The subject parcel is also located within the Design Overlay Central Business District, a.nd is subject the regulations for such properties. The City Code at Sectian 9.106 (P}(11} states that manumelat signs in the CBD District shall be liinited to 40 square feet per side, epght f~~t in height, azld sl~all be set back a minimum of five feet from all praperty iines. The propased monument sign incorporates intemally lit routed letters, which is consistent with the intent of the Design Guidelines. FINDINGS OF FACT Site Plan Approval Section 9.104 (IVn requires that the Plaruung and Zoning Commission shall make each of the following findings before approving a site plan: i. Where the amendment is to change the zoning classification of a particular property, there has been a change in the character or trend of development in the general area of the property in question, which has taken place since such property was piaced in the current zoning classification. It is unclear as to why the property was originally zoned LB, Limited Business. It is conceivable that the intersection of 44th Avenue a~~d University Avenue could be redeveloped into a commercial entity, and that the property at 4337 University 14venue was included in the LB District ta ensure that enough land was set aside for such a development. With that said, the property directly to the noYth is used for multi family residency, and the lzkelihood of that intersection being redeveloped is slim. The change in the t~-end of development is that redeveloprnent of the area into a conforming use is not likedy to occur. Public Hearin~ Opened: Michelle Ballentine who recently purchased 4334 4~' Street spoke in favor of the re-zoning. She felt the property should be zoned in a Residential category and would not support the site being used as a business. She stated that a business at that location would be an inconvenience for everyone eise in the neighborhood due to access issues and the fact that all of the surrounding properties are aiso used as residential. Public Hearing Closed. Motion by Peterson, seconded by Schmitt, that the Planning Commission recommend the Ciry Council approve the rezoning of the property located at 4337 Ilniversity Avenue from LB. Szurek stated she also thought the area looked cluttered and that it should have been placed a little further south on the property. Sargent agreed these ~re all valid paints, but the sign is already in plaee. These standards state the fallowing: a) The autdaor sales/display use shall be accessory to a commercial use. The outdoor sa/es will be accessory to the hardware stare use, which is permitfed in the GB, General Business District. b} All outdoor sales/display areas shall meet the setback requirements for a principal structure in the zoning district in which it is lacated. The setback requirements in the GB, General Business District are as follows: Front Yard: 15 feet Side Yard: nane Rear Yard: 20 feet The proposed display area will be placed in front af the store and will occupy nine (9) parking staNs. The display location will meet all minimum setback requiremer~ts. c) Outdoor sales/display areas within the public right-of-way are prohibited. The purpose of the madification io the district ~s to utilize the ur~lirnited ~ooling allowancz to generate fund balances from the District. These funds will be used as seed money to create a new scattered site TIF District throughout the City of Columbia Heights. It is anticipated that the money generated from the University Heights TIF District would allow the City to purchase up to 20 houses that are severely blighted and/or functianall_y obsolete. The plan would be to tear down dilapidated single-family homes and rep{ace them with new single-family hames at a later date. The Public Hearing to approve the expansion af the TIF District is set for June 8, 2009. Prior to this Public Hearing, Minnesota State Statutes and TIF law requires an approved Resolution from the Planning Commission ensuring that the land use resulting from the expansian of the TIF district conforms with the City's Comprehensive Plan. ~t3liiiPREFiEi~iS1~~iE ~L~iP~i lt is anticipated that the ~ity will purchase single-~Family h~me~ in areas throughaut the City in which ~he Cornprehensive Plan guides fior Residential use. For this reason, the teardown and reconstruction of nevv single-family homes would be cansistent with ~he City's Camprehensive Plan. City of Columbia Heights Planning Commission June 2, 2009 University Heights TIF District Modification Case # 2009-0603 RECOMMENDATION Motion: That the Planning Cammission approves Resolution 2009-PZQ8, finding that a modification ta the Downtown Central Business District (CBD) Revitalization Plan for the CBD Redevelopment Project and a modification to the Tax Incrernent Financing plan for the University Avenue Redevelapment (C8) Tax Increment Financing District conform to the general plans far the development and redevelopment of the City.
