Fehst, City Man ger WF/pvm 4 OFFICIAL PROCEEDINGS CITY OF COLUMBIA HEIGI3TS CITY COUNCIL MEETING OCTOBER 13, 2008 The following are the minutes for the regular meeting of the City Council held at 7:00 p.m. on Monday, October 13, 2008 in the City Council Chambers, City Hall, 590 40th Avenue N.E., Columbia Heights, MN. CALL TO ORDER/ROLL CALL/INVOCATION Present: Mayor Peterson, Councilmember Williams, Councilmember Nawrocki, Councilmember Kelzenberg Absent: Councilmember Diehm Invocation by Rev. Ruth Hograbe, Community United Methodist Church. PLEDGE OF ALLEGIANCE -recited ADDITIONS/DELETIONS TO MEETING AGENDA Mayor Peterson stated that Fire Chief Gorman has requested to speak under Presentations. There will be notices of fund raisers. Mayor Peterson removed Resolutions number 2008-232, 234, 235, 237, 239, 240, 241, 244, and 251, as these properties have been brought into compliance. Mayor Peterson stated that Councilmember Diehm contacted him, indicating that because of a family commitment she would not be present at the meeting, and by her request that item 6B - 1st reading of Ordinance No. 1559 relating to abandoned property be removed from the agenda to a later date when she can be present for the discussion. Nawrocki requested to have discussion on the Sullivan shelter, 40`" and Central office building, and the October 6`" work session. He requested to remove from the consent agenda items H, I, J, N, and R be removed for discussion. PROCLAMATIONS, PRESENTATIONS, RECOGNITION, ANNOUNCEMENTS, GUESTS A. Proclamation -Polish American Heritage Month Mayor Peterson read the proclamation and presented it to the Columbia Heights Sister City committee. Dolores Strand, Gloria Bergstrom, Ed Skorski, Marion Bernard, and Dorothy Penate, members of the Sister City Committee, accepted the proclamation. Strand referred to the Polish students that will visit us next year. Bergstrom indicated she was a chaperone for our group that visited Poland. The communication. between the students continues. It was a wonderful experience. Strand indicated that Logacz delivered a $4,000 check from the Sister City committee to the Lomianki Children's Hospital. Penate indicated that the hospital would purchase two new horses for their therapy program. Peterson thanked them for their work in the Sister City organization. With the nine students coming, the committee will need to raise funds for their visit; any donations would be appreciated. Peterson stated that on Saturday, October 18, at VFW Post #230, there will be a Booya feed as a fundraiser for the Fire Explores. Also, there is a dinner fundraiser at Community United Methodist Church. Nawrocki indicated his past comments on this resulting in a dead-end street. There is not a turn around there. Motion to waive the reading of Resolution 2008-254, there being ample copies available to the public. Motion to adopt Resolution No. 2008-254, approving the Final Plat for the Public Safety building located at 825 - 41st Avenue. Motion to waive the reading of Resolution 2008-259, there being ample copies available to the public. Motion to adopt Resolution No. 2008-259, approving the vacation of certain private drainage and utility easements fully contained within Lot 1 Block 1 Northwestern 2pd Addition. H. Motion to adopt Resolution No. 2008-231, being a Resolution ordering the preparation of a report for proposed Zone 1 C and 3B Street Seal Coat Program, Project #0901. M. Adopt Resolution 2008-230 being a Resolution ordering_preparation of a Feasibility Report for Zone 4 Street Rehabilitation Program. Hansen indicated this is an annual program in the second cycle and listed the areas, including streets that did not previously have work completed. Upon vote: All ayes. Motion carried. H. Authorization to obtain price quotes for printing and mailing the 2009-2010 City newsletters Nawrocki stated that the newsletter has gotten pretty exotic. We have a person prepare the copy and in a time of looking at expenses, we need to look at this and cut back. We print out many more than needed as 3,000 copies are handed out in the schools and to student homes in the Fridley area. We used to assemble them ourselves and took them to a printer. They did not have a multi-color print. We should just strive to get the information out to the people of the community. Fehst stated that we have received a lot of feedback on the quality of the newsletter. He suggested a motion to quit printing the newsletter and only place it on line. Nawrocki indicated many residents do not have Internet access. The budget article in the next newsletter is woefully inadequate and does not include the HRA levy and the County EDA/HRA levy. Keith Windschitl, Recreation Director, indicated the request is to seek bids on the current type newsletter, as this new style is more readable. We snail to all 55421 zip code and must give the mail carriers enough newsletters to fulfill their route. Nawrocki stated that you can limit areas and do not need to do the entire 55421 zip code. Windschitl indicated the survey completed by the schools indicated the newsletter to be very highly read by the community. Kelzenberg stated that the new format is a lot better than it used to be and is easy to read. The Fridley recipients are involved in our recreation programs. Nawrocki stated that Fridley is not helping to pay for the cost. Williams stated the request is for a price quote and asked that a "plain Jane" price be received also. Motion by Williams, second by Kelzenberg, to authorize staff to obtain price quotes for printing and mailing the 2009-2010 "Heights Happenings" city newsletters. Motion to amend by Nawrocki to do the newsletter "in-house" as in the past. Williams asked to receive the amount of staff time and cost it would take to do this in-house. Nawrocki asked for the prices to mail without the Fridley and St. Anthony addresses. Peterson called for a second of the motion to amend. Motion died for lack of a second. Upon vote of the original motion: Kelzenberg, aye; Williams, aye; Nawrocki, nay; Peterson, aye. City Council Minutes Monday, October 13, 2008 Page 5 of 27 3 ayes - 1 nay. Motion carried. Nawrocki stated he would like to see the budget newsletter article be more comprehensive. The utility rate increase is not included. He stated he is unhappy that we are not having meetings on the budget until Wednesday, October 29, the same day as the Anoka County officials meeting. Establish City Park Rental Fees Nawrocki stated a strong disagreement with this. Most ball park usage does not have fees and they require clean up. People pay taxes to pay for the park. Fehst stated that anyone can use the shelters for free, but if you want to reserve the shelter you can pay $30 plus tax for exclusive use. Nawrocki questioned if the Huset Park volleyball area can be reserved. Windschitl indicated it can be reserved. Williams reiterated that anyone can use the park free, but if you wish to reserve the shelter the fee is fair. Windschitl indicated that the Park and Recreation Commission recommended the fees, which will be used for renovations, cleanup and maintenance of the facilities. Marsha Stroik is present from the Park and Recreation Commission. Nawrocki stated he has no problem with the non-resident fee. There has not been a reduction in the budget to compensate for additional revenues. Marsha Stroik stated that as commission members they take their position seriously. Looking at the budget, this is an effort to hold down some costs. We have all paid to use facilities in other communities and do not mind. We are trying to keep the city solvent and keep the parks nice. Motion by Williams, second by Kelzenberg, to adopt the Park Rental Rates, as outlined by the Park and Recreation Commission at their meeting of June 25, 2008. Upon vote: Nawrocki, nay; Kelzenberg, aye; Williams, aye; Peterson, aye. 3ayes - 1 nay. Motion carried. J. Establish City Event WaPon Rental Fees Nawrocki stated that the VFW donated the money to buy the wagon and it provides a good service. Some equipment does need replacing, but we are using second hand items. When you tell people you will keep property taxes down and then put fees in place, you are just getting another type of tax. Kelzenberg questioned the number of rentals. Windschitl stated there are about 25 rentals a year. We deliver the trailer. It has tables, chairs, and some play equiprnert. The Park and Recreation Commission recommended the fee to offset maintenance, staff costs, and fuel. Kelzenberg stated he was amazed that this service was free, and is amazed the recommendation is only $25. Williams stated that the $25 does not cover our cost. Windschitl stated the trailer was purchased in 1999. Motion by Williams, second by Kelzenberg, to adopt the Event Wagon Rental Rate, as outlined by the Park and. Recreation Commission at their meeting of June 25, 2008. Dorothy Penate, 4900 Jackson, stated she would gladly pay the cost of the event wagon and would gladly pay the park shelter fee as families are thrilled to use them. The charges are minimal. Upon vote: elzenberg, aye; Williams, aye; Nawrocki, nay; Peterson, aye. 3ayes - 1 nay. Motion carried. o City Council Minutes Monday, October 13, 2008 Page 6 of 27 Peterson stated that we try to balance the budget the best we can. There is a lot of discussion at budget time and Park and Recreation Department gets picked on quite a bit. The commission is seven members of the community that try to find ways to reduce the budget. Peterson stated. that he would like to provide everything for nothing, but unfortunately all services come with a cost. Peterson stated that the Commission discussed this very seriously and he thanked them for the thankless job they do. N. Authorize staff to seek bids for a picnic shelter at Huset Park (west) Nawrocki again referred to cutting back on expenditures for the city. We have a shelter there now. The new shelter would be nice, but it is nice to live within the means of the taxpayers. Peterson stated that this expenditure was an approved item in the last budget. Williams stated we have done so many improvements to the park, it would be a crime not to have a nice shelter there. Kevin Hansen, Public Works Director, stated this was budgeted for in 2007 and 2008. The Park and Recreation Commission reviewed this and felt it appropriate to recommend the expenditure. This could lessen the extensive use of Murzyn Hall and would be similar to the Sullivan shelter. Nawrocki stated that this would tell taxpayers it would cost them $85,000 to build the shelter and then there would be a fee to use it. Williams stated that residents pay only if they want to reserve a shelter. Hansen stated the funds would be from the Park Development Park Dedication Fee. Park dedication fees are for additional demands by a new development. Nawrocki referred to the cost of the Murzyn Hall upgrade. Williams stated that we are not increasing taxes because of the Murzyn Hali renovation. Energy consumption will reduce the cost, and it guaranteed. Nawrocki stated. that the renovation would not reduce staff time. Peterson stated that we have a staff person that currently spends the majority of his time maintaining the substandard building and this may allow him to maintain the other city buildings. Motion by Kelzenberg, second by Williams, to authorize and direct staff to seek bids for a new picnic shelter at Huset Park West. Terry Barber, 3040 2nd Street, asked if this is in the budget. Peterson stated it is in the current 2008 budget. She stated that we are in an economic crisis and people are losing their homes. These expenses could be put on hold. Penate stated that our taxes are one-half of what they are in Wisconsin because we receive the homestead break. Williams stated this money comes from park dedication fees when the development was built and the money was approved in 2007. Hansen stated the park improvement fund is restricted by State Statute and limited to park improvements, not ongoing maintenance. Williams referred to the Wargo donation of $50,000 for the maintenance of Wargo Park. Nawrocki referred to the difference of funds for the Huset shelter and Murzyn Hall. improvements. He again requested to use park improvement funds to pay for the Murzyn Hall improvements for the first couple years. Nawrocki stated one payment is to Auto World through a contract and he may want to abstain from this vote. Motion by Nawrocki, second by Kelzenberg, to approve the payment of the bills out of the proper fund as listed in the attached register covering Check Number 127459 through Check Number 127687 in the amount of $1,816,025.81. Upon vote: Kelzenberg, aye; Williams, abstain; Nawrocki, aye; Peterson, aye. 3ayes - 1 abstention. Motion carried. Peterson asked Chief Gorman to make his announcement now. Fire Chief Gorman stated that Saturday was the Fire Department open house, with one of the biggest crowds ever in attendance. He thanked the businesses that donated to the event: Heights Bakery, Auto World, Coke, Old Dutch, Tasty Pizza, and the Fire Association. This would not be possible without them. Next year we may have our open house in our new building. Peterson asked that a letter be drafted to thank these groups for their donations. PUBLIC HEARINGS A. Adopt Resohrtion 208-228, being a Resolution to adopt an Assessment Roll and Levy a Special Assessment for Delinquent Charges Bill Elrite, Finance Director, indicated the assessments are for items such as weed removal, tree removal, and abatements. Fehst stated one assessment was for mercury removal, some are banks, and some are for grass cutting. We try to reach the banks or companies that own the property to clean up the property and if they do not, we do it. Seniors in the community that keep up their property complain to us about the unkempt and abandoned properties. Williams asked Hansen to again explain park dedication fees, and indicated that the Huset Park shelter is not a taxable item. Fehst stated that all first ring cities have park dedication fees larger than ours. Developers are required to contribute, as the site would put an additional burden on the system. Williams stated that his business had to donate land. Hansen stated it can be a cash or land donation. Nawrocki again stated that the $85,000 for the shelter could be the first year payment on the Murzyn Hall improvements. Williams asked if Murzyn Hall is part of the park system. Peterson stated it is under the Park Board and part of the park system. One of the bidders was from Wisconsin. The bids came in approximately ten percent under budget. We reviewed the two low bidders and request the concrete bid be awarded to the low bidder for $805,200. They will be able to accommodate our very tight schedule. They have been in business for 25 years. Williams questioned the amount of the high bid and. Nawrocki asked the original estimate. Upon vote: All ayes. Motion carried. Nawrocki questioned the estimate of that work. Smith stated his estimate was $400,000 and came in at $334,000. Smith gave a project update, which is going well. He is pleased with the Landwehr Company and Kevin Hansen from Public Works has been very helpful. The storm systems are 90 percent complete, the pad is ready, the parking lots are 80 percent complete, and work on the retaining walls are beginning this week. The water and sanitary sewer are up to the building. We tentatively plan for the next phase to be bid out at the end of October and bid opening date of Nov 19. Nawrocki asked how much under budget are we for both bids. Smith stated the two phases equal the projected cost. Nawrocki stated he thought we were four percent under on the first bid package. Fehst stated that the gym facility cost was under by about four percent. C. Other Business Adopt Resolution 2008-229. being a Resolution approving the_acqusition of property located at 4647 Polk Street. Sheila Cartney, Community Development Assistant, stated this property is for sale. It was built in 1948. There is a garage and makeshift lean-to, and is located on two lots. There is internal and external maintenance required. Staff has made an offer of $70,000. This property is located in the Sheffield redevelopment area. Possible future use of the property would be splitting it into two lots and selling it to two parties or working with GMHIC. The request tonight is to approve acquisition. Nawrocki asked if there is a disclosure statement. Cartney stated that was waived, as it is a City C'auncil Minutes Monday, October 13, 2008 Page 11 of 27 foreclosed home. Nawrocki stated that the house is old, but not as deteriorated as some others and questioned if this is where we should put our funds. Scott Clark, Community Development Director, stated that these properties will have a limited warranty, as there is not the required knowledge of the property. Jim Hoeft, City Attorney, stated that we are buying the properties "as is". Clark stated that the goal is to make a series of purchases in the Sheffield area and there are funds available. Staff will also come to Council with additional funding sources. The overall goal will be to buy seven to ten properties. If we choose to demolish the home we would have two lots available. Nawrocki questioned the outstanding debt for the Sheffield. project. Clark stated there is a $280,000 obligation remaining, which should be paid in four to five years. Nawrocki questioned where the funds come from. Elrite stated that the City Council approved the funds from the fund balance. Nawrocki stated concern to see where we can best spend our limited resources. Clark stated that this is part of a goal to clean up the Sheffield neighborhood through purchasing properties as they become available. The Sheffield neighborhood redevelopment is a high priority. Cartney stated that the County has it valued at $150,000 and it was offered to us for $70,000 even though they were offered $85,000. Terry Barber questioned if asbestos issues were considered. Clark stated there are anticipated additional costs for hazardous material. Nawrocki questioned the possible demolition cost. Cartney stated that we have not received demolition costs as we have not received approval to purchase the property. Bob Odden, 1201 42 '/2 Avenue, stated that in 1999 the economy downturn was forecast. He referred to the Grand Center Loft site as the wrong project at the wrong time. Don't blame the Sheffield neighborhood. He was told crime was coming down. There is not a problem home, but problem people. He asked if the intention is to make certain types of people move. Peterson stated that is not his intention. Nawrocki stated that is not the true price, as we do not know the cost of demolition and hazardous material removal. Nawrocki stated. that Anoka County has indicated they will possibly receive a $2,'750,000.00 housing grant. Fehst stated it would be the same process as the Community Development Block grant program. We have spoken to County Commission Kordiak before this program. and were told there were no fiords, but conversations continue. Clark stated that we have begun this process, starting with the County Action Plan, included foreclosure maps. We need to look at the dollars we can amass to do this, but must take the opportunity to purchase properties when it arises. Donna Schmitt, 4260 Tyler Street, suggested to split it and give it to Habitat for Humanity so we can more than double the taxable value. Nawrocki questioned working with Habitat for Humanity, as they would not agree to work with the people from our community first. Peterson referred to External City Goal #3 to improve our housing stock. This is in our target area and the price is right. We have missed some homes that we should have obtained to improve our housing stock. RESOLUTION N0.2008-228 ADOPTING AN ASSESSMENT ROLL AND LEVYING A SPECIAL ASSESSMENT FOR DELINQUENT CHARGES WHEREAS, the services listed in the assessment roll below, numbered as Project 2008-DB-19-OOI, have been provided to and benefited the properties listed therein in the amounts listed therein; and, WHEREAS, the charges to said properties for said services are unpaid and delinquent; and, WHEREAS, the City Council of the City of Columbia Heights, Minnesota, met at 7:00 p.m. on the 13`'' day of October 2008 in the City Council Chambers 590 40`'' Avenue N.E. Columbia Heights, Minnesota, being the time and place set when and where all persons interested could appear and be heard by the Council with respect to the benefits and cost of providing the services described below, a notice of such hearing having been heretofore duly published as required by law, and a notice mailed to each property owner of record, stating the proposed amount of the assessment; therefore, THE CITY COUNCIL OF THE CITY OF COLUMBIA HEIGHTS HEREBY RESOLVES: Section 1. The granting of the variance is in harmony with the general purpose and intent of the Comprehensive Plan. 5. Kevin Hansen, Public Works Director, stated this assessment is for University Avenue Service Drive, currently under construction. He listed the location and amenities to be added. New utilities have been added, curb and gutter is in. The trail, fencing, and landscaping will continue and be completed yet this year. The total cost is about $780,000 through a cooperative agreement with MNDOT. The assessment is based on the original state of the street. About 20 percent of the cost is being paid by our utility fund, 70 percent by MNDot, and 10 percent by residents. The posted assessment rate was seven percent. Six percent is the recommended interest rate. The term of the assessment is six years. Motion by Peterson, second by Diehm to establish the assessment rate at six percent. Nawrocki stated that if the current rates are less than five percent, we should only charge what our costs are. Joel Fantel spoke for Oak Hill Baptist Church. He stated the project was originally proposed at six percent interest rate and then they received notice of seven percent. They are pleased to now hear it will be six percent. Marlin Kirchbam ask when his bill for seal coating was due. Hansen stated there is 30 days allowed to pay the assessment at City Hall. c. DnagTask Force (DTF). The DTF is partially funded by a Federal Grant administered by the State of Minnesota. Part of this grant is for partial reimbursement of overtime incurred by the DTF officers. For the third quarter of 2008, we have received a check from Anoka County in the amount of $1,200 as partial reimburse~r~ent for the overtime of our DTF Of ycer. Currently the income limit for reduced senior citizen rates is set at $27,300. Attached is a resolution raising the income limit, beginning in 2009, to $29,000 for reduced senior citizen rates. For many years the formula the City has used for this limit is the maximum current year (2009) Social Security benefit for an individual at full retirement age, plus 4%, rounded to the next even $100 increment. This limit is then compared to applicants' prior year (2008) income. This formula is intended to allow for a modest amount of income beyond the maximum Social Security benefit possible. The maximum Social Security benefit for an individual at full retirement age for 2009 is $27,876. The City Council can set any formula or amount for income eligibility. If the City establishes the income eligibility guideline at a higher level, more people will qualify. As more people qualify for reduced rates, the rates for non-qualifying people will have to be raised to ensure adequate revenue in the utility fund. For many years, the number of seniors receiving the reduced rate has remained relatively constant at approximately 200 residents. This property was subject to abatement actions in 2007 and past uses on the property indicate that contamination may be present. The mechanics of this grant is that the City applies for the grant, on behalf of the owner. The legal firm of Schleck and Associates, who will work with staff to complete the application, is doing the actual grant preparation. There is significant benefit to the City to sponsor this grant, as the completion and acceptance of a remedial action plan with the Pollution Control Agency allows for future grant applications for actual clean-up and /or clean-up by the property owner leading to redevelopment. The grant resolution, which states "committing local match" does not actually commit local dollars. This is a reimbursement grant, meaning that after the owner expends funds for investigation it will be the City applying for the reimbursement. The owner will receive only a 75% return of their request, as the other 25% is the match, albeit the funds do not come from the City. Staff will request a side letter from the property owner holding the City harmless from any costs associated with this grant. Recommendation: Staff recommends approval of Resolution 2008-271 as written. Background: On August 25, 2008 the Council passed a resolution to acquire property located at 961. Gould Avenue. Included in that resolution was direction to staff to negotiate an agreement with Stadium Village Properties for the storage of snow from the parking ramp and removal of the existing building. Staff has secured such agreement with Stadium Village Properties allowing the storage of snow from the public parking ramp to be stored on 961 Gould Avenue; and the removal of the existing single family home. Stadium Village Properties will also grade the site and install a drain, maintain and operate the site, and provide screening to the property to the east. Stadium Village Properties estimates the total cost to them will be around $40,000. This agreement is an Amendment to the Operations agreement signed on August 25, 2008, in which Stadium Village Properties manages and operates the site, but the City maintains ownership. In 2022 when the ramp becomes available to the office building for ownership, 961 Gould Avenue will do the same. This action will amend two agreements, the Operations Agreement and the original Management Agreement established in 1.982. The 1982 agreement is amended to allow ownership of 961 Gould Avenue in 2022 along with the ramp. The neighbors directly affected by this proposal have been notified. Recommendation: Staff recommends the City Council approve the resolutions amending the Operations Agreement and the Management Agreement for the parking ramp and plaza property. Operator shall demolish the existing building, foundation, and. any cement surfaces on the Gould Property. Utility cut off at the curb will be done by the City at the Operator's expense. All such demolition and related work on the Gould Property shall be at the Operator's sole expense. 4. City snail allow Operator to use the Gould Property for snow storage from the adjacent property, with the hours for clearing/dumping snow subject to City approval. Best efforts to promote infiltration on the site shall be used by the Operator. 5. All grading done on the Gould Property shall be performed pursuant to a grading plan approved. by City and will take place in 2009 weather and ground conditions permitting. Minimal grading and erosion control shall take place upon removal of the structure. 6. Operator shall replace any trees removed from the Gould Property as part of the demolition and grading. Tree replacement shall be one-for-one with the size and species of tree approved by City. 7. Operator shall provide screening to the adjacent property to the east of the Gould Property through the use of plantings as approved by City. 94 8. Operator shall provide year-round maintenance on the Gould Property. Said maintenance shall include, but not necessarily be limited to grass cutting, weed control, debris/garbage collection, plant/tree removal and replacement, and. any re-grading necessary to remain compliant with the approved grading plan. 9. DATE: October 27, 2008 JBack~round: On October 20, 2008 the City purchased property at 4011 jth street as part of the Department of Housing and Urban Development's (HUD) $1.00 program. An emergency meeting was scheduled on June 16, 2008, to meet HUD's deadline for this program; at that time council also approved any ancillary closing costs in addition to directing staff to bid for demolition. On October 6, 2008 staff submitted bid specification documents to ten companies, and on October 27, 2008 five firms returned bids. Bid tabulations are as follows: Com an Quote Kevitt Excavatin $14,790.00 Veit & Company Inc $15,665.00 Bolander and Sons $16,896.00 Frattalone Com anies $18,000.00 Robinson Environmental $7,748.00 Hazardous Material removal only Based on these bids staff is recommending that Kevitt Excavating LLC be awarded the contract as responsible low bidder. In addition, it should be noted that the total demolition cost to the City includes this bid ($14,790), $1900 for utility disconnects (this was done through a Public Work's City contract) and $650 for a hazardous material survey. Total demolition costs equal $ 17,340, which is slightly below staff s original estimate of $18,000. Staff has a demo deadline of November 20, 2008 in the contract. Recommendation• Staff recommends awarding the demo bid to Kevitt Excavating LLC, based on the responsible low bid they provided. Bu-„'lding Demolition Two structures, a 1,102 square foot house with full basement and a 440 square foot garage requires demolition. The contractor shall furnish all materials, labor and equipment necessary to remove the structure, foundation and any existing concrete sidewalks, stairs, advertising signs, parking pads, and any other hardcover. The Contractor shall avoid damaging sidewalks, streets, curbs,. pavements, utilities, structures or any other property either on or adjacent to the site that are not scheduled for removal, The Contractor shall repair at his/her own expense any damage caused by operations. Restricted/Hazardous Materials At a minimum, the Contractor will be responsible for adhering to the fallowing requirements as they pertain to building demolition: .The city will ensure that service to all onsite utilities are ctrt at the curb. • Unless otherwise directed, demolition includes the removal of all above-grade and below-grade structures or objects including, but not limited to, fences, building foundations, concrete, storage bins, steel rail and railroad ties, buried utilities, miscellaneous debris, etc. • Demolished materials become the property of the Contractor and shall be loaded, properly transported to and disposed of at an appropriate off-site facility (i.e. demolition landfill, recycling center, etc.). Contractors are encouraged to salvage ar recycle as much of the building materials as possible. Reamov____ ai of Bituminous/Concrete Pavement Seeding of the entire excavated site with three inches of topsoil will be required by May 2009, 10% of the demo fee will be retained for guarantee and paid when the seeding is complete in the spring of 2009. Once demolition is completed, interim grading for the entire area disturbed during demolition and excavation activities will be necessary to prevent ponding of surface water. Contractor must be licensed, as necessary and is required to obtain all necessary permits, notifications, etc. • The Contractor must comply with the existing storm water pollution prevention plan for the Site. As deemed necessary by the City, the Contractor will be required to install silt fence, inlet protection, gravel entrances/exist, etc. • The Contractor will be responsible for controlling fugitive dust and minimizing noise, odors and off site tracking to the extent possible. • Excessive material must be removed from all haul trucks prior to leaving the Site. Furthermore, all haul trucks must be covered when transporting demolition debris. • In the event an unknown condition is encountered during the Project, the Contractor must notify the City immediately. The appropriate course of action will be determined and, if necessary, a change order may be authorized prior to completing the work. • The Contractor will be responsible far taking the appropriate measures (i.e. erecting and maintaining temporary fencing) to ensure that partially- demolished buildings, debris piles, excavations, etc. are appropriately secured at the end of work each day. • The contractor shall maintain the properties in a safe and neat manner. The properties and adjoining streets and right-of--ways shall be kept free of dirt and debris. All excavations shall be protected by fencing. If the contractor is negligent in these areas, the City reserves the right to perform this work with its own forces at overtime rates. The costs of such work shall be charged to the Contractor. The contractor will not be allowed to trespass on private property unless the contractor has received written permission from the private property owner. • The contractor shall be responsible far the removal, storage, and replacement of all signs, which may have to be moved during the work. The contractor shall provide barricades, fences or guardrails to protect workers and the general public from dangerous areas. The Contractor is responsible for maintaining safe operation of its personnel and equipment. Working hours shall be conducted between the hours of 7:00 a.m. and 7:00 p.m. Work shall not be conducted on weekends unless approved by the City.
