Columbia Heights Police Department r tff71'' February 28, 2018 Donna Schmitt, Mayor Columbia Heights City Council Re: Upcoming Revocation Hearing for 4625 and 4633 Tyler Street Dear Mayor and Members of the Columbia Heights City Council: Ll P � A: y���'M91R KE ►� Enclosed you will find a copy of the power point presentation that the CHPD has prepared for the upcoming Council Work Session on March 5h and the Public Hearing regarding these properties at the Council Meeting on March 12th. You will also find copies of several police reports documenting some of the more serious incidents for you to reference and review. Mr. Schumacher has owned these properties since mid -year 2008. He has operated these properties in a way that has adversely affected the safety, and welfare of the residents of these properties as well as the rest of the neighborhood and areas nearby. These two properties account for a disproportionate number of police calls to the property and he has failed to comply with the crime free /drug free section of the property maintenance code. Mr. Schumacher has been notified of a Public Hearing at the Columbia Heights City Council Meeting scheduled to be held on March 12, 2018. Because of the criminal and nuisance activity that has occurred, and the disproportionate number of calls that have occurred on the property, the CHPD will be recommending to the Council that Mr. Schumacher's licenses for both 4625 and 4633 Tyler Street be revoked. It should be noted that if the Council chooses to revoke both of these licenses, Mr. Schumacher shall be ineligible to hold or have an interest in an occupancy license for a period of five years. I will be prepared to answer any questions you may have at the upcoming Council Work Session. (A) A license issued or renewed under this section may be revoked or suspended upon a finding of noncompliance with the provisions of this chapter. Reinstatement of a suspended or revoked license shall be accompanied by a fee in an amount set by Council Resolution. Issuance of a new license after suspension or revocation shall be made in the manner provided for obtaining an initial license. (B) The Council may, for cause, revoke or suspend a license, or take other action restricting the privileges of a license subject to the following requirements: (1) The city, through its Property Maintenance Enforcement Officer, provides the licensee with a written statement or reasons or causes for the proposed Council action together with a notice for public hearing. (2) The Council shall conduct a public hearing on the proposed action and provide findings of fact and citations to any ordinances or regulations that have been violated, together with a statement of action taken and the conditions of any resulting revocation, suspension, or other action restricting the privileges of the licensee. (3) The Property Maintenance Enforcement Officer shall forward the findings and statement of action taken to the person in whose name said license was issued by mailing the same to the mailing address indicated on the license application. (C) A violation of any provision of this chapter or of state law, prescribing standards of conduct or regulations governing a licensee; the particular type of business or commercial activity or trade or occupation that is licensed; or the premises where the licensed activity is conducted; shall be a prima facie showing of cause for revocation, suspension, or other action restricting the privileges of a licensee as the Council may determine. (D) Nondisclosure, misrepresentation or misstatement of a material fact in any application for a license under this chapter shall be a prima facie showing of cause for revocation, suspension, or other such action restricting the privileges of a licensee as the Council may determine. (E) Any person or owner who has had an interest in two or more licenses revoked pursuant to this code shall be ineligible to hold or have an interest in an occupancy license for a period of five years. License fees, license transfer fees, license reinstatement fees, inspection fees and reinspection fees shall be established by Council Resolution. (Ord. 1532, passed 11- 26 -07) F) § 5A.410 CONDUCT ON LICENSED PREMISES /CRIME FREE/DRUG FREE AND DISORDERLY USE LEASE REQUIREMENTS. (A) All residential tenant leases, except for state licensed residential facilities and subject to all preemptory state and federal laws, shall contain the following, or substantially comparable to, crime free /drug free and disorderly use language: (1) Crime free /drug free. (a) Resident, any members of the resident's household or a guest or other person affiliated with resident shall not engage in criminal activity, including drug- related criminal activity, on or near the premises. (b) Resident, any member of the resident's household or a guest or other person affiliated with resident shall not engage in any act intended to facilitate criminal activity, including drug - related criminal activity, on or near the premises. (c) Resident or members of the household will not permit the dwelling unit to be used for, or to facilitate criminal activity, including drug- related criminal activity, regardless of whether the individual engaging in such activity is a member of the household, or a guest. (d) Resident, any member of the resident's household or a guest, or other person affiliated with the resident shall not engage in the unlawful manufacturing, selling, using, storing, keeping, or giving of a controlled substance at any locations, whether on or near the premises or otherwise. (e) Violation of any one of the above provisions shall be a material and irreparable violation of the lease and ,good cause for immediate termination of tenancy. (2) Disorderly use. (a) Resident, members of the resident's household, guests, or other persons under the resident's control shall not engage in the following disorderly use activities: violations of state law relating to alcoholic beverages, trespassing or disorderly conduct, and violations of the city code relating to prohibited noise. (b) Three disorderly use violations involving the same tenancy within a continuous 12- month period shall be a substantial and material violation of the lease and good cause for termination of the tenancy. (3) Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning. CRIMINAL ACTIVITY. Prostitution, gambling, maintaining or conducting a disorderly house, unlawful possession, transportation, sale or use of a weapon, domestic assault, delinquency of a minor, criminal street gang activity, threatening, intimidating or assaultive behavior, the unlawful discharge of firearms, or any other criminal activity on or near the premises that jeopardizes the health, safety and welfare of the landlord, his agent, other resident, neighbor or other third party, or involving imminent or actual serious property damage. DRUG RELATED CRIMINAL ACTIVITY. The illegal manufacture, sale, distribution, use or possession with intent to manufacture, sell, distribute, or use of a controlled substance or any substance represented to be drugs (as defined in § 102 of the Controlled Substance Act [21 U.S.C. 802]). (4) Non- exclusive remedies. (a) The crime free /drug free and disorderly use provisions are in addition to all other terms of the lease and do not limit or replace any other provisions. (B) These lease provisions shall be incorporated into every new lease for a tenancy beginning January 1, 2008 and all renewed leases by January 1, 2009. (C) Upon determination by the Police Department that a licensed premises or unit within a licensed premises was used in violation of the crime free /drug free provisions of subdivision (A)(1) herein, the Police Department shall cause notice to be made to the owner and property manager of the violation. The owner or property manager shall notify, the tenant or tenants within ten days of the notice of violation of the crime free /drug free lease language and proceed with termination of the tenancy of all tenants occupying the unit. The owner shall not enter into a new lease for a unit located in any licensed property within the city with an evicted tenant for a period of one year after the eviction. (D) Upon determination by the Police Department that a licensed premises or unit within a licensed premises was used for disorderly use activities as set forth in subdivision (A)(2) herein, the Police Department shall cause notice to be made to the owner and property manager of the violation and direct the owner and property manager to take steps to prevent further disorderly use violations. (E) If a second disorderly use violation as determined by the Police Department occurs within a continuous 12 -month period involving the same tenancy, the Police Department shall cause notice to be made to the owner and property manager of the second violation. The owner or property manager shall respond in writing within ten days of receipt of the notice with an action plan to prevent further disorderly use violations. (F) if a third disorderly use violation as determined by the Police Department occurs within a continuous 12 -month period involving the same tenancy, the Police Department shall cause notice to be made to the owner and property manager of the third violation. The owner or property manager shall notify the tenant or tenants within ten days of the notice of disorderly use violation of the crime freeldrug free lease language within the lease and proceed with termination of the tenancy of all tenants occupying the unit. The owner shall not enter into a new lease for a unit located in any licensed property with an evicted tenant within the city for a period of one year after the eviction. (G) The provisions of divisions (C), (D), (E) and (F) herein do not apply if the determination that the premises have been used in violation of the crime free /drug free provisions of subdivisions (A)(1) and (A)(2) herein originates from a call from or at the request of one or more tenants occupying the premises for police or emergency assistance, or in the case of domestic abuse, from a call for assistance from any source. The term DOMESTIC ABUSE has the meaning given in M.S. § 518B.01, subd. 2. (H) If the licensee fails to comply with the requirements of this section, the rental dwelling license for the premises may be denied, revoked, suspended, or not renewed. All action to deny, revoke, suspend, or not renew a license under this section shall be initiated by the City Council at the request of the Police Department in the manner described in § 5A.408. TYPE SIMMONS, ASHLEY ROSE 5/12/1990 F VICTIM JAMES, TRACEY LASHAUN 1/6/1965 M MENTIONED F SUSPECT REPORTING OFFICER(S): HILDEN, JACOB T HPD00018 CASE SUMMARY: Dispatched to the area for a vehicle that was on fire. Arrived and located small flames coming from out of the gas cap area. CHFD diminished flames and advised that it was arson. Narratives Original Officer Narrative On 01 -07 -16 at 0219 hours, I was dispatched to the 4600 block of Tyler St NE for a vehicle fire. Dispatch notes updated that it was small flames coming out of the gas can. I arrived and observed a small flame coming out of the gas cap area of MN 326 -HZL. CHFD arrived and quickly extinguished the fire. I was advised right away by CHFD Captain Field that it was arson. I observed a long metal rod coming out of the gas tank/cap area with some sort of cloth shoved in it. There were fresh footprints in the snow also right next to the area. I photographed the footprints. They came out of 4619 Tyler St NE and left northbound on Tyler St. I lost the tracks going up the stairs towards 4625 Tyler St NE. I could not find where they came from inside of 4619 Tyler St. I also photographed the metal coat hanger and cloth inside the gas cap. I later uploaded all photos as evidence at the CHPD. I spoke with a male, Tracy James, who claimed that it was his vehicle. It was actually registered to his fiance Ashley Simmons. Tracy was unable to get a hold of Ashley after trying numerous times. Tracy said that there was a female staying with him off and on and he thinks she did it. I took a recorded statement from Tracy and he said that a female by the name of "Poo" was staying off and on at his place. Poo, later identified as P M, is Ashely's god sister. Tracy told P on Monday that she needed to "move on," meaning that she needed to find a new place. Tracy said that she got upset and said "you mother fucker, I'm going to get your truck." She also told Tracy that she was going to get people to jump him. Tracy hasn't seen P since Monday. Tracy said that P doesn't know anyone inside 4619 Tyler St that he knows of. Tracy doesn't know anyone in that building that he thinks would do this. Capt. Field collected the evidence and handed it over to me. Follow -up Investigation There have not been any leads in this case and P M denied having anything to do with when she was questioned about it by Sgt. Pletcher. I am considering this case inactive until more evidence or information is obtained. The male victim was transported to the hospital with unknown injuries. The female suspect was later located. She was arrested, booked and released from jail on multiple charges. Three children involved were placed into emergency foster care. As I turned left onto 60th Avenue, I observed Tracey behind my squad car, driving an SUVS and pulling into the driveway /parking lot for 5974 3rd Street. I drove around the block and drove by the address again. I observed two females standing by the driver's side door (which was open) and talking with Tracey who was sitting in the driver's seat. I recognized one of the females as Ashley. I observed that the kids were not by the vehicle and were playing to the east of them, in the parking lot. I stopped my squad car in the driveway /parking lot, activated my emergency lights, and got out of my squad car. As I was getting out of my squad car, I yelled for Ashley to come talk to me and she said she wasn't apart of anything and ran into the apartment building. I continued to yell for Ashley and I followed her into the apartment building, walked down the steps, and stood in front of apartment number 2. I requested a Fridley squad to assist and Sgt. Mork arrived moments later. The door to the apartment was open and that was where Ashley's mom lives. I called for Ashley and she did not come out. As we approached from the street, I could see about 25 -30 people in the courtyard, and most began briskly walking away in different directions. I encountered Tracy James and other males returning to 4625 Tyler St NE 47. James was loud and vulgar about police being present. As I began to engage James verbally, I heard people yelling about somebody having been stabbed. I found Lamar Hutton standing shirtless and leaning on a garbage can in the alley. Another male, Melvin Nunn, was using a t -shirt to hold pressure on a wound to the left side of Hutton's abdomen. Nunn briefly removed the shirt and I could see an approximately 1.5" long puncture wound that had some type of flesh or organ protruding from inside. Nunn continued to provide direct pressure while Allina paramedics responded. Hutton stated that he was not sure who had stabbed him, and stated he did not realize he had been stabbed until someone pointed it out to him. Nunn stated that he had not seen the incident but heard Hutton involved in a fight with another male. Most individuals in the area were not forthcoming with information. One female, Ashley Simmons, did point out a male to me and stated that she had witnessed that male stab Hutton while the two were fighting. An open, bloody folding knife was located near Williams, and he was found to have blood stains on his shirt and shorts. The knife, shirt, and shorts were later collected by other officers as evidence. Hutton stated that he had been involved in a physical altercation with Williams, but initially adamantly stated that Williams had not been the one who stabbed him. Paramedics arrived and dressed Hutton's would before transport. I did not have an opportunity to obtain a photograph of the wound before it was dressed, but it should be visible on body camera video. I spoke with Hutton briefly in the ambulance before he was transported, and he now stated that he believed Williams had stabbed him during their fight because two other people told him they witnessed him do it. Hutton was transported to Hospital for treatment. I responded as well, and learned that Hutton would be receiving a CT scan and then would be taken for surgery. After Hutton's CT scan, it was apparent that Hutton had been given some type of sedative medication, as he was barely able to speak or open his eyes. In an audio - recorded statement, Hutton did tell me that he had become involved in the fight with Williams, and that three SUVs of males then arrived to help Williams in the fight. Hutton was not clear about how the fight had started, and also told me that he would be able to provide a better statement after his drugs wore off. Hutton signed a medical records release waiver before he appeared to be under the influence of the medications. I learned that other officers had spoken to witnesses and had arrested Williams for 2nd Degree Assault. See supplements for details. Darnell and his brother then ran around his parked vehicle to get away from him. X said that someone then yelled police, so the male ran back inside with his gun. X believed that Darnell or his brother would have been shot if police did not arrive when they did - X was too afraid to give the name of the person with the gun The entire taped statement was uploaded into evidence. Officers took statements from all witnesses and Officer Ibrahim Farah took a statement from Darnell before transporting him to ACSO Jail on 2nd Degree Assault Charges. During this incident, Tracey James and Ashley Simmons were in the courtyard swearing and yelling at police. They were also yelling for people to stop talking to the police. I advised both Tracey and Ashley multiple times to stop talking or they would be arrested. After continuing to swear at police officers for several more minutes, Tracey went into his apartment, 4625 Tyler St NE #7, and Ashley stayed outside but stopped interfering. Several people in the area stated that a bald black male, matching Tracey's physical, pulled out a black handgun on Darnell and his brother just prior to police arriving, but the witnesses refused to confirm if it was Tracey. Previous reports state that Tracey does own a handgun even though he is a convicted felon. I was familiar with Simmons and am aware of a Domestic Abuse No Contact Order in which James is the protected person and Simmons is the Respondent. Believing that a confrontation would occur when arresting Simmons, Sgt Museus and I decided to have the order confirmed prior to enforcing it. I then removed Damone from the vehicle who was sitting in the back. As I began to pat him down for weapons, I felt on the left side of his jacket a plastic baggie. I asked Damone what was it and he stated he didn't know. He said that the jacket wasn't his. I removed the plastic bag from Damone's jacket. The plastic bag was wrapped around and could right away smell strong odor marijuana. Inside the bag, there were small individually packaged baggies of marijuana which totaled 18 baggies. I asked Damon where he got the marijuana but Damone continued to insist that the jacket he had on wasn't his. He said that he quickly grabbed the jacket from his apartment. Damone's stated that he was staying at 4625 Tyler St. 97. which 1 recognized to be Tracey James' apartment. 1 handcuffed Damone and put him into my squad car. I followed the vehicle and stopped it in the 1000 block of 47th Ave. I made contact with the driver, who I identified as Anthony Jr. Jefferson. I explained to Jefferson my reason for stopping him. I observed the bag contained a white substance that I recognized from training and experience to be suspected crack cocaine. Officer Wood arrived at my stop to assist me. I told Jefferson to step out of the vehicle. Jefferson started the vehicle and attempt to put it gear. I reached in the vehicle and grabbed the gear and told Jefferson to turn off the vehicle. Jefferson ultimately listen and turn off the vehicle. I removed Jefferson from the vehicle and placed him into custody. Sgt. Pletcher and Officer Monberg arrived to assist us. I conducted a field test on the substance from the baggy and it came back positive for crack cocaine. Jefferson was unable to provide me with insurance for the vehicle he was operating. A check of Minnesota Driver and Vehicle Services records revealed that Jefferson has a Revoked Driver's License. Officer Wood completed a booking sheet for Jefferson. She also completed a tow sheet for the vehicle and it was towed to JBS impound lot. I later weighed the substance with baggy at the Columbia Heights Police Station and it weighted 7.4 grams. Shaheim stated that after he was done hanging with Anthony at the bar he was getting dropped off back to his apartment. This was recorded on officers' taxer body cameras. Narratives ORIGINAL OFFICER NARRATIVE On Tuesday, February 7, 2017 at approximately 0135 hours, Officer Scheevel, Huebner and I were dispatched to 4633 Tyler Street NE unit #3 on a report of a domestic. Dispatch stated male kicked in the rear door to the home. Dispatch remarks stated caller wanted to cancel police. I advised dispatch officers would still continue. Upon arrival, I made contact with the reporting person/ victim identified as Rose Walker ( DOB 05/16/84). Rose stated her ex- boyfriend had kicked in the rear door to the residence and was trying to get in. I could see the door was still secured but the bottom hinges came off. There was also a small dent on the door. The door was located on the north -side of the home near the kitchen area. Rose identified her ex- boyfriend to be Lamar Hutton ( DOB 04/04/79). Rose stated she had been in a relationship with Lamar for approximately 7 years. She stated they have two children together. Rose stated Lamar use to stay at the apartment but has not seen him since November. Rose and Lamar are currently separated. I asked Rose if Lamar was invited to be here tonight and she said no, he was not. Rose said she did not want to press any charges and wanted me to leave. Rose became uncooperative and was not forthcoming with information. Rose also declined to give me an audio recorded statement. She also refused me to take pictures of the damages. I asked Rose if she wanted her case number and she said no. Officer Huebner advised me that Lamar likes to hang out in 4634 Tyler St NE apartment #204. Officer Huebner and Scheevel located Lamar a short time later in that apartment. I could hear the two arguing from the end of the block. I drove down and met with the two who were both uncooperative. I identified the male as Lamar Hutton, who was visiting. Narratives ORIGINAL OFFICER NARRATIVE On May 29, 2017, at 1754hrs, I, Officer Monberg, was dispatched to 4634 Tyler St NE #204 for a caller reporting a known male, Lamar Hutton, had forced his way into her apartment. Dispatch could hear Hutton yelling in the background, and then advised that Hutton had told the caller he was going to his home across the street to retrieve his gun. Officers arrived and located Hutton outside his home at 4633 Tyler St NE 43. Hutton was verbally belligerent, vulgar, and uncooperative. After several attempts to discuss the incident and what Hutton's role may have been, he continued with his loud and vulgar outburst. Sgt Pletcher and I detained Hutton in handcuffs and he refused to sit on a concrete step, so we escorted him to my squad. I conducted a pat down search for weapons before detaining Hutton in the squad. I remained with Hutton while Officer Farah and Sgt Pletcher met with the caller, Joni Kanowitz. While in the squad, Hutton continued to yell and swear about not having done anything wrong and beating charges in the past. Sgt Pletcher advised that after speaking with Kanowitz, Hutton should be booked for Interfere with 911 Call and 5th Degree Assault. After calming down for a short time, Hutton became very belligerent and abrasive once again. After being unable to advise him of his rights, I ended the statement. While en route to jail, Hutton made several utterances that seemed to be related to this incident. He stated that Joni is a crackhead and that she owed him $20. He also made a comment that he had been in her apartment, but that he encouraged her to call 911 and did not interfere with the call. Once arriving at the jail, I conducted a full custodial search of Hutton. Inside the watch pocket of his jeans, I located a folded -up bus transfer pass. Upon opening the pass, I found that it contained a white powdery substance that appeared to be cocaine. A detention deputy also found that a $100 bill in Hutton's pocket was obviously counterfeit. I retained the suspected narcotics and the counterfeit bill and returned to the CHPD office. The counterfeit bill has pink printed foreign writing on the front that would not likely be accepted by any person or business as legitimate. It did not appear that probable cause exists that Hutton intended to defraud with the bill. The powdery substance did not test positive for cocaine or methamphetamine. There is a recent CHPD report (ICR 17098059) in which Hutton was accused of selling drywall crumbles as crack cocaine. Sgt Pletcher directed me to have the substance tested; a lab request form is attached to this report. I did not weigh the small amount of powder to avoid losing any. Monberg# 117 Monberg, William HPD00024 FOLLOW -UP INVESTIGATION On May 29th, 2017 at approximately 1755 hours, Officer Monberg and 1, Sgt Pletcher, were dispatched to 4634 Tyler St NE 4204 on a report of a named Lamar Hutton barging into the caller's apartment and threatening her. Officers are aware of Lamar from several previous contacts and know he lives at 4633 Tyler St NE #3. Officers arrived and went to Lamar's apartment, after we were updated that he left the caller's apartment. I made contact with woman inside the apartment who initially tried to lie to police by saying Lamar wasn't inside that that he may be in back. I advised the female that I needed to talk to him because he apparently just told a neighbor that he was going to get a gun, at which point Lamar came yelling from the back denying any knowledge of a gun. Lamar came outside and was immediately aggressive and belligerent towards me. Lamar was screaming at me, calling me a liar and other names, and when I attempted to ask him about what occurred, he just continued to yell, stating that he was in the apartment when Joni called the police and she didn't say he had a gun and that she owed him money. Lamar was clearly intoxicated but he refused to follow simple commands and became increasingly agitated. Officer Monberg and I detained Lamar after he attempted to walk away from us. We escorted Lamar to the squad car, as he yelled and cussed loudly for the whole neighborhood to hear. We sat Lamar down in the squad and Officer Monberg stayed with him while I went to make contact with the victim. I made contact with Joni Kanowitz at the listed address and she stated the following. She was in the back bedroom when someone knocked on her door. Her temporary roommate "Luscious" opened the door and let Lamar in. Lamar started storming to the back of the apartment towards Joni, at which point she stopped him and asked him what he was doing. Lamar stated that he was using the bathroom and when Joni told him to leave and use his own across the street, Lamar became verbally aggressive towards her, calling her a bitch and stating that the apartment didn't belong to her. Joni stated that Lamar got increasingly angry at her, yelling at her about money she owed him, and threatening to hurt her. Joni stated that she went to call 911, and as she did, Lamar slapped the phone out of her hand, causing the call to 911 to end. Joni stated that 911 called her back and she advised them of the incident, and Lamar was still in the apartment threatening to hurt her, and making gun - shooting motions with his hands pointed at her. I asked Joni if she felt threatened and if she believed that Lamar was going to hurt her and she stated that she did. Joni stated that she has never seen Lamar with a gun and didn't know if he owned one. Joni was visibly upset and wanted Lamar to go to jail. I took a recorded statement from Joni and uploaded it onto evidence.com. I also called dispatch to confirm that Joni's initial call was ended and that dispatch called her back, which they confirmed. I later ordered the audio from the 911 call. This incident was also recorded by my Taser body camera. Upon arrival, officers made contact with the male, identified as Lamar Hutton at the back of the building. Officer Monberg talked to the caller, identified as Rose Walker while I talked to Lamar. Lamar was intoxicated and had an open bottle on him. Lamar stated that he came to see his kids and get a $250 he loaned to Rose. Throughout the entire time talking to Lamar, he was verbally aggressive and belligerent toward us. Rose informed us that Lamar doesn't live with her and requested him to be removed. Lamar also told us that he doesn't live with Rosa but came to get his money from her. Rosa denied ever getting money from Lamar. We advised Lamar that there was nothing we can do since it was civil issue. We give Rosa a blue card with case number for her reference. We also explain to her the process of getting OFP against Lamar. We also told her to talk to her landlord to get Lamar to be trespass from her apartment. Rose informed us she understood. Narratives ORIGINAL OFFICER NARRATIVE On 6 -16 -17 at 1710 hours, I, Officer Hilden, was flagged down in the 4700 block of Grand Ave by a passerby. The passerby told me that people were about to fight in the 4600 block of Tyler St NE. I drove down there along with Officer Scheevel and observed a female in the street yelling towards people near 4633 Tyler St NE. I made contact and she stated that her sister was in an argument with her baby's father and that she came her to help her. I identified her sister, Rose Walker, in the back seat of a vehicle. She was crying and appeared upset. Rose stated that she was inside her apartment (4633 Tyler #3) along with her baby's father, Lamar Hutton. She stated that he wanted to take their kids but she didn't want him too so they got into an argument. Rose said that Lamar broke her phone (I did notice the screen was cracked). Rose also said that Lamar pushed her forehead with his open palm. Officer Scheevel and Officer Pregler spoke with Lamar Hutton and others that were with him. See Officer Scheevel's supplement for details. I learned from them that Rose's sisters were the aggressors and yelling and threatening Lamar and others. Everyone's story was inconsistent of each other and there was no physical evidence of any assault. Officers made sure that all parties were separated. Rose said that she was going on Thursday to file for a restraining order against Lamar. It should be noted as well that Lamar has been staying with Rose at 4633 Tyler St NE #3 for a while. There was also a female standing in the road yelling at people. I contacted a male I know from previous contact as Lamar Hutton. Lamar was standing in the courtyard yelling. Lamar stated that he had been watching his children inside of the apartment at 4633 Tyler St #3. Lamar said that he and a female he identified as "Rose" have several children together and she asked him to come over to watch the kids. Lamar said that Rose's sister then showed up and pulled him out of the apartment and started yelling at him. Lamar said that Rose's sister was accusing him of assaulting Rose. Lamar said that he never touched Rose and that she had asked him to come over to watch the kids. I then spoke with a female on scene verbally identified as Annie McElroy. Annie said that she observed Lamar and the female who was pointed out as Rose's sister yelling at each other in the courtyard. Annie said that she did not observe any physical altercation between anyone, but that Rose's sister was the aggressor in the incident as she was the one who was yelling at Lamar. We stayed on scene until all of the involved parties separated and left. We then cleared the scene. Narratives ORIGINAL OFFICER NARRATIVE On June 22, 2017, at approximately 1546 hours I, Off icer Pregler, along with Sgt. Museus responded to a domestic that we heard while in the area for an unrelated property dispute. Museus heard a female screaming and there were several people standing outside their doors and looking to the area behind 4634 Tyler. We located the disputing parties behind 4634 Tyler St. The male half was identified as Lamar Hutton, the female half was identified as Rose Walker. Rose was upset because she believes Lamar pawned their son's Play Station 4. Rose told me she left the house to begin the OFP process with Lamar. Rose said she came home, the back door to her apartment was busted, she believed by Lamar. Lamar told us he took the train from Big Lake to Columbia Heights to see their children and was planning to return to Big Lake tonight. Lamar told me he has not been in the house, he has no idea where the Play Station 4 would be. Lamar told me the last item he pawned was a television set that he pawned for Rose at Max It Pawn. No Pawn receipt was found in Lamar's pockets or papers that he willingly removed from his clothing. Rose told us Lamar has not been in the apartment for a few months, she did show Sgt. Museus the back door, the window that does not secure, table, the area where the Play Station 4 was, only the remote was left. Adult male was subsequently arrested for OFP violation and transported to Anoka county jail. Narratives Original Officer Narrative On Wednesday, July 12, 2017 at 2019 hours, I, Officer, Abdullahi along with Officer, Urbaniak were dispatched to 4633 Tyler St NE for report of a order for protection (OFP) violation. Dispatch added remarks on the call stated that a suspect "Lamar Hutton" was across the street from the caller /victim residence. I instantly, recognized the suspect's name "Lamar Hutton" from multiple prior contacts. I was able to pull up the suspect's fully identity on DVS website as a Lamar Michael Hutton. I ran Lamar for possible warrants, and confirmed the OFP on file. I noticed the caller /victim, Rose Walker was the petitioner and Lamar was the defendant. Upon my arrival, I noticed Lamar ran across Tyler St and was directly behind Rose's residence (4633 Tyler St). I parked my squad in the alley behind 4654 Tyler St NE and ran towards Lamar. At that moment, Lamar was unaware of my presence. I announced my presence and told Lamar to stop. Lamar was very cooperative and immediately stopped. Based on the OFP on file and Lamar's proximity to the caller's address, I made a decision to arrest him for OFP violation. I advised Lamar to turn around and put his hands behind his back. Lamar said "for what? I didn't do anything ". Lamar said "this ain't their property" and repeatedly assured me that he was off "their property ". Lamar said he was aware of the order for protection and that's why he was off "their property ". Lamar said he knew he was banned from 4633 Tyler St NE repeatedly. Lamar was taken into custody without a problem. I placed Lamar in handcuffs, checked for tightness, double locked and escorted him to my squad car. I had Officer Urbaniak stay with Lamar until I gathered additional information from Rose. I went to Rose's residence (4633 Tyler St #Unit 3) and made contact with her. Rose appeared very frustrated and over- whelmed about what was going on. I asked Rose if she has court document regarding OFP on file. Rose handed me Anoka county Emergency (Ex Parte) domestic abuse case filed under 02 -FA -17 -1094. I reviewed 825 41st Ave NE Columbia Heights, MN 55421 (763) 706 -8100 f.• (763) 706 -8126 www.chpolice.com emergency (Ex -Pane) domestic abuse file and later confirmed it with Anoka County Communication Center (Dispatch). Per court document, Lamar must not have any contacts with Rose, whether in person, or through other person, by telephone, mail, E -mail, electronic devices, and or social media. I also reviewed Rose's incoming text messages from " Lamar's" account under 612 -558 -2520 telephone number. I observed multiple text messages where Rose asked Lamar to leave her alone. I took pictures (screen shots) of incoming/outgoing text messages between Rose and Lamar. I read Lamar's text message to Rose stating "Let me kiss yo fat pussy" and Rose's response was "Stop ". The last received text message from Lamar was today (07/12/2017) at 1828 hours. Lamar kept the conversion going by stating "I will, I will never, love no body like you. am happy for you" and Rose responded by saying "no you not" at 1832 hours today (07/12/2017). Pictures of text messages, and court document was later uploaded to my upload folder (Per Rose, orange text messages were from her and white /clear ones were Lamar's). I noticed Rose appeared extremely frustrated and was uncooperative. According to Rose we (CHPD) officers were not doing our jobs because, Lamar was stilling harassing her. I asked Rose if she was willing to give me a recorded statement and she refused. I returned to my squad car and asked Lamar if he was willing to give me a recorded statement. Lamar got extremely agitated and refused to give me his side of the story. I requested Columbia Heights CSO for a transport. Officer Urbaniak pulled Lamar's criminal history via Channel 3. Based on Lamar's criminal history, I charged him with gross misdemeanor for violation. Per Lamar's criminal history he was convicted for domestic assault on 03/30/2011 (court file # CR108592). Domestic abuse notification form was filled out and left at jail. Lamar was transported to Anoka county jail. Lamar's criminal history was placed in in- custody mail box. Please see below for more details. H. Abdullahi Cleared by arrest. Abdullahi, Hashim HPD00055 FOLLOW -UP INVESTIGATION On July 13, 2017, I Sgt. Markham called Central Communications regarding the order that Hutton was arrested on. I learned that Hutton had not been served with the order before being arrested. I completed an authority to release form on Hutton and faxed it to the jail at 1155 hours. I called the Anoka County Jail and requested that they serve Hutton with the order before releasing him. Markham, Matt HPD00023 FOLLOW -UP INVESTIGATION On 07/18/2017 at approximately 1100 hours, I Officer Huebner, followed up with Angela, an Alexandra House advocate regarding Rose Walker's status on obtaining a permanent Order For Protection against Lamar Hutton. I learned that Rose did not appear for her court date, but Lamar did show up. I was advised that the Ex Parte and any other Orders against Lamar concerning Rose Walker were dismissed. Rose did not appear to her first court date regarding the issue, yet the Judge saw fit to continue the case until today to give Rose another chance. Rose again did not show. I had been working with Alexandra House to provide transportation to court for Rose, among other assistance such as help with obtaining the OFP. Alexandra House stated that Rose did not return their calls, and they were not able to assist her because of that. End of supplement. Narratives Original Officer Narrative On July 24, 2017, at 2013hrs, I, Officer Monberg, was dispatched to 4633 Tyler St NE #3 for a female reporting her ex- boyfriend was harassing her. I arrived and met with the caller, Rose Walker. Walker explained that her ex- boyfriend and father of one of her children, Lamar Hutton, had come to the home and walked away with their young child across the street. Walker followed them and took the son back home but Hutton was continuing to harass her about their son. Walker wanted Hutton to leave the neighborhood. I spoke with Hutton, who was seated on the front steps of 4634 Tyler St NE. Hutton explained that Walker had obtained an ex parte OFP against him that was vacated when she failed to appear at a hearing. Hutton claimed that the judge told him that he could go to the home and leave with his son. Hutton stated that Walker has a new boyfriend and he doesn't want his son around the male. I explained to Hutton that he would need a family court order to obtain custody of their son if he had Walker couldn't come to an agreement. Hutton stated that he would not be going back to Walker's apartment for the night and would be spending the night with a friend in the 4634 building. Initial reports to police indicated that a third male was at the scene pointing a handgun. On July 25, 2017 while investigating that incident, I Sgt. Markham learned that Williams' brother was at the scene during the fight. Williams' brother was identified as Lamont Cunnin ham by officers on scene. Witness X picked Cunningham out of MRAP lineup number as the male pointing a handgun at the crowd trying to break up the fight between Williams and Hutton. X indicated that Cunningham pulled the gun out after Hutton was stabbed by Williams. I had a criminal history check run on Cunningham. Cunningham has been arrested for attempted murder in 1996 and convicted of 2nd Degree Assault. Cunningham was convicted of aggravated robbery from a 1997 case, Cunningham is not entitled to possess firearms per his criminal history. Cunningham was convicted of possessing a pistol /assault weapon by ineligible person in 2006. A records browser check showed that Cunningham lives with Lanell Coleman at 4703 5th Street NE in 825 41s1 Ave NE Columbia Heights, MN 55421 (763) 706 -8100 f (763) 706 -8126 WWW.Ci�police.com Columbia Heights. Coleman applied for and received a Minnesota State Permit to Acquire Handguns From Federal Firearms Dealer from the Columbia Heights Police Department on April 25, 2017. A DVS check showed that Cunningham does not have any vehicles registered to him, but Coleman has five vehicles registered to her. The vehicles are: 1987 Blue Dodge 600 MN plate number 1987 Ford Econoline Van MN plate number 1996 X Plymouth Voyager MN plate number 2001 Gold GMC Yukon MN plate number 2004 X Kia Sedona MN plate number I was advised by Street Crimes Officer Scheevel that the GMC Yukon and Kia Sedona are the two vehicles that are current and can be seen parked at the residence. A search warrant for Cunningham's residence is being drafted by Officer Scheevel. Investigation continues. Markham, Matt HPD00023 FOLLOW -UP INVESTIGATION On 07/25/2017 at 1357 hours I, Officer Huebner, administered a photo line -up to a witness of the incident, X at the Columbia Heights Police Department. Sgt Markham had prepared the photo line -up. I had never seen any of the photographs, and I did not know who the suspected person was or what they looked like. I read the instructions to the photo line up to X, and she initialed at the bottom of the page stating that she understood the instructions. I then administered the photo lineup consisting of six photographs, individually concealed in separate folders. I handed X Photo #1. X looked at the photo, and set it back down on the table. I handed X Photo 42. She looked at the photo, and placed the folder back on the table on top of Photo #1. 1 handed X Photo #3. X looked at the photograph, and set it down on the table in its own separate pile. I handed her photo #4. She looked at the photo and placed it on the table in the pile with photos 1 and 2. I handed her Photo 45. She looked at the photo, and placed that in the pile with the others as well. I handed her Photo #6. She looked at the photo, and placed it in the pile with all the other photos except for #3. X again looked at #3, and then looked at the rest of them again as well. X stated to me that she recognized Photo #3 as the male that had the gun during the incident. X then completed the photo line -up form, stating in writing that she chose Photo #3 as the suspect that had the gun the night of the incident. X signed and dated the form, as well at the photo that she chose. The line -up was recorded on Sgt Markham's digital recorder, and my Axon body cam. End of supplement. Huebner, Joshua HPD00054 FOLLOW -UP INVESTIGATION On August 1, 2017 at 0445 hours, I assisted in executing a search warrant at 4703 5th Street. ACSO SWAT cleared the residence and secured suspect Lamont Cunningham, Lanell Coleman and approximately six children were in the home at the time of the warrant. Cunningham was turned over to Officer Bonesteel and driven to the office. Officer Scheevel wrote the warrant. Officer Hilden and Investigator Noll also assisted on the warrant. The home, garage and GMC Yukon MN plate number - were searched. No firearms were located. Officer Scheevel did find a small amount of marijuana in Cunningham's bedroom. Officer Scheevel completed the receipt, inventory and return form. I left a copy of the search warrant with Coleman. Officers Scheevel and Hilden had their body cameras recording during the search. SWAT breached the front door upon entry and the front door to the residence was now damaged. While speaking with Coleman at the residence, she said she dropped Cunningham off and picked him up in her GMC Yukon the night of the stabbing. Coleman said that she parked in the McDonald's parking lot. Coleman said she obtained a permit to purchase, but did not ever buy a gun. I reminded her that she could not have a firearm in the house with Cunningham. Coleman said she nor Cunningham had a gun the night of the stabbing. I returned to the office and took a recorded post Miranda statement from Cunningham. Cunningham said that he and Williams have the same father. Cunningham said that Williams contacted him through Facebook messenger the night of the incident via video calling. Cunningham said that he does not see Williams much, but went over to Tyler Street to get Williams, because Williams said Hutton was causing problems. Cunningham said that he never had a gun and has not had one for years. Cunningham said that Coleman drove him to Tyler Street and they parked at McDonald's. Cunningham said that the guy with the gun was in the alley when police arrived and ran away with others. Cunningham said that he never had time to get rid of anything, because the police quickly arrived. Cunningham gave me permission to look at his cell phone. Cunningham said that the only way he communicates with his brother is through Facebook messenger. I confirmed that they exchanged video messages the night of the stabbing and they had no text messages stored in his phone. The videos could not be watched. I uploaded the statement. I canceled the CISA and KOPS alert I had put out on Cunningham on July 28, 2017 at 1539 hours. Due to no firearm being found and conflicted statements, I released Cunningham. Case inactive. Markham, Matt HPD00023 FOLLOW -UP INVESTIGATION On 7/28/17 at approximately 1230 hours, I Officer Scheevel reviewed the reports regarding this case. I completed an application for a search warrant for Lamont's residence, associated vehicles and his person. I requested a no -knock nighttime search warrant due to the severity of the crime and Lamont's criminal history. The warrant was sent to County Attorney Young who approved the warrant. At approximately 1420 hours, I submitted the search warrant application via e- charging, to the Honorable Judge Barry Sullivan. At approximately 1428 hours, I received the electronically signed search warrant from Judge Sullivan. Sgt. Markham contacted the Anoka County Sheriffs Office SWAT Commander to have them assist with the search warrant. On 08/01/17 at approximately 0430 hours, Sgt. Markham, Officer Hilden and I met with the Anoka County Sheriffs Office SWAT Team. At approximately 0445 hours SWAT Operators were able to secure the premises without incident. Lamont was detained and transported to the Columbia Heights Police Department to be interviewed. Investigator Noll arrived on scene to assist with the search. Lanell was home at the time of the search warrant, along with several of her children. In one of the upstairs bedrooms where Lamont was originally located, I found a lock box on top of the dresser. Inside of the lock box, I located the following items; 1) glass marijuana pipe 2) W2 with Lamont's name on it 3) 1.211 grams of suspected marijuana 4) 3.166 grams of suspected marijuana 5) 2.024 grams of x pills in plastic packaging(later found to be trazadone hydrochloride) We searched the residence, garage and one of the vehicles. We did not locate any of the items listed on the search warrant. Sgt. Markham advised me to seize the narcotics and paraphernalia. I completed and left a receipt, inventory and return for the above seized items. The receipt was left with Lanell. Upon our arrival at Heights base I tested and weighed the suspected marijuana. Both items of suspected marijuana tested positive for marijuana using a NIK kit. Using a pill identification website I found that the x pills in the plastic bag were trazadone hydrochloride (nonscheduled). The trazadone hydrochloride weighed 2.024 grams. I placed all of the seized items into evidence and completed a property sheet. Sgt. Markham interviewed Lamont at Heights base. After the interview, Lamont was released from custody and Officer Nightingale transported him back to his house. On 8/2/17 1 had the receipt, inventory and return notarized at Heights base. I turned the receipt over to Sgt. Markham to be e- filed. I then placed a copy of the search warrant and receipt inventory and return in with my daily paperwork. Museus, called the landlord of 4633 Tyler St., Bradley Schumacher, on the telephone in response to a voicemail that Brad had left saying there was an order for protection in place during the incident #17169111. That incident occurring on 7/31/17, was a second degree assault and gun pointing incident that generated a letter from the CHPD requiring termination of tenancy. Narratives Original Officer Narrative On 11/4/17 at about 0108 hours, I was parked on the 4600 block of Tyler St facing northbound. I heard a vehicle coming from my rear and appeared to be honking at another vehicle with occupants that was stopped midblock of "Tyler St. I observed the honking vehicle was a Buick Century with Minnesota license plate #984MVB. The vehicle continued to honk repeatedly as it continued northbound on 4600 block of Tyler St. Honking a horn repeatedly at 0108 hours with no traffic- related purpose is an unnecessary noise and violation of Columbia Heights Ordinance 8.204(D). I followed the vehicle and stopped it in the 1000 block of 47th Ave. I made contact with the driver, who I identified as Anthony Jr. Jefferson. I explained to Jefferson my reason for stopping him. As I was talking to him, I could clearly see a plastic bag inside Jefferson's mouth and am aware from training and experience that narcotics are often packaged in plastic baggies At this time I asked Jefferson to turn off the vehicle. I asked Jefferson multiple times to spit out the bag; Jefferson ultimately gave the bag to me. Officer Wood arrived at my Stop to assist me. I told Jefferson to step out of the vehicle. Jefferson started the vehicle and attempt to put it gear. I reached in the vehicle and grabbed the gear and told Jefferson to turn off the vehicle. Jefferson ultimately listen and turn off the vehicle. I removed Jefferson from the vehicle and placed him into custody. Sgt. Pletcher and Officer Monberg arrived to assist us. I conducted a field test on the substance from the baggy and it carne back positive for crack cocaine. Jefferson was unable to provide me with insurance for the vehicle he was operating. A. check of Minnesota Driver and Vehicle Services records revealed that Jefferson has a Revolted Driver's License. Officer Wood completed a booking sheet for Jefferson. She also completed a tow sheet for the vehicle and it rues towed to JBS impound lot. I later weighed the substance with baggy at the Columbia Heights Police Station and it weighted 7.4 grams. I completed evidence sheet and LAP forms for the Crack Cocaine and placed into CHPD evidence locker. I also took a picture prior to placing into the locker. I placed the copy of all my paper work in- custody. Cleared by arrest M. Farah #127 Farah, Mohammed HPD00056 ADDITIONAL INFORMATION On 11/04/2017 at 11:04 hours, I (Officer D. Jones) contacted central communications and requested that Lamar Hutton have a KOPS alert be entered for his arrest on a PC pick up and hold felony OFP violation. End of supplement. Jones, Darry HPD00069 ADDITIONAL INFORMATION On 1115117 after I had submitted my report I learned that I had forgot to mention two passengers that were in the vehicle, identified as MICKEY, SHAHLIM and HUTTON, LAMAR. Shaheim stated that he got picked up at his apartment, 46133 Tyler St NE #4, by Anthony. Shaheim stated that after he was done hanging with Anthony at the bar he was getting dropped off back to his apartment. This was recorded on officers' taser body cameras. After we had search both parties, we didn't find any other drugs. I also searched the vehicle and didn't find any other drugs. I later learned that Lamar was not supposed to be within one mile of 4633 Tyler St NE as he was a respondent on OFP filed by Walker, Rose. Rose lives at 4633 Tyler St #3. I've attached a copy of the OFP below on my report. KOPS alert was entered via dispatch for Lamar for violating the OFP. I also request a warrant complaint fort Lamar with a gross misdemeanor OFT violation if he is not located with 72 hours. Forward for possible conduct on licensed premise violations. N/A BACKGROUND: Over the last several months, Community Development Staff have received inquiries regarding the establishment of Religious Facilities, and K -12 Schools, in commercial areas of the City. The City Council asked staff to look into how we can limit these types of institutional uses in commercially zoned areas. While there is recognition that these types of uses are responding to a demand in the community, reducing future K -12 Schools, or Religious Facilities from locating on commercially zoned property, shouldn't have a significant impact on meeting this demand. Currently, both Religious Facilities and K -12 Schools are permitted in all five Residential Zoning Districts and the Limited Business Zoning District. The attached draft Ordinance No. 1648, would remove K -12 Schools and Religious Facilities as permitted (conditional) uses, from the Limited Business Zoning District. Both uses would still be allowed in all residentially zoned areas with a Conditional Use Permit. Staff believes that this effort will help to maintain the intent and purpose of the LB, Limited Business District, which according to the Columbia Heights Zoning Code is to "provide appropriate locations for limited retail sales and services for the convenience of adjacent residential neighborhoods ". It is important to note that staff is not proposing to change where other types of schools such as a performing or visual arts or vocational and business schools can locate. RECOMMENDATION: Removing Religious Facilities and K -12 Schools from the Limited Business Zoning District will help to enhance the commercial nature of this district, by reserving these areas for commercial uses. While the Zoning Code will still allow for these institutional uses in other areas of the City, it is essential that the City preserve and encourage other types of commercial uses such as restaurants, and small and large retail to locate in these areas. Staff would like to bring an ordinance before the City Council later in March or April and seeks input and direction from the City Council regarding these proposed changes. ATTACHMENTS: 1. N/A BACKGROUND: The City of Columbia Heights (the "City ") has had an extensive history with respect to Planned Unit Development (Commonly referred to as "PUD ") Districts since 1974. Nevertheless, on May 29, 2001, the City Council unanimously approved Ordinance No. 1428, an ordinance which effectively repealed and replaced the previous Zoning Ordinance of the City, but subsequently eliminated the PUD District. The intent behind the elimination of the PUD District was for the newly created Mixed Use Development (Commonly referred to as "MXD ") District to replace the traditional PUD District. However, over the years, staff has determined that the MXD District is not adequately functioning how it was intended to function as a strategy for the City to encourage flexible high - quality design for development and redevelopment projects. Therefore, staff has drafted a proposed ordinance which would re- establish the PUD District so that the City may attain a higher quality of design for future development and redevelopment projects throughout the community. A PUD District is generally described as a type of development or redevelopment that follows a separate regulatory approval process which results in a development outcome that exceeds the typical development achievable through the standard requirements of the primary zoning district. The proposed ordinance attached was drafted to reflect the previous format of the PUD District eliminated by Ordinance No. 1428, as well as to incorporate several new provisions that were identified by staff to be applicable based on an evaluation of other PUD Districts in ten (10) different cities, specifically Brooklyn Center, Fridley, Golden Valley, Hopkins, North St. Paul, Richfield, Robbinsdale, Roseville, St. Louis Park, and West St. Paul. Staff would like to facilitate a discussion in regards to the re- establishment of the PUD District and review the proposed ordinance to obtain direction, feedback and comments from the City Council members. SECTION II: That Chapter 9, Article 1, Section 9.113: Planned Unit Development District shall hereafter read as follows, to wit: §9.113 PLANNED UNIT DEVELOPMENT DISTRICT. (A) Purpose. The purpose of the PUD, Planned Unit Development District is to provide greater flexibility with development and redevelopment; preserve historical, environmental, and aesthetically significant features; promote a high quality of design; and encourage more technological and energy efficient developments. This is achieved by undertaking a process that results in a development outcome that exceeds the typical development achievable through standard zoning controls. (B) General Provisions. (1) Relationship to other applicable regulations. (a) Property located within a PUD District shall be subject to the land use controls described in the primary zoning district, as well as the rules and regulations prescribed in the PUD District plan. Where the provisions of the primary zoning district and the PUD District plan are in conflict, the PUD District plan shall govern. (b) The PUD District plan review process, in accordance with the provisions of this section, constitute and supersede the requirements set forth in §9.104, subdivision (N)(2). (2) Right of application. Any person having a legal interest in the property may file an application for the establishment of a PUD District to the Zoning Administrator. (3) Authority. The City retains absolute authority and discretion to establish a PUD District, and reserves the right to deny the establishment of a PUD District if the City Council determines that the proposed benefits of the development do not justify the requested flexibilities of a PUD District. (4) Administration. The administration and enforcement of this section shall be in accordance with the provisions of §9.104. An application for establishment of a PUD District shall be filed with the Zoning Administrator on the approved form and shall be accompanied by an application fee as set forth in §9.104, subdivision (C)(5). An application shall include a narrative; a vicinity map; an accurately scaled site plan showing the locations of proposed and existing buildings, existing and proposed topography, vehicular access and parking areas, landscaping, and other site features; a stormwater management plan; elevation views of all proposed buildings and structures; and any other information determined by the Zoning Administrator to be necessary. (6) Approval. Approval of a PUD District plan shall be by ordinance, a simple majority vote, and in full force and effect from and after 30 days after its passage. (7) Physical Development Contract. After City Council approval of a PUD District plan, a Physical Development Contract shall be required prior to site development. The Physical Development Contract shall reference all the approved plans and specify permitted uses; allowable densities; development phasing if applicable; required public improvements; construction commencement and completion dates of the minimum improvements; an irrevocable letter of credit, or cash deposit in an amount sufficient to ensure the provision or development of public improvements; and any other requirements determined by the Zoning Administrator to be necessary. The Physical Development Contract shall be signed by the applicant or an authorized representative within sixty (60) days after its approval by City Council. (8) Time Limits. An established PUD District shall be validated by the construction commencement of the minimum improvements pursuant to the Physical Development Contract. If the construction commencement fails to meet the deadline specified in the Physical Development Contract, the approval of the PUD District plan by the City Council shall be rendered invalid and void. Notwithstanding the construction commencement time limitations, the City Council may, at its own discretion, approve an extension by approval of an Amendment to the Physical Development Contract if requested by the applicant in writing. (C) Areas of Flexibility. Development flexibility provided through the establishment of a PUD District will not be approved in avoidance of the regulations set forth by the primary zoning district. However, if a development is able to achieve a higher quality of design, efficiency, and technology than what current market conditions allow, the establishment of a PUD District will provide flexibility to the following areas: (1) Building Heights. (2) Building Materials (3) Building and Parking Setbacks. (4) Landscaping Requirements. (5) Multiple Building Placement. City of Columbia Heights —Ordinance 1647 Page 3 (6) Parking and Vehicular Requirements. (7) Public Art Requirements. (8) Public Spaces. (9) Signage Requirements. (10) Site Density. (D) Review Procedure. (1) Pre - application meeting. Prior to filing an application to the Zoning Administrator for the establishment of a PUD District, the applicant shall meet with City staff for a pre - application meeting. The primary purpose of the pre - application meeting is to allow the applicant and City staff to discuss land use controls, appropriate uses of the site, specific development design standards, the application process, and required information that shall be submitted with an application, as well as evaluate how the development will achieve a higher quality of design, efficiency and technology. (2) Development Review Committee. After filing a completed application, the Development Review Committee, comprised of the Zoning Administrator, Building Official, Fire Chief, City Engineer, and his /her appointee, shall conduct an administrative review of the application. All findings and determinations by the Development Review Committee shall be forwarded to the Planning Commission. (3) Neighborhood Meeting. Prior to the consideration of a PUD District plan or a major amendment to a PUD District plan by the Planning Commission, the applicant shall hold a Neighborhood Meeting within City limits, and mail a notification of the Neighborhood Meeting to all property owners within three hundred and fifty (350) feet surrounding the proposed PUD District. The purpose of the meeting is to inform the neighborhood of the proposed development and obtain input from the affected property owners. (4) Planning Commission. (a) Informal Public Hearing. The Planning Commission shall hold an informal public hearing for the consideration of a completed application for the establishment of a PUD District in accordance with the requirements of this section. The Planning Commission shall make the following findings of fact before approving the establishment of a PUD District: (i) The PUD District plan conforms to all applicable requirements of this article. (ii) The PUD District plan is consistent with the applicable provisions of the Comprehensive Plan. (iii) The PUD District plan is consistent with any applicable area plan. City of Columbia Heights —Ordinance 1647 Page 4 (iv) The PUD District plan minimizes any adverse impacts on property in the immediate vicinity and the public right -of -way. (b) Recommendation. The findings and recommendation of the Planning Commission shall be forwarded to the City Council. The Planning Commission may impose conditions of recommended approval or modifications to any PUD District plan, and require guarantees deemed necessary to ensure compliance with the requirements of this section. (5) City Council. (a) Formal Public Hearing. The City Council shall hold a formal public hearing for the consideration of a completed application for the establishment of a PUD District in accordance with the requirements of this section. (b) Action. The City Council shall review and consider the recommendations of the Planning Commission, the Development Review Committee, and the public before approval or denial, in whole or in part, is made for establishment of the PUD District. A denial shall only be based on findings of fact that the PUD District plan is not in substantial compliance with the provisions of this section or City Council determines that the proposed benefits of the development do not justify the requested flexibilities of a PUD District. (E) Amendments. An approved PUD District plan may not be changed or modified without prior approval by City Council. A request for an amendment to an approved PUD District plan shall be submitted and reviewed by the Zoning Administrator to determine if it is a minor or major amendment. (a) Minor Amendments. (i) An amendment shall be deemed minor in nature if a change or modification to the approved PUD District plan increases or decreases a provision to be in conformance with the primary zoning district; increases the density of units per acre or gross floor area in any structure by less than equal to ten percent (10%); demolishes or adds an accessory structure; significantly alters the original intent of the landscape plans or elevation views; or is not determined by the Zoning Administrator to be major in nature. (ii) A minor amendment shall be placed on the Consent Agenda of City Council without the review by the Planning Commission. The City Council may remove the minor amendment from the Consent Agenda for discussion before approval or denial. (b) Major Amendments. (i) An amendment shall be deemed major in nature if a change or modification to the approved PUD District plan increases or decreases a provision to not be in conformance with the primary zoning district; increases the density of units per acre or gross floor area in any structure by more than ten percent (10%); demolishes or adds a principle structure; alters the placement of City of Columbia Heights — Ordinance 1647 Page 5 buildings or roads; introduces a new use; decreases the amount of public spaces by more than equal to three percent (3%) or alter it in such a way to change its original intent; creates a conflict with the original conditions of recommended approval; eliminates, substantially diminishes, or compromises the original intent of the PUD District as prescribed in subdivision (A) of this section; or is not determined by the Zoning Administrator to be minor in nature. (ii) A major amendment shall require the submittal of a revised PUD District plan to the Zoning Administrator for full review and approval in accordance with the provisions of this section. (F) Cancellations. An approved PUD District plan shall be cancelled and revoked only upon City Council approving a resolution rescinding the PUD District. Cancellation of a PUD District plan shall include findings of fact that demonstrate that the district is no longer necessary due to changes in local regulations; becomes inconsistent with the Comprehensive Plan of the City; threatens public safety, health, or welfare; or at the request of the applicant or assignee in writing. This ordinance shall be in full force and effect from and after 30 days after its passage.
