Public Accuracy Test
The Public Accuracy Test for the November 6, 2012 General Election will be run on Thursday,

in the Election area, to ascertain that the equipment will correctly count the votes cast for all
offices.

DECLARING OCTOBER 25, 2012
AS "EARL E. BAKKEN DAY"IN COLUMBIA HEIGHTS
WHEREAS: Earl E. Bakken is a 1942 graduate of Columbia Heights High School, and;
WHEREAS: he went on to co-found Medtronic with the late Palmer Hermundslie in
1949 and invented the wearable cardiac pacemaker in 1957, and;
WHEREAS: he was CEO and board chairman of Medtronic until 1976 and senior
chairman through 1989, and retired in 1994. He also established the Bakken Museum in
Minneapolis. This was one of his prize inventions, and;
WHEREAS: in June of 2012 he was chosen as the school district's 2012 Alumnus of
distinction and;
WHEREAS: in August 2012 he was honored by his alma mater and received the 5a'
Annual Alumni of Distinction Award, and;
WHEREAS: our community is very proud of his accomplishments and he will be
honored with a dinner and program on Thursday, October 25, 2012 at Jax Cafd in
Minneapolis, and;
WHEREAS: all proceeds from the program will benefit the CHHS Alumni Scholarship
Foundation;

Motion by Nawrocki to add council corner to the agenda. Peterson called for a second, Motion
died for lack of a second.
4. PROCLAMATIONS,PRESENTATIONS, RECOGNITION.ANNOUNCEMENTS, GUESTS
A. Introduce new Accounting Clerk I, Emily Carr
Joseph Kloiber,Finance Director introduced Emily Can-to the council. Carr stated that she is
excited to be here and looks forward to working with everyone.
B. Proclamation of Polish American Heritage Month
Peterson stated this year marks the 31 st Anniversary of the founding of Polish American Heritage
Month, an event which began in Philadelphia and became a national celebration of Polish
history, culture and pride. The sister city actively sponsors various humanitarian, educational,
civic and social events. On February 18a', Strand was presented with a Certification of
Appreciation from the Polish American Cultural Institute of Minnesota. This is the first time a
non-Pole has received this special recognitions.

Peterson stated this year also marks the passing of a prominent Columbia Heights resident and
Sister Cities' member, Walter Logacz. A"Celebration of Live"was held on September 30, 2012
and attended by hundreds of his friends, family and colleagues. The Logacz family has
generously donated the memorial gifts received to the Sister City Organization.
Peterson presented the Proclamation of Polish American Heritage Month to Edward Sikorski,
Dolores Strand, Patricia Sowada, Marion Bernard and Karen Karkula.
Strand informed everyone about their upcoming Polish and Italian Dinner fundraiser that is
happening on Sunday, October 21, 2012 at Murzyn Hall. Music by St Mary's Balalaika
Ensemble will be provided along with a silent auction, International Bazaar, Vintage Boutique,
Holiday Treasure shop and a book store.
Strand also stated the Phyllis Husted and John Bieniek were not able to be present to accept the
award as they were at Polish classes, but did want to mention that they represented our Sister
Cities at Lomianki's traditional commemorative ceremony on September 22, 2012, to honor the
memory of the American Flyers of the"Frantic 7" U.S. Air Force Mission. Upon the opening of
the ceremony the Mayor of Lomianki asked for a moment of silence to respect the memory of
Walter Logacz.
Peterson stated that Logacz was a council member here for fourteen years and will be missed.
C. Proclamation of Homelessness Awareness Month
Peterson stated the Anoka County Community Continuum of Care, along with the Heading
Home committee, is sponsoring a unique, countywide education and awareness campaign to help
end homelessness in our shared communities. The Shoe and Winter Boot Collection, "Creating
a Path to End Homelessness"provides a unique opportunity for local, creative individuals to
join forces with communities across Anoka County in an effort to promote awareness of
homelessness and to help end homelessness. It is essential that all citizens of Columbia Heights
be aware of the importance of preventing and ending homelessness and the impact their
participation can have on ensuring that all individuals and families have access to a warm, safe
place to call home in our community.
Peterson proclaimed the month of November to be Homelessness Awareness Month.
Diehm provided updates from SAGA. The Real Legends Rock Fundraiser that was held on
September 14, 2012 raised $8300.00. There was a great turnout. Diehm also stated there is
Christmas basket fund raiser planned on October 26, 2012 by the Knights of Columbus. This
will be held at St Williams Catholic Church with a social hour starting at 6:00 PM, dinner at 6:30
PM. Silent auction, music and dancing following. Reservations are required and can be made
by calling SACA at 763-789-2444.
Diellm informed the council and residents of Columbia Heights that SACA puts out a newsletter
and in their recent issue it recognizes two local volunteers for all there help and support. The
first volunteer recognized was Marge Sandback, who has been a volunteer for 31 years, and
second volunteer recognized was Gary Boyer, who works in the food room and helps deliver
food donations.

Peterson stated last Wednesday he had the honor of presenting the Spurgeon award to our Fire
Captain Dan O'Brien who received this award from the North Star Council of Boy Scouts.
O-Brien is recognized for his work in training all of our police and fire explorers here and around
the state. Peterson stated there are only four people who get this award per year and he is very
proud of O'Brien for all of his service.

MOTION: Move to direct the City Manager to forward a letter to the State Charitable Gambling
Control Board indicating that the City of Columbia Heights has no objection to a gambling
permit for Immaculate Conception Church to conduct bingo at their event being held November
17, 2012 at 4030 Jackson Street NE, Columbia Heights; and furthermore, that the City of
Columbia Heights hereby waives the remainder of the thirty-day notice to the local governing
body.
F. Approve Business License Applications
MOTION: Move to approve the items as listed on the business license agenda for October 8,
2012 as presented.
G. Payment of bills
MOTION: Move that in accordance with Minnesota Statute 412.271, subd. 8 the City Council
has received the list of claims paid covering check numbers 145203 through 145383 in the
amount of$647,375.23.
Nawrocki asked to remove items A, B and D of the consent agenda.
Motion by Nawrocki, seconded by Diehm, to approve the consent agenda items with the
exception of items A, B and D.

Nawrocki stated in accordance to the Charter,the minutes and resolutions should be signed by
the Council Secretary as opposed to the City Clerk.
Motion by Nawrocki, seconded by Diehm, to move to approve the minutes of the September 24,
2012 City Council Meeting and the minutes of the Special Assessment Hearing of October 1,
2012,with the amendment of the minutes being signed by the Council Secretary.
Upon Vote: All Ayes, motion carried
Item D (removed from consent) Discussion on Approve Assignment of Management
Agreement for NE Business Center.
Nawrocki asked for more explanation as to the agreement and what it is for.
City Attorney Jim Hoeft explained the current management agreement is with the owners of the
40a'Avenue and Central Office Building. They are in the process of refinancing and the new
lender requested if the City allows the owners to sign documents with management's rights,the
lender then requires the City have this agreement in writing. This is to indicate if the lender
takes over the property they would have the same existing management rights.
Nawrocki asked what our existing financial interest is in the property.
Hoeft stated he did not believe the city had any financial interest in the property.
Nawrocki stated if we do not have any financial interest in it,why we are concerned with this.
Hoeft stated the city still has a management agreement to cover the parking ramp and the plaza
property. This is to cover all the management/maintenance issues with the ramp.
Motion by Diehm, seconded by Schmitt, to move to approve the Collateral Assignment of
Management Agreement for the Parking Facility and Lease of the Plaza Property and Option to
Purchase Parking Property and authorize the City Manager to Sign the Same.
Upon vote: All Ayes, motion carried.
6. PUBLIC HEARINGS
A. Adopt Resolution 2012-130 being Resolution for the Approval of a 30-inch height variance for a
fence in the front vard at 3919 Reservoir Blvd.
Jeff Sargent, City Planner stated the applicants are looking for a variance for a six foot fence in
their front yard. They would like to increase the current allowable height restriction for a
screening fence of 42"to 72"in the front yard. The property sits far back on the lot and
currently they do not have a backyard and are looking for some privacy. The Planning and
Zoning Commission voted five to zero to approve the variance.
Nawrocki asked if any of the neighbors have complained or called on the fence.
Sargent stated that one resident did call, but their concern was that the entire yard was going to

be fenced in. Sargent indicated that the homeowners had previously constructed the fence and
then came in to get the variance, so what is currently there, is all that will be approved with this
variance.
Peterson asked if anyone was present to represent the property. Being no one present,
Motion by Diehm, seconded by Nawrocki, move to waive the reading of Resolution 2012-130,
there being ample copies available to the public.
Upon Vote,All Ayes,motion carried
Motion by Diehm, seconded by Schmitt, move to adopt Resolution No. 2012-130, approving the
30-inch height variance for a fence in the front yard at 3919 Reservoir Boulevard NE, subject to
the conditions outlined in Resolution No. 2012-130.

Nawrocki asked that it be noted that the resolution is to be signed by the council secretary.

Nawrocki commented he would like to have the city clerk update the council and residents on
absentee voting.
Leonhardt stated that in person absentee voting is available at City Hall Monday through Friday
between 8:00 AM and 4:45 PM and on Saturday, November 3, 2012 from 10:00 AM to 3:00 PM.
Nawrocki stated the County has been levying about$115,000 per year as a special levy for about
five years. It is supposed to be for development and the county retains 15% of that$115,000.
Nawrocki moved that the county not levy that special levy again.
Peterson asked if there was a time line in place.
Magee stated that she believes Nawrocki is referring to response from council questions that he
had before and the Community Development Director indicated this is going to the November
EDA meeting.
Diehm stated she believed it was in front of the EDA and the council opted to table this until we
received more information from the community development director about the timing and our
options.
Peterson stated we should wait until we get the information we requested from the community
development director and act on it then.
Nawrocki asked when the decision has to go to the county if we decide not to continue with this

levying.
Magee stated she believes that it is sometime in November, as the community development
director previously indicated.
Nawrocki stated this is something that should be eliminated and we should try and raise this
money in an open meeting and done as part of the tax levy.
Nawrocki stated he reads the minutes and agendas of the different committees and the committee
that is looking at building a new city hall and library was looking at forming a connection with
people who are in support of the new library and city hall. He stated they should be looking at
the pros and cons of the cost of bonding and looking at the operating costs of the new buildings.
This should then go out to all residents in the community and go to a vote of the people before
the council takes any action.
8. ADMINISTRATIVE REPORTS

Nawrocki indicated he received a notice from Ruth Dunn about articles for the newsletter needed
to be submitted to her by September 28a' Nawrocki stated he has not seen any information on
what anyone is proposing to submit and thinks this should be reviewed by the council before it
published.
Magee stated the city has not received a draft from Dunn to date. Once Ruth receives the
information from the city, she puts together a draft and each council and staff member receives a
copy for approval prior to publishing it.

Peterson concluded the meeting with asking that we do not forget our service men and women
and keep them in our thoughts and prayers. Don't take ourselves too seriously and do a random
act of kindness.

WHEREAS: The City of Columbia Heights offices are closed on Monday,November
12, 2012 in observance of Veterans Day, and;
WHEREAS: The City Council has agreed to reschedule the regular Council meeting to
Tuesday,November 13,2012 beginning at 7:00 PM in the City Council Chambers;

PLAYGROUND EQUIPMENT REPLACEMENT
AT LA BELLE PARK
Staff was again notified of a grant program through a playground equipment manufacturer for a 47/53 cost-
share grant for new playground equipment. The grants are on a first-come first-serve basis and equipment
must be ordered by November 15, 2012. The grant program is relatively new and is not available every
year. The intent of the program is to fight childhood obesity through playground activities.
Staff applied for the grant for LaBelle Park following the Master Plan as recommended to the City Council
by the Park and Recreation Commission.
The grant recipient pays for tax and shipping.
Recommended Motion: Move to accept the grant for LaBelle Park in the amount of $21,152.80,
appropriating matching funds of $23,975.20 from the Park Development Fund 412, and furthermore
authorize the Mayor and City Manager to enter into an agreement for the same.

Dear Kevin,
We are pleased to inform you that GameTime has approved a grant in the amount of$21,152.00
for your playground project (#85306 & 11644) structure) and the enrichment of your community.
The funds must be utilized right away to qualify. Projects must ship prior to December 31St, 2012,
in accordance with the terms of the grant. Grant funds may only be applied to GameTime discrete
structures and must be pre-paid for a full matching grant. The grant is subject to terms and

Background:
To comply with Minnesota State Statutes involving an assessed improvement project, a resolution
must be passed by the City Council calling for a report on the necessity, cost effectiveness, and
feasibility of the proposed improvement.
Analysis/Conclusions:
The attached resolution calls for the City Engineer to prepare the required report for the Zone 7
Street Seal Coat Program. Zone 7 seal coat streets include local streets between California Street
and Central Avenue from 37a'to 40a'Avenues and Main Street to University Avenue from 40t"to
45a' Avenues. In accordance with City policy, streets rehabilitated as part of the 2004-2006
programs will not be assessed for seal coat.
A public improvement hearing will need to be held for Zone 7 following completion and acceptance
of the feasibility report. The bidding process will be administered by the City of Coon Rapids as
part of a multi-City JPA for various street maintenance activities.
Recommended Motion: Move to waive the reading of Resolution 2012-134, there being ample
copies available for the public.

WHEREAS, the City Council of Columbia Heights is proposing to rehabilitate local streets in

WHEREAS, the City Council intends to assess the benefitted property for all or a portion of the

RESOLUTION NO. 2012-136
ESTABLISH LIMITED CLEAN UP AND PROPERTY DAMAGE PROTECTION
FOR SEWER BACK-UPS AND WATER MAIN BREAKS FOR WATER AND
SEWER CUSTOMERS OF THE CITY OF COLUMBIA HEIGHTS
WHEREAS,the City of Columbia Heights provides water and sanitary sewer services to
property within its jurisdiction; and
WHEREAS, water main breaks may cause water to enter into property causing damage, and
WHEREAS,blockages or other conditions in the City of Columbia Heights' sanitary sewer lines
may cause the back-up of sewage into properties that are connected to the City of Columbia
Heights' sanitary lines; and
WHEREAS, water main breaks and sewer back-ups pose a public health and safety concern; and
WHEREAS, it is often difficult to determine the exact cause and responsibility for water main
breaks and sanitary sewer back-ups; and
WHEREAS, the City Council of the City of Columbia Heights desires to encourage the
expeditious clean-up of properties that have encountered damage from water main breaks and
sewer back-ups; and
WHEREAS, the City Council of the City of Columbia Heights desires to minimize the potential
of expensive lawsuits arising out of water main breaks and sanitary sewer back-up claims; and
WHEREAS,the City of Columbia Heights is a member of the League of Minnesota Cities
Insurance Trust(LMCIT); and
WHEREAS, LMCIT has offered the City of Columbia Heights limited"no fault" sewer coverage
and water main break coverage that will reimburse users of the water and sewer system for
certain clean-up costs and property damage regardless of whether the City of Columbia Heights
is at fault.
NOW THEREFORE, BE IT RESOLVED, as follows:
The City of Columbia Heights, as part of the contract for providing water and sewer services to
the customers of the City of Columbia Heights, and in consideration of the payment of water and
sewer bills, agrees to reimburse water and sanitary sewer customers for up to$10,000 of clean-
up costs and property damages caused by a water main break or sanitary sewer back-up,
regardless of whether the City of Columbia Heights is negligent or otherwise legally liable for
damages, subject to the following conditions:
I. Sanitary Sewer Back-Ups. For Sanitary sewer back-ups:
A. The back-up must have resulted from a condition in the City of Columbia Heights'
sanitary sewer system or lines, and not from a condition in a private line.
B. The back-up must not have been caused by catastrophic weather or other events for
which Federal Emergency Management Assistance is available.

C. The back-up must not have been caused by an interruption in electric power to the City of
Columbia Heights' sewer system or to any City of Columbia Heights lift station, which
continues for more than 72 hours.
D. The back-up must not have been caused by rainfall or precipitation that would constitute
a 100-year storm as determined by the National Weather Service.
E. Neither the City of Columbia Heights nor LMCIT will reimburse any costs which have
been or are eligible to be covered under a property owner's own homeowners' or other
property insurance, or which would be eligible to be reimbursed under a National Flood
Insurance Protection(NFIP)policy,whether or not the property owner actually has NFIP
Coverage.
F. The maximum amount that the City of Columbia Heights or LMCIT will reimburse is
$10,000.per building, per year. In this regard, a structure or group of structures served by
a single connection to the City of Columbia Heights' sewer system is considered a single
building.
II. Water Main Breaks. For water main breaks:
A. LMCIT will pay for claims presented by the City of Columbia Heights for water main
break damage to property of others which was not caused by the City of Columbia
Heights' negligence.
B. Neither the City of Columbia Heights nor LMCIT will pay for damages or expenses for
which the property owner has been or is eligible to be reimbursed by any homeowners' or
other property insurance.
C. The maximum amount that the City of Columbia Heights or LMCIT will reimburse is
$10,000. to any claimant,regardless of the number of occurrences or the number of
properties affected.
D. Neither the City of Columbia Heights nor LMCIT will pay more than $250,000 for water
main break damages resulting from any single occurrence. All water main break damage
which occurs during any period of 72 consecutive hours is deemed to result from a single
occurrence. If the total water main break damage for all claimants in a single occurrence
exceeds $250,000, the reimbursement to each claimant will be calculated as follows:
1. A preliminary reimbursement figure is established for each claimant, equal to the
lesser of the claimant's actual damages or$10,000.
2. The sum of the preliminary reimbursement figures for all claimants will be
calculated.
3. Each claimant will be paid a percentage of his or her preliminary reimbursement
figure, equal to the percentage calculated by dividing$250,000 by the sum of all
claimants' preliminary reimbursement figures.
IN WITNESS WHEREOF, the City of Columbia Heights,by action of its City Council, caused
this Resolution to be approved on October 22, 2012.

pursuant to City Code,Chapter 5A,Article IV,Section 5A.408(A)of that certain residential
rental license held by Chris Cornelius (Hereinafter"License Holder").
Whereas, license holder is the legal owner of the real property located at 1407-09 Circle
Terrace Blvd. NE., Columbia Heights, Minnesota,
Whereas,pursuant to City Code,Chapter 5A,Article IV,Section 5A.40"),written notice
setting forth the causes and reasons for the proposed Council action contained herein was
given to the License Holder on September 26, 2012 of an public hearing to be held on
October 22,2012.
Now,therefore, in accordance with the foregoing, and all ordinances and regulations of the
City of Columbia Heights, the City Council of the City of Columbia Heights makes the
following:
FINDINGS OF FACT
1. That on August 17,2012 inspectors for the City of Columbia Heights,inspected the
property described above and noted violations. A compliance letter listing the
violations was mailed by regular mail to the owner at the address listed on the Rental
Housing License Application.
2. That on September 26,2012 inspectors for the City of Columbia Heights performed a
reinspection and noted that violations remained uncorrected. . A statement of cause
was mailed via regular mail to the owner at the address listed on the rental housing
license application.
3. That on October 15, 2012 inspectors for the City of Columbia Heights checked
records for this property and noted that the violations remained uncorrected
4. That based upon said records of the Enforcement Office, the following conditions
and violations of the City's Property Maintenance Code were found to exist,to-wit:
a. Shall repair/replace the screen(s) on the building
5. That all parties, including the License Holder and any occupants or tenants, have
been given the appropriate notice of this hearing according to the provisions of the
City Code, Chapter 5A,Article III 5A.306 and 5A.303(A).
ORDER OF COUNCIL
1. The rental license belonging to the License Holder described herein and identified by
license number F12207 is hereby revoked.
2. The City will post for the purpose of preventing occupancy a copy of this order on
the buildings covered by the license held by License Holder.

setting forth the causes and reasons for the proposed Council action contained herein was
given to the License Holder on October 9,2012 of an public hearing to be held on October
22, 2012.

FINDINGS OF FACT
1. That on or about August 15,2012 inspection office staff sent a letter requesting the
owner of the property to renew the rental license for this property. The letter was

2. That on October 9,2012 inspection office staff reviewed the property file and noted
that the property remained unlicensed. A Statement of Cause was mailed by regular
mail to the owner at the address listed in the property records.
3. That based upon said records of the Enforcement Office, the following conditions
and violations of the City's Residential Maintenance Code were found to exist,to-
wit:

4. That all parties, including the License Holder and any occupants or tenants, have
been given the appropriate notice of this hearing according to the provisions of the
