On August 14, 2009, I wrote Mr. Utz a letter to inform him that his political campaign bus was
considered a commercial vehicle and that City Code prohibited storing commercial vehicles in
residentially zoned districts. The letter also indicated that it was staffs opinion that the bus was being
used as a portable sign, which is also prohibited. The letter requested Mr. Utz to remove the signs from
the bus and to no longer store the bus in residentially zoned districts.
On August 18, 2009, Mr. Utz came into City Hall to discuss the letter. I was not in the office, but Mr. Utz
spoke with Scott Clark regarding the letter. Mr. Clark informed Mr. Utz that I would be returning in a few
days. At that point, Mr. Utz explained that he would remove the bus but had questions for me
regarding the signage.
After receiving more complaints that the bus was still being stored at 4141 Stinson Blvd., I wrote Mr.
Utz a second letter on September 3, 2009. This letter reiterated the points made in the first letter, and
informed Mr. Utz that if the bus was not removed by September 9, 2009, a County Citation may be
issued to him.
On September 5, 2009, Mr. Utz wrote a letter to the City Council complaining that staff never made
contact with him regarding his concerns. I was never aware that Mr. Utz wanted me to contact him,
and staff assumed that he would be the one to contact me regarding his questions. Mr. Utz included
the first two letters that I had written him as well as a letter from Jerry Wellman, CSO, regarding the
illegality of parking a bus in a residential district for more than 24 hours.
I spoke with Mr. Utz when he hand-delivered me a copy of the letter he wrote. At this point, the bus
had been removed from the residential district, and some of the signage had been removed from the
bus. The bus was being stored in front of Mr. Utz's business located at 556 - 40t" Avenue, and was
being stored on 40t" Avenue. He informed me that he should have the bus stored in a properly zoned
area by September 11, 2009. I told him that we would not issue a zoning violation citation as long as
the bus was property stored by that time. I also informed him that staff would look further into the
signage issue and get back to him. I had a conversation with Jerry Wellman and told him that we, as a
city, should hold off on issuing zoning violation citations until after September 11, and only if the bus
had not been removed at that time.
A couple of days later, Mr. Utz came into City Hall with a copy of a parking citation that Jerry Wellman
issued Mr. Utz for parking his bus for longer than 6 hours along 40t" Avenue. I contacted Jerry
regarding the citation and he informed me that Chief Nadeau gave him specific direction to issue the
parking citation.
On September 14, 2009, I wrote Mr. Utz a third letter outlining staffs interpretation of the signage used
on his bus. The letter indicated that when Mr. Utz used the bus for transportation to campaign events,
the signage would be allowed to remain on the vehicle. If, however, the bus is stored even in an
allowable commercial or industrial district, for the sole reason of displaying the signage, Staff would
consider this a violation of the ordinance as this becomes a portable sign by definition.

The City of Columbia Heights has received some complaints regarding the bus you are
using to publicize your candidacy. The complaints state that you are storing the bus ii
residentially zoned districts. In responding to these complaints, staff has determined that
your bus camlot be parked in residential districts and that the political campaign signs
must also be removed from the sides of the bus.
The Zo>ung Code at Section 9.106 (L)(4)(b) states that parking facilities accessory to
residential uses shall be united solely for the parking of passenger automobiles and/or
one truck not to exceed 9,000 pounds gross capacity. Staff considers the converted
school bus to be a truck, and research reveals that an unloaded school bus is
approximately 20,000 pounds. For this reason, it is unlawful to store the bus in
residential areas. Please refiail from doing so in the future.
The City's Sign Code at Section 9.106 (P)(6)(0) specifically prolnibits portable signage
throughout the city. Staff's interpretation is that the bus is a portable sign, since its sole
purpose is to promote your candidacy. For this reason, you must remove the campaign
signs fiom the bus, as you are in violation of the ordinance.

FZE: Campaign bus usage
Dear City Council,
I have stored a campaign bus on Stinson for several months. I received a letter an
August 18, 2009 dated August 14, 2009 from Jeff Sargent of the Columbia Heights
Community Development department. His letter claimed the bus is in violation of several
ordinances.
I immediately went to the Columbia Heights Community development department to
review the claims Jeff Sargent made in the city letter. Jeff was not available so I had a short
discussion with Scott Clark the department director.
Scott Clark stated he was familiar with the letter, but he could not specifically answer
my questions about the city staff "interpretation" of ordinances. Scott Clark said the city is
responding to complaints by neighbors and to give him a few days to make contact with Jeff
Sargent, the author of the correspondence, who is out of town. Scott Clark stated he would
get back with me aboufi the letter in question, in a few days. I .left my contact information with
Mr. Clark and waited for his reply.
On Tuesday September 1, 2009, or Wednesday September 2, 2009, I received an
anonymous voice mail on my home phone from a Columbia Heights resident "living next to"
the property where the bus is parked. The individual left no name, phone or contact
information. The individual threatened my family with harassing intimidation, promising to
incite vigilantly actions of my neighbors, and now we are seriously concerned for our personal
and property safety.
Yesterday, September 4, 2009; I receive a demand notice letter dated September..3;
2009 from Jeff Sargent, stating I have failed to comply with the previous letter dated August
14, 2009. In contradiction to my personal communications with Scott Clark on August 18,
2009, no follow-up communication from the city has occurred between August 18, 2009 and
yesterday, September 4, 2009, when I received the demand notice from the city development
department.

Today Saturday September 5, 2009 I received a demand notice and threat of citation
from the police department related to my bus issue with the city Community Development
department.
I have copied below the specific ordinance the city employees use to "interpret" the
violation, specifically the permanent signage, on my vehicle. The ordinance referenced
specifically covers buildings and property with-in the city and not decals or lettering on
vehicles.

character of each zoning district, to promote an attractive environment by minimizing visual
clutter and confusion, to minimize adverse impacts on nearby property and protect the public

land uses, except as otherwise prohibited by this Chapter. All signs allowed by this Section

prohibited in all Clistricts unless criteria is presented to allow the Planning
Commission to deers that the sign design preserves and maintains the community's
unique historical and cultural elements. Without restricting or limiting the generality ofi

Our campaign would hope the city council recognizes the aggressive miss application of City
Code and the unsettling concern of special force application by Columbia Heights public
officials. Additionally we are appreciating the proactive actions of our city council to correct

Below is an updated historical chronology of events last week regarding my campaign bus.
Tuesday, September 8, 2009
On Tuesday September 8, 2009 I met with Jeff Sargent at the Columbia Heights Community
Development Department office. We discussed the code interpretation made by the city staffs who
has concluded the following:
1. Any driving my campaign bus, on city streets without driving directly toga political event and
returning to a commercial storage lot, is considered "portable signage" and is subject to the
building/real-estate sign permit zoning ardinance section 9.106. Any personal usage of the bus is
prohibited on public city roads.
2. The staff will meet again to "consider" if I am allowed to drive the bus on public city roads to political
events or general campaign activity. Soon (and not an explicitly defined time) Jeff Sargent will inform
me of the staff decision regarding violation of ordinance section 9.106 referencing general campaign
activity with the bus.
3. Although a sign, bumper stickers on personal vehicles are not considered lettering or signage
under the "staff interpretations" of section 9.106, and thus exempt from such code.
4. Although all commercial vehicles with permanent lettering, typical of my campaign bus, and
personal vehicles using magnetic signage would violate the "staff interpretations" of section 9.106
they are exempt from such code.
5. I stated parking the bus in a commercial lot is reasonable expectation and I would make
appropriate arrangements. But the issue of arbitrary code interpretations specifically applied to my
vehicle, is not acceptable, must be rescinded. If no repeal of the "portable Signage" position occurs, I
intend to discuss in an open public forum at the city council meeting on September 14, 2009, the
abuse of power, and illegal liberties of enforcement the city staff are taking.

6. Jeff Sargent agreed to allow my bus stay parked in the public street at 556 40tH Avenue North East
until Thursday 9/10 or Friday 9/11, when I could make final storage arrangements for the bus in a
commercial parking/storage area.
Wednesday, September 9, 2009
About 8:30 pm I received a voice mail call from officer warning about my bus parked at 556 40tH
Avenue North East. At 9:30 we met at the police station parking lot and during our conversation I
explained how Jeff Sargent provided permission to park the bus at this location while I made
arrangements for permanent commercial parking. Officer stated the he would pass along the
information I provided to the day shift and not to be concerned about the bus parked in the street.
Thursday, September 10, 2009
About 2:OOpm the Columbia hieights police department issued a parking violation to me for parking
my bus on the public street for over 6 hours. Later Thursday 1 approached Jeff Sargent at his office
and asked if he said I could park the bus on 40"'this wdek while I made final parking arrangements, to
which Jeff concurred. 1 then showed Jeff the ticket. Jeff reviewed the ticket, could not explain the
issuance of such as he had talked to the police department earlier in the day today.

This letter is a follow-up to our conversation that we had on the week of September 7tt' I
would like to apologize for any miscominui~ications that might have occurred between
the City a11d you from the time that I wrote the first letter addressing yoiu campaign bus.
At this time, the Coimnunity Development Department would like to reiterate our
interpretation of the signage attached to your bus.
If your bus is parked legally in a conunercialhy or industrially zoned district, and it is
obvious that the bus is not being displayed for the sole reason of promoting your
candidacy, staff's interpretation of the City Code would be that the bus is being used as a
conunercial vehicle and the signage would be permitted to remain. The understanding is
that you would be utilizing the bus for transportation while campaigning, and would store
the vehicle in an appropriate location while not in use.
If at any tune, however, it becomes apparent that yolu bus is being stored in a
corntnercially or industrially zoned district. for the sole plupose of promoting your
candidacy, staff's interpretation of the Code would be that the bus is a portable sign, and
would aslc you to remove the bus from its location. If you have any questions regarding
this letter, please let me lalow. Thank you for your attention to this matter.

At the work session of August 31St, 2009, the final design consultant of SRF reviewed the Gateway
Pedestrian Bridge plans focusing on concept rendering and selection of architectural treatments of the
bridge. Additionally, a bridge lighting plan had been prepared and illustrated to the Council. Final Plan
documents (plans and specifications) were submitted to MnDOT this week for review to meet the
ARRA submittal deadlines. Concurrent with their review, final plans are presented for review before the
council and include:
Bridge aesthetic treatments including: stone treatment of the bridge columns and switchback
columns. The helix is supported by narrower columns and is provided with a color and vertical
recess treatments (drawing attached).
An updated lighting plan for the bridge and both ramp approaches (drawing attached).
Railing details providing color matched (deep burgundy) to the bridge span trusses (drawing
attached).
The statuses of the overall development submittals are as follows:
^ Environmental; approved.
^ Right-of--Way: Order signed by Anoka County judge October 29t" for quick take of Saver's
parcel.
^ Final Plans and Specification submittal: submitted to MnDOT October 28t", 2009. Waiting final
comments for revisions and plan signatures.
One; of the last requirements of the ARRA program under MnDOT is that projects are let prior to the end
of this year. This will require a resolution approving final plans and authorizing staff to seek bids for the
project, with an award date prior to December 31St of 2009. Staff has been in contact with MnDOT
representatives on the bidding climate and they are still seeing bids come it at 10-30% lower than
expected.

The City of Columbia Heights has had a contractual relationship with Honeywell for preventive and
replacement HVAC service since 1992. The original contract included retrofit services for energy
payback as well as preventive maintenance and replacement of equipment. For the past several years,
the contract has been renewed on a year-to-year basis.
An RFP was written to include preventive maintenance and to have emergency service quoted on a time
and materials basis. The intent was. to obtain better pricing by not including equipment replacement and
for the City to start a separate fund for replacement of capital HVAC equipment items in City buildings.
The public facilities in the RFP included: City Hall; Library, Municipal Services Center, Liquor Stores
(3), Pump Stations, Lift Stations, and Park Buildings. Murzyn Hall was not included due to the new
contract with Honeywell. The new Public Safety Building was not included as servicing will be provided
through the Mechanical Contractor through the warranty period and to establish an operating and
maintenance history. In an effort to discern what the marketplace offered for competitive prices, the
RFP was sent out to the following vendors:

7. NSI Horwitz Mechanical Services

A pre-bid meeting was held 9/25/09 for interested parties to clarify any questions they had on the RFP.
Completed RFP's were received 10/21/09 from:

After the initial review of all six RFP's, Trane was eliminated because of the high cost, and Master
Mechanical and Honeywell were eliminated because ofnon-response to portions of the RFP.
Staff put together the following chart to outline the costs submitted by the remaining three vendors for a

In summary, hours to the public were reduced 15% and staffing was reduced 20.07%.
Every staff person had either a schedule change or a reduction in hours worked. In
addition, full-time staff had to take off all vacation earned in 2009 and 80 hours of
furlough each, and permanent part-time staff had to take off all vacation earned in 2009
and a proportional number of furlough hours.
The proposal for the 2010 budget would result in the following amount of staff work

Dear County Auditor-Treasurer or City Clerk:
Minnesota Statutes Sec. 134.34 and 134.341 require that State Library Services,
Minnesota Department of Fd,lcatian certif,~ annually the ~minianuui amount of local
support necessary from your county or city during the next calendar year for continued
participation in your regianal public library system. Your state-certified level of library
support is a minimum level required by state law for the regional public library systems
to continue to receive federal and state aid funds. A county or city may increase support
beyond the minimum amount to meet local library needs and goals. Please note that
regional public library systems, contracts, agreements or budgetary needs may call for
amounts larger than the minimums certified to you by this Office in the enclosed
Certification.
In legislative session 2009, the statutory formula was modified to allow for including the
lesser of the second or third preceding year's "Dollars Provided" for library operating
expenses as reported by the regional public library systems in their application for
Regional Library Basic System Support. For 2010, the revised formula allows for the

The state-certified level of library support is the Iarger amount of:
(1} The lesser of the dollars provided amount for public library service in 2007 or 2008
as specified in M.S. 134.34;

(2} The dollar amount equivalent to the lesser of either:
(a) .82 per cent of the adjusted net tax capacity of all participating areas for the
second preceding year (2008 adjusted net tax capacity, payable 2010, is used for
2010, for example} as specified in Minn. Stat. 134.34, Subd. 1;
(b) $ I 2.65 per capita in 2010 for the population of areas taxed for public library
service as specified in Minn. Stat. 134.34, Subd. 1. Since the estimated population
figures for 2008 had not been released by July 15, 2009, the 2010 state-certified
level of library support calculatians are based upon the 200'7 estimated figures from
the State Demographer.
If a county's or city's 2008 adjusted net tax capacity decreased from 2007, there is also a
provision to allow the results of the lesser of the 2007 or 2008 dollars provided amount to
be decreased by the same percentage that the 2008 adjusted net tax capacity decreased.
Funds raised by cities and counties are counted separately for certification purposes.
Cities receiving county funds for library operations cannot report funds credited to a
county far the city's state-certified level of library support.
Minn. Stat. 134.34, Subd. 1 states that: "In no event shall the Department of Education
require any city or county to provide a higher level of support than the level of support
specified in this section in order for a system to qualify for a regional library basic system
support grant. This section shall not be construed to prohibit a city or county from
providing a higher level of support far public libraries than the level of support specified
in this section."
Recent studies document the increasing use of libraries. The cast of providing library
services to rrzeet these demands is also increasing. In support of local efforts, the State
Legislature also continues to invest in libraries through Regional Library Basic System
Support; Regional Library Telecommunications Aid and statewide programs such as the
Electronic Library of Minnesota (ELM}, Reciprocal Borrowing and Returning, and the
Minitex resource sharing and delivery systems. We thank you for your ongoing support
for this vital local service and encourage you to provide generously to strengthen your
community's information resources. Reductions in library budgets do have an impact on
the quality and quantity of services to the public.

Under local contracts the Columbia Heights Public Library must also meet a per capita
rate for operating expenditures equal to/or greater than that set by the Anoka County
Library for the preceding year. Anoka County Library's projected per capita for 2009 is
$25.38 (levy-only local support). Based on the requested levy for 2010, Columbia
Heights Public Library's total per capita would be $39.87.
The increase from 2009 per capita for CHPL ($30.95) and 2010 per capita for CHPL
($39.87) is large because of the elimination of LGA from the Library's budget. The per
capita is based on the levy-only local support, so as the levy increases to make up the
difference previously supported by LGA, the per capita will also increase.
