HomeMy WebLinkAboutLetter to P&Z Ordinance 1404 CD OMMUNITY EVELOPMENT DATE: MARCH 21, 2000 TO: PLANNING AND ZONING COMMISSION FROM: JOE HOLLMAN, CITY PLANNER RE: PLANNING AND ZONING COMMISSION CASE # 2000-0101 (ORDINANCE 1404) In response to City Council concerns regarding the draft Ordinance 1404 as proposed after the March 14, 2000, Planning and Zoning Commission meeting, staff has prepared an alternate amendment (attached) which was discussed by the Council during a work session held on March 20, 2000. Generally, the City Council would like to accommodate the request to allow the Credit Union to display five vehicles for sale without negatively impacting the rest of the Central Business District. This proposed version of the amendment will allow financial institutions to display a maximum of five vehicles for sale that have been acquired through repossession or other legal means as an accessory use to the financial institution. Financial institution is being defined as either a bank, savings bank, savings association, or credit union. This use will be allowed as a Conditional Use Permit in every zoning district that permits financial institutions including the LB, Limited Business District, the CBD, Central Business District, the RB, Retail Business District, and the GB, General Business District. One significant change that is being proposed pertains to the existing Central Business District section 9.112(2)(o) which allows car sales/fleet sales/ advertisement provided that no more than two vehicles can be displayed for sale. This section will be replaced by the new amendment regarding financial institutions. Please note that under the current regulations any person who has an interest in property in the CBD can apply for a Conditional Use Permit to display two vehicles for sale. If this most recent amendment is approved financial institutions will be the only business in the CBD that would be allowed to display vehicles for sale (maximum of five). This change is intended to alleviate concerns about having a large number of used car lots in the CBD. The City Council will have a first reading of the proposed amendment during their meeting on March 27, 2000, starting at 7:00 p.m., so you are welcome to attend the meeting to voice any concerns that you may have regarding the proposal.
