HomeMy WebLinkAboutContract 2361 r ‘4 F .m Agreement between City of Columbia Heights and Master Mechanical, Inc. for Municipal Service Center Improvements AGREEMENT made as of the 13 day of December in the year 2010 BETWEEN the Owner: City of Columbia Heights 590 40 Avenue NE Columbia Heights, MN 55421 and the Contractor: Master Mechanical, Inc. 1027 Gemini Road Eagan, MN 55121 the Project is: Lower Level Radiant Heat Municipal Service Center 637 38 Avenue NE Columbia Heights, MN 55421 The Owner and Contractor agree as follows: Contractor shall furnish and install a complete radiant heating system as shown and detailed on the attached plans and specifications, Exhibit "A ". THE WORK OF THIS CONTRACT The Contractor shall complete the Work described in the Contract Documents, except to the extent specifically indicated in the Contract Documents to be the responsibility of others. DATE OF COMMENCEMENT AND SUBSTANTIAL COMPLETION The date of cotrunencement of the Work shall be the date of this Agreement unless a different date is stated below or a different date is agreed to with the Owner as stated in the Notice to Proceed. The Contract Time shall be measured from the date of commencement. The Contractor shall achieve Substantial Completion of the entire Work not later than 100 days from the date of commencement, or as follows: Final Completion by March 31, 2011 CONTRACT SUM The Owner shall pay the Contractor the Contract Sum for the Contractor's performance of the Contract. The Contract Sum shall be Thirty-two thousand five hundred eighty five dollars ($32,585.00), subject to additions and deletions as provided in the Contract Documents. CONTRACTOR PAYMENTS Based upon Applications for Payment submitted to the City, the Owner shall make progress payments on account of the Contract Sum to the Contractor as provided below and elsewhere in the Contract Documents. The period covered by each Application for Payment shall be one calendar month ending on the last day of the month. Final payment, constituting the entire unpaid balance of the Contract Sum, shall be made by the Owner to the Contractor when: 1. The Contractor has fully perfoinued the Contract except for the Contractor's responsibility to correct Work, and 2. A final Acceptance of Work has been issued by the City. The Owner's final payment to the Contractor shall be made no later than 30 days after the issuance of the City's final Acceptance of Work. CONTRACT DOCUMENTS The Contract Documents are listed herein and, except for Modifications issued after execution of this Agreement, are enumerated as follows: This Agreement Between the Owner and the Contractor. The drawings and specifications are those contained at the end of this Agreement identified as "Appendix A ". Addenda are as follows: Numbers Date Pages 1 12/3/10 2 2 12/7/10 2 3 12/8/10 1 Other documents, if any, forming part of the Contract Documents are as follows: Contractor Bid dated 12/09/2010 GENERAL CONDITIONS THE CONTRACT DOCUMENTS The Contract Documents consist of this Agreement, the Contract Drawings, Specifications, Addenda issued prior to the execution of this Agreement, General Conditions, and other documents listed in this Agreement and Modifications issued after execution of this Agreement. A Modification is (1) a written amendment to the Contract signed by both parties, (2) a Change Order, (3) a Construction Change Directive, (4) a written order for a minor change in Work issued by the City. The intent of the Contract Document is to include all items necessary for the proper execution and completion of the Work by the Contractor. THE CONTRACT The Contract Documents form the Contract for Construction. The Contract represents the entire and integrated agreement between the parties hereto and supersedes prior negotiations representations or agreements, either written or oral. The Contract may be amended or modified only by a Modification. THE WORK The term "Work" means the construction and services required by the Contract Documents, whether completed or partially completed, and includes all other labor, materials, equipment and services provided or to be provided by the Contractor to fulfill the Contractor's obligations. EXECUTION OF THE CONTRACT Execution of the Contract by the Contractor is a representation that the Contractor has visited the site, become generally familiar with local conditions under which the Work is to be performed and correlated personal observations with requirements of the Contract Documents. OWNER The Contractor shall be entitled to rely on the accuracy of information furnished by the Owner but shall exercise proper precautions relating to the safe performance of the Work. Except for permits and fees that are the responsibility of the Contractor under the Contract Documents, the Owner shall secure and pay for other necessary approvals, easements, assessments and charges required for the construction, use or occupancy of permanent structures or peinianent changes in existing facilities. OWNER'S RIGHT TO STOP THE WORK If the Contractor fails to correct Work which is not in accordance with the requirements of the Contract Documents, or persistently fails to carry out the Work in accordance with the Contract Documents, the Owner may issue a written order to the Contractor to stop the Work, or any portion thereof, until the cause for such order is eliminated; however, the right of the Owner to stop the Work shall not give rise to a duty on the part of the Owner to exercise this right for the benefit of the Contractor or any other person or entity. OWNER'S RIGHT TO CARRY OUT THE WORK If the Contractor defaults or persistently fails or neglects to carry out the Work in accordance with the Contract Documents or fails to perform a provision of the Contract, the Owner, after 10 days written notice to the Contractor and without prejudice to any other remedy the Owner may have, may make good such deficiencies and may deduct the reasonable cost thereof, including Owner's expenses and compensation for outside consultant services made necessary thereby, from the payment then or thereafter due the Contractor. WARRANTY The Contractor warrants to the Owner that materials and equipment fumished under the Contract will be of good quality and new unless otherwise required or permitted by the Contract Documents, that the Work will be free from defects not inherent in the quality required, and that the Work will conform with the requirements of the Contract Documents. Work not conforming to these requirements, including substitutions not properly approved and authorized may be considered defective. The Contractor's warranty excludes remedy for damage or defect caused by abuse, modifications not executed by the Contractor, improper or insufficient maintenance, improper operation or normal wear and tear and normal usage. The warranty period for all work covered under this Agreement shall be for a period of one year following Owner's Final Acceptance, unless provided elsewhere in the Contract Documents. PERMITS, FEES AND NOTICES Unless otherwise provided in the Contract Documents, the Contractor shall secure and pay for the building pen and other pennits and goverunental fees, licenses and inspections necessary for proper execution and completion of the Work. The Contractor shall comply with and give notices required by laws, ordinances, rules, regulations and lawful orders of public authorities applicable to performance of the Work. The Contractor shall promptly notify the Owner if the Drawings and Specifications are observed by the Contractor to be at variance therewith. If the Contractor performs Work knowing it to be contrary to laws, statutes, ordinances, building codes, and rules and regulations without such notice to the Owner, the Contractor shall assume appropriate responsibility for such Work and shall bear the costs attributable to correction. USE OF SITE The Contractor shall confine operations at the site to areas permitted by law, ordinances, permits and the Contract Documents and shall not unreasonably encumber the site with materials or equipment. CLEANING UP The Contractor shall keep the premises and surrounding area free from accumulation of waste materials or rubbish caused by operations under the Contract. At completion of the Work, the Contractor shall remove from and about the Project waste materials, rubbish, the Contractor's tools, construction equipment, machinery and surplus material. ACCESS TO WORK The Contractor shall provide to the Owner access to the Work in preparation and progress wherever located. INDEMNIFICATION The Contractor shall indemnify and hold harmless the Owner and agents and employees of any of them from and against claims, damages, losses and expenses, including but not limited to attorney's fees arising out of or resulting from perfou of the Work, provided that such claims, damage, loss or expense is attributable to bodily injury, sickness, disease or death, or to injury to or destruction of tangible property (other than Work itself), but only to the extent caused by the negligent acts or omissions of the Contractor, a subcontractor, anyone directly or indirectly employed by them or anyone for whose acts they may be liable, regardless of whether or not such claim, damage, loss or expense is caused in part by a party indemnified hereunder. Such obligation shall not be construed to negate, abridge, or reduce other rights or obligations of indemnity that would otherwise exist as to a party or person described in this Section. In claims against any person or entity indemnified under this Section by an employee of the Contractor, a subcontractor, anyone directly or indirectly employed by them or anyone for whose acts they may be liable, the indemnification obligation shall not be limited by a limitation on amount or type of damages, compensation of benefits payable by or for the Contractor or subcontractor under workers' compensation acts, disability benefit acts or other employee benefit acts. FINAL COMPLETION AND FINAL PAYMENT Final payment shall not become due until the Contractor has delivered to the Owner a complete release of all liens arising out of this Contract or receipts in full covering all labor, materials and equipment for which a lien could be filed, or a bond satisfactory to the Owner to indemnify the Owner against such lien. PROTECTION OF PERSONS AND PROPERTY The Contractor shall be responsible for initiating, maintaining and supervising all safety precautions and prograrns in connection with the performance of the Contract. The Contractor shall take reasonab!e precautions for safety of and shall provide reasonab!e protection to prevent darnage, injury or loss to: l' employees on the work and other persons who may be affected thereby; 2. the Work and materials and equiprnent to be incorporated therein; and 3. other property at the site or ad uceottborcto. The Contractor shall give notices and comply with applicable laws, ordinances, rules, regulations and lawful orders of public authorities bearing on safety of persons and property and their protection from damage, i 'uryor|oaa. The Contractor shall promptly remedy damage and loss to property caused in whole or in part by the Contractor, a subcontractor, a sub-subcontractor, or anyone directly or indirectly employed by any of them, or by anyone for whose acts they may be liable and for which the Contractor is responsible for. INSURANCE . The Contractor shall provide insurance for protection from claims under workers' compensation acts and other employee benefit acts which are applicable, claims for damages because of bodily injury, iocludin8 death, and claims for damages, other than to the Work itself, to property which may arise out oforresult from the Contractor's operations under the Contract, whether such operations be by the Contractor or by a subcontractor or anyone directly or indirectly ernployed by any ofthem. This insurance obu|l be written for not less than limits of liability specified in the Contract Documents or required by law, whichever coverage is greater, and shall include contractual liability insurance applicable to the Contractor's obligations. Certificates oflnsurance acceptable to the Owner shall be filed with the Owner prior to commencement of the Work. Complete infrared system including burners and vacuum purnps in an in-series type layout. See attached drawing for the site layout details. 2. The heating systems shall have individua dhrrnnoatatu — uonotnduudbep|uuo. 3. The wash bay heating system shall have moisture protection for the heating tubes, such as Sil-Coat tube protection. 4. The work shall include the disconnect and removal of five (5) existing gas fired unit heaters and ductwork on lower level. One (1) unit heater, in the best condition, shall be left on-site. 5. Acceptable product manufacturers shall be Superior Radiant - /REMIER VS or Roberts Gordon - CORAYVAC. Products other than those listed shall require pre-approval by the City Engineer prior to submitting quotes. 6. Provide shop drawings of the proposed infrared heating system with this bid. 7. Minimum warranty: 3 years on all components, 5 years for exchanger, 10 years for burner. D. The work shall include ucomplete installation, including removals, infrared heating equipment, therinostat controls, gas line and connections, electrical connections, permits and labor. 9. General 1) A complete Radiant Heating System shall be provided that is: - CSA approved - Fitted for Natural Gas operation - Furnished and installed complete with burners, hangers, thermostats, control panel, vacuum pump, vent terminals and/or other accessories as noted on the plan. - Removal and disposal of existing unit heaters and exhaust ducts are required as noted on the plan. 2) Radiant heaters shall be manufactured by Superior Radiant Products of Canada, Series VS; or CoRayVac UltraVac by Roberts Gordon of Buffalo, New York; or approved equal *. 3) Burner firing rate to be set by means of system vacuum with no orifice change or fuel /air adjustment. 4) Burner shall be capable of modulating from 60% to 100% of its rated input using the Control Panel. 5) Except for the first burner, subsequent burners in a leg shall have firing rates within + 2% of each other. 6) Radiant output of the first burner shall be the same as subsequent burners in that branch. 7) Clearance to combustibles shall comply with those in the UO manual for the firing rate specified. 8) Approved stainless steel flexible gas connectors shall be provided. 9) Thermostats shall be provided and installed as noted on the plan. 10) The heater unit shall operate at a minimum gas inlet pressure of 5 in W.C. and draw no more than 0.2A, 120VAC, and 60Hz. 11) System shall operate under negative pressure. 12) A manufacturer's published warranty covering all components for a period for 36 months and covering the heat exchanger for 60 months shall be supplied. 13) Where available, the contractor shall assist the City in filling out available rebate application forms to the energy service provider. (CenterPointe and/or Xcel) B. Equipment Components 1) Ignition shall be direct spark. 2) Ignition control shall: a) Make 3 ignition attempts before lockout, with purge before each attempt b) Recycle again in one hour with 3 ignition attempts c) Have a lighted diagnostic capability d) Have openly accessible sense current contacts within the housing 3) Vacuum pump motor shall be TEFC. 4) The burner shall be equipped with a clearly visible RUN light. 5) Gas valve shall include safety shutoff, a manual valve, two magnetic operators and a standard gas pressure regulator. 6) Burner housing shall be constructed of 18ga corrosion resistant steel coated with powder epoxy paint. EXHIBIT "A" Specification for Radiant Heating Equipment Page 2 7) Burner shall be equipped with a flame sight port safely useable when the unit is running during service. 8) Burner shall be equipped with a zero governor to balance fuel flow with combustion airflow regardless of vacuum draw. 9) The gas flow is precluded if: a) Main valve fails b) Vacuum pump motor fails to operate c) Power fails 10) Burner body shall be cast iron. 11) Combustion air shall be filtered by means of an air filter provided in each burner. Filter shall be replaceable without removing outside air connection if the latter is fitted. 12) All burner-operating components shall be enclosed in sealed burner housing. 13) Reflectors shall be Mill Finish aluminum, ASTM 1100, with 10 reflective surfaces. Reflector efficiency shall be higher than 99%. 14) Reflector material shall be at least 0.024 inches thick (per CSA code). 15) Reflector end caps shall be fitted to the end of each reflector run to reduce convected heat loss. 16) Reflectors shall extend below the bottom surface of the radiant tube. 17) Directing of radiant pattern shall be accomplished through use of side shields; bottom shields or 45° tilt of main reflector. 18) Couplings shall be of aluminized steel, be twelve inches in length with two draw bands of 11/4 in. wide, 14 gauge aluminized steel with high tensile bolt connectors. 19) Radiant heat exchanger tubing shall be seamless welded 16ga thick either hot rolled steel, heat-treated aluminized steel or stainless steel. 20) Combustion chamber tube shall be welded 16ga thick heat-treated aluminized steel or stainless steel. Burners with firing rate above 150,000 BTUH shall have an additional 10ft length of heat- treated aluminized steel or stainless steel tube installed downstream of the combustion chamber tube. 21) System shall incorporate a vacuum-proving switch capable of shutting off gas flow in the event of flue blockage, or failure of vacuum pump. C. Vacuum Pumps 1) Vacuum pumps shall be cast aluminum construction connected to the system by means of a high temperature flexible connector. 2) Vacuum pump motor shall be TEFC sealed ball bearings, thermally protected. D. Control Panel 1) A control panel incorporating pre-purge and post purge functions shall be provided with provision for up to 6 zone(s) of burners controlled by low voltage then 2) Night setback operation shall be included as an option. 3) Control panel shall be CSA certified as part of the Premier VS System. EXHIBIT "A" Specification for Radiant Heating Equipment Page 3 E. Unit Heaters 1) The five (5) existing unit heaters shall be disconnected and removed under this contract. A single unit heater shall be left at the MSC facility — all others shall be disposed of properly. 2) Two of the existing unit heater shall be replaced with new gas-fired unit heaters installed at the center overhead door and east of the wash bay. 3) The new unit heaters shall be Reznor model UDAP200 BTUH gas input, 115 volt, power vented. 4) Minimum thermal efficiency shall be 83%. 5) The unit heaters shall be supplied with wall-mounted then F. Installation 1) Installation must comply with manufacturer supplied Instruction Manual, all applicable local codes and/or gas utility requirements. 2) Heater must be wired in accordance with the National Electrical Code ANSI/NFPA 70 and State Electrical code and local ordinances. 3) Heater units shall be suspended in accordance with manufacturer's instruction with chain and turnbuckles exceeding 5401b pull test. 4) A permit shall be required from the City of Columbia Heights Building Inspection Department (local fees waived). * Any or-equal products must be pre-approved by the City Engineer 3 days prior to submitting a bid. GENERAL OMIT: 4) Burner shall be capable of modulating from 60% to 100% of its rated input using the Control Panel. 2. E. Four (4) existing unit heaters shall be disconnected and retrofitted for fan only operation. Remove heating components, including complete disconnection of the gas service, and reconnect for fan operation. Provide a new wall mounted timer, operable on time of day type (on-off) service. 3.
