The following are the minutes for the regular meeting of the City Council held at 7:00 PM on Monday June 12,

Project
Mayor Schmitt questioned the removal of the crosswalk signal button at the NE corner. Director Hansen
stated he will contact MnDOT.
Motion by Councilmember Murzyn, Jr., seconded by Councilmember Williams to approve a Joint Powers
Agreement with Anoka County for Construction Cost Share including Administrative Services for Storm Sewer
and Street Rehabilitation on 40th Avenue from Central Avenue to Reservoir Boulevard, City of Columbia
Heights Project 1706. All Ayes, Motion Carried.

Police Captain Lenny Austin reported that the property owner has provided an action plan, and he would like time
to review it and work with the owner. Austin suggested tabling the item until the August 14, 2017 meeting.
Motion by Councilmember Buesgens, seconded by Councilmember Novitsky to table the item until August 14,
2017. 4 Ayes, 1 Nay, Motion Carried. Ayes: Buesgens, Novitsky, Schmitt and Murzyn, Jr. Nay: Williams.
B. Resolution No. 2017 -52, a Conditional Use Permit for outdoor storage on the property located
at 725 39th Ave. NE.
City Planner Elizabeth Holmbeck reported Mark Jedele on behalf of Total Export, Inc, is requesting a Conditional
Use Permit to allow for outdoor storage on the property located at 725 39th Ave. NE. They are proposing to store
lumber, pallets, and occasionally some equipment outdoors. The applicant has proposed to add screening to the
existing fence along the adjacent residential properties and has plans to make some improvements to the exterior
of the building. The Planning and Zoning Commission unanimously recommended approval.
Motion by Councilmember Williams, seconded by Councilmember Buesgens to waive the reading of Resolution
No. 2017 -52, there being ample copies available to the public. All Ayes, Motion Carried.
Motion by Councilmember Murzyn, Jr., seconded by Councilmember Buesgens to approve Resolution No. 2017-
52, being a resolution approving a Conditional Use Permit subject to certain conditions of approval. All Ayes,
Motion Carried.
C. An appeal to the City Council, and request for a Conditional Use Permit with a waiver to a Specific
Development Standard for two K -12 Schools to operate on the property located at 3989 Central Avenue NE.
City Planner Elizabeth Holmbeck reported Nancy Aleksuk on behalf of 500, LLC has submitted an Appeal to the City
Council, and a request for a Conditional Use Permit with a waiver to a Specific Development Standard in the Zoning
Ordinance. The applicant is proposing to renovate the building to allow for two schools to operate on the property,
along with the Columbia Heights Adult Education Facility and a retail tenant. The applicant is proposing to have a K-
6th grade School and a 7 -12th grade School occupy the majority of the building.
The proposal requires a Conditional Use Permit. The applicant submitted a request for a waiver to a Specific
Development Standard of the Zoning Ordinance which requires that: the parcel upon which the K -12 School is
located shall have a lot area no less than four times the size of the building footprint.
The applicant argues that this requirement is unnecessary to the schools operation and that the proposed outdoor
playground area will meet the needs of the two schools.
The Planning and Zoning Commission held a public hearing on the request for a Conditional Use Permit with a
waiver to the Zoning Ordinance. At the meeting there was a lengthy discussion between the Planning and Zoning
Commission and the applicant regarding how the school would operate on the site. The Planning and Zoning
Commission unanimously denied the request for a waiver to a Specific Development Standard, and that the
Conditional Use Permit be denied based on the denial of the waiver request. The applicant has submitted an
Appeal to the City Council to grant the waiver as requested. Staff recommends that approximately half of the
building be reserved for commercial use, and that the first floor be retained for commercial use to ensure
compatibility with the character of the surrounding area.
Staff believes that while the applicant does not meet this requirement, they have proposed a unique, alternative
plan for an outdoor recreation area and adequate parking should be provided in the adjacent parking ramp.
However, there are concerns over how pedestrian and vehicular traffic will function on the site. By staff's literal
interpretation of the City's Zoning Ordinance, the application does not meet applicable zoning regulations (a
Specific Development Standard for K -12 Schools). However, it appears that the Findings of Fact for a Conditional
Use Permit are met. Staff recommends that if the City Council approves the Conditional Use Permit with the

requested Waiver, that the City Council direct staff to bring an Ordinance removing this requirement from the
Zoning Ordinance as not to set precedence.
Motion by Councilmember Williams, seconded by Councilmember Murzyn, Jr. to waive the reading of
Resolution No 2017 -53, there being ample copies available to the public. All Ayes, Motion Carried.
Michael Margolies, a consultant representing the applicant requested the allocation of the property be
reconsidered to allow up to 66% of the building for school use.
Councilmember Buesgens expressed concern with the lack of appropriate outdoor space. Joan Arbisi Little; Director
of Career Pathways explained they plan various offsite options for students including; parks, local libraries and
community involvement. Students will also be able to participate in MSHL sport teams. Ms. Arbisi Little reported
the traffic management plan is very important to the school.
City Attorney Jim Hoeft indicated the council will first address the waiver, if the waiver is not approved, the
conditional use and site plan are no longer applicable. If the waiver is approved, it was recommended to list
specific reasons for granting the waiver.
Mayor Schmitt questioned the reason the Planning & Zoning Commission denied the request. City Planner
Holmbeck reported the primary concerns were traffic, and pedestrian safety. Additional concerns include the fact
that the school would be occupying a large portion of the building.
Councilmember Buesgens indicated she would prefer to deny the waiver and have staff review the city code.
Hoeft stated he would prefer staff review the code, and request consideration of an ordinance to amend the
code if desired.
Councilmember Buesgens stated she has serious concerns about the request, including the location of a
school at one of the busiest intersections in the city.
Dean Dovolis; DJR Architecture, displayed a site plan of the proposed project. Dovolis showed the proposed
plan for outdoor spaces as well as the planned layout of the interior of the building.
Chris Whitehouse; DJR Architecture reported on the traffic engineer plan, indicating there is ample room for
buses, and traffic will not be queuing on 40th, Gould or Central Ave.
Mayor Schmitt asked if there was any Public Comment:
Dolores Strand asked what the names of the two schools are. Ms. Arbisi Little stated they are Skyline and Career
Pathways.
Mike Novitsky stated he is a facility manager at a charter school in St. Paul. He reported parents do not always
follow traffic rules. He also expressed concern with the proposed playground area.
Councilmember Novitsky asked if additional lighting is proposed. Mr. Dovolis said there is lighting planned, in
addition to the cement walls being removed.
Nancy Aleksuk stated that the state of Minnesota has approved the site.

Mayor Schmitt questioned if the parking ramp is public. Director Hogeboom stated it is public; the city has an
agreement indicating the owner of the building is responsible for the maintenance. Hogeboom indicated there are
numerous issues with the ramp, likely related to underuse.
Motion by Councilmember Buesgens, seconded by Councilmember Novitsky to decline the waiver to operate
two k -12 schools to operate at 3989 Central Ave NE, and request staff examine the space requirements for
elementary schools in the Central Business District to see if they need to be changes or remain the same.
Dean Dovolis indicated that if staff makes a determination in the next month or two, that will likely be too
long, and will not allow ample time to get the school opened for the 2017 -2018 school year.
Director Hogeboom described this building as challenging in attracting tenants, and mixed use is an
appropriate use. The primary concern of staff is the amount of space devoted to the school, and the most
important piece to preserve as retail would be the first floor facing Central Ave. Hogeboom reported Staff's
recommendation would be to approve the item, and direct staff to continue with the study for future
requests. Councilmember Buesgens asked the applicant if the conditional use permit allowed for 50 %, would
all of the grades fit. Ms. Aleksuk stated they could make it work with 50 %.
Mayor Schmitt stated she feels mixed use is appropriate for this space, noting there are charter schools located
downtown and schools are not always traditional.
Motion by Councilmember Buesgens, seconded by Councilmember Novitsky to decline the waiver to operate
two k -12 schools to operate at 3989 Central Ave NE, and request staff examine the space requirements for
elementary schools in the Central Business District to see if they need to be changes or remain the same.

City Attorney Jim Hoeft suggested amending condition #1 to be more specific. Buesgens reported she could
support 50 %. Novitsky agreed. Hoeft also suggested adding condition #14; Construction of gymnasium be
constructed in a way to allow other users to use the space.
Motion by Mayor Schmitt, seconded by Councilmember Williams to approve Resolution No. 2017 -53, as
amended, being a resolution approving a Conditional Use Permit with a waiver to a Specific Development Standard,
and subject to certain conditions of approval. 2 Ayes, 3 Nays, Motion failed. Ayes: Schmitt and Williams.

Director Hogeboom stated he will look at trends in other cities and report back to the council.

$2,600,000 over the 20 years remaining of the debt.
Motion by Councilmember Williams, seconded by Councilmember Murzyn, Jr. to waive the reading of
Resolution 2017 -58, there being ample copies available to the public. All Ayes, Motion Carried.
Motion by Mayor Schmitt, seconded by Councilmember Williams to adopt Resolution 2017 -58, being a
resolution awarding the sale of general obligation refunding bonds, series 2017A, in the original aggregate
principal amount of $3,265,000; fixing their form and specifications; directing their execution and delivery; and
providing for their payment. All Ayes, Motion Carried.

2017 -59, there being ample copies available to the public. All Ayes, Motion Carried.
Motion by Mayor Schmitt, seconded by Councilmember Buesgens to adopt Resolution 2017 -59, being a
resolution 2017 -59, awarding the sale of general obligation refunding bonds, series 2017B, in the original
aggregate principal amount of $8,505,000; fixing their form and specifications., directing their execution and
delivery, providing for their payment; providing for the escrowing and investment of the proceeds thereof; and
providing for the redemption of bonds refunded thereby. All Ayes, Motion Carried.
2. Resolution authorizing a tax levy increase by the City for economic development purposes.
Community Development Director Joe Hogeboom reported the Columbia Heights EDA approved Resolution
No. 2017 -14, requesting a tax levy increase by the City of Columbia Heights (for economic development
purposes. Under State Statute Section 469.107, the City Council is authorized to levy a tax for the benefit of
the EDA for economic development activities, in an amount no to exceed 0.01813 percent of the City's
estimated market land value. Thus, the EDA is requesting that the City Council increase its EDA levy to
$220,100 for taxes payable in 2018, which would be a tax levy increase of $136,100 from the taxes payable in
2017. State Statute requires a 30 -day reverse referendum period after City Council holds a public hearing,
following two successive publications of the attached resolution 2017 -56 and the notice of public hearing.
Mayor Schmitt questioned the process for renewing the contract with Anoka County.
Hogeboom explained there are a few ways the city receives money to fund economic development activities.
One way is the EDA levy, being considered tonight. Another mechanism is a levy administered by Anoka
County Housing and Redevelopment Authority. This is separate from the EDA levy and done in a 5 year cycle.
The City Council and the EDA will decide whether to renew that contract later in the summer.
Mayor Schmitt indicated she is not in favor of renewing the contract with Anoka County. Finance Director
Kloiber stated any action taken at this point will be subject to the truth in taxation meeting this fall.
Motion by Councilmember Williams, seconded by Councilmember Buesgens to waive the reading of Resolution
No. 2017 -56, there being ample copies available to the public. All Ayes, Motion Carried.

Report of the City Council
Councilmember Novitsky attended the Love Somali Feed my Starving Children event and goal setting sessions.
Novitsky announced he will be attending the League of Minnesota Cities Conference.
Councilmember Williams reported the library has almost doubled its use in the past year. Williams announced
the Sister Cities has received The Most Outstanding Sister City in the U.S for cities under 25,000 award.
Williams suggested the Council continue to work with the Charter School on their application. City Manager
Fehst commented that the council did a nice job expressing their opinions on the item.
Councilmember Buesgens planted flowers with the beautification committee, attended the Park & Recreation
meeting, the Memorial Day service, the Goal Setting sessions, Max Richter's farewell party, the HeightsNext
perennial exchange, the Planning & Zoning meeting and the Community picnic.
Mayor Schmitt reported the Community Picnic was a success. The Mayor attended the Memorial Day service,
Max Richter farewell, and the last day of school celebration at Dairy Queen.
Report of the City Manager
The City Manager reported the Jamboree will begin the week of June 21St. There is an All America City reunion
event planned for June 21St at Murzyn Hall.

Mike Novitsky requested council consider budgeting funds to allow for training opportunities for
commissioners.

Whereas, the City Council has considered the advice and recommendations of the Planning and Zoning
Commission regarding the effect of the proposed Conditional Use Permit upon the health, safety, and welfare
of the community and its Comprehensive Plan, as well as any concerns related to compatibility of uses, traffic,
property values, light, air, danger of fire, and risk to public safety in the surrounding areas;
Now, therefore, be it resolved, in accordance with the foregoing, and all ordinances and regulations of the
City of Columbia Heights, the City Council of the City of Columbia Heights makes the following:
FINDINGS OF FACT
Section 9.104 (H) of the Zoning Ordinance outlines nine conditions that must be met in order for the City
Council to grant a Conditional Use Permit. They are as follows:
(a) The use is one of the conditional uses listed for the zoning district in which the property is located,
or is a substantially similar use as determined by the Zoning Administrator.
(b) The use is in harmony with the general purpose and intent of the Comprehensive Plan.
(c) The use will not impose hazards or disturbing influences on neighboring properties.
(d) The use will not substantially diminish the use of property in the immediate vicinity.
(e) The use will be designed, constructed, operated and maintained in a manner that is compatible
with the appearance of the existing or intended character of the surrounding area.
(f) The use and property upon which the use is located are adequately served by essential public
facilities and services.
(g) Adequate measures have been or will be taken to minimize traffic congestion on the public streets
and to provide for appropriate on -site circulation of traffic.
(h) The use will not cause a negative cumulative effect, when considered in conjunction with the
cumulative effect of other uses is the immediate vicinity.
(i) The use complies with all other applicable regulations for the district in which it is located.

Further, be it resolved, that the attached plans, maps, and other information shall become part of this
Conditional Use Permit and approval; and in granting this Conditional Use Permit the City and the applicant
agree that this permit shall become null and void if the project has not been completed within one (1)
calendar year after the approval date, subject to petition for renewal of the permit. The Conditional Use
Permit is subject to certain conditions of approval that have been found to be necessary to protect the public
interest and ensure compliance with the provisions of the Zoning and Development Ordinance, including:
CONDITIONS
1. The outdoor storage area shall be accessory to a commercial or industrial use.
2. Outdoor storage within the public right -of -way is prohibited.
3. All outdoor storage areas shall meet the setback requirements for a principal structure in the zoning
district in which the use is located.
4. Outdoor storage areas shall be located in rear yards or in the side yard behind the front building line of
the principal structure.
5. The storage area shall be fenced and screened from adjacent uses and the public right- of -way.
Required screening shall consist of a fence, wall, earth berming and /or vegetation no less than six feet
in height and no less than 80% opaque on a year round basis. The fence cannot exceed 7 feet in height.
All screening will be installed within 3 months from the date the Conditional Use Permit is approved.
6. All goods, materials and equipment shall be stored on an impervious surface.
7. All goods, materials and equipment shall be stored in an orderly fashion, with access aisles of sufficient
width to accommodate emergency vehicles as needed.
8. The height of materials stored, excluding operable vehicles and equipment, shall not exceed the height
of the screening provided.
9. Combustible storage cannot be located within 10 feet of lot line. Exception to this is if the storage is
reduced to no more than 6 feet in height it can be within 3 feet of lot lines.
10. Outside storage cannot be located under unprotected eaves, canopies, projections, or overhangs of a
structure if the structure is sprinkled.
11. No truck traffic associated with the use of the property will be allowed on Jackson Street. The curb cut
off of Jackson Street cannot be used for entering or exiting.
12. Any barbed wire adjacent to residential properties must be removed.
13. The building on the subject property encroaches into the City Right of Way. The applicant must have an
encroachment agreement written which addresses any work within the City Right of Way. The
applicant must work with the Public Works Director /City Engineer to determine the terms of the
encroachment agreement. The applicant must provide a recordable document for the City to review
within 30 days of the approval of the Conditional Use Permit. The applicant is responsible for recording
the encroachment agreement with the Anoka County Recorder's Office.
14. The proposed fencing along the adjacent northern and eastern residential property lines must be 80%
opaque year round. Fencing materials must be approved by the Zoning Administrator.
15. All areas on which vehicles are parked must be paved surfaces, per the Zoning Ordinance.
16. Vehicles that are visible from the street or adjacent residential properties must be parked in an orderly
fashion, in appropriately sized and striped parking spaces, per the Zoning Ordinance.
17. Trash and /or recycling collection areas shall be enclosed on at least three sides by an opaque screening
wall or fence no less than six feet in height. The open side of the enclosure shall not face any public
street or the front yard of any adjacent property.
18. All exterior lighting shall be downcast so as not to adversely impact neighboring residential properties.

The applicant must submit a detailed lighting plan for review by the Building Official, prior to
construction.
Resolution No 2017 -54
A resolution of the City Council for the City of Columbia Heights, Minnesota,Approving State of Minnesota
Joint Powers Agreements with the City of Columbia Heights on behalf of its City Attorney and Police
Department Whereas, the City of Columbia Heights on behalf of its Prosecuting Attorney and Police
Department desires to enter into Joint Powers Agreements with the State of Minnesota, Department of Public
Safety, Bureau of Criminal Apprehension to use systems and tools available over the State's criminal justice
data communications network for which the City is eligible. The Joint Powers Agreements further provide the
City with the ability to add, modify and delete connectivity, systems and tools over the five year life of the
agreement and obligates the City to pay the costs for the network connection.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Columbia Heights, Minnesota as follows:
1. That the State of Minnesota Joint Powers Agreements by and between the State of Minnesota acting
through its Department of Public Safety, Bureau of Criminal Apprehension and the City of Columbia Heights on
behalf of its Prosecuting Attorney and Police Department, are hereby approved. Copies of the two Joint
Powers Agreements are attached to this Resolution and made a part of it.
2. That the Chief of Police, Scott Nadeau, or his successor, is designated the Authorized Representative for the
Police Department. The Authorized Representative is also authorized to sign any subsequent amendment or
agreement that may be required by the State of Minnesota to maintain the City's connection to the systems
and tools offered by the State. To assist the Authorized Representative with the administration of the
agreement, the Police Captain is appointed as the Authorized Representative's designee.
3. That the City Attorney James Hoeft, or his successor, is designated the Authorized Representative for the
Prosecuting Attorney. The Authorized Representative is also authorized to sign any subsequent amendment or
agreement that may be required by the State of Minnesota to maintain the City's connection to the systems
and tools offered by the State. To assist the Authorized Representative with the administration of the
agreement, the City Attorney's legal assistant is appointed as the Authorized Representative's designee.
4. That Donna Schmitt, the Mayor for the City of Columbia Heights, and Katie Bruno, the City Clerk, are
authorized to sign the State of Minnesota Joint Powers Agreements.
RESOLUTION NO 2017 -55
WHEREAS, on June 12, 2017, the City Council (the "Council ") of Columbia Heights, Minnesota (the "City ")
approved Ordinance No. 1640, being an ordinance that allows liquor to be served until 2:00 am; and
WHEREAS, the City may prescribe annual license fees sufficient to defray the costs incurred by it in reviewing,
investigating, and administrating applications for this action.
NOW, THEREFORE BE IT RESOLVED, in accordance with the foregoing, and all ordinances and regulations of
the City, Council hereby amends the 2017 License Fee schedule to include a $300 municipal application fee

RESOLUTION AUTHORIZING A TAX LEVY INCREASE BY THE CITY FOR ECONOMIC DEVELOPMENT PURPOSES.
BE IT RESOLVED, By the City Council ( "Council ") of the City of Columbia Heights (the "City ") as follows:
WHEREAS, the City established the Columbia Heights Economic Development Authority (the "Authority') by
an enabling resolution adopted on January 8, 1996, pursuant to Minnesota Statutes 469.090 to 469.1081 (the
"EDA Act "); and
WHEREAS, the Council has given to the Authority the responsibility for all economic development and
redevelopment projects and programs; and
WHEREAS, under Section 469.107 of the EDA Act, the City is authorized to levy a tax for the benefit of the
Authority, in an amount not to exceed 0.01813 percent of the City's estimated market value (the "EDA Levy');
and
WHEREAS, the City currently levies an EDA Levy of 0.01813 percent of the City's estimated market value, or
$84,000, as authorized by the EDA Act; and
WHEREAS, the City is authorized to increase its EDA Levy beyond the statutory cap as provided in Section
469.107, subd. 2 of the EDA Act, upon the request of the Authority; and
WHEREAS, the Authority has requested that the City increase its EDA Levy to $220,100 for taxes payable in
2018, in order to better serve the Authority's economic development activities within the City, representing an
increase of $136,100.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Columbia Heights, as follows:
1. The request by the Authority for an increase in the City's EDA Levy in the amount of $136,100 for taxes
payable in 2018, for a total EDA Levy of $220,100, is hereby approved, subject to publication of this Resolution
along with a notice of public hearing on this Resolution in substantially the form attached as Exhibit A (the
"Notice ") for two successive weeks in the official newspaper of the City, and the holding of a public hearing on

WHEREAS, the City of Columbia Heights enter into MnDOT Agreement No. 1027707 for the following

To provide for maintenance by the City of Columbia Heights of the sidewalk and lighting roadway
improvements construction and other associated construction to be performed upon, along, and adjacent to
TH 65 (Central Avenue) from 47th Avenue NE to 51st Avenue NE, within the corporate city limits under City
Project No. 1608 and State Project Nos. 113 - 010 -022 and 0207 -116.

collaboration, and have determined that having the ability to write "work orders" against a master contract

future. Hogeboom gave an overview of the proposed guidelines, indicating requests will be reviewed by the
City Council on a case by case basis.
Mayor Schmitt questioned who will be responsible for the maintenance of the items. Hogeboom explained
the current proposal is largely funded through a grant from the MWMO. Public Works will perform the
installation. Hansen reported maintenance on the existing public art areas is done by either the original
contractor or city staff.
City Logos and Taglines Usage Guidelines Discussion
Community Development Director Joe Hogeboom reported it had been recommended by the City Attorney
that a set of guidelines be established that guide both internal and external usage of the City's official logos
and taglines.
Mayor Schmitt commented that the All America City tagline may appear to be out of date. Manger Fehst
reported a neighboring city displayed the award for about five years. Hogeboom explained the All America
City does not have to be used, it is optional.
Review proposed change to late fee for delinquent utility charges
Assistant Finance Director Jackie Zillmer reported staff will need to amended the fee schedule to address late
fees on delinquent utility accounts. Staff is proposing a change from 5% of the current bill to 7% off the
outstanding balance.
Discussion of Refuse Rates — Disposal and tipping fees
Director of Public Works Kevin Hansen reported the contract with the current hauler is coming due.
Bids will be presented to the council soon. The City has operated our refuse and recycling collection as an
organized collector for over 30 years. For the initial 20 years, the same hauler (last known as Allied) provided
our service. When their contract was ending in 2009, the City utilized an RFP process to obtain the best
prices for service. In 2010, Veolia (now known as Advanced Disposal) began servicing the City. With the new
contract, in an effort to control costs, the City chose to pay for disposal by weight as a separate line item.
A resource recovery facility has operated in the county since 1990. This facility creates electricity by burning
trash. Initially called RRT, the facility was sold in 2010 to the electrical provider Great River Energy or GRE. For

a number of years, the County had subsidized the cost of operating the RRT to remain competitive with
landfill disposal costs. With the sale to GRE, the County subsidy was transitioned out. Costs have increased
about 50% since 2010.
Director Hansen reported for an organized city all municipal waste is required to go to GRE. Bringing 100% of
refuse to GRE, would result in a cost increase of approximately $70,000. Staff will need to prepare an RFP,
consistent with both statuary language and the Anoka County Solid Waste Management Plan.
Councilmember Buesgens questioned if costs would reduce if recycling increases. Hansen reported haulers
are paid based on number of pickups and tonnage.
Circle Terrace Park Building bids
Director of Public Works Kevin Hansen reported two builders were contacted to review the plans. The
builders estimate this to be a $275,000 project. The bids came in significantly higher. Hansen reported costs
are up about 20% in the building trades, contractors are very busy.
Options include rebidding with a more flexible completion date. Hansen reported the funding source of
$237,000 need to be requested by the end of the year, or we lose the funding. Currently staff is looking for
ways to reduce the cost of the project, and additional funding sources. Hansen hopes to bring this to the
council in June or July.
1087 Polk Circle Storm Water Overflow
Director of Public Works Kevin Hansen explained a joint storm sewer project was completed with the City of
Fridley in the 1980's. The area between the La Casita Parking lot and 1087 Polk Circle has a 30 foot easement
and is a relatively flat, low area and has repeatedly surcharged, overtopped and flooded during significant
storm events. With the platting of the three parcels and the addition of Planet Fitness, a small portion of this
overflow area will now become a parking lot. Due to the history of surface flooding, staff required all of the
storm water from Planet Fitness be directed out to existing piping on 51st Court. To improve and adequately
protect the property at 1087 Polk Circle, staff is proposing some minor storm sewer improvements along with
regrading to create an overflow.
Staff has been in contact with the owner of 1087 Polk Circle and he is agreeable to re- grading the rear of his
property to provide an overflow area during significant storm events. The cost of the improvements will be
shared with the City of Fridley under the existing storm sewer cost share agreement from when this system
was originally put in.

BACKGROUND:
The Metropolitan Council (the "Met Council ") offers a variety of incentive -based livable community grant
programs. These programs are intended to leverage private and public partnerships to help communities
achieve their regional and local goals of development. The City of Columbia Heights (the "City ") established
several local development goals in 2010 with the adoption of the 2030 Comprehensive Plan, one of which
identified a need to provide a variety of life cycle housing opportunities with the incorporation of affordable
housing options that are 60% of the area median income (the "AMI "), specifically development projects that
incorporate workforce housing.
Since Dominium has proposed the development of a multi - family, workforce housing project on the corner of
47th and Grand Avenue, located at 1069 Grandview Court NE and 4729 Grand Avenue NE, Columbia Heights
(the "Subject Project "), and in conjunction with their two requests for public financial assistance, staff
recommended that application be made to the Livable Communities Demonstration Account (the "LCDA ")
development grant program offered through the Met Council.
The LCDA development grant program is a funding source intended to support development projects that
incorporate affordable, workforce housing and demonstrate an efficient and cost - effective use of land and
infrastructure. Eligible applicants are required to be a local governmental unit, such as a city, town, county,
economic development authority, or housing and redevelopment authority. Thus, Dominium would not be
able to solely apply for LCDA development grant funding. They would need to partner with a local
governmental unit to act as a legal sponsor on their behalf in order to be eligible for LCDA development grant
funding.
Therefore, Dominium would like to partner with the City to apply for LCDA development grant funds in the
amount of $750,000 for the Subject Project to provide financial assistance with site acquisition; improvement
of public infrastructure including, but not limited to sidewalks, trails, transit shelters, and bike facilities; and
placemaking such as, lighting, landscaping, seating, and other furnishings. An application has been prepared
for submittal, but because Dominium is requesting the City to sponsor them, the City Council needs to
approve a resolution authorizing the submittal of the application. If Resolution 2017 -69 is approved, staff will
submit the attached application on or before the due date of June 29, 2017 to the Met Council.
STAFF RECOMMENDATION:
Staff recommends approving Resolution 2017 -69, a resolution identifying the need for the Livable
Communities Demonstration Account funding and authorizing the submittal of an application for grant funds.

RESOLUTION IDENTIFYING THE NEED FOR LIVABLE COMMUNITIES DEMONSTRATION ACCOUNT FUNDING
AND AUTHORIZING AN APPLICATION FOR GRANT FUNDS
BE IT RESOLVED BY the City Council (the "Council ") for the City of Columbia Heights, Minnesota (the "City') as
follows:
WHEREAS, the City is a participant in the Livable Communities Act's Housing Incentives Program for 2017 as
determined by the Metropolitan Council (the "Met Council "), and is therefore eligible to apply for Livable
Communities Demonstration Account (the "LCDA ") funds; and
WHEREAS, the City has identified a proposed project within the City that meets the LCDA's purposes and
criteria and is consistent with and promotes the purposes of the Metropolitan Livable Communities Act and
the policies of the Met Council's adopted metropolitan development guide; and
WHEREAS, the City has the institutional, managerial and financial capability to ensure adequate project
administration; and
WHEREAS, the City certifies that it will comply with all applicable laws and regulations as stated in the grant
agreement; and
WHEREAS, the City agrees to act as legal sponsor for the project contained in the grant application submitted
on or before June 29, 2017; and
WHEREAS, the City acknowledges LCDA grants are intended to fund projects or project components that can
serve as models, examples or prototypes for development or redevelopment projects elsewhere in the region,
and therefore represents that the proposed project or key components of the proposed project can be
replicated in other metropolitan -area communities; and
WHEREAS, only a limited amount of grant funding is available through the Met Council's LCDA during each
funding cycle and the Met Council has determined it is appropriate to allocate those scarce grant funds only to
eligible projects that would not occur without the availability of Demonstration Account grant funding.
NOW, THEREFORE BE IT RESOLVED that after appropriate examination and due consideration, the governing
body of the City:
Finds that it is in the best interests of the City's development goals and priorities for the proposed
project to occur at this particular site and at this particular time; and
2. Finds that the project component(s) for which LCDA funding is sought would not occur solely through
private or other public investment within the reasonably foreseeable future and will occur within three
years after a grant award only if LCDA funding is made available for this project at this time.
3. Represents that the City has undertaken reasonable and good faith efforts to procure funding for the
project component for which LCDA funding is sought but was not able to find or secure from other
sources funding that is necessary for project component completion within three years and states that
this representation is based on the following reasons and supporting facts:

In a continued effort for the City to support the incorporation of quality demonstration design
elements that encourage public interaction; create connections to local transit services; and

4. Authorizes its City Manager to submit on behalf of the City an application for Met Council LCDA grant

west building situates the common amenity areas, which are socially active and more carefully articulated on
the exterior, to face toward the main road (Central Ave). This provides and visually attractive addition to the
area while also providing a neighborhood sense presence of neighbors for pedestrians on Grand Ave. Parking
is accessible through new roads that connect through Grand Ave. Direct access to roads through the existing
neighborhood are minimized.

innovative bcause it offers the benefits of both an urban setting such as access to high quality public
transporation along with high desnity housing. Additionally, this project also offers the advantages of being in a
suburban location. Being walking distance to all three levels of public schools, numerous parks, and
retail /restaurants gives residents opportunities to rely on transporation methods other than automoblies. This
project will have unique amenities including two separate outdoor play structures as well as a indoor structure
for children of all ages, a school bus stop shelter and sidewalks all corners of the site to the main streets for
easy access.

necessary. The LCDA grant is highly critical to this project in it's feasibility to be able to build a 100%
affordable apartment complex where charged rents will be severty under market rate. With the current
economic status in limbo due to tax reform, tax credit equity investors are more conservative than in recent
years in providing equity. As a result, affordable housing developer are struggling to find ways of raising enough
funds to make projects finanacially feasible. As a result, less affordable developements are happening and in a
time when there is such a high demand for affordable housing.

time staff sizing on a per unit basis. This calculation was done on this project to determine that it will create
four full time jobs. For the temporary jobs, the developer consulted with a General Contractor who was done
several similar projects in recent years to determine an average per unit job amount. The temporary job amount
in 1 -3 is specifically tradespeople who worked on the project.

Briefly explain the overa / /pubiic engagement strategy(ies) used, the potential for the project to produce meaningful public involvement,
and the process to date.
The public has and will have a very active role in the design and features of this project. On May 17th, the
developers hosted an open neighborhood meeting at the Columbia Heights Public Library. Neighbors and
residents of Columbia Heights attended and were able to ask questions as well as give their input on the
development as well as the design and other features. These comments were taken with serious
consideration. Originally considering developing a one building project, based on feedback from the
neighborhood meeting, this plan was replaced with the current two building plan. The comments of opening the
land space and allowing for more pedestrian walkways throughout the site was incorpoarated into the latest
design. As a result of the impact the neighbors had, the developers will be holding another neighborhood
meeting to present the latest plans that were created based on the feedback received. Additionally, several
meetings have or will occur with the City so far including: city planning meeting, EDA worksession, City
Council worksession and a Planning and Comission meeting. These meetings are highly critical in developing
a project that is accepted by everyone.

developers have met several times with both the condo assocation and larger master assocation. These
meetings have been highly critical in listening to what condo and townhome owners think and feel about the
project. As a result, the developer have taken into consideration these comments and incorporated them into
the site design. These include more access to the site, pedestrian walkways, and traffic control including the
addition of curb bump outs.

concerns of congestion and lack of circular traffic on the site which the developers took into consideration in
updating the design.

There has been some oppostion from the neighboring condo owners who have voiced their displeasure over
rental housing. Originally, this site was supposed to be a third phase of the adjacent condos in which two more
condo buildings would be built. This plan, however, fell through. The condo owners are concered becasue they

BACKGROUND:
Pursuant to State Statutes, Sections 469.090 to 469.1082, and specifically Section 469.1082, subd 1 through 4,
a county may form an economic development authority or may grant economic development powers to an
existing county housing and redevelopment authority. Thus, in 2007 after the required procedures were met,
Anoka County (the "County ") granted economic development powers to their existing County Housing and
Redevelopment Authority (the "ACHRA "). The ACHRA may levy an additional property tax in cities or
townships that adopt a resolution electing to participate in the economic development activities.
Previously, the City of Columbia Heights (the "City ") City Council (the "Council ") has elected to participate in
the ACHRA's economic development activates from 2007 to 2017 with the adoption of Resolution 2007 -156
and 2012 -142. And, over the past ten (10) years, the ACHRA levy has provided the City with essential gap
financing assistance for land acquisition, site investigation, remediation, and building demolition that has
directly correlated to creation of local job opportunities, redevelopment of substandard /underutilized
property, improvement of the aging housing stock, and expansion of the local tax base.
Participating cities or townships may elect to withdraw participation every fifth year following adoption of a
resolution electing to participate. Since Resolution 2012 -142 was passed on November 13, 2012, the City
would need to adopt a withdrawal resolution by November 13, 2017; however, if a City desires to withdraw
participation, written notice must be sent neither less than 90 days nor more than 180 days prior to November
13, 2017. Therefore, the Council needs to determine if participation in the ACHRA's economic development
activities for another five years would benefit the residents of the City on or before August 14, 2017.
STAFF RECOMMENDATION:
Staff recommends approval of Resolution 2017 -70 for continued participation in the ACHRA economic
development activates for another five (5) years.
RECOMMENDED MOTION(S):

RESOLUTION AUTHORIZING THE APPROVAL OF PARTICIPATION IN THE ANOKA COUNTY HOUSING AND
REDEVELOPMENT AUTHORITY'S ECONOMIC DEVELOPMENT ACTIVITIES FOR THE FISCAL YEARS 2018 to 2022
BE IT RESOLVED BY the City Council (the "Council ") of the City of Columbia Heights, Minnesota (the "City ") as
follows:
WHEREAS, the City is part of Anoka County (the "County "), and such is a rapidly growing and important
segment of the Twin Cities Metropolitan Region, made up of rich variety of vital, desirable communities; and
WHEREAS, the Council has determined that the residents of the City would realize many benefits from
expansion of the County tax base, including but not limited to; the creation of local job opportunities,
redevelopment of property throughout the City, as well as maintaining and improving the housing stock, wider
sharing of tax burden, and access to enhanced infrastructure, services, and retail and business activities; and
WHEREAS, in order to expand the local tax base, the County Board of Commissioners has indicated an interest
in fostering a regional approach to economic development in the County; and
WHEREAS, in 2007 a statutorily formed citizens exploratory committee recommended to the Board of
Commissioners that the County Housing and Redevelopment Authority (the "County HRA ") be granted the
powers of an economic development authority; and
WHEREAS, on June 12, 2007, the County Board of Commissioners, after fulfilling the statutory requirements,
did authorize the County HRA to exercise said powers of an economic development authority; and
WHEREAS, MN Stat. 469.1082 requires that a municipality shall, declare its willingness, by resolution, to join
the county in its economic development activities; and
NOW, THEREFORE BE IT RESOLVED, that the City does hereby declare its support of the County and its
countywide economic development objectives and activities; and
BE IT FURTHER RESOLVED, that the City does hereby elect to participate in the County HRA economic
development activities for the fiscal years 2018 through 2022.

At the March 6t" 2017 City Council work session, the City Council asked staff to consider discontinuing the use
of water shut -off as a routine collection procedure for delinquent utility bills. The City Council also directed
staff to survey surrounding communities on the matter.
Staff received responses from 22 municipal utility billing departments located in the North Metro Area. The
principal findings are:
I. The only respondent that uses shut -off for routine collection is the City of Becker.
The reported policy implementation commonly occurred from 10 to over 20 years ago. The City of
Saint Anthony was an exception, in that they report implementing only within the last few years.
About a quarter of the respondents report that they still retain the ability to shut -off for collection. We
suspect that several of the other respondents also retain the ability to shut -off for collection, but their
current staff may not be aware of this, due to turnover.
4. The reported volume of delinquent assessments is 3% - 5% of annual utility revenue. For the City of
Columbia Heights, that would be approximately $300,000 in delinquent bills, compared to the most
recent annual total of approximately $50,000.
5. The City's one -time late fee of 5% is clearly on the low end of the reported range of late fees, with 10%
being both the highest and the most common rate reported. Respondents were about equally split
between one -time late fees and recurring late fees. All respondents also charge a separate
administrative fee for the special assessment certification process itself.
STAFF RECOMMENDATION:
Staff recommends discontinuing the use of shut -off for routine collection. In a time of stable property
ownership, outsourcing routine collections to Anoka County through the special assessment process is
administratively relatively efficient, compared to the existing practice. Currently, staff negotiates and
manages a payment plan with each delinquent customer, per the last direction on this matter from the City
Council. The recommended change would also enhance the safety of City staff by substituting the
consequence of a sheriff's sale for non - payment, in place of the current consequence of shut -off by public
works staff, followed by revocation of occupancy by the City building official.

Staff strongly recommends that the following related steps also be taken to ensure the success of the new
policy:
1. Revise the existing late fee to keep the financial burden of the expected increase in delinquency from
being carried by the customers that pay their bills timely. Based on both the survey of surrounding
communities and on current interest rates, staff recommends a late fee of 7% on the outstanding
delinquent balance, calculated at each quarterly billing due date.
2. Discontinue grandfathering tenant names on customer accounts established prior to 2014. The City's
policy since 2014 has been to establish all new accounts only in the property owner's name. Clarifying
that the property owner is ultimately responsible for the utility bill will be important with the expected
increase in tenants leaving utility charges to be paid by assessments to the property owner as a result
of this policy change.
3. Retain the current shut -off ordinances as an infrequently -used option for circumstances where
collection by special assessment is not applicable. Examples include tax - forfeit property and repair
situations which prevent accurate billing. Staff recommends that these shut -off fees be limited to $75
per occurrence, discontinuing the additional $25 currently added for each repeated occurrence. First, it
is unlikely that the recurring charge would ever apply under the new policy. Second, past experience
has also shown that when the repeat charge has been applied, it has not improved collection rates at
all. Consequently, the administrative burden of tracking the repeat charge has outweighed its intended
benefit.
Staff recommends adopting the motions below.

A RESOLUTION OF THE CITY COUNCIL FOR THE CITY OF COLUMBIA HEIGHTS, MINNESOTA, ESTABLISHING
FEES FOR LATE PAYMENT OF UTILITY BILLS AND FOR WATER SERVICE SHUT - OFF /TURN -ON.
Whereas, the rates for water, sewer, and refuse services provided and billed by the City of Columbia Heights
are established by Resolution 2015 -98; and
Whereas late payment of utility bills and other noncompliance by utility customers with regard to City
ordinances regulating water, sewer, and refuse, add to the cost of the utility services provided by the City; and
Whereas, certain fees must be imposed upon such delinquent or noncompliant customers, in order that these
additional costs are not borne by the majority of the City's utility customers, who pay their utility bills on a
timely basis and comply with the City ordinances regulating water, sewer, and refuse services;
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of Columbia
Heights, the City Council of the City of Columbia Heights makes the following:
ORDER OF COUNCIL
IT IS HEREBY RESOLVED, effective August 1, 2017:
1. A late fee of 7% is imposed on any utility charges not paid by the due date stated on the customer bill,
including taxes and all fees other than prior late fees.
2. The late fee in item 1 above will be calculated and billed at each quarterly billing due date, and if
applicable at the final billing date for terminated accounts, until the delinquent portion is paid in full.
3. A fee of $75 per occurrence is imposed for the shut - off /turn -on of water service, when initiated by the
City due to late payment or other customer noncompliance with City ordinances regulating water,
sewer, and refuse.
4. A fee of $25 per occurrence is imposed for the shut - off /turn -on of water service, when water service
shut - off /turn -on is requested by the customer.
BE IT FURTHER RESOLVED that the foregoing does not preclude the City from any other collection or
enforcement procedures legally available.

BACKGROUND: At the City Council meeting on May 1, 2017, Council authorized staff to seek bids for street
rehabilitation of 39th Avenue including new sidewalk on the south side, from Central Avenue to the Huset
Parkway Roundabout.
ANALYSIS /CONCLUSIONS: Currently cash available from city inter -fund loans to fund the utility construction
is limited. For this reason, there is a potential for bonding for street rehabilitation on 39th Avenue. The fact
that bonding rates are at their lowest point in years makes bonding a very viable financing option.
STAFF RECOMMENDATION: To keep the potential bonding alternative open, a resolution declaring the intent
to bond should be approved by the City Council prior to awarding bids. This has been done for both Utility and
Street Rehabilitation construction projects since 1998. It should be noted that the resolution does not commit
the City to bonding or the dollar amount stated, but keeps the option for bonding open in the future, up to the
dollar amount specified.
RECOMMENDED MOTION(S): Move to waive the reading of Resolution 2017 -67, there being ample copies
available to the public.
Move to adopt Resolution 2017 -67, being a resolution approving the declaration for the official intent of the
City of Columbia Heights to bond for the 39th Avenue State Aid Street Rehabilitation, Central Avenue to Huset

A resolution of the City Council for the City of Columbia Heights, Minnesota,
WHEREAS, the Internal Revenue Service has issued Tres. Reg. 1.140.2 providing that proceeds of tax exempt
bond used to reimburse prior expenditures will be not be deemed spent unless certain requirements are met;
and,
WHEREAS, the City of Columbia Heights (the "City ") expects to incur certain expenditures which may be
financed temporarily from sources other than bonds, and reimbursed from the proceeds of a bond;
Now therefore, in accordance with the foregoing, and all ordinances and regulations of the City of Columbia
Heights, the City Council of the City of Columbia Heights makes the following:
FINDINGS OF FACT
1. The City reasonably intends to make expenditures for State Aid Street Rehabilitation, Project No. 1705,
from Central Avenue to Huset Parkway Roundabout, and reasonably intends to reimburse itself for such
expenditures from the proceeds of debt to be issued by the City in one or more series in the maximum
principal amount of $325,000.
2. This resolution is intended to constitute a declaration of official intent for purposes of Tres. Reg. 1.150 -2
and any successor law, regulating or ruling.

BACKGROUND: Annually, Public Works staff cleans and inspects portions of the sanitary and storm sewer
system, including pipe and structures. Through underground televising, staff has determined that the sanitary
locations identified below will need pipe segments replaced. In these areas the pipe has lost shape, pipe
segments are missing or the pipe has settled significantly which decreased pipe capacity or limits the access of
our televising camera to get through. The condition of structures is determined through visual inspections. In
addition, catch basins are being added at 2 locations to minimize localized flooding.
Sanitary Sewer System
These projects involve spot removals, construction, and restoration at the following locations:
East of TH 47, 37th Avenue to Naegle Avenue Royce Street, McLeod Street to 44th Avenue
(Abandon unused pipe and manholes) Tyler Street, 42nd Avenue to 44th Avenue
37th Avenue, east of Reservoir Boulevard Arthur Street, 39th Avenue to 42nd Avenue
Taylor Street, north of 45th Avenue
Storm Sewer System
These projects involve removals, construction
restoration at the following locations:
49th Avenue, west of Washington Street
Monroe Street, north of 48th Avenue
Central Avenue, near 4801 Central Avenue
of storm sewer manholes, catch basins and /or pipe, and
Gould Avenue, east of Central Avenue
45th Avenue, west of Keyes Park
STAFF RECOMMENDATION: Staff recommends awarding the base bid with storm sewer realignment and
alternate 1. Alternate 1 provides the option to directionally drill the storm sewer pipe across 49th Avenue
(CSAH 4), as may be required by Anoka County. Funding will be $114,490 Sanitary Sewer fund, $97,465 Storm
Sewer fund, $37,975 Municipal State Aid Construction, and $103,585 Municipal State Aid Maintenance fund.
RECOMMENDED MOTION(S): Move to waive the reading of Resolution 2017 -68, there being ample copies
available to the public.
Move to adopt Resolution 2017 -68 being a resolution accepting bids and awarding the 2017 Sanitary and
Storm Sewer Repairs and Installations, City Project No. 1711, to Northdale Construction Company, Inc. of
Albertville, Minnesota, based upon their low, qualified, responsible bid in the amount of $353,512.10 from
Fund 651 - 51711 -4000; and, furthermore, to authorize the Mayor and City Manager to enter into a contract for

BACKGROUND:
On May 1, 2017, the Columbia Heights Economic Development Authority (the "EDA ") received a financial
application for the City of Columbia Heights (the "City ") to issue tax - exempt bonds on behalf of Dominium in
connection with the proposed acquisition and construction of a multi - family housing development located at
1069 Grandview Court NE and 4729 Grand Avenue NE, Columbia Heights (the "Subject Project ").
In accordance with the provisions of Minnesota State Statutes, the City is authorized to develop and
administer a housing program to provide for the financing of new construction or the acquisition and
rehabilitation of an existing building and site for the purpose of providing a multi - family housing development.
Furthermore, State Statutes also provides that such programs for multi - family housing developments may be
financed by revenue bonds or obligations issued by the City.
Thus, Dominium has requested that the City finance the Subject Project with the issuance of tax - exempt
conduit revenue bonds (the "Tax- Exempt Bonds "), in one or more series, in a principal amount not to exceed
$45,000,000. Bonds of this type are not an obligation of the City or its taxpayers, rather an obligation of the
developer. Only project revenues of the developer, typically rent collected after project completion would be
pledged for repayment of the Tax - Exempt Bonds.
The City has previously issued Tax - Exempt Bonds for other various developments, such as the Sullivan Shores
townhomes, Crestview senior care facilities, the Columbia Park Clinic, and Legends of Columbia Heights. And
with issuance of Tax - Exempt Bonds, the City Council has required that the developer reimburse the City for all
the costs associated to issuance of the bonds, as well as pay an issuance fee in the amount of one percent
(1 %) of the principal amount issued for the Tax - Exempt Bonds. In the case of the request by Dominium, the
City would realize an issuance fee in the amount of $450,000.
Before the City may issue Tax - Exempt Bonds on behalf of Dominium, the City must first adopt a preliminary
resolution approving the issuance of Tax - Exempt Bonds specific to the Subject Property, and submit a Housing
Program to the Metropolitan Council for consideration. Once the Metropolitan Council approves the housing
program, the City will need to prepare and submit an application requesting allocation of multi - family housing
bonds to the Minnesota Department of Management and Budget (the "State "). Allocations of multi - family
housing bonds are released January and August of each year. Therefore, Dominium has requested that the
City Council consider approval of the Resolution 2017 -71 in order for application to be made for the August
2017 allocation of multi - family housing bonds from the State.
Furthermore, tonight also services as the duly required public hearing for residents desiring to be heard
regarding the matter. Notice of the public hearing was sent out and published in the Sun Focus newspaper on
Friday, June 2, 2017. If approved and after receiving State allocations of multi - family housing bonds, an
issuance resolution will be presented before City Council for final approval.

ADOPTING A HOUSING PROGRAM WITH RESPECT TO A MULTIFAMILY
HOUSING PROJECT; GRANTING PRELIMINARY APPROVAL FOR THE
ISSUANCE OF MULTIFAMILY HOUSING REVENUE BONDS TO FINANCE
THE PROJECT UNDER MINNESOTA STATUTES, CHAPTER 462C, AS
AMENDED; AND AUTHORIZING THE REIMBURSEMENT OF
EXPENDITURES MADE IN ANTICIPATION OF THE ISSUANCE OF SUCH
BONDS
BE IT RESOLVED by the City Council of the City of Columbia Heights, Minnesota (the "City"),
as follows:
Section 1. Recitals.
1.01. The City is a home rule charter city duly organized and existing under the Constitution
and laws of the State of Minnesota.
1.02. Pursuant to Minnesota Statutes, Chapter 462C, as amended (the "Housing Act "), the City
is authorized to carry out the public purposes described in the Housing Act by providing for the issuance
of revenue bonds or other obligations to finance or refinance multifamily housing developments located
within the City. As a condition to the issuance of revenue bonds under the Housing Act, the City must
adopt a housing program providing the information required by Section 462C.03, subdivision 1 a of the
Housing Act (the "Housing Program "). A public hearing must be held in accordance with the
requirements of Section 147(f) of the Internal Revenue Code of 1986, as amended (the "Code "), and
regulations promulgated thereunder (the "Regulations "), and the requirements of the Housing Act. The
City Council of the City (the "Council ") must also grant preliminary approval to the issuance of revenue
bonds to finance the multifamily housing development referred to in the Housing Program, and authorize
the submission of an application to Minnesota Management & Budget for an allocation of bonding
authority with respect to the Bonds (as hereinafter defined) to finance the Project (as hereinafter defined).
1.03. Columbia Heights Leased Housing Associates III, LLLP, a Minnesota limited liability
limited partnership (the `Borrower "), has proposed that the City, pursuant to the Housing Act, issue its
revenue bonds in an aggregate principal amount not to exceed $45,000,000, in one or more series (the
"Bonds "), the proceeds of which will be loaned by the City to the Borrower. The Borrower will apply the
proceeds of such loan to: (i) the acquisition, construction, and equipping of a multifamily housing facility
comprised of up to 190 affordable rental apartments to be located in two four -story buildings, together
with related common amenity spaces, including a fitness facility, a club room, and 140 or more
underground parking spaces and an additional 130 or more surface parking spaces, to be located at 1069
Grandview Court NE and 4729 Grand Avenue NE in the City (the "Project "); (ii) the funding of one or
more reserve funds to secure the timely payment of the Bonds; (iii) the payment of interest on the Bonds
during the construction of the Project; and (iv) the payment of the costs of issuing the Bonds.
1.04. Under Section 147(f) of the Code, prior to the issuance of the Bonds a public hearing
duly noticed must be held by the Council. Under Section 462C.04, subdivision 2 of the Act, a public
hearing must be held on each housing program after one publication of notice in a newspaper circulating
generally in the City, at least fifteen (15) days before the hearing.

1.05. Under Section 146 of the Code, the Bonds must receive an allocation of the bonding
authority of the State of Minnesota. An application for such an allocation must be made pursuant to the
requirements of Minnesota Statutes, Chapter 474A, as amended (the "Allocation Act ").
Section 2. Preliminary Findings. Based on representations made by the Borrower to the City to
date, the Council hereby makes the following preliminary findings, determinations, and declarations:
(a) The Project consists of a housing development designed and intended to be used for
rental occupancy.
(b) The proceeds of the Bonds will be loaned to the Borrower and the proceeds of the loan
will be applied to: (i) the acquisition, construction, and equipping of the Project; (ii) the funding of one or
more reserve funds to secure the timely payment of the Bonds; (iii) the payment of interest on the Bonds
during the construction of the Project; and (iv) the payment of the costs of issuing the Bonds. The City
will enter into a loan agreement (or other revenue agreement) with the Borrower requiring loan
repayments from the Borrower in amounts sufficient to repay the loan when due and requiring the
Borrower to pay all costs of maintaining and insuring the Project, including taxes thereon.
(c) In preliminarily authorizing the issuance of the Bonds and the financing of the
acquisition, construction, and equipping of the Project and related costs, the City's purpose is and the
effect thereof will be to promote the public welfare of the City and its residents by retaining and
improving multifamily housing developments and otherwise furthering the purposes and policies of the
Housing Act.
(d) The Bonds will be limited obligations of the City payable solely from the revenues
pledged to the payment thereof, and will not be a general or moral obligation of the City and will not be
secured by or payable from revenues derived from any exercise of the taxing powers of the City.
Section 4. Public Hearing. On the date hereof (June 26, 2017), the Council conducted a public
hearing on the Housing Program, the Project, and the issuance of the Bonds, notice of which hearing (the
"Public Notice ") was published as required by Minnesota Statutes, Section 462C.04, subdivision 2 of the
Housing Act, and as required by Section 147(f) of the Code and applicable Regulations promulgated
thereunder. The Public Notice provided a general, functional description of the Project, as well as the
maximum aggregate face amount of the obligations to be issued for the purposes referenced above, the
identity of the initial owner, operator, or manager of the Project, and the location of the Project. The
Public Notice was published in the Sun Focus, the official newspaper and a newspaper circulating
generally in the City, on June 2, 2017, a date at least fifteen (15) days before the meeting of the Council
on June 26, 2017. At the public hearing a reasonable opportunity was provided for interested individuals
to express their views, both orally and in writing, on the Project and the proposed issuance of the Bonds.
Section 5. Housing Program. Bond counsel, as described below, prepared and submitted to the
City a draft Housing Program to authorize the issuance by the City of the Bonds, in an aggregate principal
amount not to exceed $45,000,000, to finance the acquisition, construction, and equipping of the Project
by the Borrower. The Housing Program was prepared and submitted to the Metropolitan Council for its
review on or before the date of publication of the Public Notice.
Section 6. Preliminary Approval. The Council hereby provides preliminary approval to the
issuance of the Bonds, in the aggregate principal amount not to exceed $45,000,000, to finance all or a
portion of the costs of the Project pursuant to the Housing Program of the City, subject to: (i) review of
the Housing Program by the Metropolitan Council; (ii) receipt of an allocation of the bonding authority
from the State of Minnesota; (iii) final approval following the preparation of bond documents; and

(iv) final determination by the Council that the financing of the Project and the issuance of the Bonds are
in the best interests of the City.
Section 7. Submission of an Application for an Allocation of Bonding Authority. Under
Section 146 of the Code, the Bonds must receive an allocation of the bonding authority of the State of
Minnesota. An application for such an allocation must be made pursuant to the requirements of the
Allocation Act. The Council hereby authorizes the submission of an application for allocation of bonding
authority pursuant to Section 146 of the Code and the Allocation Act. The Mayor of the City, the City
Manager, and Kennedy & Graven, Chartered, acting as bond counsel for the City with respect to the
Project and the Bonds, are hereby authorized and directed to take all actions, in cooperation with the
Borrower, as are necessary to submit an application for an allocation of bonding authority to Minnesota
Management & Budget.
Section 8. Reimbursement of Costs under the Code.
8.1. The United States Department of the Treasury promulgated by Section 1.150 -2 of the
Regulations, which governs the use of the proceeds of tax - exempt bonds, all or a portion of which are to
be used to reimburse the City or the Borrower for project expenditures paid prior to the date of issuance
of such bonds. Section 1.150 -2 of the Regulations requires that the City adopt a statement of official
intent to reimburse an original expenditure not later than sixty (60) days after payment of the original
expenditure. Section 1.150 -2 of the Regulations also generally requires that the bonds be issued and the
reimbursement allocation made from the proceeds of the bonds occur within eighteen (18) months after
the later o£ (i) the date the expenditure is paid; or (ii) the date the project is placed in service or
abandoned, but in no event more than three (3) years after the date the expenditure is paid. The
Regulations generally permit reimbursement of capital expenditures and costs of issuance of the bonds.
8.2. To the extent any portion of the proceeds of the Bonds will be applied to expenditures
with respect to the Project, the City reasonably expects to reimburse the Borrower for the expenditures
made for costs of the Project from the proceeds of the Bonds after the date of payment of all or a portion
of such expenditures. All reimbursed expenditures shall be capital expenditures, a cost of issuance of the
Bonds, or other expenditures eligible for reimbursement under Section 1.150- 2(d)(3) of the Regulations
and also qualifying expenditures under the Housing Act.
Based on representations by the Borrower, other than (i) expenditures to be paid or reimbursed
from sources other than the Bonds, (ii) expenditures permitted to be reimbursed under prior regulations
pursuant to the transitional provision contained in Section 1.150- 20)(2)(i)(B) of the Regulations,
(iii) expenditures constituting preliminary expenditures within the meaning of Section 1.150- 2(f)(2) of the
Regulations, or (iv) expenditures in a "de minimus" amount (as defined in Section 1.150- 2(f)(1) of the
Regulations), no expenditures with respect to the Project to be reimbursed with the proceeds of the Bonds
have been made by the Borrower more than sixty (60) days before the date of adoption of this resolution
of the City.
8.3. Based on representations by the Borrower, as of the date hereof, there are no funds of the
Borrower reserved, allocated on a long term -basis or otherwise set aside (or reasonably expected to be
reserved, allocated on a long -term basis or otherwise set aside) to provide permanent financing for the
expenditures related to the Project to be financed from proceeds of the Bonds, other than pursuant to the
issuance of the Bonds. This resolution, therefore, is determined to be consistent with the budgetary and
financial circumstances of the Borrower as they exist or are reasonably foreseeable on the date hereof.

Section 9. Costs. The Borrower will pay the administrative fees of the City and pay, or, upon
demand, reimburse the City for payment of, any and all costs incurred by the City in connection with the
Project and the issuance of the Bonds, whether or not the Bonds are issued.
Section 10. Commitment Conditional. The adoption of this resolution does not constitute a
guarantee or a firm commitment that the City will issue the Bonds as requested by the Borrower. If, as a
result of information made available to or obtained by the City during its review of the Project, it appears
that the Project or the issuance of Bonds to finance or refinance the costs thereof is not in the public
interest or is inconsistent with the purposes of the Housing Act, the City reserves the right to decline to
give final approval to the issuance of the Bonds. The City also retains the right, in its sole discretion, to
withdraw from participation and accordingly not issue the Bonds should the Council, at any time prior to
the issuance thereof, determine that it is in the best interests of the City not to issue the Bonds or should
the parties to the transaction be unable to reach agreement as to the terms and conditions of any of the
documents for the transaction.

In accordance with the provisions of Minnesota Statutes, Chapter 462C, as amended (the "Act "),
the City of Columbia Heights, Minnesota (the "City" or the "Issuer ") is authorized to develop and
administer a housing program to provide for the financing of new construction or the acquisition and
rehabilitation of an existing building and site for the purpose of providing a multifamily housing
development under the circumstances and within the limits set forth in the Act. Section 462C.07 of the
Act provides that such programs for multifamily housing developments may be financed by revenue
bonds or obligations issued by the Issuer.
The Issuer has determined that it is in the best interests of the residents of City to create this
Program for a Multifamily Housing Development (the "Program ") to encourage and facilitate the
development of a multifamily housing development in the City to meet the needs of low and moderate
income families in the City. The Issuer has received a proposal by Columbia Heights Leased Housing
Associates III, LLLP, a Minnesota limited liability limited partnership, or its affiliates or assigns (the
"Owner" or the "Borrower "), that it approve this Program providing for the acquisition, construction,
and equipping of a multifamily rental housing development comprised of up to 190 units to be located
at 1069 Grandview Court NE and 4729 Grand Avenue NE in the City for occupancy by persons and
families of low and moderate income. The Owner has provided the following description of the Project:

The Project will provide related common amenity spaces, including a fitness facility, a
club room, and 140 or more underground parking spaces and an additional 130 or more
surface parking spaces. Full -time staff will be available at the Project.
The Project is proposed to be financed with tax - exempt conduit revenue bonds
or obligations to be issued by the Issuer and revenues derived from low income housing
tax credits under the Low - Income Housing Tax Credit Program created under the federal
Tax Reform Act of 1986 ( "4% LIHTC ").
As indicated by the foregoing, the acquisition, construction, and equipping of the Project is to be funded
in part through the issuance of conduit revenue bonds or obligations of the Issuer, in one or more series,

in an original aggregate principal amount that is not expected to exceed $45,000,000 (the "Obligations ")
The total costs of the Project are estimated to be approximately $45,023,198.
The specific activities described in this Program will be undertaken to further the policies and
goals consistent with the housing portion of the comprehensive plan for the City and as otherwise
outlined herein. The Project will be acquired and constructed in accordance with the requirements of
Section 462C.05 of the Act.
Section A. Definitions. The following terms used in this Program shall have the following
meanings, respectively:
"Act" shall mean the Minnesota Statutes, Chapter 462C, as currently in effect and as the same
may be from time to time amended.
"Bonds" shall mean the conduit revenue bonds or obligations to be issued by the Issuer to
finance the Program.
"Borrower" shall mean the Owner.
"City" shall mean the City of Columbia Heights, Minnesota.
"Code" shall mean the Internal Revenue Code of 1986, as amended.
"Housing Unit" shall mean any one of the apartment units to be located in the Project, occupied
by one or more persons or a family, and containing complete living facilities.
"Issuer" shall mean the City.
"Land" shall mean the real property upon which the Project is situated.
"Owner" shall mean Columbia Heights Leased Housing Associates I1I, LLLP, a Minnesota
limited liability limited partnership.
"Program" shall mean this Program for a Multifamily Housing Development for the financing of
the Project pursuant to the Act.
"Project" shall mean the residential rental housing development, to be located at 1069
Grandview Court NE and 4729 Grand Avenue NE in the City, consisting of 190 Housing Units, of which
it is currently expected that seventy -two (72) will be one - bedroom units, eighty -two (82) will be two -
bedroom units, and thirty -six (36) will be three- bedroom units, to be acquired, constructed, and equipped
by the Owner, together with functionally related and subordinate facilities.
Section B. Program for Financing the Project. It is proposed that the City establish this
Program to provide financing for the acquisition, construction, and equipping of the Project at a cost and
upon such other terms and conditions as are set forth herein and as may be agreed upon in writing
between the City, the initial purchaser of the Bonds, and the Borrower. The City expects to issue the
Bonds as soon as the terms of the Bonds have been agreed upon by the City, the Borrower, and the initial
purchaser of the Bonds. The proceeds of the Bonds will be loaned by the City to the Borrower to finance
the acquisition, construction, and equipping of the Project, to fund required reserves, to pay interest on
the Bonds during the construction of the Project, and to pay a portion of the costs of issuing the Bonds.

It is anticipated that the Bonds will have a maturity of approximately forty (40) years or less and
will bear interest at a variable rate or at fixed rates consistent with the market at the time of issuance.
The City will hire no additional staff for the administration of the Program. Insofar as the City
will be contracting with underwriters, legal counsel, bond counsel, the fiscal agent, and others, all of
whom will be reimbursed from bond proceeds and revenues generated by the Program, no administrative
costs will be paid from the City's budget with respect to this Program. The Bonds will not be general
obligation bonds of the City, but are to be paid only from properties pledged to the payment thereof,
which may include additional security such as additional collateral, insurance, or a letter of credit.
Section C. Local Contributions to the Program. In addition to the Bonds to be issued under
the Program, the Project is expected to be funded from additional sources, including low income housing
tax credits.
Section D. Monitoring Methods. No special monitoring by the Issuer is anticipated to be
necessary in connection with the construction, development, and equipping of the Project, but any such
monitoring will be provided or arranged by the Owner. Proceeds of the Bonds proposed to be issued to
finance the Project are expected by the Owner to be held and disbursed by a third party and the initial
purchasers of the Bonds, and it is believed the disbursement procedure exercised by such parties and the
oversight exercised by certain other parties will be adequate to ensure that the financing of the Project as
presented is in fact carried out. The Project must be operated in accordance with various operating
covenants (relating to such things as maintenance, insurance, etc.) to be contained in a revenue agreement
among the Issuer and the Owner, which agreement will be assigned by the Issuer to the holder of the
Bonds (except for certain retained rights of the Issuer including the payment of fees and expenses of the
Issuer, indemnification of the Issuer by the Owner, and similar rights of the Issuer), as security for the
holders of the Bonds. To ensure continuing compliance with certain rental and occupancy restrictions
imposed by the Act and Section 142(d) of the Code (including the requirement that a portion of the
Housing Units in the Project be occupied by families of low and moderate income) and to ensure
continuing compliance with any similar restrictions imposed by the Issuer, the Issuer, the Owner, and the
holder of the Bonds or a trustee will enter into a Regulatory Agreement.
Section E. Standards and Requirements Relating to the Financing of the Project Pursuant to
the Program. The following standards and requirements shall apply with respect to the operation of the
Project by the Owner pursuant to this Program:
(1) Substantially all of the proceeds of the sale of the Bonds will be applied to the acquisition,
construction, development, and equipping of the Project, the payment of costs of issuance,
and to the funding of appropriate reserves. The proceeds of the Bonds will be made
available to the Owner under the terms of the documents under which the Bonds are issued
and sold, which will include certain covenants to be made by the Owner to the Issuer and the
initial purchasers of the Bonds regarding the use of proceeds and the character and use of the
Proj ect.
(2) The Project qualifies as a "multifamily housing development," within the meaning of the
Act, since it is comprised of one or more buildings located on contiguous parcels, the units of
which are rented to persons or families for use as residences.
(3) The Owner, and any subsequent owner of the Project, will not arbitrarily reject an
application from a proposed tenant because of race, color, creed, religion, national origin,

sex, affectional preference, marital status, or status with regard to public assistance or
disability.
(4) It is expected that at least one hundred percent (100 %) of the Housing Units will be held for
occupancy by families or individuals with gross income not in excess of sixty percent (60 %)
of median family income, adjusted for family size. The affordability standards and set -aside
requirements of Section 462C.05, Subdivision 2 of the Act, and the other requirements of
Act and Section 142(d) of the Code will be satisfied by the Owner.
Section F. Evidence of Compliance. The City may require from the Borrower at or before
the issuance of the Bonds, evidence satisfactory to the City of compliance with the standards and
requirements for the making of the financing established by the City, as set forth herein; and in
connection therewith, the City or its representatives may inspect the relevant books and records of the
Borrower in order to confirm such ability, intention and compliance. In addition, the City may
periodically require certification from either the Borrower or such other person deemed necessary
concerning compliance with various aspects of this Program.
Section G. Issuance of Bonds. To finance the Program authorized by this Section the City
will by resolution authorize, issue, and sell the Bonds, in one or more series in an aggregate principal
amount not to exceed $45,000,000. The Bonds will be issued pursuant to Section 462C.07,
subdivision 1, of the Act, and will be payable primarily from the revenues of the Project. The costs of
the Project, including capitalized interest, costs of issuance of the Bonds and required reserve funds, are
presently expected to be in excess of the principal amount of the Bonds. It is expected that the Owner
will contribute to the Project the difference between the total costs of the Project and the principal
amount of the Bonds, and any other sources available to the Owner to finance the Project. The costs of
the Project may change between the date of preparation of this Program and the date of issuance of the
Bonds. The Bonds are expected to be issued in the fourth calendar quarter of 2017.
Section H. Severability. The provisions of this Program are severable and if any of its
provisions, sentences, clauses, or paragraphs shall be held unconstitutional, contrary to statute, exceeding
the authority of the Issuer, or otherwise illegal or inoperative by any court of competent jurisdiction, the
decision of such court shall not affect or impair any of the remaining provisions.
Section I. Amendment. The Issuer shall not amend this Program, while the Bonds
authorized hereby are outstanding, to the detriment of the holder or holders of such Obligations.
Section H. State Ceiling.
(1) An application for an allocation of a portion of the annual volume cap for private
activity bonds will be made or has been made to the office of Minnesota Management & Budget,
pursuant to Section 146 of the Code and Minnesota Statutes, Chapter 474A, as amended (the
"Allocation Act ").
(2) Pursuant to the terms and requirements of the Allocation Act: (i) the Project will
meet the requirements of Section 142(d) of the Code regarding the incomes of the occupants of
the Project; and (ii) the maximum rent for at least twenty percent (20 %) of the Housing Units
will not exceed the area fair market rent or exception fair market rents for existing housing, if
applicable, as established by the United States Department of Housing and Urban Development.

(3) Prior to the issuance of the Bonds, the Borrower will enter into a Regulatory
Agreement with the City that specifies the maximum rental rates of the rent - restricted units in the
Project and the income levels of the residents of the Project occupying the income - restricted
units. Such rental rates and income levels must be within the limitations established in
accordance with the preceding paragraph (2). The Borrower will be required to annually certify
to the City over the term of the agreement that the rental rates for the rent - restricted units are
within the limitations under the preceding paragraph (2). The City may request individual
certification of the income of residents of the income - restricted units of the Project. The office
of Minnesota Management & Budget may request from the City a copy of the annual
certification prepared by the Borrower. The office of Minnesota Management & Budget may
require the City to request individual certification of all residents of the income - restricted units
of the Project.
(4) The City will monitor Project compliance with the rental rate and income level
requirements established under the preceding paragraph (2). The City may issue an order of
noncompliance if the Project is found by the City to be out of compliance with the rental -rate or
income -level requirements established under the preceding paragraph (2). The Borrower shall
pay a penalty to the City equal to one -half of one percent of the total amount of the Bonds issued
under the Allocation Act for the Project if the City issues an order of noncompliance. For each
additional year the Project is out of compliance, the annual penalty must be increased by one -half
of one percent of the principal amount of the Bonds issued under the Act for the Project. The
City may waive insubstantial violations.
This Program relates solely to the Project described herein. This Program is separate and distinct
from any and all housing policies established by the Housing and Redevelopment Authority in and for
the City of Columbia Heights.

RESOLUTION NO. 2017 -63
Resolution of the City Council for the City of Columbia Heights approving revocation pursuant to City Code,
Chapter 5A, Article IV, Section 5A.408(A) of that certain property rental license held by Stephanie A. Carr
(Hereinafter "License Holder ").
Whereas, license holder is the legal owner of the real property located at 4254 2nd Street N.E., Columbia
Heights, Minnesota,
Whereas, pursuant to City Code, Chapter 5A, Article IV, Section 5A.408(B), written notice setting forth the
causes and reasons for the proposed Council action contained herein was given to the License Holder on June
6, 2017 of a public hearing to be held on June 26, 2017.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of Columbia
Heights, the City Council of the City of Columbia Heights makes the following:
FINDINGS OF FACT
1. That on or about April 30, 2017, inspection office staff sent a letter requesting the owner of the
property submit the rental license application for this property. The letter was mailed by regular mail
to the owner at the address listed in the property records.
2. That on June 6, 2017, inspection office staff reviewed the property file and noted that the property
remained unlicensed. A Statement of Cause was mailed by regular mail to the owner at the address
listed in the property records.
3. That based upon said records of the Enforcement Office, the following conditions and violations of the
City's Property Maintenance Code were found to exist, to -wit:
a. Failure to submit renewal rental license application and fees.
4. That all parties, including the License Holder and any occupants or tenants, have been given the
appropriate notice of this hearing according to the provisions of the City Code, Chapter 5A, Article III
5A.306 and 5A.303(A).
ORDER OF COUNCIL
1. The rental license belonging to the License Holder described herein and identified by license number
F15400 is hereby revoked;
2. The City will post for the purpose of preventing occupancy a copy of this order on the buildings
covered by the license held by License Holder;
3. All tenants shall remove themselves from the premises within 45 days from the first day of posting of
this Order revoking the license as held by License Holder.
