SECTION I S TELECOMMiJNICATIONS COMMISSION
(Ordinance 1002 Effective 7/14/82)

Section 3315 (1) A Columbia Heights Telecommunications Commission is hereby established
which shall consist of seven (7) members to be organized as follows:
A. Seven (7) members shall be appointed by the Columbia Heights City Council. The
members appointed by the Columbia Heights City Council shall be residents of Columbia
Heights and shall include one (1) Columbia Heights Councilperson. A majority of
Commission members shall constitute a quorum.
B. Each member of the Commission shall serve a term of two (2) years except that the
Columbia Heights Councilperson shall serve at the pleasure of the Council.
C. The Assistant to the City Manager, or a person designated by him/her shall be an ex-
officio member of the Commission.
D. If a seat on the Commission becomes vacant before the term of said seat has expired, it
shall be filled by appointment by the City Council.
E. The Commission shall elect a chairperson from among its membership.
F. The Commission shall establish a monthly meeting date and conduct business of the
Commission as prescribed hereinafter. A meeting agenda shall be sent to Commission
members at least two days prior to the meeting date.
3.315 (2) The Commission shall serve in an advisory capacity to the Council and the
administrative service of the City. The duties and responsibilities of the Commission shall be as
follows:
A. Study, investigate and make written recommendations to the City Council on all matters
pertaining to the provision of telecommunication services within the City on its own
initiative or as referred to the Commission by the Council or administrative service of the
City. This shall include, but not be limited to, the following matters:
(1) Additional services which could be furnished by the telecommunication service
providers.
(2) Rate adjustments.
(3) Actions of a provider which may be grounds for revocation of its franchise,
permit, license, or other right to do business in the City.
(4) Provider's performance regarding subscriber complaints and interruption of
service.
(5) Operation and use of access channels.
(6) Renewal or extension of the franchise, permit, license, or other right to do
business in the City.
(7) Channel, spectrum, or capacity allocation and programming.
(8) Compliance of provider with terms and conditions of the franchise, permit,
license, or right to do business in the City.
(9) Possible sanctions against the Provider.
B. Prepare and submit an annual report to the City assessing the Grantee's performance
according to the terms of the Cable Television Franchise and make written
recommendations to the City.
C. Three months prior to the fifth year of operation and every five years thereafter, the
Commission shall submit a report to the City, which report shall include a written
appraisal of the performance of the Grantee over the entire length of the cable franchise
with regard to the provisions of the cable franchise. The report shall include
recommendations for revised or additional provisions of the franchise, considering at
least the following items: channel capacity, channels for access, cable casting; facilities
and staff assistance available for access cable casting; two way capability, and the need
for further service to be extended within the franchise area based upon a reassessment of
the communication needs of the City in relation to the services generally offered by the
cable industry.

OLD BUSINESS
A. Channel Check
Channels 2-6 and 16 were fuzzy. However, it was noted that earlier in the day they were fine.
B. Correspondence Log and Complaint Follow Up.
#145-Hurley-Complained about a large price increase for her programming choices, as well as being
limited to two converter boxes. Kathi Donnelly-Cohen sent her a letter explaining that she should choose a
programming package that best suits her needs, as she is paying for several premium channels on an ala
carte basis at the present time. This is a costly way of subscribing to services. She also recently added
High Speed Data Service which increased the cost. Converters for digital services are being limited to two
per household due to the High demand for this newly offered service. Additional converters should be
available shortly for those who wish to have them. Kathi enclosed a copy of her account ledger and also a
price list for the packages currently available. Ms. Hurley will need to contact AT & T Broadband with
her choices. So far she hasn't contacted AT & T Broadband to make any changes.
#146-George Marko-Called to get his service re-installed on Apri12"~. He was told it would be April 11'h
before it could be done. He thought this was an unreasonable length of time. Kathi Donnelly-Cohen
reported that his re-install was completed on April 9°i ~ however, the customer was not home at the time.
C. Franchise Fee Analysis Update
AT & T has submitted their response regarding the findings of the Analysis done. Ashpaugh and Sculco
has since then responded to them again, reiterating the fact that they owe money to Maplewood based on
the findings in the report. Maplewood is considering how to proceed from here and if they will pursue the
amount the report says is due them. Other cities have expressed their support of Maplewood and may also
pursue compensation based on the way the franchise fees were figured.

D. Status of Wide Open West Franchise
Steve Guzzetta reported that he spoke with a representative from Wide Open West about
three weeks ago. They are formally withdrawing their application and have requested the
balance of their deposit be returned to them. There is about %z of the original amount
remaining, and this refund is being processed.
E. Status of Everest Connection Corp. Franchise
Notice was received from Utilicorp Communications Services, the major investor in
Everest Connections Corporation, stating they would be postponing expansion in the
Minneapolis/St. Paul area. The test for their business model is taking place in the Kansas
City Metropolitan Area. This will give them concrete evidence that their business model is
viable and that they would be able to fulfill contractual obligations if they decide to expand
to other areas. The City will be refunding whatever amount is left to them also and if they
choose to proceed at a later time, they will need to re-apply.
F. Other Old Business
There was no other old business.
NEW BUSINESS
A. Receipt of the Annual Report for 2000
The Annual Report was received and enclosed in the agenda packets. Linda stated she had
been in contact with Kathi Donnelly-Cohen regarding the letter from AT & T Broadband's
Controller stating what the revenues of the company were. Last year a letter from an
auditor verified these figures. She felt that an auditor should verify the figures listed for
2000 also.
Steve Guzzetta noted that Form 395 (EEO Report) referred to Exhibit B that was not there.
The Subscriber Contract is illegible and the community television guidelines need
proofing. Linda Magee recommended tabling the acceptance of the Annual Report until
these items are addressed and the Revenue amounts are verified by an Auditor.
B. Notice of Rate Increase Effective July 1, 2001.
Notice was received February 16, 2001 regarding price increases effective Julyl, 2001.
This price increase is to Basic Service, equipment, and installation rates. The City will
need to review and approve the 1240 and 1205 rate filings. The review will be done in
conjunction with other cities as has been done in the past.
Bruce Nawrocki expressed his opinion that since this industry was de-regulated, he feels it
has given the cable companies a license to steal, so to speak. He feels subscribers are
being overcharged and all the price increases are notjustified.

C. Conversion of Billing System to CSG/Billing Format Changes
AT & T Broadband is converting their billing system to another program that will simplify
the bills and make it easier for tracking and assigning work orders for each subscriber. An
explanation of the new format will be enclosed with the next billing. The franchising
authority's phone number on the bills will also be system specific, which will help
subscribers reach the proper person if they have concerns.
D. Resignation of Public Access Employee
We were informed that Edward Harris has resigned his position with AT & T Broadband.
He was one of the two technicians assigned to the Columbia Heights Studio to help us with
local origination programming. Linda Magee questioned the status of his replacement.
Kathi Donnelly-Cohen reported they will be offering his position to someone they have in
mind shortly.
E. Other New Business
Reuben stated that since NASA programming is easy to insert, and Channe196 is a
duplication of BRAVO, it should be inserted there. Kathi Donnelly-Cohen responded that
Channe196 is a digital channel and not really reserved for BRAVO programming, so it will
not be inserted there. She again reiterated that NASA programming could be inserted on
an access channel out of Roseville if that is the Commission's desire.
Steve Guzzetta reported there was a meeting of the Cable Administrators a week ago and
that they discussed customer service standards. The group is concerned that AT & T has
not been meeting the customer service standards as required. This issue needs to be looked
at closer.
Dennis invited anyone interested to attend the Mayor's Prayer Breakfast on May 15°i.
Anyone wishing to attend should contact either Linda Magee or Carole Blowers.
There was a short discussion regarding Channe195. Chatme195 is being utilized as a
security channel for apartment buildings that wish to have their security cameras connected
to for their video feed. There is an initial charge for the filter to allow this service.

B. Report of AT & T Broadband-
A discussion took place regarding the automated phone answering system AT & T
Broadband is using. There was a question regarding whether or not you can "0"out to a
customer service representative, and the length of time it takes to do so.

C. Report of the Cable Attorney
Steve Guzzetta stated there is a rumor that if AT & T divests itself of some of its
businesses, the cable services portion may be bought by another large entity such as
Comcast.
A Press Release was received April 17°i regarding a lawsuit by a city in Pennsylvania that
was suing AT & T and Comcast. Comcast transferred its franchise to AT & T after the
City said no to such a transfer. The City doesn't trust either company after this move and
has asked that a trustee be appointed while they are going through the franchising renewal
process.
Steve reported on a Santa Cruz, California case. Many of the decisions regarding this case
were bad for franchising authorities. Some of the findings indicated that the 394 Form
must be found incorrect within 30 days, and if a 5% franchise fee is charged, then the
franchising authority cannot charge the cable company with the transfer fee expenses.
However, he pointed out that the judge determined that the franchising authority may look
at more than just the legal, technical, and financial qualifications of the company.
Although the findings of this lawsuit are not applicable here, the case could be cited during
future franchise renewals, especially if federal law was the basis for the judge's decision.
The Kelly bill and the Administrative bill are both dead in this legislative session.

Linda Magee at the City of Columbia Heights Contacted me regarding questions you had on the
cable service. 1 tried to call you today and your mother informed me that you would not be
available to talk until 8:00 pm, I, unfortunately, will not be able to call you at that time. I did
speak with both your mother and father and was able to get a little information about what you are
experiencing. 1 thought a letter with some supporting information might assist you.
Your father recalls having Showtime, The Move Channel, Cinemax and HBO in the previous
package. If this was called The Gold Star package, then this is one that we actually eliminated in
1998. You could not buy the package after that date. We "grandfathered" in those subscribers
with a letter that stated Ihat we were no longer offering the service and that a change would have
to be made some time in the future. Over the past two and a halt years, we have tried to
telemarket those subscribers and move them into packages that we currently offer. We tried to
be careful and let subscribers know that if they did not like the new package, they could change
but the ofd package would not be available. However, if you previously had Showtime, The
Movie Channel, Cinemax and HBO, these services are still packaged with Starz! and Encore for
$27.95. The package is called Premium Preferred. With 3 converters ($2.66 X 3) and 3 remotes
($.47 X 3), plus Basic 1 and 2 ($33.08), and the Broadband Monthly guide, the monthly rate
would be $73.07 without taxes, franchise fees and PEG fees.
It appears that you changed to the Gold Olgltal package for $66.99. That is less than the current
price for the Premium Preferred but not cheaper than what you may have been paying for the old
Gold Star package. But as you had to make some change, it did offer many more channels than
what you currently had. The Digital Gold includes the Basic 1 and 2 you have plus 12 basic
digital channels, choice of 2 digital packs (i0-13 channels each), 4 versions of Encore, 3 versions
of Starz!, 36 music channels, access to 39 pay-per-view channels, one digital converter and
special remote. 1f you added another digital converter and remote, that would be $7.95
additional.
Your dad said that he believed he has been changed to Digital Bronze. That would include the
Basic 1 and 2, digital basic (12 channels) 4 versions of Encore, one digital converter and remote,
36 music channels and access to 39 pay-per-view channels for $41.99 plus taxes and fees.
However, it looks like you have the Digital Silver, which adds to the Bronze an additional choice
of a digital bonus tier, 3 versions of Starz! and a choice of one premium service for $56.99 plus
taxes and fees. He said that you still have the 2 additional analog converters and remotes as
well.
There will be a few changes that wilt occur in July, The price of the analog converters will change
from $2.66 to $3.80 and the remotes will go from $.47 to $.35 each. Also the Digital Gold
package will INCLUDE two converters and remotes, so if you currently have the Gold package
and pay $7.95 for the additional converter, we can lower that by $7.95 come July 1. I have
enclosed a grid That lists the contents of each of the packages. You can certainly go back to an

analog package if you wish. I just want to make sure that you have the channels you want and in
a price range that you are comfortable with. Please look through this information and you can
either contact someone in customer service to assist you or you can call me. f am unable to
actually set up a service call but I can coordinate one if necessary. Either way I will be happy to

E. SELLING OF PROGRAMS: THE PRODUCER IS RESPONSIBLE FOR
REIMBURSING AT&T Broadband /COMMUNITY Tv15;COLUMBIA HTS.
FOR THE ACTUAL PRODUCTION COSTS, FOR ANY PROGRAMS OR
SECTIONS OF PROGRAMS PRODUCED WITH AT&T Broadband
EQUIPMENT THAT ARE SOLD. PRODUCTION COSTS ARE
THE DETERMINATION OF AT&T Broadband AT THE TIME OF THE
PRODUCTION.
F. UPON DETERMINATION BY THE STUDIO COORDINATORS THAT
PROGRAM SUBJECT MATERIAL OFFERED BY AN ACCESS
USER/PRODUCER MAY OFFEND SOME VIEWERS AND MAY NOT BE
APPROPRIATE FOR YOUNG VIEWERS DUE TO MATURE CONTENT, THE
FOLLOWING ANNOUNCEMENT MAY PRECEDE AND/OR APPEAR DURING
BREAKS IN CABLECAST OF THAT PROGRAM:
"The following program is considered to be of mature theme and
therefore may be considered to offensive to viewers. Viewer/parental
discretion is recommended."
G. IN THE EVENT OF POOR TECHNICAL QUALITY THAT IS NOT SEVERE
ENOUGH TO RESULT IN THE PREVENTION OF CABLE BUT MAY CAUSE
VIEWER CONCERN, THE FOLLOWING ANNOUNCEMENT MIGHT BE SHOW
PRIOR TO THE PROGRAM WITH ADDITIONAL INFORMATION AS TO
THE SPECIFIC PROBLEM DURING BREAKS IN THE PROGRAM:
"The viewer may find the technical quality of some portions of the
following program unsatisfactory."
4. STORAGE: ANY PROPS; SETS, COSTUMES, ETC., STORED BY AT&T Broadband
MAY BE USED IN ANY ACCESS PRODUCTION. OWNERSHIP OF
FORMENTIONED WILL REMAIN WITH ORIGINAL OWNER. COPYRIGHTED
TIMES, LOGOS & ORGANIZATION SYMBOLS OR EMBLEMS MAY NOT BE USED

MANNER.
i. PERFORMING UNAUTHORIZED REPAIR ON THE

k. RETURNING EQUIPMENT NOT IN THE PRESENCE OF THE

6. REGULATION OF GUIDELINES:

Congratulations! I am pleased to inform you that you have been chosen to serve on the Columbia
Heights Telecommunications Commission. The City Council requests that you attend the next
regular City Council meeting on Tuesday, May 29, at approximately 7:00 p.m., in the Council
Chambers, so you may be introduced to the public.
The Telecommunication Commission studies, investigates, and makes written recommendations
on all matters pertaining to the provision of telecommunications services within the City. The
commission oversees the administration of the cable television franchise, which includes rate
regulation activities, franchise renewals, transfers of ownership, enforcement of customer service
standards and ensuring compliance of the cable company with the terms and conditions of the
franchise. The City Council realizes the immense changes happening in this "electronic age" and
hope that, through the direction of the Telecommunications Commission, the City can make
intelligent decisions that will benefit everyone on our community. We feel your expertise and
insight would be a definite asset to this Commission.
You will officially begin serving this vacant position at the next regularly scheduled meeting of
June 21, 2001. This Commission meets the third Thursday of each month at 7:00 p.m. in City Hall
Conference Room # 1. The vacant two year term that you are filling will expire in April of 2003. If

In our continuing efforts to provide you with important and timely information, I want
to tell you about some upcoming price changes that will be affecting local cable
customers.
Effective with June 2001 billing statements, the monthly price for AT&T's two-way
RoadRunner high-speed cable Internet service will increase by $6.00. Therefore, the new
monthly price will be:
RoadRunner Service (including modem lease) $45.95
The price for customers with one-way RoadRunner service and the price for customers
who do not also subscribe to either Standard Cable video service or Digital Telephone
Service will not be changing. Notice to customers is being provided via legal notice
placed in the Icoa! ne~•vspaper. We ~.re a!so sending a :supplemental e••maii message and
a message on billing s#afements directly to current two-way RoadRunner customers.

package will be discounted correspondingly so that the customer will not receive any net
increase. Customers will be notified of 4he Basic 1 Service and equipment price changes
via a bill insert with June billing statements.
For customers receiving service through commercial accounts, bulk rate
arrangements with multiple dwelling owners, or similar arrangements, some of the
product, pricing and other information contained herein may not apply. Where such are
inconsistent with the information in this pricing structure, the terms and conditions of such
separate arrangements will apply.
Finally, effective June 1, 2001, we will be changing the pricing structure for our
digital services by introducing our Digital Value Packages. These new packages are
designed to provide a uniform pricing and packaging structure for our current an future
digital cable customers. Beginning June 1, all of our digital packages will include the basic
and expanded basic tiers that are part of our Standard Cable offering, and we will no
longer offer the old digital packages. All Digital Value Package prices will be inclusive of
Standard Cable service. The new Digital Value Package Prices will be as follows: Digital
Bronze package - $41.99; Digital Silver Package - $56.99; Digital Gold package - $66.99;
and Digital Platinum package - $81.99. Please see the enclosed sheet for more detail. As
a courtesy to our current digital customers, their existing package will remain unchanged
at this time. However, current digital customers will not be able to move from one old
digital package to another old digital package. They do have the option to subscribe to a
new Digital Value Package.

I am writing to update you on some changes that are happening to our cable Internet services.
As you may recall, as part of the FCC obligations with the merger, AT&T Broadband was required
to sever its ties to RoadRunner. On June 3, 2001, the AT&T RoadRunner home page content will
change from RoadRunner to Excite(rJHome. The new content will allow subscribers to customize
their individual home page with the services they are most interested in. Subscribers will have
access to key service features like games, Internet radio and movie trailers. They can track their
individual investments, sports scores of favorite teams, etc.
While the page will automatically change on June 3, subscribers will receive an e-mail from AT&T
Broadband advising them of this change as well as a letter mailed to their home. Both will
contain step by step ihstructions on how to set up their personal choices. Samples of this
correspondence are attached for your reference. This change will not affect the e-mail or personal
web space that customers may have set up. If subscribers would like more information, they are
directed to contact us at http://help.broadband.attcom/support.
Effective June 3 as well, we are consolidating the technical services center for Internet support.
On that date, both the Tier 1 and Tier 2 support for our customers will move to Convergis. This
group is highly trained and dedicated to computer and Internet technology.
We believe that this changes will provide the best of the Internet by providing the great AT&T
Broadband infrastructure and the content of ExciteCr~Home along with the experienced support of
the Convergis group. If you have any questions regarding this change, please feel free to
