NATIONAL PUBLIC WORKS WEEK
Proclamation
WHEREAS, Public Works services provided in our community are an integral part of our citizen's
everyday lives; and
WHEREAS, the support of an understanding and informed citizenry is vital to the efficient operation
of Public Works systems and programs such as water, sewer, streets and highways, parks, public
buildings, solid waste collection, and snow removal; and
WHEREAS, the health, safety and comfort of this community greatly depends on these facilities and
services; and
WHEREAS, the quality and effectiveness of these facilities, as well as their planning, design, and
construction, is vitally dependent upon the efforts and skill of public works officials; and
WHEREAS, the efficiency of the qualified and dedicated personnel who staff Public Works
departments is materially influenced by the people's attitude and understanding of the importance of
the work they perform,
NOW, THEREFORE, I, Donna Schmitt, Mayor of the City of Columbia Heights, do hereby proclaim the
week of May 21 through May 27, 2017 as
"NATIONAL PUBLIC WORKS WEEK"

DECLARING JUNE 4, 2017 AS PASTOR MAX RICHTER DAY
IN THE CITY OF COLUMBIA HEIGHTS
WHEREAS, Pastor Max Richter has been an active member of our community
while serving at Community United Methodist Church since 2011, and
WHEREAS, Pastor Max has prayed regularly at the City Council meetings, has
shared his vocal talents with the community at Ecumenical services, and has
been actively involved in the Columbia Heights ministerium.
WHEREAS, Pastor Max has reached out to the people of this community and his
congregation in times of joy and sorrow, bringing and them together through
faith, compassion, love and laughter, and
WHEREAS, Pastor Max's compassionate heart for his vocation has been a
benefit not just to Community United Methodist Church, but also to the City of
Columbia Heights,

The following are the minutes for the regular meeting of the City Council held at 7:00 PM on
Monday May 8, 2017 in the City Council Chambers, City Hall, 590 40th Ave. N.E., Columbia
Heights, Minnesota
1. CALL TO ORDER
Mayor Schmitt called the meeting to order at 7:03 p.m.
2. ROLL CALL
Present: Mayor Schmitt, Councilmember Williams, Councilmember Murzyn, Jr., Councilmember
Buesgens and Councilmember Novitsky
Also Present: Walt Fehst; City Manager, Jim Hoeft; City Attorney, Joe Kloiber; Finance Director,

3. INVOCATION
Invocation provided by Max Richter, Community United Methodist Church.
Mayor Schmitt announced Pastor Richter would be transferring to a church in a different city, and
thanked him for his service over the years.

City Clerk Katie Bruno indicated there was a change to be made to the minutes of April 24, 2017.
Page 3, item F to be changed as follows:
Finance Director Joe Kloiber explained that the City is expected to save approximately
$2,000,000 ($1,600,000 net of 45uGpee e present value) as a result of refinancing two
outstanding bond issues.
Motion by Councilmember Buesgens, seconded by Councilmember Murzyn, Jr. to approve the
agenda as presented, noting the change in the City Council minutes from April 24, 2017.

recommended by the Traffic Commission.
F. Approve Permits for the 2017 Jamboree
MOTION: Move to authorize staff to close Huset Parkway for the time period from Tuesday
afternoon, June 20, through Sunday, June 25, 2017.
MOTION: Move to authorize the Police Department to issue a parade permit for the Jamboree
Parade to be held on Friday, June 23, 2017 beginning at 6:00 p.m. for the following streets: Central
Avenue from 45th Avenue to 40th Avenue, west on 40th Avenue to 5th Street and 5th Street to Mill
Street.
MOTION: Move to authorize fireworks at dusk on Saturday, June 24, 2017 and to waive the Fire
Department fireworks display permit fee.
G. Adopt Resolution 2017 -44 being a Resolution Accepting Bids and Awarding A Contract
for the 2017 Miscellaneous Concrete Repairs and Installations, City Project 1700
MOTION: Move to waive the reading of Resolution 2017 -44, there being ample copies available to
the public.

MOTION: Move to adopt Resolution 2017 -44 being a resolution accepting bids and awarding the
2017 Miscellaneous Concrete Repairs and Installations, City Project No. 1700, to Create
Construction, based upon their low, qualified, responsible bid in the amount of $107,916.05 from
Fund 415 - 51700 -4000; and, furthermore, to authorize the Mayor and City Manager to enter into a
contract for the same.
H. Approve Business License Applications
MOTION: Move to approve the items as listed on the business license agenda for May 8, 2017.
I. Payment of Bills
MOTION: Move that in accordance with Minnesota Statute 412.271, subd. 8, the City Council has
received the list of claims paid covering check number 165554 through 165719 in the amount of
$679,155.80.
Motion by Councilmember Williams, seconded by Councilmember Novitsky to approve the
Consent Agenda items as presented. All Ayes, Motion Carried.

1. SECOND READING of Ordinance 1639, Providing For the Issuance and Sale Of General
Obligation Refunding Bonds, Series 2017A, in the Maximum Aggregate Principal Amt Of
$3,375,000.
Councilmember Williams commented that the City will be saving over $2,000,000 with the
refunding (refinancing) of two bond issues.
Motion by Councilmember Murzyn, Jr., seconded by Councilmember Williams to waive the reading
of Ordinance 1639, there being ample copies available to the public. All Ayes, Motion Carried.
Motion by Councilmember Buesgens, seconded by Councilmember Williams to adopt Ordinance
1639, providing for the issuance and sale of General Obligation Refunding Bonds Series 2017A in
the maximum aggregate principal amount of $3,375,000. All Ayes, Motion Carried.
B. Bid Considerations
1. Adopt Resolution 2017 -43 being a Resolution Accepting Bids and Awarding a Contract for
the 2017 Water Main Construction, City Projects 1703 and 1710
Director of Public Works Kevin Hansen reported the proposed work is being done prior to the
scheduled mill and overlay on Main Street from 40th Avenue to 44th Avenue by Anoka County.
In addition, the operation of hydrants and water main valves are evaluated during the annual
flushing program and while isolating water main break locations.
Hansen reported Northdale Construction Company, Inc. submitted the low base bid of $393,924.72.

Motion by Councilmember Buesgens, seconded by Councilmember Murzyn, Jr. to waive the reading
of Resolution 2017 -43, there being ample copies available to the public. All Ayes, Motion Carried.
Motion by Councilmember Novitsky, seconded by Councilmember Williams to adopt Resolution
2017 -43 being a resolution accepting bids and awarding the 2017 Water Main Construction, City

Northdale Construction Company, Inc. of Albertville, Minnesota, based upon their low, qualified,
responsible bid in the amount of $393,924.72 with $331,732.60 from Fund 651-51703-5185 and
$62,192.12 from Fund 651- 51710 -4000, and, furthermore, to authorize the Mayor and City
Manager to enter into a contract for the same. All Ayes, Motion Carried.

10. ADMINISTRATIVE REPORTS
Report of the City Council
Councilmember Buesgens reported she attended the Comp Plan kickoff meeting, volunteered with
MWMO and volunteered at United Methodist Church free dinner event.
Councilmember Williams reported the library will be serving lunches to children and adults this
summer. Columbia Heights teacher Erin Edwardson Stern was named the 2017 Columbia Heights
Public Schools' Local 710 Teacher of the Year. Congratulations were expressed to Chief Scott
Nadeau, recently named 2017 Big Brother of the year by Big Brother Big Sisters of the Twin Cities.
Councilmember Murzyn, Jr. reported there was one applicant at the recent Planning & Zoning
Commission meeting. Renaissance Fireworks requested an Interim Use Permit to allow for the
sale of fireworks at 4005 Central Ave NE. The commission approved the request.
Councilmember Novitsky reported the High School's drama production; Little Shop of Horrors, was
very well done. Novitsky has been working on various Jamboree events.
Mayor Schmitt attended the annual Mayors Conference the end of April. Schmitt is working on a
Mayor's Exchange with the Mayor of Rushford, MN. She attended the "Love Somalia Event ". The
group is organizing a Feed my Starving Children event for Somalia.
She also attended the Valley View Fun Run, and St Matthews's production of "Beauty & the
Beast."
The Community Prayer Breakfast was announced. Gratitude was expressed to Romans Caf6, who
will be providing breakfast.

11. CITIZENS FORUM
Frost Simula -1700 49th Ave NE asked the council members how much time they devote to reading
their meeting packets.
Councilmember Buesgens indicated she spends anywhere from 3 -4 hours. Councilmember
Novitsky said he spends at least 2 hours. Councilmember Murzyn, Jr. said he spends 2 -3 hours.
Councilmember Williams said it varies.

Motion by Councilmember Murzyn, Jr., seconded by Councilmember Buesgens to adjourn. All Ayes,
Motion Carried.

A resolution of the City Council for the City of Columbia Heights, Minnesota,
WHEREAS, pursuant to an advertisement for bids for City Project Nos. 1703 and 1710, 2017 Water
Main Construction and 2017 Hydrant and Gate Valve Construction, bids were received, opened and
tabulated according to law.
Now therefore, in accordance with the foregoing, and all ordinances and regulations of the City of
Columbia Heights, the City Council of Columbia Heights makes the following:
FINDINGS OF FACT
The following bids were received complying with the advertisement.

Pete's Water & Sewer $426,755.39
It appears that Northdale Construction Co., 9760 71st Street NE, Albertville, Minnesota is the lowest
responsible bidder.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF COLUMBIA HEIGHTS, MINNESOTA
1. The Mayor and City Manager are hereby authorized and directed to enter into a contract with
Northdale Construction Co., Inc. in the name of the City of Columbia Heights, for the 2017 Water

Main Construction and 2017 Hydrant and Gate Valve Construction, City Project Nos. 1703 and
1710, for a bid amount of $393,924.72 according to plans and specifications therefore approved

bidder and the next lowest bidder until the contract has been signed.
3. City Project Nos. 1703 and 1710 shall be funded with $331,732.60 from Fund 651 - 51703 -5185
and $62,192.12 from Fund 651- 51710 -4000.
RESOLUTION NO. 2017 -44
A resolution of the City Council for the City of Columbia Heights, Minnesota,
WHEREAS, pursuant to an advertisement for bids for City Project No. 1700, Miscellaneous Concrete
Repairs and Installations, bids were received, opened and tabulated according to law.
Now therefore, in accordance with the foregoing, and all ordinances and regulations of the City of
Columbia Heights, the City Council of Columbia Heights makes the following:

Ordinance 1639
BEING AN ORDINANCE PROVIDING FOR THE ISSUANCE AND SALE OF
GENERAL OBLIGATION REFUNDING BONDS, SERIES 2017A,
IN THE MAXIMUM AGGREGATE PRINCIPAL AMOUNT OF $3,375,000
The City of Columbia Heights does ordain:
Section 1. It is hereby determined that:

(a) On September 19, 2007, the Columbia Heights Economic Development Authority
(the "EDA ") issued its Public Facility Lease Revenue Bonds, Series 2007B (Municipal Liquor Stores
Project) (the "Series 2007B Bonds "), in the original aggregate principal amount of $5,040,000. The
Series 2007B Bonds were issued under the terms of a Mortgage and Security Agreement and Trust
Indenture, dated as of September 1, 2007 (the "Indenture "), between the EDA and U.S. Bank
National Association (the "Trustee "). Pursuant to a Ground Lease, dated as of September 1, 2007,
the EDA leases certain land (the "Sites ") from the City of Columbia Heights, Minnesota (the
"City "). Pursuant to a Lease - Purchase Agreement, dated as of September 1, 2007, the Authority
leases to the City, with the option to purchase by the City, the Sites and the facilities constructed
thereon, including the municipal liquor store (the "Facilities ").
(b) Pursuant to Section 3.01(b) of the Indenture, the Series 2007B Bonds maturing on
or after February 1, 2018, are subject to optional redemption, at the election of the City, on
February 1, 2017, and any date thereafter, at a price of par plus accrued interest. The City has
proposed to exercise its option to redeem the outstanding Series 2007B Bonds and acquire the
Sites and the Facilities from the EDA. The Series 2007B Bonds are currently outstanding in the
aggregate principal amount of $3,700,000.
(c) The City is authorized by Minnesota Statutes, Section 475.67, subdivision 3 to
issue and sell its general obligation bonds to refund obligations and the interest thereon before
the due date of the obligations, if consistent with covenants made with the holders thereof, when
determined by the City Council to be necessary or desirable for the reduction of debt service costs
to the City or for the extension or adjustment of maturities in relation to the resources available

(d) The City has determined that it is necessary and desirable for the reduction of
debt service costs to the City to issue its General Obligation Refunding Bonds, Series 2017A (the
"Bonds "), in the maximum aggregate principal amount of $3,375,000, pursuant to the home rule
charter of the City (the "City Charter ") and Minnesota Statutes, Section 475.67, subdivision 3, to
redeem and prepay the outstanding Series 2007B Bonds and acquire the Sites and the Facilities
from the EDA.
Section 2. Ehlers & Associates, Inc. is authorized to negotiate the sale of the Bonds in the
maximum aggregate principal amount specified in Section 1(d) hereof, in accordance with terms of
proposal approved by the Finance Director of the City. The City Council will meet on Monday, June 12,
2017, or such other date specified by the City Manager in accordance with the City Charter, to consider
the sale of the Bonds and take any other appropriate action with respect to the Bonds.
Section 3. The EDA is authorized and directed to provide to the Trustee written notice of the
City's election to redeem the outstanding Series 2007B Bonds in accordance with the terms provided in
Section 3.02 of the Indenture.
Section 4. This ordinance shall be in full force and effect from and after thirty (30) days after its
passage.

• New York Times. We just get the Sunday Edition. Every day delivery would cost too much.
• Copiers /Printers Overage: Costs should be recouped by public printing fees.
• Orkin: No problems so far, but we do have regular inspections as part of a contract for all city owned buildings.
• Electric: From February 6 -March 8th we received a credit for energy generated by the solar panels. Overall they
should generate 60 -80% of our energy consumption.
• Gas: Should be low during upcoming months. Not much boiler or fireplace usage in summer months. Over winter
the fireplace was on regularly, but mostly by request during the spring.
• Build /Maint Burden = Custodial costs
• Credit Card Fees: Put in the budget for the possibility of future credit card processing.

• Staffing Update: On March 6th Barb Kondrick announced her retirement; effective April 7th. A posting has already
been released, and has garnered 30 Applications, which Human Resources will evaluate and narrow the selection
down to around 8 candidates to interview (Kelli Bourgeois does a very nice job of structuring the hiring process
and making it a comfortable process for both the department and the applicant). Estimated start date of new
librarian will be the beginning of June.
Art Display Policy: CHPL already has an Art Policy for acquiring artwork (adopted in 2016), but this new policy
lays out the process for person's /entity's requests to exhibit artwork in the library. Included is an Application to
Exhibit, and an Exhibit Space Contract (based on similar documents adopted by ACL, HCL, and United Theological
Seminary). The need for this Policy is because of interest by the Columbia Heights School District to display
student artwork, and the Master Water Steward's Water Art Competition that is being hosted at the library.

BACKGROUND:
For many years, the City has purchased its property and liability insurance from the League of Minnesota Cities
Insurance Trust (LMCIT). Staff is currently preparing the renewal application for this policy for the period June
1, 2017 through May 31, 2018.
When providing liability insurance to member cities, the LMCIT has always required that member cities
document whether or not they waive the tort liability limits established for municipalities by Minnesota
Statutes, Section 466.04. Previously, this action only had to be taken once. Beginning in 2015, the LMCIT
requires member cities to document this decision annually as a condition of renewing the insurance policy.
The tort liability limits established by Minnesota Statutes, Section 466.04, cap the dollar amount that the City
could be liable for under certain types of liability claims. Waiving the limits would not provide any additional
protection to the City or its taxpayers. Waiving the limits only increases the potential benefits for claimants.
Staff estimates that waiving the limits would increase annual premiums by approximately $15,000. The City's
insurance agent, Brian Lundquist of Nesbit Agencies, advises that no Minnesota City currently waives these
limits.
RECOMMENDED MOTION(S):

effects:
If the member does not waive the statutory tort limits, an individual claimant would be able to recover no more than
$500,000 on any claim to which the statutory tort limits apply. The total all claimants would be able to recover for a
single occurrence to which the statutory tort limits apply would be limited to $1,500,000. These statutory tort limits
apply regardless of whether the city purchases the optional excess liability coverage.
If the member waives the statutory tort limits and does not purchase excess liability coverage, a single claimant could
potentially recover up to $2,000,000 for a single occurrence. (Under this option, the tort cap liability limits are waived to
the extent of the member's liability coverage limits, and the LMCIT per occurrence limit is $2 million.) The total all
claimants would be able to recover for a single occurrence to which the statutory tort limits apply would also be limited
to $2,000,000, regardless of the number of claimants.
If the member waives the statutory tort limits and purchases excess liability coverage, a single claimant could
potentially recover an amount up to the limit of the coverage purchased. The total all claimants would be able to
recover for a single occurrence to which the statutory tort limits apply would also be limited to the amount of coverage
purchased, regardless of the number of claimants.
Claims to which the statutory municipal tort limits do not apply are not affected by this decision.

Dominium has requested public financial assistance form the Columbia Heights Economic Development
Authority (EDA) for the redevelopment of the property located at the corner of 47th and Grand Avenue NE. In
Columbia Heights, the EDA is the authority authorized to exercise Tax Increment Financing (TIF) powers,
however the EDA may not exercise any TIF powers without prior approval from the City Council. Thus, in order
to consider establishment of a TIF District, certain events must occur that are outlined on the attached
Schedule of Events. As part of that process and more of a formality, the EDA must formally request that the
City Council call for a public hearing to consider the proposed establishment of a TIF district.
Earlier tonight, the EDA formally considered Resolution 2017 -11, a resolution requesting that the City Council
call for a public hearing on July 10, 2017 for the modification to the Central Business District revitalization plan
and for the establishment of the 47th and Grand TIF District.
STAFF RECOMMENDATION:
Staff recommends adopting Resolution 2017 -51, a resolution calling for a public hearing by the City Council on

Whereas, the owner of record is the legal owner of the real property located at 4329 Main Street
N.E. Columbia Heights, Minnesota.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations oft he City of

FINDINGS OF FACT
1. That on May 4, 2017 the Fire Department responded to a complaint at the address listed
above. Inspectors noted that the structure was damaged, open, and unsecured.
2. That on May 4, 2017 the Fire Chief ordered that Advanced Companies secure the
structure.
3. That based upon said records of the Fire Department, the following conditions and
violations of City Codes(s) were found to exist and have been abated, to wit:

neighboring cities of Minneapolis, Fridley and New Brighton all allow alcohol sales to occur until 2:00 am. A
local businessperson approached the Council seeking this change to allow Columbia Heights establishments
the ability to better compete for late -night customers with neighboring communities.
If this Ordinance is approved and a 2:00 am bar close time were to be established, entities that would desire
to remain open until 2:00 am. would need to file for additional approval from the Minnesota Department of
Alcohol and Gambling Control. Depending on the gross receipts of the business, the state would charge an
additional $200 - $1,000 in fees (payable to the State).
The City could also impose additional fees that would offset the costs associated with additional application
processing and law enforcement. The City proposes to charge an additional $300 fee per year for
establishments wishing to remain open and serve alcohol until 2:00 am to offset anticipated administrative
and law enforcement costs. This proposed municipal fee is in -line with what is being charged in various
neighboring communities. A resolution to amend the Community Development Fee Schedule and add this fee
will be brought before the City Council for consideration coinciding with the Second Consideration of
Ordinance No. 1640.
STAFF RECOMMENDATION:
Staff recommends approval of Ordinance No. 2017 -1640 as presented.

WINE LICENSES WITHIN THE CITY OF COLUMBIA HEIGHTS
The City of Columbia Heights does ordain:
SECTION 1:
§ 5.502 3.2% MALT LIQUORS (BEER).
City Code of 2005, is proposed to include the following addition and shall hereafter read as
follows, to wit:
(3) No sale of 3.2% malt liquor (beer) may be made between 24:00 a.m. and 8:00 a.m. on the
days of Monday through Saturday, nor between 24:00 a.m. and 12:00 noon on Sunday.
SECTION 2:
§ 5.503 ON -SALE CLUB LIQUOR.
City Code of 2005, is proposed to include the following addition and shall hereafter read as
follows, to wit:
(2) The off -sale of malt liquor shall only be permitted during the same days and hours of
Municipal Liquor Stores, and between the hours of 10:00 a.m. on Sundays and 24:00 a.m. on
Mondays; and

(A) Establishments to which on -sale licenses have been issued or hereafter may be issued,
pursuant to §§ 5.502 and 5.503 may serve intoxicating liquors between the hours of 10:00 a.m.
on Sunday and 23:00 a.m. on Mondays in conjunction with the serving of food, provided that
such establishment is in conformance with the Minnesota Clean Air Act.
SECTION 7:
§ 5.510 ON -SALE TEMPORARY LIQUOR LICENSES.
City Code of 2005, is proposed to include the following addition and shall hereafter read as
follows, to wit:
(1) No licensee of his agent may sell or permit the sale of intoxicating liquor licensed to be sold
under this section between the hours of 23:00 a.m. and 8:00 a.m. on days Monday through
Saturday, nor between the hours of 23:00 a.m. and 12:00 noon on Sunday. No licensee or his
agent or any other person shall consume or allow to be consumed on the licensed premises any
intoxicating liquor between the hours of 2:00 3:38 a.m. and 8:00 a.m. Should the Council decide
to additionally restrict the hours of sale in granting the license, no licensee or his or her agent
may sell or permit the sale of intoxicating liquor at any time not specifically allowed in such
license.
This Ordinance shall be in full force and effect from and after 30 days after its passage.

BACKGROUND:
At the April 3, 2017 City Council Work Session meeting, the City Council discussed regulations for Adult Day
Care facilities. The City of Columbia Heights currently requires 150 square feet of outdoor space available on
site for each adult at the facility under care. The state of Minnesota, which regulates and provides licensing for
adult day care facilities, does not require that outdoor space be provided. Staff polled a number of
communities, and discovered that many do not require that outdoor space be provided for adult day care
facilities.
The attached Ordinance reduces the amount of required outdoor space to a total of 150 square feet per site,
regardless of the number of adults served. If no outdoor space is available at the site, as is sometimes the
case, then the Ordinance would require a written plan be submitted that demonstrates how outdoor
recreational activities will be provided at the facility.
STAFF RECOMMENDATION:
Staff recommends approval of Ordinance No. 2017 -1641 as presented.

available on the site, the property owner must submit a written proposal that demonstrates
recreational activities for adults under the facility's care will be provided off -site. The City
Manager, or his or her designee, is authorized to approve or deny this proposal.
