Performance Expectation Agreement (PEA) for the installation of a wireless access solution
for point -to -point for City Hall to Top Value and Park View locations.
1. Project Information:
a. Project Number: RDM1027 -IT
b. The purpose of this project is to provide a wireless access solution for point -to -point for
City Hall to Top Value and Park View locations.
2. Proposed Project Equipment List: The equipment listed in Table 1 is a listing of items to
be installed by the Marco installation team upon arrival. This table includes equipment items
purchased through Marco.

3. Task List: ATTACHMENTI of the PEA contains the major tasks to be completed by the
Marco installation team upon their arrival. Although the tasks are general in nature, tasks
determined to be out -of -scope for this project will be billed at our normal service rates.
4. Billing: The total cost for this project as outlined in Attachment 1 and Table 1 will not
exceed $12,705.00. If additional services or hours are required, they will be billable at
$185.00 an hour.
* These rates are in effect during normal business hours. Services provided before
8:00 a.m., after 5:00 p.m. or on Saturdays will be charged at 1.5 times the normal
hourly rate, Sundays and holidays will be billed at 2 times the normal rate.
5. Implementation Schedule Dates: The anticipated Team Start Date (TSD) for this project
is to be determined. This date is contingent upon material availability, team availability,
customer support requirements completed, and all other necessary lines or supporting
communication requirements as outlined above.
6. Warranty: Marco warrants that the hardware included in the original system will be free from
defects in materials and workmanship if an item arrives inoperable from the date of
acceptance by City of Columbia Heights; please return this merchandise within 30 days for
replacement. After the 30 days the systems are covered by their respective manufacturer's
warranties. Please consult the warranty documentation that accompanies the product for
details. Any charges from the manufacturer are the sole responsibility of the customer
(including but not limited to shipping, travel or labor charges). Marco can provide assistance
with the processing of these warranties at our normal service rates. Optional contracts or
warranty enhancements are available for an additional fee at the time of purchase. If the
customer purchases the Cisco extended warranty, will receive the required on -site services
for post installation from Cisco.
7. Customer Responsibilities: Customer retains the on -going responsibility to follow the
operating instructions applicable to the customer's equipment and software. It is the legal
responsibility to assure that all software installed on the customer's computers are legally
obtained and licensed. Under no circumstances will Marco install or upgrade software when
questions of licensing exist. In addition, the customer is solely responsible to assure
that proper backup procedures are in place sufficient to safeguard the customer's
data. Prior to a network Operating System upgrade, the customer is responsible to provide
two complete verified backups.
8. Limitation of Liability: In no event will Marco be liable for any damages caused by the
customer's failure to perform customer's responsibilities. In no event will Marco be
responsible for any loss of profits or consequential damages, even if Marco has been
advised of the possibility of such damages. Marco will not be liable for any claim against the
customer brought by any other party.
9. Sparing: It is the responsibility of City of Columbia Heightsto provide spares for the
installed equipment. Marco recommends as a minimum, hot spares for the bridge units,
transceivers, and spare ports for the switched Ethernet connections. Downtime caused as a
result of parts on order is not the responsibility of Marco.

10. PEA Processing:
a. We request you provide message or telephonic acknowledgment of receipt of this PEA
to Tash Oslowski, 800.847.3094 or by FAX 1.800.847.3035).
NOTE: Scheduling action cannot be finalized until your concurrence with the PEA has
been returned to this office. Any delay at this time can incur a delay in the
installation of your programmed facility.
b. Signed concurrence with the PEA ( "ACCEPTANCE SIGNATURES:" section) may be
either FAXED at 1.800.847.3035 or MAILED to:

and shall imply concurrence with the following information:
(1) Concurrence with the equipment or facility siting;
(2) Concurrence with the list of materials,
(3) Concurrence with all supporting requirements, service, and team start date. This
agreement constitutes the entire understanding of both parties. No other
agreements have been expressed or implied. Any changes or modifications to this
contract need signed agreement by both parties, and are contained as amendments
to this document.

PEA Task List
Initials The Marco installation team shall complete the following tasks:
y � 1. At the Parkview Villa:
1.1 Install one 12dB Omni antenna outside the penthouse wall. Run and terminate multimode fiber
from the antenna location to the LAN. Existing media converters (10BaseFX- 10BaseTX) will be
used.
1.2 Install the Cisco bridge unit in the penthouse mechanical room. Existing 120VAC power will be
used.

64, 2. At the City Hall:
2.1. Install one Yagi antenna on the existing tower.
2.2 Install the Bridge unit inside the stair well or outside on the tower depending on the distance
requirements of the bridge unit. Existing media converters (10BaseFX- 10BaseTX) will be used.
120VAC power will be required near the installation of the bridge unit.
2.3 Configure the bridge unit for operation on the existing LAN.
3. At Top Value Liquor.
3.1. Install one Yagi antenna on a pipe near the A/C unit.
3.2 Install the Bridge unit near the administrative offices upstairs. 120VAC power will be required near
the installation of the bridge unit.
3.3 Configure the bridge unit for operation on the existing LAN.
