WHEREAS: The Constitution of the United States of America, the guardian of our liberties,
embodies the principles of limited government in a Republic dedicated to rule by law; and
WHEREAS: September 17, 2016, marks the two hundred twenty -ninth anniversary of the
framing of the Constitution of the United States of America by the Constitutional
Convention; and
WHEREAS: It is fitting and proper to accord official recognition to this magnificent document
and its memorable anniversary, and to the patriotic celebrations which will commemorate it;
and
WHEREAS: Public Law 915 guarantees the issuing of a proclamation each year by the President
of the United States of America designating September 17 through 23 as Constitution Week,
NOW, THEREFORE I, Gary Peterson by virtue of the authority vested in me as Mayor of the City

The following are the minutes for the regular meeting of the City Council held at 7:00 PM on Monday August 8,

1. CALL TO ORDER
Mayor Peterson called the meeting to order at 7:05 p.m.

Motion by Councilmember Williams, seconded by Councilmember Nawrocki to appoint Nancy Becker as
Council Secretary Pro Tem. All Ayes, Motion Carried.

A. Mayor Peterson introduced Sarah Burghardt, the new Sun Focus Reporter for the City of Columbia Heights.
B. Sal Di Leo commented on the great accomplishment of Columbia Heights being awarded the All- America
City Award and the positive attention that has been focused on our community because of it. He invited the
Council and the public to attend the third annual City of Peace Awards event which will be held at Murzyn Hall
on September 11, 2016, the fifteenth anniversary of the attacks on the United States. In response to those
attacks, the City of Peace movement was started by citizens and led by Mayor Peterson with the mission of
regaining the peace the City had enjoyed prior to September 11, 2001, and to empower all people within the
City, recognizing them as individuals, not categories.
C. Councilmember Schmitt requested the addition of a report of a meeting that she attended at the Mississippi
Watershed Management Organization (MWMO) on August 4, 2016. It was part of a Planning Seminar
cosponsored by Barr Engineering.
Donna Schmitt reported on the meeting she attended at MWMO regarding stormwater infrastructure. Key
points were: the importance of volunteers in managing stormwater runoff, the incorporation of faith
communities, and the advantages of narrowing streets. She stated that it was a great learning experience and
MWMO offers many opportunities to the public to learn about a variety of interesting topics.

Councilmember Nawrocki asked the City Manager what impact this has on the budget. City Manager Walt
Fehst responded that the budget revenue will be increased and that this action simply itemizes, recognizes,
and accepts the revenue.

MOTION: Move to adopt City of Columbia Heights, Minnesota, Resolution 2016 -65, being a resolution
accepting a contribution of $17,373 from the Columbia Heights Activity Fund, and amending the 2016

MOTION: Move to approve the items as listed on the business license agenda for August 8, 2016.
G. Payment of Bills
Councilmember Nawrocki said he had asked previously for a breakdown of revenues and expenditures for
the new library building, beyond what had come out of the bond issue. Finance Director Joseph Kloiber
responded that we had provided initial numbers for his previous inquiry, and will now furnish the updated
numbers.
MOTION: Move that in accordance with Minnesota Statute 412.271, subd. 8, the City Council has received
the list of claims paid covering check number 162225 through 162407 in the amount of $ 1,611,981.83.
Councilmember Schmitt requested items D and E be removed for discussion.
Motion by Councilmember Murzyn Jr., seconded by Councilmember Nawrocki to approve the consent
agenda items A, B, C, F, and G. All Ayes, Motion Carried.
The following items were removed for discussion:
D. Resolution 2016 -66 Awarding the Purchase of a Police Vehicle and Radio, and Amending the Related
2016 Budgets.
Police Chief Scott Nadeau explained that there was an accident involving a 2013 marked police vehicle in the
Columbia Academy parking lot in June, 2016. The League of Minnesota Cities Insurance Trust (LMCIT)
determined that the vehicle was totaled. The cash value of the vehicle was less than the cost of a
replacement vehicle, so this budget amendment covers the difference between the amount paid out by
LMCIT and the cost of the new vehicle. In addition, this is an opportunity to purchase a new squad car radio.
In 2018 the current radio will become obsolete and would need to be replaced at additional cost, so it is
preferable to install the new encrypted signal style radio in the replacement vehicle now. Councilmember
Nawrocki asked which driver was responsible for the accident and whether the other driver's insurance
would cover the damages. Chief Nadeau stated the accident was considered primarily the other driver's fault,
but with no -fault insurance your own insurer typically covers your damages and then may attempt to recover
costs from the other insurance company.
Motion by Councilmember Murzyn Jr., seconded by Councilmember Nawrocki to waive the reading of
Resolution 2016 -66, there being ample copies available to the public. All Ayes, Motion Carried.
Motion by Councilmember Murzyn Jr., seconded by Councilmember Nawrocki to adopt City of Columbia
Heights, Minnesota, Resolution 2016 -66, being a resolution awarding the purchase of a police vehicle to Ford
of Hibbing in the amount of $24,178, the purchase of a police radio through Anoka County in the amount of
$4,550, and amending the 2016 budgets of the Insurance Fund 884 and the Capital Equipment Fund 431 to
appropriate these amounts. All Ayes, Motion Carried.
E. An Ordinance opting out of the requirements of Minnesota Statutes, Section 462.3593.
At Councilmember Schmitt's request, Planner Elizabeth Holmbeck gave an overview of the requirements
of Minnesota Statutes, Section 462.3593 as well as the opt out provision which is available to the City.
She stated that if the City would like to expand housing to include accessory structures, the
recommended procedure is to opt out of this requirement now and adopt an Ordinance later that would
better suit our City. Councilmember Schmitt commented that she thinks this is a unique idea, but she has
concerns given the small lot sizes throughout much of Columbia Heights. She stated that she thinks it is a
good idea to opt out at this point, but bring it back later in a different version.
Eric Mosman, 3906 3rd Street, stated that as he reads the statute, the City does not have the right to opt
out of this requirement. He believes that only the county can opt out and this is an emergency measure
because it is a health issue and it should not be delayed. City Attorney Jim Hoeft responded that the City
does indeed have the authority to opt out. This is a state enacted provision and each city needs to
evaluate it for their community and consider how it works with their current zoning.
Motion by Councilmember Nawrocki, seconded by Councilmember Schmitt to waive the reading of Ordinance
No 1632, there being ample copies available to the public. All Ayes, Motion Carried.
Motion by Councilmember Nawrocki, seconded by Councilmember Schmitt to approve Ordinance No 1632,
being an Ordinance opting out of the requirements of Minnesota Statutes, Section 462.3593, on first
consideration. The second consideration will take place on August 22nd, 2016 at approximately 7:OOpm in the
Council Chambers of Columbia Heights City Hall, All Ayes, Motion Carried.

Councilmember Nawrocki asked for clarification about a Greensheet item from the Community Development
Department about "Open to Business, 15t and 2"d Quarter Results." Elizabeth Holmbeck replied that Open to
Business is a free service offered by the Consortium of Community Developers through Anoka County for
business owners or those who are interested in starting a business. A representative has office hours at City
Hall once per month.
City Manager Walt Fehst reported that he met with the School District Superintendent, Mayor, Police Chief,
and several members of the school administration to discuss the plans which are being made for honoring
Medal of Honor recipients this fall. The School District is preparing for many activities, one of which will be
rededicating a flagpole on October 6th. The City also has a flagpole which will be rebuilt in the next week or two
and will be moved closer to the water at LaBelle Park (James LaBelle from Columbia Heights, was a Medal of
Honor recipient). We would like to rededicate our flagpole within a day or two of the School District's
rededication ceremony and will see if we can get a Medal of Honor winner to come and participate, since there
are many coming to Minneapolis for the Congressional Medal of Honor Convention, on October 4 -8.
Councilmember Nawrocki asked if they talked about joining together on one memorial event. Fehst replied that
the School District is intent upon going ahead with their own dedication, so there will be two separate
memorials.
Councilmember Nawrocki thanked and complimented Mayor Peterson on the thank you letter he wrote to the
resident who helped the people who were trapped on University Avenue during the last heavy rainfall.
Councilmember Nawrocki stated he appreciated that the Jamboree parade was now showing on Cable TV
Channel 16.
Councilmember Nawrocki followed up on a question he had previously asked about the elevation of the
property at 4860 Monroe. Because the house is so low, he inquired as to whether the house was built before or
after the street was constructed. City Manager Walt Fehst said he thought the house was probably built low to
begin with. Nawrocki requested that he double check on it.
City Manager Walt Fehst reminded everyone that the primary election is tomorrow for candidates for City
Council and Mayor. Polls will be open for voting from 7:00 AM to 8:00 PM.
11. CITIZENS FORUM
Frost Simula, 1700 49th Avenue, expressed concern about a property in his neighborhood with major
construction going on and with no permits displayed in the windows. Mr. Simula stated that he has contacted
the City numerous times regarding this, and has been told that this project does have permits. He is concerned
about the quality of the work being performed and now the property has been put back on the market, even
though the permits have not been closed out. What guarantee does the purchaser of this property have that
the permits have been completed, closed out, and the home meets our codes? Mayor Peterson responded that
in order to get a certificate of occupancy, the inspections will need to have been completed and the permits
signed by the building inspector, but a property can be sold before the work has been completed.
Councilmember Nawrocki requested that the City Manager check with the Building Department to get more
information and check to see if the permits are posted as required and whether the work is being properly
done.

Connie Buesgens, 102144 th Avenue NE, stated she thinks the City has an awesome staff, and she wanted to
especially thank the Community Development Department for their work in bringing a Hy -Vee store to the City.
Secondly, she wanted to report on the MWMO workshop she attended with Councilmember Schmitt. Two
things she took away from the meeting were (1) She saw some interesting designs that combine improving
stormwater drainage with deterring speeding traffic and (2) Although there are advantages to these designs,
there are also costs to consider, such as fewer parking spaces. Her third comment was about the parking ramp
across from El Tequila. She said it was very dirty and wondered who was responsible for it. City Manager Walt
Fehst responded that presently the ramp belongs to the City, but we have contracted with a management
company to maintain it, so we will check with them about the condition.
Todd Kruse, President of the Twin Cities North Chamber of Commerce, thanked the City for working with them
and announced that the Second Annual Chamber Movie Night would be at the Heights Theater on September
20th
Harold Hoium, 4200 3`d Street NE, shared his concerns about cleanup after storms, unlicensed workers, tree
stumps, and snow plowing.
12. ADJOURNMENT
Mayor Peterson reminded us to remember our service men and women, and our police officers and
firefighters, and to keep them in our thoughts and prayers. Try to enjoy life and do a random act of kindness.

RESOLUTION NO. 2016 -65
A resolution of the City Council for the City of Columbia Heights, Minnesota, accepting a contribution from the
Columbia Heights Activity Fund in the amount of $17,373; and amending the 2016 budget for the City's
Contributions Fund 883 for the same amount.
Whereas, City Council adopted an initial 2016 budget by resolution 2015 -97; and
Whereas, the City was subsequently awarded a contribution of $17,373 from the Columbia Heights Activity Fund
for food and lodging expenses related to participation in the National Civic League's 2016 All American City event;
and
Whereas, the acceptance of this additional revenue and the related expenditure were not included in initial 2016
budget;
Now, therefore, in accordance with all ordinances and regulations of the City of Columbia Heights, the City Council
of the City of Columbia Heights makes the following:
ORDER OF COUNCIL
IT IS HEREBY RESOLVED, that the City of Columbia Heights accepts a contribution of $17,373 from the Columbia
Heights Activity Fund, and amends the 2016 budget for the City's Contributions Fund 883 for the same amount.

Whereas, a subsequent event led to the total loss of a certain police vehicle; and

Met Council Reform Discussion with Patricia Nauman Metro Cities & MN State Representative
Carolyn Laing
Patricia Nauman explained the League of MN Cities created a subsection to represent the collective
interest of cities at the Metropolitan Council. Metro Cities created a task force in 2011,
recommendations included staggered terms, governor appointment of members, and the formation of
a nomination committee.
The Metro Council would recommend against city or county officials serving on the Met Council for a
variety of reasons including incompatible offices, local officials would serve as both a regulator and
regulated party.
Director Hogeboom indicated that the Met Council has been good to work with in the past. Fehst
noted we have had very good relations with the Met Council as well, stating we could do nothing, and
not take a formal position
Representative Carolyn Laine agreed the Met Council works for Columbia Heights, and would not
recommend the Council consider the Anoka County proposal.
Councilmember Nawrocki stated he does not think it would be a bad idea for local elected officials to
serve on the Met Council, noting it could improve relations between the groups.
Nawrocki stated staggered terms probably would not make too much a difference. Councilmember
Schmitt stated she is in favor of staggered terms noting the disadvantage of the council changing over
completely when there is a new Governor.
Representative Laine recommended the council consider an alternate resolution from the one
submitted by Anoka County. Councilmember Schmitt agreed that the proposed resolution from Metro
Cities would be a good starting point.
City Manager Fehst commented that the City is no longer a member city of Metro Cities, and suggested
the council consider renewing our membership.
Proposed Ordinance "Opting Out" of New Temporary Dwelling Unit Requirements
City Planner Elizabeth Holmbeck reported that in May 2016, Governor Dayton signed a bill that creates
a new statewide permitting process that allows a specific type of temporary transitional housing in

residential districts. The transitional housing would be permitted in freestanding structures or vehicles
on residential properties, aside from the main home on the property.
State law requires that all communities in Minnesota either begin issuing permits for such housing, or
"opt out" of this requirement by September 1, 2016. Community Development staff suggests that the
City of Columbia Heights consider opting out of this requirement.
Representative Laine provided detail on the temporary units, as well as the specific legislation
pertaining to them.
Councilmember Nawrocki asked what the cost is for the unit. Schmitt stated rent is $1,250 /month.
Director Hogeboom reported that by opting out at this time, the City can take time to look at the
zoning code more thoroughly. Councilmember Nawrocki commented that a majority of homes in
Columbia Heights are built on small lots.
Representative Laine stated this is good legislation to address a future need, and suggested that if the
council choses to opt out, they draft an ordinance in the near future.

PUBLIC HEARING TO REMOVE "NO PARKING" DESIGNATION ON THE EAST SIDE OF JACKSON STREET
Residents present:
Steve Smith representing Immaculate Conception Church, 4030 Jackson Street
At the January meeting the Traffic Commission called for a public hearing to consider removing the "No
Parking Saturday 4 PM to 6 PM" and "No Parking Sunday 6 AM to Noon" designations on the east side of
Jackson Street from 41St Avenue to approximately 230' south of 41St Avenue. There are five different
parking "zones" along Jackson Street. The Public Hearing notice was published in the Sun Focus and
property owners within 300' of the proposed change in parking designations were notified of the hearing
by mail.
On behalf of Immaculate Conception Church, Mr. Steve Smith requested the "No Parking" signs for
Saturday and Sunday be removed. The church feels there is no longer a need for a no parking restriction,
and, as parishioners are aging, the church would like to offer parking closer to the door. The "No
Parking" signs were originally put up because of a protester who would park his car mounted with very
offensive signs. The "No Parking" signs did not hinder the protester from displaying his signs; he simply
parked around the corner. Since this protester has not been seen for over six months, the church is
requesting removal of the no parking signs to recover the parking spaces.
Motion by Olson to remove the "No Parking Saturday 4 PM to 6 PM" and "No Parking Sunday 6 AM to
Noon" designations on the east side of Jackson Street from 41St Avenue to approximately 230' south of
41St Avenue. Motion seconded by Carlson. Motion passed unanimously.

REQUEST TO DESIGNATE THE SOUTH SIDE OF 40T' AVENUE FROM 5T" STREET TO 20' EAST OF 5T" STREET
AS "NO PARKING ".
Commissioner Clerkin has requested no parking 20' from the southeast corner of 5th Street and 40th
Avenue so it is possible to see around trucks. He stated he has almost been hit many times coming from
that intersection.
The police report shows only one accident in five years, which had nothing to do with visibility. Clerkin
still feels visibility is a safety issue. He has talked to other residents who agree and they would like some
type of buffer. Vans are parked all the way to the edge of the corner requiring cars to pull out further
into the intersection. There is currently only a daycare center on the corner and no stores. Young
stated this will require a public hearing to give business owners an opportunity to speak.
Motion by Clerkin to call a Public Hearing for the next Traffic Commission meeting to request no parking
20' from the southeast corner of 5th Street and 40th Avenue. Seconded by Doty. Motion passed
unanimously.

Commissioner Tyler moved to Shoreview and has resigned from the Traffic Commission. Carlson
requested we send him a thank you letter. Young stated she will draft one up for everyone to sign at
the next meeting. Schmitt suggested that we remind the council secretary of Commissioner Tyler's
resignation. She also advised that we did receive an application requesting appointment to a
Commission. The applicant asked for Planning & Zoning, Traffic, or Charter so there is a possibility he
could get appointed. Application was from an Adam Schell at 4128 Arthur Street. Apparently he has
only lived in Columbia Heights for a short period of time.
A disabled parking sign has been requested by the resident at 4220 Van Buren Street. The sign will be
installed when weather permits.

Doty inquired about putting up a seasonal "Turtle Crossing" sign from May to July on either 491h
Avenue and /or Innsbrook Parkway to warn drivers about turtles crossing the street. The turtles leave
Highland Lake to lay eggs from May to July and many of them get run over. He would like to see
some type of signage. Other cities put up seasonal signs for this type of thing. Young stated she will
discuss it with the Public Works Director but seasonal signs are somewhat difficult.

On May 12, 2016, Governor Mark Dayton signed a bill that creates a new statewide permitting process that
allows a specific type of temporary transitional housing in residential districts. The transitional housing would
be permitted in freestanding structures or vehicles on residential properties, aside from the main home on the
property. Anyone certified with needing assistance with two or more "instrumental activities of daily life" for
physical or mental reasons may reside on the property on which the "caregiver" or "relative" lives.
State law requires that all communities in Minnesota either begin issuing permits for such housing, or "opt
out" of this requirement by September 1, 2016. Due to the complexities associated with this new law, as well
as potential unforeseen consequences of allowing temporary living structures to exist on residential
properties, many communities in the Twin Cities Metropolitan Area are considering adopting ordinances to
opt out of this requirement. Community Development staff suggests that the City of Columbia Heights
consider opting out of this requirement, as well, at this time.
STAFF RECOMMENDATION:
Staff does not feel that allowing quasi - permanent recreational vehicles and other structures to be lived in on
residential lots is a safe and effective land use. There could be land -use and performance standard issues that
could occur on lots throughout the City, particularly because Columbia Heights has many smaller lots. There
are a number of concerns staff have regarding this type of transitional housing, including:
• How to provide electricity and other utilities to the units.
• How the units will receive sanitation services.
• How fresh water will be supplied to the units.
• Whether or not the units will be allowed for people who do not meet the state definition of disabled.
• Setback and height requirements for units.
• Other aesthetic considerations (color, building materials, type of unit, etc.)
• Whether or not the units will be temporary, quasi - permanent, or permanent.
• What type of permitting process will be used to allow these units (licenses, Conditional Use Permits, etc.)
• Who will inspect the units, and what measures will be used to evaluate inspections.
• Frequency of inspections.
• Penalties for code violations.
Staff suggests that the Council adopt an ordinance to "opt out" of this mandate, as permitted by state law. If
the City ever were to consider expanding housing to include accessory structures the best approach would be
to opt out of this requirement and adopt an Ordinance structured in a manner that addresses land -use and
performance standard concerns and best suits our City. Staff intends to further research this matter later this
year.

BACKGROUND: On March 28, 2016 the City Council awarded the annual crack sealing program to American
Pavement Solutions, Inc. The project was bid as part of the North Metro JPA for Street Maintenance Program.
Approximately 5,367 L.F. was routed and sealed in Zone 7B prior to the 2016 seal coat and 51,504 L.F. was
routed and sealed in Zone 1 prior to the 2017 seal coat. It is preferable to crack seal one year prior to seal
coating. Staff made an error in the estimated quantity for the bid. All crack sealing not included in either the
Zone 7B or Zone 1 seal coat areas was removed from the project.
STAFF RECOMMENDATION: The crack sealing project is complete. A final compensating change order and a
copy of the Engineer's Report of Final Acceptance are attached. Staff is recommending final acceptance of the
work and final payment to American Pavement Solutions, Inc.

BACKGROUND: Since 2007, the Park & Recreation Commission has used a process of public input and review
to form a basis for the creation of Master Plans for the redevelopment of City parks. To date, Sullivan Lake
Park, Silver Lake Beach Park, Ramsdell Park, and LaBelle Park have all had Master Plans prepared. Based on
the completed Master Plans, construction plans and specification were prepared for each park.
In 2016, the Parks budget has funds established for the planning process of another City park, Keyes Park, as
selected by the Park & Recreation Commission.
STAFF RECOMMENDATION: A similar master planning process has now been completed, considering
condition of the park and amenities, park features and unmet needs, past Commission and public
discussions /review, and uses. The Commission held an informational meeting for Keyes Park in April with two
Concept Plans presented and reviewed. Following that meeting, the concept plans were placed on the City
website and at the Library, The Commission reviewed all public comments at their May 2016 regular meeting
for a final recommendation to the City Council.
A summary of comments received via email, phone or letter are attached. Based upon the review process,
staff would recommend the Master Plan include the following elements:
1. Realigned athletic fields (2)
2. Introduction of a soccer field
3. Remodeling of the existing warming house
4. Adding a medium -sized picnic shelter to the warming house
5. New playground
6. Addition of a paved walking trail
7. An outdoor adult fitness area
8. Reconfigured parking lots

10. Site landscaping
11. Preserve sliding hill
RECOMMENDED MOTION(S): Move to accept the Master Plan as prepared by the firm of ISG, based upon a
recommendation of the Park & Recreation Commission.

KEYES PARK COMMENTS
Concept 1
Make a bigger parking lot. Leave some space for future additions by making picnic area smaller.
My main concern for each concept is lack of parking at the lot near the sharp corner of 45th Ave. I live
just down the road from this corner and during the summer with all the ball games going on, there is
NOT enough parking so people park along the road, which leads to congestion by (and on) the sharp
45th Ave. curve. It's dangerous, trust me ... trying to get home and driving thru the mess is a pain in the
rear! This park is extremely busy with ball games all summer and isn't big enough to accomodate the
cars.
This Concept separates all the features which I dislike.
Concept 2
I prefer Concept 2. Soccer field must be movable.
Eliminate soccer field. McKenna Park has a soccer field, and there have been many complaints about
games being played late, noise, alcohol consumption, and smoking pot there by the soccer players.
Heights doesn't need to attract these types of issues.
I feel this Concept is better. Picnic area and children's play area are together which would allow for easy
monitoring of children at play while families may gather for picnics. Also having the ball fields come
together at one point allows for easy monitoring if participants happen to be on both fields.
Master Plan
Would like an adult /teenage size soccer field.
I believe most picnic areas should have some sun shelter above the benches, as in the summer months
they become unusable without shade.
Please update the playgrounds, put in more garbage cans, and just liven up the place.
Add lighting around the picnic area.
Other Comments
Please replace one of the baseball fields with a soccer field. Whenever it's nice out, the neighbor kids are
always at the park kicking a soccer ball around. Also, it would be nice if we could have a bee and
butterfly friendly garden there. I would be happy to maintain it.
A pedestrian walkway down Mc Leod would be helpful. This is a high traffic area and no sidewalk is
available. Connect sidewalk from 44th to park.
A sidewalk connection from 44th Avenue to Keyes Park.

BACKGROUND: The new library located at 3939 Central Avenue is now complete and in operation. The prior
building located at 820 401h Avenue is currently for sale and on the market. The old shelving units are still in
the building and may have a limited resale value. A list of all of the shelving units is attached.
STAFF RECOMMENDATION: Staff is proposing to advertise the sale of the shelving units with bids due at the
end of September. In the event that public bidding does not provide sufficient value, staff would then
recommend holding an auction at the library site to dispose of the shelving units and the remaining furniture
in the building space.
RECOMMENDED MOTION(S): Authorize staff to dispose of the steel shelving at the former library site located
at 820 40th Avenue, by either public bids or auction.

BACKGROUND: Mayor Gary Peterson has been leading the effort to bring back the feeling of peace to
Columbia Heights that would span several years. Three monuments have been funded and installed in the city,
which are permanent reminders of the importance of striving for peace in Columbia Heights. The monuments
include the Clock Tower at 40th and Central Avenues in 2006; the bronze statue "Always on Guard" in front of
the public safety building on 41st Avenue in 2009; and the Heritage Tower along with the adjacent Hentges
Legacy Garden in May 2013.
To continue this effort, the City Council, supported by the Police Department in neighborhood outreach, has
been working on a new peace initiative located on Circle Terrace. The City purchased three lots along Circle
Terrace and this area was included in the LaBelle Park Master Plan, originally approved in 2012 and amended
by the Council in 2015. Staff has also secured CDBG funding for a new multi - purpose building identified in
the original plan.
Previously, this area has been referred to as either the Circle Terrace play lot or an extension of the LaBelle
Park main park. The official naming of this area was reviewed and discussed by the Park & Recreation
Commission at their June regular meeting, and their recommendation is to officially name this as the City of
Peace Park, consistent with the City of Peace efforts and the Police Department's outreach to this area.
Work on the park has been conducted by staff and consists of site grading and erosion control. The 2016 Park
budget included the replacement of the playground equipment and providing for a sport court following the
amended Master Plan.
STAFF RECOMMENDATION: Rename the park to City of Peace Park, based on a recommendation of the Park
& Recreation Commission.
RECOMMENDED MOTION(S): Move to waive the reading of Resolution 2016 -73, there being ample copies
available to the public.
Move to adopt Resolution 2016 -73 changing the name of Circle Terrace Park to City of Peace Park based upon
a recommendation from the Park & Recreation Commission.

BACKGROUND:
Work on environmental soil remediation and site grading is complete. As indicated to the Council at contract
award of CP -1, the extent of contaminated and unsuitable soils was estimated based on soil borings, but could
vary significantly. If found suitable, soils excavated on -site were intended to be reused on -site.
Additional work was required during construction due to the extent of contaminated or unsuitable materials.
The change order (attached) is for the following construction items:
1) Additional removal of contaminated soil (final quantities).
Additions or deletions to the contract modified quantities using the contract bid prices.
STAFF RECOMMENDATION:
ICS Consulting and staff recommend approval of Change Order No. 3 for the Library Bid Package CP -1.
RECOMMENDED MOTION(S):
Move to approve contract Change Order No. 3 for Library Bid Package CP -1, Project 1410, to Veit & Company
in the amount of $27,046.45 for a new contract amount of $675,789.07.

BACKGROUND: The 2016 Parks budget has $40,000 allocated for the replacement of the play area and
equipment at the City of Peace Park. A site plan has been reviewed and approved by the Park & Recreation
Commission, following the amended Labelle Park Master Plan approved by Council in 2015.
The new equipment for the last several playground replacements has been GameTime equipment. The local
vendor has informed us that GameTime is now available off the U.S. Communities National Joint Purchasing
Contract (information sheet attached).
Staff based the equipment selection on what was previously available and what would fit within the small
space of the park available. The contract includes all the play elements of the plan including a swing set, a
small playset with slides, the engineered wood fiber surfacing, matching benches and trash can, and a
basketball hoop for the sport court.
The national contract pricing is $24,980 plus shipping.
STAFF RECOMMENDATION: Staff recommends purchasing playground equipment from GameTime off of the
U.S. Communities National Joint Purchasing Contract in the amount of $24,980 plus shipping.
RECOMMENDED MOTION(S): Move to authorize the purchase of replacement playground equipment in the
amount of $24,980, plus shipping, from the Park Development Fund 412, and furthermore authorize the
Mayor and City Manager to enter into an agreement for the same.

City Attorney at both the April and July meetings, the Charter Commission proposes the attached amendment to
the City Charter.

CHAPTER 3, SECTION 19
PROCEDURE ON ORDINANCES.
The City of Columbia Heights does ordain:
SECTION 1:
Chapter 3, section 19 is amended as follows:
Section 19. PROCEDURE ON ORDINANCES. "The enacting clause of all ordinances by the council
shall be in the words, "The City of Columbia Heights does ordain," Every ordinance shall be
presented in writing. Every ordinance, other emergency ordinances and interim ordinances, shall
have two public readings in full, except that the reading may, by four - fifths (4/5) vote, be
dispensed with, provided the printed text is made a part of the official minutes upon passage and
at least three days shall elapse between the first and second readings thereof. Every ordinance
appropriating money in excess of five hundred dollars, and every ordinance and resolution
authorizing the making of any contract involving a liability on the part of the city in excess of five
hundred dollars, shall remain on file in the office of the secretary of the council at least one week,
and shall be published at least once in the official newspaper of the city or posted on official
bulletin boards in the manner provided by this charter, before its final passage except in the case
of emergency ordinances. (Election ballot question passed November 5, 2002) (Ordinance 1079,
passed March 26, 1984)
SECTION 2:
This Ordinance shall be in full force and effect from and after thirty (30) days after its passage.

Resolution of the City Council for the City of Columbia Heights declaring the property a nuisance
and approving emergency abatement of ordinance violations pursuant to Chapter 8, Article II, of City
Code, of the property owned by Investors Group of Minnesota LLC (Hereinafter "Owner of
Record ").
Whereas, the owner of record is the legal owner of the real property located at 4001 University
Avenue N.E. Columbia Heights, Minnesota.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of
Columbia Heights, the City Council of the City of Columbia Heights Makes the following:
FINDINGS OF FACT
1. That on August 9, 2016 the Fire Department responded to a complaint at the address listed
above. Inspectors noted that the structure was open and unsecured.
2. That on August 9, 2016 the Fire Chief ordered that Advance Companies secure the vacant
structure.
3. That based upon said records of the Fire Department, the following conditions and violations
of City Codes(s) were found to exist and have been abated, to wit:
A. Approve the emergency abatement of the hazardous situation located at 4001
University Avenue N.E.
CONCLUSIONS OF COUNCIL
1. That the property located at 4001 University Avenue N.E. is in violation of the provisions of
the Columbia Heights City Code as set forth in the Notice of Abatement.
2. That the emergency abatement of the hazardous situation located at 4001 University Avenue
N.E. is hereby approved.

Whereas, the owner of record is the legal owner of the real property located at 4321 University Avenue N.E.,
Columbia Heights, Minnesota.
And whereas, pursuant to Columbia Heights Code, Chapter 8, Article II, Section 8.206, written notice setting

The Metropolitan Council governs regional planning for the seven - county Twin Cities Metropolitan Area. This
region includes Hennepin, Ramsey, Anoka, Dakota, Washington, Scott and Carver Counties. As part of its
general oversite, the Metropolitan Council oversees regional land use and transportation planning, affordable
housing management, management of the regional sanitary sewer system and oversite of Metro Transit.
The Metropolitan Council is the only regional planning agency in the United States that is operated by
unelected officials. Critics of the Metropolitan Council say that the system creates taxation without
representation. Supporters of the current system believe that competing political interests would stifle
infrastructure planning and housing resource allocation on a regional level. Most groups concur that some
level of reform is needed to ensure greater consistency in Council policies and practices during the change of
gubernatorial administrations.
In May, Anoka County Board Chairperson Rhonda Sivarajah met with the City Council to request support of the
Twin Cities' Local Government Coalition for Metropolitan Council Reform. Chairperson Sivarajah stated that
the coalition is comprised of a number of local government officials from Anoka, Dakota Carver and Scott
Counties, as well as 34 cities, who have joined together to develop a position statement, as well as a set of
guiding principles, meant to reform metropolitan governance in the Twin Cities.
In August, Metro Cities Executive Director Patricia Nauman and Minnesota Congressperson Carolyn Laine met
with the City Council to discuss the issue of Metropolitan Council reform. Metro Cities, which represents the
interest of cities that fall under the jurisdiction of the Metropolitan Council, supports reform measures that
would stagger terms of Councilors, as well as enhancements to the Councilor nominating process. The
majority of the City Council concurred with Metro Cities' position. The attached resolution reflects Metro
Cities' requests for Metropolitan Council reform.
STAFF RECOMMENDATION:
Staff recommends adopting the attached Resolution as presented.
RECOMMENDED MOTION(S):
Motion: Waive the reading of Resolution No. 2016 -69, there being ample copies available to the public.

Whereas, the Metropolitan Council (Met Council) has been the regional policy- making body, planning agency, and
provider of essential services for the seven - county Twin Cities region for nearly 50 years, and;
Whereas, a 17- member board appointed by the Governor guides the strategic growth of the metro area, adhering to the
council's mission of fostering efficient growth for a prosperous region. Local officials and citizens share their expertise
with the council by serving on key advisory committees, and;
Whereas, Metro Cities represents the shared interests of cities in the metropolitan region at the Legislature and
Metropolitan Council and has adopted the following policies on regional governance, and;
Whereas, Metro Cities supports the appointment of Metropolitan Council members by the Governor with four year,
staggered terms for members. The appointment of the Metropolitan Council Chair should coincide with the term of the
Governor, and;
Whereas, Metro Cities supports a nominating committee process that maximizes participation and input by local officials
and supports having a majority of local officials serve on the nominating committee to recommend Metropolitan Council
members. Metro Cities supports a public and transparent process in the nominating process for recommending local
officials to the Governor for appointment to the Metropolitan Council, and;
Whereas, Metro Cities supports the appointment of Metropolitan Council members who have demonstrated the ability
to work with cities in a collaborative manner and commit to meet with local government officials regularly, and who
understand the diversity and the commonalities of the region, and the long -term implications of regional decision -
making, and;
Whereas, the City Council discussed and concurred with the policy on its August 1, 2016 Work Session meeting.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of Columbia Heights,
the City Council of the City of Columbia Heights hereby supports Metro Cities' policies on regional governance.

BACKGROUND:
In April, 2015, the City Council adopted revised official logos, an official style guide and an official "brand" for
the City of Columbia Heights. Since that time, Columbia Heights has incorporated the new City logo into
infrastructure signage, vehicle signage, official documents, and other promotional devices. At the time of
initial brand adoption, the City adopted the official tagline, "Rediscover the Heights ".
While "Rediscover the Heights" is still a valid and useful tagline, in light of the recent designation as an All-
America City, as well as the ongoing effort to be a City of Peace (including the formal request to re -name the
LaBelle /Circle Terrace Play Lot as City of Peace Park), staff recommends incorporating the following taglines
into our officially approved Logos and Style Guide document:
Columbia Heights: All-America City
Columbia Heights: City of Peace
An illustration of the logo applications is attached for your reference. There may be times when the use and
application of the aforementioned taglines are appropriate.
STAFF RECOMMENDATION:
Staff recommends approval of Resolution No. 2016 -74, amending Official Logos, Style Guide and Brand for the
City to include the additional taglines of "Columbia Heights: All-America City" and "Columbia Heights: City of
Peace ".
