Our company is a Minnesota licensed, insured, bonded, investigative/consulting agency specializing in executive pre-employment background investigations. Our services extend beyond mere reference checking, which is particularly important if a candidate is not well known to the appointing authority. We direct our efforts towards providing our clients with prompt, detailed, accurate information so that the client can make an effective employment decision. Several of our municipal clients have found it beneficial to conduct background screening profiles on the top two or three finalist candidates so that the background information can be used to further assist them in the final appointment process. We recommend that the pre-employment background/reference investigation be conducted by an outside, licensed, experienced, confidential investigative agency. The International City/County Management Association (ICMA} and the Police Executive Research Forum (PEKE) recently endorsed this concept by stating, "although you may use your own staff to handle the background investigation, it is strongly recommended that this sensitive job be contracted to a licensed private investigator experienced in conducting police executive background inquiries. Contracting the job to a professional agency gives you more intimate control of the process, the end prodzrct cmd provides greater protection of the candidate 's privacy. " Data Interpretation Setter & Associates LLC assists clients in collecting and interpreting public and private data concerning background reference material. Many times this type of information is complex and needs to be carefully evaluated to determine content and accuracy in order to ensure its proper use. Our unique process provides that opportunity and allows the applicant to review the background data being considered in the employment process before it is presented to the appointing authority. This step further increases accuracy crud minimizes potential employment liability. Clients and applicants alike have found this unique step in our review process to be most beneficial. All background services are designed to conform to federal, state and local laws such as the Fair Credit Reporting Act (FCRA}, the Minnesota Data Practices Act, Minnesota Peace Officers Standards and Training Board IMPOST) rules and regulations and others. 3 Background Process There are different levels of background investigation and reference inquiry. Our services may include, but are not limited to, review of the applicant's application and resume for accuracy and completeness (obtaining addendum information, when necessary); first and second interviews with applicant along with the following inquiries: employment history, residence checks/updates (current and former), social security number verification, employment eligibility, professional license/complaint check, driver's license history, motor vehicle accident search, military veteran status, civil court records, lien/judgment/bankruptcy, credit history, federal/state/county/local criminal record checks, academic records, personnel tile, internal investigation/discipline records, along with select interviews with both listed and non-listed references. In those instances where a candidate already has a police Iicense in this, or another state, efforts will be made to obtain any available previous employment background investigative information. As part of our background inquiry each candidate is required to complete and have notarized a "Consent and Authorization to Conduct a Background Investigation" form. When the final background report is completed and after the applicant has had the opportunity to review the data, we will submit the report to the appointing authority and ask that a City representative and/or the City Attorney review its contents to ensure public purpose and legal format prior to the release of any information contained in the report. Background Licensing Requirements Minnesota state law states that only employers, attorneys, or private investigators are allowed to conduct pre-employment background investigations. Private investigators must be licensed, insured and bonded (as is Setter & Associates LLC), by the Minnesota Board of Private Detective/Protective Services. Persons or agencies not licensed by the State of Minnesota, who conduct such background investigations for a fee, may be in violation of Minnesota Statutes 326.338, subd. 1 and Minnesota Statutes 326.339 (gross rnisdenzea~~or). 4 MPOST Mr. Setter's extensive experience as a former chief law enforcement officer and chairman of the Minnesota. Background investigative services will be conducted at the discretion of the investigator -either on-site, in-person, by telephone, or any combination thereof, unless otherwise instructed by the client. Setter & Associates LLC will provide background investigative services at the rate of $100.00 per hour, plus related associate/clerical services which will be billed at the rate of $50.00 an hour. It is estimated that chief of police background investigative fees (per candidate) for the City of Columbia Heights (Metro area, non-travel) will range between X2,000 and $3,000. Setter & Associates LLC agrees to obtain prior approval for out-of--area travel, time and expenses. Other direct expenses such as, but not limited to, data base search fees, mileage, lodging/meals, report copying fees, etc., will be invoiced in addition to the above.
