
FINDINGS OF FACT
(a) Because of the particular physical surroundings, or the shape, configuration, topography, or other
conditions of the specific parcel of land involved, strict adherence to the provisions of this article would cause
practical difficulties in conforming to the zoning ordinance. The applicant, however, is proposing to use the
property in a reasonable manner not permitted by the zoning ordinance.
(b) The conditions upon which the variance is based are unique to the specific parcel of land involved and are
generally not applicable to other properties within the same zoning classification.
(c) The practical difficulties are caused by the provisions of this article and have not been created by any
person currently having a legal interest in the property.
(d) The granting of the variance is in harmony with the general purpose and intent of the Comprehensive
Plan_
(e) The granting of the variance will not be materially detrimental to the public welfare or materially
injurious to the enjoyment, use, development or value of property or improvements in the vicinity.
RESOLUTION NO. 2018 -65
A RESOLUTION OF THE CITY COUNCIL FOR THE CITY OF COLUMBIA HEIGHTS, MINNESOTA, APPROVING THE

ENTERING INTO OF THAT CERTAIN AGREEMENT AND GRANT OF LICENSE WITH VARIOUS PROPERTY
OWNERS.
BE IT RESOLVED, by the City Council (the "Council ") for the City of Columbia Heights (the "City ") as follows:
WHEREAS, the Columbia Heights Economic Development Authority (the "EDA ") and the City have collaborated
to create a certain Fagade Improvement Grant Program (the "Program "); and
WHEREAS, pursuant to guidelines established for the Program, the EDA is to award and administer a series of
grants to eligible commercial property owners and /or tenants for the purposes of revitalizing existing store
fronts, increasing business vitality and economic performance, and decreasing criminal activity along Central
Avenue Northeast, in the City's Central Business district; and
WHEREAS, pursuant to the Program, the City is to coordinate a surveillance camera monitoring program by
placing surveillance cameras on some of the storefronts that are part of the Program for the purposes of
improving public safety in and around the Central Business District.
NOW THEREFORE, in accordance with the foregoing, and all ordinances and regulations of the City of
Columbia Heights, the Council hereby makes the following:
FINDINGS OF FACT
1. The Program guidelines have been reviewed and approved by both the City and the EDA and the
guidelines are tailored to fulfill the objectives set forth in such guidelines.
2. The Agreement and Grant of License with various property owners (the "License Agreement ") is
necessary for the placement, use, and maintenance of the security cameras, as contemplated under
the Program guidelines, and the License Agreement, as presented to the Council on the date of this
resolution, is in acceptable form, on advice of the City attorney.
3. In order to implement and carry on the Program, City staff will be required to secure the agreement
of various property owners to the License Agreement, and City police personnel will be required to
carry on the surveillance activities described in the License Agreement.
NOW THEREFORE, BE IT RESOLVED, that the Council hereby makes the following:
ORDER OF COUNCIL
1. The Council hereby approves the form and substance of the License Agreement, and approves of the
City entering into the License Agreement with various property owners, as recommended by City
staff in accordance with the Program guidelines.
2. The Council hereby authorizes and directs Donna Schmitt, as Mayor, and Walter Fehst, as City
Manager, to execute and deliver each License Agreement on behalf of the City.
The Council hereby authorizes Donna Schmitt, as Mayor, and Walter Fehst, as City Manager, to take such
other action as is necessary on behalf of the City to carry out the purposes of the foregoing resolutions.

RESOLUTION NO. 2018-66
A RESOLUTION OF THE CITY COUNCIL FOR THE CITY OF COLUMBIA HEIGHTS, MINNESOTA,
AMENDING THE 2019 WATER SUPPLY RATES SET BY RESOLUTION 2015 -98.
Whereas, the rates for water, sanitary sewer, storm sewer, refuse, and recycling services, billed on or after
January 1, 2019, by the City of Columbia Heights were established by resolution 2015 -98; and
Whereas, based on current estimates, the rates established by resolution 2015 -98 for water services billed on
or after January 1, 2019, are not sufficient to meet the necessary operating and infrastructure costs of the
City's water utility fund;
Now, therefore, in accordance with the foregoing and with M.S. 103G.29 and with all ordinances and
regulations of the City of Columbia Heights, the City Council of the City of Columbia Heights makes the
following:

BACKGROUND:
In 2017, the City of Columbia Heights partnered with a local consortium of public and private entities in Anoka
County to increase economic growth. The consortium desired to better understand Anoka County's assets as
well as its competitive advantages in an effort to strengthen the economic competitiveness of attracting new
businesses to the area.
Ady Advantage was retained in the later part of 2017 to conduct a market research analysis and evaluation of
business opportunities, targets industries, and strategies to position Anoka County for economic growth. The
report, commonly referred to as the Business Recruitment Roadmap, outlined a strategic plan for targeting
and marketing Anoka County to the rest of the region, as well as an implementation plan for the consortium
to achieve its vision and goals for the county.
As a result of the Business Recruitment Roadmap, Anoka County hired an Economic Development Specialist to
oversee the implementation of the plan itself, but also to be supervised by an Executive Committee comprised
of representatives from Anoka County, Connexus Energy, Metro North Chamber, and four (4) participating
cities or townships. The four cities that currently have representation on the Executive Committee are
Columbia Heights, Coon Rapids, East Bethel, and Lino Lakes.
Attached for consideration are two documents; a Memorandum of Understanding and a Voluntary Cost
Sharing Agreement. These two documents provide the framework for the Anoka County Regional Economic
Development by outlining general objectives; defining mutual responsibilities; setting goals, timelines,
communication and other details necessary to achieve the desired outcomes; and addressing the need for
cost sharing of website services, social media support, marketing assistance, and future services related to the
county -wide economic development initiative.
STAFF RECOMMENDATION:
Staff recommends approving the Memorandum of Understanding and Voluntary Cost Sharing Agreement as
presented.

By and Among
THE COUNTY OF ANOKA, CONNEXUS ENERGY, METRONORTH CHAMBER OF COMMERCE,
AND PARTICIPATING MUNICIPALITIES WITHIN ANOKA COUNTY
This Memorandum of Understanding ( "MOU ") is by, between, and among the County of Anoka, a
political subdivision of the state of Minnesota, (hereinafter "the County "); Connexus Energy, a
Minnesota corporation in Ramsey, Minnesota; MetroNorth Chamber of Commerce, a Minnesota
nonprofit organization; and participating Municipalities located within Anoka County, Minnesota
(See Exhibit A). For purposes of this MOU, the aforementioned are referred to collectively as the
"Hosting Agencies" for the Anoka County economic development initiative.
WHEREAS, a research study was completed by a Consultant, Ady Advantage, in December 2017
( "the Study ") for a market research analysis and evaluation of business opportunities, targets, and
strategies for economic development within Anoka County; and
WHEREAS, as a result of the Study, the Hosting Agencies plan to gather with one another as well as
other community partners to develop a vision, create an action plan, and set realistic goals to
implement shared objectives for economic development and business recruitment within Anoka
County; and
WHEREAS, the Hosting Agencies wish to enter into this MOU to establish organizational structures
and to develop specific goals and objectives for the collaboration;
NOW, THEREFORE, it is agreed as follows:
A. Purpose. The purpose of this MOU is to set a framework for the Hosting Agencies and other
participating entities, to further the goals of the economic development collaboration by:
(a) outlining general objectives, (b) defining mutual responsibilities, and (c) setting goals,
timelines, communication, and other details necessary to achieve the desired outcomes.
B. Term. This Memorandum of Understanding is effective upon execution and will continue in
effect for five (5) years, or until completion and implementation of a Final Action Plan, as
determined by the Executive Committee. The term of this MOU may be renewed for
subsequent five (5) year terms upon written agreement of the parties.
C. Executive Committee. For purposes of this MOU, the Executive Committee for the Anoka
County economic development initiative is comprised of representatives from Anoka
County, Connexus Energy, Metro North Chamber, and up to four participating cities ( "City
members "). City members of the Executive Committee shall have staggered, rotating terms
as addressed below. A Chairperson may be selected by the members of the Executive
Committee to set and conduct meetings and be the primary point of contact between the
Executive Committee and any subcommittees.

The names and contact information for the initial Executive Committee members are listed
in the attached Exhibit B to this Agreement.
1. Executive Committee Members' Terms. Election, and Appointment:
• The members of the Executive Committee shall serve for initial terms of eighteen
(18) and twenty four (24) months, as designated on Exhibit B. Certain Executive
Committee members' terms may be renewed, as appropriate, to fulfill the
objectives set forth in this MOU.
No more than two County representatives may be designated as "voting
members" on the Executive Committee. Other County representatives serving on
the Executive Committee, in excess of two voting members, shall participate as
non - voting members.
The four City members of the Executive Committee shall have staggered, rotating
terms to enable other participating municipalities to serve on the Executive
Committee, as desired. City members may serve a maximum of two (2)
consecutive terms.
As City members' terms expire, the Executive Committee shall survey interest
among all participating cities and elect new City members to the Executive
Committee to fill expired or vacant terms. The Committee's selection of new City
members shall take into consideration such factors as the size of each
municipality, and location, to ensure that the Executive Committee constitutes a
diverse geographic representation of Anoka County.
Election of Executive Committee members shall be accomplished by majority
vote, to take place at a regular meetings of the Committee, or by electronic
means (email) if a vacancy arises. .
2. Executive Committee Meetings:
• The Executive Committee members will hold regular meetings approximately
every other month, with the first meeting to be scheduled in the fall of 2018.
• At least two times per year, the Executive Committee will schedule broad
based meetings and invite a larger group of City officials and staff, community
partners, and other stakeholders, to provide updates and information
regarding the current priorities of the economic development collaboration.
The Executive Committee may also communicate electronically (via email) to
review opportunities and give direction to subcommittees as needed.
3. Executive Committee Goals and Objectives:
• Define a Vision: The Executive Committee is responsible for gathering
information from its subcommittees to form a vision for the business climate
and opportunities within Anoka County. The Executive Committee will then
communicate that vision with all Cities, community partners and identified
stakeholders in the County.

Develop a Strategic Plan. The Executive Committee will engage in strategic
planning, to develop goals, interim activities, and a Final Action Plan, within
applicable time frames as set by the Executive Committee.
Communication. The Executive Committee will ensure that reliable
communication occurs with all subcommittees, and that cities and community
partners are kept informed of the progress and results of the collaboration.
Review and Contracting. The Executive Committee will continually review its
progress and may enter into contracts with outside partners or private
companies, as required to effectively research and /or implement work
developed over the course of this project.
D. Subcommittees. The purpose of subcommittees is to ensure diversification of ideas and
representation across Anoka County in taking on specific tasks related to economic
development.
• The Executive Committee may, at any time during one of its regular meetings,
seek to establish, modify, or eliminate one or more subcommittees, which may
be comprised of County and City officials /staff, community partners, or other
public or private individuals or entities assisting in the economic development
collaboration.
• Subcommittees may also include additional advisory members with expertise
relevant to the work of the subcommittee.
• As of the date of this MOU, three Subcommittees have been formed: (1)
Alignment /Regionalism; (2) Readiness; (3) Marketing and Differentiation.
• Subcommittees should attempt to meet on a monthly basis if possible.
E. Reporting. The following persons /entities should provide written or oral monthly reports to
the Executive Committee:
a. Subcommittee Reports. All subcommittees shall promptly deliver reports to the
Executive Committee on matters which the subcommittee has addressed.
b. Economic Development Specialist. Anoka County will direct its Economic
Development Specialist ( "ED Specialist ") to assist the Executive Committee and
other entities in this collaboration. The ED Specialist will report directly to the
County Administrator regarding day -to -day operations and activities. At the
request of the Executive Committee, the ED Specialist will provide reports to the
Executive Committee as to research outcomes and progress. The ED Specialist
may also be asked to present findings at the broader, semi - annual meetings
attended by cities, community partners, and other stakeholders.
Financial Contributions.
a. Economic Development Specialist. The County is subsidizing and monitoring the
activities of the Economic Development Specialist, described herein, to provide direct
project assistance and research in connection with this collaboration.
b. Budget and Cost Sharing. If the Executive Committee seeks continued services for
website and social media support, marketing assistance, or other outside services,

the cost allocation among cities and financial responsibilities will require execution of
separate agreements. On or around August of each calendar year, a proposed
budget for the following year will be voted on by the Executive Committee at a
regular meeting, and distributed to the members. An agreement for voluntary cost
sharing among participating municipalities will also be distributed, with the first
agreement effective for year 2019. Negotiation, execution, and administration of any
such cost sharing agreement must comply with applicable statutes and regulations.
Nothing in this MOU shall obligate the agencies or partners to obligate or transfer
any funds absent a separate agreement authorizing such contributions.
G. Modification: Material alternations, modifications, or variations of the terms of this MOU
must be reduced to writing as an amendment and signed by the parties. Election or
appointment of members to the Executive Committee, the formation of subcommittees, and
updates to Exhibits A and B to this MOU do not require formal amendment of this MOU.
H. Authorized Representatives. By signing this MOU, the undersigned certifies that he /she is
authorized to act and carry out the terms of this MOU.

VOLUNTARY COST SHARING AGREEMENT
FOR ANOKA COUNTY ECONOMIC DEVELOPMENT
THIS AGREEMENT is made between the County of Anoka, a political subdivision of the State
of Minnesota ( "County "), and the undersigned participating municipality ( "City "), a municipal
corporation organized under the laws of the State of Minnesota.
WITNESSETH
WHEREAS, the County and the City, along with other community partners, entered into
a Memorandum of Agreement ( "MOU ") on , 2018, to set goals, create an
action plan, and implement shared objectives in promoting economic development within Anoka
County;
WHEREAS, the MOU addresses the need for cost sharing between the County and
municipalities of Anoka County to support continued services for website services, social media
support, marketing assistance, and future services related to the county -wide economic
development initiative;
WHEREAS, an annual budget for the above activities was developed, including a
formula for participating municipalities to provide proportional cost sharing based upon its
population;
NOW, THEREFORE, the parties understand and mutually agree as follows:
The budget for services related to website services, social media, marketing, and
other supportive activities required for economic development, is currently set at
$20,000.00 for calendar year 2019.
2. For 2019, the City agrees to contribute the sum of $0.057 per individual resident
within its city limits, as a voluntary contribution to the economic development
costs described above.
The City shall provide such payment annually, by the end of the first quarter in
each calendar year, beginning in 2019.
4. Each calendar year, the County will provide an annual budget and proposed
formula for the City's use in calculating its contributions under this Agreement.
The City may opt out or cancel this Agreement by providing 30 days' written
notice to the County Administrator: Jerry Soma, 2100 Third Avenue, Ste. 700,
Anoka, MN 55303.
6. This agreement shall terminate concurrently with the MOU, unless a City chooses
to opt out or cancel this agreement prior to its expiration, as provided above.

BACKGROUND:
Consistent with Minnesota Statutes and City Code, the City Council annually adopts a resolution prior to the
Special Assessment Public Hearing regarding costs to be borne by the City for public improvement projects.
The resolution establishes the amount of the City share and the amount of the special assessments for
projects to be levied against benefiting properties in the City of Columbia Heights. The purpose of the
resolution is to advise the general public of costs to be incurred by the City versus costs to be incurred by
benefiting property owners.
STAFF RECOMMENDATION:
Adoption of the resolution is done annually and staff considers this a routine matter in order to comply with
State Statutes and the City Code. Staff recommends adoption of the attached resolution.
City Project 1701: 2018 Street Seal Coat, includes select local streets in Zone 2,
Bounded by Reservoir Boulevard, 45th Avenue, Stinson Boulevard, and 37th Avenue
City Project 1705: 2017 State Aid Street Rehabilitation includes the following street:
39th Avenue, Jefferson Street /Huset Parkway to Central Avenue
City Project 1805: 2018 State Aid Street Rehabilitation includes the following streets:
Main Street, 37th Avenue to 40th Avenue
37th Avenue, Main Street to 5th Street
RECOMMENDED MOTION(S):
Move to waive the reading of Resolution 2018 -75, there being ample copies available for the public.
Move to adopt Resolution 2018 -75 being a resolution establishing amount of City share and amount of special
assessments on projects to be levied.

A resolution of the City Council for the City of Columbia Heights, Minnesota,
WHEREAS, the City Council of the City of Columbia Heights by motion on the 27th day of August, 2018,
ordered a special assessment hearing to levy the cost of improvements and;
WHEREAS, the following projects will be specially assessed in October, 2018, and a portion of the costs
may be borne by the City,
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of

BACKGROUND:
Staff is recommending a Zoning Text Amendment, to remove the fee schedule chart currently displayed in City
Code, Section 9.104 (c) (5). The Community Development Department oversees the land use planning and
zoning functions of the City. There are a number of land use applications that a property owner can file with
the City. All land use applications have various application fees which are established by a resolution of the
City Council. Periodically, the fees are evaluated and adjusted based on comparable area rates as well as staff
time used for processing and evaluating land use requests.
Currently, the way the Zoning Code is set up, when a fee is changed by the City Council, staff must bring an
ordinance to the Planning Commission and then to the City Council for approval, as this action is technically
amending the literal language (the fee chart) in the code. Alternatively, staff has added language to the code
referencing that the Community Development Department will keep a record of the current fees. Removing
this chart will ultimately save staff time going forward, and lessens the likelihood that outdated fees are left in
the Zoning Code. In addition, it will save money on publication fees associated with ordinance changes.
STAFF RECOMMENDATION:
The City Council unanimously approved Ordinance No. 1651 on first consideration at the regular meeting held
on September 10th, 2018. This is the second reading of Ordinance No. 1651. Staff recommends approval of
Ordinance No. 1651, and the summary of Ordinance No. 1651 as presented.

BEING AN ORDINANCE AMENDING CITY CODE OF 2005 RELATING TO ZONING AND LAND
DEVELOPMENT, AND REMOVING THE PLANNING AND ZONING FEE SCHEDULE FROM THE

NOW, THEREFORE, BE IT RESOLVED The City Council (Council) of the City of Columbia Heights,
Minnesota (City) does ordain:
SECTION 1:
§9.104 (c) (5), City Code of 2005, as it currently reads is amended as follows:
(5) Application fees. Fees for all applications for development or land use approval shall be a
flat rate and established by resolution of the City Council. The city retains the right to require
an escrow and additional payment for any out -of- pocket expenses for consultants and
professional services and /or to obtain an escrow for cases that are extraordinary in size or
complexity. Remaining escrowed funds not spent in reviewing the application shall be returned
to the applicant. Payment of all fees is a condition of application approval. The FCC

SUMMARY OF ORDINANCE NO. 1651
BEING AN ORDINANCE AMENDING CITY CODE OF 2005 RELATING TO ZONING AND LAND
DEVELOPMENT, AND REMOVING THE PLANNING AND ZONING FEE SCHEDULE FROM THE
ZONING CODE.
The City Council for the City of Columbia Heights, Minnesota has adopted Ordinance No. 1651.
The purpose of this Ordinance is to remove an outdated fee chart from the Zoning Code. Fees
associated with various land use applications will now be kept on file in the Community
Development Department.
This is a summary of Ordinance No. 1651. A printed copy of the entire text of the Ordinance is
available for inspection by any person during regular office hours at the office of the City
Planner, or by standard or electronic mail.
Ordinance No. 1651 was adopted by the City Council of Columbia Heights on September 24,
2018.

BACKGROUND:
The City of Columbia Heights (the "City ") licenses establishments to sell tobacco, tobacco products, or tobacco
related devices. if a licensed tobacco establishment desires to allow customers or potential customers to
sample a portion of their tobacco product on -site, then pursuant to the Minnesota Clean Indoor Air Act and
City Code they may apply for an additional Smoke Shop License through the City.
However, in an effort to regulate and control the amount of licensed tobacco establishments that have on -site
sampling, the City only allows four (4) Smoke Shop Licenses to be issued in a given year with the existing
establishments receiving first preference for license renewal. A license holder may voluntarily surrender a
Smoke Shop License, and in such a case, the City Council has previously elected to reduce the amount of
licenses available within the City.
On July 24, 2018, Foaud's, Inc., a Minnesota corporation doing business as Yafa Hookah Bar voluntarily
surrendered their Smoke Shop License for the property located at 4110 Central Avenue NE, unit 210B,
Columbia Heights, MN. If the City Council desires to reduce the available Smoke Shop Licenses in 2019 from
four (4) to three (3), an ordinance shall need to be adopted changing City Code accordingly.
STAFF RECOMMENDATION:
Staff recommends approving the first reading of Ordinance No. 1652 as presented and to setting up the
second reading of Ordinance No. 1652 for adoption on October 8, 2018.

BEING AN ORDINANCE AMENDING ORDINANCE NO. 1616, CITY CODE OF 2014, RELATING TO THE USE OF

The City of Columbia Heights, Minnesota does ordain:
Chapter 5, Article III, Section 5.303, Subsection (B), which currently reads as follows, to wit:
§ 5.303 LICENSE.
(B) No person shall operate a smoke shop without first having obtained a smoke shop license to do so
from the city. At any given time, there shall be no more than four smoke shops, all with appropriate
licenses, throughout the city. Currently existing smoke shop establishments should be granted the first
preference to renew their smoke shop license if they choose to do so.
Is hereby amended to read as follows:

Whereas, the owner of record is the legal owner of the real property located at 950 40th Avenue
N.E. Columbia Heights, Minnesota.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of

FINDINGS OF FACT
1. That on August 14, 2018 the City of Columbia Heights responded to a complaint at the
address listed above. Inspection determined that the structure was damaged and
unsecured.
2. That on August 14, 2018 the Fire Chief had his designee order Advanced Companies secure
the structure.
3. That based upon said records of the Fire Department, the following conditions and
violations of City Codes(s) were found to exist and have been abated, to wit:
A. Approve the emergency abatement of the hazardous situation located at 95040th
Avenue N.E.
CONCLUSIONS OF COUNCIL
1. That the property located at 950 40th Avenue N.E. is in violation of the provisions of the
Columbia Heights City Code as set forth in the Notice of Abatement.
2. That the emergency abatement of the hazardous situation located at 95040th Avenue N.E.
is hereby approved.

Chapter 5A, Article IV, Section 5A.408(A) of that certain property rental license held by James Banwell
(Hereinafter "License Holder ").
Whereas, license holder is the legal owner of the real property located at 1114 401h Avenue N.E. Columbia
Heights, Minnesota,
Whereas, pursuant to City Code, Chapter 5A, Article IV, Section 5A.408(B), written notice setting forth the
causes and reasons for the proposed Council action contained herein was given to the License Holder on
August 24, 2018 of a public hearing to be held on September 24, 2018.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of Columbia
Heights, the City Council of the City of Columbia Heights makes the following:
FINDINGS OF FACT
1. That on May 29, 2018, inspectors for the City of Columbia Heights, inspected the property described
above and noted violations. A compliance letter listing the violations was mailed by regular mail to the
owner at the address listed on the Rental Housing License Application.
2. That on July 10, 2018, inspectors for the City of Columbia Heights performed a re- inspection and noted
that violations remained uncorrected. A statement of cause was mailed via regular mail to the owner
at the address listed on the rental housing license application.
3. That on August 9, 2018, inspectors for the City of Columbia Heights checked records for this property
and noted that the violations remained uncorrected
4. That based upon said records of the Enforcement Office, the following conditions and violations of the
City's Property Maintenance Code were found to exist, to -wit:
a. Shall repair /replace rotting windows /trim.
b. Shall pay $100 re- inspection fee.
5. That all parties, including the License Holder and any occupants or tenants, have been given the
appropriate notice of this hearing according to the provisions of the City Code, Chapter 5A, Article III
5A.306 and 5A.303(A).
ORDER OF COUNCIL
1. The rental license belonging to the License Holder described herein and identified by license number
F17249 is hereby revoked.
2. The City will post for the purpose of preventing occupancy a copy of this order on the buildings
covered by the license held by License Holder.
3. All tenants shall remove themselves from the premises within 45 days from the first day of posting of
this Order revoking the license as held by License Holder.

BACKGROUND: As required under the city charter, the city manager provided the city council with a proposed 2019
budget and tax levy at a council meeting in August. That document explains the proposed 2019 budget and tax levy with
143 pages of summary and detail information, including comparisons to both the current year budget and to two prior
years of actual expenses. This document is available on the city website.
The city council must adopt a proposed budget and tax levy resolution by September 30th to begin the state- mandated
Truth -in- Taxation process. The city council must also adopt a final version at a budget hearing in December. The final tax
levy can be less than, but not greater than, the proposed levy. This allows counties to mail each taxpayer a notice in
November stating the proposed tax on each property. The taxpayer thereby has time to consider their proposed tax
before the budget hearing in December. In addition to this state - mandated process, the city council holds work sessions
from September to December of each year to analyze the proposed budget in detail.
One important piece of information, that was not available when the proposed 2019 budget was compiled, is the
amount of the 2019 Area -Wide Fiscal Disparities Subsidy. Available data now shows this subsidy of $3.1 million will
decrease by $16,000 or 0.5% for 2019. The fact that property values in Columbia Heights increased by more than the
metro average for both 2018 and 2019 was the primary reason this subsidy will not increase for 2019.
The attached resolution increases the 2019 City gross tax levy by $623,000 or 5.5% over 2018. The gross tax levy
includes both the amount paid by local taxpayers and the Area -Wide Fiscal Disparities Subsidy. With no increase to the
subsidy share for 2019, the effective increase in the local taxpayers' share for 2019 will be 7.8 %.
STAFF RECOMMENDATION: The city manager recommends approval of the proposed 2019 budget and levy.
RECOMMENDED MOTION(S): Move to waive the reading of Resolution 2018 -50, there being ample copies available to
the public.
Move to adopt Resolution 2018 -50, being a resolution adopting a proposed budget for the year 2019, setting the
proposed city levy, approving the HRA levy, approving a tax rate increase, and establishing a budget hearing date for
property taxes payable in 2019 of December 10, 2018, at approximately 7:00 p.m. in the city council chambers.

ADOPTING A PROPOSED BUDGET FOR THE YEAR 2019, SETTING THE PROPOSED CITY LEVY, APPROVING THE HRA LEVY,
APPROVING A TAX RATE INCREASE, AND ESTABLISHING A BUDGET HEARING DATE FOR PROPERTY TAXES PAYABLE IN 2019.
Now, in accordance with all ordinances and regulations of the City of Columbia Heights, the City Council of the City of Columbia
Heights makes the following:

Section C. The City Council of the City of Columbia Heights hereby approves the Housing and Redevelopment Authority Tax Levy
for the fiscal year 2019 in the amount of $ 247,000
BE IT FURTHER RESOLVED: That the public budget hearing is scheduled for December 10, 2018 at approximately 7:00 p.m. in the
City Council Chambers.
BE IT FURTHER RESOLVED: That the County Auditor is authorized to fix a property tax rate for taxes payable in the year 2019 that
is higher than the tax rate calculated for the City for taxes levied in 2017 collectable in 2018.
BE IT FURTHER RESOLVED: That the City has adequate fund balances and reserves to pay bond principal and interest payments on
General Obligation Bond Series 2009A in the amount of $25,000 and that the County Auditor is authorized to cancel $25,000 of
the related Bond Levy for taxes payable in 2019, leaving a balance of $205,329 to be levied for taxes payable in 2019 for Series
2009A.
BE IT FURTHER RESOLVED: That the City has adequate fund balances and reserves to pay bond principal and interest payments on
General Obligation Bond Series 2015A in the amount of $275,000 and that the County Auditor is authorized to cancel $275,000 of
the related Bond Levy for taxes payable in 2019, leaving a balance of $206,254 to be levied for taxes payable in 2019 for Series
2015A.
BE IT FURTHER RESOLVED: That the City has adequate fund balances and reserves to pay bond principal and interest payments on
General Obligation Bond Series 2017A in the amount of $335,344 and that the County Auditor is authorized to cancel $335,344 of
the related Bond Levy for taxes payable in 2019, leaving a balance of $0 to be levied for taxes payable in 2019 for Series 2017A.
BE IT FURTHER RESOLVED: That the City has adequate fund balances and reserves to pay bond principal and interest payments on
General Obligation Bond Series 2017B in the amount of $295,000 and that the County Auditor is authorized to cancel $295,000 of
the related Bond Levy for taxes payable in 2019, leaving a balance of $268,446 to be levied for taxes payable in 2019 for Series
2017B.
The Finance Director /Treasurer is hereby instructed to transmit a certified copy of this resolution to the County Auditor of Anoka
County, Minnesota.
