contingent upon receiving a grant from the Columbia Heights Foundation Library Foundation for the entire

The following are the minutes for the regular meeting of the City Council held at 7:00 PM on Monday

The following items were removed from the Consent Agenda for discussion:
D. Consideration to adopt the State Records Retention Schedule
City Manager Walt Fehst explained the City is looking to come into compliance with the State's
recommended Records Retention Schedule. Manger Fehst suggested tabling the item and plan to discuss at
a future worksession.
Motion by Councilmember Williams, seconded by Councilmember Murzyn, Jr. to table the item adopting
Resolution 2015 -13, adopting the General Records Retention Schedule for Minnesota Cities, and to submit
notification to the Minnesota Historical Society. All Ayes, Motion Carried, Item Tabled.
F. Payment of Bills
Councilmember Nawrocki questioned a payment in the amount of $1,164.00 to DC Management &
Environmental. It was determined this was a payment for the clean -up of hazardous material from the gun
range.
Motion by Councilmember Nawrocki, seconded by Councilmember Williams to move that in accordance
with Minnesota Statute 412.271, subd. 8, the City Council has received the list of claims paid covering check
number 159796 through 159948 in the amount of $1,081,223.50. All Ayes, Motion Carried.
8. PUBLIC HEARINGS
A. Consideration of Declaration of a nuisance and abatement of violations within the City of Columbia
Heights is requested regarding the property at 723 38th Avenue NE and 3924 Main Street NE for failure
to meet the requirements of the Residential Maintenance Code.
Fire Chief Gary Gorman reported the property at 723 38th Ave NE currently does not have an overhead
garage door.
Holly Reinke, the owner of the property requested an extension to allow time for her contactor to make the
necessary repairs. Ms. Reinke reported she obtained a building permit in December 2014, since that time
additional repairs were required on the property.
City Attorney Jim Hoeft explained that permits are valid for six months, and if Ms. Reinke would obtain a
new building permit; she would have six months to complete the project.
Mr. Hoeft suggested the council table the item until the February 8th meeting. If a building permit is issued,
there would be no need to consider the item. Councilmember Schmitt questioned if the permit would
remain valid if the property is sold within the six months. Mr. Hoeft clarified that the permit would remain
with the property.
Motion by Councilmember Williams, seconded by Councilmember Murzyn, Jr. to table the item; declaring
the property at 723 38th Ave NE a nuisance and approving the abatement of violations from the property
pursuant to City Code section 8.206. All Ayes, Motion Carried, Item Tabled.
Fire Chief Gary Gorman reported the property at 3924 Main St NE has a fence in disrepair.
Motion by Councilmember Nawrocki, seconded by Councilmember Murzyn, Jr. to close the public hearing
and to waive the reading of Resolution Number 2016 -11, there being ample copies available to the public.
All Ayes, Motion Carried.
Motion by Councilmember Williams, seconded by Councilmember Murzyn, Jr. to adopt Resolution Number
2016 -11, being resolution of the City Council of the City of Columbia Heights declaring the property listed a
nuisance and approving the abatement of violations from the property pursuant to City Code section 8.206.
All Ayes, Motion Carried.
B. Consideration of Revocation of the license to operate a rental unit within the City of Columbia Heights
is requested against the rental property at 4959 5th Street NE for failure to meet the requirements of the
Residential Maintenance Codes. *REMOVED FROM AGENDA, Property brought into compliance.
9. ITEMS FOR CONSIDERATION

10. ADMINISTRATIVE REPORTS
Councilmember Nawrocki reported the Charter Commission met in January, and is continuing to look for
language that may be out of date. The commission discussed increasing the candidate filing fees, and is
considering a change from $5.00 to $15.00. Councilmember Nawrocki reported that Columbia Heights has
one of the lowest filing fees in the area. City Attorney Hoeft explained the $15.00 amount was suggested as
a result of an inflationary rate comparison. Councilmember Nawrocki distributed a copy of the Charter
Commission "Year in Review' to the council members. Mr. Hoeft reported the commission will consider a
second reading of the item at their next meeting, and then the council will consider the item.
Report of the City Manager
City Manager Fehst reported the North Metro Home and Garden Show will take place on Saturday,
February 6th from 9:00 -3:00 at the National Sports Center in Blaine.
Councilmember Nawrocki asked for an update regarding doing business with Financial One Credit Union.
City Manager Fehst indicated he hasn't an update at this time.

Mr. Hoeft had nothing to report.
11. CITIZENS FORUM
Connie Buesgens -1021 44th Ave NE requested the council consider adding "Vertical Farming" as a permitted
use in the Zoning Code, and submitted a letter of request to the council. Ms. Buesgens suggested it would
be good to have something in place, in the event there is interest expressed. City Manager Fehst stated he
would look into it, noting it would likely fall under the light industrial use.
City Attorney Hoeft noted that the City Code addresses various uses, and it may not always be necessary to
add languages, noting staff would likely look at comparable uses.
Manager Fehst stated he will have the Community Development Director look into, and decide if necessary
to amend the City Code at this time.
Malcom Watson -1717 49th Ave NE commented that the recent article in the local newspaper did not give an
explanation or justification of the indicated 9.9% (average) increase in property taxes, other than the voter
approved library levy.
12. ADJOURNMENT
Mayor Peterson announced school board elections are Tuesday, January 26th, with a second election being
April 5, 2016 (Primary will be February 9, 2016).
Mayor Peterson announced the Sister Cities group will be hosting the 10th Annual Young Artists Showcase
at Murzyn Hall on Tuesday, January 26th at 7:00 pm. The Mayor also announced an upcoming SACA
fundraiser; the second annual Fire and Ice Polar Plunge will be taking place on Saturday January 30th at
Silver Lake Beach.
Mayor Peterson reminded us to remember our service men and women, and our police officers and fire
fighters, and to keep them in our thoughts and prayers.

Resolution of the City Council for the city of Columbia Heights declaring the property a nuisance and approving
abatement of ordinance violations pursuant to Chapter 8, Article II, of City Code, of the property owned by Christos
Aleandrou (Hereinafter "Owner of Record ").
Whereas, the owner of record is the legal owner of the real property located at 3924 Main St NE, Columbia Heights,
Minnesota.
And whereas, pursuant to Columbia Heights Code, Chapter 8, Article II, Section 8.206, written notice setting forth the
causes and reasons for the proposed council action contained herein was sent via regular mail to the owner of record on
January 8, 2016.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the city of Columbia Heights, the
City Council of the city of Columbia Heights makes the following:
FINDINGS OF FACT
1. That on December 4, 2015, an inspection was conducted on the property listed above. Inspectors found
violations. A compliance order was sent via regular mail to the owner at the address.
2. That on January 8, 2016, inspectors re- inspected the property listed above. Inspectors noted that violations
remained uncorrected. A compliance order and statement of cause was mailed via regular mail to the owner
listed in the property records.
3. That based upon said records of the Fire Department, the following condition

were found to exist, to wit:
A. Shall repair /replace fence along driveway.

hearings relevant to the abatement of violations on the property listed above.
3. That all applicable rights and periods of appeal as relating to the owner of record, occupant, or tenant, as the
case may be, have expired, or such rights have been exercised and completed.
ORDER OF COUNCIL
1. The property located at 3924 Main St NE constitutes a nuisance pursuant to City Code.

PUBLIC HEARING TO DESIGNATE LOOKOUT PLACE AS NO PARKING
Residents present:
Veronica Johnson, 351 Jolly Lane
Mohamed Botan, 401 Lookout Place (arrived late)
Kathy Young, Assistant City Engineer, advised that at the Traffic Commission meeting on December 7,
2015, Commissioners called for a Public Hearing to consider restricting parking on Lookout Place.
Ms. Veronica Johnson submitted a request for "No Parking" on the south side of Lookout Place, the
concern being the combination of intersections close together and the width of Lookout Place, especially
during the winter months.
Several area residents attended the Traffic Commission meeting on December 7. The Commissioners and
residents discussed the "No Parking" request. All residents in attendance agreed with no parking on the
south side of Lookout Place from Bakken Boulevard to 5th Street. Resident opinions were split concerning
no parking on the north side of Lookout Place. Visibility of traffic on 5th Street is an issue when vehicles
are parked on the north side of Lookout Place. The private streets in the area have no street parking on
either side.
At the December meeting, the Traffic Commission called for a public hearing to consider "No Parking" on
the south side of Lookout Place and "No Parking" for 30' from each corner on the north side of Lookout
Place between Bakken Boulevard and 5th Street.
Ms. Veronica Johnson faces Lookout Place. She was concerned about parking on the south side of
Lookout Place and other residents were concerned about parking on the north side. Mr. Mohamed
Botan stated he lives on the corner, so this is the only place to park in front of his house. Olson explained
that there is a visibility issue at the corners and we want to make it safe for both sides of the street. That

is why no parking will be allowed 30' from the corner on the north side.
Motion by Olson to designate "No Parking" on the south side of Lookout Place between Bakken
Boulevard and 5th Street and designate "No Parking" 30 feet from each corner on the north side of
Lookout Place between Bakken Boulevard and 5th Street. Motion seconded by Clerkin. Motion passed
unanimously.
Explained to residents that motions will be on the January 11th council meeting agenda.

REQUEST TO REMOVE NO PARKING DESIGNATION ON THE EAST SIDE OF JACKSON STREET
On behalf of Immaculate Conception Church, Mr. Steve Smith has requested the "No Parking" signs for
Saturday and Sunday be removed. The signs are on the east side of Jackson Street near the north end.
The church feels there is no longer a need for a no parking restriction.
In checking with the Fire and Police Chiefs, there are no concerns with removing the "No Parking" signs.
Staff considers a Public Hearing necessary to discuss removing the "No Parking" designation as residents
may object to on street parking. For example, the streets adjacent to First Lutheran Church are posted
"No Parking on Sundays" based on resident request.
Motion by Olson to call a Public Hearing for the next Traffic Commission meeting to remove "No Parking
Sunday" and "No Parking Saturday" signs on the east side of Jackson Street from 41St Avenue to
approximately 230 feet south of 41st Avenue. Seconded by Carlson. Motion passed unanimously.
OTHER NEW BUSINESS
Commissioner Clerkin requested no parking 20' from the southeast corner of 5th Street and 40th Avenue
so it is possible to see around trucks. There is a daycare center there now and no stores. He stated he
has almost been hit many times coming from that intersection and would like it addressed at the next
meeting. Young stated she will put it on the agenda.

B. POLICE
Captain Austin reported the speed survey for Huset Parkway showed speeds higher than he
anticipated, but nothing close to 50 mph. Speeds shown are averages with the top speed being

around 37 or 38 mph. He stated that the curve in the road will throw speed perception off. However,
in a residential area 37 or 38 is getting up there. Olson stated that with the park nearby he can see
the concern. The plan is to mark the pedestrian crossing more clearly once the weather clears up.
C. COMMISSIONERS
Doty questioned what a long time meant regarding removing the "No Parking" signs on Jackson
Street. He stated he has parked across from the person in question three times recently. States this
person does come out in good weather and when in good health. Doty saw him last year and two
years ago. He can still protest. Captain Austin stated he has not received a police call in years. The
commissioners agreed that they need to revisit this at the next meeting when someone from the
church is present.

PUBLIC HEARING TO REMOVE "NO PARKING" DESIGNATION ON THE EAST SIDE OF JACKSON STREET
Residents present:

At the January meeting the Traffic Commission called for a public hearing to consider removing the "No
Parking Saturday 4 PM to 6 PM" and "No Parking Sunday 6 AM to Noon" designations on the east side of
Jackson Street from 41St Avenue to approximately 230' south of 41s' Avenue. There are five different
parking "zones" along Jackson Street. The Public Hearing notice was published in the Sun Focus and
property owners within 300' of the proposed change in parking designations were notified of the hearing
by mail.
On behalf of Immaculate Conception Church, Mr. Steve Smith requested the "No Parking" signs for
Saturday and Sunday be removed. The church feels there is no longer a need for a no parking restriction,
and, as parishioners are aging, the church would like to offer parking closer to the door. The "No
Parking" signs were originally put up because of a protester who would park his car mounted with very
offensive signs. The "No Parking" signs did not hinder the protester from displaying his signs; he simply
parked around the corner. Since this protester has not been seen for over one year, the church is
requesting removal of the no parking signs to recover the parking spaces.
Motion by Olson to remove the "No Parking Saturday 4 PM to 6 PM" and "No Parking Sunday 6 AM to
Noon" designations on the east side of Jackson Street from 41St Avenue to approximately 230' south of
41St Avenue. Motion seconded by Carlson. Motion passed unanimously.

OLD BUSINESS
REQUEST TO DESIGNATE THE SOUTH SIDE OF 40TH AVENUE FROM 5TH STREET TO 20' EAST OF 5TH STREET
AS "NO PARKING ".
Commissioner Clerkin has requested no parking 20' from the southeast corner of 5tH Street and 40th
Avenue so it is possible to see around trucks. He stated he has almost been hit many times coming from
that intersection.
The police report shows only one accident in five years, which had nothing to do with visibility. Clerkin
still feels visibility is a safety issue. He has talked to other residents who agree and they would like some
type of buffer. Vans are parked all the way to the edge of the corner requiring cars to pull out further
into the intersection. There is currently only a daycare center on the corner and no stores. Young
stated this will require a public hearing to give business owners an opportunity to speak.
Motion by Clerkin to call a Public Hearing for the next Traffic Commission meeting to request no parking
20' from the southeast corner of 5th Street and 40th Avenue. Seconded by Doty. Motion passed
unanimously.

A. CITY ENGINEER
Commissioner Tyler moved to Shoreview and has resigned from the Traffic Commission. Carlson
requested we send him a thank you letter. Young stated she will draft one up for everyone to sign at
the next meeting. Schmitt suggested that we remind the council secretary of Commissioner Tyler's
resignation. She also advised that we did receive an application requesting appointment to a
Commission. They put down Planning & Zoning, Traffic, and Charter so there is a possibility he could
get appointed. Application was from an Adam Schell at 4128 Arthur Street. Apparently he has only
lived in Columbia Heights for a short period of time.
A disabled parking sign has been requested by the resident at 4220 Van Buren Street. The sign will be
installed when weather permits.

Doty inquired about putting up a seasonal "Turtle Crossing" sign from May to July on either 49th
Avenue and /or Innsbrook Parkway to warn drivers about turtles crossing the street. The turtles leave
Highland Lake to lay eggs from May to July and many of them get run over. He would like to see
some type of signage. Other cities put up seasonal signs for this type of thing. Young stated she will
discuss it with the Public Works Director but seasonal signs are somewhat difficult.

The meeting was called to order by Chair Patricia Sowada at 6:30 p.m. Members present were:
Nancy Hoium, Steve Smith, Patricia Sowada, Barbara Tantanella and Catherine Vesley. Also
present: Library Director Renee Dougherty, Recording Secretary Renee Rewitzer. Absent:
Council Liaison Gary Peterson.
The minutes of the December 2, 2015, Board meeting were approved as corrected to include
Barbara Tantanella's name in members present.
The bill list dated 12/2/2015 was reviewed. It was moved, seconded, and passed that the bills
be paid.

Old Business:
1. The Foundation made approximately $150.00 profit from the movie fundraiser last
month. The Board surmises that the movie is easily accessible through TV and DVD
hence the low turnout. The Foundation plans to do something different for next
year. The Foundation received a gift of Medtronic Stock from an anonymous
donor; the stock was sold and the Foundation kept the proceeds. The Foundation
will meet on January 13 and will update Dougherty on their plans for 2016.
2. The new library construction progress is approximately five days behind schedule.
The last bit of concrete will be poured on Friday, January 8 which is also when the
steel beams arrive. Those will be erected starting January 18. Once the beams are
in then the roof will be put on and then the walls will go up. Dougherty attended
the open bids for shelving; there were only two bids one of which did follow bid
instructions. Vesley asked if the bid was reasonable and Dougherty replied it was -.
The bid will go to Council on January 11.
3. The 2016 Budget has been set. All City departments were to cut 1% from their
respective budgets. The microfilm reader was cut from the Library budget to meet

the goal. It is hoped that the Foundation will foot the bill for a new microfilm
reader for the new library.
4. Two new Pages will begin training on January 11, Aeris Allen and Karen Juneau -
Yaeger.
New Business:
1. Anoka County signed a contract with Bibliotheca for the RFID system. Columbia
Heights Public Library will be eligible for the same prices for RFID tags, self -check
kiosks, security gates, and staff stations that Anoka County Library received. The
library will tag the collection before moving so that the self- checkout capability will
be available at the new library. Vesley asked if this RFID system was stable
technology and Dougherty replied it is. Vesley asked if volunteers were needed to
help tag the collection and Dougherty replied in the affirmative. Teams will consist
of one staff member and one volunteer to tag the collection.
Z. BookWarms began December 28 and Winter Reads began on January 2. Both adult
and children are encouraged to read, and submit reviews to be eligible for fabulous
prizes Youth Read Down is happening in January. Youth can earn $1.00 off their fine
for every fifteen minutes spent reading in the library. This is an inexpensive way to
remove barriers to library use for youth and to promote the value of reading.
Items from the Floor:
1. Proposed Library Board meeting dates for 2016 were presented to the board.
Vesley moved to accept the dates as written and Tantanella seconded the motion.
Motion passed unanimously.
Dougherty asked the Board to take action on proposed dates the library will be
closed to the public for moving to the new library. Motion: Close the library for the
weeks of May 23, May 30 and June 6. Hoium moved and Tantanella seconded the
motion. Motion passed unanimously.
3. Vesley shared that the nonfiction book club will meet at 10:00 on the third Friday of
the month.
4. Dougherty shared that AuthorPat Stinson will be at the library on January 12 at 6:30
p.m.
5. There being no further business, the meeting was adjourned at 7:15 p.m.

BACKGROUND:
A Public Improvement Hearing for the Street Rehabilitation project on 45th Avenue from Main Street to the
dead end at University Avenue was held on February 1, 2016. The City Council ordered the improvement
project. This section of 45th Avenue is the municipal boundary between Columbia Heights and Fridley. The
City of Fridley is administering the project. The scope of work involves reclaiming the existing bituminous and
aggregate base materials and paving a new bituminous surface.
ANALYSIS:
The proposed work remains essentially unchanged from the work presented at the Public Improvement
Hearing. Minor storm sewer structure work and storm /sanitary sewer castings will be replaced as needed.
The proposed funding for this work is as follows:
Storm Sewer Construction Fund $15,500
Sanitary Sewer Construction Fund $12,500
Water Construction Fund $10,000
Final plans and specifications for the City of Fridley 2016 Street Resurfacing project are substantially complete.
The bid opening is scheduled for late February or early March with City Council award on March 14, 2016.

BACKGROUND:
A Public Improvement Hearing for the Street Seal Coat project in Zone 7B was held on February 1, 2016. The
City Council ordered the improvement. Under a joint powers agreement between several north metro cities
(Coon Rapids, Andover, Brooklyn Center, Columbia Heights, Anoka, Circle Pines, East Bethel, Ham Lake, and
Mahtomedi) the City of Coon Rapids administers the project. The seal coat will be done on streets west of
University Avenue between 37th Avenue and 45th Avenue. The scope of work involves application of emulsion
by computer controlled mechanical sprayers immediately followed by spreading FA -2 granite or trap rock as a
cover aggregate. The road surface is finished by rolling with a tire -based roller for proper aggregate
penetration and distribution.
ANALYSIS:
The proposed construction remains essentially unchanged from the work presented in the feasibility report.
Final plans and specifications for the Street Maintenance Materials are substantially complete. The bid
opening is scheduled for March 11, 2016 with City Council award on March 28, 2016.

BACKGROUND:
At the January meeting the Traffic Commission called for a public hearing to consider removing the "No
Parking Saturday 4 PM to 6 PM" and "No Parking Sunday 6 AM to Noon" designations on the east side of
Jackson Street from 41st Avenue to approximately 230' south of 41St Avenue.
On behalf of Immaculate Conception Church, Mr. Steve Smith requested the "No Parking" signs for Saturday
and Sunday be removed. The church feels there is no longer a need for a no parking restriction and as
parishioners are aging, they would like to offer closer access to the main door of the church.
The Fire and Police Chiefs do not have a preference concerning the "No Parking" signs.
ANALYSIS /CONCLUSIONS:
The Traffic Commission held a public hearing to consider removing the "No Parking Saturday 4 PM to 6 PM"
and "No Parking Sunday 6 AM to Noon" designations on the east side of Jackson Street from 41st Avenue to
approximately 230' south of 41st Avenue at their meeting on February 1, 2016. The Public Hearing notice was
published in the Sun Focus. Property owners within 300' of the proposed change in parking designations were
notified of the hearing by mail. No one spoke in opposition of the proposed change in "No Parking"
designation.
RECOMMENDED MOTION(S): Move to remove the "No Parking Saturday 4 PM to 6 PM" and "No Parking

BACKGROUND:
In 2015 the Anoka County Library (ACL) sought proposals to implement Radio Frequency Identification (RFID) of
collection materials and to install automated materials handling machines (AMH) which utilize RFID at the two largest
branches in the library system, Northtown and Rum River. The county published a Request for Proposal (RFP) for a
turnkey system for RFID and AMH and received two proposals in August 2015. The RFP included a joint powers
purchasing agreement so that Columbia Heights Public Library (CHPL) might purchase items under the contract executed
by Anoka County with the chosen vendor. Two vendors submitted proposals and provided onsite demonstrations of
equipment and software in September 2015. The vendors, 3M Library Systems and TechLogic, are Minnesota companies
who have previously provided library technology to ACL. The recommendation of the Anoka County RFID /AMH selection
committee (comprised of county library, purchasing and technology staff) was to split the project and award the RFID
tags, self -check stations, and security gates to 3M Library Solutions and the automated materials handling equipment to
TechLogic.
RFID technology uses tags which are placed on books and media discs to provide identification and security for those
items. It replaces the electromagnetic security systems currently in use in the libraries. RFID tags identify individual
collection items for management of checkouts and returns, enable streamlined collection inventory and provide security
for the items within a single device. RFID self- service checkout stations integrate with the library system software to
record checkouts on the user's library account and deactivate the security on multiple items simultaneously. Security
gates will alarm if a person exits the library without properly checking out an item.
ACL seeks to enhance library productivity by utilizing RFID /AMH technology for labor- intensive tasks such as material
sorting and delivery. They anticipate that using machines rather than people to lift and sort materials will reduce
repetitive stress injuries and back strains thereby reducing worker's compensation costs. ACL also wants to enhance
customer service by streamlining self- checkout and reduce material losses with modern security gates. CHPL will
experience similar benefits including labor cost savings for checking out the 100,000 library items which are borrowed
each year.
During the period that ACL was negotiating a contract for RFID 3M sold their Library Systems division to Bibliotheca, Inc.
which is now the largest global company providing RFID library solutions. All 3M Library Systems employees have been
retained by Bibliotheca and will continue to provide installation and ongoing support for the equipment.
CHPL will need to add RFID tags to all collection materials in order to continue to partner with ACL to provide library
service to the community. The construction of the new building also provides an opportunity to add self- service
checkouts for customers and updated security gates at the building entrance to prevent theft of materials. It is staffs
intent to tag all CHPL collection items prior to moving to the new building.
PROJECT BUDGET
The base cost to purchase and install security gates, staff workstations, customer self -check stations, RFID tags for books
and media, one -month rental of a conversion station, and a three -year contract for support maintenance of equipment
is $63,509.

and a 3 -year maintenance contract on the hardware for a base cost of 63,509. The Library Board has reviewed the
detailed plan for RFID implementation and endorsed it at their February 3, 2016 meeting. The Columbia Heights Library
Foundation has had a preliminary discussion of the details of RFID implementation and has verbally agreed to fund the
project. The Foundation will receive final cost estimates and take formal action at their February 10, 2016, meeting. Staff
is seeking Council action at this time to insure that contracts can be executed and equipment received in time to allow
tagging of the collection (approximately 75,000 items) during the month of March. The security gates and self -check
stations will be installed in the new building in May and all parts of the system will be operational when the new building
opens in June 2016.
RECOMMENDED MOTION(S):
Move to award a contract for purchase and installation of security gates, staff workstations, self -check stations, RFID
tags for books and media discs, one month rental of a conversion station, and a 3 -year maintenance contract on the
system to Bibliotheca (formerly 3M Library Systems) for a base cost of $63,509 contingent upon receiving a grant from
the Columbia Heights Foundation Library Foundation for the entire cost of the project ; and furthermore to authorize

BACKGROUND:
The City Attorney and Police Department have had access to the State Court System records for many years.
The Court System has decided to replace their existing software with a new operating system.
The City Attorney requests that the City Council authorize the City Manager to sign a Master Subscriber
Agreement between the City of Columbia Heights and the Minnesota Court Data Services Division for
purposes of the City Attorney being able to access court records.
The new system requires new subscriber agreements for all cities who wish to have their prosecutors continue
to have access to their court records. In addition, each person accessing the system must sign a user
acknowledgement form certifying that the individual has read and understands the requirements and
restrictions regarding access to the data on the system, which can be used only in accordance with a
legitimate governmental business need.
There is no cost for this integration. This resolution is merely for the approval to sign the agreement to allow
access per the request from the State.
RECOMMENDED MOTION(S):
The City Attorney recommends the Council approve the resolution and authorize the City Manager to sign the
Master Subscriber Agreement between the City of Columbia Heights and the Minnesota Court Data Services
Division for the purposes of the City Attorney being able to access court records.

WHEREAS, Anoka County, Minnesota Criminal /Traffic Court is converting to paperless court files and it
is necessary for municipal prosecutors to access electronic filings through the "Fast Access" for the purpose of
accessing court records and court documents at the court facility and detention area, as designated by County
Court Administrator, in cases scheduled on the first appearance, bail hearing, and arraignment calendars
where prosecutors and defense attorneys typically do not have a case file and need access to the documents
filed with the court; and
WHEREAS, access to the necessary court records and filings is through and authorized by the State of
Minnesota Office of State Court Administration; and
WHEREAS, in order to obtain access to the court records it is necessary to execute a Master Subscriber
Agreement for Minnesota Court Data Services for governmental agencies.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF COLUMBIA HEIGHTS,
MINNESOTA:
1. That the City Council hereby approves the aforesaid Master Subscriber Agreement for the City Attorney's
Office and hereby authorizes execution of the same by the City Manager.
2. That the City Council hereby determines that the Paralegal in the City Attorney's Office shall serve as the
Agency Account Manager on behalf of the City of Columbia Heights.
