The meeting was called to order at 7:05 p.m. by Dennis Sh•oik, Chairperson,

OLll BUSINESS
A. Channel Check
Channels 31 & 55 had low volume and Channel 58 was slow to sink in. Kathi will check on this.
B. Correspondence Log and Complaint Follow Up.
#147-Klimek-Complained about poor reception of4-5-9 & 11. When she called for an appointment, she
was told it would be two weeks before service could be done. She thought that was an excessive delay.
Kathi Donnelly-Cohen said due to the CSG conversion, the service schedule looked full. The Cable Co.
sent a tech out on April 30°i to remedy the problem.
#148-Meinhu•dt-He is being billed for a converter box and doesn't have one. His bill is to be corrected.
#149-Egli-Neighbors temporary cable wire is laying on the ground in her yard. The line was moved out of
her way until it can be installed permanently.
#150-Solem-Complained about new price he is paying for digital package that he changed to after a
telemarketer called him. Kathi sent him a letter explaining the packages and prices for digital service, so
he could decide which one he wants, He disagreed with the letter and left Kathi several messages. She
researched his account and found that he has changed his programming package three times in the last 2
months, and therefore his billing is very difficult to understand. Tae had an $82 balance on his account,
which she credited in full. Slte sent him another letter and explained this, and again asked him to decide on
the programming package he really wants. She will report back at the next meeting.
Brad Peterson questioned the procedure when dispatching a service tech to a call and the fact they don't
receive notification of cancellations. He had a call scheduled, called in the morning to cancel, and the
service tech still came out. Kathi explained the procedure followed in routing and scheduling the service
techs. It is hard to cancel calls, once printed, as there are many sub contracted techs doing work in addition
to those on staff.
C Franchise Pee Analysis Update
Steve Guzzetta reported the Ramsey-Washington Cornntission will discuss this issue at their next meeting.
Mr. Seykora from AT & T Broadband attended their June meeting and provided some additional
information to the commission for their consideration. They will review the information and discuss it at
their next meeting.

D. 2000 Amoral Report-Remaining Outstanding Items
*The Guidelines for Community Television Chaimel 15 Equipment/Facilities were re-
submitted.
*The attaclunents for Form 395 were provided.
*The financial statements with verification by an accountant required an audit to be
performed. This is being done and as soon as the new financial information is ready, it will
be forwarded to the City.
The acceptance of the Annual Report is tabled until all the items have been submitted.
E. Ocher Old Business
Kathi reported that they had made air offer to someone for the Access Studio position to
replace Eddie Harris. The person at first accepted the position, then later declined the
position due to another position he accepted in production. The position has been re-
posted.
NEW BUSINESS
A. Receipt of the ls` Quarter Franchise Fees
The ls' Quarter Franchise Fee payment of $31,655.30 was received and a copy of such was
enclosed in the agenda packet.
B. Notice of Rate Increase Effective June 1, 2001 for Road Ruimer Service.
Notice was received May 1, 2001 regarding a price increase effective June 1, 2001 for two
way Road Rumrer Service. The price for this service will be increased $6.00 resulting in a
cost of $45.95/month. As a reminder, the price for Basic Service, equipment, and
installation will also be increased effective July 1st. The City will need to review and
approve the 1240 and 1205 rate filings, The review will be done in conjunction with other
cities as has been done in the past.
David Mahoney reported his Internet access was not accessible tonight. Kathi will check
on the reason for this.
C. Changes to AT & T Roadnumer Service
A letter was received May 24'" regarding changes that will be made to the cable Internet
services. As part of the FCC obligations with the merger, AT & T Broadband was required
to sever its ties to RoadRunner. On June 3, 2001, At & T RoadRunner home page content
will change from RoadRimner to Excitena Homo. The new content will allow subscribers
to customize their individual home page with the services they are most interested in.
Effective June 3`d, the technical services were also consolidated for Internof support. Tier 1
and Tier 2 support for customers will move to Convergis,
D. Notice of Price Change for Converter Boxes
Prices for converter boxes will be $3.80/month effective July 1, 2001. This amount is still
lower than the maximum permitted rate of $6.62 calculated on FCC Form 1205.

E. Review of Request from ISD #13 for Funding ofHardwar•e and Software for Video
Production Class
Jean Kuelm had called Kathy Kelly to request her attendance at our meeting, but was
unable to reach her. Jean was unfamiliar with some of the items requested and would like
more information before bringing this request before the City Manager and the Council.
The commission members discussed the items being requested and thought the items
looked like a package to upgrade their present equipment. They questioned whether these
specific items were needed or if other alternatives would also work, and if price
comparisons were obtained. The commission members concurred they would like to
consider this request, but needed more information. Demris will try and contact her and
ask her to attend our next meeting.
F. Other New Business
Reuben Ruen questioned the duties of the Telecommunications Commission and felt the
duties needed to be better defined. He had particular concerns due to the recent purchase
of a wireless data system that is to be used by Parkview Villa and the Liquor Stores to
incorporate them into our network. This item was authorized to be purchased without airy
input from the Telecommunications Conunission. He thought that was a mistake. He was
not upset that the Council purchased such a package, but that they did so uninformed. He
has concerns regarding the fact this system operates without a license and may be subject
to future interference if someone decides to use the same frequency. He also questioned
privacy/security of the data that may be transmitted. A discussion took place on the best
way to ensure that the Administrative Staff and City Council members are better informed
before making these types of decisions. It was decided to have the commission members
review the duties of the commission, make recommended changes, and then to discuss
these changes with the city council and staff at a work session.

The reports from May were enclosed in the agenda packets. New reports will be drafted
due to the conversion to the new system. AT & T representatives are meeting with Tom
Creighton to establish what information is wanted and useful to the various cities.
C. Report of the Cable Attorney
*Columbia Heights is iii a coalition of cities to review the 1240 and 1205 forms for the rate
increase that will take effect July 1, 2001. Al] forms acid orders issued during the last 4-5
years will be reviewed during this process to ensure that they have been correctly
submitted.

*Steve Guzzetta reported he has not had any further communications with Everest Corp.
regarding their request to postpone their application for a fi~auchise. He has advised all
cities to terminate the application and to refund any remaining funds. Everest can then re-
submit their request when, and if, they decide to proceed.
*Steve Guzzetta updated commission members on a case that was decided in the
Washington DC regarding the construction of a Tower for High Definition TV
Transmission. The District ordered the construction to be stopped due to height and
location issues. The courts ruled in favor of the District as the tower was for TV
transmission, not personal wireless communications. Under federal law, goverrunent
jurisdictions camiot prohibit the construction of towers used for personal wireless
communication needs. However, construction oftowers/antennas can be restricted by
cities depending on the use of the tower.
*Steve also reported that Section 253 of the Communications Act, which states that no one
can prohibit any entity from providing cable services, was challenged in the state of
Virginia. A private cable company filed the litigation because they felt a city shouldn't
provide cable services in direct competition with a private company. The FCC ruled that
cities are an entity and can provide cable services if they choose.
*The federal law has upheld a City's right to manage the use of their right of ways and to
charge a fair and reasonable fee to do so.
D. Report of the Assistant to the City Manager

Dear Mr. Solem:

I received your phone messages. While I understand your concerns, I had hoped that I had sent
along some information that would assist you. I will enclose the ledger of your account so that we
are both clear on ~n.~hat services you had and what services you currently subscribe to. You have
made a number of changes and the account ledger will show numerous pro-rates from when a
service was added and then dropped. I will try and explain each change. Due to our change
over from Cable Data to CSG, the ledgers look very different. I can see what appears to be a
charge for the On-Screen-Program guide (OSPG) at $4.95. This was originally in the Gold Star
package. You may have ordered this a la Carte. If not, then it was an over charge. There also
seems to be an error in charging for The Movie Channel during a period when many changes
were happening on the account. From my perspective, it appears to be much easier to just credit
your account for the current balance duo and start fresh. That means you do have to decide what
level of service you want based on the information I am providing to you. Please understand that
since the Gold Star packages no longer exist, the only way to offer you similar services would be
on an a la Carte basis and it would be very costly. The important message I must deliver is that
the package you had previously, Gold Star 4, does not exist and I cannot recreate an identical
package like that for you. Had you not accepted the telemarketing offer, you still would have lost
the Gold Star package on March 31.
Meredith Cable marketed the Gold Star packages. After the merger with King Vidoo and
Continental, the name changed to first MediaOne and then AT&T Broadband. Each of these three
companies had different rates, line ups and premium package offers. We needed to merge them
to a single set of services and prices. We notified subscribers to the Gold Star packages in June
of 1998 that the package would no longer be offered and that we would be contacting them about
future options. Before you received a letter that would have notified you that you were to be
automatically moved to a different package unless you made a change by the end of February,
you were telemarketed by the group promoting the Digital service. If you had declined that offer,
you would have received the letter and on March 31, all Goid Star services were gone.
I will not try and defend anything that was stated by the telemarketer, as I was not part of that
conversation. But I can explain what the offer was and that you may have misunderstood. By
subscribing to the Digital Gold service, you were offered the first two months at 50% of the rate of
the Digital Gold service. The digital service was priced separately from Basic 1 and 2, at $32.50.
price would be $16.25 a month compared to $19.95 for the Gold Star service. (These are now
sold as a package with Basic 1 and 2 for $66.99) For the first two months, it should have been
less expensive than your current service, with many more channels, overall, than you were
receiving. However, the promotional adjustment (but only $14.95) was placed on the account on
4/17, after the bill went out. That means you did not see the discount and the bill would have
been greater than you were quoted.
A change was then made on the account from the Digital Gold to Premium Select 4/30 and then
another to Digital Silver in June. Our records indicate that you currently have Digital Silver at

$56.99 plus 2 analog converters and remotes. (Your dad mentioned that he thought you had
Digital Bronze?) Your bill, without any fees or taxes, would be $63.25. ($72.24 if I calculated out
the taxes correctly) If I credit out the entire balance on your bill, is this the level of service that you
wish to retain? I will credit the account today and will not make any changes on your account
until I hear from you. You can leave me a voice mail message at your convenience.
As we continue to add more channels, we will be moving more and more to the Digital tiers. If
you pick an analog tier now, I can make no guarantees as to how long they will remain available
on the analog level.
I would encourage you to review the enclosed price sheets and determine what level of service
best meets your needs -whether that is a Digital package or an analog package. Unfortunately I
cannot create a package for you like the old Gold Star unless you take the premium services on
an a la Carte basis. That, however, would be very costly. Showtime 2 was taken off the analog
level sometime ago and is only available in a Digital package.

SECTION 15 TELECOMMiJNICATIONS COMMISSION
(Ordinance 1002 Effective 7/14/82)
(As amended by Ordinance 1307 Effective 10/11/95)
(As amended by Ordinance 1325 Effective 7/10/96)
Section 3.315 (1) A Columbia Heights Telecommunications Commission is hereby established
which shall consist of seven (7) members to be organized as follows:
A. Seven (7) members shall be appointed by the Columbia Heights City Council. The
members appointed by the Columbia Heights City Council shall be residents of Columbia
Heights and shall include one (1) Columbia Heights Councilperson. A majority of
Commission members shall constitute a quorum.
B. Each member of the Commission shall serve a term of two (2) years except that the
Columbia Heights Councilperson shall serve at the pleasure of the Council.
C. The Assistant to the City Manager, or a person designated by him/her shall be an ex-
officio member of the Commission.
D. If a seat on the Commission becomes vacant before the term of said seat has expired, it
shall be filled by appointment by the City Council.
E. The Commission shall elect a chairperson from among its membership.
F. The Commission shall establish a monthly meeting date and conduct business of the
Commission as prescribed hereinafter. A meeting agenda shall be sent to Commission
members at least two days prior to the meeting date.
3.315 (2) The Commission shall serve in an advisory capacity to the Council and the
administrative service of the City. The duties and responsibilities of the Commission shall be as
follows:
A. Study, investigate and make written recommendations to the City Council on all matters
pertaining to the provision of telecommunication services within the City on its own
initiative or as referred to the Commission by the Council or administrative service of the
City. This shall include, but not be limited to, the following matters:
(1) Additional services which could be furnished by the telecommunication service
providers.
(2) Rate adjustments.
(3) Actions of a provider which maybe grounds for revocation of its franchise,
permit, license, or other right to do business in the City.
(4) Provider's performance regazding subscriber complaints and interruption of
service.
(5) Operation and use of access channels.
(6) Renewal or extension of the franchise, permit, license, or other right to do
business in the City.
(7) Channel, spectrum, or capacity allocation and programming.
(8) Compliance of provider with terms and conditions of the franchise, permit,
license, or right to do business in the City.
(9) Possible sanctions against the Provider.
B. Prepare and submit an annual report to the City assessing the Grantee's performance
according to the terms of the Cable Television Franchise and make written
recommendations to the City.
C. Three months prior to the fifth year of operation and every five years thereafter, the
Commission shall submit a report to the City, which report shall include a written
appraisal of the performance of the Grantee over the entire length of the cable franchise
with regard to the provisions of the cable franchise. The report shall include
recommendations for revised or additional provisions of the franchise, considering at
least the following items: channel capacity, channels for access, cable casting; facilities
and staff assistance available for access cable casting; two way capability, and the need
for further service to be extended within the franchise area based upon a reassessment of
the communication needs of the City in relation to the services generally offered by the
cable industry.
