HomeMy WebLinkAboutContract 2012 2470 Anoka County Contract No. 2011 AMENDMENT NO. 1 TO AGREEMENT FOR RESIDENTIAL RECYCLING PROGRAM THIS /\K8ENC)K8ENT is made this 2012. the date of the signature of the p3[USS notwithstanding, by and between the CoUOh/ Of AoVh@, a political ' subdivision of the State of MiDOesOt8, 2100 Third AvenU9, Anoka, K8iOO880t8 55803, hereinafter referred to as the "County," and City of C[>LUK8B(/\ HEIGHTS, hereinafter referred to as the "Municipality." WITNESGETH: WHEREAS, the County wishes to 8[D8Dd its Agreement with the Municipality for SCORE funds dated February 17, 2012; and WHEREAS, the County anticipates receiving an additional $407.827.00 in SCORE funds; and WHEREAS, Paragraph 10. GENERAL PROVISIONS of said Agreement provides that any amendments, @|t8ratiOOS' variations, modifications, Or VV8\Vers of this Agreement shall be valid only when they have been [8dUCRd in writing, duly signed by the parties. NOW, THEREFORE, in consideration of the ORutUG| covenants heF8iD@ft8[ stated or contained in the Agreement, the parties do hereby agree as fO||OvVG: i. The parties agree to change Paragraph 4. PROGRAM, as follows: The Municipality shall develop and implement 8 rBSideOU8| solid waste recycling p[Og[3Dl adSqUG[8 to meet the Municipality's annual recycling gOg| Of 1.755 tUOS Of recyclable nl3Leha|s as established by the County. The Municipality 5h8|| ensure that the recyclable [n8teri8|S CO||eCt9d are delivered to p[DCeSs0[S or end markets for recycling. 8. The Municipal recycling program Sh8|| include the following CODnpon8Ota: i. Each household (including multi-unit hOUS8h0|dn) in the Municipality Shg|| have the opportunity to recycle at |88Gt four broad types of OQ8te[i8lS. such as paper, glass,,plastic, DlBt@| and textiles. ii. The recycling program Sh@|| be operated in COnnp|i8DCe with all applicable federal, state, and |Oc8| |8VVS` ordinances, [U|eG and [8gUi@tiOOG. iii. The K8UOiC|p8|itV shall implement 3 public iDf000@tinO program that cODi8iOS at least the following CODlpDORntS: ` ^ (1) One prV[nOU0n is h3 be rOeUed to each household focused exclusively VD the Municipality's recycling program; (2) One promotion advertising recycling opportunities available for residents is to be included in the Municipality's nCVva|eUBr or |0Cg| newspaper; and (3) Two connDlUOitV presentations are to be given OO recycling. The public information oODlpon8Dto listed above must promote the focused [eCyC|@b|e material of the year as specified by the County. The County will provide the Municipality with background rnator|@| on the focused recyclable material of the year. iv. The Municipality, OO an Ongoing besiS, shall identify new residents and provide detailed information on the recycling opportunities available to these new residents. b. If the Municipality's [8CydiOg program did not achieve the Municipality's recycling goals as established by the County for the prior calendar year, the Municipality shall prepare and submit to the County by March 31' 2012. a plan acceptable to County that i8 designed to achieve the recycling goals set forth in this /\gn8eFneOt. C. The Municipality Sh8|| conduct Phase 2 of Recycling Center enhancements including: 1\ purchased used oil vat for recycling center; and 2\ construct/pave drive-thru path with exit. 2. The parties agree 10 oham0m Paragraph 7. ELIGIBILITY FOR FUNDS, as follows: The Municipality is entitled to receive reimbursement for eligible 8XpeOS8S, |eSS revenues or other reinnbU[Sern0Dt received, for eligible activities Up t0 the project nOaXiO0Unn as computed below, which Sh8|| not exceed $49.830.00. The project maximum for eligible expenses shall be computed aafollows: 3. /\ base amount of$1O.UOO.00 for recycling activities only; and b� 85.O5 per household for recycling activities only. Notwithstanding any provision to the contrary, the County reserves the right to reduce the funding provided hereunder iOthe event insufficient SCORE funds are available. If the SCORE payment of $407,827.00 is not received or is rCdVoed, the County may reduce the project nnGXi[nu0GnlDUOtpayobietOth8MVDidp@|ity. The County will promptly notify the Municipality in the event that the project maximum will bereduced. 2 The Municipality is entitled to receive additional reimbursement for eligible expenses, less revenues or other reimbursement received, for eligible activities as described in paragraph 4.c. up to the project maximum for additional funds, which shall not exceed $50,000.00, not including the Municipality match of $0.00 for a total project award of$50,000.00. Notwithstanding any provision to the contrary, the County reserves the right to reduce the funding provided hereunder in the event insufficient additional funds are available. If the additional payment of $245,557.94 is not received or is reduced, the County may reduce the project maximum amount payable to the Municipality. The County will promptly notify the Municipality in the event that the project maximum will be reduced. 3. This Amendment is hereby made a part of and shall be amended to the Agreement of the parties. 4. All other terms and conditions of the original Agreement shall remain in full force and effect.
