CITY COUNCIL MEETING
OCTOBER 13, 2008
The following are the minutes for the regular meeting of the City Council held at 7:00 p.m. on Monday,
October 13, 2008 in the City Council Chambers, City Hall, 590 40th Avenue N.E., Columbia Heights,
MN.
CALL TO ORDER/ROLL CALL/INVOCATION
Present: Mayor Peterson, Councilmember Williams, Councilmember Nawrocki, Councilmember
Kelzenberg
Absent: Councilmember Diehm
Invocation by Rev. Ruth Hograbe, Community United Methodist Church.
PLEDGE OF ALLEGIANCE -recited.
ADDITIONS/DELETIONS TO MEETING AGENDA
Mayor Peterson stated that Fire Chief Gorman has requested to speak under Presentations. There
will be notices of fund raisers.
Mayor Peterson removed Resolutions number 2008-232, 234, 235, 237, 239, 240, 241, 244, and 251,
as these properties have been brought into compliance.
Mayor Peterson stated that Councilmember Diehm contacted him, indicating that because of a
family commitment she would not be present at the meeting, and by her request that item 6B - 1st
reading of Ordinance No. 1559 relating to abandoned property be removed from the agenda to a later
date when she can be present for the discussion..
Nawrocki requested to have discussion on the Sullivan shelter, 40`" and Central office building, and
the October 6`" work session. He requested to remove from the consent agenda items H, I, J, N, and
R be removed for discussion.
PROCLAMATIONS, PRESENTATIONS, RECOGNITION, ANNOUNCEMENTS, GUESTS
A. Proclamation -Polish American Heritage Month
Mayor Peterson read the proclamation and prese~ited it to the Coluiizbia Heights Sister City
committee.
Dolores Strand, Gloria Bergstrom, Ed Skorski, Marion Bernard, and Dorothy Penate, members
of the Sister City Committee, accepted the proclamation. Strand referred to the Polish. students
that will visit us next year. Bergstrom indicated she was a chaperone for our group that visited
Poland. The communication between the students continues. It was a wonderful experience.
Strand indicated that Logacz delivered a $4,000 check from the Sister City committee to the
Lomianki Children's Hospital. Penate indicated that the hospital would purchase two new horses
for their therapy program. Peterson thanked them for their work in the Sister City organization.
With the nine students coming, the committee will need to raise funds for their visit; any
donations would be appreciated.
Peterson stated that. on Saturday, October 18, at VFW Post #230, there will be a Booya feed as a
fundraiser for the Fire Explores. Also, there is a dinner fundraiser at Community United
Methodist Church.

Nawrocki stated that there would be a fundraiser for SACA at the Fridley KC hall. Tickets are to
be purchased by this Thursday.
CONSENT AGENDA
City Manager Walt Fehst took Councilmembers through the Consent Agenda items.
A. Approve the minutes of the September 22, 2008 Columbia Hei htg s City Council meeting.
Motion to approve the minutes of the September 22, 2008 Columbia Heights City Council

B. Accent Board and Commission minutes
Motion to accept the September 2, 2008 minutes of the Library Board meeting.

C. Approve Premises Permit Application for Columbia Heights Athletic Boosters to conduct
charitable gambling activities at Top Valu Liquor I and II and Sarna's Tobacco Shoppe and
Sarna's Classic Grill
Motion to direct the City Manager to forward a letter to the State Charitable Gambling Control
Board stating that the City of Columbia Heights has no objection to the issuance of a Class B
premises permit for the Columbia Heights Athletic Boosters Club in conjunction with activities
at Top Valu I (4950 Central Avenue NE) and II (2105 37th Avenue NE), Sarna's Tobacco
Shoppe (4329 Central Avenue NE) and Sarna's Classic Grill, (3939 University Avenue NE), and
furthermore that the City Council hereby waives the remainder of the sixty-day notice to the
local governing body.
D. Approve the transfer of funds from the General Fund to Police Department Budget to Reimburse
Overtime Fund re: Detox transports.
Motion to transfer $390 received from Anoka County for partial reimbursement of costs
associated with Detox Transports from the General Fund to the Police Department 2008 Budget
under line item 1020, Police Overtime.
E. Approve the transfer of fiords from the General Fund to Police Department Budget to Reimburse
Overtime Fund re: Anoka County DWI Task Force.
Motion to transfer $4,500.93 received from the State of Minnesota as reimbursement for our
participation in the Anoka County DWI Task Force to the Police Department 2008 Budget line
item 1020, Police Overtime.
F. Approve the transfer of funds from the General Fund to Police Department Budget to Reimburse
Overtime Fund re: Off-Duty Employment Assignments.
Motion to transfer $1,130.04 received from Unique Thrift Stores and $1,565.20 received from
Northeast Metro 916 for a total of $2,695.24 from the General Fund to the Police Department
2008 Budget line item 1020, Police Overtime.

G. Adopt Resolution No. 2008-254 being a Resolution approving the final plat for 825 - 41st
Avenue and Resolution 2008-259 approving vacation private drainage and utility easements.
Nawrocki indicated his past comments on this resulting in a dead-end street. There is not a turn
around there.
Motion to waive the reading of Resolution 2008-254, there being ample copies available to the
public.
Motion to adopt Resolution No. 2008-254, approving the Final Plat for the Public Safety
building located at 825 - 41st Avenue.
Motion to waive the reading of Resolution 2008-259, there being ample copies available to the
public.
Motion to adopt Resolution No. 2008-259, approving the vacation of certain private drainage
and utility easements fully contained within Lot 1 Block 1 Northwestern 2"d Addition.
H. Authorization to obtain price quotes for Rrinting and mailing the 2009-2010 City newsletters -
removed for discussion
I. Establish City Park Rental Fees -removed for discussion
J. Establish City Event Wagon Rental Fees -removed for discussion
K. Approve final payment for the Zone 2 and 3 Street Rehabilitation Projects (0702)
Motion to accept the Engineer's Report of Final Acceptance for the 2007 Street Rehabilitation.
Projects in Zone 2 and 3, City Project Number 0702, and authorize Final Payment of
$103,102.03 to Midwest Asphalt Corporation of Hopkins, Mim~esota.
L. Adopt Resolution 2008-231, being a Resolution ordering reparation of a Feasibilityport for
Zone 1C and 3B Seal Coating, City Project #0901
Hansen indicated the areas involved; streets north of 49t" between Central and our east border,
and three streets east of Central will be included.
Motion to waive the reading of Resolution 2008-231, there being ample copies available for the
public.
Motion to adopt Resolution No. 2008-231, being a Resolution ordering the preparation of a
report for proposed Zone 1 C and 3B Street Seal Coat Program, Project #0901.
M. Adopt Resolution 2008-230 being a Resolution ordering_preparation of a Feasibilit~eport for
Zone 4 Street Rehabilitation Program•
Hansen indicated this is an annual program in the second cycle and listed the areas, including
streets that did not previously have work completed.
Motion to waive the reading of Resolution No. 2008-230, there being ample copies available for
the public.
Motion to adopt Resolution No. 2008-230, being a Resolution ordering the preparation of a
feasibility report for Zone 4 Street Rehabilitation Program.
N. Authorize staff to seek bids for a picnic shelter at Huset Park (west) -removed for discussion

Motion to approve the Development Contract between the City of Columbia Heights and New
Perspectives for the Hart Lake Addition..
P. Approval of the attached list of rental housing license applications, in that they have met the
requirements of the Residential Maintenance Code.
Motion to approve the items listed for rental housing license applications for October 13, 2008.
Q. Approve the Business License Applications
Motion to approve the items as listed on the business license agenda for October 13, 2008 as
presented.
R. Approve payment of the bills. -removed for discussion.
Motion by Williams, second by Kelzenberg, to approve the Consent Agenda items, with the
exception of items H, I, J, N and R. Upon vote: All ayes. Motion carried.
H. Authorization to obtain price quotes for printing and mailing the 2009-2010 City newsletters
Nawrocki stated that the newsletter has gotten pretty exotic. We have a person prepare the copy
and in a time of looking at expenses, we need to look at this and cut back. We print out many
more than needed as 3,000 copies are handed out in the schools and to student homes in the
Fridley area. We used to assemble them ourselves and took them to a printer. They did not have
a multi-color print. We should just strive to get the information out to the people of the
community. Fehst stated that we have received a lot of feedback on the quality of the newsletter.
He suggested a motion to quit printing the newsletter and only place it on line. Nawrocki
indicated many residents do not have Internet access. The budget article in the next newsletter is
woefully inadequate and does not include the HRA levy and the County EDA/HRA levy. Keith
Windschitl, Recreation Director, indicated the request is to seek bids on the current type
newsletter, as this new style is more readable. We mail to all 55421 zip code and must give the
mail carriers enough newsletters to fulfill their route. Nawrocki stated that you can limit areas
and do not need to do the entire 55421 zip code. Windschitl indicated the survey completed by
the schools indicated the newsletter to be very highly read by the community.
Kelzenberg stated that the new format is a lot better than it used to be and is easy to read. The
Fridley recipients are involved in our recreation programs. Nawrocki stated that Fridley is not
helping to pay for the cost.
Williams stated the request is for a price quote and asked that a "plain Jane" price be received
also.
Motion by Williams, second by Kelzenberg, to authorize staff to obtain price quotes for printing
and mailing the 2009-2010 "Heights Happenings" city newsletters.
Motion to amend by Nawrocki to do the newsletter "in-house" as in the past.
Williams asked to receive the amount of staff time and cost it would take to do this in-house.
Nawrocki asked for the prices to mail without the Fridley and St. Anthony addresses.
Peterson called for a second of the motion to amend. Motion died for lack of a second.
Upon vote of the original motion: Kelzenberg, aye; Williams, aye; Nawrocki, nay; Peterson, aye.

Nawrocki. stated he would like to see the budget newsletter article be more comprehensive. The
utility rate increase is not included. He stated he is unhappy that we are not having meetings on
the budget until Wednesday, October 29, the same day as the Anoka County officials meeting.
Establish City Park Rental Fees
Nawrocki stated a strong disagreement with this. Most ball park usage does not have fees and
they require clean up. People pay taxes to pay for the park. Fehst stated that anyone can use the
shelters for free, but if you want to reserve the shelter you can pay $30 plus tax for exclusive use.
Nawrocki questioned if the Huset Park volleyball area can be reserved. Windschitl indicated it
can be reserved.
Williams reiterated that anyone can use the park free, but if you wish to reserve the shelter the
fee is fair. Windschitl indicated. that the Park and Recreation Commission recommended the fees,
which will be used for renovations, cleanup and maintenance of the facilities. Marsha Stroik is
present from the Park and Recreation Commission. Nawrocki stated he has no problem with the
non-resident fee. There has not been a reduction in the budget to compensate for additional
revenues.
Marsha Stroik stated that as commission members they take their position seriously. Looking at
the budget, this is an effort to hold down some costs. We have all paid to use facilities in other
communities and do not mind. We are trying to keep the city solvent and keep the parks nice.
Motion by Williams, second by Kelzenberg, to adopt the Park Rental Rates, as outlined by the
Park and Recreation Commission at their meeting of June 25, 2008. Upon vote: Nawrocki, nay;
Kelzenberg, aye; Williams, aye; Peterson, aye. 3ayes - 1 nay. Motion carried.
J. Establish City Event Wagon Rental Fees
Nawrocki stated that the VFW donated the money to buy the wagon and it provides a good
service. Some equipment does need replacing, but we are using second hand items. When you
tell people you will keep property taxes down and then put fees in place, you are just getting
another type of tax.
Kelzenberg questioned the number of rentals. Windschitl stated there are about 25 rentals a year.
We deliver the trailer. It has tables, chairs, and some play equipment. The Park and Recreation
Commission recommended the fee to offset maintenance, staff costs, and fuel. Kelzenberg stated
he was amazed that this service was free, and is amazed the recommendation is only $25.
Williams stated that the $25 does not cover our cost. Windschitl stated the trailer was purchased
in 1999.
Motion by Williams, second by Kelzenberg, to adopt the Event Wagon Rental Rate, as outlined
by the Park and Recreation Commission at their meeting of June 25, 2008.
Dorothy Penate, 4900 Jackson, stated she would gladly pay the cost of the event wagon and
would gladly pay the park shelter fee as families are thrilled. to use them. The charges are
minimal.
Upon. vote: elzenberg, aye; Williams, aye; Nawrocki, nay; Peterson, aye. 3ayes - 1 nay. Motion

Peterson stated that we try to balance the budget the best we can. There is a lot of discussion at
budget time and Park and Recreation Department gets picked on quite a bit. The commission is
seven members of the community that try to find ways to reduce the budget. Peterson stated that
he would like to provide everything for nothing, but unfortunately all services come with a cost.
Peterson stated that the Commission. discussed this very seriously and. he thanked them for the
thankless job they do.
N. Authorize staff to seek bids for a picnic shelter at Huset Park (west
Nawrocki again referred to cutting back on expenditures for the city. We have a shelter there
now. The new shelter would be nice, but it is nice to live within the means of the taxpayers.
Peterson stated that this expenditure was an approved item in the last budget. Williams stated we
have done so many improvements to the park, it would be a crime not to have a nice shelter
there. Kevin Hansen, Public Works Director, stated this was budgeted for in 2007 and 2008. The
Park and Recreation Commission reviewed this and felt it appropriate to recommend the
expenditure. This could lessen the extensive use of Murzyn Hall and would be similar to the
Sullivan shelter.
Nawrocki stated that this would tell taxpayers it would cost them $85,000 to build the shelter and
then there would be a fee to use it.
Williams stated that residents pay only if they want to reserve a shelter. Hansen stated the funds
would be from the Park Development Park Dedication Fee. Park dedication fees are for
additional demands by a new development. Nawrocki referred to the cost of the Murzyn Hall
upgrade. Williams stated that we are not increasing taxes because of the Murzyn Hall renovation.
Energy consumption will reduce the cost, and it guaranteed. Nawrocki stated that the renovation.
would not reduce staff time. Peterson stated that we have a staff person that currently spends the
majority of his time maintaining the substandard building and this may allow him to maintain the
other city buildings.
Motion by Kelzenberg, second by Williams, to authorize and direct staff to seek bids for a new
picnic shelter at Huset Park West.
Terry Barber, X040 2°d Street, asked if this is in the budget. Peterson stated it is in the current
2008 budget. She stated that we are in an economic crisis and people are losing their homes.
These expenses could be put on hold.
Penate stated that our taxes are one-half of what they are in Wisconsin because we receive the
homestead break.
Williams stated this money comes from park dedication fees when the development was built
and the money was approved in 2007. Hansen stated the park improvement fund is restricted by
State Statute and limited to park improvements, not ongoing maintenance. Williams referred to
the Wargo donation of $50,000 for the maintenance of Wargo Park.
Nawrocki referred to the difference of funds for the Huset shelter and Murzyn Hall
improvements. He again requested to use park improvement funds to pay for the Murzyn Hall
improvements for the first couple years.
Upon vote: Kelzenberg, aye; Williams, aye; Nawrocki, nay; Peterson, aye. 3ayes - 1 nay.

Motion carried.
R. Approve payment of the bills.
Nawrocki stated one payment is to Auto World through a contract and he may want to abstain
from this vote.
Motion by Nawrocki, second by Kelzenberg, to approve the payment of the bills out of the
proper fund as listed in the attached register covering Check Number 127459 through Check
Number 127687 in the amount of $1,816,025.81. Upon vote: Kelzenberg, aye; Williams, abstain;
Nawrocki, aye; Peterson, aye. 3ayes - 1 abstention. Motion carried.
Peterson asked Chief Gorman to make his announcement now.
Fire Chief Gorman stated that Saturday was the Fire Department open house, with one of the
biggest crowds ever in attendance. He thanked the businesses that donated to the event: Heights
Bakery, Auto World, Coke, Old Dutch, Tasty Pizza, and the Fire Association. This would not be
possible without them. Next year we may have our open house in our new building.
Peterson asked that a letter be drafted to thank these groups for their donations.
PUBLIC HEARINGS
A. Adopt Resolution 208-228, being a Resolution to adopt an Assessment Roll and Levv a Special
Assessment for Delinquent Charges
Bill Elrite, Finance Director, indicated the assessments are for items such as weed removal, tree
removal, and abatements. Fehst stated one assessment was for mercury removal, some are banks,
and some are for grass cutting. We try to reach the banks or companies that own the property to
clean up the property and if they do not, we do it. Seniors in the community that keep up their
property complain to us about the unkempt and abandoned properties.
Williams asked Hansen to again explain park dedication fees, and indicated that the Huset Park
shelter is not a taxable item. Fehst stated that all first ring cities have park dedication fees larger
than ours. Developers are required to contribute, as the site would put an additional burden on
the system. Williams stated that his business had to donate land. Hansen. stated it can be a cash or
land donation. Nawrocki again stated that the $85,000 for the shelter could be the first year
payment on the Murzyn Hall improvements. Williams asked if Murzyn Hall is part of the park
system. Peterson stated it is under the Park Board and part of the park system.
Motion by Williams, second by Kelzenberg, to close the public hearing and waive the reading of
Resolution 2008-228 there being ample copies available to the public. Upon vote: All ayes.
Motion carried.
Motion by Williams, second by Kelzenberg, to adopt Resolution 2008-228, being a resolution to
adopt a special assessment roll and levy a special assessment for delinquent charges. Upon vote:
All ayes. Motion carried.
B. 1st reading of Ordinance No. 1559 being_an ordinance amending the City of Columbia Heights
Code of 2005 relating to abandoned property. -Removed by request of Councihnember Diehm
C. Adopt Resolution 2008-255 being a Resolution approving a 21.5- foot front Ord parking
setback variance for 4301 Benjamin Street.
Jeff Sargent, City Planner, stated this variance request is from the Church of All Nations. The

previous parking lot needed repair and replaced it with a concrete lot, including a landscaped
area. They were too close to the road and required to correct the issue, therefore the request for a
variance. Sargent showed the area involved by an overhead aerial picture. The congregation has
grown and parking is much needed. The overall amount of covered surface is now less than
previously covered. The variance would allow parking to the established area and would replace
the landscaped area.
Nawrocki complimented the people of the church for improving their parking situation. People
of the congregation did a lot of the labor. Williams agreed they have done a nice job and thanked
them.
Peterson stated that the Planning and Zoning Commission agreed to the church's request. It is
impressive how they have grown and what they have accomplished. The City Council has been
invited to their service on January 4.
Motion by Nawrocki, second by Williams, to waive the reading of Resolution 2008-255, there
being ample copies available to the public. Upon vote: All ayes. Motion carried.
Motion by Williams, second by Nawrocki, to adopt Resolution No. 2008-255, approving a 21.5-
foot front yard parking setback variance for the Church of All Nations located at 4301 Benjamin
Street, subject to the conditions outlined in Resolution No. 2008-255. Upon vote: All ayes.
Motion carried.
A congregation member stated that the service in January would be their 5th anniversary.
D. Adopt Resolutions 2008-243, 1490 Lincoln Terrace N.E., 2008-244, 1308-10 Circle Terrace
Blvd. N.E. 2008-245 1355-59 Circle Terrace Blvd. N.E. 2008-246 1331-33 Circle Terrace

abatement of violations within the City of Columbia Heights•
Fire Chief Gornlan listed the abatement violations for the properties:
2008-243, 1490 Lincoln Terrace N.E., - replace missing garage window, repair to front yard.
2008-245, 1355-59 Circle Terrace Blvd. N.E. -vacant property in foreclosure -listed items.
2008-246, 1331-33 Circle Terrace Blvd. N.E. -listed items requiring repair.
2008-247, 1337-39 Circle Terrace Blvd. N.E. -listed items requiring repair.
2008-249, 4359 Arthur Street N.E. -there was a fire at this property that required it to be
boarded up.
2008-250, 4509 Fillmore Street N.E. -broken glass in storm doors and repair the storm door.
2008-252, 4515-17 Fillmore Street N.E. -torn screens, repair garage door, broken glass front
door.
2008-253, 3810-12 3rd Street N.E. -property vacant and unsecured -approval to board it up.
Motion by Nawrocki, second by Williams, to close the public hearing and to waive the reading
of Resolution Number 2008-243, 245, 246, 247, 249, 250, 252, and 253 there being ample copies
available to the public. Upon vote: All ayes. Motion carried.
Motion by Williams, second by Nawrocki, to adopt Resolution Number 2008-243, 245, 246,
247, 249, 250, 252, and 253 being resolutions of the City Council of the City of Columbia
Heights declaring the properties listed a nuisance and approving the abatement of violations from
the property pursuant to City Code section 8.206. Upon vote: Ali ayes. Motion carried.

Fire Chief Gorman listed the rental license revocation issues:
2008-233, 4308 5th Street N.E. -Failure to submit application, pay fee and schedule inspection.
2008-236, 941 45th Avenue N.E. -Failure to submit application, pay fee and schedule
inspection.
2008-238, 4960 7th Street N.E. -Failure to submit application, pay fee and schedule.
2008-242, 1307-09 Circle Terrace Blvd. N.E. -removal of scrub growth.
Ceasar and Katie Higgens, 4308 5`" Street tenants, came forward to ask what would happen to
them. Gorman addressed that the property will be posted, with a 45-day notice to correct the
items or the home will be illegal to rent. Then there will be a 45-day notice making it illegal for
tenants to be there. He offered them the information on what their rights are.
Melinda Winda, 4960 7t'' Street, stated the property is owned by her fiance, who is in jail. It has
been in redemption, but is now in foreclosure and will be vacated by December. Gorman stated
the information came from our utility billing department. The property is owned by a bank and
the utilities are paid by another name. Gorman stated that we do not have a rental license that we
are revoking. This gives us an opportunity to go through the process if it is being rented. Winda
stated she tried to contact the fire department and no one got back to her.
Motion by Williams, second by Nawrocki, to close the public hearing and to waive the reading
of Resolution Numbers 2008-233, 236, 238, 240, and 242 being ample copies available to the
public. Upon vote: All ayes. Motion carried.
Motion by Williams, second by Kelzenberg, to adopt Resolution Numbers 2008-233, 236, 238,
240, and 242 being Resolutions of the City Council of the City of Columbia Heights approving
revocation pursuant to City Code, Chapter SA, Article IV, Section SA.408(A) of the rental
licenses listed. Upon vote: All ayes. Motion carried.
7. ITEMS FOR CONSIDERATION

B. Bid Considerations
Accept bids and award contracts for Public Safety Center Phase 2 -concrete precast, structural
steel
Doc Smith, EDS Construction Manager, indicated the bid opening was Thursday at 2:00 p.m. He
stated there are only three companies in Minnesota that do this type work. One of the bidders
was from Wisconsin, The bids came in approximately ten percent under budget. We reviewed
the two low bidders and request the concrete bid be awarded to the low bidder for $805,200.

Williams questioned the amount of the high bid and Nawrocki asked the original estimate. Smith

Smith listed the qualities of the companies. Far Molin Concrete the bid was $335,795.00. The
rejected alternate was for taking out the basement on the west end of the apparatus bay.

Smith stated that Red Cedar Steel Erectors, Inc. could not meet the bid date requirements. This
would allow moving to the second bid of Berggren Steel Fabricating. Smith indicated the
difficulties with waiting the additional three weeks, due to weather restrictions. Nawrocki stated
that it was anon-responsive bid. Nawrocki. questioned the alternate #1 that they did not bid on.
Smith stated it was a deduct alternate.
Motion by Nawrocki, second by Williams, to accept the bid and award the contract for
Columbia Heights Public Safety Center Phase 2, bid to CH2-OS-1 to Berggren Steel Fabricating,
Inc. in the amount of $338,091.00 as the low responsible bidder. Upon vote: All ayes. Motion
carried.
Nawrocki questioned the estimate of that work. Smith stated his estimate was $400,000 and
came in at $334,000.
Smith gave a project update, which is going well. He is pleased with the Landwehr Company and
Kevin Hansen from Public Works has been very helpful. The storm systems are 90 percent
complete, the pad is ready, the parking lots are 80 percent complete, and work on the retaining
walls are beginning this week. The water and sanitary sewer are up to the building. We
tentatively plan for the next phase to be bid out at the end of October and bid opening date of
Nov 19.
Nawrocki asked how much under budget are we for both bids. Smith stated the two phases equal
the projected cost. Nawrocki stated he thought we were four percent under on the first bid
package. Fehst stated that the gym facility cost was under by about four percent.
C. Other Business
Adopt Resolution 2008-229, being a Resolution approving the acquisition of property located at
4647 Polk Street.
Sheila Cartney, Community Development Assistant, stated this property is for sale. It was built
in 1948. There is a garage and makeshift lean-to, and is located on two lots. There is internal and
external maintenance required. Staff has made an offer of $70,000. This property is located in
the Sheffield redevelopment area. Possible future use of the property would be splitting it into
two lots and selling it to two parties or working with GMHIC. The request tonight is to approve
acquisition.
Nawrocki asked if there is a disclosure statement. Cartney stated that was waived, as it is a

foreclosed home. Nawrocki stated that the house is old, but not as deteriorated as some others
and questioned if this is where we should put our funds.
Scott Clark, Community Development Director, stated that these properties will have a limited
warranty, as there is not the required knowledge of the property. Jim Hoeft, City Attorney, stated
that we are buying the properties "as is". Clark stated that the goal is to make a series of
pltrchases in the Sheffield area and there are funds available. Staff will also come to Council
with additional funding sources. The overall goal will be to buy seven to ten. properties. If we
choose to demolish the home we would have two lots available.
Nawrocki questioned the outstanding debt for the Sheffield project. Clark stated there is a
$280,000 obligation. remaining, which should be paid in four to five years. Nawrocki questioned
where the funds come from.. Elrite stated that the City Council approved the funds from the fund
balance. Nawrocki. stated concern to see where we can best spend our limited resources. Clark
stated that this is part of a goal to clean up the Sheffield neighborhood through purchasing
properties as they become available. The Sheffield neighborhood redevelopment is a high
priority. Cartney stated that the County has it valued at $150,000 and it was offered to us for
$70,000 even though they were offered $85,000.
Terry Barber questioned if asbestos issues were considered. Clark stated there are anticipated
additional costs for hazardous material. Nawrocki questioned the possible demolition cost.
Cartney stated that we have not received demolition costs as we have not received approval to
purchase the property.
Bob Odden, 1201 42 '/2 Avenue, stated that in 1999 the economy downturn was forecast. He
referred to the Grand Center Loft site as the wrong project at the wrong time. Don't blame the
Sheffield neighborhood. He was told crime was coming down. There is not a problem home, but
problem people. He asked if the intention is to make certain types of people move. Peterson
stated that is not his intention.
Nawrocki stated that is not the true price, as we do not know the cost of demolition and
hazardous material removal.
Nawrocki stated that Anoka County has indicated they will possibly receive a $2,750,000.00
housing grant. Fehst stated it would be the same process as the Community Development Block
grant program. We have spoken to County Commission Kordiak before this program and were
told there were no funds, but conversations continue. Clark stated that we have begun this
process, starting with the County Action Plan, included foreclosure maps. We need to look at the
dollars we can amass to do this, but must take the opportunity to purchase properties when it
arises.
Donna Schmitt, 4260 Tyler Street, suggested to split it and give it to Habitat for Humanity so we
can more than double the taxable value.
Nawrocki questioned working with Habitat for Humanity, as they would not agree to work with
the people from our community first.
Peterson referred to External City Goal #3 to improve our housing stock. This is in our target
area and the price is right, We have missed some homes that we should have obtained to improve
our housing stock. We have funding and we will have a lot of opportunity in the future to buy

more. If we keep doing so, we will be able to attract new residents.
Nawrocki referred to properties that we purchased that are still vacant such as Burger King. Look
at what you are getting and where it will go.

Nawrocki requested a report on the Sullivan Lake shelter, the office building at 40`" and Central, and

• The Sullivan Lake shelter was vandalized and the underside of the top was burned. It will be
covered by insurance. We are looking to place video equipment at the site. Nawrocki stated
that a resident questioned no rain gutters on the shelter and the gaps that collect leaves in the
ridges as a concern. Hansen stated this would be checked.
Nawrocki spoke to the history of the bank building action. Peterson stated the agreement was
made is done.
Nawrocki questioned the 37t" and Central developer not performing like he said he would. Fehst
stated that the developer wanted to build a car part store, which we do not want.

THE APPLICANT SEEKS THE FOLLOWING RELIEF: A 21.5-foot front yard parking setback variance per Code
Section 9.109 (C).
WHEREAS, the Planning Commission has held a public hearing as required by the City Zoning Code on October 7, 2008;
WHEREAS, the City Council has considered the advice and recommendations of the Planning Commission regarding the effect
of the proposed variance upon the health, safety, and welfare of the community and its Comprehensive Plan, as well as any
concern related to traffic, property values, light, air, danger of fire, and risk to public safety, in the surrounding area;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Columbia Heights that the City Council accepts
and adopts the following findings of the Planning Commission:
1. Because of the particular physical surroundings, or the shape, configuration, topography, or other conditions of the
specific parcel of land involved, where strict adherence to the provisions of this Ordinance would cause undue
hardship.
2. The conditions upon which the variance is based are unique to the specific parcel of land involved and are generally
not applicable to other properties within the same zoning classification.
3. The difficulty or hardship is caused by the provisions of this Ordinance and has not been created. by any person
currently having legal interest in the property.
4. The granting of the variance is in harmony with the general purpose and intent of the Comprehensive Plan..
5. The granting of the variance will not be materially detrimental to the public welfare or materially injurious to the
enjoyment, use, development or value of property or improvements in the vicinity.
FURTHER, BE IT RESOLVED, that the attached plans, maps, and other information shall become part of this variance and
approval; and in granting this variance the city and the applicant agree that this variance shall become null and void if the project
has not been completed within one (1) calendar year after the approval date, subject to petition for renewal of the permit.
CONIDTIONS ATTACHED:
1. The Church of All Nations shall submit a plan to restore the right-of--way and. area between the property line and the
approved parking setback with landscaping by June 1, 2009. The City Engineer shall approve said plans.
2. The Church of All Nations shall supply the City with a letter from the Rice Creek Watershed District approving the
parking lot resurfacing project.

1. That on September 3, 2008 the Fire Department was at the property to check for long grass and found the property on the
3812 side unsecured. Due to all previous notifications to the property owner not being addressed the Fire Department
contacted DuAll Restorageion Services to board up and secure the building to prevent unauthorized entry.

noted one violation remained uncorrected. A statement of cause was mailed via regular mail to the owner at the address

APPROVING THE ACQUISITION OF PROPERTY LOCATED AT 4647 Polk Street
WHEREAS, the City has found that there exists conditions of deterioration, and substandard structure, in need of repairs which
are in violation of the City Housing Code and City Ordinances or there exists a need (due to blighting influences) for intervention
by the City to prevent further deterioration of the area: and
WHEREAS, the City has the option to acquire such property pursuant to the Purchase Agreement by and between the City of
Columbia Heights and Realty Executives Top Producers (the "seller"} and Purchase Agreement has been signed by the seller and
provided to the City Council
NOW THEREFORE BE IT RESOLVED
1. The City Council hereby approves the terms of the Purchase Agreement for 4647 Polk Street NE between the City of
Columbia Heights and ReMax Associates and authorizes the Mayor and City Manager to sign the agreement on behalf of
the city at a purchase price of $70,000.00 plus all ancillary costs associated with closing.
2. The City Council hereby author°izes the staff to ha~idle ail the requirements aj~d conditions in order for the City to
complete the transaction contemplated in the Purchase Agreement.
3. The City Council approves payments of the purchase cost from the Sheffield Redevelopment Fund.
