Proposed Ordinance Change Outline
Precious Metal Dealers:
• Buy unwanted precious metal including gold and silver
• May or may not sell purchased materials back to the public
• In most cases, metal is shipped off site and refined /smelted
Rationale for Ordinance Change:
• Current Zoning Code does not define Precious Metal Dealer business
• Current Zoning Code does not regulate Precious Metal Dealer businesses
• Current Zoning Code does not specify where Precious Metal Dealers may locate
KEY ISSUE: Whether or not the particular business will be selling purchased goods back to the
market.
• If so, the business is nothing more than a pawnshop
• If not, further clarification in the Zoning Code is needed to regulate this type of business
Proposed Ordinance Changes Includes:
• Definition of Precious Metal Dealer
• Definition of Pawnshop
• Regulations imposed on Precious Metal Dealers including the requirement of a
Conditional Use Permit (CUP), licensing, reporting sales, etc.
Ordinance Amendment Options:
1. Define "Pawnshop" and include Precious Metal Dealers as a part of the definition
regardless of whether the business sells merchandise back to the public.
Outcome: Precious Metal Dealers would have to follow the same regulations as a
pawnshop, which would include the requirement of a CUP and the
restriction of not being able to locate within 3,000 feet of another
pawnshop, consignment store or currency exchange business.
2. Differentiate between Precious Metal Dealers that sell merchandise back to the public
and ones who don't.
• Those selling back to the public would be classified as Pawnshops and would
have to abide by all rules and regulations governing them.
• Those only purchasing precious metals and not selling back to the public would
need further regulations
• CUP required?
• Distance separation from other "like" businesses required?
• Which Zoning District? General Business, Central Business District, or
both?
3. Allow Precious Metal Dealers as a permitted use, as they are "Personal Service"
industries and have no retail component associated with them.
• No CUP required
• If business would sell merchandise back to the public, the Zoning Code would
still classify the business as a pawnshop.
