Mayor Peterson announced that three long -time City employees recently retired; Carole Blowers, Carol
Femling and Steve Kolosky.
A. National Night Out proclamation.
Mayor Peterson read the proclamation in its entirety. Sergeant Justin Pletcher reported that Columbia
Heights has seen a steady decrease in crime in the recent years, at the same time community outreach
has been on the increase. In 2014 there were 53 National Night Out parties, with 1,260 residents
participating. Sergeant Pletcher announced other upcoming community outreach events, as well as
effort towards becoming a "Heart-Safe Community."

MOTION: Move to establish August 10, 2015 at 7:00 p.m. as a Public Hearing for consideration
of alley lighting between 4140 and 4146 Reservoir Boulevard.
Director of Public Works, Kevin Hansen reported that the City received a petition from four of
six property owners to install a mid -block street light. Hansen explained there are six parcels,
seven properties, as one is a duplex.
D. Installation Of 2-Way Stop Signs on Quincy Street and 43rd Avenue, Stopping Traffic On
Quincy Street
MOTION: Move to install two -way "STOP" signs at the intersection of Quincy Street and 43rd
Avenue, stopping north and south bound traffic on Quincy Street, as recommended by the Traffic
Commission.
E. Approve Business License Applications
MOTION: Move to approve the items as listed on the business license agenda for July 13, 2015
as presented.
F. Payment of Bills
MOTION: Move that in accordance with Minnesota Statute 412.271, subd. 8, the City Council
has received the list of claims paid covering check number 157257 through 157498 in the amount
of $ 1,109,276.10.
Councilmember Nawrocki requested that item A be removed from the Consent Agenda for

1. Accepting Bids And Awarding A Contract For The 49th Avenue Turn Lane Construction, City
Project 1415

Director of Public Works, Kevin Hansen gave an overview of the proposed project. The project
is to be done on the west side of Central Ave; the existing median will be moved slightly north to
allow the turn lane. The project is scheduled to be completed prior to school opening in
September. The City has received a MNDOT Grant in the amount of $180,000.
Staff recommends the additional funding of $18,000 come from the state aid construction
account.
Councilmember Nawrocki asked what the original project estimate was. Director Hansen
reported it was $180,000. Hansen reported the cost on this project is impacted by the tight time
fame, as we are completing it before the start of the school year.
Motion by Councilmember Williams, seconded by Councilmember Schmitt to accept bids and
award the 49'x' Avenue Turn Lane Construction, City Project No. 1500, to Hardrives , Inc., based
upon their low, qualified, responsible bid in the amount of $198,003.60 from Fund 415- 51415-
5185; and, furthermore, to authorize the Mayor and City Manager to enter into a contract for the
same. All Ayes, Motion Carried.
C. New Business and Reports
1. Authorization to seek bids for Library Bid Package #2 for the new Cily Library
Director of Public Works, Kevin Hansen reported that bid package #1 has been awarded and Veit
Construction will begin excavation Monday July 20th
Bid package #2 consist of four separate contracts; general construction, mechanical, electrical
and fire protection.
The project team has been updating the project estimate on a continuous basis. It was determined
that costs need to be reduced. This has involved a "value engineering" process to reduce
$380,000 of costs from the final design. A summary of those modifications was reviewed with
the council. A list of alternates was also reviewed.
Councilmember Nawrocki asked what the original bond issue was. Director Hansen stated it was
$6.89 million. Nawrocki asked where the remainder of the money will come from. Hansen
responded that the city council authorized an additional $2.3 million in additional funding
sources. There is a grant from MWMO for $600,000 to pay for storm sewer improvements.
Councilmember Nawrocki asked if the $381,000 includes the under estimated amount of
$287,000 from Bid package No. 1. Director Hansen explained it would be reflected in
contingencies. Hansen explained the value engineering process was done to bring the project in
line with the expected revenue.
Councilmember Schmitt suggested that many of the items listed on the schedule of alternates
could possibly be covered by a donor. Director Hansen responded that a meeting is planned
with the Library Foundation in order to identify fundraising for specific items, and more
information will be available the beginning of August.
Councilmember Schmitt asked if there are any library board members experienced in grant
writing. Director Hansen reported two grants have been received so far; totaling $900,000.
Mayor Peterson stated we will want to stay within the goal of $9.3 million, while constructing a
quality building.
Motion by Councilmember Williams, seconded by Councilmember Schmitt to authorize staff to
seek bids for Bid Package #2 for the Library: General Construction, Mechanical, Electrical, and
Fire Protection. All Ayes, Motion Carried.

10. ADMINISTRATIVE REPORTS
City Manager Walt Fehst thanked firefighter Steve Kolosky for his years of dedicated service.
Manager Fehst congratulated Gary Gorman and the fire department for being awarded a SAFER
grant to allow for the hiring of two full -time daytime firefighters for two years.
Councilmember Nawrocki suggested the library board gain a better understanding of the open
meeting law. Manger Fehst stated that the chairperson has been reminded of the open meeting law.
Councilmember Nawrocki questioned if anything has been done related to the predatory remolding
situation that occurred at the residence on 49 "' Ave. Manager Fehst stated this will be discussed at
the August worksession.

There were not any residents wishing to speak.

Mayor Peterson reminded us not to take ourselves too seriously and to try to do a random act of
kindness.

Background
Through a variety of causes and circumstances, the City's General Fund had a significant surplus in
2014. Some of that surplus has already been used in 2015 by the City Council to lessen property taxes
for 2016 and 2017 by paying off certain bonded debt early. Approximately $500,000 of the 2014
General Fund surplus remains available for use.
One of the main financial challenges facing the City is the need to sustain its capital projects funds over
the long term. A staff projection in 2013 estimated that the balances of the governmental Capital
Equipment Replacement Fund 431 and the governmental Buildings Improvement Fund 411, would be
exhausted by the year 2021.
Analysis:
Although steps have been implemented under the City's five -year financial plan to begin to extend the
life of the City's equipment and building funds, the approved 2015 purchase of a fire truck for
approximately $500,000 is a major expense for which additional funding should be considered.
The cost of this single vehicle is two to three times the average annual cost for all other equipment
combined from the Capital Equipment Replacement Fund 431. By transferring the remaining 2014
General Fund surplus to Fund 431, the City Council will avoid the situation of "taking one step forward
and two steps back" in its effort to sustain its capital projects funds over the long term.
If the City Council approves this transfer, the resulting fund balance of the General Fund will still meet
the working capital goal set by Resolution 95 -40, and will also meet the expected trend of the five -year
financial plan.
RECOMMENDED MOTION: Move to waive the reading of Resolution 2015 -54, there being ample
copies available for the public.

WHEREAS, the City Council of the City of Columbia Heights has adopted by resolution 2014 -94, a
2015 budget calling for the purchase of a fire emergency vehicle; and
WHEREAS, the estimated cost of $500,000 for this vehicle is significantly more than the average
annual expenditures for all purposes from the Capital Equipment Replacement Fund 431; and
WHEREAS, the City Council of City of Columbia Heights judges that it is financially prudent to sustain
the fund balance in the Capital Equipment Replacement Fund 431 over the long term, for substantially
all of the annual equipment purchases made for its governmental activities; and
WHEREAS, an unassigned surplus of 2014 revenue over 2014 expenditures of approximately $500,000
remains currently held in the City of Columbia Heights General Fund;
NOW, THEREFORE, BE IT RESOLVED that the 2015 City of Columbia Heights' budget is amended
to appropriate an interfund transfer of $500,000 from the General Fund to the Capital Equipment
Replacement Fund 431.

Background:
At the December 8, 2014 regular meeting, the Council authorized staff to seek proposals for professional
services for the design and construction of the new Library which included:
• Architectural — HGA. completed
• Site /Civil — HGA. completed
• Owner Representation — ICS Consulting. completed
• Geo- Technical — RAP Implementation and Construction Contingency; and Construction Testing and
Special Inspections of unique structural features driven by site conditions such as pilings, structural
concrete foundations, and materials testing for concrete, steel, and densities, testing certifications, and
onsite inspections.
Staff prepared an RFP for Geotechnical Services for the RAP Implementation and Construction Contingency
Plan and sent it to five geotechnical firms:
1. American Engineering Testing (AET)
2. Braun Intertec
3. Environ Testing
4. Northern Technologies, Inc (NTI)
5. ProSource Technologies
The RFP details specific testing and environmental services for the new library project to meet the
requirements in the Response Action Plan and Construction Action Plan approved by the MNPCA on June 9,
2015 (attached). Two proposals were received on July 15th in response to the Geotechnical RAP
Implementation Services RFP (attached). Proposals were evaluated on the following criteria:
(50% of total review score):
• Ability of respondent to staff project appropriately.
• Ability of respondent to meet criteria established in Response Action Plan (RAP) and Construction
Contingency Plan.
• Previous experience and references.

• Fee structure.

Based on the proposals received and the selection process established in the RFP and conducted by City staff

Dear Mr. Hansen:
The Minnesota Pollution Control Agency (MPCA) Brownfields staff in the Petroleum Brownfields (PB)
and Voluntary Investigation and Cleanup (VIC) Programs have reviewed the Response Action Plan and
Construction Contingency Plan (RAP /CCP) submitted for the Central Avenue Library site, located at the
address referenced above (the Site). The RAP /CCP dated April 7, 2015, was prepared and submitted on
your behalf by Braun Intertec Corporation (Braun).
Residential dwellings were formerly located on the southwest corner of the Site from at least 1934 until
the mid- 1950s. The remainder of the Site consisted of a lowland area until dumping and filling of the
lowland began in the 1940s. By the mid- 1950s, the residential dwelling formerly located on south Site
parcel was demolished; filling activities on the entire Site were complete. A multi- tenant commercial
building with a bowling alley in the basement was constructed on the south Site parcel by 1957 and
operated until 2014 when the building was demolished. A Burger King restaurant was constructed on
the north Site parcel in 1965 and operated until the City of Columbia Heights purchased the property in
December of 2004 and was demolished in January of 2005.
The entire Site area was characterized as containing dump materials from 9 to 27 feet in thickness. The
fill materials consisted of poorly graded sand with silt and gravel, sandy lean clay, clayey sand, and silty
sand. The dump materials consist of demolition material, foundry sand, concrete, bricks, wood, metal,
glass, asbestos containing materials, and some small amounts of municipal garbage. Soil samples were
collected from the intermixed fill and dump materials and arsenic, lead, mercury, and polynuclear
aromatic hydrocarbons were detected in the samples at concentrations greater than the MPCA's soil
reference values for commercial /industrial land use. Soil vapor samples were collected and analytical
results indicated that methane and hydrogen sulfide were not detected beneath the building foot print
and that methane and hydrogen sulfide were detected at very low levels at one location beneath the
parking area.

The RAP /CCP proposes excavation and disposal of approximately 5,500 cubic yards of dump material.
Clean fill will be used as backfill for the excavated areas and a vapor barrier will be installed under the
building. A new library building will be constructed on the northwest portion of the Site and the
remaining portion of the Site will be paved parking with some limited green spaces. The library building
does not meet the suggested 200' setback requirement for buildings near dumps. The City will install
special pilings for the library building to overcome the poor engineering properties of the dump fill.
The RAP /CCP is hereby approved, subject to the following conditions:
1. Dust suppression methods shall be used during excavation, stockpiling and loading of dump
material and soil. Trucks shall be covered to transport the material to the disposal area.
2. Backfill material shall be sampled at a rate based on the source of the material. For pit run
material documentation of the material may be provided by the source facility. If from an urban
source, the soil shall be sampled at a rate of a sample for every 500 yards of material. The
sources of backfill will be documented and listed in the RAP Implementation report along with
the sampling results.
3. An affidavit will be a component of the RAP and will be filed with the county. It will identify the
location of dump materials that will remain on the Site.
4. Petroleum contaminated soils encountered at the Site, at or greater than 200 parts per million
(PPM) as measured by a photoionization detector (PID), should be excavated and properly
managed at an MPCA approved off -site treatment /disposal facility.
5. Petroleum contaminated soils less than 100 PPM (PID) may be used to construct on -site
landscape berms. Soils must be mixed 50/50 with clean soils and covered with 2 feet of clean
cover soils, along with a vegetative cover.
6. Petroleum contaminated soils at or greater than 10 PPM (PID) encountered during the
installation of underground utilities should be removed and properly managed as part of the
RAP /CCP. If contamination remains at or above 10 PPM a vapor barrier is required.
7. Imported soil and excess fill targeted for off -site reuse shall be from a native source and /or
meet the MPCA's criteria for Unregulated Fill. Soils that do not meet Unregulated Fill criteria
may not be used at the discretion of the contractor or other project personnel.
8. Any contaminated soils removed from the Site must be treated or disposed of in a method
approved by the MPCA. Contaminated soils transported to an approved landfill must be in
compliance with all state and local permits. The applicant must notify MPCA staff when
contaminated soils are initially transported and where soils will be disposed of prior to disposal.
Please include all transportation and handling manifests for such soils within the final
implementation report.
9. This RAP /CCP approval is contingent on the applicant obtaining all other required state, federal
and local government permits.
10. MPCA Brownfield Program staff does not provide review or approval of the discharge and /or
treatment of groundwater, stormwater or any other dewatering action.
An implementation report describing the completed response action activities, sampling results, soil
management and disposal, and imported soils shall be prepared and submitted to the MPCA. If the
implementation report will not be submitted within one year of the date of this letter, please notify the
MPCA project staff of the status of the development. Approval of this plan does not suggest that any of
the costs incurred will be eligible for reimbursement from the Petro Board.

The RFP details specific testing and environmental services for the new library project to meet the

2015 (attached). Two proposals were received on July 15th in response to the Construction Testing and
Special Inspections RFP (attached). The firm of AET responded they would not be able to adequately staff

ICS Consulting, Inc. has reviewed the proposals that were received on Wednesday, July 15, 2015
at 3:00 p.m. for the above - referenced project. After reviewing the two respondent proposals
we have found Braun Intertec to have a more complete and comprehensive project approach. It
was clear that Braun has identified the appropriate time required for the testing of the driving
piles and followed the specification laid out by the documents generated by HGA. Braun also
included double the amount of site visits for concrete construction testing.
The base price for Braun Intertec's proposal is $67,040 and Northern Technologies, Inc.'s
proposal is $46,994; however, after reviewing Northern Technologies work scope, additional
dollars /hours needed to be added to provide a true comparison and make their proposal
consistent with the requirements of the specification. When adding the additional
requirements of testing, Northern Technologies revised price is $69,571.
It is also important to understand that each proposal is an estimate, the true cost will be
determined after each phase of testing is complete. If the construction and the testing goes
faster than anticipated, the cost savings will go back to the owner. It is our recommendation for
award is as follows:

MOTION: Move to close the public hearing and to waive the reading of Resolution

MOTION: Move to adopt Resolution Number 2015 -48, being resolution of the City
Council of the City of Columbia Heights declaring the property listed a nuisance and
approving the emergency abatement of violations from the property pursuant to City
Code section 8.206.

Resolution of the City Council for the City of Columbia Heights declaring the property a nuisance
and approving emergency abatement of ordinance violations pursuant to Chapter 8, Article II, of City
Code, of the property owned by Michael Thoennes (Hereinafter "Owner of Record ").
Whereas, the owner of record is the legal owner of the real property located at 666 40th Avenue N.E.
Columbia Heights, Minnesota.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of
Columbia Heights, the City Council of the City of Columbia Heights Makes the following:
FINDINGS OF FACT
1. That on July 20, 2015 the Fire Department responded to a complaint at the address listed
above. Inspectors noted that the structure was open and unsecured.
2. That on July 20, 2015 the Fire Chief ordered that Advance Companies secure the vacant
structure.
3. That based upon said records of the Fire Department, the following conditions and violations
of City Codes(s) were found to exist and have been abated, to wit:
A. Approve the emergency abatement of the hazardous situation located at 666 - 40th
Avenue N.E.
CONCLUSIONS OF COUNCIL
That the property located at 666 40th Avenue N.E. is in violation of the provisions of the
Columbia Heights City Code as set forth in the Notice of Abatement.
2. That the emergency abatement of the hazardous situation located at 666 40th Avenue N.E. is
hereby approved.

pursuant to City Code, Chapter 5A, Article IV, Section 5A.408(A) of that certain
residential rental license held by Mujir Ibrahim (Hereinafter "License Holder ").
Whereas, license holder is the legal owner of the real property located at 1132 45th
Avenue N.E. Columbia Heights, Minnesota,
Whereas, pursuant to City Code, Chapter 5A, Article IV, Section 5A.408(B), written
notice setting forth the causes and reasons for the proposed Council action contained
herein was given to the License Holder on June 9, 2015 of a public hearing to be held on
July 27, 2015.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of
the City of Columbia Heights, the City Council of the City of Columbia Heights makes
the following:
FINDINGS OF FACT
1. That on April 29, 2015, inspectors for the City of Columbia Heights, inspected the
property described above and noted violations. A compliance letter listing the
violations was mailed by regular mail to the owner at the address listed on the
Rental Housing License Application.
2. That on June 4, 2015, inspectors for the City of Columbia Heights performed a
reinspection and noted that violations remained uncorrected. A statement of
cause was mailed via regular mail to the owner at the address listed on the rental
housing license application.
3. That on June 25, 2015, inspectors for the City of Columbia Heights checked
records for this property and noted that the violations remained uncorrected. A
$100 reinspection fee was assessed for the additional reinspection.

5. That based upon said records of the Enforcement Office, the following conditions
and violations of the City's Property Maintenance Code were found to exist, to-
wit:
a. Repair kitchen ceiling (active leak from bathroom).
b. Repair hole in bedroom door.
c. Replace missing drawers /cabinet doors in kitchen.
d. 1132: Repair /replace non - working smoke detector in kitchen.
e. 1132: Replace missing drawers in kitchen.
f. 1132: Replace missing handles for drawers in kitchen.
g. Shall provide screens for all windows.
h. Remove chair from outside front.
i. 1134: Repair stove to work properly. Will not light.
j. Repair damaged light fixture out front.
k. 1132 Repair /replace non - working smoke detector in living room

6. That all parties, including the License Holder and any occupants or tenants, have
been given the appropriate notice of this hearing according to the provisions of
the City Code, Chapter 5A, Article III 5A.306 and 5A.303(A).
ORDER OF COUNCIL
1. The rental license belonging to the License Holder described herein and identified
by license number F14238A is hereby revoked.
2. The City will post for the purpose of preventing occupancy a copy of this order on
the buildings covered by the license held by License Holder.
3. All tenants shall remove themselves from the premises within 45 days from the
first day of posting of this Order revoking the license as held by License Holder.
