CITY COUNCIL MEETING
MONDAY, AUGUST 22, 2011
The following are the minutes for the regular meeting of the City Council held at 7:00 p.m. on Monday,
August 22, 2011 in the City Council Chambers, City Hall, 590 40th Avenue N.E., Columbia Heights,
MN.
CALL TO ORDER/ROLL CALL /INVOCATION
Dan Thompson, Columbia Heights Assembly of God, gave the Invocation.
PLEDGE OF ALLEGIANCE - recited
ADDITIONS /DELETIONS TO MEETING AGENDA
Mayor Peterson added the fire alarm system at Murzyn Hall under Bid Considerations and removed
Resolutions 2011 -79 and 2011 -81, in that they have been brought into compliance.
Nawrocki indicated that Jerry Wegscheid, VFW Post 230, wished to give a presentation. Nawrocki
requested to add discussion of the budget and request to obtain bid specifications for legal and
financial services to the agenda. Fehst stated those items are scheduled for work session discussions.
Nawrocki stated that the rules allow items brought to the City Manager for placement on the agenda
are to be placed and discussed at a regular meeting. The Manager did not place this on the agenda as
requested. Our legal contract is fifteen years old and it would be in the best interest of the city to go
out for bids for both legal and financial services. Peterson stated this was discussed at the last
meeting and requested to place on a work session agenda. The Council can vote to add it to this
agenda. Fehst stated that a cost comparison of legal services is being prepared for distribution. This
may not be the best time to change our auditor, as we have a new Finance Director. Peterson
indicated that upon no other Council members requesting to pursue discussion at this meeting, it be
placed on a work session agenda.
Nawrocki questioned if the budget would be discussed tonight. Fehst stated that the budget was
distributed tonight, as required. Discussion will be held at the first Council meeting in September.
Peterson stated that as in the past, the budget would first be discussed at a work session. Nawrocki
referenced budget increase numbers, which Fehst responded to. Nawrocki stated that it is time to
decrease expenses, rather than increase property taxes. Fehst gave the history of budget decreases.
Motion by Diehm, second by Williams, to discuss obtaining bid specifications for legal and
financial services at the first work session in September. Upon vote: All ayes. Motion carried.
PROCLAMATIONS, PRESENTATIONS, RECOGNITION, ANNOUNCEMENTS, GUESTS
A. Proclamation - Patriot Day, September 16, 2011
Malcolm Watson, Fridley Post Chaplin and former Columbia Heights City Manager, indicated
the date and location of the celebration to honor our heroes that risk their lives and those that
gave their lives in the line of duty.
Nawrocki referred to the special day today for the 30 patriots killed in the helicopter in
Afghanistan and questioned our flags not being at half -mast. Peterson indicated the event today
was for one of the local soldiers and the other was recognized last week. Muscovitz, City Clerk,
indicated that flags are ordered at half -mast by the Governor on all State owned property.
Peterson commended Nawrocki for his work with the VFW.

Jerry Wegscheid, Columbia Heights VFW Post 230, indicated that on Saturday, September 10 at
10:00 a.m., Post 230 and the Tri-City American Legion will hold a joint flag disposal ceremony.
Peterson stated his appreciation for all the hard work the Post and Legion does. Nawrocki stated
that flags can be dropped off any time at Post 230 and they will be properly disposed of.
Fehst acknowledged Malcolm Watson's contribution to the profession of City Manager. He
indicated all of the positions he held. We are lucky that he is still contributing to our community.
B. Introductions
Paid -on -Call Firefighters
Fire Chief Gary Gorman introduced our two new firefighters, Brian Polski and Will Shutte. They
have completed all of their training and will now be full time paid on call fire fighters. He
presented them with their helmets. Both firefighters spoke of their background and excitement
with their new status.
Nawrocki questioned the firefighter's presence at Walgreens. Gorman stated it was a community
event they requested the Police and Fire Departments attend to promote our community and to
honor them.
Peterson indicated that on September 16 he will be on the roof of our Central Avenue liquor
store over night to raise funds for the Lee Carlson Mental Health and Well -being Center. He has
received notice that Senator Barb Goodwin will also support this fundraiser by spending the
evening on the roof.
CONSENT AGENDA
City Manager Walt Fehst took the Council members through the Consent Agenda items.
A. Approve Minutes of the August 8, 2011 City Council Meeting
Motion to approve the minutes of the August 8, 2011 City Council meeting.
B. Accept Minutes of Boards /Commissions
Motion to accept the Charter Commission minutes of the July 21, 2011, meeting.
C. Approve Business License Applications
Motion to approve the items as listed on the business license agenda for August 22, 2011 as
presented.
D. Approve Attached List of Rental Housing Applications
Motion to approve the items listed for rental housing license applications for August 22, 2011, in
that they have met the requirements of the Property Maintenance Code.
E. Review Payment of the Bills
Motion that in accordance with the MN Statute 412.271, subd. 8 the City Council has received
the list of claims paid covering check number 140019 through 140166 in the amount of
$1,060,254.44.
Motion by Nawrocki, second by Diehm, to approve the Consent Agenda items. Upon vote: All ayes.

A. Adopt Resolutions 2011 -78, 4603 Fillmore Street N.E., 2011 -79, 1000 Peters Place N.E., 2011-
80, 5009 4th Street N.E., 2011 -81, 4514 -16 Fillmore Street NE, and 2011 -90, 4233 -35
University Avenue NE being Resolutions of the City Council of the City of Columbia Heights
approving rental license revocation for failure to meet the requirements of the Property
Maintenance Codes.
Fire Chief Gorman requested rental license revocation for 4603 Fillmore Street N.E., 5009 4th
Street N.E., and 4233 -35 University Avenue NE, as they have failed to submit an application,
schedule an inspection, and pay the required fees.
Motion by Diehm, second by Nawrocki, to close the public hearing and to waive the reading of
Resolution Numbers 2011 -78, 80, and 90 being ample copies available to the public. Upon vote:
All ayes. Motion carried.
Motion by Diehm, second by Nawrocki, to adopt Resolution Numbers 2011 -78, 80, and 90
being Resolutions of the City Council of the City of Columbia Heights approving revocation
pursuant to City Code, Chapter 5A, Article IV, Section 5A.408(A) of the rental licenses listed.
Upon vote: All ayes. Motion carried.
B. Adopt Resolutions 2011 -82, 5117 4th Street N.E., 2011 -83, 4643 6th Street N.E., 2011 -84, 4345
5th Street NE, 2011 -85, 4510 Taylor Street NE, 2011 -86, 5000 7th Street NE, 2011 -87, 1131
40th Avenue NE, 2011 -88, 4107 5th Street NE, and 2011 -89, 5000 Johnson Street NE being
declarations of nuisance and abatement of violations within the City of Columbia Heights.
Gorman listed abatement requests for: 5117 4 Street N.E., remove dead trees and stumps; 4643
6 Street N.E., sod or seed in bare areas; 4345 5th Street NE, install address numbers; 4510
Taylor Street NE, repair window frames, screen door, peak, non - conforming fence; 5000 7
Street NE, sod or seed in bare areas; 1131 40 Avenue NE, repair deteriorated shed; 4107 5
Street NE, repair damaged garage door; and 5000 Johnson Street NE, repair privacy fence.
Motion by Williams, second by Schmitt, to close the public hearing and to waive the reading of
Resolution Numbers 2011 -82, 83, 84, 85, 86, 87, 88, and 89 there being ample copies available
to the public. Upon vote: All ayes. Motion carried.
Motion by Williams, second by Schmitt, to adopt Resolution Numbers 2011 -82, 83, 84, 85, 86,
87, 88, and 89 being resolutions of the City Council of the City of Columbia Heights declaring
the properties listed a nuisance and approving the abatement of violations from the properties
pursuant to City Code section 8.206. Upon vote: All ayes. Motion carried.
ITEMS FOR CONSIDERATION

B. Bid Considerations
1. Fire Alain system bid request for Murzyn Hall
Fehst stated this request is a non- budgeted item to go out for fire alarm panel bids. For the
past month or so, Murzyn Hall has had numerous false fire alarms. The repair company has
indicated that the panel is a 1977 model that is past its performance life. Keith Windschitl,
Recreation Director, indicated that the false alarms have interrupted events such as wedding
receptions. It also shuts down the air conditioning unit. The repair service has been out three
times, but only billed us once. They state that the panel has exceeded its life expectancy. A
new system would give more information than the current system. Gorman explained the
new efficient systems. The current panel continues to jump into alarm mode. It is important

to have a working system for this building because this building could have up to 700
occupants at one time.
Peterson questioned how fast this can be updated and fixed. Windschitl stated the alarm is
currently disabled. Gorman stated that Fire Net is working on a quote for us, and three other
companies are coming out to look at this and bid. They may have to order parts and it may
take a month or more. Gorman stated we are looking to override the alarm, yet allow
operation of the sprinkler system.
Motion by Nawrocki, second by Diehm, that upon three responsive quotes for replacement
of the Murzyn Hall alarm system, with an acceptable bid less than $15,000, this replacement
go forward. Upon vote: All ayes. Motion carried.
Nawrocki questioned if the funds could be found in the current budget. Windschitl stated
there are funds available in the current budget, as we have not hired a replacement Head
Custodian at this time. Fehst also commented on the costs incurred for the Fire Department
false alaun responses.

ADMINISTRATIVE REPORTS
Report of the City Manager
Fehst indicated that the League of Minnesota Cities will prepare a joint survey to comply with the
Performance Measures. However, they have made clear, for the first year, they will have ten
prepared questions. We could have survey questions on our new web site. Fehst stated that Council
meetings can now be viewed on our web site as a live feed.
Nawrocki again spoke on the budget and the need to cut back costs. Nawrocki requested an update
on the tree concern at 4415 Main Street. Nawrocki questioned when the Council would meet to
review the City Manager's performance. Peterson indicated he was waiting to receive member's
review forms.
Report of the City Attorney — nothing to report
CITIZENS FORUM
Roger Strom, 690 47 Avenue, questioned the street seal coating being done in his area. Property
owners were not notified. Peterson stated that the first seal coat after street reconstruction is not
charged to the resident.
Diehm stated that SACA will hold their 5` vintage sale fund raiser on Saturday, September 10.
Schmitt indicated that The Lighthouse of Columbia Heights will host a pancake breakfast with
profits going to the Police Association Adopt a Family Program. Funds will assist up to four families
purchase of holiday gifts. The Library also was the recipient of such an event. Fehst stated that they
have been excellent corporate citizens. Fehst indicated that parking will be available on the east side
for such events.
Diehm showed the Council meeting streaming live on her computer. Peterson wished Council
member Nawrocki a happy 80` birthday (yesterday).

Peterson stated "Don't forget our service men and women, who are dedicating their lives to us and
taking care of our freedoms; don't take ourselves too seriously, and do a random act of kindness.

Resolution of the City Council for the City of Columbia Heights approving revocation pursuant to City Code, Chapter 5A, Article
IV, Section 5A.408(A) of that certain residential rental license held by Suki Lewandowski (Hereinafter "License Holder ").
Whereas, license holder is the legal owner of the real property located at 4603 Fillmore Street N.E., Columbia Heights,
Minnesota,
Whereas, pursuant to City Code, Chapter 5A, Article IV, Section 5A.408(B), written notice setting forth the causes and reasons
for the proposed Council action contained herein was given to the License Holder on July 20, 2011 of an public hearing to be held
on August 22, 2011.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of Columbia Heights, the City
Council of the City of Columbia Heights makes the following:
FINDINGS OF FACT
1. That on or about June 24, 2011 inspection office staff sent a letter requesting the owner of the property to submit a rental
license application and schedule a rental inspection for this property. The letter was mailed by regular mail to the owner
at the address listed in the property records.
2. That on July 20, 2011 inspection office staff reviewed the property file and noted that the property remained unlicensed.
A Statement of Cause was mailed by regular mail to the owner at the address listed in the property records.
3. That based upon said records of the Enforcement Office, the following conditions and violations of the City's Residential
Maintenance Code were found to exist, to -wit: Failure to schedule a rental property inspection and failure to submit
rental license fees.
4. That all parties, including the License Holder and any occupants or tenants, have been given the appropriate notice of
this hearing according to the provisions of the City Code, Chapter 5A, Article III 5A.306 and 5A.303(A).
ORDER OF COUNCIL
1. The rental license belonging to the License Holder described herein and identified by license number U4603 is hereby
revoked;
2. The City will post for the purpose of preventing occupancy a copy of this order on the buildings covered by the license
held by License Holder;
3. All tenants shall remove themselves from the premises within 45 days from the first day of posting of this Order
revoking the license as held by License Holder.

1. That on or about March 15, 2011, inspection office staff sent a letter requesting the owner of the property submit the

reasons for the proposed council action contained herein was sent via regular mail to the owner of record on July 6, 2011.

2. That on July 6, 2011 inspectors re- inspected the property listed above. Inspectors noted that violations remained
uncorrected. A compliance order and statement of cause was mailed via regular mail to the owner listed in the property
records.
3. That on August 8, 2011 inspectors re- inspected the property and found that violations remained uncorrected.
4. That based upon said records of the Fire Department, the following conditions and violations of City Codes(s) were
found to exist, to wit: Shall remove the dead tree (and all of the tree stump(s)) in the _front yard_ to within 2 -4 inches
below ground level.
5. That all parties, including the owner of record and any occupants or tenants, have been given the appropriate notice of
this hearing according to the provisions of the City Code Section 8.206(A) and 8.206(B).
CONCLUSIONS OF COUNCIL
I. That the property located at 5117 4 Street N.E. is in violation of the provisions of the Columbia Heights City Code as
set forth in the Notice of Abatement.
2. That all relevant parties and parties in interest have been duly served notice of this hearing, and any other hearings
relevant to the abatement of violations on the property listed above.
3. That all applicable rights and periods of appeal as relating to the owner of record, occupant, or tenant, as the case may
be, have expired, or such rights have been exercised and completed.
ORDER OF COUNCIL
1. The property located at 5117 4 Street N.E. constitutes a nuisance pursuant to City Code.
2. That a copy of this order shall be served upon all relevant parties and parties in interest.

Resolution of the City Council for the City of Columbia Heights declaring the property a nuisance and approving abatement of
ordinance violations pursuant to Chapter 8, Article II, of City Code, of the property owned by Joseph Pajari (Hereinafter "Owner
of Record ").
Whereas, the owner of record is the legal owner of the real property located at 4643 6 Street N.E., Columbia Heights, Minnesota.
And whereas, pursuant to Columbia Heights Code, Chapter 8, Article II, Section 8.206, written notice setting forth the causes and
reasons for the proposed council action contained herein was sent via regular mail to the owner of record on July 14, 2011.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of Columbia Heights, the City
Council of the City of Columbia Heights makes the following:
FINDINGS OF FACT
I. That on June 2, 2011 an inspection was conducted on the property listed above. Inspectors found violations. A
compliance order was sent via regular mail to the owner at the address.
2. That on July 14, 2011 inspectors re- inspected the property listed above. Inspectors noted that violations remained
uncorrected. A compliance order and statement of cause was mailed via regular mail to the owner listed in the property
records.
3. That on August 10, 2011 inspectors re- inspected the property and found that violations remained uncorrected.
4. That based upon said records of the Fire Department, the following conditions and violations of City Codes(s) were
found to exist, to wit: Shall sod, lay down grass seed or install approved landscaping material on all bare areas of the
yard FILL IN THE HOLES IN THE YARD — BACK.
5. That all parties, including the owner of record and any occupants or tenants, have been given the appropriate notice of
this hearing according to the provisions of the City Code Section 8.206(A) and 8.206(B).
CONCLUSIONS OF COUNCIL
I. That the property located at 4643 6 Street N.E. is in violation of the provisions of the Columbia Heights City Code as
set forth in the Notice of Abatement.
1 That all relevant parties and parties in interest have been duly served notice of this hearing, and any other hearings
relevant to the abatement of violations on the property listed above.

ordinance violations pursuant to Chapter 8, Article II, of City Code, of the property owned by JZ Properties, LLC (Hereinafter
"Owner of Record ").
Whereas, the owner of record is the legal owner of the real property Located at 4345 5 Street N.E., Columbia Heights, Minnesota.
And whereas, pursuant to Columbia Heights Code, Chapter 8, Article II, Section 8.206, written notice setting forth the causes and
reasons for the proposed council action contained herein was sent via regular mail to the owner of record on July 14, 2011.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of Columbia Heights, the City
Council of the City of Columbia Heights makes the following:

"Owner of Record ").
Whereas, the owner of record is the legal owner of the real property located at 4510 Taylor Street N.E., Columbia Heights,
Minnesota.
And whereas, pursuant to Columbia Heights Code, Chapter 8, Article II, Section 8.206, written notice setting forth the causes and
reasons for the proposed council action contained herein was sent via regular mail to the owner of record on July 21, 2011.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of Columbia Heights, the City
Council of the City of Columbia Heights makes the following:
FINDINGS OF FACT
1. That on May 10, 2011 an inspection was conducted on the property listed above. Inspectors found violations. A
