A. Sister Cities' sharing of recent National Award for "Best Overall Program"
Dolores Strand and Gloria Bergstrom representing Sister Cities shared their recent award
with the council and the audience. It was explained that Columbia Heights received this
National Award for "Best Overall Program" for cities with a population less than 25,000.
B. Recognition of Library Volunteers
Library Director Renee Dougherty reported that in 2014 library volunteers provided 905
hours of service. Paul Kram introduced his reading partner Tina. Paul and Tina work
together in the "Buddy up and Read" program. Barb Kondrick introduced many of the adult
volunteers, and thanked them for their many services.
Gissel and Dasy Inamagua both serve as teen volunteers, and spoke about their positive
experience in serving at the library. Children's Librarian Bethany Grabow introduced many
teen volunteers and thanked them for their committed service.

MOTION: Move that in accordance with Minnesota Statute 412.271, subd. 8, the City
Council has received the list of claims paid covering check number 157665 through 157853
in the amount of $ 1,501,582.00.
Councilmember Nawrocki requested that items D and E be removed from the Consent Agenda
for discussion.
Motion by Councilmember Williams, seconded by Councilmember Nawrocki to approve Consent
Agenda items A, B, C, F and G. All Ayes, Motion Carried.
Councilmember Nawrocki requested that the following items be removed from the Consent
Agenda for discussion:
D. Resolution approving; a subordination of mortgage in connection with the City's Single
Family Deferred Loan Program.
Councilmember Nawrocki requested both an explanation of the item, and the address of the
property. Associate Planner Holmbeck explained that for privacy reasons the address was
not disclosed. Director Hogeboom explained that the homeowner is refinancing their
mortgage, and the new lender is requesting a new subordination agreement. The agreements
were prepared by the city's EDA Attorney, and adhere to the city's policy.
Motion by Councilmember Nawrocki, seconded by Councilmember Murzyn, Jr. to waive the
reading of Resolution 2015 -58, there being ample copies available to the public. All Ayes,
Motion Carried
Motion by Councilmember Nawrocki, seconded by Councilmember Williams to approve the
subordination of Mortgage in connection with the City's Single Family Deferred Loan
Program. All Ayes, Motion Carried
E. Title: Resolution approving the lot combination for the property located at 3927 Central
Ave. NE. and 3939 Central Ave. NE.
Councilmember Nawrocki expressed concern with combining the lots, indicating he thought
the back lot would be available to lease.
Director Hogeboom explained the new library is proposed to constructed in the middle of
two legal lots, and state code does to allow for a building to cross property lines. Hogeboom
stated that the city could re -plat the lots in the future. City Attorney Jim Hoeft suggested it
be better to wait to re -plat until the city has determined what they would like to see in the
area.
Motion by Councilmember Williams, seconded by Councilmember Schmitt to authorize the
lot combination for the properties located at 3927 Central Ave. NE. and 3939 Central Ave.

NE. and to direct staff to submit the Lot Sketch and Description, dated April 27, 2015, to
Anoka County Property Records and Taxation division. All Ayes, Motion Carried.
8. PUBLIC HEARINGS
1. Public Hearing to adopt Resolution 2015 -49 being a Resolution levying and adopting
the assessment for alley light area no. 677 -45
Thomas Rustemis, residing at 1427 Circle Terrace questioned the need for the alley light.
Director of Public Works, Kevin Hansen reported that a valid petition was received on
July 13, 2015. The petition requested the installation of an alley light. The assessment
policy was briefly explained as well. Director Hansen reported the property owner at
4140 Reservoir Blvd. had called city offices and requested their name be removed from
the petition.
Mr. Rustemis suggested an alternate location for the light be considered. Director Hansen
noted that if council would like to consider a different location, the item should be tabled,
in order to allow city staff to provide notice to the adjoining property owners.
Motion by Councilmember Williams, seconded by Councilmember Schmitt to close the
public hearing and waive the reading of Resolution 2015 -049, there being ample copies
available to the public. All Ayes, Motion Carried.
Motion by Councilmember Williams, seconded by Councilmember Schmitt to table the
item until August 24, 2015. All Ayes, Motion Carried.
2. Consideration of Resolution approving a Conditional Use Permit for the property
located at 3912 Central Avenue NE.
Associate Planner Elizabeth Holmbeck reported that the Planning and Zoning
Commission reviewed the request both in June and in August. The commission voiced
concerns over the potential negative impacts the business could have on neighboring
properties. Additionally the commission opposed allowing an additional auto related
business along the Central Ave corridor.
Staff discussed the request with the City Attorney, it was determined the application is
consistent with the City Code. The Planning and Zoning commission declined to make a
recommendation to the Council, citing that the application does not meet the findings of
fact. However, they added additional conditions to the permit for council consideration.
The recommendation of staff is to approve the request, subject to 14 conditions.
Councilmember Nawrocki commented that the property is currently in disrepair, and
agreed with the Planning and Zoning commission, that the area is adequately served with
auto related businesses. Councilmember Murzyn Jr. (liaison to the Planning & Zoning
Commission) stated that he agrees with the Planning & Zoning commission, that an auto
related business is not desirable in that location. City Attorney Jim Hoeft clarified that

the request is a permitted use in the area, subject to a conditional use permit, and the
council can decide what reasonable conditions will be placed on the request.
Director of Community Development Joe Hogeboom explained that while the property is
a house, it has been zoned commercial, and became a business about five years ago, losing
its non - conforming use designation. The applicant purchased the property with the
intention to use as a business. Councilmember Nawrocki asked if anyone will be living in
the building. Director Hogeboom explained that the house would be required to have the
second floor converted to a legal dwelling unit. Councilmember Nawrocki commented
that parking seems inadequate for the use. Director Hogeboom explained the property
would be reconfigured.
Marlaine Szurik, chairperson of the Planning & Zoning Commission expressed concern
with the proposed use, noting there is not adequate space for screening or snow removal.
Ms. Szurik also expressed concern with the business facing the alley.
Jay Shahidi, the contractor working with the applicant reported the applicant intends to
repair the house and expand the garage.
Catherine Vesley, 5135 Matterhorn Drive commented that this property is across the street
from the new library site, and expressed concern with having another auto related
business, and would like to see Columbia Heights move in a more progressive way.
City Attorney Hoeft addressed some of the concerns, noting that they are addressed in the
conditions of the Conditional Use Permit. Mr. Hoeft stated it is his legal opinion that the
City Council approve the application with the fourteen recommended conditions.
Motion by Councilmember Schmitt, seconded by Councilmember Williams to close the
Public Hearing and waive the reading of Resolution 201 5 -35, there being ample copies
available to the public. All Ayes, Motion Carried.
Motion by Councilmember Williams, seconded by Councilmember Schmitt to approve the
Conditional Use Permit for the property located at 3912 Central Avenue NE. 4 Ayes, I
Nay, Motion Carried. Ayes: Mayor Peterson, Councilmembers Williams, Schmitt and
Murzyn, Jr. Nay: Councilmember Nawrocki.
3. Resolution approving a Conditional Use Permit for the property located at 1400 49th
Ave. NE.
Associate Planner Elizabeth Holmbeck reported that the Planning and Zoning
Commission reviewed the request and recommended council approval with one change
that would prohibit the sign to be lit between the hours of 10:00 PM and 6:00 AM.
Mayor Peterson suggested the sign be permitted to be lit until 11:00 PM, as it provides
valuable community information. City Manager Fehst asked if the sign could be dimmed
during the overnight hours.
Ms. Holmbeck clarified that the City Code requires the sign be dimmed overnight,
however the Planning & Zoning commission added the condition to have the sign off
overnight.

Bill Holmgren, representing Columbia Heights School District commented that the
proposed two new signs are considerably less bright than the three current signs. Mr.
Holmgren requested the restriction be lifted.
Colin Livingood, 1600 49th Ave. stated that the current lit signs are problematic, and
would ask the council leave the resolution as is.
Mayor Peterson suggested the sign at the High School remain on overnight, as it serves as
a message center. Councilmember Schmitt suggested both signs be turned off at 11:00
PM to be consistent with the other lighting on the school grounds.
Councilmember Schmitt made a motion to amend the resolution to change the time from
10:00 PM to 11:00 PM on both signs, Councilmember Murzyn seconded the motion.
2 Ayes, 3 Nays, Motion Failed. Ayes: Councilmembers Schmitt and Murzyn. Nays: Mayor
Peterson, Councilmembers Williams and Nawrocki.
Motion by Councilmember Schmitt, seconded by Councilmember Williams to close the
Public Hearing and waive the reading of Resolution 2015 -55, there being ample copies
available to the public. All Ayes, Motion Carried.
Motion by Councilmember Schmitt, seconded by Councilmember Murzyn, Jr. to approve
the Conditional Use Permit, for the property located at 1400 49th Ave. NE. as originally
recommended by staff.
Mayor Peterson amended the recommended motion to have the sign at the east end be off
from 10:00 PM to 6: 00 AM, and the sign at the High School remain on and dimmed
overnight, pursuant to the City's ordinance. Councilmember Murzyn, Jr. seconded the
amended motion.
4 Ayes, I Nay, Motion Carried. Ayes: Mayor Peterson, Councilmembers Williams,
Murzyn, Jr. and Nawrocki. Nay: Councilmember Schmitt.
Motion by Councilmember Williams, seconded by Councilmember Murzyn, Jr. to approve
the Conditional Use Permit for the property located at 1400 49th Ave. NE. as amended.
All Ayes, Motion Carried.
4. Resolution approving a Variance for the property located at 4040 Central Ave. NE.
Associate Planner Elizabeth Holmbeck reported the applicant is requesting a variance for
the existing wall sign, allowing a waiver to section 9.106 permitting a wall sign in excess
of 100 square feet, and allowing a sign to be painted directly on the exterior surface of the
building.
The Planning and Zoning Commission recommend the city council deny the request,
citing the application does not meet the required findings of facts.
Councilmember Nawrocki commented that the exterior painting was done without City
approval and noted that there are also many lit signs in the window. Councilmember
Schmitt suggested that while the city has a sign ordinance policy, we should consider a
mural policy. Mayor Peterson commented that the sign is eye - catching. Councilmember

Williams commented that the city is fortunate to have Mr. Wetch and his business in the
community. Councilmember Murzyn Jr. noted the Planning Commission was concerned
that the text was large, and not in compliance with the sign ordinance.
Community Development Director Joe Hogeboom read the definition of a sign from the
city code, noting that the sign in question would need a variance if it is to remain.. Director
Hogeboom reported that the sign code is scheduled to be reviewed in the near future, and
staff will likely look into considering murals. City Attorney Jim Hoeft suggested the
council could table the item (can be indefinite) and direct staff to review the City's current
sign ordinance, and address the item in the future.
Mayor Peterson commented that if staff is already considering revisions to the sign code
he would support tabling the item.
Motion by Mayor Peterson, seconded by Councilmember Williams to table the item. All
Ayes, Motion Carried.
5. Resolution approving a Variance for the property located at 4101 Central Ave. NE.
Associate Planner Elizabeth Holmbeck reported the applicant is requesting a variance for
the existing wall sign, allowing a waiver to section 9.106 permitting a wall sign in excess
of 100 square feet. Councilmember Schmitt asked why a monument sign was not
considered. Ms. Holmbeck stated it was likely due to space limitations. Councilmember
Nawrocki was concerned that there may confusion with Miller Heights Chapel on Central
Ave. Ms. Holmbeck clarified that Washburn McReavy has purchased the Miller Heights
chapel and that location will be closed.
Motion by Councilmember Williams, seconded by Councilmember Schmitt to close the
Public Hearing and waive the reading of Resolution 2015 -57, there being ample copies
available to the public. All Ayes, Motion Carried.
Motion by Councilmember Williams, seconded by Councilmember Nawrocki to approve
the Variance for the property located at 4101 Central Ave. NE. All Ayes, Motion Carried.
9. ITEMS FOR CONSIDERATION

1. Library Bid Package No. 2, City ject No. 1410
Director of Public Works Kevin Hansen gave an overview of the four bidding packages.
The General Construction bid was awarded to Ebert Construction, including six
alternates. The Fire Protection bid is awarded to Breth- Zensen. The Mechanical bid was
awarded to Cool Air Mechanical, with three alternates. The Electrical bid was awarded to
People's Electric with two alternates. Director Hansen reported overall the bids are
$346,000 under the architect's original estimate, a project contingency of $746,000.

Motion by Councilmember Williams, seconded by Councilmember Murzyn, Jr. to accept
bids and award General Building Construction including alternates 3, 4, 5, 6, 13, and 14
for the New Library, City Project No. 1410, to Ebert Construction, based upon their low,
qualified, responsible bid in the amount of $5,112, 600 from Fund 450 -51410 -5120; and,
furthermore, to authorize the Mayor and City Manager to enter into a contract for the
same. All Ayes, Motion Carried.

10. ADMINISTRATIVE REPORTS
City Manager Walt Fehst suggested a library ground- breaking be scheduled for Monday,
September 14, 2015 at 5:30 PM.
Councilmember Nawrocki requested the Library Board meeting materials be made available
to the public in advance of the meeting. Manager Fehst stated that he has spoken to the
Library Director; however, all materials are not required to be available in advance of a
meeting.
Councilmember Nawrocki asked when budget material will be distributed. Manager Fehst
responded it will be available in September, as required by the City Charter. Nawrocki stated
he would like the information available in advance for the public. Manager Fehst noted the
City's five year budget plan is available on the website.

ourselves too seriously and to try to do a random act of kindness.

pylon sign to promote motor fuel prices only. Such motor fuel price signs do not require a
conditional use permit. All dynamic LED signs may occupy no more than 60% of the actual copy
and graphic area. The remainder of the sign must not have the capability to have dynamic LED
signs, even if not used. Only one, contiguous dynamic display area is allowed on a sign face.
2. A dynamic LED sign may not change or move more often than once every ten seconds for
commercial, industrial uses, or public uses, and no more than once every ten minutes for religious
and/or educational institution uses, except one for which changes are necessary to correct hour -and-
minute, date, or temperature information.
3. A display of time, date or temperature information may change as frequently as once every five
seconds, however information displayed not relating to the date, time or temperature must not
change or move more often than once every ten seconds for commercial, industrial uses, or public
uses, and no more than once every ten minutes for religious and/or educational institution uses.
4. The images and messages displayed must be static, and the transition from one state display to
another must be instantaneous without any special effects. Motion, animation and video images are
prohibited on dynamic LED sign displays.

The images and messages displayed must be complete in themselves, without continuation in
content to the next image or message or to any other sign.
6. Dynamic LED signs must be designed and equipped to freeze the device in one position if a
malfunction shall occur. The displays must also be equipped with a means to immediately
discontinue the display if it malfunctions, and the sign owner must immediately stop the dynamic
display when notified by the city that it is not complying with the standards of this section.
7. Dynamic LED signs may not exceed a maximum illumination of 5,000 nits (candelas per square
meter) during daylight hours and a maximum illumination of 500 nits (candelas per square meter)
between dusk to dawn as measured from the signs face at maximum brightness. Dynamic LED
signs must have an automatic dimmer control to produce a distinct illumination change from a
llumination level to a lower level for the time period between one -half hour before sunset and one -
half hour after sunrise. The easterly sign (at Highland Elementary) shall not be lit between the
hours of 10:00 p.m. and 6:00 a.m.
8. Dynamic LED signs existing on the effective date of Ordinance 1593, passed April 25, 2011, must
comply with the operational standards listed above. An existing dynamic LED sign that does not
meet the structural requirements may continue as a non - conforming sign subject to § 9.105(E).

RESOLUTION APPROVING A SUBORDINATION OF MORTGAGE IN CONNECTION
WITH THE CITY'S SINGLE FAMILY DEFERRED LOAN PROGRAM
BE IT RESOLVED By the City Council ( "Council ") of the City of Columbia Heights ( "City ") as
follows:
Section 1. Recitals.
1.01. The City has heretofore established a deferred loan program for the rehabilitation of
single - family homes (the "Program "), administered by the Economic Development Authority of the City
(the "Authority "), and has approved certain deferred loans to individual applicants in connection with
the Program.
1.02. Each loan under the Program is secured by a mortgage (the "City Mortgage "), which is
subordinated to the mortgage of the applicant's primary lender (the "Primary Mortgage ") pursuant to the
Authority's Subordination Policy (the "Policy ").
1.03. Gregory L. Miller ( "Applicant "), who received a loan secured by a City Mortgage under
the Program, now wishes to refinance his Primary Mortgage, and has requested that the City subordinate
its City Mortgage to the new Primary Mortgage.
1.04. City staff and legal counsel have reviewed Applicant's request and documentation, have
determined that subordination of the City Mortgage to the new Primary Mortgage complies with the

Policy in all respects, and have prepared a Subordination of Mortgage (the "Subordination "), attached as
Exhibit A, for review and approval by the Council.
1.05. The Council has reviewed the Subordination and finds that the approval and execution of
the Subordination are in the best interest of the City and its residents.

Discussion regarding Residential Point of Sale Inspections:
Director of Community Development Joe Hogeboom introduced Frost Simula, a resident at 1700 49th
Ave NE. Mr. Simula reported that he purchased his home in 2013, and was unaware the home was
"flipped." Mr. Simula presented a power point, detailing many of the substandard home repairs and
renovations. Repairs are estimated at about $100,000.
Mr. Simula explained that predatory remodeling is a type of fraud, and would like the City to put
practices in place to protect future home buyers.
City Manager Fehst thanked Mr. Simula for his presentation, and asked the council of they would like
to revisit a point of sale program; noting it could serve to protect home buyers as well as maintain and
improve the city's housing stock.
Community Development Director Hogeboom reported that there are two ways some metropolitan
areas are addressing the issue. Some cities have a City Official complete the inspection, other cities
contract with an Independent Home Inspector. Hogeboom estimated the cost to be between 104,000
and 156,000 annually, noting the cost could be incorporated into the price of the permit.
Director Hogeboom suggested it would beneficial to offer permit applications on -line, as well as
property records.
City Manager Fehst explained some of the pros and cons in implementing a point of sale program and
suggested contacting those individuals who had expressed opposition in the past.
Councilmember Schmitt suggested offering an incentive program for first time home buyers, to include
a home buying seminar /class. Mayor Peterson stated that he likes the idea of a voluntary disclosure
statement from the seller. Director Hogeboom noted this would need to be completed by a city
sanctioned inspector in order to avoid inconsistencies. Mayor Peterson suggested residents check on
permit activity if they see renovations taking place. Director Hogeboom stated he will continue to
research, and bring more information to the council in September.

FBI Academy application for 2018 or 2019
City Manager Fehst explained the FBI Academy provides an excellent opportunity for professional
development and growth, as well as benefiting the community. Fehst stated he is in full support of the
program. Chief Scott Nadeau thanked Manager Fehst for his endorsement, and shared how the
course has benefited his career. Nadeau reported that "good things are happening" in the Columbia
Heights Police Department. Nadeau described Captain Austin as a dependable leader, and this
program would be a great next step for him.
Captain Austin stated he understands the value of continued education, as he has recently completed
his Master Degree and this academy would be a valuable next step.
Councilmember Nawrocki commented that Captain Austin has been a real valuable asset to the
community, and would not like to see him leave. Captain Austin commented that he is vested in
Columbia Heights and has no intention of leaving the department.
Motion by Councilmember Murzyn Jr., seconded by Councilmember Nawrocki to authorize Captain
Lenny Austin to attend the FBI Academy in 2018. All Ayes, Motion Carried.
Library CP -2 Bid Results / Review
Director of Public Works Kevin Hansen reported that the bids were split into the following four
sections; General Construction, Fire Protection, Electrical and Mechanical. For the General
Construction bid, the lowest bid came from Ebert, with a base bid of $500,048.
Director Hansen provided an overview of the alternates, including; Generator and transfer switch,
sidewalk snow melt system, free standing fire place, wall mounted display case, unique bench in the
children's area, alternate brick, exterior stone benches, low profile floor (pdm), fire sprinkler piping,
HVAC controls, property insurance and storm water treatment device. Bids were described as very
good.
The Fire Protection bid came in at $47,330, there were two bids received. Five bids were received for
the mechanical bid; the low bid was $758,000. Two bids were received for the electrical portion; the
low bid was $750,000.
Director Hansen distributed an overall project budget sheet, identifying funding and revenue. Current
revenue was reported as $10,154.850. Costs incurred since 2014 were reported as $10,261,241.
Current contingencies are $745,000, for unforeseen issues during construction, if not used it will
remain in the project at the end. Hansen reported the Library Foundation has indicated they may
interested in providing funds for a new book collection, as well as a donor wall. Hansen indicated that
city staff is continuing to look for additional grants.

Old Business
1. In the Heart of the Beast Mask - Making Activity
Betsy updated Donna about the Jamboree mask - making activity. The Public Arts
Commission were volunteer helpers. She said the 26 kids had fun, but there was some
disappointment among Liz Bray and the Commissioners regarding the quality level of the art
supplies and lack of preparation. Betsy said the Commissioners met u7th Liz afterwards to
discuss the activity. The general consensus was that the program design was too simplistic
for our needs.
• Gretchen also added that ITHOTB did not provide an activity syllabus.
• Carrie brought a few photos from the mask - making activity. She said about 8 -10 children
participated in the Jamboree parade with their masks.
• The Commission discussed putting on their own art program during a future Jamboree.
Sarah said one of our Directory artists might be able to provide instruction during a
workshop.
• Brainstorming for art activity ideas will be on October 2015's meeting agenda.
2. Grant Updates — Heights Theater Mural
Rita updated the Commission about the costs for a professional muralist. It is likely that a
muralist would cost more than $5,000.00.

• Gretchen spoke to Tom Letness about the mural idea and presented options for either a
painted or electronic mural. Tom liked the idea of an electronic mural. He thought it would
be a neat idea and would look nice by the new library. The electronic mural wouldn't look
good on a tan building, so the wall would need to be painted white. Tom also suggested an
idea of a picture frame mural. There hasn't been a decision made yet, but Torn would like to
work with the people organizing the project.
• The Commission agreed that an electronic mural would be a good way to tie into current
events and showcase local arists. However, a painted mural would most likely be easier and
less expensive in the long run.
• Jen mentioned that projectors for the electronic mural might not be cheap. Rita, Sarah, and
Betsy pointed out that maintenance, light bulbs, logistics, and security would need to be
considered for an electronic mural if we go this route.
• Jen would like to see a permanent outdoor installation.
• Erin said the October MRAC Community Arts grant is up to $5,000.00 with a City match of
$1,250.00. The deadline for this grant is October 5, 2015.
• Erin mentioned another grant, one up to $10,000.00, with a February deadline date.
• There was discussion whether the Commission should concentrate on the smaller of the two
grants.
• Donna said the Heights Theater mural project could be put off for another year.
• Rita liked the idea of Mentoring Peace Through Art (mentoringpeace.org), but Donna didn't
like the quality of their work.
• The Commission agreed to have a list of requirements for the mural work.
• Sarah asked if mural supplies (paint, etc.) that are donated by local businesses (e.g. Sherwin -
Williams, etc.) would need to go through the city. Erin said yes because the city is our fiscal
agent.
• Jen asked if the Commission could have a fundraising campaign to ask for donations for the
mural project.
• Everyone agreed that concentrating on a smaller project made sense. The members talked
about painting the city's recreation department buildings. Betsy thought it would be great to
have a small-scale version mural project for kids to participate in. Jen said a professional
artist could be hired to help coordinate the project. Also, providing art workshops for kids
to prepare for the mural project is a possibility. Sarah said Heighten the Arts might be a
good resource because they can apply for money due to their school connection.
• There was discussion about starting a Grant - Murals Subcommittee, which would involve
researching grants, talking to the necessary people, weighing the pros and cons of a painted
vs. electronic mural, and corning up with idea proposals.

• Rita would like to add more to the website's "About" page and asked members to submit
ideas to her.
• Jen said she would put together a summary about the Commission and email it to Rita to put

4. Directory of Local Artists
• A total of twenty -four artists have submitted to the Directory.
• Two new entries: Branko Gulin, a sculptor; and Leigh Herrick, a poet, writer, and recording
artist.
• Gretchen thanked Sarah for drafting an email to send to Directory entrants.
• Gretchen talked to the owner of Squeeky Toys to clarify the artistic nature of the business.
Squeeky- Toys researches and restores antiques and costumes, has made space education
videos, participated in Convergence -con, and previously been involved with NEMAA.
5. Logo Designs / Branding
• Since there was nothing new to add, the Commission agreed to keep this off future agendas
for now.
6. November 2015 Meeting Date
• Carrie said all of the remaining meetings for 2015 (other than November) have been
reserved in the Keyes Room at 6:30 PM.
• Meeting dates: Wednesday, August 12; Wednesday, September 9; Wednesday, October 14;
and Wednesday, December 9.
• The Commission agreed to meet on Tuesday, November 10, 2015 at 6:30 PM in the Keyes
Room.
• Carrie will contact Deanna Saefke to reserve the November date.
7. Sub - Committee Updates
a. Policy
• Jen handed out a Policies and Procedures draft she has been working on and asked
the Commission to give her feedback before the next meeting.
• Jen pointed out the Definition of Public Art in the City's Ordinance. There was
discussion about omitting the word "physical" (artwork) from the summary because

the Commission believes viewable artwork should also include performance art,
music, etc. Donna said any changes to the Ordinance would need to be made by the
City.
• Also, the Commission talked about adding a disclaimer to their website regarding
posting artists' work. If the work is considered offensive, the Commission has the
right to refuse posting pictures of the art, as well as any links to the artist's webpage.
• Jen talked about the city of Hutchinson's PAC Policies document and asked the
members to check out their webpage for more information.
b. Electronic Communications
• Sarah has composed an electronic letterhead, which she will email to Gretchen and
Carrie.
c. Arts Center Proposal
• The City Council has received the Commission's Arts Center Proposal.
• Gretchen thanked Erin for drafting the Proposal letter.
d. Budget Proposal
• Jen sent the Budget Proposal to Walt Fehst and Joseph Kloiber.
• Jen received an email response from Joseph Kloiber. He said the Commission's
request would be processed as $1,400.00. However, there is a separate process to
expend that budget.
• Joseph Hogeboom, the City's Community Development Director, emailed Jen and
suggested they meet with any website questions.
New Business
1. Ron Parizek (NENL -�A) — future guest speaker?
• There was a consensus by the Commission to have Ron Parizek as a guest at one of our
summer meetings.
2. Thank -yous/ Letters/ Correspondence
• Nothing new to report.
3. Minnesota State Arts Board Study: Artists Thrive
• Erin talked about Artists Thrive, a needs assessment study of artists in Minnesota. Since the
Commission needed to wrap up their meeting, no further discussion was held.
4. Strategic Goal Planning
• Discussion of strategic goal planning wiU be on August's meeting agenda.

BACKGROUND: On July 13, 2015 the City Council established a Public Hearing for the formal consideration of
assessing an alley light to benefited properties, as requested by petition. A public Hearing was held on August
101h but tabled to August 241h based on resident input regarding the location of the light.
The proposed light is located in the alley. The petition is for one protective light to be installed on an existing
pole between 4140 and 4146 Reservoir Boulevard. Resident input from August 101-h- suggested the most
effective location might be better served on the pole between 4156 and 4154 Reservoir Boulevard.
There are six parcels included in the assessment. Of these six parcels, four property owners signed the
petition in favor of installing the alley light. Following the August 101-h Public Hearing, notices were sent out to
the affected parcels informing them of the continuation of the hearing to consider a different location for the
light.
Currently, the monthly cost to each of the benefiting homeowners is $1.00 per month. This cost may increase
with increases in the electric rates.
STAFF RECOMMENDATION: Staff recommends levying and adopting the assessment for Alley Light Area No.
677 -45.
RECOMMENDED MOTION(S): Move to close the public hearing and waive the reading of Resolution 2015 -049,
there being ample copies available to the public.

RESOLUTION NO. 2015 -49
A resolution of the City Council for the City of Columbia Heights, Minnesota, adopting assessment roll
according to the City Charter for the following local improvement and determining that said improvement will
be made, and ratifying and confirming all other proceedings, heretofore had: Special Assessment for alley
light area numbered 677 -45.
Whereas, the City Council of the City of Columbia Heights, Minnesota, met at 7:00 p.m. on the 24th day of
August, 2015, in the City Council Chambers, 590 40th Avenue N.E. Columbia Heights, Minnesota, being the
time and place set when and where all persons interested could appear and be heard by the Council with
respect to benefits, and to the proportion of the cost of making the local improvement above described, a
notice of such hearing having been heretofore duly published as required by law, and a notice mailed to each
property owner of record, stating the proposed amount of the assessment; and,
Whereas, this Council has heretofore estimated the cost of such local improvement and has prepared an
assessment roll therefore,
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of Columbia
Heights, the City Council of the City of Columbia Heights makes the following:
Section 1. That this Council does hereby adopt the aforesaid assessment roll known and
described as "Assessment Roll for Local Improvements" numbered 677 -45 for alley
lighting, a copy of which is attached hereto and made a part hereof.
Section 2. That this Council hereby finds and determines that each of the lots and parcels of
land enumerated in said assessment roll was and is especially benefited by such
improvements. This Council further finds and determines that the proper
proportion of the cost of such improvement to be especially assessed against each
lot or parcel of land is the amount as billed annually by Xcel Energy Company.
Section 3. That the assessment will be added to the utility bill prepared and mailed by the
City of Columbia Heights to property owners or occupants on record with the
Finance Department.
Section 4. This resolution shall take effect immediately upon its passage.

ADOPTION OF PROPOSED SPECIAL ASSESSMENT
Notice is hereby given that the purpose of this Public Hearing is also to adopt assessment roll 677 -45, for the area of alley
lighting. The proposed assessments are to be levied pursuant to Minnesota Statutes, Chapter 429. The City Council may levy
and adopt special assessments that are the same or different than the proposed amount.
ASSESSMENT ROLL AVAILABLE FOR INSPECTION
The proposed assessment roll is now on file for public inspection at the City of Columbia Heights Clerk's Office, 590 40th
Avenue NE, Columbia Heights, Minnesota. You are invited to examine the assessment roll prior to the hearing during business
hours; no appointments are necessary. The assessment roll will also be available for examination at the hearing.
OBJECTIONS AND APPEALS
Written and oral objections will be considered at the hearing. The City Council may adopt the assessments at the hearing or at
a subsequent meeting. Minnesota Statute, Section 429.061, states that no appeal may be taken as to the amount of the
assessment unless a written objection, signed by the affected property owner, is filed with the municipal clerk prior to the
assessment hearing or presented to the presiding officer at the hearing. An owner may appeal an assessment to the District
Court pursuant to Minnesota Statute, Section 429.081, by serving notice of the appeal upon the Mayor or the Clerk of the City
within thirty (30) days after the adoption of the assessment and filing such notice with the District Court within (10) days after
service upon the Mayor or the Clerk.

STAFF RECOMMENDATION:
Declaration of a nuisance and abatement of violations within the City of Columbia Heights is requested
regarding the property at:

RECOMMENDED MOTION(S):
Move to close the public hearing and to waive the reading of Resolution Number 2015 -60, there being

Heights declaring the property listed a nuisance and approving the abatement of violations from the
property pursuant to City Code section 8.206.

Resolution of the City Council for the City of Columbia Heights declaring the property a nuisance and
approving abatement of ordinance violations pursuant to Chapter 8, Article II, of City Code, of the property
owned by MNSF II Acquisitions LLC (Hereinafter "Owner of Record ").
Whereas, the owner of record is the legal owner of the real property located at 1101 46th Avenue N.E.,
Columbia Heights, Minnesota.
And whereas, pursuant to Columbia Heights Code, Chapter 8, Article II, Section 8.206, written notice setting
forth the causes and reasons for the proposed council action contained herein was sent via regular mail to the
owner of record on June 11, 2015.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of Columbia
Heights, the City Council of the City of Columbia Heights makes the following:
FINDINGS OF FACT
1. That on June 9, 2015, an inspection was conducted on the property listed above. Inspectors found
violations. A compliance order was sent via regular mail to the owner at the address.
2. That on July 9, 2015, inspectors re- inspected the property listed above. Inspectors noted that
violations remained uncorrected. A compliance order and statement of cause was mailed via regular
mail to the owner listed in the property records.
3. That on August 11, 2015, inspectors re- inspected the property and found that violations remained
uncorrected.
4. That based upon said records of the Fire Department, the following conditions and violations of City
Codes(s) were found to exist, to wit:
A. Shall repair /replace retaining wall.
5. That all parties, including the owner of record and any occupants or tenants, have been given the
appropriate notice of this hearing according to the provisions of the City Code Section 8.206(A) and
8.206(6).
CONCLUSIONS OF COUNCIL
1. That the property located at 1101 46th Avenue N.E. is in violation of the provisions of the Columbia
Heights City Code as set forth in the Notice of Abatement.
2. That all relevant parties and parties in interest have been duly served notice of this hearing, and any
other hearings relevant to the abatement of violations on the property listed above.
3. That all applicable rights and periods of appeal as relating to the owner of record, occupant, or tenant,
as the case may be, have expired, or such rights have been exercised and completed.

mail to the owner listed in the property records.
3. That on June 30, 2015, inspectors re- inspected the property and found that violations remained
uncorrected.
4. That based upon said records of the Fire Department, the following conditions and violations of City
Codes(s) were found to exist, to wit:
A. Shall repair /replace broken window in front.
B. Shall seed or sod backyard.
5. That all parties, including the owner of record and any occupants or tenants, have been given the
appropriate notice of this hearing according to the provisions of the City Code Section 8.206(A) and
8.206(B).

Resolution of the City Council for the City of Columbia Heights approving revocation pursuant to City Code,
Chapter 5A, Article IV, Section 5A.408(A) of that certain residential rental license held by BRP II, LLC
(Hereinafter "License Holder ").
Whereas, license holder is the legal owner of the real property located at 4213 3rd Street N.E., Columbia
Heights, Minnesota,
Whereas, pursuant to City Code, Chapter 5A, Article IV, Section 5A.408(B), written notice setting forth the
causes and reasons for the proposed Council action contained herein was given to the License Holder on July
24, 2015 of a public hearing to be held on August 24, 2015.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of Columbia
Heights, the City Council of the City of Columbia Heights makes the following:
FINDINGS OF FACT
1. That on June 17, 2015, an inspection was conducted on the property listed above. Inspectors found
violations. A compliance order was sent via regular mail to the owner at the address.
2. That on July 23, 2015, inspectors re- inspected the property listed above. Inspectors noted that
violations remained uncorrected. A compliance order and statement of cause was mailed via regular
mail to the owner listed in the property records.
3. That on August 13, 2015, inspectors re- inspected the property and found that violations were finally
corrected, and the License Holder was informed that a $100 reinspection fee was due.
4. That based upon said records of the Fire Department, the following conditions and violations of City
Codes(s) were found to exist, to wit:
A. License Holder failed to pay reinspection fee.
5. That all parties, including the owner of record and any occupants or tenants, have been given the
appropriate notice of this hearing according to the provisions of the City Code Section 8.206(A) and
8.206(B).
ORDER OF COUNCIL
1. The rental license belonging to the License Holder described herein and identified by license number
F14529 is hereby revoked;
2. The City will post for the purpose of preventing occupancy a copy of this order on the buildings
covered by the license held by License Holder;
3. All tenants shall remove themselves from the premises within 45 days from the first day of posting of
this Order, revoking the license as held by License Holder.
