CALL TO ORDER/ROLL CALL/INVOCATION Mayor Peterson called the meeting to order at 7:05 PM. Members Present: Mayor Peterson, Council member Williams, Council member Diehm, and Council member Nawrocki. Members Absent: Council member Schmitt Staff Present: City Manager Walt Fehst, Finance Director Joseph Kloiber, City Engineer/Public Works Director Kevin Hanson, City Attorney Jim Hoeft, and City Clerk/Council Secretary Tori Leonhardt. ADDITIONS/DELETIONS TO MEETING AGENDA Nawrocki reported at the Anoka County Local Officials meeting they talked about ground water and more specifically, about the ground water in Columbia Heights. He had a pamphlet on the subject if anyone was interested. He also stated that he paid for his own meal at the event, as well as his mileage. Nawrocki indicated that he would like to pay for his lunch at the upcoming luncheon being sponsored by the police department and the employee luncheon. Fehst replied that the police luncheon is paid for by the association and he would have to check into the cost for the employee luncheon. Nawrocki expressed his disappointment that the City does not try and work with local companies on catering our events. He would like to address some items under the City Managers report. 4. PROCLAMATIONS,PRESENTATIONS,RECOGNITION,ANNOUNCEMENTS, GUESTS Community Development Director Scott Clark introduced Joseph Hogeboom who is the new Assistant Community Development Director,replacing Sheila Cartney who took a job with the City of Rogers in October. Clark stated this is a combination position covering both the City Planner and the Community Development Assistant positions. Hogeboom stated he feels very fortunate to be here. He came from the City of Golden Valley where he started as an Intern in the Planning Department seven years ago and was promoted to an Assistant Planner. From there he was promoted to the City Planner and most recently he was promoted to the Housing and Redevelopment Coordinator. He study at the University of Wisconsin and received his Master's degree at Hamlin University. 5. Payment of Bills MOTION: Move that in accordance with Minnesota Statue 412.271, subd.8,the City Council has received the list of claims paid covering check number 149987 through 150176 in the amount of $791,791.78. Motion by Diehm, seconded by Williams, to approve the Consent Agenda with the exception of items B, C, and D that have been removed for further discussion. Upon Vote: All ayes. Motion Carried. Items removed for Discussion: Item B: Adopt Resolution 2013-101, being a resolution approving the terms of an inter-fund 7 City Council Meeting Minutes Tuesday,November 12,2013 Page 3 of 7 loan from the Community Development Capital Improvement Fund 420 to the Anoka County Community Development Programs Fund 202 Kloiber stated in December 2012, the EDA purchased the Mady's property at 3927 Central Avenue using available funds from the Community Development Capital Improvement Fund 420. Prior to the purchase of the property, the City passed Resolution 2012-51 requesting Anoka County HRA levy funds from 2008-2012 be used towards the purchase. These funds were disbursed from the Anoka County HRA. Until the remainder is collected, the City is borrowing from the fund. Motion by Diehm, seconded by Williams to waive the reading of Resolution 2013-101, there being ample copies available to the public. Upon Vote: All ayes. Motion Carried. Motion by Diehm, seconded by Williams to adopt Resolution 2013-101,being a resolution approving the terms of an inter-fund loan from the Community Development Capital Improvement Fund 420 to the Anoka County Community Development Programs Fund 202. Item C: Adopt Resolution 2013-102,being a resolution to transfer and gppropriate $34,000 from the 2013 general fund budget to the capital equipment replacement general government fund 431. Kloiber stated this item was discussed at the November 4th work session in regards to the City deferring certain equipment purchases (copy machines)budgeted in 2013 to 2014, so the City can take advantage of the new sales tax exemption effective in 2014 and save almost 7% on the cost of this equipment. Motion by Diehm, seconded by Williams, to waive the reading of Resolution 2013-102,there being ample copies available to the public. Upon Vote: All ayes. Motion Carried. Motion by Diehm, seconded by Williams, to adopt Resolution 2013-102,being a resolution to transfer and appropriate $34,000 from the 2013 general fund budget to the capital equipment replacement general government fund 431. Item D: Adopt Resolution 2013-100 Approving Amendment No. 2 to Water Agreement with the City Of Minneapolis Hansen explained that this will only impact the purchase of water, not our rates. There are three components. 1). Rate Calculation: The current contract details that Columbia Heights will pay an "inside rate"or percentage of what Minneapolis customers pay. 2). Water supply: The City of Minneapolis will be able to drill groundwater wells in Minneapolis, if need be. 3). Frequency of the Cost of Service Study(COS): The current contract calls for updating the COS every five years, this changes it to every three years. This averages it out so not to impact residents as much if we have a really dry or really wet year. Nawrocki asked if this is an increase that we are paying to the City of Minneapolis,but not an increase that the residents are paying, and if not, when do we expect an increase to the residents will happen. Hansen replied it defines the rates; it does not impact the rates directly right now. In 2014 it will be the fifth year of a five year plan. Nawrocki stated somewhere along the lines, the cost will go up. Diehm stated this is consistent 8 City Council Meeting Minutes Tuesday,November 12,2013 Page 4 of 7 with our five year plan. Hansen stated we already took the cost increase into account in our five year plan. Motion by Diehm, seconded by Williams, to adopt Resolution 2013-100,being a resolution approving Amendment Number 2 to the Water Agreement between the cities of Minneapolis and Columbia Heights and authorizing the Mayor and City Manager to execute the amended agreement. ADMINISTRATIVE REPORTS Report of the City Manager Fehst recognized that the Council members each received a copy of a letter from a resident regarding the concrete repairs that were done along Argonne. The complainant stated that some areas were painted white and some of the panel replacements were not perpendicular. Hansen indicated the white paint was the sealant and it would all blend in after a year and the panel replacements have never been perpendicular as they are usually irregular. Hansen also stated most of these are astatic issues. There were some areas that were brought up about uneven spots in the pavement and the contractor has diamond ground those areas and the Public Works Department is keeping an eye on them and we will continue to monitor these issues in the spring. Nawrocki asked that Hansen reply to the complainant in writing. Hansen indicated that he will do so. Fehst indicated that Council member Schmitt attended the Met Council Thrive meeting and she talked with District 13 Representative, Jon Commers, about having the next meeting in Columbia Heights. Fehst followed up with Commers on some dates to meet and as soon as a date is confirmed, he will let the Council know and will advertise it so residents will be informed as to the when and where. It will be in the evening sometime between 6-1 OPM. Fehst stated a letter went to the County to consider appointment of Council member Schmitt to the Rice Creek Water Shed District. Fehst also stated the City continues to work with HUD and with Aeon on the purchase of the Parkview North and South. Fehst stressed that the City wants to preserve senior housing. Nawrocki brought up as to what the cost was for our annual fee for the MWMO. Hansen stated as soon as he gets a response from them,he will let Council member Nawrocki know. Nawrocki reiterated that no money would be distributed to the Arts Commission therefore; they should be told that they need to keep their own minutes and set up their own meetings, etc. He also brought up at the last meeting about the copper being removed from the light poles and the fact if 9 City Council Meeting Minutes Tuesday,November 12,2013 Page 5 of 7 these lines get hit by lighting that it could be a serious thing. Hansen stated that staff has had conversations with Xcel and they are aware of the continuous cycle of copper theft and Hansen will inquire what their plan is to replace it in Columbia Heights. Peterson suggested that the resident that called Nawrocki call Xcel and report where the copper is missing. Nawrocki stated he would like to see a copy of our contract with Xcel. He would also like to know what follow up we are going to have on the diseased tree at 4440 5th Street. Hansen stated he would get that information for him. Nawrocki commented that the couch was picked up in the alley at 4911 Central Avenue,but now there were bags left by the dumpster and would like to know who is responsible for the trash container. Nawrocki indicated that a resident contacted him that they are not receiving the Focus paper and they live in an individual unit behind the old Kmart site. Fehst stated that the Focus will not deliver to apartment buildings,but they should be delivering to individual residential homes. Nawrocki informed Fehst that he would also like copies of the bids the City received for the City luncheon. Report of the City Attorney Hoeft indicated he had nothing to report at this time. 9. CITIZENS FORUM Mayor Peterson invited everyone to the Taste of Heights on November 22nd at Murzyn Hall starting at 6:OOPM and the event goes until 10:00PM. There will be food from Sarna's Classic Grill, Yaffa Grill and Pizzeria, Royal Orchid, Miller's Coiner Bar&Grill, Tasty Pizza,Kevin Lindee the Chocolatier, Eldorado Restaurant, Adelita's Bakery, and Jalapeno's. There will also be music by accordionist Joe Macko, the Culver's Jammers, Little Ripley Band, and the Erverators. On Saturday,November 23rd at Murzyn Hall the Golden Gloves will be sponsoring the "Fight in the Heights". Doors open at 6:OOPM and fight starts at 7:OOPM with admission being$15.00. On December 11th there will be a wrestling match at Murzyn Hall sponsored by the Lions. Peterson asked that we keep our service men and women in our thoughts and prayers and to do a random act of kindness. 10.ADJOURNMENT Mayor Peterson adjourned the meeting at 7:59PM. Tori Leonhardt, City Clerk/Council Secretary 10 City Council Meeting Minutes Tuesday,November 12,2013 Page 6 of 7 RESOLUTION 2013-100 RESOLUTION APPROVING AMENDMENT NUMBER 2 OF WATER AGREEMENT BETWEEN THE CITIES OF MINNEAPOLIS AND COLUMBIA HEIGHTS WHEREAS, the City of Minneapolis operates a municipal water system known as the Minneapolis Public Works—Division of Water Treatment and Distribution Services; and WHEREAS, on June 1, 2004 the City of Minneapolis and the City of Columbia Heights entered into an Agreement entitled "Minneapolis—City of Columbia Heights Water Agreement"for the City of Minneapolis to supply water to the City of Columbia Heights; and WHEREAS, the City of Minneapolis and the City of Columbia Heights deem it appropriate to make amendments to Section 2 and Section 10 of that agreement defining rate calculation, water supply and cost of service study; and WHEREAS, the City Council has determined that approving the amended agreement is reasonable, prudent, and in the best interest of the public; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Columbia Heights, Minnesota as follows: Amendment Number 2 to the Water Agreement is approved and the Mayor and City Manager are authorized and directed to execute the amended agreement. RESOLUTION 2013-101 CITY OF COLUMBIA HEIGHTS RESOLUTION APPROVING THE TERMS OF AN INTER-FUND LOAN FROM THE COMMUNITY DEVELOPMENT CAPITAL IMPROVEMENT FUND 420 TO THE ANOKA COUNTY COMMUNITY DEVELOPMENT PROGRAMS FUND 202 RECITALS A. The City of Columbia Heights ("City") and its Economic Development Authority("Authority"), by participation in the Anoka County Housing and Redevelopment Authority (the "ACHRA") economic development activities, can request funds to support the City's redevelopment and housing maintenance and improvement goals within the City. B. The Authority purchased 3927 Central Avenue NE (the "Property") in December 2012 using Community Development Capital Improvement Fund(fund 420). 11 City Council Meeting Minutes Tuesday,November 12,2013 Page 7 of 7 C. The City adopted Resolution 2012-51, requesting that the ACHRA dedicate the annual ACHRA levy collection for fiscal years 2008-2012 for the purchase of the Property, $573,383.82. D. October 14, 2013 the Council approved a grant agreement by and between the ACHRA and the City regarding the disbursement of levy funds. E. The grant agreement(Contract 2538) dedicates the annual ACHRA levy collected in the City for the tax levy payable in 2013 and 2014 towards the purchase of the Property. F. The City has determined to temporarily finance the remaining levy committed, $340,839.87, from fund 420 at 0%interest,until it is collected from the tax levy payable in 2013 and 2014. G. Upon annual receipt of ACHRA funds, payment will be made to fund 420, until the outstanding balance is paid. NOW, THEREFORE, BE IT RESOLVED, The City Council authorizes a loan to the Authority for $340,839.87, from the Community Development Capital Improvement Fund 420 until funds are disbursed from the ACHRA. RESOLUTION NO. 2013-102 TRANSFER AND APPROPRIATE $34,000 FROM THE 2013 GENERAL FUND BUDGET TO THE CAPITAL EQUIPMENT REPLACEMENT GENERAL GOVERNMENT FUND 431 WHEREAS, the City Council of the City of Columbia Heights has adopted a 2013 budget as required by the City charter and Minnesota statute, including a 2013 budget for the City's general fund; and WHEREAS, included within the total 2013 general fund budget is $34,000 for certain equipment purchases; and WHEREAS, a cost savings can obtained by the City of Columbia Heights if it were to defer the purchase of this equipment to 2014; and WHEREAS, the City of Columbia Heights has determined that an effective way to account for the extension of the budget authority for these purchases to 2014 is to transfer the 2013 authorization to the capital equipment replacement fund established for such purposes; NOW, THEREFORE, BE IT RESOLVED that the 2013 City of Columbia Heights' budget be amended to transfer and appropriate $34,000 from the 2013 general fund budget to the capital equipment replacement general government fund 431. 12 COLUMBIA HEIGHTS PUBLIC LIBRARY Approved BOARD OF TRUSTEES 11/6/13 MINUTES 4 October 2, 2013 The meeting was called to order by Chair Patricia Sowada, at 6:29 p.m. Members present were: Nancy Hoium, Steve Smith, Patricia Sowada, Barbara Tantanella, and Council Representative Tami Diehm. Also present: Library Director Renee Dougherty and Acting Recording Secretary Kelly J. Olson. Not present: Catherine Vesley. The minutes of the September 4, 2013, Board meeting were approved as mailed. The bill list dated 9/4/13 was reviewed. It was moved, seconded, and passed that the bills be paid. The bill list dated 9/18/13 was reviewed. It was moved, seconded, and passed that the bills be paid. The 2013 accounting dated 10/2/13 was reviewed. Old Business: 1. Dougherty gave an update on the new Children's Librarian Bethany Grabow who will start on October 14, 2013. Bethany is a native Nebraskan who received her degree in Library Science from Clarion University. Bethany is very enthusiastic and will bring many great ideas to her new position. She will be a good fit for our community and our staff. She will be introduced at the City Council meeting on October 28 and the Library Board meeting on November 6. 2. Dougherty noted the Foundation Spaghetti Fundraiser had a very successful dinner netting $4200. Tantanella mentioned there were a lot of great silent auction items this year and that the Task Force member did a great job. Dougherty said that all baskets were picked except for one. 3. Dougherty asked if anyone could make the parent meeting for ACCapp HeadStart October 3 at 6:00 p.m. Tantanella volunteered to attend. New Business: 1. The Board reviewed the August crossover statistics. Smith noted that nothing really jumped out at him; Sowada mentioned that it looked good. Dougherty said that we have lost a couple of our outreach patrons. 2. The Board reviewed the Unique Management report for August. Dougherty said we continue to submit collections accounts each month and Hoium said that it is definitely worth our while. Dougherty said that Anoka County Library staff is working on some scripts when issuing library cards to be more intentional and give gentle reminders about the importance of returning library materials on time to avoid overdue fines. This led to a discussion regarding the Read Down program we had in June for teens. Hoium asked if this is something we could do again. Smith agreed and after some discussion a motion was made by Hoium and seconded by Tantanella to offer a youth Read Down program quarterly. (Youth aged seventeen and under, may earn $1 off accrued fines,bills or library card replacement fees for every 15.minutes of reading done in the library. Motion carried unanimously. 1- 10/3/13 13 3. The Proposed Closed Days/Holiday Schedule for 2014 was reviewed. Dougherty said it basically mirrors ACL schedule. Hoium moved approval of the 2014 Closed/Holiday schedule by Hoium with a second from Tantanella. Motion carried unanimously. 4. Dougherty passed out the 2014 Proposed Detail Budget that she will be presenting to the Council on October 7. Department Heads were instructed to stay under 2% increase and Dougherty stated that library budget includes only a 7/10 of I%increase. Included in the budget under capital outlay is a new microfilm reader. 5. Dougherty discussed the proposal to reduce the maximum overdue fines for magazine from $7.00 to$2.00. Current policy is a maximum overdue fine of$7.00 but if the magazine is lost the fine is $6.00. ACL lowered their maximum fine to $2.00 and Smith made a motion to change ours as well with a second from Tantanella. Motion carried unanimously. 6. Dougherty reported author Chris Niskanen had 12 people for his program on his book The Minnesota Book of Skills, and that it was very entertaining. Children's programs for October include READ Dogs beginning October 7, Science of Toys October 17 and Radical Robots October 18. At least 119 Columbia Heights residents received a new library card and 25 people used the coupon for a free item from our book sale cart. 2. Dougherty reported Library Aide Candice Marsh has turned in her resignation and that she will advertise the position to the current pages and Library Clerk Ramon Gomez has interviewed for a position at the Columbia Heights Police Department. 3. Dougherty reported that she will be attending the Minnesota Library Association conference held in St. Cloud along with Adult Services Specialist Barb Kondrick on October 10 and 11. This year there will be more mini-conferences regarding services to seniors, whereas last year they had a lot for children services. OLD BUSINESS A. Tour of redeveloped parks B. Tour of City parks for future redevelopment Hansen and Windschitl conducted the tour of several city parks. Huset Park West. Hansen indicated bids were taken for the compliance repairs to the wading pools. The bids to repair one pool at a time were very high,around$75,000 per pool. The next step is to receive bids to repair two pools in the same year and see if the cost is lower. Hansen asked if there would be interest among the members to have one splash pad in the park system in lieu of wading pools. Stroik replied yes the St. Anthony splash pad is very nice,highly used and has the benefit of being accessible by all. She asked if the garage behind John P. Murzyn Hall could be tore down for the use of that space. Hansen and Windschitl replied that the garage is used for multiple storage needs in both departments. Stroik asked about using fencing instead of the building. Peterson indicated that is not the safest option and makes it hard to hide what is in the area. Peterson reminded the members that the Fights in Heights event will be held at Murzyn Hall on September 15 beginning at 5:00 p.m. McKenna Park. The members commented that the new playground looks good. Hansen displayed the McKenna Park master plan. The parking lot will be installed next year. The plan also shows two small fields with walking trails to the fields and playground. Greenhalgh asked 15 Park&Recreation Commission August 28,2013 Page 2 how often the hockey rink is used. Windschitl replied that a resident uses the rink every weekend for a group to play volleyball. The neighbors around McKenna Park like having the group use the park and have called to voice their approval and ask for the lights to be put on for them in the fall. He stated the two ball fields are well utilized by the recreation programs such as T-Ball, Squirts Baseball,Traveling Baseball,Girls Softball, and Youth Soccer. A Twins Grant was received for the fencing behind the home plate at both ball fields. Windschitl stated the park building has extensive use for two summer youth programs and is also occasionally rented for private functions. Sullivan Lake Park. Hansen reported staff has done a lot of work to clean out a view of the lake from the shelter. There are DNR restrictions on the amount of plant material that can be removed around the edge of the lake. Members commented it looks very nice. Hansen indicated the current trail is four and a half to five feet wide and splits into two paths for bikes and pedestrians but is not the proper width around the whole lake. In the next few month staff will pull out the split trail and install one ten foot wide trail in the area near 53rd Avenue. Eventually the trail will be 10 feet wide around the entire lake with a few areas at nine feet wide due to conditions in certain areas. Hansen stated a ten foot wide trail is the standard for a combined use trail with pedestrians and bicycles. Hansen reported continued problems with the ballasts for the light poles within the park. The light bulbs are able to be replaced but the fixture is not. Due to the original installation of the light poles a lot of breaks occur with the aluminum. Hansen indicated no electrical work is done in-house. Residents of the Sullivan Shores townhomes continue to request removal of plant growth to view the lake from the townhomes. Hansen stated the removal of cattails is only allowed by the DNR if the plants are restricting water flow. Keyes Park. Hansen reported that Steve Oslund the coordinator for the national hockey day held here this past winter is interested in doing another hockey day in heights. Hansen reported the hockey rink surface needs improvement. During the previous hockey day the thickness was very uneven for the ice to form properly. Staff recommends removal of the pavement inside the rink to even out the surface to achieve better ice,and to repaint the boards. Community Garden Plots. Windschitl pointed out the community garden plots to the Commission. He indicated there are 48 plots, 10 feet by 15 feet,reserved at a fee of$26.78 for the season. Evans asked if the water is supplied by the City. Windschitl replied yes,the cost is covered in part by the reservation fee. Silver Lake Park. Hansen stated this is a small park and that the improvements over the last few years turned out really well. There are no future plans for changes at this park. The usage of this park has increased since the installation of the shelter. Hansen reported the public boat landing on Silver Lake is in the budget for 2014 for improvements. Payne asked if the building is open for use at the park. Hansen replied no. The building needs a lot of work especially with plumbing to be used by the public. The exterior of the building is in decent condition so it is currently used for storage of park department equipment. Ramsdell Park. Stroik indicated the outfield of the ball field is a disaster and had heard comments on the condition. Hansen replied the field is in poor condition right now,weeding was done in the field,the irrigation system is not correct so parts of the field are oversaturated and other areas are dry. Windschitl reported girls' softball is played on this field during the spring and summer. A fall softball team will not play on this field due to the condition of the outfield. They are using Huset 3 for the fall league. 16 Park&Recreation Commission August 28,2013 Page 3 LaBelle Park. The Commission viewed the installation progress of the new playground. Hansen reported the location of the playground was moved from the master park plan in order to keep as many existing trees as possible and keep the playground further away from the LaBelle residences. Hansen indicated the estimated amount to remove the boardwalk is $135,000. He stated there are six inlets to LaBelle Pond and one outlet flow of water directly to Jackson Pond behind Rainbow Foods,which then eventually flows into the Mississippi River. Windschitl reported the police department ran a search for LaBelle Park calls with complaints or contacts related to the basketball court. The report indicated only two complaints were received in 2011 dateing back to 2005. Based on that report the conditions do not warrant removal of the basketball hoops/posts. A memo regarding the findings and decision of the Commission was sent to resident David Hase in response to the prior request he made to take down the hoops or posts. A father and young daughter were riding bicycles through the park while the Commission was gathered and thanked the members for building the playground and improving the park. NEW BUSINESS Windschitl informed the Commission of a recent request for a Community Carnival Special Event. The event would be hosted by the Urban Youth and Children Education Center(UYCEC) in conjunction with East Africa Family and Youth Development(EAFYD) along with other sponsors. The request is to use Huset Park East and West,closing off Jefferson Street for the carnival similar to the Jamboree setup. The request is to hold the event on Monday,October 14 from 1:00 p.m.— 11:00 p.m. and Tuesday,October 15 from 1:00 p.m.— 12:00 midnight. The event would obtain all required permits. This carnival would be free and open to the public. Commission members commented that the park closes at 11:00 p.m.,the neighbors need to be considered as they already take on any inconveniences during the Jamboree Carnival,the request is on two week night evenings,the cost of having police offers would be expensive as one officer's rate is $99 per hour,the cost of electricity should be covered by the group,and a concern with allowing other carnivals that might take away from the Jamboree celebration. Hansen voiced a concern with the short time frame for this request. This wagon consists of a trailer loaded with many accessories, such as tables, chairs, and recreational equipment such as balls and other play equipment. The trailer is used by Columbia Heights businesses and residents to assist them with family gatherings, special events, or community block parties where people can get to know their neighbors better. Staff delivers the trailer to the address for use and then picks it up after the event is over. The Columbia Heights Park and Recreation Commission unanimously approved a rental increase for the event wagon at their meeting on October 23, 2013. The Park and Recreation Commission feels that we need to cover increased gas costs, maintenance, administrative costs and equipment replacement costs resulting from the event wagon use. Currently, we are charging $25.00 plus tax to use the event wagon. This fee was established in 2009 and has not been increased. The new fee would become effective as of January 1, 2014. Attached is the event wagon policy. The Neighborhood Event Wagon is a trailer with tables, chairs, and a wide variety of recreational equipment (i.e., bats, balls, games, etc.) that can be used to assist a community/resident group with a gathering at their Columbia Heights home, park, or business. Reservation Procedure 1. Submit completed application form to the Columbia Heights Recreation Department. A reservation fee plus tax is due at the time of the reservation. A $200 refundable damage deposit check is also required. 2. Application requests must be made at least 5 working days prior to requested date. 3. All events must be located within the City of Columbia Heights. 4. The Event Wagon is available for use between May l and September 30, limited to one use per summer unless Event Wagon becomes available within four days of the requested date. 5. Reservations can be made over the phone by making payment with a Visa, Discover or Master Card. 6. The grantee of use permit shall be liable for any loss or damage to the Event Wagon and its contents. 7. The grantee of the Event Wagon will be responsible to insure that the orange safety cones are placed behind the trailer when located on a city street. 8. The grantee of use permit shall not transfer or relinquish said permit to another person or group without written permission of the Recreation Director. 9. Only the City of Columbia Heights staff can transport the Event Wagon. The Event Wagon cannot be relocated after it has been delivered by city staff. 10. If the grantee wishes to use the Event Wagon in a park, a Park Permit must be issued by the Recreation Dept. If it is necessary to block off a section of the street, a Block Party permit must be issued to grantee by the Police Department. The City of Columbia Heights shall have the authority to revoke a permit upon evidence of violation of city ordinance or permit. 11. All paper and other party debris must be disposed of properly at the conclusion of the event. 12. The trailer must be picked up in the condition it was left upon delivery. 13. Whereas, the license holder is the legal owner of the real property located at 1200-02 Circle Terrace Boulevard N.E., Columbia Heights, Minnesota. Whereas, pursuant to City Code, Chapter 5A, Article IV, Section 5A.408(B), written notice setting forth the causes and reasons for the proposed Council action contained herein was given to the License Holder on November 6, 2013 of a public hearing to be held on November 25, 2013. Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of Columbia Heights, the City Council of the City of Columbia Heights makes the following: FINDINGS OF FACT 1. That on September 26, 2013 inspectors for the City of Columbia Heights, inspected the property described above and noted violations. A compliance letter listing the violations was mailed by regular mail to the owner at the address listed on the Rental Housing License Application. 2. That on October 29, 2013 inspectors for the City of Columbia Heights performed a reinspection and noted that violations remained uncorrected. A statement of cause was mailed via regular mail to the owner at the address listed on the rental housing license application. 3. That on November 12, 2013 inspectors for the City of Columbia Heights checked records for this property and noted that the violations remained uncorrected 4. That based upon said records of the Enforcement Office, the following conditions and violations of the City's Property Maintenance Code were found to exist, to- wit: a. Shall install a smoke detector on main floor. b. Shall repair/replace cracked glass in bedroom. c. Shall repair/replace landscape edging that is falling out. d. Shall repair/replace wood pillars in front that are rotting. e. Shall repair large trench on north side of property. 5.
