Call to Order - The meetillg was called to order by Chair Diehin a~ 6:30 p.m.

Pledge of Allegiance
Nawrocki voiced his displeasure that this special meeting was called without 1~irst polling the
members to see if they were available. Vice Chair Bobby Williams said he called the Special
Meeting because the item being considered tonight needed to be addressed in a timely manner
and this was the only evening a meeting colild be held before the deadline.
Clark also explained that the Board has to approve ~he proposed Resolution and submit a
statement detailing h~w the grant wolild be used by April 10`~' in order to receive the fiinds being
offered to us throiigh the ARRA Grant. He further stated, that other meetin~; agendas were
already full and this was the only night to hold this nleeting.
CONS~NT AGENDA
Approve the Minutes of January 27, 2009 Regular Meeting and Financial Report for the
months of January and February, 2009, on Resolution 2009-04.
Nawrocki questioned what the Uuicorp payment was fc~r. Sheak responded that they did the 5`~'
floor modernization project.
Motion by Nawrocki, secoilded by Ecklund, to approve the consent agenda Items as listed. All
ayes. Motion Carried.
BUSIN~SS ITEMS
Report of Mana~emcnt Companv
Laura Sheak, Manager, asked if there were any questions on the monthly reports that were
included in the agenda packets. Nawrocki asked her about the fire in the south building and why
it wasn't included in the report. She responded that she doesn't ii~clude that information in those
reports, but she u~pdates the Board on those situations verbally as part of her Manager's Repoi~t.
Sheak told the Board that the new computers are in, the cameras I1ave been installed and are
operating, and the St~' floor rei~zodeling is complete. She tl~en informed the Board that the fire in
the sotrtl~ building was caused by careless smoking. There was about $8,000 worth of damage to
the unit, which has been renov~ted and will be ready to rent April 1 st. The tenant in that ttnit was
evicted.

Nawrocki questioned the rules regarding smoking in the building. He would like to see t11e
Residential Council discuss this issue and make a recomnlendation to the Board at the next
meeting. Parkview's Manager stated that some research has beeil done on this and that currently
the leases do not address smoking in the individual ui~its at all. Smoking is prohibited in the
common areas of the building already, but not in tlie individual units. If the policy were to
change to a"smoke free" status for the n~rth bui1di11~, it would need to be submitted and
approved by } IUD. She said the Resident Council and HRA Board could decide to make the
south building "smoke free", as that would not have to go to HUD for approval. She also
advised the Board that if any restrictions are set, the consequences for each violation would need
to be firmly established, so that they woiild have control.
Nawrocki stated he knows other sites have phased in v~rious options to achieve a"smoke free"
building. ~Ie said he isn't making any recommendations on t11is issue, but would like to have
feedback from the Resident's Council.

covered.

Annrov~l of 2009 ARRA C:rant for Canital Activities
Lisa explained that HUD notitied them that the ~~RA of Coluinbia Heights has been awarded a
~rant of $131,959 from the American Recovery and Reinvestment Act (ARRA) of 2009. This is
part of the stimulus package established for public housing projects, and can only be used for
capital improvements. The timeline for obligatin~ and expending the funds has been accelerated
in comparison to other grants. She explained the need to accept the money and siibmit a plan by
April l Ot~' so that work can begin as soon as possible. They expect all the work covered by this
grant to be completed within one year.
The projects may be pulled forward from the PHA's annual plan or new projects may be created
with a requiredl0 day notice. Mauagement is recommending the funds be allocated to exterior
1-ehabilitation (caulking and painting), replacement of the hot water heater, replacenlent of the
controls on the boiler, sidewalk repairs and seal coating the parking lot. There was a discussion
regardin~ the need to have the parking lot seal coated again since it was just done in 2006. Lisa
explained that they siiggested this as a potential item becalise the other work will require heavy
eqliipnlent on site to do the various prc~jects and that rnay make parking lot re-surfacing necessary
again.
In order to receive the fi~ilds, the HRA Board must adopt a resolution accepting AR.IZA funding
for carrying o~tt capital activities at the public housing project, and to slibmit a stateinent defllung
the proposed projects. Staif recommends the HRA Board adopt Resoltiition 2009-03.

Nawrocki asked if we applied fc~r this grant. Lisa stated that no, this was part of Obanla's
Stinlulus Package that was earmarked for Public Housing Buildings. The money was awarded
based on past grants, and projected plans included on the various reports we are required to
submit. He then wanted to know what process would be followed now to obtain contl-actors to
do the work. Lisa informed 11in1 that an architect or consultant would be hired as soon as
possible, per policy, for the purpc~se of writing the specifications, obtaining competitive bids, and
overseeing the projects. She said that~ CommonBond has a bid list they work froin and that they
could also post Requests for Pi•oposals on the League of MN Cities Website. Nawrocki wanted
to make sure thai colnpetitive bids are received to ensure we ~et as much done as possible with
the grant money.
Dielun suggested the Board be updated with a written memo by the end of April stating the
progress made on obtaining bids and scheduling of the projects. Based on the report, there may
be a need tc~ schedule additional meetings to approve bids/contracts for this work.
Lisa pointed out that the funds only cover work on the north building, except for the sidewallc
and parking lot improvemelzts that are cornmon areas for both buildings. Clark felt we shoitld
utilize the architeet/consultant to review and recommend capital improvements that should be
done on the south building at ihe same time. He stated that there is no formal capital
improvement plan in place for the south building at this time and one should be established,
asing the iilformation obtaii~ed in this review.
Motion by Williams, seconded by Kelzenberg, to adopt Resoliition 2009-03, a Resolution of the
Coluinbia Heights Housing and Redevelopment Anthority (HRA) confirming acceptance of the
2009 ARRA fiinding and au~thorizes the proposed uses of such fiinds. All ayes. MOTION
PASSED.

ASSISTANCG
WHEREAS, the City of Col~~mbia Heights Nousing and Redevelopment Authority and HUD have entered into a
Ca~pital Fund ACC ~mendment for the American Recovery and Rei~~vestment Act (ARRA) Formula Grant for 2009
for the purpose of carryipg out capital activities at their p~iblic housing developments.
NOW THEREFORE, B~ IT RESOLVED, The Ciry of Columbia Heights Housing and Redevelopment Autharity
authorizes the Executive Director, to accept 2009 ARRA fui~ding and authorizes the proposed uses of such funds.

RESOLUTION OF THE COLUMBIA HEIGHTS HOUSING & REDEVELOPMENT
AUTHORITY (HRA) APPR4VING THE FINANCIAL STATEMENT FOR, MARCH,
APRIL, MAY AND JUNE OF 2009 AND PAYMENT OF BILLS FOR THE MONTHS OF
MARCH, APRI~, MAY AND JUNE OF 2009.
WHEREAS, the Columbia Heights Housing and Redevelopment Authority (HRA) is
required by Minnesota Statutes Section 469.096, Subd. 9, to prepare a detailed
financial statement which shows all receipts and disbursements, their nature, the
money on hand, the purposes to which the money on hand is to be applied, the HRA's
credits and assets and its outstanding liabilities; and
WHEREAS, said Statute also requires the HRA to examine the statement and
treasurer's vouchers or bills and if correct, to approve them by resolution and enter the
resolution in its records; and
WHEREAS, the financial statement for the months of March, April, May and June of
2009 and the list of bills for the months of March, April, May and June of 2009 are
attached hereto and made a part of this resolution; and
WHEREAS, the HRA has examined the financial statement and the list of bills and finds
them to be acceptable as to both form and accuracy.
NOW, THEREFORE BE IT RESOLVED by the Board of Commissioners of the
Columbia Heights Housing & Redevelopment Authority that it has examined the
attached financial statements and list of bills, which are attached hereto and made a
part hereof, and they are found to be correct, as to form and content; and
BE IT FURTHER RESOLVED the financial statements are acknowledged and received
and the list of bills as presented in writing are approved for payment out of proper
funds; and
BE IT FURTHER RESOLVED this resolution and attachments are to be made a part of
the permanent records of the Columbia Heights Housing & Redevelopment Authority.

The following comments were given by Parkview North residents:
1. Since smoking outside the building creates smoke that drifts in through the
windows, I would prefer that outside smoking be restricted to the park, across the
parking lot, or anywhere else that is not in the vicinity of the building. ~
2. I feel that anyone that wants to should be able to smoke wherever they want to. I
feel that the non-smokers can be in an area away from the smoke if they choose to
do that. They would not have to be by someone that smokes if that is what they
want. By the way I am not, nor, have I ever been a smoker.
3. Once there was so much smoke in my apartment the air was hazy and it was
difficult to stay in it (the month was December)! T'hank you for finally addressing
this issue!
4. People who live here and smoke can go outside away from the building, and
smoke. Most of the time I have second-hand smoke from the guy across the hall.
He "stinks" up the halls and my kitchen, ha11, and sometimes my bedroom. I also
get smoke through the bedroom vent. My other challenge with smokers is smoke
in my bedroom at night. In the sumrner, folks sit outside under the overhang and
smoke up a cloud of the stuff. The odor comes into my bedroom via the open
window. Sometimes people smoke outside at 3:30 a.m.! It stinks!
5. I do wish they would stay further away from the entrances. Th~ smake caming in
and out of the building is bad.
6. I feel that to not smoke in or out of your apartment, or the building is an
infringement on a persons rights. Certain people here in the building always want
to dictate to the rest of the tenants-if they want a"smoke-free" building let them
move to one that has that policy.
7. I feel that people should be able to smoke in their apartments and if you want
people not smoke outside.
It's really a choice that people make. No it's not healthy, but people that do
smoke what to let us be privileged to smoke. New people no smoking if they think
everyone happier. Keep peace.
9. I think that second-hand is bad. I feel that have some rights also. Thanks for
asking.
10. Again this is a free county. Smoke or don't. Whatever.
11. I think smoking should not be allowed in indoor common areas. If persons want
to smoke in their apartrnents that should be their choice. Enough choices are taken
away all ready.

problems like sneaking smokes-or anger between smokers and non-smokers or
smoking in the stairwells. I t~iink sneaking smokes would create a greater fire
threat to the buildin;g than letting people smoke in the privacy and safety
(sprinkler system & fire doors) of their own unitso This is a small community-an
US vs. THEM would be a very bad idea.

14. They should not be allowed to smoke inside the unit or outside. The people who
smoke is putting everyone else's health at risk.
15. I want a clean fresh air in my home. Please make me a healthy tenant. Without
you-this will not pass the bill. It has to pass the government bill first please

16. Just outside door, winter you know months. Amen Amen. Maybe build a kind of
outdoor ventilation shed. Ventilation is important. A fan set at a certain setting in
the units by a slightly cracked open window-the living room picture window on
a small coffee table with lounge chair nearby. Basically said, some stuff in the
kinda latter years of living life is needed due to anxiety, stress, etc somehow
sometimes.

19. I think it would benefit smoker to try and quit and better for their health and they
would save lots of money. Maybe you could get support groups for people who

1. Yes and no-I think that because they have been here for years. I want them to be
here more years to come. Certain areas allowed for everyone. I have a strong
allergy to smoke.
2. We don't feel we have the right to tell someone how to live their lives.
3. I don't think anyone on oxygen should be smoking. I do not like cigarette butts
thrown on the grounds near the building.
4. No, I think if it's going to be smoke-free building ther~ only smoking should be
allowed outside on other side of parking lot.
5. Also they put their butts on the ground. Not good.
6. Yes do not admit smokers.
7. No smoking.
8. I have only been here a short time and have experienced one fire here due to a
srnoker and it was very upsetting. At time the srnell of smoke is so bad on my
floor I have to put a towel at the door. Second hand smoke is so harmful. Please
make this a smoke-free building. There may be some smokers who move out
because of this. But think of how much safer and how much better the building
would smell. I know of another senior building that has gone smoke-free. Some
may feel this is taking away their right-well what about my rights to live safe
and breathe clean air.
9. The smoke comes from under the doors of the units and sometimes the doors are
propped open. This should change!
10. I am allergic to tobacco smoke. Therefore I do not sit outside because of people
smoking there.
11. I have iwo husbands die from smoked related problems.
12. Their needs to be a date set for the entire building to be smoke-free or it will take
many years for current resident to either move out or die. Because of the age of
residents here-ranging from young to old you need a specific date to go smoke-
free. Otherwise, it cannot be marketed as a smoke-free building. The senior (south
side) should be all smoke-free. It is a sign of the times and something we deserve!
Someone could fa11 asleep and start a fir~ while smoking.
13. If smoking would be allowed on only some floors the smoke odor would still
spread through the air to other floors and through the elevator. I live in fear of a
fire starting on the south side is someone fell asleep while smoking. We
experienced one fire, which could have been a disaster for all residents. I believe
that second-hand smoke is very harmful and dirty. Smoke is very dirty and how it
gets into the walls, woodwork, carpeting, etc. When a smoker opens their door,
the odor gets out and goes into other apartments. Going smoke-free is a"sign of
the times".
14. Residents that use oxygen should not be allowed to smoke in the aparl~nents.
15. If people want to smoke in their unit is should be their decision. I don't want it in
my unit.
16. My visitor never smoke in my apartrnent I da not want this in my apartment.

BACKGROUND:
On December 4, 1996 the City's Economic Development Authority entered into an Agreement
(pertinent pages attached) for a site lease with T-Mobile for 250 sq. ft. of rooftop space at
Parkview Villa. This Agreement's original base lease was $12,000 and escalates annually, per
provisions in Section 2 a. (the 2009 paid lease was $19,212.38.). The lease has renewal terms,
(Section 4), and the current five-year renewal term expires on January 1, 2012. T-Mobile wants
to renegotiate a new lease based on a changing economy. Attached is a letter dated June 12,
2009 that outlines two options for consideration, these are:
1) A base of $17,000 per year starting on 9/10/09 for four years then a 5% rent increase
every five years starting on 9/10/2014 until 9/10/2027. After 9/10/2027 a rent holiday
until 9/10/2034 (which means no rent paid during that time}
2) The alternative would be a lump-sum payrnent of $110,000 in exchange for a 15-year
lease assignment. Staff has calculated that based on a 4 percent interest rate that
the future ten-year value would be $ 162,826.
Staff does not recommend entering into a new negotiation at this time. The key question is if T-
Mobile elects to terminate their lease, will there be another carrier that will take its place for an
amount that is equal to or higher than the newly offered rates? Staff seeks discussion and
direction on this lease proposal.

a• Amount, Adiustr.lents. As consideration far this Lease, Tenant shall pay Lan~lord
an annual rent in the amount of Twelve Thousand DoIlars ($1?,000.00) for the initial year, ~:nich
shall be increased each year an January 1, by tne greater of: (i} four percent (4%) of the pre~•ious
year's annualized rental, or (ii) by an amount equal to the inerease in the Consumer Price IndeY
("CPI")• The CPI shall mean the "Consumer Price Index for All Urban Consumers, :41I Cities,
All Items (1984 = 100)" as published by the United States Deparnnent of Labor Statistics. or if
such index shaIl be discontinued, the successor index, or if there shall be no successor inde~.
such compa~ abie index as mutually asreed upan by the parties. To determine the annual rental
increase to be paid by Tenant under a CPI adjuster, the annualized re.ntal for the previous ~•ear
shail be multiplied by a percentase fiaure, computed from a fraction, the numerator or which
shall be the CPI for the third quarter of the preceding year and the denominator of which shall oe
the CPI for the corresponding quarter of one year earlier. Such fraction shall be conve:ted to a
percentaQe equivalent. The resulting percenta~e fixture shall be multiplied by the previous ~~ear's
rent (annualized far the first year, see parasraph 4 below).
b. Time of Pavment Taxes. Landlord shalI communicate ali rentaI increases to the
Tenant in writinQ by the preceding December 1 of each year. The rental shall be paid annuallv in
advance beQinnins ten (10) days after the Commencement Date for the first year and thereafter
on the First (151) day of January. In addition to the annual rental, Tenant a~ees to timelv pati• its
pro rata share of any taxes or payment in lieu af taxes required as a result of this Lease.
~• GovernmentaI Aaoroval Continvencv.
a. Tenant A~~Iication. Tenant's riaht to use the Leased Premises is expressly made
contingent upon its obtaining aIl the certificates, permits, zoning and other approvals that ma~• be
required by any federal, state, or local authority. This shall include the engineering study
specified in subparagraph 3(b) below on the Property to be conducted at Tenant's expense.
Landlord shall cooperate with Tenant in its efforts to obtain and retain such approvals and shall
take no action which would adversely affect the status of the Leased Premises with respect to the
Tenant's proposed use thereof.
b, Interference Studv. Before obtaining a building permit, Tenant must perform a
radio frequency interference study showing that Tenant's intended use will not interfere with any
e~sting communications facilities and an engineering study showing that the building is able to
support the Tenant's antenna facilities, as defined in subparagraph 5(b}, without adversely
affecting the City's use of the property. This radio frequency interference study shall be
performed by an independent radio consultant, approved by Tenant and Landlord, which
approval shall not be unreasonably withheld ar delayed, and sha11 be the final authority relating
to interference studies. The independent radio consultant must be a registered electrical
professional engineer in the State of Minnesota. If the study finds that there is a potential for
interference that cannot be reasonably remedied or for prejudice to the property, Landlord may
terminate this Lease immediately and refund any initial rental payment to Tenant.
c. Non-A~proval. In the event that any applicatian necessary under subparagraph
3(a) above is finally rejected or any certificate, perrnit, license, or approval issued to Tenant is
canceled, expires, lapses, or is otherwise withdrawn or terminated by governmental authority so
that Tenant, in its sole discretion, will be unable to use the Leased Premises for its intended
purposes, or if an interference or engineering study, whether conducted pursuant to subparagraph
3(b) above or otherwise, should indicate, in Tenant's sole discretion, that the Leased Premises are
unsatisfactory for Tenant's intended use, Tenant shall have the right to terminate this Lease and
be reimbursed for any rental payment previously made. Notice of Tenant's exercise af its right to
terminate shall be given to Landlord in writing by certified mail, return receipt requested, and
shall be effective upon receipt of such notice by Landlord as evidenced by the return receipt.
Except as required under subpasagraph 13(d) below, upon such termination, this Lease shall
become null and void and the parties shall have na further obligations to each other.
4. Term and Renewals. The "Initial Term" of this Lease shall commence on the date on
which all conditions precedent detailed in Exhibit C have been met ("Effective Date") and end on
December 31 of the fifth calendar year of the Lease. Subject to the terms and conditions of this
Lease, Tenant shall have the right to extend this Lease for three (3) additional five (5) year
renewal periods ("Renewal Term"} commencing on January 1 following the expiration date of
the Initial Term or of any subsequent Renewal Term. This Lease shall be automatically renewed
for each successive Renewai Term unless Tenant sends written notice of non-renewal to
Landlord no later than ninety (90) days prior ta the expiration of the Initial Term or any Renewal
Term, such notice provided in accordance with paragraph 21 of this Lease.
5. Tenant's Use.

~. Events of Termination. Except as othenvise provided herein, this Lease may be
.ed by either party upon sixty (60) days' written notice ta the other party as follaws:
(i) By either party upon a default af any covenant or term hereof by the ather
party, which default is not cured within sixty (60) days of receipt of
written notice of default to the other party (without, however, limiting any
other rights of the parties pursuant to any other provisions hereof~; and
(ii) By Tenant for cause if it is unable to obtain or maintain any license, permit
or other governmental approval necessary for the construction and/or
operation of the Antenna Facilities or Tenant's business; and
(iii) By Tenant for cause if the Leased Premises is or becames unacceptable for
technological reasons under the Tenant's Antenna Facilities, design or
engineering specificatians or the communications systems to which the
Antenna Faeilities belong.
b. Notice of Termination. The parties shall give notice of termination in writing by
certified mail, return receipt requested. Such notice shall be effective upon receipt as evidenced
by the return receipt. All rentals paid for the Lease prior to said termination date shall be
retained by Landlord.
~~ c. Tenant's Liabilitv for Eariv Termination. If Tenant terminates this Lease other
than for cause or of right as provided in this Lease, Tenant shall pay to Landlord as liquidated
darnages for early termination, 100% af the annual rent for the year in which Tenant terminates,
unless Tenant terminates during the last year of any Term under paragraph 4 and Tenant has paid
the annual rental for that year.
d. Site Restoration. In the event that this Lease is terrninated or not renewed, Tenant
shall have sixty (60} days from the terrnination or expiration date to remove its Antenna
Facilities and related equipment from the Leased Premises and repair the site. In the event that
Tenant's Antenna Facilities and related equipment are not removed to the reasonable satisfaction
of the Landlord, they shall be deemed abandoned and become the property of the Landlord, and
Tenant shall have no further rights thereto. Tenant has notified the Landlord that the following
entities have an interest in the Antenna Facilities and related equipment because of financing
arrangements:
None
If Landlord removes the Antenna Facilities or related equipment, Landlord must give written
notice to the above entities at the addresses provided, informing them that Antenna Facilities or
related property have been removed and v~~ill be deemed abandoned if not claimed and the
storage fees and other reasonable costs paid within thirty (30) days.

BACKGROUND:
At the present time staff has no authority for potential rent increases in January of 2010 and
views that this should be an agenda item for the October meeting. Any rental increase should
be looked at as the need to capture increased operating costs and the need to adequately
cover capital improvements. In light of this objective, staff has worked with CommonBond to
develop a twenty-year Capital Improvement Plan that illustrates future needs. The
presentation of the Plan is for discussion purposes only and as such, no action needs to be
taken.
