Columbia Heights is requested regarding the property at 4020 Hayes Street NE for failure to meet
the requirements of the Residential Maintenance Code.
MOTION: Move to close the public hearing and to waive the reading of Resolution Number 2017 -89,
there being ample copies available to the public.
MOTION: Move to adopt Resolution Number 2017 -89, being resolution of the City Council of the City
of Columbia Heights declaring the property listed a nuisance and approving the abatement of
violations from the property pursuant to City Code section 8.206.
B. Consideration of revocation of the license to operate a rental unit within the City of Columbia pg 52
Heights is requested against the rental property at 1336 43 %Z Avenue NE for failure to meet the
requirements of the Residential Maintenance Codes.

The following are the minutes for the regular meeting of the City Council held at 7:00 PM on Monday August
14, 2017 in the City Council Chambers, City Hall, 590 40th Ave. N.E., Columbia Heights, Minnesota

Mayor Schmitt called the meeting to order at 7:24 p.m.

Motion by Councilmember Murzyn, Jr., seconded by Councilmember Novitsky to approved the agenda as
presented. All Ayes, Motion carried.
City Manager Walt Fehst reported the council agenda has been modified in a couple of areas to make it easier
to follow. He also reported the council letter documents will be incorporating the City's Strategies and Short
Term Goals.
Mayor Schmitt reported just prior to the meeting the Council completed an Executive Session where the City
Manager's Performance Evaluation was completed.

A. Acknowledgement and introduction of Teen Volunteers at the Library
Bri Belanger, Pat Sowada and Catherine Vesley reported that teen volunteers have provided over 300
volunteer hours this year. The following volunteers were recognized; Farah Abdulkadir, Hanan Ahmed,
Frannie Crego,
Catherine Cruz, Helen Desta, Brook Desta, Patrick Fink, Kali Folland, Ava Grotting, Lauren Hackett, Munira

B. Update from Sister Cities
Dolores Strand announced the Columbia Heights Sister City group has received the "Best Overall Program"
award, for populations less than 25,000. This was the second time in three years the award was received.

I. Payment of Bills
MOTION: Move that in accordance with Minnesota Statute 412.271, subd. 8, the City Council has
received the list of claims paid covering check number 166714 through 167028 in the amount of
$4,911,606.44.
Motion by Councilmember Buesgens, seconded by Councilmember Novitsky to approve the Consent
Agenda items A, 8, D, G, H and 1. All Ayes, Motion Carried.
The following items were removed for discussion:
C. City Hall Master Plan
Kevin Hansen, Public Works Director indicated that this is one of the Council's recently adopted Short
Term Goals. Since 2014 staff has looked at a variety of rehabilitation projects at the current building.
At that time an estimate of $650,000 was given to complete the major rehabilitation projects. Mayor
Schmitt stated that any necessary repairs will continue to be addressed.
Councilmember Buesgens requested the value of the current building be included in the forthcoming
proposal.
Motion by Councilmember Buesgens, seconded by Councilmember Novitsky to authorize staff to
prepare a City Hall Master Plan. All Ayes, Motion Carried.
E. Keyes Park Final Plans
Kevin Hansen, Public Works Director gave an overview of the proposed improvements, noting this is
the fifth major park redevelopment plan in the City. Plans include two new athletic fields, storm water
treatment, new parking lot, new playground set, and retaining the current sliding hill. Walking trails
will be included as an add - alternate. Hansen anticipates bids being considered at the August 28th City
Council meeting.
Motion by Councilmember Novitsky, seconded by Councilmember Murzyn, Jr. to approve the final
Plans and Specifications and order Advertisement for Bids for Keyes Park Improvements, City Project
1610.
F. Refuse Cart Purchase
Kevin Hansen, Public Works Director reported the City will soon be seeking bids for waste service.
Hansen explained that by purchasing the refuse carts currently in use, the upcoming bidding process
will be more consistent. Mayor Schmitt questioned if this savings will passed on to the residents.
Hansen indicated that by removing the cart replacement form the bids, that savings will be passed to
the residents. Hansen reported the vendor will be responsible for storing, maintaining and replacing
the carts if necessary. Mayor Schmitt questioned the warranty period of the carts. Hansen indicated
he will look into it.
Motion by Councilmember Buesgens, seconded by Councilmember Novitsky to approve the purchase
of 12,836 carts from Advanced Disposal Services at a price of $10.00 each, with funding from the
Refuse Fund 603.
All Ayes, Motion Carried.

Motion by Councilmember Buesgens, seconded by Councilmember Williams to amend the 2017 Refuse
Fund Budget authorizing the expenditure of $128,360 from fund balance to purchase the carts. All
Ayes, Motion Carried.
8. PUBLIC HEARINGS
A. Repeat Nuisance Call Service Fee Appeal
Lenny Austin, Interim Police Chief gave some background on the item, noting the most recent call for service
was made by a neighbor at the property located at 940 39th Ave. City Attorney Jim Hoeft reported he
reviewed the incident, and advised the Council that they have the legal right to impose the $250 Call for
Service Fee, or deviate from doing so, provided they offer their reasons for doing so.
Austin indicated he met with the building manager in June, at that time he was informed of steps being
implemented to address the issues. There have been no subsequent calls.
Mayor Schmitt opened the Public Hearing at 8:04 PM.
Michael Kemp; representing Ken Hertz reported the property owner has been working to improve the
problems at the property. Mr. Kemp, on behalf of Mr. Hertz requested the council consider rescinding the
$250 call for service fee.
Mayor Schmitt questioned if the ordinance excludes domestic calls. Hoeft indicated that if a domestic victim
makes the call, it is not considered a nuisance call.
Kathy Ahlers -4010 Hayes Street questioned how frequently the call for Service fee is imposed. Interim Chief
Austin reported less than 1% of the 950 -1000 rental properties in the City.
The Public Hearing was closed at 8:14 PM.
Motion by Councilmember Williams, seconded by Councilmember Murzyn, Jr. to uphold the $250 Nuisance Call
for Service Fee imposed on Ken Hertz, owner of 940 39th Avenue NE. All Ayes, Motion Carried.

Report of the City Council
Councilmember Novitsky and Murzyn, Jr. reported they attended the North Metro Fire Ops 101 training.
Councilmember Novitsky also attended the Northeast Ecuadorian parade and 13 National Night Out parties
Councilmember Murzyn, Jr. announced the VFW Post 230 will be serving breakfast and lunch. They will also
hold a Flag Retirement Ceremony on October 13tH
Councilmember Williams attended the Heights Manor board meeting.
Councilmember Buesgens attended the Improving Local Economies through the League of Minnesota Cities,
the Park & Recreation Commission meeting, the Crest View luncheon, the Retirement Party for Scott Nadeau,
the Blooming Heights Garden Gala, a forum at Macalester College, a National Night Out party, the EDA

meeting, a Metro Agency meeting, served as a volunteer for Becca's Trashcan Art, and participated in the first
Dog Day Afternoon event hosted by HeightsNext.
Mayor Schmitt attended the Improving Fiscal Futures meeting through the League of Minnesota Cities, the
Bridgeview Luau, the Crest View Picnic, the Anoka County Fair, the Ecuadorian Festival, the Crest View Block
Party & Car Show, a luncheon with Keith Ellison and other Mayors, and attended the State Capital Grand
opening, where she participated in the Mayor's March.
Report of the City Manager
City Manager Walt Fehst reminded the Council that the Anoka County League of Local Government will be
hosting an event on August 30th. Manger Fehst thanked the council for providing a performance review at
the preceding work session.
11. CITIZENS FORUM
DeWayne Morrell -4212 Reservoir Blvd. was concerned with the proposed refuse cart program, indicating he
would also like to see pricing options available to residents with less usage.
Mr. Morrell expressed concern with the proposed size of the HyVee fuel station. Director Hansen clarified
that the council has approved the convenience store and fuel station at the corner of 47th and Central Ave.
Mr. Morrell questioned why the council doesn't require more police officers to be residents of the City.
Mayor Schmitt indicated that residency requirements are illegal.
Mr. Morrell requested an update on the parking lot at 37th Ave. auto storage location. Councilmember
Buesgens reported the company may be hiring an engineer to assist with paving the lot.
Kathy Ahlers -4010 Hayes St. NE reported approximately 65 -70 people attended the Dog Day Afternoon event
held at Huset Park. A petition for a dog park was presented to the Council.
Malcom Watson -1717 49th Ave NE indicated he would like to talk with someone about the City Hall Master
Plan and the plans for Keyes Park.

BACKGROUND: In 2016, the City of Columbia Heights partnered with the City of Minneapolis on a grant
application to the Metropolitan Council under their Regional Solicitation Program. Early in 2017, while we scored
fairly well, we were informed we missed the funding threshold.
This summer, a new funding program was announced by MnDOT called their Minnesota Highway Freight
Program. The Minnesota Highway Freight Program (MHFP) provides federal funding to construction projects on
public roads that provide measurable freight transportation benefits. These federal funds were made available by
the creation of the National Highway Freight Program in the FAST Act.
Minneapolis, working with city staff, will prepare an application to provide funding under the Minnesota
Department of Transportation's 2017 Minnesota Highway Freight Program Funding Solicitation for State and
Local Highway Construction Projects. The application includes a brief description of the project, estimated costs,
and the requested amounts. The project requires a minimum local match for construction in addition to the costs
for design, engineering, administration and any additional construction costs to fully fund the project. The
application will maximize the use of federal funding. The funding to be awarded is for projects to be constructed
in 2019 through 2022.
The proposed project will reconstruct the pavement surface, curb and gutter, traffic signals, lighting, some
sidewalks, as well as construction of a bicycle facility. The total estimated cost of the reconstruction project is
$10,800,000. The application requests $8,640,000 with a minimum local match requirement of $2,160,000.
Columbia Heights and Minneapolis would split the required local match and engineering costs, if awarded.
STAFF RECOMMENDATION: Staff recommends consideration of the Resolution authorizing submitting a funding
application and committing local state aid funds for the City's required match.
RECOMMENDED MOTION(S): Move to waive the reading of Resolution 2017 -86, there being ample copies

A resolution of the City Council for the City of Columbia Heights, Minnesota, supporting submission of a
grant application for reconstruction of 37th Avenue from Central Avenue to Stinson Boulevard;
WHEREAS, the City Council of the City of Columbia Heights is the official governing body; and
WHEREAS, the City of Columbia Heights is recommending submitting an application to the Minnesota
Department of Transportation's Minnesota Highway Freight Program (MHFP) and commitment of local
funds to provide the required local match for federal funding in collaboration with the City of
Minneapolis, for the complete reconstruction of 37th Avenue from Central Avenue to Stinson Boulevard,
a distance of approximately one mile.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of
Columbia Heights, the City Council of the City of Columbia Heights makes the following:
FINDINGS OF FACT
1. The City of Columbia Heights has the legal authority to apply for the grant in collaboration with
the City of Minneapolis.
2. The total estimated cost of the reconstruction project is $10,800,000. The application requests
$8,640,000 with a minimum local match requirement of $2,160,000.
3. That the City Council approves the application to the Minnesota Department of Transportation's
MHFP to reconstruct 37th Avenue from Central Avenue to Stinson Boulevard, and commits local
funds to provide the required local match for federal funding, which will be split between the
City of Minneapolis and the City of Columbia Heights.

MINNESOTA HIGHWAY FREIGHT PROGRAM DESCRIPTION
Program Purpose
The Minnesota Highway Freight Program (MHFP) provides federal funding to construction projects on public roads that provide
measurable freight transportation benefits. These federal funds were made available by the creation of the National Highway
Freight Program in the FAST Act.
Eligible Applicants
Eligible applicants are any governmental entity that owns or maintains public roads. MnDOT districts, specialty offices, as well as
counties, cites, and tribal governments are eligible applicants. Non -state aid cities and townships are strongly encouraged to
work with their county in developing the application.
The project recipient/sponsor must be qualified to administer a federal aid construction contract. To be qualified, the local public
agency must be adequately staffed and suitably equipped to undertake and satisfactorily complete the work. Projects must
receive adequate supervision and inspection to insure that projects are completed in conformance with approved plans and
specifications.
For project recipients that are townships or non - state -aid cities, the project must be sponsored by a public agency qualified to
administer a federal aid construction contract on behalf of the recipient.
Up to 10% of the money in this program may be spent on intermodal projects within a public or private freight rail or water facility.
Public port authorities, private railroads, and other entities are also eligible to apply for this program under a separate solicitation.

To be eligible for funding, a proposed project must be on a public road, and provide a clear benefit to highway -based freight
transportation. Projects that improve the safety, mobility, or efficiency of freight transportation, or improve road access to freight
facilities, are the intended recipients of these program dollars. Eligible projects include new construction, as well as add -ons and
up- scopes to existing projects, as long as the addition provides a clear freight benefit. Preliminary Engineering costs (the
location, design, and related work preparatory to the advancement of a project to physical construction) are eligible for these
program funds, as long as the preliminary engineering costs are included as part of the construction cost. Preliminary
engineering costs are subject to the provisions of 23 U.S.C. 102(b) and the implementing regulations at 23 CFR 630.112(c)(2)
that require States to repay such costs if right -of -way or construction has not been initiated within 10 years of authorization of
preliminary engineering.
All projects that fall in the Metropolitan Council planning boundary must be a Tier 1, Tier 2, or Tier 3 corridor on the Metropolitan
Council's Truck Highway Corridor Study or the project itself must provide a direct and immediate physical connection to one of

Match Requirement
Applicants are required to identify other public and /or private funding sources that will contribute to the cost of the proposed
project. The Minnesota Highway Freight Program may provide federal funds for up to 80 percent of the eligible project cost.
Projects on the Interstate may receive up to 90 percent of the eligible project cost of the project.
Minimum and Maximum Award
For new construction projects, the minimum award provided to any one project in this solicitation will be $500,000. There is no
minimum award amount for add -ons or up- scopes to existing projects.
The maximum award provided to any one project in this solicitation will be one fiscal year's worth of NHFP funding. The fiscal
year is whichever fiscal year the project falls in.

Mileage Limitation
The legislation that created the National Highway Freight Program places a limit on how many miles of non - Interstate roadway in
Minnesota can be funded with program money. That limit is 75 miles for all Metropolitan Planning Organization (MPO) urbanized
areas, and 150 miles for non -MPO urbanized areas (everywhere else). As such, the mileage available for projects off of the
Interstate is limited. These mileage limits to not apply to the Interstate system — the entire system is eligible.

APPLICATION INSTRUCTIONS
To apply for Minnesota Highway Freight Program funding, applicants must submit the enclosed application and all required
attachments by August 31, 2017. The information requested is intended to provide program evaluators with sufficient
information to determine project eligibility, effectively score and rank projects, and to determine the program funding amount to
be awarded.
How to Submit an Application
Applications must be submitted electronically to _ FreightPlans.DOTCcDstate.mn.us. Applicants will receive confirmation of their
submission.
Applications must be received by 5:00 p.m. on Thursday, August 31, 2017.
Required Attachments
In addition to the application form, the following must be included:
A resolution indicating the governing body's approval of this application and commitment of the match funding
identified in the application
• A map or maps showing the project location
• A project layout or conceptual drawing
• Letter of support from the metropolitan planning organization (MPO), if applicable

Resolution of the City Council for the City of Columbia Heights declaring the property a nuisance and
approving abatement of ordinance violations pursuant to Chapter 8, Article II, of City Code, of the property
owned by Daniel Anthony Kuch (Hereinafter "Owner of Record ").
Whereas, the owner of record is the legal owner of the real property located at 4020 Hayes St. N.E., Columbia
Heights, Minnesota.
And whereas, pursuant to Columbia Heights Code, Chapter 8, Article II, Section 8.206, written notice setting
forth the causes and reasons for the proposed council action contained herein was sent via regular mail to the
owner of record on July 28, 2017.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of Columbia
Heights, the City Council of the City of Columbia Heights makes the following:
FINDINGS OF FACT
1. That on May 25, 2017, an inspection was conducted on the property listed above. Inspectors found
violations. A compliance order was sent via regular mail to the owner at the address.
2. That on July 27, 2017, inspectors re- inspected the property listed above. Inspectors noted that
violations remained uncorrected. A compliance order and statement of cause was mailed via regular
mail to the owner listed in the property records.
3. That on July 31, 2017, inspectors re- inspected the property and found that violations remained
uncorrected.
4. That based upon said records of the Fire Department, the following conditions and violations of City
Codes(s) were found to exist, to wit:
A. Shall remove remainder of tree.
5. That all parties, including the owner of record and any occupants or tenants, have been given the
appropriate notice of this hearing according to the provisions of the City Code Section 8.206(A) and
8.206(6).
CONCLUSIONS OF COUNCIL
1. That the property located at 4020 Hayes Street N.E. is in violation of the provisions of the Columbia
Heights City Code as set forth in the Notice of Abatement.
2. That all relevant parties and parties in interest have been duly served notice of this hearing, and any
other hearings relevant to the abatement of violations on the property listed above.
3. That all applicable rights and periods of appeal as relating to the owner of record, occupant, or tenant,
as the case may be, have expired, or such rights have been exercised and completed.

(Hereinafter "License Holder ").
Whereas, license holder is the legal owner of the real property located at 1336 43 %2 Avenue N.E. Columbia
Heights, Minnesota,
Whereas, pursuant to City Code, Chapter 5A, Article IV, Section 5A.408(B), written notice setting forth the
causes and reasons for the proposed Council action contained herein was given to the License Holder on July
13, 2017 of a public hearing to be held on August 28, 2017.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of Columbia
Heights, the City Council of the City of Columbia Heights makes the following:
FINDINGS OF FACT
1. That on May 12, 2017, inspectors for the City of Columbia Heights, inspected the property described
above and noted violations. A compliance letter listing the violations was mailed by regular mail to the
owner at the address listed on the Rental Housing License Application.
2. That on June 14, 2017, inspectors for the City of Columbia Heights performed a re- inspection and
noted that violations remained uncorrected. A statement of cause was mailed via regular mail to the
owner at the address listed on the rental housing license application.
3. That on July 10, 2017, inspectors for the City of Columbia Heights checked records for this property and
noted that the violations remained uncorrected
4. That based upon said records of the Enforcement Office, the following conditions and violations of the
City's Property Maintenance Code were found to exist, to -wit:
a. Shall remove multiple dead trees on south side of yard.
b. Shall remove the dead pine trees (and all of the tree stumps) in the rear of the yard to within 2-
4 inches below ground level.
c. Shall pay $100 reinspection fee.
5. That all parties, including the License Holder and any occupants or tenants, have been given the
appropriate notice of this hearing according to the provisions of the City Code, Chapter 5A, Article III
5A.306 and 5A.303(A).
ORDER OF COUNCIL
1. The rental license belonging to the License Holder described herein and identified by license number
F15854 is hereby revoked.
2. The City will post for the purpose of preventing occupancy a copy of this order on the buildings
covered by the license held by License Holder.
3. All tenants shall remove themselves from the premises within 45 days from the first day of posting of

BACKGROUND: Project plans and specs and authorization to bid was approved by the City Council at their
July 10, 2017 regular meeting. Plans and specifications were advertised for bids in the FOCUS, and
electronically on the City website and through Quest Construction Data Network. Twenty -seven contractors
(prime and sub) requested a copy of the bidding documents. Four bids were received and publicly read aloud
at the August 22, 2017 bid opening. A copy of the bid opening minutes is attached.
The low bid was submitted by Forest Lake Contracting, Forest Lake, Minnesota in the amount of $711,633 for
Project 1705 and $887,927.72 for Project 1706, $49,316 or 3.08% separated the next bidder. The project cost
is consistent with the Engineer's Estimate.
The bid included the following projects:
• Project 1705: 39th Avenue from Central Avenue to Huset Parkway
Construction consists of full depth reclamation of existing surface, new bituminous pavement, new
curb and gutter and sidewalk on the south side, and spot replacement of curb and gutter and sidewalk
on the north side.
• Project 1706: 40th Avenue from Central Avenue to Reservoir Boulevard
From Central Avenue to LaBelle Pond construction consists of new storm sewer on the north and south
sides and full street reconstruction. From LaBelle Pond to Reservoir Boulevard construction is a mill
and overlay.
• Alternate 1: Residential Construction
These are unit bid prices for residents on the project to have concrete or bituminous driveway or
sidewalk work done on private property.
• Alternate 2: (deduction) for work started and finished in 2018.
• Addendum 2: Rehabilitation of JPM upper parking lot and 46th Avenue near Keyes Park
Rehabilitation of the JPM upper parking lot includes spot replacement of curb and gutter, full depth
reclamation of existing surface and new pavement. 46th Avenue repair involves full reconstruction of
approximately 200' of street west of Parkview Lane.

With accepting Alternate 2, the contractor has indicated they will construct Project 1706: 40th Avenue in 2017,
and construct all other work in 2018, with a completion date of June 1, 2018.
Project funding will be provided by assessments, Anoka County JPA, State Aid funds, Storm Sewer and other
utility funds, and JPM fund.
STAFF RECOMMENDATION: Based upon the bids received, Forest Lake Contracting, Inc. of Forest Lake, Minnesota
is the low, qualified, responsible bidder. Staff is recommending award of the bid to Forest Lake Contracting,
including add alternates 1 & 2 and addendum 2.

BACKGROUND: The City Council accepted the Master Plan for Keyes Park at their August 22, 2016 meeting
and authorized the preparation of plans.
$350,000 is budgeted in the 2017 Parks Capital Improvement Fund for Keyes Park, and $75,000 from the
Storm Water Fund. At their July 2017 regular meeting, the Park and Recreation Commission reviewed the
plans and made a motion recommending plan approval and bidding to the City Council.
Plans and specifications were advertised for bids in the Sun Focus, and electronically on the City website and
through Quest Construction Data Network. Eight contractors (prime and sub) requested a copy of the bidding
documents. Two bids were received and publicly read aloud at the August 22, 2017 bid opening. A copy of
the bid opening minutes is attached.
Peterson Companies submitted the low base bid of $500,905.90 and base bid plus alternates in the amount of
$654,250.34. This is substantially higher than the Engineer's Estimate base bid of $435,000.
STAFF RECOMMENDATION: Reject all bids and authorize rebidding over the winter of 2017/2018. The project
architect's recommendation letter is also attached
RECOMMENDED MOTION(S): Move to reject all bids for Keyes Park Improvements, Project Number 1610,
and authorize staff to seek new bids.

RE: Bid Recommendation for Keyes Park Improvements Project
Kevin,
On August 22, 2017, a Public Bid Opening was held for the Keyes Park Improvements Project. A total of two
compliant bids were received for the project. Bids ranged from $654,250.34 to $670,521.00, including all
alternates. ISG has reviewed the bid proposals and developed a bid tabulation, which is attached. There were
minor math errors associated with the low bid, but they did not affect the results or have significant impacts to
the overall project cost. The corrected total bid amounts were $654,230.34 and $670,521.00, respectively.
Upon review of the received bids, it was determined that all bids exceeded the estimated project budget. At this
time, ISG recommends that the City reject all bids at the next scheduled City Council Meeting.
ISG will continue to work with you to integrate cost - saving measures and update the plans and specifications
accordingly prior to rebidding the project in December 2017 / January 2018.
