XXXX BEING AN ORDINANCE AMENDING ORDINANCE NO. 1490, CITY CODE OF 2005 RELATING TO TRASH HANDLING EQUIPMENT WITHIN THE CITY OF COLUMBIA HEIGHTS The City of Columbia Heights does ordain: Chapter 9, Article I, Section 9.106 (C) of the Columbia Heights City Code, is proposed to include the following additions and deletions: § 9.106 GENERAL DEVELOPMENT STANDARDS. (C)Accessory uses and structures. (5)Trash handling equipment. For all uses other than one- and two-family located in the side or rear dwellings, trash and/or recycling collections areas shall be yards only, located no closer than one (1) foot from any side or rear property lines. The trash and/or recycling areas shall be screened utilizing a 6-foot wall with the same exterior masonry material as the principal structure and shall include a latchable gate with at least 80% opacity. enclosed on at least three sides by an opaque screening wall or fence no less than six feet in height. The open side of the enclosure 96-gallon shall not face any public street or the front yard of any adjacent property. trash receptacles shall be screened with a wall of sufficient height to completely screen the receptacle, constructed with the same masonry material as the principal structure. Such enclosures shall also be equipped with a latchable gate with at least 80% opacity. (a)All multi-family housing properties shall construct a trash enclosure as described in § 9.106 (C)(5) within two (2) years of the effective passage of the ordinance. Section 2: This ordinance shall be in full force and effect from and after 30 days after its passage.
