abatement of violations from the property pursuant to City Code section 8.206.

Adopt Resolution 2011 -95 being a resolution adopting a proposed budget for the year 2012, p65
setting the proposed City levy, approving the HRA levy, and establishing a budget hearing date
for property taxes payable in 2012.
MOTION: Move to waive the reading of Resolution 2011 -95 there being ample copies available

MOTION: Move to adopt Resolution 2011 -95, being a resolution adopting a proposed budget,
setting the General, Library, and EDA proposed levy, establishing a budget hearing date for

MOTION: Move to amend the 2011 budget to include the proposed 2012 budget for Public
Works sanitary sewer construction of $125,000 for sanitary sewer lining and $25,000 for I/I
reduction.
MOTION: Move to waive the reading of Resolution 2011 -94, there being ample copies available
to the public.
MOTION: Move to adopt Resolution 2011 -94, being a resolution accepting bids and awarding
the contract for 2011 Sanitary Sewer Lining, City Project No. 1104 including Alternate 1 and

PROCLAMATION
65 ANNIVERSARY OF FALLDIN POST #555
SEPTEMBER 24, 2011
WHEREAS, following the cessation of WWII, a group of local Veterans joined together to
establish an American Legion Post in Northeast Minneapolis, receiving their charter on
September 24, 1946, and;
WHEREAS, the post was named in honor of Arthur and Leonard Falldin, who sacrificed their
lives for our country. Nine of their siblings served in WWII and two are still with us, and;
WHEREAS, the Falldin Post's main objective was to establish an athletic youth program for the
children in the Northeast Minneapolis area. Falldin was well known for its excellent youth
programs and the many awards received, and;
WHEREAS, the Post is still active and involved in such programs as Americanism, Veteran's
Affairs, hospital visitation, Oratorical, American Education Week, Boys and Girls State,
Legionville, community service, a Memorial Day program, and other occasions that arise, and;
WHEREAS, the 65 Anniversary celebration of the Falldin Post will be held at the National
Guard Armory, 1025 Broadway Avenue NE, Minneapolis on Saturday, September 24, 2011 from
1:00 to 5:00 p.m.
NOW THEREFORE BE IT RESOLVED that I, Mayor Gary L. Peterson do hereby proclaim

PROCLAMATION
Joining the National Moment of Remembrance of the 10 "' Anniversary of
September 11
WHEREAS, the governing body of the City of Columbia Heights expresses their support
of the United States Senate regarding coming together as a Nation and ceasing all work
or other activity for a moment of remembrance beginning at 12:00 p.m. Central Daylight
Time on September 11, 2011, in honor of the 10th anniversary of the terrorist attacks
committed against the United States on September 11, 2001; and
WHEREAS, at 8:46 a.m., on September 11, 2001, hijacked American Airlines Flight 11
crashed into the upper portion of the North Tower of the World Trade Center in New
York City, New York; and
WHEREAS, 17 minutes later, at 9:03 a.m., hijacked United Airlines Flight 175 crashed
into the South Tower of the World Trade Center; and
WHEREAS, at 9:37 a.m., the west wall of the Pentagon was hit by hijacked American
Airlines Flight 77, the impact of which caused immediate and catastrophic damage to the
headquarters of the Department of Defense; and
WHEREAS, at approximately 10:00 a.m., the passengers and crew of hijacked United
Airlines Flight 93 acted heroically to retake control of the airplane and thwart the taking
of' additional American lives by crashing the airliner in Shanksville, Pennsylvania, and, in
doing so, gave their lives to save countless others; and
WHEREAS, nearly 3,000 innocent civilians were killed in the heinous attacks of
September 11, 2001; and
WHEREAS, tens of thousands of individuals narrowly escaped the attacks at the
Pentagon and World Trade Center and, as witnesses to this tragedy, are forever changed;
and
WHEREAS, countless fire departments, police departments, first responders,
governmental officials, workers, emergency medical personnel, and volunteers responded
immediately and heroically to those horrific events; and
WHEREAS, the Fire Depai hnent of New York suffered 343 fatalities on September 11,
2001, the largest loss of life of any emergency response agency in United States history;
and
WHEREAS, the Port Authority Police Department suffered 37 fatalities in the attacks,
the largest loss of life of any police force in United States history in a single day; and
WHEREAS, the New York Police Department suffered 23 fatalities as a result of the
terrorist attacks; and

WHEREAS, the impact of that day on public health continues through 2011, as nearly
90,000 people are at risk of or suffering from negative health effects as a result of the
events of September 11, 2001, including 14,000 workers and 2,400 community residents
who are sick, and tens of thousands of others whose health is being monitored; and
WHEREAS, 10 years later, the people of the United States and people around the world
continue to mourn the tremendous loss of innocent life on that fateful day; and
WHEREAS, 1.0 years later, thousands of men and women in the United States Armed
Forces remain in hann's way defending the United States against those who seek to
threaten the United States; and
WHEREAS, on the 10th anniversary of this tragic day, the thoughts of the people of the
United States are with all of the victims of the events of September 11, 2001 and their
families; and
WHEREAS, the lives of Americans were changed forever on September 11, 2001, when
events threatened the American way of life; and
WHEREAS, in 2009, Congress and the President joined together to designate September
11 as a National Day of Service and Remembrance under the Serve America Act; and
WHEREAS, in September 2009 and 2010, President Obama issued Proclamation 8413
and Proclamation 8559 proclaiming September 11, 2009, and September 11, 2010,
respectively, as Patriot Day and National Day of Service and Remembrance; and
WHEREAS, September 11 will never, and should never, be just another day in the hearts
and minds of all people of the United States;
NOW, THEREFORE BE IT RESOLVED that the governing body of the City of
Columbia Heights, Minnesota
(1) recognizes September 11, 2011, as a day of solemn commemoration of the events of
September 11, 2001, and a day to come together as a Nation; and
(2) offers its deepest and most sincere condolences to the families, friends, and loved
ones of the innocent victims of the September 11, 2001, terrorist attacks; and
(3) honors the heroic service, actions, and sacrifices of first responders, law enforcement
personnel, State and local officials, volunteers, and countless others who aided the
innocent victims of those attacks and, in doing so, bravely risked and often gave their
own lives; and
(4) recognizes the valiant service, actions, and sacrifices of United States personnel,
including members of the United States Armed Forces, the United States intelligence
agencies, the United States diplomatic service, homeland security and law enforcement
personnel, and their families, who have given so much, including their lives and well-
being, to support the cause of freedom and defend the security of the United States; and

(5) reaffirms that the people of the United States will never forget the challenges our
country endured on and since September 11, 2001, and will work tirelessly to defeat
those who attacked the United States; and
BE IT FURTHER RESOLVED that on the 10th anniversary of this tragic day in United
States history the governing body of the City of Columbia Heights calls upon all of the
people and institutions of the United States to observe a moment of remembrance on
September 11, 2011, including (i) media outlets; (ii) houses of worship; (iii) military
organizations; (iv) veterans organizations; (v) airlines; (vi) airports; (vii) railroads; (viii)
sports teams; (ix) the Federal Government; (x) State and local governments; (xi) police,
fire, and other public institutions; (xii) educational institutions; (xiii) businesses; and
(xiv) other public and private institutions; and
BE IT FURTHER RESOLVED that the City of Columbia Heights, Minnesota
encourages the observance of the moment of remembrance to last for one minute
beginning at 12:00 p.m. Central Daylight Time by, to the maximum extent practicable
ceasing all work or other activity; and marking the moment in an appropriate manner,
including by ringing bells, blowing whistles, or sounding sirens.

PROCLAMATION
Constitution Week
September 17 23, 2011
WHEREAS, our Founding Fathers, in order to secure the blessings of liberty for
themselves and their posterity, did ordain and establish a Constitution for the United
States; and,
WHEREAS, it is important that all citizens fully understand the provisions
and principles contained in the Constitution in order to effectively support,
preserve and defend against all enemies; and,
WHEREAS, September 17, 2011, marks the two hundred twenty -fourth
anniversary of the drafting of the Constitution of the United States of
America by the Constitutional Convention; and,
WHEREAS, it is fitting and proper to accord official recognition of this
magnificent document and its memorable anniversary; and,
WHEREAS, the independence guaranteed to American citizens, whether by
birth or naturalization, should be celebrated during Constitution Week,
September 17 through 23, 2011, as designated by proclamation of the
President of the United States of America in accordance with Public Law
915;
NOW THEREFORE, BE IT RESOLVED that I, Gary L. Peterson, Mayor

PROCLAMATION
OF OCTOBER 2011 AS
DOMESTIC VIOLENCE AWARENESS MONTH
WHEREAS, the community problem of domestic violence has become a
critical public health and welfare concern in Anoka County; and
WHEREAS, domestic violence is a crime, the commission of which will
not be tolerated in Anoka County and perpetrators of said crime are subject
to prosecution and conviction in accordance with the law; and
WHEREAS, over thousands of women and children have and will continue
to access assistance from Alexandra House, Inc., a domestic violence service
provider; and
WHEREAS, domestic violence will be eliminated through community
partnerships of concerned individuals and organizations working together to
prevent abuse while at the same time effecting social and legal change; and
WHEREAS, October is National Domestic Violence Awareness Month;
and
WHEREAS, during National Domestic Violence Awareness Month,
Anoka County organizations will inform area residents about domestic
violence, its prevalence, consequences and what we, as a concemed
community can do to eliminate its existence.
NOW, THEREFORE, BE IT RESOLVED that I, Mayor Gary L. Peterson

FINANCIAL PLANNING WEEK
OCTOBER 3 - 9, 2011
WHEREAS, the financial planning process allows individuals to achieve
their dreams by empowering them to identify and manage realistic financial
goals and negotiate the financial barriers that arise at every stage of life; and
WHEREAS, everyone can benefit from knowing about the value of
financial planning and where to turn for objective financial advice; and
WHEREAS, the Financial Planning Association is the membership
organization for the financial planning community, representing tens of
thousands of members dedicated to supporting the financial planning process
as a way to help individuals achieve their goals and dreams; and
WHEREAS, the Financial Planning Association believes that everyone is
entitled to objective advice from a competent, ethical financial planner to
make smart financial decisions; and
WHEREAS, the Financial Planning Association is dedicated to helping
individuals discover the value of financial planning;
NOW THEREFORE, I, Mayor Peterson, by virtue of the authority vested
in me as Mayor of the City of Columbia Heights, do hereby proclaim

CITY COUNCIL MEETING
MONDAY, AUGUST 22, 2011
The following are the minutes for the regular meeting of the City Council held at 7:00 p.m. on Monday,
August 22, 2011 in the City Council Chambers, City Hall, 590 40th Avenue N.E., Columbia Heights,
MN.
CALL TO ORDER/ROLL CALL /INVOCATION
Dan Thompson, Columbia Heights Assembly of God, gave the Invocation.
PLEDGE OF ALLEGIANCE - recited
ADDITIONS /DELETIONS TO MEETING AGENDA
Mayor Peterson added the fire alarm system at Murzyn Hall under Bid Considerations and removed
Resolutions 2011 -79 and 2011 -81, in that they have been brought into compliance.
Nawrocki indicated that Jerry Wegscheid, VFW Post 230, wished to give a presentation. Nawrocki
requested to add discussion of the budget and request to obtain bid specifications for legal and
financial services to the agenda. Fehst stated those items are scheduled for work session discussions.
Nawrocki stated that the rules allow items brought to the City Manager for placement on the agenda
are to be placed and discussed at a regular meeting. The Manager did not place this on the agenda as
requested. Our legal contract is fifteen years old and it would be in the best interest of the city to go
out for bids for both legal and financial services. Peterson stated this was discussed at the last
meeting and requested to place on a work session agenda. The Council can vote to add it to this
agenda. Fehst stated that a cost comparison of legal services is being prepared for distribution. This
may not be the best time to change our auditor, as we have a new Finance Director. Peterson
indicated that upon no other Council members requesting to pursue discussion at this meeting, it be
placed on a work session agenda.
Nawrocki questioned if the budget would be discussed tonight. Fehst stated that the budget was
distributed tonight, as required. Discussion will be held at the first Council meeting in September.
Peterson stated that as in the past, the budget would first be discussed at a work session. Nawrocki
referenced budget increase numbers, which Fehst responded to. Nawrocki stated that it is time to
decrease expenses, rather than increase property taxes. Fehst gave the history of budget decreases.
Motion by Diehm, second by Williams, to discuss obtaining bid specifications for legal and
financial services at the first work session in September. Upon vote: All ayes. Motion carried.
PROCLAMATIONS, PRESENTATIONS, RECOGNITION, ANNOUNCEMENTS, GUESTS
A. Proclamation - Patriot Day, September 16, 2011
Malcolm Watson, Fridley Post Chaplin and former Columbia Heights City Manager, indicated
the date and location of the celebration to honor our heroes that risk their lives and those that
gave their lives in the line of duty.
Nawrocki referred to the special day today for the 30 patriots killed in the helicopter in
Afghanistan and questioned our flags not being at half-mast. Peterson indicated the event today
was for one of the local soldiers and the other was recognized last week. Muscovitz, City Clerk,
indicated that flags are ordered at half -mast by the Governor on all State owned property.
Peterson commended Nawrocki for his work with the VFW.

Jerry Wegscheid, Columbia Heights VFW Post 230, indicated that on Saturday, September 10 at
10:00 a.m., Post 230 and the Tri -City American Legion will hold a joint flag disposal ceremony.
Peterson stated his appreciation for all the hard work the Post and Legion does. Nawrocki stated
that flags can be dropped off any time at Post 230 and they will be properly disposed of.
Fehst acknowledged Malcolm Watson's contribution to the profession of City Manager. He
indicated all of the positions he held. We are lucky that he is still contributing to our community.
B. Introductions
Paid -on -Call Firefighters
Fire Chief Gary Gorman introduced our two new firefighters, Brian Polski and Will Shutte. They
have completed all of their training and will now be full time paid on call fire fighters. He
presented them with their helmets. Both firefighters spoke of their background and excitement
with their new status.
Nawrocki questioned the firefighter's presence at Walgreens. Gorman stated it was a community
event they requested the Police and Fire Depaituents attend to promote our community and to
honor them.
Peterson indicated that on September 16 he will be on the roof of our Central Avenue liquor
store over night to raise funds for the Lee Carlson Mental Health and Well -being Center. He has
received notice that Senator Barb Goodwin will also support this fundraiser by spending the
evening on the roof.

1. Fire Alarm system bid request for Murzyn Hall
Fehst stated this request is a non - budgeted item to go out for fire alarm panel bids. For the
past month or so, Murzyn Hall has had numerous false fire alarms. The repair company has
indicated that the panel is a 1977 model that is past its performance life. Keith Windschitl,
Recreation Director, indicated that the false alarms have interrupted events such as wedding
receptions. It also shuts down the air conditioning unit. The repair service has been out three
times, but only billed us once. They state that the panel has exceeded its life expectancy. A
new system would give more information than the current system. Gorman explained the
new efficient systems. The current panel continues to jump into alarm mode. It is important

to have a working system for this building because this building could have up to 700
occupants at one time.
Peterson questioned how fast this can be updated and fixed. Windschitl stated the alarm is
currently disabled. Gorman stated that Fire Net is working on a quote for us, and three other
companies are coming out to look at this and bid. They may have to order parts and it may
take a month or more. Gorman stated we are looking to override the alarm, yet allow
operation of the sprinkler system.
Motion by Nawrocki, second by Diehm, that upon three responsive quotes for replacement
of the Murzyn Hall alarm system, with an acceptable bid less than $15,000, this replacement
go forward. Upon vote: All ayes. Motion carried.
Nawrocki questioned if the funds could be found in the current budget. Windschitl stated
there are funds available in the current budget, as we have not hired a replacement Head
Custodian at this time. Fehst also commented on the costs incurred for the Fire Department
false alarm responses.

ADMINISTRATIVE REPORTS
Report of the City Manager
Fehst indicated that the League of Minnesota Cities will prepare a joint survey to comply with the
Performance Measures. However, they have made clear, for the first year, they will have ten
prepared questions. We could have survey questions on our new web site. Fehst stated that Council
meetings can now be viewed on our web site as a live feed.
Nawrocki again spoke on the budget and the need to cut back costs. Nawrocki requested an update
on the tree concern at 4415 Main Street. Nawrocki questioned when the Council would meet to
review the City Manager's performance. Peterson indicated he was waiting to receive member's
review forms.
Report of the City Attorney — nothing to report
CITIZENS FORUM
Roger Strom, 690 47 Avenue, questioned the street seal coating being done in his area. Property
owners were not notified. Peterson stated that the first seal coat after street reconstruction is not
charged to the resident.
Diehm stated that SACA will hold their 5` vintage sale fund raiser on Saturday, September 10.
Schmitt indicated that The Lighthouse of Columbia Heights will host a pancake breakfast with
profits going to the Police Association Adopt a Family Program. Funds will assist up to four families
purchase of holiday gifts. The Library also was the recipient of such an event. Fehst stated that they
have been excellent corporate citizens. Fehst indicated that parking will be available on the east side
for such events.
Diehm showed the Council meeting streaming live on her computer. Peterson wished Council
member Nawrocki a happy 80 birthday (yesterday).

BACKGROUND
The Police Department received reimbursement from the Edward Byrne Memorial Justice Assistance
Grant (commonly referred to as JAG 1) for overtime expended toward proactive, targeted initiatives.
The JAG I grant is a countywide award for which Anoka County is acting as fiscal agent. This
reimbursement was in the amount of $7,161.49, which covers the second quarter of 2011.
In addition, over the past months the Columbia Heights Police Department worked several overtime
security details at various locations. They are as follows:
$3,500.00 from School District 13 for traffic enforcement at the Summer Academy,
$2,405.00 for overtime details at Unique Thrift,
$ 346.88 for a security detail at Heights Theater, and
$ 75.00 from Global Academy for a security detail at their 5K event.
ANALYSIS /CONCLUSION
The $13,488.37 from these five sources was deposited into the General Fund. The Police
Department is requesting that the funds received be moved back into the 2011 Police Department
Budget, Overtime line item.
RECOMMENDED MOTION
Move to transfer the following:
$7,161.49, the amount received as reimbursement under the JAG grant, and
$3,500.00, the amount received from District 13 for traffic enforcement at the Summer Academy,

The City of Columbia Heights does ordain:
Section 1: Chapter 6, Section 56 of the Charter of the City of Columbia Heights which currently reads
as follows, to wit:
PURCHASES AND CONTRACTS. The city manager shall be chief purchasing agent of the
City. All purchases and contracts on behalf of the City shall be made by the City Manager,
but subject to the approval of the City Council whenever the amounts of such purchases or
contracts exceeds $3,000. Said amount may be amended by a simple majority of the Council
by resolution. All contracts for the conveyance of any real estate by the city shall be signed
by the Mayor and the City Manager on behalf of the City and shall be executed in the name
of the city.

Analysis /Conclusions:
The attached resolution calls for the City Engineer to prepare the required report for the 2012 Street
Rehabilitation program in Street Zone 7, generally bounded by California Street to Central Avenue, 37 Avenue
to 40 Avenue and Main Street to University Avenue, 40 Avenue to 44 Avenue, including 4 Street, 40
Avenue to 42 Avenue.
A Public Improvement Hearing will need to be held for these segments of roadways following completion and
acceptance of the feasibility report.

RESOLUTION 2011 -91
Resolution of the City Council for the City of Columbia Heights declaring the property a nuisance
and approving abatement of ordinance violations pursuant to Chapter 8, Article II, of City Code, of
the property owned by Zeleaem Bekele (Hereinafter "Owner of Record ").
Whereas, the owner of record is the legal owner of the real property located at 581 49 Avenue N.E.,
Columbia Heights, Minnesota.
And whereas, pursuant to Columbia Heights Code, Chapter 8, Article II, Section 8.206, written
notice setting forth the causes and reasons for the proposed council action contained herein was sent
via regular mail to the owner of record on August 22, 2011.
Now, therefore, in accordance with the foregoing, and all ordinances and regulations of the City of
Columbia Heights, the City Council of the City of Columbia Heights makes the following:
FINDINGS OF FACT
1. That on July 13, 2011 an inspection was conducted on the property listed above. Inspectors
found violations. A compliance order was sent via regular mail to the owner at the address.
2. That on August 22, 2011 inspectors reinspected the property listed above. Inspectors noted
that violations remained uncorrected. A compliance order and statement of cause was
mailed via regular mail to the owner listed in the property records.
3. That on September 2, 2011 inspectors reinspected the property and found that violations
remained uncorrected.
4. That based upon said records of the Fire Dept intent, the following conditions and violations
of City Codes(s) were found to exist, to wit:
A. Shall remove all/any outside storage from the property. Shall store in shed or garage.
Items include, BUT NOT LIMITED TO; PALLETS, LARGE DIRT PILE, LARGE
PILE OF CONCRETE CHUNKS, MISC GARBAGE, FENCE POSTS, METAL GATE,
CONCRETE BLOCKS. ETC.
5. That all parties, including the owner of record and any occupants or tenants, have been given
the appropriate notice of this hearing according to the provisions of the City Code Section
8.206(A) and 8.206(B).
CONCLUSIONS OF COUNCIL
1. That the property located at 581 49 Avenue N.E. is in violation of the provisions of the
Columbia Heights City Code as set forth in the Notice of Abatement.
2. That all relevant parties and parties in interest have been duly served notice of this hearing,
and any other hearings relevant to the abatement of violations on the property listed above.
3. That all applicable rights and periods of appeal as relating to the owner of record, occupant,

completed.

Attached is the resolution to adopt the proposed 2012 budget and tax levy. As called for in the City's five -year
financial plan, the proposed 2012 levy is a 3.98% increase over 2011. This was discussed at the September 6,
2011 Council work session. Substantial detail (122 pages) supporting the amounts in the resolution is in the
City Manager's 2012 Budget Message, which was distributed to the City Council on August 22, 2011.
As stated in the City Manager's 2012 Budget Message, in order to maintain the current level of services and
limit the levy to the planned increase of 3.98 %, the budget proposed in this resolution uses $416,685 of fund
balance in 2012, instead of the $196,512 of fund balance envisioned in City's five -year plan. This was
primarily the result of the loss of the state -paid market value homestead credit for 2012, which was not expected
at the time the five -year plan was last updated.
As discussed at the September 6, 2011 work session; based on projections under the five -year plan, using
$416,685 of fund balance in 2012 will leave the City with enough working capital in its General Fund through
2013, to be within the state auditor's recommended range for city financial reserves, although at the lower end
of that recommended range. The situation beyond 2013 is difficult to project at this point, as that will be greatly
affected by next the state legislature's biennial budget process. For these reasons, if the Council expects to add
additional expenditures to the tax - supported funds in the proposed 2012 budget, it should fund these additional
expenditures either by an alternate motion to increase the levy to cover the expenditures, or by reducing other
tax - supported expenditures in the proposed budget. The proposed levy adopted by the Council can only be
reduced once it has been certified to Anoka County; it cannot be increased. The levy must be certified to Anoka
County on or before September 15, 2011.
We note that the separate 2012 HRA levy included in the attached resolution is a $22,031 decrease from 2011.
A related item for discussion is scheduling the remaining budget review process. At this point, staff
recommends scheduling work sessions for Monday October 3 and Monday November 7 for budget review.
After the October 3` session, Council and staff can consider whether progress to that point warrants additional
sessions.
RECOMMENDED MOTION: Move to waive the reading of Resolution 2011 -95 there being ample copies
available for the public.
RECOMMENDED MOTION: Move to adopt Resolution 2011 -95, being a resolution adopting a proposed
budget, setting the General, Library and EDA proposed levy, establishing a budget hearing date for property
taxes payable in 2012 of December 12, 2011 at approximately 7:00 p.m. in the City Council Chambers, and

BE IT FURTHER RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBIA HEIGHTS, MINNESOTA: That the public budget
hearing is scheduled for December 12, 2011 at approximately 7:00 p.m. in the City Council Chambers.
BE IT FURTHER RESOLVED BY THE COUNCIL OF THE CITY OF COLUMBIA HEIGHTS, COUNTY OF ANOKA, MINNESOTA:
That the County Auditor is authorized to fix a property tax rate for taxes payable in the year 2012 that is higher than
the tax rate calculated for the City for taxes levied in 2010 collectable in 2011.
BE IT FURTHER RESOLVED : That the City has adequate fund balances and reserves to pay bond principal and interest
payments on General Obligation Bond Series 2003A in the amount of $44,200 and General Obligation Bond Series
2006A in the amount of $102,990, and that the County Auditor is authorized to cancel the related Bond Levies in their
entirety for taxes payable in 2012.
BE IT FURTHER RESOLVED: That the City has adequate fund balances and reserves to pay bond principal and interest
payments on General Obligation Bond Series 20088 in the amount of $225,000 and that the County Auditor is
authorized to cancel $225,000 of the related Bond Levy for taxes payable in 2012, leaving a balance of $435,300 to be
levied for taxes payable in 2012 for Series 20088.
BE IT FURTHER RESOLVED: That the City has adequate fund balances and reserves to pay bond principal and interest
payments on General Obligation Bond Series 2009A in the amount of $103,973, and that the County Auditor is
authorized to cancel $103,973 of the related Bond Levy for taxes payable in 2012, leaving a balance of 5126,274 to be
levied for taxes payable in 2012 for Series 2009A.
The City Clerk is hereby instructed to transmit a certified copy of this resolution to the County Auditor of Anoka County,
Minnesota.

Background:
On February 14, 2011 the City Council authorized staff to seek bids for our annual sanitary sewer lining
program. This is an annual program to rehabilitate sections of sanitary sewer pipe that have been televised
and found to be deteriorating, have cracked or broken joints or sections, contain root intrusion or have
infiltration present. This project consists of lining the following segments:
985 L.F. of 10" VCP on 4 Street, 40 Ave (CSAH 2) to 1 MH south of 42 Ave
815 L.F. of 8" VCP on 4 Street, l MH south to 2 MH north of 42n Ave
1,315 L.F. of 10" VCP on 5` Street, 40 Ave (CSAH 2) to 42 Ave
330 L.F. of 8" VCP on 5 Street, 42n Ave to 1 MH north of 42 Ave
1,644 L.F. of 8" VCP on 6 Street, 40 Ave (CSAH 2) to 1" MH north of 42n Ave
520 L.F. of 8" VCP on Washington Street, 1 MH south to 1 MH north of 42 Ave
333 L.F. of 10" VCP on 42 Avenue, 5 St to 6 St
665 L.F. of 8" VCP on 42 Avenue, 6 St to Washington St
In addition, the following alternates were included with the project:
Alternate 1: 775 L.F. of 8" VCP on 40 Avenue, 2n St to University Ave
Alternate 2: Install 25 main to service lateral connection liners
Plans and specifications were advertised for bids in the Sun Focus on August 11, 2011. Seven contractors
received copies of the bidding documents. Two bids were received and publicly read aloud at the September
7, 2011 bid opening. A copy of the minutes is attached.
Analysis/Conclusions:
Insituform Technologies USA, Inc. submitted the low bid in the amount of $211,91L40. The unit price for
the sanitary sewer main lining work is $30.40 per lineal foot for 8" pipe and $34.60 per lineal foot for 10"
pipe. This is higher than what the City paid in 2010 ($23.00 per lineal foot for 8" pipe), however, it is
similar to what was paid in 2007, which was $30.00 per lineal foot for 8" pipe. In 2009, the City paid $32.00
per lineal foot for 10" pipe. The total base bid for sanitary sewer main lining is $211,911.40.
Alternate bid 1 for $22,707.50 was received for lining the pipe on 40` Avenue. A section of this pipe
collapsed this summer and had to be repaired. Much of the remaining pipe is severely deteriorated, some is
actually missing. The main is being lined to prevent another collapse.
Alternate bid 2 for $61,987.50 was received for lining up to 25 connections between the main and the private
service lateral. The televising displayed connections with continuous water infiltration from outside to
inside the pipe.
The Engineer's Estimate for lining was $180,000. Staff recommends combining the 2011 and proposed
2012 Public Works sanitary sewer construction funds to fund the work - awarding the base bid and alternates
1 and 2. The Public Works sanitary sewer construction fund has $150,000 budgeted in 2011 for sanitary
sewer lining and I/I reduction. The proposed 2012 Public Works sanitary sewer construction fund also has

$150,000 budgeted for sanitary sewer lining and I/I reduction. Under this scenario, there would be no
sanitary sewer lining project in 2012.
As an alternate, the bids could be rejected and rebid. It is staff's opinion that this would not significantly
impact the unit pricing, but would only reduce the scope of the work to the 2011 budgeted amount.
Recommended Motion: Move to amend the 2011 budget to include the proposed 2012 budget for Public
Works sanitary sewer construction of $125,000 for sanitary sewer lining and $25,000 for I/I reduction.
Recommended Motion: Move to waive the reading of Resolution 2011 -94, there being ample copies
available to the public.
Recommended Motion: Move to adopt Resolution 2011 -94, being a resolution accepting bids and
awarding the contract for 2011 Sanitary Sewer Lining, City Project No. 1104 including Alternate 1 and
Alternate 2 to
Insituform Technologies USA, Inc., of Chesterfield, Missouri based upon their low, qualified, responsible
bid in the amount of $296,606.40 with funds to be appropriated from Fund 652 -51104 -5185; and,
furthermore, to authorize the Mayor and City Manager to enter into a contract for the same.
Alternate Recommended Motion: Move to reject bids for 2011 Sanitary Sewer Lining, City Project No.
1104 and authorization to rebid the project.

specifications therefore approved by the Council.
2. The City Engineer is hereby authorized and directed to return, forthwith, to all bidders,
the deposits made with their bids except the deposit of the successful bidder and the next
lowest bidder shall be retained until the contract has been signed.
3. City Project No. 1104 shall be funded from the Sanitary Sewer Construction Fund.
