accepted the proclamation. Hansen announced an Arbor Day celebration will take place on
April 28th, celebrating 25 years of being a Tree City USA.

C. Prayer Breakfast Proclamation
Mayor Schmitt read the proclamation, proclaiming Wednesday May 10th as the date for the
Columbia Heights Prayer Breakfast. Mayor Schmitt extended an invitation to all to attend.
Profits will go to the Kiwanis Key Club.
D. Community Fundraiser Announcement —Alyce Lentz
Mayor Schmitt announced a benefit for the Lentz family will take place at Murzyn Hall from
5:00 -8:00 PM on Wednesday, April 12tH

Consent Agenda as presented. All Ayes, Motion Carried.
8. PUBLIC HEARINGS
A. Approving a Final Plat for Aisling Fitness, LLC for the three vacant lots located at 51St Ct NE.
City Planner Elizabeth Holmbeck reported Aisling Fitness, LLC has requested Final Plat Approval
for the vacant site located behind La Casita and White Castle. The site is currently comprised
of three vacant lots, which do not have assigned addresses.
The applicant is proposing to remove the existing lot lines, and re -plat the property to allow
for a fitness facility to be constructed on the south end of the site.
The Preliminary plat and Site Plan were approved by the Planning and Zoning Commission and
City Council in January 2017. The Final Plat went before the Planning and Zoning Commission
on April 4, 2017, and was unanimously recommended for approval. The applicant has
submitted construction plans for review and will be issued pending approval of the Final Plat.
Once the Final Plat is approved and recorded Planet Fitness Representatives are anticipating
beginning construction at the end of this month.
Motion by Councilmember Buesgens, seconded by Councilmember Williams to close the public
hearing and waive the reading of Resolution No. 2017 -29, there being ample copies available to
the public. All Ayes, Motion Carried
Motion by Councilmember Murzyn, Jr., seconded by Councilmember Williams to approve
Resolution No. 2017 -29, approving the Final Plat for the three vacant properties located on 51st
Court NE. (PIN:25- 30 -24 -23 -0018, 25- 30 -24 -23 -0017, and 25- 30- 24 -22- 0066), subject to certain
conditions of approval. All Ayes, Motion Carried
9. ITEMS FOR CONSIDERATION

1. Consideration of Resolution 2017 -20, Appointment to fill City Council Vacancy
Mayor Schmitt read a prepared statement explaining her recent withdraw of support for Nick
Novitsky, because of inappropriate verbal statements at a recent Council work session.
Schmitt reported Nick has apologized to each member of the council. Schmitt suggested the
council consider appointing Ted Landwehr, who has proven to be level- headed.
Motion by Mayor Schmitt, seconded by Councilmember Buesgens to adopt Resolution No.
2017 -20, appointing Ted Landwehr to the City Council vacant seat, with the term expiring
when their successor is elected and qualified in January, 2019. 2 Ayes, 2 Nays, Motion failed.
Motion by Mayor Schmitt, seconded by Councilmember Williams to adopt Resolution No.
2017 -20, appointing Nick Novitsky to the City Council vacant seat, with the term expiring
when their successor is elected and qualified in January, 2019. 3 Ayes, 1 Nay, Motion Carried.

Mayor Schmitt explained for the benefit of the City, it is imperative to move on. Schmitt also
commented that the council has functioned very well in all other items they have considered.
Mayor Schmitt encouraged the other applicants to consider filing for office in the 2018
Election.
Councilmember Williams and Murzyn, Jr. also agreed that the council has worked well on all
other items this year, for the benefit of the City. The council congratulated Nick.

10. ADMINISTRATIVE REPORTS
Councilmember Buesgens reported she attended the recent HeightsNext volunteer potluck
on March 30th. The Safer Street talk was attended; Sean Broom was the moderator, discussing
concerns with 49th Ave.
Councilmember Williams reported he attended the Anoka County Local Government Officials
quarterly meeting. County Officials were impressed with our recent All America City
designation in 2016. Williams reported we are one of the few cities implementing body
cameras for police officers. Williams reported there have been numerous issues occurring at
Heights Manor. Williams indicated housing sales have been very good in Columbia Heights,
and he attributes this in part to the All America City Award.
Mayor Schmitt reported she attended the Community Connections Conference in
Minneapolis, many ideas were presented. The Safe Street discussion was attended at the
library, the focus was on safety around the schools and along 49th Ave.
The Mayor also attended The Wyland Foundations Mayor's Water Pledge Challenge at the
Mall of America. Columbia Heights residents are encouraged to sign up.
City Manager Walt Fehst reported the City has purchased a new street sweeper, and city staff
will be traveling to Texas for training. Manager Fehst also reported the City has been in
discussions with the Lions for planning of the 2017 Jamboree. A citywide garage sale is
planned for May 20tH
11. CITIZENS FORUM
Frost Simula -1700 49th Ave NE announced Heights Next will be hosting a movie night on April
13TH; where short films about pollination will be shown. Simula encouraged the composting of
yard waste.
Jerry Klein -2207 N. Upland Crest commended the council on making a decision to act in the
best interest of the City, and congratulated Nick Novitsky.

Malcom Watson -1717 49th Ave NE inquired about the date if the Board of Appeals and
Equalization meeting.
Mayor Schmitt expressed gratitude to the Candidates, Council and Staff for their commitment
during the selection process.

RESOLUTION NO. 2017 -20
A RESOLUTION CALLING FOR APPOINTMENT TO VACANT CITY COUNCIL SEAT
WHEREAS: on January 9, 2017, the City Council declared a vacancy on the City Council as a result
of Donna Schmitt being elected as Mayor; and
WHEREAS: notice was published of the intention to accept applications for the vacancy on the City
Council until February 23, 2017 at 4:30 PM; and
WHEREAS: pursuant to the City Charter, the City Council may appoint an eligible person to fill the
vacancy on the City Council until the next regular municipal election.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Columbia Heights:
1. That Nick Novitsky shall be appointed to the City Council to fill the vacancy of the
remainder of Donna Schmitt's term, with the term expiring when their successor is
elected and qualified in January, 2019.
2. That the appointment of Nick Novitsky shall take effect upon administration of the
Official Oath of Office.
RESOLUTION NO. 2017-29
A resolution of the City Council for the City of Columbia Heights, Minnesota, approving a Final Plat
for Aisling Fitness, LLC for the Three (3) vacant lots located at 51St Court NE.

Whereas, a proposal (Case # 2017 -0401) has been submitted by Aisling Fitness, LLC to the City
Council requesting Final Plat Approval from the City of Columbia Heights at the following site:
ADDRESS: Three (3) vacant lots located at 51St Court NE (Property Identification Numbers (PIN):
25- 30 -24 -23 -0018, 25- 30 -24 -23 -0017, and 25- 30- 24- 22- 0066).
LEGAL DESCRIPTION: On file at City Hall.
THE APPLICANT SEEKS THE FOLLOWING: Final Plat Approval per Code Section 9.104 (M).
Whereas, the Planning and Zoning Commission held a public hearing as required by the City
Zoning Code on April 4, 2017;
Whereas, the City Council has considered the advice and recommendations of the Planning and
Zoning Commission regarding the effect of the proposed Final Plat upon the health, safety, and
welfare of the community and its Comprehensive Plan, as well as any concerns related to
compatibility of uses, traffic, property values, light, air, danger of fire, and risk to public safety in
the surrounding areas;
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of
Columbia Heights, the City Council of the City of Columbia Heights makes the following:
FINDINGS OF FACT
Section 9.104 (M) (6) of the Zoning Ordinance outlines conditions that must be met in order for
the City to grant Final Plat Approval. They are as follows:
(a) The Final Plat substantially conforms to the approved Preliminary Plat.
(b) The Final Plat conforms to the requirements of 9.115.
Further, be it resolved, that the attached plans, maps, and other information shall become part of
this Final Plat; and in granting approval the City and the applicant agree that the Plat shall become
null and void if a Final Plat is not recorded with the Anoka County Recorder's Office within one (1)
calendar year after the approval date.
CONDITIONS
I. All required state and local codes, permits, licenses and inspections will be met and in full
compliance.
2. The applicant shall be responsible for the cost of filing and recording written easements
with the Anoka County Recorder's Office.
3. Upon approval of the Final Plat, the applicant shall be responsible for filing and recording
the Final Plat with the Anoka County Recorder's Office within one year of the date of City

Council action. In the event that a Final Plat is not recorded within this time period, the
Final Plat will become void.
4. Separate permanent easements will need to be placed over storm water BMP's to be
installed, and the easements will need to be on a recordable document, accepted by Anoka
County Recorder's Office.
5. The applicant shall meet the requirements outlined in the attached report from the City's
Building Official, dated 3/24/17.
RESOLUTION NO. 2017 -30
A Resolution of the City Council for the City of Columbia Heights, Minnesota, approving a
collective bargaining agreement between the City of Columbia Heights and Law Enforcement
Labor Services, Inc. Local No. 311— Police Officers
Whereas, negotiations have proceeded between Law Enforcement Labor Services, Inc. (LELS),
Local No. 311, representing Police Officers of the City, and members of the City's negotiation
team; and
Whereas, said negotiations have resulted in a mutually acceptable collective bargaining
agreement for calendar years 2017 and 2018; and
Whereas, changes to the current agreement are hereby attached as Exhibit A, and a copy of said
collective bargaining agreement is available for inspection at the Office of the City Manager and is
made a part hereof by reference.
Now therefore, be it resolved that the collective bargaining agreement as negotiated, be and is
hereby established as the salary and fringe benefit program for calendar years 2017 and 2018 for
LELS, Local No. 311— Police Officers, bargaining unit employees of the City; and

the City Manager's Compensation and Benefits for 2017 and 2018
Whereas, in previous years the City Manager has received an adjustment in compensation and
benefits consistent with that given the management employees; and

Now therefore, be it resolved that the City Council of the City of Columbia Heights does hereby
make the following modifications to the City Manager's compensation and benefits, consistent
with pay adjustments and benefits granted other management employees:
Effective January 1, 2017: 2.25% cost of living adjustment
Effective January 1, 2018: 2.5% cost of living adjustment
$895 per month Employer contribution to insurances for 2017 and 2018. Contributions are either
1) premium contribution if participating in the high option health insurance plan, or 2) with a $30
HSA contribution (deducted from the $895) if participating in a high deductible health plan.
For calendar year 2017, for employees taking family health insurance through the EMPLOYER the
EMPLOYER will contribute an additional $100 per month towards health insurance premiums for
a total EMPLOYER contribution of $995 for employees taking family health insurance For

WHEREAS, pursuant to Resolution No. 2016 -84, a report has been prepared by the City Engineer

WHEREAS, the report provides information regarding whether the proposed project is feasible,

Whereas, the Planning and Zoning Commission approved the Site Plan for the proposed
development on January 4th, 2017; and
Whereas, certain improvements which will be completed as components of this proposed
development are required to be reviewed and monitored by the City.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of
Columbia Heights, the City Council of the City of Columbia Heights approves Resolution No. 2017-

Discussion regarding appointment to fill City Council Vacancy
Councilmember Buesgens requested this work session be scheduled to discuss the plan for the
resolution appointing a council member. The council agreed additional questions would not be
beneficial. Buesgens asked if the council wanted to discuss their top choices, or just vote.
Mayor Schmitt clarified the goal for the council is to nominate one candidate that three of the members
could agree on.
Mayor Schmitt suggested going through the six names (top candidates), asking the council if there were
any additional names they wish to add. Councilmember Buesgens questioned if the council will discuss
if there are tied votes, Mayor Schmitt indicated that would be permitted. Mayor Schmitt also indicated
she will be explaining her reason for changing her original vote regarding Nick Novitsky.
Motion by Councilmember Murzyn, Jr., seconded by Councilmember Buesgens to adjourn.

A. Review of Charter Chapter 2, Section 9, Vacancies on the Council.
President Smith distributed a timeline summarizing the appointment process. Smith indicated the process is
lengthy, and wondered if the commission would like to consider any changes. City Attorney Hoeft indicated
this section of the Charter was revised in the past. Hoeft indicated the time period appears to be prolonged;
noting that Council in the past wanted to be sure there was ample time for people to submit applications.
Hoeft indicated State Statute would require a Special Election, even a more lengthy process.
Commissioner Fiorendino questioned if any of the Charter requirements are addressed in State Law. Hoeft
indicated the Charter is specific to the City of Columbia Heights.

Commissioner Bak questioned if the appointment process has been used in the past. Hoeft indicated there
was a time when a member needed to have a break in service. Hoeft indicated the only issue at that time was
in regard to the interview process, relating to the open meeting requirement.
Commissioner Penniston questioned the following language from Section 9 of the Charter:
The council shall inten�iew each of the applicants within 30 days from the close of the application period, and
shall conduct said interviews in an agreed upon uniform mangier as a council. After said 30 day eriod the
council shall make its appointment from the pool of applicants within 15 days, whether done so at a regular
council meeting or a special meeting.
Councilmember Buesgens indicated the Council intends to interview as quickly as possible in order to have a
full council seated as soon as possible. City Attorney Hoeft indicated the council can decide on the appointee
at any point following the interviews; however the appointment will not become effective until the said 30 day
period. Hoeft indicated there is some leeway built into the timeframe, noting additional time may be
necessary at various times. Hoeft suggested observing the process this time, and if necessary; revisit at a
future meeting.
Commissioner Utz questioned of there is an option for a Special Election in the current Charter. President
Smith indicated there is not.
Commissioner Anderson questioned if the role of the Charter Commission is to protect the Charter? President
Smith indicated the Charter Commission is responsible to see that City processes follows the Charter
requirements. Commissioner Bak indicated the commission also needs to ensure we are not in conflict with
state laws.
Commissioner Anderson questioned the need for a Charter. Hoeft indicated that in addition to the
appointment process ability, the Charter allows for the power of referendum, initiative and recall. Additionally
the Charter addresses the Police Department reporting to the Mayor, although collective bargaining
agreements address many of the personnel issues. Hoeft indicated there was discussion in the past of
removing that, and having the Police Department report to the City Manager, the voters voted against the
change.

The labor agreement between the City and International Association of Firefighters, Local #1216 (IAFF)
representing the full time Firefighters and Fire Captains, terminated on December 31, 2017. Negotiations
between the City and IUOE have resulted in a mutually acceptable labor agreement for calendar years 2017
and 2018. The proposed changes are as follows:
1. Article VII — Savings Clause
This AGREEMENT is subject to law. In the event any provision of this AGREEMENT shall be held to be
contrary to law by a court of competent jurisdiction from whose final judgment or decree no appeal has
been taken, within the time provided, or administrative ruling or is in violation of legislation or
administrative regulations such provisions shall be voided. All other provisions shall continue in full
force and effect. The voided provision may be renegotiated at the written request of either party.
2. Article XV — Funeral Leave
Amend current language to read:
15.1 Employees may be granted funeral leave with pay for the death of a spouse, children, mother,
father, sister, brother, grandparents, or grandchildren in accordance with the following:
a) For employees assigned to 2,912 hours /year shifts, the maximum benefit shall not exceed 72
hours' pay.
b) for employees assigned to 2,080 hours /year shifts, the maximum benefit shall not exceed 40
hours' pay.

BACKGROUND: The current Rescue 1 is a custom built heavy rescue vehicle purchased in 1990 from Road
Rescue at a cost of $97,613. The cost of the chassis in the amount of $28,313 was donated to the City by the
Columbia Heights Boosters. The intent of the truck was to carry EMS supplies for large scale incidents, rescue
tools, and the heavy rescue extrication tools. The truck also carries air and a filling station to fill our SCBA air
bottles on the scene. The vehicle was refurbished in 2004 at a cost of $35,000.
Rescue 1 is not being used anymore for the purposes that it was intended. Smaller and lighter rescue and
extrication tools and have been incorporated onto our aerial truck and pumpers. The filling of air bottles on a
scene happens rarely due to spare bottles being incorporated onto our vehicles. The vehicle is 27 years old
with 28,093 miles and 4731 engine hours.
To replace this vehicle with a similar truck would cost approximately $225,000 to $275,000. Staff does not
feel this type of vehicle is needed anymore and a smaller, more inexpensive vehicle would meet our needs.
STAFF RECOMMENDATION: Staff is proposing to purchase a Ford F250 pickup truck with a crew cab and lift
gate. This vehicle would give us more versatility while also being able to transport five firefighters to an
emergency scene. The truck box would allow us to carry dirty gear and equipment from fire scenes without
putting them into the back of the ambulance or cabs of the trucks which causes cleanliness and health issues.
The purchase of this vehicle was approved as part of the 2017 Fire Department budget.

delivery from the factory. Therefore, Aspen Equipment does not warrant that quoted products can be installed on a chassis without modifications to the chassis or products installed. As such, Aspen

BACKGROUND: Current market conditions present an opportunity to reduce annual interest expense by
refinancing (a.k.a. refunding) two outstanding bond issues, EDA Series 2007B and City Series 2008A. This
matter was reviewed at the January EDA meeting and the February Council work session. The attached presale
report prepared by Ehlers and Associates, the City /EDA's bond consultant, estimates the present value of this
interest savings to be $1,600,000.
STAFF RECOMMENDATION: Staff recommends approval of the attached resolutions as a best practice in debt
issuance. These resolutions authorize City staff and Ehlers to accomplish the tasks necessary to obtain bids for
the City Council to award the replacement bond sales on approximately June 12, 2017.

Council Member introduced the following resolution and moved its adoption:
Resolution Providing for the Sale of
$8,750,000 General Obligation Refunding Bonds, Series 2017B
A. WHEREAS, the City Council of the City of Columbia Heights, Minnesota has heretofore determined
that it is necessary and expedient to issue the City's $8,750,000 General Obligation Refunding Bonds,
Series 2017B (the "Bonds "), to effect a current refunding of the General Obligation Public Safety
Bonds, Series 20013; and
B. WHEREAS, the City has retained Ehlers & Associates, Inc., in Roseville, Minnesota ( "Ehlers "), as its
independent municipal advisor for the Bonds in accordance with Minnesota Statutes, Section 475.60,
Subdivision 2(9);
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Columbia Heights,
Minnesota, as follows:
1. Authorization; Findings, The City Council hereby authorizes Ehlers to assist the City for the sale of
the Bonds.
2. Meeting; Proposal Opening. The City Council shall meet at 7:00 p.m. on June 12, 2017, for the
purpose of considering proposals for and awarding the sale of the Bonds.
3. Official Statement. In connection with said sale, the officers or employees of the City are hereby
authorized to cooperate with Ehlers and participate in the preparation of an official statement for the
Bonds and to execute and deliver it on behalf of the City upon its completion.
The motion for the adoption of the foregoing resolution was duly seconded by City Council Member
and, after full discussion thereof and upon a vote being taken thereon, the
following City Council Members voted in favor thereof.

Proposed Issue:
$8,750,000 General Obligation Refunding Bonds, Series 2017B
Purpose:
The proposed 2017B Bond issue is to complete an advance refunding of the
General Obligation Public Safety Bonds, Series 2008B. The bonds were originally
issued to construct the City's Public Safety Center. This refunding is solely for
interest savings and does not extend the duration of the bonds. The refunding is
considered an Advance Refunding because the new Bonds will be issued more
than 90 days prior to the call (pre- payable) date of the original 2008B Bonds. The
call date for the 2008B Bonds is February 1, 2018.
Interest rates on the Refunding Bonds are projected to be 1.2% to 3.4 %. The
refunding is expected to reduce total interest expense by approximately $1,293,884
from 2019 to 2038 or approximately $64,700 per year. The present value benefit
of the advance refunding is estimated to be approximately $964,554, which is
equal to 11.69% of the refunded principal.
Authority:
The Bonds are being issued pursuant to the City Charter and Minnesota Statutes,
Chapter 475 for general bonding authority. The Bonds will be general obligations
of the City for which its full faith, credit and taxing powers are pledged.
Because the Refunding Bonds will be general obligations of the City, the Bonds
count against the City's General Obligation Debt Capacity Limit of 3% of
estimated market value (EMV). The City's EMV is $1,214,009,300 for Pay 2017
and 3% of EMV produces a debt limit of $36,420,279. The proposed 2017 Bonds
plus the City's applicable outstanding debt of $8,895,000 equals $21,270,000,
which is below the statutory debt limit.
Section 72 of the Columbia Heights City Charter also limits certain outstanding
debt to no more than 10% of the assessed value of all taxable property in the City.
The Pay 2017 value of $1,214,009,300 produces a $121,400,930 Charter debt
limit. The proposed 2017 Bonds plus the City's applicable outstanding debt of
$15,380,000 equals $27,755,000, which is below the Charter debt limit.
Term /Call Feature:
The Bonds are being issued for a 21 -year term. Principal on the Bonds will be due
on February 1 in the years 2018 through 2038. Interest is payable every six months
beginning February 1, 2018.
The Bonds maturing on and after February 1, 2027 will be subject to prepayment
at the discretion of the City on February 1, 2026 or any date thereafter.
Bank Qualification:
Because the City is expecting to issue no more than $10,000,000 in tax exempt
debt during the calendar year, the City will be able to designate the Bonds as "bank
qualified" obligations. Bank qualified status broadens the market for the Bonds,
which can result in lower interest rates.

Rating:
The City's most recent bond issues were rated AA by Standard & Poor's. The City
will request a new rating for the Bonds.
If the winning bidder on the Bonds elects to purchase bond insurance, the rating
for the issue may be higher than the City's bond rating in the event that the bond
rating of the insurer is higher than that of the City.
Basis for
Based on our knowledge of your situation, your objectives communicated to us,
Recommendation:
our advisory relationship as well as characteristics of various municipal financing
options, we are recommending the issuance of general obligation bonds as a
suitable financing option for the following reasons:
- This is the most overall cost effective option that still maintains future
flexibility for the repayment of debt; and,
- This coincides with the City's past practices to finance these types of
projects with this type of debt issue.
Method of
In order to obtain the lowest interest cost to the City, we will competitively bid the
Sale /Placement:
purchase of the Bonds from local and national underwriters/banks.
We have included an allowance for discount bidding equal to 1.20000% of the
principal amount of the issue. The discount is treated as an interest item and
provides the underwriter with all or a portion of their compensation in the
transaction.
If the Bonds are purchased at a price greater than the minimum bid amount
(maximum discount), the unused allowance may be used to lower your borrowing
amount.
Premium Bids: Under current market conditions, most investors in municipal
bonds prefer "premium" pricing structures. A premium is achieved when the
coupon for any maturity (the interest rate paid by the issuer) exceeds the yield to
the investor, resulting in a price paid that is greater than the face value of the
bonds. The sum of the amounts paid in excess of face value is considered
"reoffering premium."
The amount of the premium varies, but it is not uncommon to see premiums for
new issues in the range of 2.00% to 10.00% of the face amount of the issue. This
means that an issuer with a $2,000,000 offering may receive bids that result in
proceeds of $2,040,000 to $2,200,000.
For this issue of Bonds we have been directed to use the premium to reduce the
size of the issue. The adjustments may slightly change the true interest cost of the
original bid, either up or down.
You have the choice to limit the amount of premium in the bid specifications. This
may result in fewer bids, but it may also eliminate large adjustments on the day of
sale and other uncertainties.

Other Considerations:
The proceeds of the new bonds will be placed with an escrow agent who will hold
the funds and pay interest on the original bonds until the call date and to prepay
the original bonds at the first opportunity. The escrow account will be invested in
in open market securities bid through a bidding agent since the State and Local
Government Series (SLGS) Securities window is currently closed. The escrow
will be verified by a verification agent.
Review of Existing Debt:
We have reviewed all outstanding indebtedness for the City and find that refunding
the City's 2009A bonds may offer some potential savings. Refunding these bonds
now, however, will impact the Bank Qualification of the City's refunding bonds
for 2017 and reduce overall savings. We suggest revisiting this opportunity in
calendar year 2018.
We will continue to monitor the market and the call dates for the City's outstanding
debt and will alert you to any future refunding opportunities.
Continuing Disclosure:
Because the City has more than $10,000,000 in outstanding debt (including this
issue) and this issue is over $1,000,000, the City will be agreeing to provide certain
updated Annual Financial Information and its Audited Financial Statement
annually as well as providing notices of the occurrence of certain reportable events
to the Municipal Securities Rulemaking Board (the "MSRB "), as required by rules
of the Securities and Exchange Commission (SEC). The City is already obligated
to provide such reports for its existing bonds, and has contracted with Ehlers to
prepare and file the reports.
Arbitrage Monitoring:
Because the Bonds are tax - exempt obligations /tax credit obligations, the City must
ensure compliance with certain Internal Revenue Service (IRS) rules throughout
the life of the issue. These rules apply to all gross proceeds of the issue, including
initial bond proceeds and investment earnings in construction, escrow, debt
service, and any reserve funds. How issuers spend bond proceeds and how they
track interest earnings on funds (arbitrage /yield restriction compliance) are
common subjects of IRS inquiries. Your specific responsibilities will be detailed
in the Tax Certificate prepared by your Bond Attorney and provided at closing.
We recommend that you regularly monitor compliance with these rules and /or
retain the services of a qualified firm to assist you.
Risk Factors:
Advance Refunding: The Bonds are being issued for the purpose of "advance"
refunding prior City debt obligations. Only one advance refunding of an original
tax - exempt debt obligation is permitted under current IRS rules. This refunding is
being undertaken based in part on the following assumptions:
• Since the new Bonds will extend the "call" date for this debt, we are
assuming that the City does not expect to have revenues available to pre-
pay the current obligations prior to this new call date.

introduced the following resolution and moved its adoption:
Resolution Providing for the Sale of
$3,375,000 General Obligation Refunding Bonds, Series 2017A
A. WHEREAS, the City Council of the City of Columbia Heights, Minnesota has heretofore determined
that it is necessary and expedient to issue the City's $3,375,000 General Obligation Refunding Bonds,
Series 2017A (the "Bonds "), to effect a current refunding of the Public Facility Lease Revenue
Bonds, Series 200713; and
B. WHEREAS, the City has retained Ehlers & Associates, Inc., in Roseville, Minnesota ( "Ehlers "), as its
independent municipal advisor for the Bonds in accordance with Minnesota Statutes, Section 475.60,
Subdivision 2(9);
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Columbia Heights,
Minnesota, as follows:
1. Authorization; Findings. The City Council hereby authorizes Ehlers to assist the City for the sale of
the Bonds.
2. Meeting; Proposal O ep ning. The City Council shall meet at 7:00 p.m. on June 12, 2017, for the
purpose of considering proposals for and awarding the sale of the Bonds.
3. Official Statement. In connection with said sale, the officers or employees of the City are hereby
authorized to cooperate with Ehlers and participate in the preparation of an official statement for the
Bonds and to execute and deliver it on behalf of the City upon its completion.
The motion for the adoption of the foregoing resolution was duly seconded by City Council Member
and, after full discussion thereof and upon a vote being taken thereon, the
following City Council Members voted in favor thereof:

Proposed Issue:
$3,375,000 General Obligation Refunding Bonds, Series 2017A
Purpose:
The proposed 2017A Bonds are being issued by the City to acquire the existing
municipal liquor store building from the EDA, thereby effectively refunding the
EDA Public Facilities Lease Revenue Bonds, Series 2007B. This will be
considered a current refunding because the 2007B are callable (pre - payable) as of
2/1!2017.
The 2007B Bonds were special obligations payable solely from rental payments
made by the City to the EDA from liquor store revenue. The Refunding Bonds will
be general obligations of the City; however, debt service is still expected to be paid
from liquor store revenue. This Refunding is solely for interest savings and does
not extend the duration of the bonds.
Interest rates on the Refunding Bonds are projected to be 1.2% to 2.65 %. The
refunding is expected to reduce total interest expense by approximately $736,491
from 2018 to 2029 or approximately $61,374 per year. The net present value
benefit of the refunding is estimated to be approximately $646,086, which is equal
to 17.46% of the refunded principal.
Authority:
The Bonds are being issued pursuant to the City Charter and Minnesota Statutes,
Chapter 475 for general bonding authority. The Bonds will be general obligations
of the City for which its full faith, credit and taxing powers are pledged. As noted
above, debt service is still expected to be paid from liquor store revenue.
Because the Refunding Bonds will be general obligations of the City, the Bonds
count against the City's General Obligation Debt Capacity Limit of 3% of
estimated market value (EMV). The City's EMV is $1,214,009,300 for Pay 2017
and 3% of EMV produces a debt limit of $36,420,279. The proposed 2017 Bonds
plus the City's applicable outstanding debt of $8,895,000 equals $21,270,000,
which is below the statutory debt limit.
Section 72 of the Columbia Heights City Charter also limits certain outstanding
debt to no more than 10% of the assessed value of all taxable property in the City.
The Pay 2017 value of $1,214,009,300 produces a $121,400,930 Charter debt
limit. The proposed 2017 Bonds plus the City's applicable outstanding debt of
$15,380,000 equals $27,755,000, which is below the Charter debt limit.
Term /Call Feature:
The Bonds are being issued for a 12 -year term. Principal on the Bonds will be due
on February I in the years 2018 through 2029. Interest is payable every six months
beginning February 1, 2018.
The Bonds maturing on and after February 1, 2027 will be subject to prepayment
at the discretion of the City on February 1, 2026 or any date thereafter.

Bank Qualification:
Because the original 2007B Bonds were issued as "bank qualified" tax exempt
obligations, the Refunding Bonds will continue to be considered bank qualified
debt without impacting the $10,000,000 limit for new bank qualified debt this
calendar year. Bank qualified status broadens the market for the Bonds, which can
result in lower interest rates.
Rating:
The City's most recent bond issues were rated AA by Standard & Poor's. The City
will request a new rating for the Bonds.
If the winning bidder on the Bonds elects to purchase bond insurance, the rating
for the issue may be higher than the City's bond rating in the event that the bond
rating of the insurer is higher than that of the City.
Basis for
Based on our knowledge of your situation, your objectives communicated to us,
Recommendation:
our advisory relationship as well as characteristics of various municipal financing
options, we are recommending the issuance of general obligation bonds as a
suitable financing option for the following reasons:
- This is the most overall cost effective option that still maintains future
flexibility for the repayment of debt; and,
- This coincides with the City's past practices to finance these types of
projects with this type of debt issue.
Method of
In order to obtain the lowest interest cost to the City, we will competitively bid the
Sale /Placement:
purchase of the Bonds from local and national underwriters /banks.
We have included an allowance for discount bidding equal to 1.20000% of the
principal amount of the issue. The discount is treated as an interest item and
provides the underwriter with all or a portion of their compensation in the
transaction.
If the Bonds are purchased at a price greater than the minimum bid amount
(maximum discount), the unused allowance may be used to lower your borrowing
amount.
Premium Bids: Under current market conditions, most investors in municipal
bonds prefer "premium" pricing structures. A premium is achieved when the
coupon for any maturity (the interest rate paid by the issuer) exceeds the yield to
the investor, resulting in a price paid that is greater than the face value of the
bonds. The sum of the amounts paid in excess of face value is considered
"reoffering premium."
The amount of the premium varies, but it is not uncommon to see premiums for
new issues in the range of 2.00% to 10.00% of the face amount of the issue. This
means that an issuer with a $2,000,000 offering may receive bids that result in
proceeds of $2,040,000 to $2,200,000.
For this issue of Bonds we have been directed to use the premium to reduce the
size of the issue. The adjustments may slightly change the true interest cost of the
original bid, either up or down.

You have the choice to limit the amount of premium in the bid specifications. This
may result in fewer bids, but it may also eliminate large adjustments on the day of
sale and other uncertainties.
Review of Existing Debt:
We have reviewed all outstanding indebtedness for the City and find that refunding
the City's 2009A bonds may offer some potential savings. Refunding these bonds
now, however, will impact the Bank Qualification of the City's refunding bonds
for 2017 and reduce overall savings. We suggest revisiting this opportunity in
calendar year 2018.
We will continue to monitor the market and the call dates for the City's outstanding
debt and will alert you to any future refunding opportunities.
Continuing Disclosure:
Because the City has more than $10,000,000 in outstanding debt (including this
issue) and this issue is over $1,000,000, the City will be agreeing to provide certain
updated Annual Financial Information and its Audited Financial Statement
annually as well as providing notices of the occurrence of certain reportable events
to the Municipal Securities Rulemaking Board (the "MSRB "), as required by rules
of the Securities and Exchange Commission (SEC). The City is already obligated
to provide such reports for its existing bonds, and has contracted with Ehlers to
prepare and file the reports.
Arbitrage Monitoring:
Because the Bonds are tax - exempt obligations /tax credit obligations, the City must
ensure compliance with certain Internal Revenue Service (IRS) rules throughout
the life of the issue. These rules apply to all gross proceeds of the issue, including
initial bond proceeds and investment earnings in construction, escrow, debt
service, and any reserve funds. How issuers spend bond proceeds and how they
track interest earnings on funds (arbitrage /yield restriction compliance) are
common subjects of IRS inquiries. Your specific responsibilities will be detailed
in the Tax Certificate prepared by your Bond Attorney and provided at closing.
We recommend that you regularly monitor compliance with these rules and /or
retain the services of a qualified firm to assist you.
Risk Factors:
The Bonds are being issued for the purpose of a current refunding of previously
issued debt obligations. Those prior debt obligations are "callable" now and can
therefore be paid off within 90 days or less. The new Bonds will not be pre - payable
until February 1, 2026.
As previously noted, the Refunding Bonds will be general obligations of the City
for which its full faith, credit and taxing powers are pledged. The debt service is
expected to paid from liquor store revenue; however, if liquor store revenue is
insufficient to pay debt service, the City may need to increase the levy to pay the
debt service.
This refunding is being undertaken based in part on an assumption that the City
does not expect to have future revenues to pay off this debt and that market
conditions warrant the refinancing at this time.

BACKGROUND: Current market conditions present an opportunity to reduce annual interest expense by
refinancing (a.k.a. refunding) two outstanding bond issues, EDA Series 2007B and City Series 2008A. This
matter was reviewed at the January EDA meeting and the February Council work session. Ehlers and
Associates, the City /EDA's bond consultant, estimates the present value of this interest savings to be
$1,600,000.
Under the City Charter, the ordinance process is required the first time bonds are issued for a project.
Subsequently issuing replacement (refunding) bonds to obtain interest savings only requires the resolution
process under the Charter.
Series 2017A and Series 2017B are both for the purpose of replacing ten -year old bonds at today's lower
interest rates. Series 2017A happens to replacing bonds that were issued by the EDA however, not by the City.
Consequently, Series 2017A must go through the ordinance process, even though it is to replace existing
bonds. Whereas, Series 2017B is replacing bonds that were issued by the City, and does not require the
ordinance process a second time.
STAFF RECOMMENDATION: Staff recommends approval of the motions listed below.

MOTION: Move to schedule the second reading of Ordinance 1639, providing for the issuance and sale of

to be May 8th, 2017, at approximately 7:00 P.M. in the City Council Chambers.

BEING AN ORDINANCE PRO`'IDING FOR THE ISSUANCE AND SALE OF
GENERAL OBLIGATION REFUNDING BONDS, SERIES 2017A,
IN THE MAXIMUM AGGREGATE PRINCIPAL AMOUNT OF $3,375,000
The City of Columbia Heights does ordain:
Section 1. It is hereby determined that:
(a) On September 19, 2007, the Columbia Heights Economic Development Authority
(the "EDA ") issued its Public Facility Lease Revenue Bonds, Series 2007B (Municipal Liquor Stores
Project) (the "Series 2007B Bonds "), in the original aggregate principal amount of $5,040,000. The
Series 2007B Bonds were issued under the terms of a Mortgage and Security Agreement and Trust
Indenture, dated as of September 1, 2007 (the "Indenture "), between the EDA and U.S. Bank
National Association (the "Trustee "). Pursuant to a Ground Lease, dated as of September 1, 2007,
the EDA leases certain land (the "Sites ") from the City of Columbia Heights, Minnesota (the "City ").
Pursuant to a Lease - Purchase Agreement, dated as of September 1, 2007, the Authority leases to the
City, with the option to purchase by the City, the Sites and the facilities constructed thereon,
including the municipal liquor store (the "Facilities ").
(b) Pursuant to Section 3.01(b) of the Indenture, the Series 2007B Bonds maturing on
or after February 1, 2018, are subject to optional redemption, at the election of the City, on
February 1, 2017, and any date thereafter, at a price of par plus accrued interest. The City has
proposed to exercise its option to redeem the outstanding Series 2007B Bonds and acquire the Sites
and the Facilities from the EDA. The Series 2007B Bonds are currently outstanding in the aggregate
principal amount of $3,700,000.
(c) The City is authorized by Minnesota Statutes, Section 475.67, subdivision 3 to issue
and sell its general obligation bonds to refund obligations and the interest thereon before the due date
of the obligations, if consistent with covenants made with the holders thereof, when detennined by
the City Council to be necessary or desirable for the reduction of debt service costs to the City or for
the extension or adjustment of maturities in relation to the resources available for their payment.
(d) The City has detennined that it is necessary and desirable for the reduction of debt
service costs to the City to issue its General Obligation Refunding Bonds, Series 2017A (the
"Bonds "), in the maximum aggregate principal amount of $3,375,000, pursuant to the home rule
charter of the City (the "City Charter ") and Minnesota Statutes, Section 475.67, subdivision 3, to
redeem and prepay the outstanding Series 2007B Bonds and acquire the Sites and the Facilities fi-om
the EDA.
Section 2. Ehlers & Associates, Inc. is authorized to negotiate the sale of the Bonds in the
maximum aggregate principal amount specified in Section 1(d) hereof, in accordance with terns of proposal
approved by the Finance Director of the City. The City Council will meet on Monday, June 12, 2017, or such
other date specified by the City Manager in accordance with the City Charter, to consider the sale of the
Bonds and take any other appropriate action with respect to the Bonds.
Section 3. The EDA is authorized and directed to provide to the Trustee written notice of the
City's election to redeem the outstanding Series 2007B Bonds in accordance with the terms provided in
Section 3.02 of the Indenture.

STAFF RECOMMENDATION:
Revocation of the license to operate a rental unit within the City of Columbia Heights is requested against
rental properties at:
2017 -36 — 4600 Jefferson Street NE
2017 -37 — 4512 Washington Street NE
for failure to meet the requirements of the Property Maintenance Codes.
RECOMMENDED MOTION(S):
Move to close the public hearing and to waive the reading of Resolution Numbers 2017 -36 and 2017 -37,
being ample copies available to the public.
Move to adopt Resolution Numbers 2017 -36 and 2017 -37, being Resolutions of the City Council of the City
of Columbia Heights approving revocation pursuant to City Code, Chapter 5A, Article IV, Section 5A.408(A)
of the rental licenses listed.

Resolution of the City Council for the City of Columbia Heights approving revocation pursuant to City Code,
Chapter 5A, Article IV, Section 5A.408(A) of that certain property rental license held by Jennifer Picken
(Hereinafter "License Holder ").
Whereas, license holder is the legal owner of the real property located at 4600 Jefferson Street N.E., Columbia
Heights, Minnesota,
Whereas, pursuant to City Code, Chapter 5A, Article IV, Section 5A.408(B), written notice setting forth the
causes and reasons for the proposed Council action contained herein was given to the License Holder on April
6, 2017 of a public hearing to be held on April 24, 2017.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of Columbia
Heights, the City Council of the City of Columbia Heights makes the following:
FINDINGS OF FACT
1. That on or about February 28, 2017, inspection office staff sent a letter requesting the owner of the
property submit the rental license application for this property. The letter was mailed by regular mail
to the owner at the address listed in the property records.
2. That on April 5, 2017, inspection office staff reviewed the property file and noted that the property
remained unlicensed. A Statement of Cause was mailed by regular mail to the owner at the address
listed in the property records.
3. That based upon said records of the Enforcement Office, the following conditions and violations of the
City's Property Maintenance Code were found to exist, to -wit:
a. Failure to submit renewal rental license application and fees.
4. That all parties, including the License Holder and any occupants or tenants, have been given the
appropriate notice of this hearing according to the provisions of the City Code, Chapter 5A, Article III
5A.306 and 5A.303(A).
ORDER OF COUNCIL
1. The rental license belonging to the License Holder described herein and identified by license number
F15159 is hereby revoked;
2. The City will post for the purpose of preventing occupancy a copy of this order on the buildings
covered by the license held by License Holder;
3. All tenants shall remove themselves from the premises within 45 days from the first day of posting of
this Order revoking the license as held by License Holder.
